Commissioners present: Karen Godfrey, Mary VanderLaan, Nick Loehlein, Marni Elias, and Wes Volkenant Commissioners absent: Scott Hudson Also present: City Planner Peter Hellegers Others PLEDGE OFALLEGIANCE APPROVAL OFMINUTES May 25, 2021 Regular Meeting Chairperson Koehler assumed a motion to approve the May 25, 2021 Regular Meeting minutes as presented. Motion carries by unanimous consent. PUBLIC HEARING: CONDITIONAL USE PERMIT/IN-HOME BEA UTYSALONI 15018 BLUEBIRD STREET NWI KRISTI JOHNSTON (APPLICANT) The Planning and Zoning Commission is asked to hold a public hearing to gather public input and make a recommendation to the City Council on a Conditional Use Permit (CUP) at 15018 Bluebird Street NW by Kristi Johnston for an in-home beauty salon. City Planner Hellegers presented background on the CUP, stating the property is zoned R- 4 and an in-home beauty salon is a conditional use in this area. He reviewed City Code and State Statute related to this business. City Code states the salon must be the occupant of the home and only one stylist and one chair are permitted. He stated any improvements to the home to accommodate the business will require a building permit. Mr. Hellegers displayed the interior site drawing showing the workspace layout. Mr. Hellegers stated the applicant would have to apply for a sign permit and comply with the sign standards for residential property. Commissioner Volkenant asked what traffic impact the business would have on the neighborhood. Mr. Hellegers stated the anticipated traffic volume is limited by one stylist/one chair and will not have a significant impact on traffic. Chairperson Koehler stated the noise ordinance is in effect 10 p.m. — 6 a.m. Chairperson Koehler assumed a motion to open the public hearing at 7:11 p.m. Motion carries by unanimous consent. Kristi Johnston, 15018 Bluebird Street NW, came forward to answer questions from the Commission. Commissioner Loehlein stated the Commission has received comments about increased traffic and asked Ms. Johnston to speak about the duration and frequency of appointments. Ms. Johnston stated haircuts are typically 45 minutes and cut and color are 2-4 hours. At most, she has 6 customers per day. She stated she serves families, coming in one car, waiting while she cuts each family members hair. Ms. Johnston ran a home salon out of Minneapolis for 21 years. Recently, she has been renting space and follows all of COVID and licensing procedures. Commissioner Loehlein asked if she expects back-to-back scheduling. Ms. Johnston averages 15 minutes between customers. She has more customers around the holidays and an occasional wedding party. She stated there is typically one car at a time in her driveway. Commissioner Volkenant asked if customer parking would impact mail delivery and garbage trucks. Ms. Johnston stated customers would park in her driveway. She lives on the opposite side of the street from the mailboxes. She feels her customers have the common sense not to park by garbage containers. Chairperson Koehler stated the expectation is that customers park in her driveway. Chairperson Koehler asked if parking is allowed on her street. Ms. Johnston stated there are not any "No Parking" signs on her street. Chairperson Koehler stated the hours of operation in the Resolution are 8 a.m. — 9 p.m. Monday through Saturday. Ms. Johnston stated she is comfortable with those hours, and she typically works 3-4 days a week. She appreciates having flexibility for special circumstances. Chairperson Koehler asked how she accommodates wedding parties if she only has one customer at a time. Ms. Johnston stated the wedding parry sits in her living room while she serves one customer at a time. Regular Andover Planning and Zoning Commission Meeting Minutes—June 8, 2021 Page 3 1 2 Chairperson Koehler asked if she was planning on placing signage in her yard. Ms. 3 Johnston stated she has never advertised for her business and has relied on word of mouth. 4 She may place a notice on Next Door. She has never placed signs in her yard. 5 6 Commissioner Volkenant said the Commission received letters with concerns about two 7 chairs operating in her home and asked Ms. Johnston to address those concerns. Ms. 8 Johnston stated she has a main work chair, and the second chair is for heat processing or 9 color waiting time. She stated sometimes the chair is used for a parent/child customer 10 where one waits for the other. Commissioner Volkenant stated her intention is to operate 11 at as a Sole Proprietor and not have another stylist work for her. Ms. Johnston responded 12 she is a Sole Proprietor and works by herself. 13 14 Commissioner Elias asked how long it will take for her to get her State license. Ms. 15 Johnston stated it takes around 15 days for the license to process. She said her goal to open 16 her new salon is July 9. 17 18 Commissioner Elias asked if she intends to work on another customer while one is in the 19 second chair. Ms. Johnston replied she would if she is serving a family or people driving 20 together. She stated it serves the customers in the most efficient amount of time. 21 22 Commissioner Godfrey asked if her business in Minneapolis followed the one chair/one 23 stylist policy. Ms. Johnston replied it was the same policy in Minneapolis. Commissioner 24 Godfrey stated Ms. Johnston is experienced in this type of situation and making it work. 25 Ms. Johnston replied affirmatively. She stated she was signed off from zoning in the City 26 of Minneapolis and could operate her business if no one complained. She indicated she 27 has never received a complaint. 28 29 Commissioner VanderLaan asked if she planned any plumbing improvements and if the 30 home is in the sewer line. Ms. Johnston said they have added a sink and have passed 31 inspections from plumbing and electrical. She stated they did not change any walls and 32 did not need a building permit. 33 34 Mr. Hellegers summarized written and phone comments from the neighborhood. He said 35 the neighborhood was mainly concerned about traffic and they had concerns prior to the 36 CUP application. He received concerns about the hours of operation and two chairs. He 37 said he received a comment about opposition to home businesses and allowing them in 38 residential areas. 39 40 Chairperson Koehler assumed a motion to close the public hearing at 7:29 p.m. Motion 41 carries by unanimous consent. 42 43 Commissioner Loehlein stated it seems there is a traffic issue already and feels Ms. 44 Johnston's business will not add to the traffic issue. 45 Regular Andover Planning and Zoning Commission Meeting Minutes —June 8, 2021 Page 4 1 Commissioner Loehlein referred to the section of City Code that limits home salons to one 2 chair/one stylist. He said it can be taken literally as only having one chair. He said it can 3 also be read as one client at a time and asked Mr. Hellegers to help the Commission 4 interpret it. Mr. Hellegers stated it can be read both ways. He said the intent is to limit the 5 number of persons that can be served at a time and the number of stylists permitted to work 6 in the home business. He stated he believes the intent is to have one stylist serving one 7 client at a time. Commissioner Loehlein indicated he sees it the same way as Mr. Hellegers. 9 Commissioner Volkenant stated Mr. Hellegers put up a slide that stated a secondary chair to is consistent with previous home salon CUPS. He indicated the City has approved a 11 secondary chair with previous decisions. Mr. Hellegers stated the applicant provided more 12 detail in her sketch plan than other applicants. He said other salons have proposed 13 secondary chairs and have been approved. 14 15 Commissioner VanderLaan said each house in Andover has around 12-13 vehicles in and 16 out of their driveway every day. She sees Ms. Johnston's business bringing very few cars 17 coming each day. She is impressed by Ms. Johnston and her handling of the concerns of 18 the neighbors. Commissioner VanderLaan stated one car every one hour seems small. She 19 complimented Ms. Johnston on being law abiding, following the rules, and choosing 20 Andover for her home and business. She wished Ms. Johnston success. 21 22 Commissioner Elias appreciates that Ms. Johnston will not have signage and will operate 23 during normal business hours. She understands the current traffic concerns and appreciates 24 Ms. Johnston's efforts not to add to the traffic problem. She said if it passes, she wishes 25 her success. 26 27 Commissioner Volkenant appreciates hearing concerns from neighbors, and he feels the 28 facts and details the applicant provided address the concerns. He said it was well presented 29 and has a minimal impact on the neighborhood. He said he hopes it passes and wishes her 30 well. 31 32 Chairperson Koehler stated Andover City Code allows people to open home businesses 33 without a permit for many reasons, such as a tailor, secretarial, or law office. He said City 34 streets are meant to handle this type of operation. Chairperson Koehler asked about 35 complaints from traffic in the area in the past year. Mr. Hellegers replied he is not aware 36 of any complaints. 37 38 Chairperson Koehler asked if the City has received complaints from the 12 currently active 39 home salons. Mr. Hellegers said he checked with Code Enforcement, and they have not 40 received any complaints. 41 42 Motion by Godfrey, seconded by Volkenant, to recommend approval of a Conditional Use 43 Permit for an in-home beauty salon at 15018 Bluebird Street NW. 44 Regular Andover Planning and Zoning Commission Meeting Minutes —June 8, 2021 Page 5 1 Chairperson Koehler requested staff clean up the code regarding the one chair policy and 2 bring it back to the Commission. 3 4 Motion carries 5 ayes, 1 nay (Koehler). 5 6 Chairperson Koehler stated this item will go to City Council on June 15, 2021. 7 8 Chairperson Koehler stated he voted nay because the City Code is wrong, and he wants the 9 code changed. He wished Ms. Johnston well and raging success with her business. 10 11 OTHER BUSINESS 12 13 Mr. Hellegers updated the Commission on items they have sent to the City Council. 14 15 Commissioner VanderLaan said the Commission should review the home occupation 16 ordinance in light of COVID and the trend to work from home. She asked if the City of 17 Andover is assisting people in working from home within the constraints of health, safety, 18 and welfare. She asked if the City is promoting economic growth. She asked the 19 Commission and staff to review if they are being responsive to the needs of home 20 businesses. 21 22 Commissioner Volkenant stated the location of the business is around 1515` and Bluebird. 23 He said 1515` is a main thoroughfare and Bluebird is busy as well. He said when the empty 24 lot near there is developed, it will increase traffic on Bluebird. He asked what that vacant 25 property will eventually become. Mr. Hellegers said the land use map shows the property 26 as commercial and residential. As is required by state statute, in order to approve the rezoning request the City must find one of the following two findings to be true: 1. The original zoning was done in error. 2. The character of the area or times and conditions have changed to such an extent to warrant the rezoning. The property is located within the Metropolitan Urban Service Area (MUSA) and also is within the current stage of sanitary sewer expansion. Times and conditions have changed with the extension of municipal sewer and water into this area of the City and the development of single-family residential neighborhoods immediately adjacent to the site. The Comprehensive Plan guides the properties as Transitional Residential; which contains properties within the MUSA boundary currently zoned rural but guided for urban development. It has been requested by the applicant with property owners consent to rezone the properties so the land can be developed into urban residential lots for the proposed development known as Oakview Acres. ACTION REQUESTED The Planning & Zoning Commission is asked to hold a public hearing to gather public input and consider recommending approval of the rezoning request based on the fact that the property is located within the MUSA, water and sewer are available to the property, and the request is in harmony with the Comprehensive Plan. A map showing the site location is attached for your review. The proposal consists of 22 total single-family urban residential lots, with 21 being newly created lots and 1 lot containing the existing home on the site. DISCUSSION The Andover Review Committee (ARC) has reviewed the preliminary plat application and submitted comments to the developer. The remaining comments that have yet to be addressed are attached for your review. City staff would suggest the comments be reviewed as part of the preliminary plat review. Conformance with Local Plans and Ordinances I . The property is located within the Metropolitan Urban Services Area (MUSA) boundary. 2. The proposal has a net density of 2.4 units/acre which meets Comprehensive Plan requirements. 3. Pending tonight's action(s) the property was proposed to be rezoned to R-4: Single Family Urban. 4. A variance is needed to increase a permanent cul-de-sac beyond 500 feet. This is consistent with what was proposed during sketch plan review. Street Access There are 4 proposed access points into the site that connect to the existing streets of the surrounding neighborhood. Access from 161 st Ave NW to the north of the site is not feasible due to the presence of existing access points and wetlands. Because of this, the existing roadway connections are the only ones that could be utilized to access the site. Three of the 4 proposed access points would terminate in permanent cul-de-sacs, with the extension of 159th Lane NW on the northern most edge of the site terminating in a temporary cul-de-sac. This temporary cul-de-sac would serve as a connection to an adjacent property that has yet to be developed and is anticipated to be extended in the future. The extension of Avocet St NW will require a variance because it increases the length of a permanent cul- de-sac beyond 500 feet. However, Avocet St NW as it exists today was granted a variance at the time the surrounding neighborhood was developed to extend beyond 500 feet. The extension of this cul-de-sac would create an additional approximately 70 feet of roadway and terminate in a permanent cul-de-sac serving only 2 lots. Language for approving the variance has been included in the attached Draft Resolution of Approval. Lots The 22 proposed lots meet the minimum district requirements established by the City Code for the R-4 zoning district. Due to limitations with the location of existing roadways, wetlands, floodplain, etc. some lots are much larger than the minimum lot size requirement. The minimum lot size for the R-4 zoning district is 11,400 square feet. Lot sizes in the proposed development range from 14,966 square feet to 121,437 square feet. Utilities Each of the 22 lots will be served by municipal sewer and water. During modeling of the City's sanitary sewer system 27-29 sewer connections had been anticipated to be available for the site with additional connections anticipated for adjacent properties with development potential. The applicant is proposing 22 new connections which is within the capacity of the system. Coordination with other Agencies The developer and/or property owner are responsible to obtain all necessary permits including but not limited to Minnesota Department of Natural Resources, U.S. Army Corps of Engineers, Coon Creek Watershed District, Minnesota Pollution Control Agency, LGU, and any other agency that may have an interest in the site. Initial contact shall be made with the City Engineering Department regarding this item Sketch Plan Review On February 9, 2021, the Planning & Zoning Commission held a public hearing and reviewed a sketch plan for the proposed development. During sketch plan review the Commission requested that the applicant preserve as many trees as feasibly possible and that they consider adding additional space between the existing neighborhood and Block 2, Lot 13. In order to meet stormwater requirements and the requirements of other agencies, the majority of trees on the site will need to be removed. However, the applicant is proposing to plant new trees on each lot as part of the development. The applicant was able to create additional space between existing and proposed homes on Block 2, Lot 13 as requested by the Commission. Park & Recreation Commission Recommendation At their June 3, 2021 meeting, the Park & Recreation Commission reviewed the proposed development and unanimously recommended a cash contribution in lieu of land for park dedication requirements. ACTION REQUESTED The Planning & Zoning Commission is asked to hold a public hearing regarding the preliminary plat request and make a recommendation to the City Council. WHEREAS, pursuant to published and mailed notice thereof, the Planning and Zoning Commission has conducted a public hearing on said preliminary plat; and, WHEREAS, as a result of such public hearing, the Planning & Zoning Commission recommends approval of the preliminary plat to the City Council; and, NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Andover hereby agrees with the recommendation of the Planning and Zoning Commission and approves the Preliminary Plat of Oakview Acres with the following conditions: 1. City of Andover staff comments dated June 29, 2021. 2. The applicant shall be responsible for the cost of construction of all improvements proposed as a part of the preliminary plat. 3. Including the existing home one new building permit may be issued for the proposed platted area, however, no additional building permits will be issued until the final plat has been recorded with Anoka County. 4. Prior to final plat recording with Anoka County, a development agreement acceptable to the City Attorney must be executed by the developer. 5. Separate easement documents shall be required for each Vehicle Maintenance Access Area. 6. Such plat approval is contingent upon the rezoning of the property from R-1: Single Family Rural to R-4: Single Family Urban. 7. Applicant shall obtain all necessary permits from appropriate jurisdictions and agencies that may be required in order to develop the property. 8. A variance to allow a cul-de-sac as shown on the approved plan to extend beyond the 500 -foot maximum length requirement of City Code 11-3-3 is granted based on the findings listed in this resolution.
