CHAPTER 1A: 3.2 PERCENT MALT LIQUOR SECTION 3-1A-2: INELIGIBILITY FOR LICENSE: A. On -Sale License; Locations Prohibited: No on -sale license shall be granted for any place within four hundred feet (400') of any public or private school nor within four hundred feet (400') of any shersh religious institution, the measurement being from building corner to building corner. This restriction shall not apply to sharehes religious institutions or schools located in the Limited Business, Neighborhood Business, General Business, or Industrial Zoning Districts. (Ord. 301, 10-5-2004; Amended Ord. 404, 1-18-11) CHAPTER 1B: INTOXICATING LIQUOR SECTION 3-1 B-2: ELIGIBILITY AND INELIGIBILITY FOR LICENSE: F. No license shall be granted for any place located within four hundred feet (400') of any public or private school nor within four hundred feet (400') of any shay& -religious institution, the measurement being from building corner to building corner. This restriction shall not apply tom religious institutions or schools located in the Limited Business, Neighborhood Business, General Business or Industrial Zoning Districts. (Ord. 301, 10-5-2004; Amended Ord. 404 1-18-11) CHAPTER 5: TRANSIENT MERCHANTS, PEDDLERS, SOLICITORS AND CANVASSERS SECTION 3-5-1: DEFINITIONS: TEMPORARY RETAIL FOOD ESTABLISHMENT: A retail food establishment that operates at a fixed location for a temporary period of time in connection with a fair, carnival, circus, public exhibition or similar transitory gathering, including shareh religious institution suppers, picnics or similar organizational meetings, mobile food establishments, and agricultural markets. TITLE 5 POLICE REGULATIONS CHAPTER 5: HOME AND BUSINESS ALARM SYSTEMS SECTION 5-6-2: NOISES PROHIBITED: Adjacent To Schools, Gharshes-Religious Institutions And Hospitals: No person shall create any excessive noise on a street, alley, or public grounds adjacent to any school, institution of learning, shafsh religious institution, or hospital when the noise unreasonably interferes with the working of the institution or disturbs or unduly annoys its occupants or residents and when conspicuous signs indicate the presence of such institution. (Amended Ord. 230, 6-17- 1997) SECTION 5-6-3: HOURLY RESTRICTIONS ON CERTAIN OPERATIONS': B. Other Permitted Activities: 1. The following acts or noises are permitted between the hours of ten o'clock (10:00) P.M. and seven o'clock (7:00) A.M. daily: a. Equipment used in connection with special events or activities which are authorized, sponsored, permitted or approved in the city by the City Council, so long as the activity is conducted pursuant to the conditions of the license, permit or contract authorizing such activity. b. Ch, -reh Religious Institution bells, chimes or carillons, school bells, or emergency civil defense warning signals. c. Antitheft devices. d. Machines or devices for the production of sound on or in authorized emergency vehicles. ' See also subsection 12-14-11A3 of this code, hours restricted for loading and unloading materials near residential districts. TITLE 9 BUILDING REGULATIONS CHAPTER 12: ANTENNAS AND TOWERS SECTION 9-12-5: ZONING DISTRICT REGULATIONS: A. Residential Zoning Districts: 1. Towers supporting antennas and conforming to all applicable provisions of this chapter may be allowed only in the following residentially zoned locations: (Ord. 270, 12-5-2000; amd. 2003 Code) a. Sharnh Religious Institution sites, when camouflaged; b. Public land, including City water towers, schools, and publicly - purchased parks when the City Council determines that the tower will not adversely affect the use of the park or neighboring properties; (Ord. 364, 2-19-2008) TITLE 10 WATER AND SEWER CHAPTER 5: STORM WATER MANAGEMENT SECTION 10-5-4: STORM WATER DRAINAGE FEE: A storm water drainage fee for each parcel of land within each category shall be as follows: Land Use Category REF Business, commercial, industrial and public 2.1 Religious Institutions 1.0 Developed parks 0.5 Elementary and middle schools 1.0 High schools 1.0 Manufactured housing 1.2 Multiple housing 1.1 Single-family rural, estate, suburban and farmstead 0.5 Single-family urban 1.0 TITLE 13 PLANNING AND DEVELOPMENT CHAPTER 4: SHORELAND MANAGEMENT SECTION 13-4-6: ZONING AND WATER SUPPLY/SANITARY PROVISIONS: 3. Height Of Structures: All structures in city residential districts, except shurmhes religious institutions and nonresidential agricultural structures, must not exceed twenty-five feet (25') in height. All other Titles, Chapters and Sections of the City Code shall remain as written and adopted by the Andover City Council. CITY OF ANDOVER ATTEST: Michelle Hartner, City Clerk ie Trude, Mayor CITY OF ANDOVER COUNTY OF ANOKA STATE OF MINNESOTA ORDINANCE NO. 481 SUMMARY AN ORDINANCE AMENDING CITY CODE TITLE I ADMINISTRATION, TITLE 3 BUSINESS AND LICENSE REGULATIONS, TITLE 5 POLICE REGULATIONS, TITLE 9 BUILDING REGULATIONS, TITLE 10 WATER AND SEWER AND TITLE 13 PLANNING AND DEVELOPMENT STATUTORY AUTHORIZATION AND POLICY Statutory Authorization This ordinance amendment is adopted pursuant to the authorization and policies contained in Minnesota Statute 412. Policy The purpose of these regulations is to protect the public health, safety and welfare. The proposed amendments to the City Code, replaces "Church" with "Religious Institution" throughout the City Code. GENERAL PROVISIONS AND DEFINITIONS Jurisdiction The provisions of this ordinance shall apply to the City of Andover. Enforcement The City Administrator or his/her designee shall have the authority to enforce the provisions of this ordinance. Interpretation Interpretation of the provisions of this ordinance shall be held to be the minimum requirements and shall be liberally construed in the favor of the governing body. A printed copy of this ordinance is available for inspection by any person during regular hours of the City Clerk. Adopted by the City Council of the City of Andover on this 3' day of April 2018.
