Hanson, City Planner SUBJECT: Approval of Minutes — December 13, 2016 Work Session and Regular Meeting DATE: February 28, 2017 REQUEST The Planning and Zoning Commission is requested to approve the work session and regular meeting minutes from December 13, 2016. 2 3 4 5 6 7 8 PLANNING AND ZONING COMMISSION WORKSHOP MEETING 9 DECEMBER 13, 2016 10 11 The Workshop Meeting of the Andover Planning and Zoning Commission was called to 12 order by Vice Chairperson Nemeth on December 13, 2016, 6:02 p.m., at the Andover 13 City Hall, 1685 Crosstown Boulevard NW, Andover, Minnesota. 14 15 Commissioners present: Commissioners Timothy Cleven, Scott Hudson, Bert 16 Koehler IV, Steve Peterson, and Jeff Sims 17 18 Commissioners absent: Chairperson Daninger 19 20 Also present: Community Development Director Joe Janish 21 City Planner Stephanie Hanson 22 Others 23 24 25 DISCUSS AMENDMENT TO THE COMPREHENSIVE PLAN RURAL RESERVE 26 27 Ms. Hanson updated the Commission on the Packer family approaching the City on a 28 matter related to the Comp Plan. The family wants to leave 40 acres to 5 individuals. 29 They came to the City wanting to know if they could subdivide the acreage into 5 parcels. 30 This area is set aside for future urban development. The Comp Plan says in a rural 31 reserve area, there can be 1 house per 20 acres or 2 houses for this 40 acres. One option 32 is to subdivide 1 unit, per 10 acres, in the rural reserve area. A Comp Plan amendment 33 would be needed, so that is an option. The City would have the option to update the 34 Comp Plan and split the areas allowing more than one unit per 10 acres, or even 1 unit 35 per acre in these areas.. However, there are a lot of regulations, and the area is slated for 36 urban development at some time. We agreed with the Metropolitan Council at some 37 point that there could be 1 unit per 3 acres. In the south part of the metro area, they have 38 flexible development guidelines where they create an overlay zoning district to create 39 smaller lots in these areas, and include ghost platting and how it would develop in the 40 future, so there is a plan. 41 42 Ms. Hanson went on to state that this matter was brought to the City Council and they 43 were in support of moving forward and looking at the option of flexible development 44 guidelines. The City Council would like to see if we can put this concept to use in our 45 City. City staff talked to the Packer family and they are in agreement as well. They want 46 to break off 2 five acre parcels and put 30 acres into an "open space" to preserve for Andover Planning and Zoning Commission Workshop Meeting Minutes — December 13, 2016 Page 2 l development in the future and they could also sell the land in the future. This is how 2 other communities are handling this. Open space in this case means something different 3 than we typically refer to in City matters. The City will work with the Metropolitan 4 Council on Comp Plan development. The Commission will need to develop the language 5 and zoning ordinance changes, develop guidelines for the requirements to meet (for any 6 others that might want to do this as well): roads, preserve open space, and placement of 7 houses for future subdividing. In 2008, there was a concept plan for development in this 8 area, a very rough sketch. That can be utilized as well when considering this work. 9 10 Commissioner Cleven asked if the property owners could subdivide the 5 acres in the 11 future. Ms. Hanson stated that they could. Mr. Janish displayed "Concept Plan `B' from 12 2005" for this rural area. It was noted that it would probably require a right-of-way for 13 this property because it is known where the road may be in the future. 14 15 Commissioner Peterson inquired about County roads in this area. Ms. Hanson stated that 16 would be looked at and that she really did not think that this will open the flood gates for 17 similar requests. 18 19 Commissioner Sims arrived. 20 21 Vice Chairperson Nemeth stated that he was concerned the City would be swamped with 22 applicants. Ms. Hanson stated that it cannot be much because they would have to build 23 roadways and that would be financially prohibitive, so it would only be on the outer 24 edges. She commented that there had been a little interest in one additional area. She 25 reminded Commissioners that there is a lot of peat in the area so it is not as desirable for 26 development. Vice Chairperson Nemeth reminded everyone that there is also farming in 27 that area. 28 29 Commissioner Peterson asked Ms. Hanson to review the map for future roadways. 30 31 Commissioner Koehler inquired if the Comp Plan had a timeline. Ms. Hanson noted that 32 this is developer driven. He went on to ask if this would change the Metropolitan 33 Council's MUSA line. Ms. Hanson stated that it would not. 34 35 Commissioner Peterson asked if the residents had their own septic, and if urban services 36 come, would they be required or have the option for urban services. Ms. Hanson stated 37 that they would have to hook up. 38 39 Commissioner Koehler commented that they did not require people to hook up south of 40 Coon Creek. Ms. Hanson stated that if the lot size is smaller, then yes. She went on to 41 say that there would be a work session with City Council in January, and that this 42 Commission will see the matter in February. She clarified that there is not much support 43 for community septic systems by the City Council. 44 Andover Planning and Zoning Commission Workshop Meeting Minutes — December 13, 2016 Page 3 1 Commissioner Peterson asked about the future trail plan, along Constance Blvd., that is 2 not built yet. He wondered if that would be a part of this planning. Ms. Hanson replied 3 no, that these would strictly be 2.5 acre lots, but they could leave an easement for the 4 future. Commissioner Peterson wondered if they would need to decide the south or north 5 side of the road. 6 7 Commissioner Koehler suggested an easement on both sides and vacate one of them later. 8 Ms. Hanson confirmed that could be done. Commissioner Koehler stated he would like 9 to have that flexibility down the road. 10 11 Commissioner Koehler also indicated that there had been issues in past regarding 12 subdividing once every so often and asked about the time frame. Ms. Hanson stated that 13 the City guideline had been once every 5 years and the City fairly recently changed it to 14 3. Commissioner Koehler asked if the family knew that. Ms. Hanson stated that 5 acres 15 is the magic number for the family because they want pole buildings for "toys." 16 17 Commissioner Koehler asked if they could divide the 5 -acre lots again. Ms. Hanson 18 stated they could not because there is no road frontage. The rest of the 30 acres will need 19 to remain open space until it becomes an urban development. 20 21 Commissioner Peterson asked for clarification if services were to be brought up to this 22 area, could the property be divided. Ms. Hanson confirmed that if it was urban medium 23 or high density, the answer was, "yes." Ms. Hanson indicated that the engineering 24 department will have some things to think about. This parcel of land is one of the most 25 developable areas. 26 27 Ms. Hanson clarified that this is a rural reserve area (in light blue on the map), and not 28 rural residential, which is automatically 2.5 acres. She also confirmed that some 29 residents in other related areas are asking about when services will come. 30 31 Commission Koehler asked if there were any decisions for the Commission at this time. 32 Ms. Hanson stated that the information was only "food for thought at this time. 33 34 Ms. Hanson went on to say that the two sons want to build on the new lots in the spring 35 and the rural reserve area is only area where there will be services in the future (in an 36 undetermined amount of time). 37 38 Commissioner Peterson noted that according to the concept plan, the development should 39 be high density facing Constance Blvd., and now this is the reverse. 40 41 Commissioner Nemeth commented on the need for developments with larger lots and that 42 demand may feed that change. 43 44 Commissioner Cleven cited the new Oak View development. 45 Andover Planning and Zoning Commission Workshop Meeting Minutes — December 13, 2016 Page 4 1 Commissioner Sims inquired about the Comp Plan work starting next year. Ms. Hanson 2 noted that work starts in February, once the new Planning & Zoning Commission 3 composition is set and that there will be work sessions late in February. It will be a two - 4 year project and that with an update to the Comp Plan, this can be done in May/June and 5 the family can build. 6 7 Ms. Hanson stated that the consultants are starting their work now and some is being 8 done in house and that the transportation plan is focused on compliance. 9 10 Commissioner Peterson asked if they would get the opportunity to comment on the 11 transportation plan. Ms. Hanson stated that she assumes there will be meetings in the 12 Council Chambers on that and that they will consult with the County. In 2017 in the 13 summer, work will start to widen Hanson up to 155th Lane. 14 15 Commissioner Peterson expressed his desire to see the transportation plan before it is 16 done to provide input. Ms. Hanson will talk to Mr. Berkowitz about the transportation 17 plan and input noting that the City's plan will focus on the roads owned by the City. She 18 noted that engineering staff has been involved with the plans for Hanson and Bunker. 19 20 Vice Chairperson Nemeth expressed his wish to address Round Lake Blvd where there is 21 a small amount of road that is one-half mile where it goes from 4 -lane to a 2 -lane to a 4- 22 lane. 23 24 OTHER BUSINESS 25 26 Ms. Hanson updated the Planning Commission on related items. She indicated that there 27 were 140 lots within the City that are ready to build on and already approved at this time. 28 29 103 new residential housing permits were issued this year. 30 31 Commissioner Peterson noted that it was not a huge inventory, considering there were 32 100 homes permitted this year. 33 34 Commissioner Nemeth recounted some of the possibilities within the City for future 35 development. 36 37 Ms. Hanson referred to the Comp Plan update and that land uses will need to be 38 considered. A topic for 2017 will be to really think about workforce housing, as there is 39 not much in the City of Andover and the City needs to provide that. She explained that 40 workforce housing is a lower valued home or an entry level home. Another term that is 41 used is affordable housing. Mr. Janish explained that by providing for all income levels, 42 families become established in the city and then work their way up and stay through 43 retirement housing. Ms. Hanson does not expect much change for parks and trails in the 44 Comp Plan. 45 • Andover Planning and Zoning Commission Workshop Meeting Minutes — December 13, 2016 Page 5 1 Commissioner Cleven expressed the need for more commercial sites. Ms. Hanson stated 2 that redevelopment will be a discussion point. 3 4 Commissioner Cleven asked if the bus company own another parcel. Ms. Hanson 5 indicated that they have additional property that is developable as a commercial piece. 6 7 ADJOURNMENT s 9 Motion by Peterson, seconded by Hudson, to adjourn the meeting at 6:53 p.m. Motion 10 carried on a 6 -ayes, 0 -nays, 1 -absent vote (Daninger). 11 12 13 Respectfully Submitted, 14 15 Marlene White, Recording Secretary 16 TimeSaver Off Site Secretarial, Inc. 17 2 3 4 5 6 7 8 PLANNING AND ZONING COMMISSION MEETING — DECEMBER l3, 2016 9 10 The Andover Planning and Zoning Commission Meeting was called to order by Vice 11 Chairperson Nemeth on December 13, 2016, 7:00 p.m., at the Andover City Hall, 1685 12 Crosstown Boulevard NW, Andover, Minnesota. 13 14 Commissioners present: Commissioners Timothy Cleven, Scott Hudson, Bert 15 Koehler IV, Steve Peterson, and Jeff Sims 16 17 Commissioners absent: Chairperson Daninger 18 19 Also present: Community Development Director Joe Janish 20 City Planner Stephanie Hanson 21 Others 22 23 24 APPROVAL OF MINUTES. 25 26 November 9, 2016 27 28 Ms. Hanson stated that there were no changes from staff to the minutes that were 29 distributed. 30 31 Commissioner Nemeth had the following changes: 32 - Page 2, line 4 — ...hauling may not ensure the project can be completed in 2016, 33 not 2017 (change 2017 to 2016) 34 - Page 2, line 41 — ...CCWD and the City, and also for economic reasons (add the 35 word also). 36 - Page 4, line 5 — In the spring (add the word "the") 37 - Page 4, line 18 and line 24 — the date should be December 31, 2017 38 - Page 5, line 21 — Motion carried on 6 ayes, 0 nays, 1 absent (Cleven) 39 - Page 7, line 18 — The Estates of Arbor Oaks is opening July 2017 (edit open to 40 opening) 41 42 Vice Chairperson Nemeth asked if there were any other changes. 43 44 Commissioner Koehler indicated that he believed that line 4, page 2 was correct as stated 45 and that the year should not be changed to 2016. Commissioner Nemeth directed the 46 City staff to determine the exact wording to express the accurate intent. Regular Andover Planning and Zoning Commission Meeting Minutes — December 13, 2016 Page 2. 1 Motion by Koehler, seconded by Peterson, to approve the minutes as amended. Motion 2 carried on a 5 -ayes, 0 -nays, 1 -present (Cleven), 1 -absent vote (Daninger). 3 4 PUBLIC HEARING: INTERIM USE PERMIT — STOCKPILE — PRESERVEAT 5 OAK VIEW — METROWIDE DEVELOPMENT. 6 7 City Planner Hanson noted the purpose of this agenda item is to hold a public hearing and 8 take input on an IUP to store up to 4,000 cubic yards of soil. 9 10 City Planner Hanson reviewed the information with the Commission. 11 12 Commissioner Koehler asked Ms. Hanson if the Commissioners had heard about this 13 before and if not, why they were hearing about it now after the dirt was already in place. 14 Ms. Hanson replied that the applicant was not aware the IUP was needed and that some 15 communities have this requirement and some do not. She also reported that the 16 developers came right away to the City to request a permit, when approached. She 17 confirmed that the soil was already stored on site. 18 19 Commissioner Koehler asked if residents in the area had been notified of the hearing that 20 evening. Ms. Hanson stated that those residents within 700 feet had been notified. She 21 had received two phone calls from residents wanting clarification. 22 23 Commissioner Koehler asked if the applicant requests the days and times of hauling for 24 the IUP or if the City puts that information into the document. Ms. Hanson responded 25 that the City adds in the times to the IUP. Commissioner Koehler noted that the 26 times/days were not consistent with the application that the Commission saw at the 27 meeting the previous month. Ms. Hanson stated the times are consistent with the times 28 for previously approved NP's as part of an approved residential development such as 29 Country Oaks North and White Pine Wilderness 2nd Addition. 30 31 Commissioner Cleven asked how long the stock pile would be there. Ms. Hanson 32 replied, November 30, 2019, and that condition number 5 states this date and that the lUP 33 would also expire on that date. Within the City, IUPs are typically 2-3 years, and no 34 more than 5 years, for approving stock piles. 35 36 Vice Chairperson Nemeth asked about the quantity of subtractions and additions to the 37 stockpile. Ms. Hanson replied that no more than 4,000 cubic yards, about what is there 38 now, would be added or subtracted to the existing stockpile. 39 40 Vice Chairperson Nemeth asked if there had been any comments from the engineering 41 department. Ms. Hanson indicated yes, that silt fencing would need to be in place and 42 seeding would need to be done. The City performs frequent inspections and once the soil 43 is removed, the developer has to submit a final grading plan. 44 Regular Andover Planning and Zoning Commission Meeting Minutes — December 13, 2016 Page 3 1 Vice Chairperson Nemeth asked for clarification as to why a haul route was not 2 identified. Ms. Hanson stated that the soil would only be hauled within the development 3 itself 4 5 Motion by Koehler, seconded by Cleven, to open the public hearing at 7:17 p.m. Motion 6 carried on a 6 -ayes, 0 -nays, I -absent vote (Daninger). 7 8 Kathleen Hammer, 105 South 5 1 Avenue, Minneapolis, was present from Metrowide 9 Development. She stated that they had read the proposed IUP and has no issues with it. 10 11 Commission Koehler asked if it would be an issue if weekend hauling was removed. Ms. 12 Hammer noted that normal construction hours allow hauling on the weekend. 13 Commissioner Koehler commented that the last IUP the Commission approved did not 14 allow weekend hours. 15 16 Ms. Hanson stated that condition number 4 allows hauling 8:00 a.m. —1:00 p.m. on 17 Saturdays and is consistent with other developments where there is hauling on site only 18 and it is not leaving the development. 19 20 Commissioner Sims clarified that in last month's IUP that was under consideration, the 21 soil was going out on the road, and that last month's IUP was the exception, rather than 22 this request. 23 24 Ms. Hanson stated that the previous IUP was for mining where the soil will be leaving 25 the site, and that this IUP is for land reclamation where the soils will remain within the 26 development. 27 28 Motion by Koehler, seconded by Cleven, to close the public hearing at 7:22 p.m. Motion 29 carried on a 6 -ayes, 0 -nays, 1 -absent vote (Daninger). 30 31 Vice Chairperson Nemeth noted that there was no one else in the audience, besides the 32 applicant. There were no additional comments. 33 34 Motion by Koehler, seconded by Cleven, to recommend to the City Council approval of 35 the resolution granting an interim use permit for storage of soil for the property legally 36 described as, Block 2, Lot 3, Preserve at Oak View, Anoka County, Minnesota. Motion 37 carried on a 6 -ayes, 0 -nays, 1 -absent vote (Daninger). 38 39 City Planner Hanson stated that this item would be before the Council at the January 3, 40 2017 City Council meeting. 41 42 OTHER BUSINESS 43 44 City Planner Hanson updated the Planning Commission on related items. 45 Regular Andover Planning and Zoning Commission Meeting Minutes — December 13, 2016 Page 4 1 City Planner Hanson welcomed Joe Janish as the new Community Development Director 2 for the City. He started a few weeks ago. 3 4 On November 9, the Commission discussed extending the date for the mining permit for 5 Mr. Smith on the properties along Butternut St. The City Council went ahead and 6 extended the IUP to November 30, 2017. On December 6, the City Council held a 7 public hearing on vacation of drainage and utility easement for a back and side yard 8 within the Woodland Estates neighborhood. 9 10 The Estates at Arbor Oaks received their Certificate of Occupancy. The Open House is 11 on Thursday, December 15 from 5:00 — 7:00 p.m. 12 13 Building permits for Joy's Kitchen and Dunkin Donuts are ready to be picked up. 14 15 103 new single family homes have been permitted by the City during the year. There are 16 approximately 140 open lots in the City. 17 18 Vice Chairperson Nemeth asked if there were going to be more tenants at Shoppes at 19 Andover Station. Ms. Hanson replied that there would not be additional tenants as 20 AT&T has 2 spaces. 21 22 Vice Chairperson Nemeth inquired as to the outcome of the amount of time Mr. Smith 23 would have to start and complete the IUP mining project that was discussed/proposed at 24 the last Commission meeting. Hanson, City Planner SUBJECT: Public Hearing: Conditional Use Permit (CUP) — Liquor Sales — 13650 Hanson Blvd NW, Suite 103 — Joy's Kitchen DATE: February 28, 2017 INTRODUCTION City Code 12-12 requires a CUP for liquor licenses in the I — Industrial District. The applicant is proposing to have liquor sales at a new establishment known as Joy's Kitchen. DISCUSSION City Code 12-12 requires a CUP for liquor sales in the Industrial District. Once a CUP is approved, the applicant will be required to obtain a liquor license that will be issued by the City Council. The City Council will issue the liquor license. City code 12-14-613 provides the following general review criteria to consider when granting a CUP. In granting a Conditional Use Permit, the City Council shall consider the advice and recommendation of the Planning and Zoning Commission and: 1. The effect of the proposed use upon the health, safety, moral and general welfare of occupants of surrounding lands. Staff believes the CUP will not affect the health, safety, moral and general welfare of the occupants of surrounding lands. Liquor sales are regulated by City Code 3 — 1 and must comply with Minnesota Statutes 340A.402. 2. Existing and anticipated traffic conditions, including parking facilities on adjacent streets and land. The CUP will not generate additional traffic to the commercial area. Parking facilities are adequate and provide the required number of parking spaces as required by City Code. This was reviewed as part of the commercial site plan review. 3. The effect on values of property and scenic views in the surrounding area, and the effect of the proposed use on the Comprehensive Plan. Restaurants are a permitted use within the commercial districts and liquor sales are allowed with a CUP and liquor license. Staff believes the CUP will not have a negative effect on surrounding property values. ACTION REQUESTED The Planning and Zoning Commission is requested to hold a public hearing and make a recommendation to the City Council. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Andover hereby agrees with the recommendation of the Planning and Zoning Commission and approves the conditional use permit for liquor sales at 13650 Hanson Boulevard NW, Suite 103, subject to the following condition: 1. A liquor license must be approved by the City of Andover prior to the sale of liquor on the premises. Adopted by the City Council of the City of Andover on this 7th day of March, 2017.
