PLANNING AND ZONING COMMISSION WORKSHOP MEETING
AUGUST 12, 2020
The Workshop Meeting of the Andover Planning and Zoning Commission was called to
order by Chairperson Bert Koehler IV on August 12, 2020, 6:00 p.m., at the Andover City
Hall, 1685 Crosstown Boulevard NW, Andover, Minnesota.
Commissioners present: Karen Godfrey, Scott Hudson, Nick Loehlein (remote),

PLANNING AND ZONING COMMISSION PROCED URES PACKET REVIEW
Community Development Director Janish introduced the Planning and Zoning
Commission Procedures packet and stated it was a tool for the Commission to use in
conducting meetings, orientating new Commissioners, and reviewing projects for
recommendation to the City Council.
Mr. Janish reviewed the General Information section, explaining the role of the
Commission, procedures, meeting dates and times, length of terms, staff reports,
attendance, and payment.
Mr. Janish reviewed the Summary of Items Reviewed by the Commission section stating
the Commission has a role in establishing and applying law. Mr. Janish highlighted how
the Commission establishes law through the Comprehensive Plan, Comprehensive Plan
Amendments, Zoning Ordinances and Amendments, and rezoning. Mr. Janish explained
how the Commission applies law and defined lot splits, sketch plans, ghost plat,
preliminary plats, Conditional Use Permits (CUP), Interim Use Permits (IUP), and
variances.
Commissioner VanderLaan asked how concerned the Commission should be about setting
precedence. Mr. Janish explained what precedence is: same situation, same time, and same

1 scenario. Mr. Janish stated that the Commission can consider the changing of times and
2 the changing of philosophy when looking at projects.

4 Mr. Janish detailed the Planned Unit Development (PUD) process stating the purpose is to
5 encourage more efficient allocation of density and intensity of land use where such
6 arrangement is desirable and feasible by providing the means for greater creativity and
7 flexibility in environmental design than provided under the strict application of this code.
8 He explained it is up to the developer to prove the amenity or variation from code is
9 desirable.

11 Chairperson Koehler stated a well-done PUD is more desirable to the City than following
12 code. Mr. Janish agreed that a well-done PUD is more desirable. Chairperson Koehler
13 asked how staff reviews the PUD. Mr. Janish replied staff does an extensive review and
14 presents to the Commission what they believe is a good buildable plan.

16 Mr. Janish reviewed the general application process beginning with initial discussions, staff
17 review, public hearings, Commission recommendation, and Council approval or denial.
18 Mr. Janish displayed the pyramid of discretion framework and how Planning and Zoning
19 processes fit into the framework.

21 Commissioner Loehlein asked that staff include State Statute and City Code references in
22 the process document. Commissioner Loehlein also asked about PUD's, and for an
23 example narrowing streets, to show where and/or why that is better than the typical City
24 process.

26 Commissioner Godfrey stated she gave comments to Mr. Griffiths prior to the meeting and
27 said staff did an excellent job.

PUBLIC HEARING: INTERIM USE PERMIT - MINING & LAND RECLAMATION

Mr. Griffiths introduced the item and stated the applicant currently owns three different
unaddressed properties located west of Tulip St NW encompassed by a floodplain. He
explained these properties have limited potential for anything other than agricultural

1 purposes. Mr. Griffiths stated the applicant has been working with the Engineering
2 Department on ways that a dwelling could be constructed on the property.

4 Mr. Griffiths stated the applicant is proposing to excavate approximately 8,500 cubic yards
5 of fill from the floodplain within the property, creating a permanent pond and relocating
6 the fill to three different locations along Tulip St NW. He explained the end result will be
7 the creation of three areas of usable upland, one of which could be suitable for construction
8 of a dwelling in the future.

to Mr. Griffiths reported code requires an Interim Use Permit when excavating more than 400
11 cubic yards. Mr. Griffiths explained the Interim Use Permit requirements and the Planning
12 Commission's role in reviewing the request. Mr. Griffiths stated staff has reviewed the
13 application and placed 10 conditions upon the applicant, pointing out conditions 9 and 10
14 for Commission feedback. Mr. Griffiths displayed a drawing to illustrate the changes to
15 the property.

17 Commissioner Godfrey asked if the three pads were sufficient to build a residential
18 property including a well and septic system. Mr. Griffiths replied the proposed pad to the
19 south could be suitable for development and the other two pads would require additional
20 work and permitting to make it suitable.

31 Sue Small, 16228 Tulip Street, approached the Commission and asked how this project
32 impacts her land. She stated she has a high-water table and had to pump water out.

34 Tony Wesp (applicant), 17619 Tulip Street, approached the Commission and informed
35 them the three parcels total 43 acres. He stated the construction will occur on 1/3 of the
36 property and explained they are mitigating wetland so there is no impact to the water table.

38 Commissioner VanderLaan asked if the applicant was looking to build a home to live in.
39 Mr. Wesp explained the intention is to build a home for his family to live in and continue
40 farming the remainder of the land. Mr. Wesp stated the other two areas of upland are for
41 future use to be determined and that he understands additional work is required in the future
42 for development to occur on the two most northerly building pads.

Chairperson Koehler asked staff to show a map where trucks and construction vehicles
would access the land. Mr. Wesp showed a map illustrating the haul routes which are
contained entirely within the property.
Chairperson Koehler acknowledged an email staff received from Bob and Bonnie Dehn,
16485 Tulip St NW, expressing their support for the request.
Mr. Griffiths stated staff received multiple phone calls asking questions about the project.
He stated there was one concern about the pond being a breeding area for mosquitos. Mr.
Griffiths said staff contacted the Metropolitan Mosquito Control District and they will add
the proposed pond to their list for treatment.
Motion by Hudson, seconded by Godfrey, to close the public hearing at 7:20 p.m. Motion

Chairperson Koehler thanked staff for giving the applicant some leeway for the date and
fill amount, so the applicant does not have to return for minor variations.

of Interim Use Permit - Mining & Land Reclamation - PID# 17-32-24-21-0002, PID# 17-
32-24-12-0004, PID# 17-32-12-0002. Motion was taken by roll call:

July 14, 2020 meeting were approved by the City Council.

SUBJECT: PUBLIC HEARING: 2040 Comprehensive Plan Update

INTRODUCTION
The City of Andover submitted the 2040 Comprehensive Plan Update (aka 2018 Comp Plan) to the
Met Council on June 24, 2019. Met Council conducted a completeness review, determined the
plan was incomplete, and provided the City with a list of items that needed to be addressed. One
item included the overall density and densities to allow for the development of affordable housing.
The City Council discussed the issue of density at a series of work session meetings (October 22, 2019;
November 6, 2019; November 12, 2019; and November 19, 2019). These discussions led to the
creation of two new land use districts: Urban Residential Medium Low (URML) and Urban
Residential High Low (URHL). City staff updated the Planning Commission on the status of the
Comprehensive Plan at their February 11, 2020 Work Session.
Staff used the densities from the fall of 2019 to complete plan revisions and presented the revisions
to the City Council at their June 23, 2020 work session. The City Council expressed concern with
the level of density in certain locations and directed staff to make additional changes. Density levels
were brought back to the City Council work session on June 30, 2020 and staff presented options to
adjust the density and development areas which addressed Council concerns. At their July 7a'
meeting the Council agreed with the revisions (option 3.4). Staff used the new density revisions
(option 3.4) to revise the Comp Plan and prepare the document to be brought to Planning
Commission and the City Council.
DISCUSSION
Comprehensive Plan Update — Revisions
The current redline copy of the 2040 Comprehensive Plan Update (2018 Comp Plan) is available
on the City's website (under Planning: Plans, Reports and Resources) or by clicking on the
following link: httys://ww-w.andovernm.gov/179/Plans-Reports-Resources. Due to the size ofthe
document a paper copy has not been provided with this report. Alternatively, staff has provided the
matrix that was used to address concerns that the Metropolitan Council raised with the first review.
Summary of Changes since the February Planning Commission Work Session:
• URL Density levels adjusted from 2.2 - 4.0 units per acre, to 2.4 — 4.0 units per acre. These
levels are consistent with current Andover densities.
• Altered locations for URM, URML, URHL
• Added URML-Mixed, Planned Development Areas — (areas A through E)
• Removed LC: Limited Commercial, incorporated into NC: Neighborhood Commercial
• Adjusted information accordingly
Citizen Involvement and Comments
The City held an open house on the revisions to the Comprehensive Plan Update in July 2020. A
handful of people attended the open house and two residents provided written comments which are
included as an attachment to this report.
ACTION REQUESTED
The Planning Commission is asked to review the Comprehensive Plan Update, hold a public
hearing on theses proposed amendments to the plan, and provide a recommendation to the City
Council.

A RESOLUTION APPROVING THE SUBMITTAL OF THE ANDOVER COMPREHENSIVE
PLAN TO THE METROPOLITAN COUNCIL
WHEREAS, Minnesota Statutes section 473.864 requires each local governmental
unit to review and, if necessary, amend its entire comprehensive plan and its fiscal devices
and official controls at least once every ten years to ensure its comprehensive plan
conforms to metropolitan system plans and ensure its fiscal devices and official controls
do not conflict with the comprehensive plan or permit activities that conflict with
metropolitan system plans; and
WHEREAS, Minnesota Statutes sections 473.858 and 473.864 require local
governmental units to complete their "decennial" reviews by December 31, 2018; and
WHEREAS, the Metropolitan Council approved a submittal extension for the City
of Andover until June 30, 2019; and
WHEREAS, the City Council, Planning and Zoning Commission, and City staff
have prepared a proposed Comprehensive Plan intended to meet the requirements of the
Metropolitan Land Planning Act and Metropolitan Council guidelines and procedures; and
WHEREAS, pursuant to Minnesota Statutes section 473.858, the proposed
Comprehensive Plan was submitted to adjacent governmental units and affected special
districts and school districts for review and comment on January 28, 2019; and
WHEREAS, the Planning and Zoning Commission has considered the proposed
Comprehensive Plan and all public comments, and thereafter submitted its
recommendations to the City Council; and
WHEREAS, the Planning and Zoning Commission conducted a public hearing on
March 26, 2019 relative to the adoption of the proposed Comprehensive Plan; and
WHEREAS, the City Council has reviewed the proposed Comprehensive Plan and
those recommendations, public comments, and comments from Anoka County Parks
Department; and
WHEREAS, the City of Andover submitted their Comprehensive Plan Update to
the Metropolitan Council on June 24, 2019; and
WHEREAS, the Metropolitan Council conducted a completeness review and on
July 16, 2019, notified the City of Andover of several areas in the City's Comprehensive
Plan Update that did not meet the requirements for the regional policy plans; and
WHEREAS, the City of Andover has worked with Metropolitan Council staff to
address areas identified in the plans and make necessary revisions; and
WHEREAS, the Planning and Zoning Commission conducted a public hearing on
September 8, 2020 relative to the adoption of the proposed Comprehensive Plan; and
WHEREAS, the Planning and Zoning Commission has considered the proposed
revisions to the Comprehensive Plan Update and all public comments, and thereafter
submitted its recommendations to the City Council; and
WHEREAS, the City Council has reviewed the proposed Comprehensive Plan and
those recommendations, public comments, and comments from Anoka County Parks
Department; and
WHEREAS, Minnesota Statutes section 473.858 requires a local governmental
unit to submit its proposed comprehensive plan to the Metropolitan Council following
recommendation by the Planning and Zoning Commission and after consideration but
before final approval by the governing body of the local governmental unit; and
WHEREAS, based on its review of the proposed Comprehensive Plan, Planning
and Zoning Commission, and staff recommendations, the City Council is ready to submit
its proposed plan to the Metropolitan Council for review pursuant to Minnesota Statutes
section 473.864.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF ANDOVER,
MINNESOTA, AS FOLLOWS:

Thank you for taking the time this evening to walk through the Andover Comprehensive Plan update with me at the
town hall. I took an opportunity to review the full plan after our meeting.
I mentioned my strong support for the current Rural Residential density limits (0.4 units/acre).
It also occurred to me that the comprehensive plan is silent on the cities approach to renewable energy. There may be a
place in the plan to address the desires to promote or discourage certain renewable energy installations such as
photovoltaic systems (either roof mount or stand alone), wind energy, etc.

I live at 2410 151 st Ave NW and we back up to the farms that are Ed Fields, Eveland Farms and
Slyzuk Farms. We are hoping to see this land remain farm field for the forseeable future. As far as
that goes, I'd like to see all of the land that isn't housing remain land in Andover. I think we are
growing too fast.
Are there any immediate plans for the land behind my house? Last I heard it had gotten designated
as part of the 500 year flood plain.
