Special City Council Meeting - April 24, 2000
The Special Meeting of the Andover City Council was called to order by Mayor Jack
McKelvey, Apri124, 2000, 6:00 p.m., at the Andover City Hall, 1685 Crosstown
Boulevard NW, Andover, Minnesota.
Councilmembers present: Mike Knight, Don Jacobson, Julie Johnson
Councilmembers absent: Ken Orttel

BUS TOUR
The Andover City Council, from 6-7 p.m., took a bus tour of various projects in the city.
DISCUSS SOIL BORINGS/ANDOVER BOULEVARD
Todd Blank with Short, Elliott, HendricksonJ, Inc., summarized the work that has been
done and what has been found so far on 149 and farther south. He stated there were 23
soil borings done by the school district on the proposed high school site. The city
contacted separately to do another 12 to get an idea what the soil is like closer to Round
Lake Boulevard. This will help them make a better decision when the time comes. Of
the 35 borings, 13 borings did have some type of peat or muck in them. These types of
soils need to be taken out before a road can be built. The depth range is from one foot to
11 feet down.
Mr. Blank stated there is a thinner area on the northern portion and a longer and thicker
portion on the southern part of the Eveland property. Consequently, it would be more of
a challenge and more expensive to build a road on the southern portion.
There was further discussion on the locations where the borings were done. A resident
voiced her concern and questioned the variations of the aerial on the boring number nine
location and other sites. Mr. Blank replied that this area probably had some surface
vegetation that was still out there at the time of the aerial photograph.
Scott Erickson stated they are not looking for a commitment tonight as to where the road
will go. At this point, they are going over the information and fme-tuning routes. As
things progress, the next phase will be to explore it in more detail.
A member of the audience asked about the time rrame for State Aid money. There was
more discussion regarding the watershed, Corp of Engineers' policy on floodplain
boundaries, the impact on farmland, dewatering, etc.

Mr. Blank stated the road would probably be better located to the north.
Mayor McKelvey asked Don Eveland where he is proposing to build two homes. Dave
Carlberg proceeded to pass out maps with two red dots indicating the potential locations
of the homes.
There was further discussion on the location of the school building and a road coming off
of Coon Creek Drive. Mayor McKelvey asked members of the Knoll family if there was
a route that would least impact them. They stated the southern route would be the best.
Ken Slyzuk preferred the southern route also.
Scott Erickson was asked his engineering opinion. He stated they would need to talk to
the Anoka County Highway Department on what needs to be addressed. He would work
with SEH on putting numbers together for an estimate. Presently they are looking at the
intersection of Crosstown Boulevard and Andover Boulevard. ' Councilmember Knight
asked who would be responsible for that intersection. Mr. Erickson stated it would be a
catch 22. It would need to be worked out with the county, school district and city:

At this time, Mayor McKelvey and Councilmember Knight stated they needed to wait for
the school board decision on the location of the elementary school before they could.
proceed further.
VARlANCEÆVELAND .
This item was tabled at the April 18 council meeting to give staff an opportunity to take a
look at ways to find to avoid some variances or at least to give Mr. Eveland a couple of
building permits on the back 64 acres that he owns. Mr. Carlberg reviewed for the
audience that the school district is looking at the 80 acres that he owns on Crosstown
Boulevard. On the map is an existing situation, so if Mr. Eveland came in for a building
permit today, he could create these parcels to meet all the requirements of the city's
ordinance and Agricultural Preserve (1 for 40). It's when the school district comes in and
acquires the 80 acres, there's where we run into the issue of no frontage. The difficulty is
where the position of the State Aid road goes. We are in a limbo right now as far as
where the road will go and how to position his home, but if Mr. Eveland came in now for
building permits, staff could do these Metes and Bounds splits and get him the building
permits.
There was discussion on how the house can be positioned facing the road or right-of-way.
It was explained that the policy for any structure is wherever your right-of-way is; you
can only turn your homes 90 degrees from the front.

Councilmember Jacobson had two questions. 1) How many houses per acre can you
have to qualifY for Ag Preserve? Mr. Carlberg responded one house per 40 acres. 2) In
order to do this, doesn't Mr. Eveland actually have to split it and create two Metes and
Bounds lots in order for council to grant it? Mr. Carlberg stated he is actually splitting
into three parcels on it. He will have to do this before getting a building permit.
Councilmember Jacobson questioned if Mr. Eveland was aware of this. Therefore,
discussion continued as Mr. Carlberg explained to Mr. Eveland the process.
Motion by Jacobson, Seconded by Johnson, to approve application for building permits
subject to the division ofthose two parcels and waive park dedication. Motion carried
unanimously.
SCHEDULE STRAGlC PLANNING WORKSHOP
Mr, Carlberg explained that staff will put this on the May 2 Council meeting agenda that
they would like to schedule sometime in June an all-day Friday meeting with council and
staff. This would be prior to budgeting, etc. There really is a need to have a good
strategic planning session on where we see the city going and setting some goals,
possibly bringing someone in fÌ'om the outside.
Councilmember Jacobson stated that the last time we did something like this, we had
almost all the city staff and department heads there and it got to the point where we didn't
progress vel)' far. Mr. Carlberg stated that this time there would only be department
heads and council present at the workshop. It will be discussed in detail at the May 2
City Council meeting. A suggestion for a date would be the third week in June.
OTHER BUSINESS
Mr. Carlberg had two items to discuss. 1) A letter addressed to the Mayor concerning
the Brooks Crossing project stating they felt they did not do a vel)' good job presenting
their PUD and would like to come back on the May 2 Council Agenda and give a
presentation about their PUD project if that is acceptable with the Council.
Counci1member Knight stated he is not interested in changing his mind. Councilmember
Jacobson indicated he would like to see something in writing. Councilmember Knight
stated he agreed with the chairman of the Planning and Zoning Commission. What we
are doing is basically nullifYing our 2-Y> acre policy. Mr. Carlberg stated there are some
issues here. The developer doesn't have clear direction as to what he is suppose to do.
He is not sure ifhe should come in with the standard 2 'h acre development or ifhe
should come in with the PUD with the idea of maybe giving some concessions on the
density issue. He may have received mixed messages from Council and would like to
have it clarified before spending thousands of dollars and then finding out that it is not
acceptable.

Councilmember Knight would not be interested in sitting through another presentation.
Councilmember Jacobson said if it doesn't benefit the city, he is not interested. Mayor
McKelvey would agree to watch a 5-minute video on a previous project they have done,
but not a 45-minute presentation. Councilmember Knight restated that he agreed with the
p & Z Committee Chair that we would be negating the 2-11, acre policy and that everyone
would be coming in with these things. We have done it before, but not this time.
Mayor McKelvey, by majority of the council, agreed to have Mr. Carlberg direct the
Brooks Crossing developer to proceed with a 2-11, acre development project.
Mr. Carlberg stated the last item to be discussed is the letter received from the
Metropolitan Council dated April 21 ,2000. The numbers for multi-family development
that are in the letter are above and beyond what was originally discussed. Staff needs to
meet with them and find out how they came up with these numbers. Density and
transportation are the major issues to discuss at a May workshop.
, Council would be interested in watching a video on multi-family housing presented by
John Kari of the Met Council, either before a meeting, or at the Strategic Plarming
workshop.
Motion by Mayor McKelvey, Seconded by Jacobson to adjourn. Motion carried
unanimously,
