MINUTES
The Regular Bi-MonthJy Meeting of the Andover City Council was called to order by Mayor Jack
McKelvey, October 3, 2000,7:02 p.m., at the Andover City Hall, 1685 Crosstown Boulevard NW,
Andover, Minnesota,
Councilmembers present: Tony Howard, Mike Knight, Ken Orttel
Councilmember absent: Don Jacobson

Carroll Abbott. 2917 142nd Lane - was glad to see Dave Carlberg appointed Acting Administrator.
He stated No Parking signs have been placed along Heather by the park that read No Parking
between April 1 to July 1. One sign gives no date in July. He felt it should say between April 1 and
July 31, as most teams play in the month of July. Mayor McKelvey felt the date should read to
August 31. Mr. Erickson stated he will look into the matter.

DOMESTIC VIOLENCE AWARENESS MONTH PROCLAMATION
Mayor McKelvey read the proclamation declaring October of2000 as Domestic Violence Awareness
Month.
PUBLIC HEARING: VACATION OF EASEMENT/14434 BLUEBIRD STREET/DAHLER
Mr. Carlberg reviewed the application of Jennifer and Patrick Dahler to vacate a portion of drainage
and utility easement along the north area of the property. The area is outside the 100-year flood
elevation. Staff is recommending approval. He also reviewed photos of the area in question. Mayor
McKelvey opened the hearing for public testimony. There was none.
Motion by Knight, Seconded by Howard, to close the public hearing. Motion carried on a 4- Yes,
I-Absent (Jacobson) vote. 7: 17 p.m.
Motion by Knight, Seconded by Orttel, the Resolution granting the vacation of easement as
presented. (Resolution R228-00) Motion carried on a4-Yes, I-Absent (Jacobson) vote.
CONSIDER BRIMEYER GROUP, lNC., CONTRACT
Mr. Dickinson explained the proposed contract from the Brimeyer Group, Inc., outlines the entire
phase process as described at the workshop. He pointed out that if the City goes through the entire
recruitment process and the chosen applicant does not stay in the position for 18 months, the City
will need to go through the entire process again at no charge. The contract is a flat fee of$16,000
which includes everything except some outside expenses. The maximum expenses should not
exceed $3,000, though he didn't think it would be that much.

There was some discussion on the last paragraph relating to payments made ifthe City decides to
terminate the agreement. The payments are to be one-third of the fee paid upon signing the
agreement, one-third after presentation of the Progress Report and the balance after the search has
been successfully completed. Attorney Hawkins stated if the City terminates the contract, it should
not owe any more than what it has owed to that point. While the agreement can be read to that
effect, he said he would clarifY it further that the only obligation the City will have is to make the
payment due to that point.
Motion by Orttel, Seconded by Knight, that the Council enter into the contract with the Brimeyer
Group, Inc., for assistance in the selection of a new City Administrator, subject to correction and the
final approval by the City Attorney. Motion carried on a 4- Yes, I-Absent (Jacobson) vote.
RESCHEDULE NOVEMBER 7 COUNCIL MEETING
Motion by Knight, Seconded by Howard, to reschedule the November 7 meeting to Thursday,
November 9 at 7:00 p.m. Motion carried on a 4-Yes, I-Absent (Jacobson) vote.
SET MEETING DATE/BUDGET WORKSHOP
Motion by Howard, Seconded by Orttel, to schedule Tuesday, October 24, 7 p.m. for a budget
workshop. Motion carried on a 4- Yes, I-Absent (Jacobson) vote.
SCHEDULE SPECIAL MEETING/CANVASS ELECTION RESULTS
No special meeting was scheduled, as it will be done at the regular Council meeting to be held on
Thursday, November 9.
SCHEDULE EDA MEETING
The Council scheduled an Economic Development Authority meeting for Tuesday, October 10, 8
p.m., following the special meeting with the Planning and Zoning Commission.

Deer hunting - Councilmember Orttel stated he is still hearing about the prohibition on deer hunting
south of l61st Avenue. Apparently the change made in the definition of family did not include the

spouses of children. He didn't feel that was the intent, thinking in-laws and siblings should be
considered. There is also a group of people east of Crosstown who are asking the area be allowed
for hunting because it is still basically rural. Mr. Carlberg stated the item of who should be allowed
to get hunting pennits for areas south of 161 st could be brought back to the Council at the next
meeting for consideration. Any change in the boundary, however, probably would not take affect
until next year.
Ballfields at the new Senior High - Mayor McKelvey asked that research be done on what it will take
to remove the Ag Preserve designation for the property west of the new high school so the ball fields
can be constructed on them. Attorney Hawkins stated he will look at the procedure and whether or
not there is an acreage limitation on the amount of land that can be removed for public need.
October 12 Metropolitan Council Operations town meeting - Mr. Carlberg asked if the Council
wanted to speak at that meeting or should he represent the City. He also asked for clarification on
what should be said at that meeting. The Council had a concern that comments made at that meeting
would not jeopardize the City's Comprehensive Plan negotiations. The Council agreed to schedule
that evening as a special meeting and agreed to discuss the issues to be raised at the special meeting
on October 10.
Motion by Orttel, Seconded by Knight, to set October 12, 7:30 p.m., at the Anoka County Board
Room as a City of Andover Council meeting. Motion carried on a 4- Yes, I-Absent (Jacobson) vote.
