Councilmembers present: Don Jacobson, Julie Johnson (arrived at 8 p.m.), Mike Knight, Ken Orttel Councilmembers absent: None Also present: City Attorney, William G. Hawkins City Engineer, Scott Erickson City Finance Director, Jim Dickinson Code Enforcement Officer, Jeff Johnson Community Development Director, Dave Carlberg City Administrator, Richard Fursman Others RESIDENT FORUM Jeny Windschitl - asked to be able to submit a letter regarding Item 4, Ordinance No. 208, Zoning Ordinance, discussion. Winslow Holasek. 1159 Andover Boulevard - was concerned that when Andover is compared with other cities, none of the neighboring cities are used. He would like to see comparisons done with those cities bordering Andover as well. Mayor McKelvey explained normally comparisons are done with cities of similar populations, but he will ask that neighboring cities b.e used as well in the future. Jim Hansen. 3555 141st Avenue - was concerned with the City's inability to enforce the ordinance relating to junk cars and about a temporary mobile home permit that was issued for a neighboring residential lot on 3542 142nd. The permit was issued for the resident to live in while the residence is being repaired ÍÌ'om a suspect fire. He had pictures of the trailer, which has a broken window, needs repairs and is not presentable in a residential area. That residence has also had quite a few problems with Sheriff calls. It is a nuisance. He and neighbors have called the City many times, but nothing is done. He was told a 120-day permit was issued to have the house built; and if the house is not completed in that time, an additional permit can be given. The trailer is an eye sore. The owner of the house used to be a City employee and may have known the person working for the Building Department and may have easily received the permit. He didn't think he would b.e able to move that junk trailer next to his house. That yard is already a health problem with garbage in the back yard, He doesn't know if the trailer is hooked up to sewer and water. At 6 a,m, this morning there were three more vehicles on the premises. The trailer has been on site for a very short period of time and already there have been two Sheriff's calls to it. He called the City on three different occasions about the garbage in the back because he is concerned with rats. It is a very poor situation. Regular Andover City Council Meeting Minutes - January 18, 2000 Page 2 (Resident Forum, Continued) Anne Torgelson. 14220 Rose - stated the house is a known drug house, and she would like it cleaned up. Pam? 3436 142nd Avenue - asked with the number of cars on the site and the number of times the officers respond, how much do they as taxpayers have to pay for this? No one would want this in their neighborhood, If she has a couple junk yards in her yard, she gets a letter from the City. She understood that, but questioned why nothing is being done about this yard. It doesn't seem like anything is getting done by the City and it keeps getting worse. She's lived in the City for 26 years, and now the road is a straight-away. People go SO mph to that house. There are no speed bumps and no police when needed. That place is an eyesore and it stinks. There is no yard. It is all fenced in. The City needs to get something done with the lot. Diane? . l420S Silverod - related an incident when she came home to find police in her yard and going through the house next to the trailer with guns drawn. It was a vel)' fiightening experience and shouldn't be happening in Andover. When this trailer was brought into the yard, they had to go through the side of her yard making deep ruts. It is getting to be a bad situation. Dawn ? . next door to the house in question - since she moved into her house in May, two of the vehicles on the neighboring yard have never been moved. Another is full of garbage. She cannot let her children go outside, and it is not fair to the children that they can't play in their back yard. She never knows when the police will show up in the neighbor's back yard. This makes her angl)'. The neighborhood looked nice when they bought the house, but now she doesn't want to live there any more because eveI)' single day the police are in that house. Something has to get done. Kathy Connelly - sold Dawn the house because of the problems next door. She had to keep her kids in day care because of the number of times the police came out with guns drawn. They like the neighborhood and moved only three blocks down. Something has to be done with this situation. Another resident stated it appears someone has been living in the trailer the last seven days. The City inspector was supposed to look at the trailer and deem it habitable. Others commented further on the number of times police are called to that residence and surround it with guns drawn. It is scary. A gentleman talked about the night of the fire and how he helped the neighbor take the Harley Davidson out of the garage. When the officials came, they are told to leave the area because of the possibility ofmethamphetamines in the house causing toxic fumes. People live in the house without power and water because they don't pay their bills. Another gentleman stated there was a generator in the back yard last night, so someone was living in the trailer. He's made complaints to Mr. Johnson about the junk cars, so the City has known about this for a year. He did contact the State Health Department, but he doesn't know what happened. Councilmember Orttel stated he just recently found out about the trailer. In the past trailer home permits came to the Council for approval. He believed the Building Official left a tag saying the Regular Andover City Council Meeting Minutes - January 18. 2000 Page 3 (Resident Forum, Continued) trailer was uninhabitable; and if that is the case, no one should be living there. Also, he felt the whole situation is incredible and that the neighborhood should not have to be living with all of this. Mr. Johnson stated he was out there on Thursday and did check the rear yard. Prior to this he was unable to view the back yard because he does not have authority to go onto private property. There are a number of vehicles, and a letter was sent to the property owner to address the junk vehicles and exterior storage. The ordinance allows two vehicles parked off the driveway. The new ordinance will prevent any vehicle fÌ'om being parked off the driveway. A neighboring resident commended Mr. Johnson could come on her property at any time to view that lot. Andy? . 14229 Rose - moved in about a year ago. He didn't know about what was going on at that lot but then saw the trailer parked there. Even if the trailer is habitable, it sticks out front and is an eye sore. The outside appearance of the trailer is trash. They could live with it if it were nice. He wanted to know what the City was going to do and in what time line. Kathy? . 14216 Silverod - stated if the trailer gets moved, there is still the issue of drugs and police officers running in the house and in her back yard. In discussing the concerns on the number of police calls to the residence, the Council agreed to ask the Sheriff for a report by the next meeting. Attorney Hawkins stated if the trailer is not being used or is not properly placed, the City has the right to revoke the permit. But there has to be some reason to revoke it such as the trailer is uninhabitable or it is not hooked up to sewer and water. He suggested all parties involved provide a report to the Council. The Council also asked that one person from the neighborhood be the contact person for City Staff. James ? and Susan Sherman - are not citizens of Andover but addressed the Council about supporting the Junior Chamber of Commerce organization. They provided some background of the organization which helps to build leadership skills through community service. They are asking for support and for a facility for their meetings. They left material about their organization for the Council and for the public. APPROVAL OF MINUTES January 4, 2000, Regular Meeting: Page 5, discussion by John Moore, seventh line, change "railroad" to "Rum River". Motion by Knight, Seconded by Orttel, approval as amended. Motion carried on a 4- Yes, I-Absent (Johnson) vote. SCHOOL DISCUSSION Mr. Carlberg explained the purpose of having this item on the agenda is to let the residents know that the City has offered the commercial site on the northwest comer of Bunker Lake and Hanson Boulevards to the school district for a potential high school site. It is 77 acres. Many of the issues were discussed with the school district and MPCA, and it is felt that is a viable site for a senior high school. The MPCA will allow the site for institutional use. The siting of a high school will be discussed by the school board on Thursday evening, January 20. Bill Hupp. 1650 Andover Roulevard - asked about the progress of acquiring Anoka Auto Wrecking in conjunction with the school. Mr. Fursman stated at this time additional development is needed to acquire the funds necessary to purchase Anoka Auto Wrecking. If the property is sold to the school district, the funds would be available to purchase the salvage yard. Preliminary negotiations Regular Andover City Council Meeting Minutes - January 18, 2000 Page 5 (School Discussion Forum, Continued) have been starting with the owners of the salvage yard. There is no question that site would have to be redeveloped if the commercial site is chosen for the school. Mr. Hupp asked if the City has considered any land for a hockey arena. Five to seven acres would be needed for that. Tonv ? , stated he has checked into the construction of a hockey arena for Andover. Much of it depends on which site is chosen for the high school. If they can get the land, he has the contracts to construct the arena basically for cost. There is a lot of interest for both boys' and girls' hockey. Mayor McKelvey stated they will look into it. Dale ? . 13862 Holly - stated there are neighborhood schools in Andover, but then the kids get shifted further out. She hoped the Metropolitan Council Staffis researching this issue and giving all boards the infonnation. In the quest to do what is best for the children and the community, she hoped the City is fortunate enough to get the high school. It is important for the residents to attend the meeting on Thursday, as their input could be critical. She wondered if the location next to a salvage yard and landfill is what is best for the children. Does this do the City proud? Money is all the school board cares about, and Andover seems to be under represented on that Board. Possibly somebody can provide the infonnation needed on the sites. She thanked Staff for their help with the calculations for sewer, water, demographics, etc. The Council explained the landfill site has been studied and monitored extensively. The MPCA has said it is very safe. (Councilmember Johnson arrived at this time, 8:00 p.m.) Lee Parker. 3704 161 st - asked about the status of the MUSA. He understood there is a proposal of it being extended. The Metropolitan Council has said they would not allow a direct line to go up to the school on 161 st. It would have to be an extension of the line. That would also mean additional easements. He is hearing the property owners on 161 st are not interested in selling their land, stating he has a petition from them. The people built in that area because it is rural and without municipal utilities. He is also hearing they would be moving the gas line next to his house. A representative from Northern Natural Gas told him the pipe in the ground is 40 years old and is not an issue, but he felt it would be a problem with the wells if the pipe ends up breaking or leaking. They do not want the school there for safety reasons, because they don't want to give up their land and because of what is going on with the City's sewer and water. There were no further comments. Thursday's meeting has also been called as a Special City Council meeting because several Councilmembers indicated they would be present. Regular Andover City Council Meeting Minutes - January 18, 2000 Page 6 ORDER FEASIBILITY REPORT/lPOO-05/2000 STREET AND UTILITY RECONSTRUCTION/SEVENTH A VENUE AREA Mr. Carlberg explained the project area is outside of the 2020 MUSA. It had been included in the 1996 Comprehensive Plan, but the City was told by the Metropolitan Council to remove it. If there is a need for utilities in an emergency situation, they could be brought to his area. If utilities were brought to the Meadowoods, Dostaler Hanes Addition, Ivywood Estates, Johnson's Oakmount Terrace and Dehn's Addition neighborhoods, the Comprehensive Plan would have to be amended. Councilmcmber Orttel felt it is unlikely the one-acre subdivisions would be interested in sanitaIy sewer, but they may want to consider municipal water. Mr. Erickson stated the original streets in those neighborhoods need to be reconditioned, but the residents may want to look at utilities. He suggested Staff do a feasibility to obtain estimated cost of the improvements, then have neighborhood meetings before acting on the project. The Council suggested the costs be broken down to sewer and water and just water alone. Possibly more than one neighborhood meeting is needed because of the diversity in that area. Motion by Orttel, Seconded by Jacobson, the Resolution as prepared. (Resolution R020-00 ordering preparation of a feasibility report for 2000 street and utility reconstruction) Motion carried unanimously. DENY SPECIAL USE PERMIT/US WEST TELECOMMUNICATION TOWERl32XX SOUTH COON CREEK DRIVE Motion by Orttel, Seconded by Knight, the Resolution as prepared (denying the Special Use Permit request) DISCUSSION: Councilmember Jacobson suggested the permit be held in abeyance during the moratorium rather than denying it. Mr. Carlberg explained the Council must take action on the permit unless the applicant makes a written request to hold it. The applicant did not make that request. They did pay the fee for this permit. The ordinance states they cannot make re-application within a year of denial. Attorney Hawkins stated the denial is based upon Council action rather than the specifics of the application. Because of that, he advised that the provision in the ordinance relating to the inability to make re-application within a year be waived. Councilmember Orttel amended the motion that the one-year prohibition on re-application would not apply because it is a Council action for denial based on the moratorium. (Resolution R021-00) Motion carried unanimously. Regular Andover City Council Meeting Minutes - January 18, 2000 Page 7 APPROVE ORDINANCE NO. 20B/ZONING ORDINANCE Council member Jacobson stated he reviewed the ordinance with the understanding that the only changes were those that were underlined or in italics. Since that is not the case, he stated he did not thoroughly examine the proposed ordinance and suggested tabling the item. He did provide a marked up copy for Staff to consider. Mr. Carlberg stated Staff would also like to table the item, as it does not include the direction of the Council on multi-family housing discussed at last week's special meeting. Councilmember Orttel questioned the definition of Neighborhood Business on Page 34. Mr. Johnson stated that section should be redefined. The Council agreed the ordinance should be discussed in greater detail at a work session in March but that the provision on multi-family housing should be acted upon as soon as possible. Motion by Orttel, Seconded by Johnson, to table Item 4 to the work session in March. Motion carried unanimously. DISCUSSION ON NEWSLETTER Councilmember Orttel asked about the policy for advertising in the City's newsletter. He was particularly concerned with the ad in the last newsletter that appeared as though the City was endorsing the product. Councilmember Jacobson stated the Council had agreed to accept advertising in the newsletter as a way to generate funds. The ad was provided to them with the copy written by the individual. He did change it somewhat and added the graphics. If ads are accepted, he felt they could not discriminate. The Council needs to decide whether or not to continue the policy of accepting paid advertisements in the newsletter. Councilmember Orttel suggested other papers and newsletters be contacted regarding their policy on paid advertisements. He didn't think the City had to accept all ads. It also bothers him that the City would help in creating the ads or use the City logo so it looks like the City supports the product. Councilmember Johnson didn't have a problem with advertising in general but felt this ad looked like the Council was endorsing that item. Councilmember Knight was also concerned with the ad in question as it was somewhat deceptive. He suggested a disclaimer that this is not officially endorsed be placed by the ad so it is more obvious. The Council then agreed a more obvious disclaimer should be added that this is not an endorsed product by the City. Also, the newsletter committee will come back with a policy on advertisements for the Council to review. Regular Andover City Council Meeting Minutes - January 18, 2000 Page 8 ISSUE SURROUNDING BILL'S SUPERETTE ON HANSON BOULEVARD Councilmember Orttel stated the site has been there for eight to nine years and almost nothing has been done in that time other than cut down the trees. Why not rezone the area to be more compatible with the residential area to allow a medical clinic or office buildings. With the possibility of a school across Hanson Boulevard, having a convenience store could be a safety issue with students running across the road. The City has a responsibility to control what is constructed around the schoo!. Attorney Hawkins stated the legal challenge on that property was a group of property owners to the City's action of the Special Use Permit. The City would have the right to change the zoning as long as the owners do not have a vested issue in the zoning. The more money they have invested, the more sympathetic the courts will be to allow it to remain the same. Mayor McKelvey stated the property owners contacted him and are looking at other uses than a convenience store. That property may be for sale. It may be a good time to consider a rezoning. Councilmember Orttel felt the item is worth considering. No action was taken by the Council this evemng. SCHEDULE BOARD OF REVIEW Motion by Orttel, Seconded by Knight, to set April 26 for the Board of Review, 7 o'clock. Motion carried unanimously. CHANGE DATE OF FIRST CITY COUNCIL MEETING IN MARCH Motion by Knight, Seconded by Orttel, to move that meeting to March 6 (because of the caucuses being held on March 7). Motion carried unanimously. ADMINISTRATOR SALARY ADJUSTMENT Mr. Fursman stated this item was requested by the City Council following his review. For the year 2000, wages for the entire Staff were set at the 1999 averages for communities of 10,000 to 25,000 population plus a three-percent cost of living adjustment. The administrator, however, did not receive the three-percent adjustment. At that time he stated he was satisfied with the salary. The Council discussed the administrator's salary and the difficulty of comparing with other cities without knowing the duties that are required in each. Councilmember Orttel stated the Council doesn't know how the salary relates to other duties in terms of demands and responsibilities. Population may not be the best indicator of salary as Andover has a lower rate of employees than other cities. Andover does not have a police force to oversee. Some cities have managers rather than administrators; some have assistants. There was some discussion in the past of a contract with the Regular Andover City Council Meeting Minutes - January 18, 2000 Page 9 (Administrator Salary Adjustment, Continued) administrator which has some protection for both parties. He felt that is another consideration that should be looked at here. Councilmember Jacobson argued with fewer employees, it may mean more responsibilities for the administrator, so it may be more difficult. The intent had been to bring the salaries of the City employees up to what is compatible with other cities of similar size. Motion by Jacobson, Seconded by Johnson, to treat the Administrator the same as the Council has the others and add three percent of the rate for year 2000 and make the salary $84,678. DISCUSSION: Mr. Fursman explained the dollar amount of increase for each employee varied. The administrator position is the further behind in the average wage for cities of similar population, but he realizes it needs to be done in stages. Councilmember Orttel stated another concern is that when the City stops growing, it is going to be difficult to sustain such salaries. Councilmember Knight suggested a 1.5 percent increase instead. Councilmember Jacobson called the question. Vote carried on a 3- Yes, I-No (Orttel), I-Abstain (Knight as he would prefer a compromise at 1.5 percent) vote. Winslow Holasek again asked about the salaries of administrators of neighboring cities. He would like to see those comparisons. Mr. Fursman stated in looking at the salaries for cities with population between 10,000 and 25,000, they used the average range of their 1999 averages for Andover's 2000 salaries. In order to stay with those communities, a three percent adjustment was anticipated. John Ward suggested all people under the administrator should have a written job description of their scope of work. The description for the administrator can then be compared with other communities. There are many things other communities have that Andover does not that would justifY higher wages in those cities. Mr. Fursman stated there are statutory rules that govern plus provisions granted by the City Council. When comparing the position in the various cities, some duties will be similar because of statutory requirements. The rest depends on the make up of the particular community and the challenges it faces. APPLICATION FOR USE OF SHELTER and RESOLUTION ESTABLISHING 2000 USER FEES FOR SHELTER AT SUNSHINE PARK Councilmember Jacobson did not have a problem charging businesses and large civic organizations to use the shelter at Sunshine Park, but he felt it was rather excessive to charge residents $25 for four hours to use it. He suggested residents be charged $10 to cover the filing of the application. The residents pay for the parks through the general levy, and he didn't feel $25 was appropriate. Regular Andover City Council Meeting Minutes - January 18, 2000 Page 10 (Shelter at Sunshine Park, Continued) The Council noted that the shelter can be used by the residents any time it is not reserved. It is a large shelter which would be suitable for large events. Compared to other cities and counties, $25 is not out ofline. Park and Recreation Commission Chairperson Dave Blackstad stated there will be a message board at the shelter so people will be aware of when the shelter is reserved. The fee is to cover extra costs of maintenance such as City Staff dumping the garage and cleaning up the grills. Motion by Orttel, Seconded by Johnson, to approve Items 10 and 11 (the application and Resolution R022-00 setting the user fee for the shelter at Sunshine Park). Motion carried on a 4- Yes, I-No (Jacobson) vote. SECURITY FOR PARK PROPOSAL Councilmember Knight asked for clarification of the security. Mr. Fursman explained it would be a directed patrol. When they are not on an assignment that has a higher priority, the CSO will be present at the parks. However, they don't get called as regular officers do. Park and Recreation Commission Chairperson Dave Blackstad stated the CSO will vary the activities from taking the four-wheeler on the trails, cruising the parks, checking for parking violations at the fields to shutting off the field lights at 10:30 and locking the gate for the Recycling Center. The CSO would be moving around the City to check on other parks and the trail system. There would be no set time. The intent is to reduce vandalism. The City does have an accounting of vandalism done in the past, and it can be monitored at the end of next year to determine the effectiveness of the CSO security patrol. Motion by Knight, Seconded by Orttel, approval ofItem 14 (security for park patrol). Motion carried unanimously. MA YOR/COUNCIL INPUT Grey Oaks development - Councilmember Jacobson asked Mr. Windschitl the status of that development. Will he proceed with the original plat or the amended plat? Mr. Windschitl stated they have made a request in writing to the City. The Resolution passed by the Council requires certain things of him and he is trying to comply with them. Water problems - Councilmember Johnson had a call from a resident regarding the brown water with a very strong cWorine odor. Mr. Erickson stated health should not be a problem, but that complaint will be directed to the Water Department. Regular Andover City Council Meeting Minutes - January 18. 2000 Page 11 (Mayor/Council Input, Continued) Feasibility on potential community center - Mr. Fursman announced the feasibility report on a potential community center will be presented on February 3 at the Staff Development Center in Anoka. The Councils nom Andover, Anoka and Ramsey and the School Board are invited to attend. If there is a quorum, a special meeting should be called for that evening. Issue on the lot on I42nd raised during Resident Forum - The Council wanted to receive reports as soon as possible to find out what is going on there. Attorney Hawkins stated he will investigate. A report is needed nom the Sheriff's office. He will also investigate ifthere is a public nuisance. Mr. Carlberg stated they will look at the issue with the mobile home permit and will expedite the matter. APPROVAL OF CLAIMS Councilmember Jacobson questioned the Claim on Page 7 of$1,S27.0S for mediation services. He didn't recall that item being approved by the Council, thinking the mediation services provided for the City came through the agencies funded with CDBG funds. Mr. Dickinson explained the City has been paying for this service since 1997. This is a non-profit service paid for by the cities and the county. Councilmember Orttel stated the Council did approve this service. Motion by Knight, Seconded by Jacobson, approval of the payment of Claims. Motion carried unanimously.
