Commissioners present: Dean Daninger, Scott Hudson, Bert Koehler IV, Nick Loehlein, and Jeff Sims Commissioners absent: Timothy Cleven Also present: City Planner Stephanie Hanson Others PLEDGE OFALLEGIANCE APPROVAL OF MINUTES March 13, 2018 Regular Meeting Chairperson Nemeth stated that he had a few changes to the minutes and inquired if staff or the commissioners had any changes or corrections to the minutes. City Planner Hanson indicated that staff had no changes or corrections to the minutes. Chairperson Nemeth requested the following corrections be made to the minutes: - page 2, line 7 - add "(Nemeth)" behind "present' Chairperson Nemeth inquired if a correction was needed on page 2, line 24 to indicate: "Daninger noted" rather than "Daninger suggested". Commissioner Daninger replied that "suggested" was fine and did not need to be changed. Chairperson Nemeth requested the following corrections be made to the minutes: - page 3, line 44 - change "Chairman" to "Chairperson" - page 4, lines 1 and 2 — should read "Motion by Daninger, seconded by Hudson to deny the variance. Preliminary Plat — White Pine Wilderness Fourth Addition — Outlot A, White Pine Wilderness Third Addition — Tolberg Homes. City Planner Hanson noted the purpose of this item is to hold a public hearing and take input on the preliminary plat for White Pine Wilderness Fourth Addition, a plat containing 14 urban lots proposed by Tolberg Homes. City Planner Hanson reviewed the proposed preliminary plat with the Commission, noting the Review Committee had reviewed this request, the developer made revisions according to staffs' comments, and indicated that the developer will continue to work with staff to satisfy all comments. City Planner Hanson stated the subject property is located within the 2020 Metropolitan Urban Service Area (MUSA) and is zoned Single Family Urban Residential (R-4). It can be developed into urban lots at a net density of 1.75-3.5 single-family homes per acre. The proposed net density for the Fourth Addition is 2.20 units per acre. City Planner Hanson noted the development will be accessed by extending Zilla Street NW to the north. Municipal utilities are available to the development with trunk sewer and water lines located within White Pines Wilderness Third Addition, which will be extended to the north for the Fourth Addition. City Planner Hanson described the minimum lot size requirements and stated the proposed lots meet these requirements for the R-4 zoning district. City Planner Hanson stated there has been a significant amount of wetlands and floodplain as part of the development that have been delineated and approved. On January 18, 2018 the Park and Recreation Commission reviewed the plat and recommended cash in lieu of land for the 14 buildable lots. She noted an application was recently submitted to the Lower Rum River Water Management Organization (LRRWMO). 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 Regular Andover Planning and Zoning Commission Meeting Minutes — March 27, 2018 Page 3 City Planner Hanson explained the developer is responsible to obtain necessary permits from agencies that may have interest in the site. Initial contact will be made with the City Engineering Department regarding this item. She stated the Planning and Zoning Commission is asked to hold a public hearing for this preliminary plat and make a recommendation to the City Council. Chairperson Nemeth inquired if there were questions from any Commissioners. Commissioner Hudson asked if the cul-de-sac was meeting the City's code requirement for maximum length. City Planner Hanson replied, yes and stated that even though the proposed cul-de-sac does not appear to meet the length requirement, it in fact does. She then explained that the City code requires the measurement to be taken from the intersection. Therefore, it does meet the 500 -foot requirement. Commissioner Koehler asked whether or not any feedback had been received on the memorandum sent on February 5th, from Director of Public Works/City Engineer Berkowitz. City Planner Hanson replied yes and stated that the developer has been working with staff on that. She stated that they have specifically been working on the grading of the site. She then stated that revised plans were submitted to staff last week. Commissioner Koehler questioned if they had heard back on item number 3 from the memorandum, regarding the volume of material being excavated from the two (2) basins. City Planner Hanson replied that the developer could better speak to that question. Chairperson Nemeth asked about item number 1 from the memorandum and inquired where the two (2) proposed basins would be located. City Planner Hanson replied that the developer could also speak better to that question. Chairperson Nemeth asked about item number 2 from the memorandum and inquired about how the 4:1 ratio for the slopes was determined. City Planner Hanson stated that the ratio was required by City code. Chairperson Nemeth asked why Lot 12, on the preliminary plat was labeled as an "Incidental Wetland" and asked if Lot 12 was a buildable lot. City Planner Hanson replied that the lot is a buildable lot and stated that the developer could speak further on that question as well. Motion by Daninger, seconded by Sims, to open the public hearing at 7:17 p.m. Motion carried on a 6 -ayes, 0 -nays, 1 -absent (Cleven) vote. Chairperson Nemeth asked the developer to come up for questions and asked whether there would be a presentation. Nathan Jones, representing Tollberg Homes, 1428 5`s Avenue in Anoka stated that he did not have a formal presentation for this meeting because the project has already been discussed through a concept plan. He stated that there have been no significant changes to Regular Andover Planning and Zoning Commission Meeting Minutes — March 27, 2018 Page 4 1 the plan since then. Mr. Jones stated that the original plan intended to create a water 2 feature in the adjacent open space area. He explained that they took this idea to the Open 3 Space Committee for approval, and the committee did not support the construction of any 4 features in the adjacent open space area. 5 6 Mr. Jones stated that the proposed basins, questioned by Commissioner Koehler, are no 7 longer part of the plan and will not be constructed. Mr. Jones stated that the changes 8 were noted in the revised plans that were submitted to staff last week. He then went on to 9 address the "Incidental Wetland" question. He explained that area was excavated back in 10 2006, and he stated that he believed some of the materials that were excavated were used 11 in the 2"d phase by a different developer. He stated that prior to the excavation of that 12 area there were no wet land characteristics present. He commented that the housing 13 recession impacted the time frame between development phases, and he explained that 14 they have been working with their consultants and the Army Corps of Engineers to 15 resolve the issue. He stated that they have now received a confirmation from the Army 16 Corps of Engineers that the area is classified as "Incidental'; therefore, the area no longer 17 fails under the jurisdiction of the Army Corps of Engineers. Mr. Jones then stated that 18 they would be hauling in approximately 20,000 yards of fill for the project. 19 20 Chairperson Nemeth thanked Mr. Jones for addressing those questions and asked if any 21 Commissioners had further questions of Mr. Jones. 22 23 Commissioner Koehler asked if there were any plans for distinguishing the border 24 between the north side of the proposed lots and the open space area. Mr. Jones replied no 25 and commented that there would be somewhat of a natural boundary created between the 26 newly sodded yards and the non -sodded open space area. Commissioner Koehler replied 27 that he thought that was good, because it could be left up to the future homeowners. 28 29 Chairperson Nemeth inquired if the surrounding additions had any such boundaries 3o between the open space area. Mr. Jones replied, no there was nothing that he was aware 31 of. 32 33 Chairperson Nemeth asked for further clarification on the "Incidental Wetland" and 34 asked if that meant that the wetland was created. He then asked if it would no longer be 35 considered a wetland after it was filled back in. Mr. Jones stated that was correct. 36 37 Joe Mulvihill, 1372 162"d Avenue NW, stated that at a previous meeting he attended for 38 the 3`d Addition, there was a discussion about a future trail access to be added to access 39 the open space area. He questioned if this was being planned now. He also asked why 40 some lots had widths listed on the preliminary plat and others did not. He specifically 41 referenced Lots 1, 2, and 3 and questioned if the measurements listed were building pad 42 widths. 43 44 Commissioner Koehler asked staff to confirm that the measurements, referred to by Mr. 45 Mulvihill, were lot width measurements, not building pad width measurements. City Regular Andover Planning and Zoning Commission Meeting Minutes — March 27, 2018 Page 5 1 Planner Hanson confirmed that was correct, the measurements were lot width 2 measurements. 3 4 Commissioner Koehler stated that building pad widths are usually not seen at this stage in 5 the development phase. City Planner Hanson agreed. 6 7 Chairperson Nemeth asked Mr. Mulvihill if that answered his question. Mr. Mulvihill 8 replied yes and questioned at what point could or would the building pad width 9 measurements be provided. City Planner Hanson replied that staff does not require that 10 information. 11 12 Commissioner Koehler commented that the setback requirements inevitably determine 13 this information and stated that Mr. Mulvihill could request the specific setback 14 requirements for this development from staff. City Planner Hanson agreed. 15 16 Chairperson Nemeth asked Mr. Jones to address Mr. Mulvihill's inquiry regarding the 17 trail. Mr. Jones stated that there is a trail currently being planned between Lots 7 and 8. 18 He also stated that he agreed that building pad widths and placements are determined by 19 setback requirements. 20 21 Motion by Koehler seconded by Hudson, to close the public hearing at 7:31 p.m. Motion 22 carried on a 6 -ayes, 0 -nays, 1 -absent (Cleven) vote. 23 24 Chairperson Nemeth asked if there were other questions or comments from any 25 Commissioners. 26 27 Commissioner Daninger commented on the significant amount of hauling and questioned 28 if there was a permitting process for hauling to ensure that the roads were kept clean. City 29 Planner Hanson stated that there is a staff member that patrols the active and ongoing plat 30 development for this purpose, and she stated that staff also relies on calls from residents. 31 32 Commissioner Daninger stated that resident complaints have a large impact and staff 33 appreciates when it does not have to get to that point. 34 35 Chairperson Nemeth asked if a haul route would need to be provided. City Planner 36 Hanson replied yes and commented that there was only one access point to this 37 development. 38 39 Commissioner Koehler commended Tollberg Homes for bringing forward a proposal that 40 was in compliance with the City's code requirements. 41 42 Motion by Koehler, seconded by Loehlein, to recommend to the City Council to approve 43 the resolution for the preliminary plat for White Pine Wilderness Fourth Addition, a plat 44 containing 14 urban lots legally described as White Pine Wilderness Third Addition, 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 Regular Andover Planning and Zoning Commission Meeting Minutes — March 27, 2018 Page 6 Outlot A, proposed by Tollberg Homes, subject to five conditions as detailed in the staff report. Motion carried on a 6 -ayes, 0 -nays, 1 -absent (Cleven) vote. City Planner Hanson stated that this item would be before the Council at the April 3, 2018 City Council meeting. OTHER BUSINESS City Planner Hanson updated the Planning Commission on related items. City Planner Hanson mentioned that there have been 9 single-family home permits issued this year, the Muddy Paws building permits have been pulled, the CUP amendment for Clock Tower Commons was approved, the site plan for Growing Generations has been submitted for staff to review, the variance request from last meeting was approved, the preliminary plat request from the last meeting was also approved, and the zoning code changes regarding religious institutions were also approved. Commissioner Koehler thanked everyone who was involved in putting together the parade, held the past Saturday, for the goalie for the U.S. women's hockey team. DISCUSSION As with all rezonings, the City shall find one of the two following findings that are provided by state statute: The original zoning was in error. The character of the area or times and conditions have changed to such an extent to warrant the rezoning. The property is located within the Metropolitan Urban Service Area (MUSA) and also within the current stage of sewer expansion. Times and conditions have changed with the extension of municipal sewer and water into this area of the city. The Andover Comprehensive Plan has the properties guided as Transitional Residential; which contains properties within the MUSA currently zoned rural but guided for urban development. It has been requested by the property owner to rezone the properties so the land can be developed into urban residential lots for the proposed development known as Catcher's Creek East. ACTION REQUESTED The Planning and Zoning Commission is asked to hold a public hearing to gather public input and consider recommending approval of the rezoning request based on the fact that the property is located within the MUSA, water and sewer are available to the property, and the request is in harmony with the Andover Comprehensive Plan. The proposed plat contains 39 urban residential lots as proposed by Mark of Excellence. DISCUSSION Conformance with Local Plans and Ordinances 1. The property is located in the Metropolitan Urban Service Area (MUSA). 2. The property is currently zoned R-1, Single Family Rural Residential. However, the comprehensive land use plan has it guided as transitional residential which contains properties within the MUSA currently zoned rural but guided for urban development. A rezoning of the properties to R-4 Single Family Urban accomplishes this request. Street Access Public street access to Catcher's Creek East would be provided from Andover Blvd. A temporary Fire Lane will be constructed on the west side of the proposed development as required by the Fire Department. This temporary access would be removed in the future when the property to the west develops creating additional access to the proposed development (1441 Lane and 1441 Blvd). The majority of the streets will conform to the city's standards (33 feet wide within 60 feet of right-of-way), with the exception of the proposed "eyebrow" cul de sac. Staff is requesting the developer remove the "eyebrow" from the proposed plat. With the removal of the cul de sac the developer would have one less lot. However, the City of Andover has not allowed for an "eyebrow" cul de sac to become constructed since incorporation as a city. "Eyebrow" cul de sacs require that a "cul de sac truck" to come out and remove the snow from the area. An "Eyebrow" also requires additional street maintenance time and funds over the lifetime of the improvement. Staff is suggesting the Planning and Zoning Commission and City Council consider condition 14 of the attached resolution, which would require the developer to remove the "eyebrow" from the development. Staff is requesting the developer to provide a 93' diameter permanent cul de sac design on the eastern edge of the development at 1440' Ave. The reason for a permanent design vs. a temporary is that the future extension is up to a different city. The City of Andover has no authority of when or if the future extension would occur. Staff is suggesting the Planning and Zoning Commission and City Council consider condition 15 of the attached resolution which requires the eastern 144`s Lane "temporary" cul de sac to be designed to permanent cul de sac standards due to the amount of variables that exist with the future extension. Anoka County Highway Department (ACHD) ACRD is in the process of reviewing the applicants submittal. The applicant has currently submitted plans which include the construction of a right-hand turn lane. Condition 2 of approval requires the applicant to conform to the requirements of the Anoka County Highway Department. Sewer and Water Access Water and sewer for this development will be obtained from the south and staff has requested from the developer the status of obtaining a right of entry or temporary easement from the property owner along Butternut Street south of the plat for construction of the sanitary sewer and water main. The construction method for sewer and water from south of Coon Creek could vary from open cut if right of entry or temporary easement is obtained; if not obtained directional boring would occur. Condition 8 of approval restricts utility work until the developer has developed a resolution on the process in which the sewer and water extension will be installed. Coon Creek Watershed District The Coon Creek Watershed District completed the review of the preliminary plat. Their comments have been attached for your review. The applicant will need to satisfactorily address all comments prior to the submittal of the final plat. There are wetlands and floodplains on the property. The applicant is proposing to impact 7,995 square feet of wetland. The mitigation will be done through wetland bank credits. A significant area of the 100 year floodplain (which consists of both floodway and flood fringe areas) and the 500 year floodplain exist along Coon Creek, as shown on the grading plan. Portions of the 100 year flood fringe and the 500 year floodplain areas will need to be removed from the floodplain due to the proposed construction of homes within the area. It will be the responsibility of the developer to apply for a Letter of Map Amendment (LOMA) through FEMA for approval to allow homes to be constructed. Without this LOMA, homeowners most likely will have to purchase flood insurance. Staff is recommending that a condition of the final plat is to allow the plat to be recorded but building permits cannot be issued until FEMA approves the LOMA. Burial Grounds The property has burial grounds on it that has been inventoried by the State Archeologist. The applicant is working with the State Archeologist to determine the requirements if any for additional protection of the burial site. When the applicant obtained their mining IUP the State Archeologist was involved and the applicant adhered to the requirements established at that time. The applicant is currently verifying that additional protection is not needed. Condition 16 requires that the protection of the burial grounds shall be acceptable to the Minnesota Indian Affairs Council (MIAC) and State Archeologist. Coordination with other Agencies The developer and/or owner are responsible to obtain all necessary permits (Minnesota Department of Natural Resources, U.S. Army Corp of Engineers, Coon Creek Watershed District, Minnesota Pollution Control Agency, LGU and any other agency that may have an interest in the site). Initial contact shall be made with the City Engineering Department regarding this item. Trails The Andover Comprehensive Plan shows regional trails along Coon Creek and along Andover Boulevard. Construction of a trail along the creek may be challenging due to the location of wetland and floodplain. However, trails can be built within floodplains, and any wetland impacts would need to be mitigated. It is important to note that the trail along Coon Creek would be a regional trail paid for out of the City's trail fund and/or potential MNDNR grant funds. Tree Preservation/Landscaping A more detailed landscaping plan must be submitted that shows tree spacing, removal and species of trees to be planted in the development. Also, the landscaping plan shall show the type of landscape screening to be provided on the multiple frontage lots along Andover Blvd as required by City Code Title 12, Chapter 13. The existing trees around the two homes within the proposed development will be removed. Park and Recreation Commission Recommendation The Park and Recreation Commission reviewed the preliminary plat at their December 7, 2017 meeting. A recommendation of a cash contribution in lieu of land was made. Lots Each of the 39 lots meet the minimum lot width, depth and area requirements of the R-4 Zoning District. WHEREAS, Mark Smith has requested approval of a preliminary plat for Catcher's Creek East; and WHEREAS, the Andover Review Committee has reviewed the preliminary plat; and WHEREAS, pursuant to published and mailed notice thereof, the Planning Commission has conducted a public hearing on said plat; and WHEREAS, as a result of such public hearing, the Planning Commission recommends approval of the preliminary plat to the City Council; and NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Andover hereby agrees with the recommendation of the Planning and Zoning Commission and approves the Preliminary Plat of Catcher's Creek East with the following conditions: 1. Park and trail dedication as recommended by the Park and Recreation Commission at the December 7, 2017 meeting. 2. City of Andover staff comments dated March 21, 2018, Coon Creek Watershed District comments, and Anoka County Highway Department comments shall be satisfactorily addressed prior to any grading of the site. The Andover Engineering Department will determine when all items have been addressed. 3. A detailed Landscape Plan shall be submitted that shows tree spacing and species of trees to be planted in the development. The landscaping plan shall show the type of landscape screening to be provided on the multiple frontage lots along Andover Blvd as required by City Code Title 12, Chapter 13. The Landscape Plan shall be approved by the Andover Natural Resources Technician prior to any grading of the site. 4. The applicant shall be responsible for the cost of construction of all improvements proposed as a part of the preliminary plat. 5. Approval is contingent upon the applicant providing public easements of sufficient size to allow construction of public streets, sanitary sewer and water utilities to serve the plat in compliance with the City Code. 6. One building permit may be issued for the proposed platted area, however no additional building permits will be issued until the final plat has been recorded with Anoka County and the Federal Emergency Management Agency (FEMA) approves the request for a Letter of Map Amendment (LOMA) on the lots that are impacted by the floodplain. In no case shall the building permit be for a proposed lot that is impacted by the floodplain. 7. Prior to final plat recording at Anoka County, a development agreement acceptable to the City Attorney must be executed by the Developer. 8. No utility work shall begin until a resolution on the construction process for the sewer and water extension has been determined. rd Temporary cul-de-sac easement(s) shall be provided for 144" Ave and 144'h LN. Separate documents shall be required for each temporary cul-de-sac easement to be recorded with the final plat. A one hundred (100) foot trail easement along the north side of Coon Creek shall be shown on the preliminary plat which will be recorded as a separate easement document with the final plat. Such plat approval is contingent upon the rezoning of the properties to accompany single family urban development. Separate easement documents will be required for each proposed vehicle maintenance access to be recorded with the final plat. Prior to final plat recording at Anoka County, a development agreement acceptable to the City Attorney must be executed by the Developer. The "eyebrow" cul de sac be removed from the plat and reconfigured to follow past city policy. The cul de sac on the eastern end of 144'h Ave adjacent to the City of Ham Lake shall be designed to "permanent" cul de sac specifications. A copy of the preliminary plat was provided for Commission review. Thirty-nine lots are being proposed. The proposed preliminary plat is located just to the east of Hickory Meadows Park. Once the property to the west of this new development is purchased by a developer, the developer will need to make the necessary street connections between Regular Andover Park & Recreation Commission Meeting Minutes — December 7, 2017 Page 2 Catcher's Creek East and Hickory Meadows which will allow residents access to and from Hickory Meadows Park. Staff is recommending cash in lieu of land. Commissioner Miskowiec asked if Ham Lake has any trails on Coon Creek that abuts the border and Mr. Haas stated there are not due to DNR protected wetland. Typically Ham Lake does not build a lot of trails due to the City being more rural with no City water or sewer. Commissioner Butler stated Shadowbrook East Park is just to the south and with Hickory Meadows Park just to the west of this proposed development, additional park land is necessary. ROSE PARK SHELTER SIZE/TYPE AND FUNDING Mr. H reviewed the Park and Recreation Commission is requested to consider the size and type new shelter at Rose Park. The existing shelter will be removed within the next couple o eeks. It will take 3-4 months after ordering to receive the shelter. Pictures of differen helters from Coverworx were provided for Commission review. Shelter A is similar to Nshelter at Maple View Park and Shelter B is similar to the one at Fox Meadows Park.
