Consider Estates of Cedar Ridge Sketch Plan/Park Dedication Requirements DATE: March 22, 2018 INTRODUCTION This item is in regard to reviewing and determining the park dedication requirements for the proposed sketch plan for the proposed Estates of Cedar Ridge. DISCUSSION A copy of the sketch plan is attached to this item. Fifteen lots are being proposed on the west side of Hanson Boulevard NW just north of 16155 Avenue NW. The sketch plan area consists of 70 acres. There is quite a bit of floodplain and wetlands on the westerly 1/3 of the property so some of the property is limited at to what can be developed. The Park Comprehensive Plan does not identify additional park land for this area. Note: The developer is proposing this development be done as a Planned Unit Development (PUD). Staff is recommending cash in lieu of land. The developer has been invited to attend the meeting to answer any questions the Commission may have. ACTION REQUIRED The Park and Recreation Commission is requested to review the proposed sketch plan and provide direction on the park dedication requirements for the proposed Estates of Cedar Ridge development. Consider 2018 Spring/Summer Soccer/Lacrosse Schedule DATE: March 22, 2018 INTRODUCTION This item is in regard to consider approval of the 2018 spring/summer soccer/lacrosse schedule. Attached for your review are the proposed fields that will be available for 2018 soccer/lacrosse season. The City has received applications for use of the fields from the following groups: Note: Copies of the By -Laws, 5010 Status, Certificate of Insurance and Grievance Procedures for NMSA and AALA are available from City staff if you would like to review them or you can visit NMSA and AALA websites for that information. NMSA and AALA have met and have agreed on the spring -summer schedule (see attached). As indicated on the proposed schedule, Fox Meadows Park will be closed for the spring -summer season, but Timber Trails Park soccer field is available for use for the upcoming 2018 spring -summer season. It is the policy of the City of Andover to try to meet the recreational needs of its citizens. The goal of the Park and Recreation Commission in scheduling is to allot the limited number of recreational facilities in a fair and equitable manner, using compromise when necessary to accommodate the maximum number of requests possible. The Guidelines for Field Usage by Youth Associations may be used to determine field allocation (see attached). Facility requests submitted by the due date with this completed form will be given the highest priority. Subsequent requests will be filled on a first-come, first-served basis if facilities are available. The sequencing of scheduling will be considered with City youth associations having first priority. Consider 2018 Tournament Application/The Heroes Tourney 211 Annual Softball Tournament -Tribute to the Troops MN DATE: March 16, 2017 INTRODUCTION The Park and Recreation Commission is requested to consider the 2018 Tournament Application as requested by the Tribute to the Troops of Minnesota for the 2nd Annual Softball Tournament called The Heroes Tourney. DISCUSSION Attached for your review is the application that has been submitted by the group. The group has requested to use Sunshine Park Fields 1-4 all day for Saturday, August 4, 2018. This request does not conflict with any of the youth tournaments as none are scheduled for that weekend at Sunshine Park since the youth fall schedules are not due until July. There will be fees required since this is an adult group that will be using the fields. The fee proposed will be as follows (assuming no field maintenance is required by the City): • $206.25 Tournament fee for the park (1 day only). Note: Applicant is requesting this fee be waived. • $200 Field usage fee for the 2 extra fields that are being requested. A total of 4 fields are being used. Note: Applicant is requesting this fee be waived. • $250 Damage deposit fee which refundable after the tournament is over and an inspection has been done by Public Works. Note: Since the applicant has requested to waive the tournament and field usage fees it will require City Council approval. For any late application, the late fees (including escrows if maintenance is being requested) must also be submitted with the application, including the penalty fee. Late applications must be approved by the Park and Recreation Commission at least two weeks prior to the date of the tournament. The sequencing of scheduling will be considered with City Youth Associations having first priority. A $500.00 damage deposit fee (or $250.00 deposit fee for non-profit organizations) is due eight weeks before the tournament date. Any equipment damaged or lost or any damage to City property by renter will be deducted from deposit fee. The $500.00 (or the $250.00), less any money for damages, will be returned after inspection and final City maintenance personnel costs of the tournament have been determined by the Public Works Department. " If the tournament organization is requesting a Non -Intoxicating Liquor License, it will be necessary to request Attachment A. The City Council has adopted the following policy: "Field reservation fees and the required escrow for tournaments shall be paid no later than eight weeks prior to the tournament date. If the tournament is cancelled, the field reservation fee nor the Non -Intoxicating Liquor License Fee will be returned. In the event that another sponsor requests the use of the facilities after a tournament has been cancelled, the new sponsor must pay the full amount and the original sponsor will be refunded the total minus any administrative costs incurred by the City. It will take 3-4 months to manufacturer and make delivery. Item is on the agenda to discuss the possible concrete pad area for concessions and a sidewalk that is necessary to meet ADA requirements to the new shelter. • Terrace Park Playground Equipment Replacement — The playground structure for 5-12 year olds and new swings have been ordered. As of right now the neighborhood will be installing the new equipment most likely on Saturday, May 19th. • Pine Hills South Park Playground Equipment Refurbish — The replacement parts have been received for the existing playground structure. The replacement and repainting of the playground structure will be done this spring. Staff has been in contact with the local GameTime representative to make sure that they are ready to go as soon as we get warmer weather. ON -HOLD PROJECTS — None at the time. OTHER ITEMS OF INTEREST — • Kelsey Round Lake Park— Staff has received approval from the City Council to move ahead in applying for the MNDNR grant (Outdoor Recreation Grant Program). Staff is currently updating the application from last year and will resubmit by the deadline date in late March of 2018. • ASN Trail -- Staff has received approval from the City Council to move ahead in applying for the MNDNR grant (Local Trail Grant Program). Staff is currently updating the application from last year and resubmit by the deadline date in late March of 2018. • Eveland Field Fencing.— Nothing new to report. This fencing project is on hold until staff hears back from the Andover Athletic Association (AAA) and the Andover High School to determine if they plan on moving forward in relocating the outfield fence in 2018. As previously indicated they would like the fence to be relocated closer to home plate to meet the fast pitch standards so the players have an opportunity to hit homeruns. Note: The existing outfield fencing itself is in poor condition in some sections and probably should be replaced if the outfield fence is to be relocated. • Update of Pedestrian Trails — The trails that are planned for the next 3 years are as follows: ❖ 2018- Crosstown Blvd NW between Bunker Lake Blvd NW and 140th Avenue NW. The Engineering Department has completed the draft trail alignment and has identified trail easements needs and has begun working with property owners to secure the trail easements. ❖ 2019- ASN Trail from Kensington Estates to ASN Ball Field Facility. Note: Staff has received approval from the City Council to proceed applying for a MNDNR grant (Local Trail Connections Program). Consider New Association-Organization/MN Augers Baseball DATE: March 22, 2018 INTRODUCTION The Park and Recreation Commission is requested to consider MN Augers Baseball as a qualifying association under the Guidelines for Field Usage by Youth Athletic Associations. The Guidelines that have been adopted by the City Council are attached for your review. DISCUSSION The City has received an Application for Scheduled Use of Recreational Facilities from the MN Augers Baseball organization. Since Mn Augers Baseball would like to use City fields for the upcoming season, the Park and Recreation Commission will need to review the information/documentation provided and determine if they are a qualified association. City Administration and the City Attorney have reviewed the applicant's information provided regarding the Procedures (Item 2) referenced in the Guidelines for Field Usage by Youth Athletic Associations. The requirements, MN Augers Baseball response and City staff's review and response is as follows: 2.1.1 - The program shall be targeted to have a minimum of 51 % participation from Andover residents based on the previous year participation in that association. Since this would be the first year of MN Augers Baseball, the organization is not able to submit an affidavit as to the accuracy of the number of Andover resident participants from last year. City Staff's Review and Response: Staff's understanding is that 22 out of 24 players would be Andover residents. Therefore, this does meet the intent of the Guidelines for Field Usage by Youth Athletic Associations. 2.1.2 — Democratic procedures and elections that ensure input from the residents regarding the program and policies. MN Augers Baseball indicated in their March 1, 2018 letter to the City that they are organized and conform to the rules, regulations, by-laws and grievance procedures of the United States Specialty Sports Association (USSSA). They also identified in the letter that they understand that they do not qualify to be recognized as an official youth athletic association. A copy (which is 19 pages long) of the USSSA rules for your review is available on the USSSA website: hllp://web.usssa.com/usssa/usssa-aeneral/2018BBRulebook.pdf City Staff's Review and Response: Out of the information provided, there is no indication that MNAugers Baseball have by-laws. If there are no by-laws for this association, it is questionable as to whether there exist appropriate democratic procedures and election processes. In response to this requirement, MNAugers Baseball referred to their following of the USSSA rules as indicated above. However, the USSSA rules govern participation in USSSA sponsored events and do not dictate or direct how associations are to govern themselves or handle internal problems. Therefore, this does not meet the intent of the Guidelines for Field Usage by Youth Athletic Associations. 2.1.3 - All associations must provide verification that they have 501c(3) or equivalent non-profit status with the State of Minnesota. As indicated in their March 1, 2018 letter to the City, the MN Augers Baseball is not a 501c(3) organization. City Staff's Review and Response: MNAuger Baseball has indicated that they are not a 501c(3) organization nor any indication of an equivalent non-profit entity with the State of Minnesota. Therefore, this does not meet the intent of the Guidelines for Field Usage by Youth Athletic Associations. 2.1.4 - Certificate of insurance, which also names the City of Andover as "Additional Insured". The applicant has provided an insurance certificate. City Staff's Review and Response: The provided insurance certificate does list the City of Andover (Certificate Holder) as an Limited "Additional Insured". The "Additional Insured" shall have the same insurance coverage as the Named Insured which this does not. The provided insurance policy does not meet the intent of the Guidelines for Field Usage by Youth Athletic Associations. 2.1.5 - Established grievance procedures, as outlined by association by-laws. MN Augers Baseball indicated in their March 1, 2018 letter to the City, their grievance procedures are as identified with the United States Specialty Sports Association (USSSA). Attached is a copy of the Guidelines Concerning Legal Disputes for your review. Commission members can also visit USSSA website for further information: http://web.usssa.com/usssalusssa-generaULe ag lDiVutes.pdf City Staffs Review and Response: With respect to the grievance procedures, the USSSA 2018 Baseball Rulebook was reviewed, which include the grievance procedures of USSSA. Review of the USSSA rules suggests that they have nothing to do with the resolution of MN Augers Baseball's potential internal conflicts and grievances. Rather, the grievance procedures outlined by the USSSA deal with conflicts and grievances with USSSA and their sponsored tournaments. Therefore, this does not meet the intent of the Guidelines for Field Usage by Youth Athletic Associations. 2.1.6 - Duplication of sport offering by associations is not encouraged. MN Augers Baseball indicated in the March 1, 2018 letter that they are not duplicating anyone else's offerings. They indicate in the letter that they play in a completely different regular season leagues, completely different tournaments and play completely different baseball teams. Due to USSSA requirements here in Minnesota, the MN Augers Baseball cannot play any games or tournaments within the State of Minnesota which is another reason why they feel this is not a duplication. City Staffs Review and Response: MN Augers Baseball would be a traveling baseball team which the City of Andover already has an association that offers traveling baseball. So, it is difficult to say that this is a duplication of offering or not. Therefore, this may or may not meet the intent of the Guidelines for Field Usage by Youth Athletic Associations. Attached is a letter from the Andover Baseball Association with concerns regarding MN Augers Baseball request to use the City's fields. Summary- Based on the information available at this time, it appears MNAugers Baseball meets I out of 6 requirements of the Guidelines for Field Usage by Youth Athletic Associations. We were established in 2015 to fulfill the need for an Elite Baseball Program that competes against the finest players and teams in premier baseball tournaments across Minnesota, Wisconsin, Iowa and Missouri. In our last 6 tournaments we have (3) championships, (2) runner up and a P place finish. The MN Augers baseball program is committed to developing today's youth. We promote teamwork, commitment, hard work, community service and fierce competition as our core values. It is these core values that we strive to instill in our youth baseball players and would like the support of our local city resources to help achieve our goals. While we are not a 501(c)3 organization we strive to keep costs low for our players and families. All coaches, support personnel and directors are all volunteers. Each year we receive an enormous amount of support from our local businesses. As of the date of this letter, we have 35 Businesses from Andover and adjacent communities supporting our organization. The cost to play with the MN Augers is $125.00 per player. Other local organizations are costing players up to $440.00 for travel baseball. In our quest for use of City resources, we realize that we do not qualify to be recognized as an official youth athletic association. However, times are changing in the way that MN will recognize youth baseball organizations and will open up opportunity for choices. Local residents will no longer be limited to just (1) organization. Hopefully the qualifications for City recognized youth organizations will change as well. MN Augers just happens to be ahead of the curve One of the major concerns of the City is duplication of sport offers between associations. Since we are not recognized as a youth athletic association we cannot duplicate their offerings. With that being said, we play in completely different regular season leagues, we play in completely different tournaments and we play completely different baseball teams. We truly are a different baseball organization aspiring to different levels and different experiences. MN Augers is a member of the Unites States Specialty Sports Association and has been for the past 4 years. We are organized and conform to the rules, regulations, by-laws and grievance procedures of the Unites States Specialty Sports Association. We are insured through the Perfect Game Association and have listed City of Andover as additional insured. MN Augers has (2) baseball teams comprised of 22 young athletes, 13 years of age. 20 (90%) of those athletes are residents in the City of Andover. Last year our program held 78% residents and the prior year to that we had 73% residents. The MN Augers will be asking for a very small percentage of city resources for the (2) baseball teams that 20 out of the 22 players are residents of the City. We have secured practice fields thru other resources; howeverthey are not suitable for baseball games. There are 5 baseball fields in the City that suit the needs for our age group. Hidden Creek North, Shadow Brook, Pine Hills, Timber Trail and Andover Station North. With 5 fields available each night and 5 night's (m -f) per week, there is a total of 25 fields per week that are available. We are requesting the use of 2 of 25 available fields for our baseball games. Simply put, we are only requesting 8% of the City resources and the other organizations benefit from 92% of the resources. We have attempted multiple times (5 in all) to work together with ABA on a schedule that will benefit the residence's uses of City's resources. I've reached out to Patti Murmane, ABA's president and each time has been met with rejection. Our last request was to attend a scheduling meeting to work together, it was denied. We are hoping that we can work with the City to obtain a small percent of City resources. Guideline Statement A key goal of the City of Andover's Parks & Recreation Commission's function is to provide a rich variety of recreational opportunities to residents in the most cost efficient manner possible. To achieve this goal, the City will emphasize a partnership with Andover's volunteer organizations to plan, organize, and implement youth recreational programs both as a means of containing service costs and as a method of ensuring a community-based program. 2. Procedures The City may recognize any number of associations based on the availability of resources and determination of the benefit to the community by the Parks & Recreation Commission. To qualify as a recognized City of Andover youth athletic association, the association must provide: 2.1.1. Unless specified by sanctioning or governing bodies, youth sports program(s) must be open to all residents (regardless of their school affiliation). The programs shall be targeted to have a minimum of 51 % participation from Andover residents based on the previous year participation in that association. The number of participants must obtained from the State organization for that particular association or sport or the president of the particular association must sign a affidavit as to the accuracy of the number of participants last year from Andover. 2.1.2. Democratic procedures and elections that ensure input from the residents regarding the program and policies. The Parks Coordinator shall be provided a copy of the group's by-laws with the required field application. 2.1.3. All associations must provide verification that they have 50lcQ or equivalent non-profit status with the State of Minnesota. 2.1.4. Established grievance procedures, as outlined by association by-laws. 2.1.6. Duplication of sport offering by associations is not encouraged. Example: If more than one recognized associatioli.offers the same level of competitiveness, this shall trigger the field allocation clause. The number of Andover residents within each of the associations will determine the percentage of fields that will be allocated to the particular association. 2.2. In return, qualifying associations will receive from the City priority use of City - owned facilities. This means that all required information/documentation must be provided by the association to the City of Andover before an application submitted by that association can be accepted for use of the City's facilities. Note: The Park and Recreation Commission has the authority to review the number of fields that are being -requested by the association. The final determination will be made by the Park and Recreation Commission based on need for the association. Acknowledgment of the groups as providers of their respective sport offerings. As part of this, the City does not offer programs in these areas, but refers resident to these organizations. 2.3. Youth athletic associations are valued partners to the City in providing organized recreational opportunities. Consequently, serious conflicts arising within or between associations and resident groups that threaten the quality of those recreational opportunities are of concern to the City. 2.4. Barring a legal imperative to the contrary, the City's role in resolving such conflicts is limited to encouraging the association board and party in conflict to work through the problem, according to existing by-laws, with staff representatives providing facilitation and information, as needed. 3. Responsibility The Parks Coordinator or a city representative will work with the various athletic associations to ensure the responsibilities are being met. Staff through the grievance procedure addresses concerns from the general public. I want to begin by thanking you for kindly working with Andover Baseball Association (ABA is a member of MYAS) over the years, and several other associations within the city. I know that at times it gets very difficult as you try to balance the needs of everyone. Your time and effort is very much appreciated! I put a little more thought into the MN Auger baseball team (Kevin Torgerson) situation. I want to layout a thought process below and just get your perspective. Ultimately, I would like to make a recommendation for the city to handle this. This problem is not new as we have witnessed this a few times in our past, and other cities have gone through the same situation with very specific age groups. We know this for certain as the two largest organizations in the state of MN (MYAS and Metro-Baseba// League) have rules against what they call "Rogue" teams. These teams have tried to start up in many other communities in the past for similar circumstances. Those cities have also had to make the hard choices. First, ABA (Andover Baseball Association) offers 4 levels of play (Consistent with at least 126 other communities in MN). We have Travel baseball for ages 9-14U, Northstar Rec (In -House 13-15 year olds), In -House for Tee Ball through 12 year old ages, and the over- growing Sandlot league 16-19 year olds. The kids on Kevin's team are Andover residents. I am confident that every kid on the team is a Little League player from last season. Now that these kids are beyond the Little League age the natural progression is for them to try out for ABA programs. In the fall, Kevin and the rest of the families of this team decided that they did not want to play with ABA as they wanted to travel a different path. In August/September of last year they could have tried out for the ABA Travel Program. They chose not to. They coaches of this team could have applied for coaching.. They chose not to. It was an open and transparent process commended by the community and the High School Program. There was plenty of room for all of these kids. Our 13 and 14 year old programs are proof that CRALL coaches and children do play in our program and that we have a solid transition process. Last year, for example, a previous CRALL coach, now coaching for ABA, was named to the 13AA All Star Coaching staff through MYAS. And this year he is the 14AAA coach for ABA. ABA respects his coaching ability and he is a great person and asset to the association! We are glad he chose ABA as his next step after CRALL. Second, the MYAS's North Star league (13U -15U) is still available to Kevin's team. This is via ABA Registration which is currently open and the league is fun and competitive. These teams travel to other towns, just like the Travel program does. So, all of these kids and coaches still have options within our association. Third, this group of families has decided to set out on their own. Disrupt the community and try to divide an organization for their own personal gain. We have confirmed that they are not a part of Minnesota Youth Athletics Services (MYAS) nor Metro Baseball League (MBL). These leagues are not an option for them as MYAS and MBL both instruct Club and Independent teams to join their local associations. Just like the rules of the City of Andover. The best this team will be able to do is setup scrimmages against local teams; purchase USSSA insurance; (Anyone can do this but this does not put you in a league. It allows you to get an ID number and join USSSA tourneys); and travel out of state to join tournaments. This team is restricted from joining MYAS and MBL tournaments. This is due to MYAS and MBT honoring the relationship with ABA the legit association in Andover. This is and always has been a decision by the governing bodies in MN (MYAS and MBL). All MYAS and MBL communities voted on this and made this a rule long ago in an attempt to keep baseball pure in the state of Minnesota. This is not an ABA rule but rather a governing body rule. Fourth, Kevin's teams did not hold tryouts. They have one full team that played all- stars together at CRALL (Most of them), and the possible second team is being filled in. This goes against the tradition of Little League and ABA. Both organizations hold tryouts, select coaches, have democratically elected Boards and are nonprofit organizations etc. What this team is doing is trying to make a strong statement that we will form our own team, play by our own rules, and we will petition the city and local associations to get field space. What should our response be? Well, first and foremost we should make sure that the kids have opportunities to play baseball. ABA does this. This should be about the kids having fun, learning life lessons through hard work, tryouts and learning from different styles of coaches. We should not be teaching them that if we push hard enough we can divide a city and associations in an attempt to get our own way. Also, ABA has worked very well with Legacy, Fast Pitch, and Slow Pitch! We are very welcoming to families that transition to ABA from CRALL (We have many examples of this). We are working through things very diplomatically and we have made great progress that benefits the children and families of Andover. We are able to make some space in the schedule for Kevin's team(s), but what kind of precedence are we setting? He is demanding Monday through Friday and is adamant about it, but more than likely we will suggest 2 weekday and weekend time slots (Consistent with all the other ABA teams). Fundamentally speaking, this is a troublesome decision for me. I firmly believe that a decision to let these people forge their own path will lead to evermore problems next year and in the years ahead. My recommendation would be to have Kevin and these families join our North Star program this year through ABA. They can apply to coach a team just like every other parent in Andover, and the kids will be placed on teams accordingly. Many Andover kids have gone through this program and they enjoy it. In the Fall of 2018 the kids can try out for the 2019 Travel program and the parents can apply to coach there as well. Beyond that, all of these parents can join the ABA Board in positions that are available. Instead of dividing the community they should join the association and work as a team to help grow the baseball and youth sports community. So, we can provide field time, but I truly believe that this is only going to lead to worse problems in the next few years for ABA and the City. ABA does not close registration till March 15th for T -ball through 15 and 16-19 is open till after April 1 st. With ABA workings with Fast pitch and Slow pitch all of our organizations have already had to look at non city fields to meet our needs. Giving up Timber trails even for 2 days during the week possibly will put ABA in a position to have to go and rent more fields outside the city of Andover. The Timber trails allows us to have fields available for our ages 12 through 19. Why should this burden be put on ABA? And the residence of Andover who are part of this legitimate organization? Finally, this team requesting fields does not have a league (We have confirmed this and USSSA is not a league it is a governing body that has tournaments). We can provide references at MYAS, MBL and USSSA if needed. If Kevin wants to form and independent team he should follow the path of the Club organizations and rent space/time at local training facilities. Also Oak View Middle School is an alternative of a field that he could use for practices. It is used during the school year by the 8th grade team and is open during the summer as a rental field through Anoka Hennepin school district. ABA last year had to rent this field due to Timber Trails being under improvements last year. Kevin's players and families already have 2 options within ABA (Travel and North Star) and they have decided that they are not for them. If we allow this plan to go forward we will have more teams asking for the same next season. ABA has served the community well for 20+ years. I would really like support from the City so that we can continue that tradition. I believe this may be a letter you would like to share with the entire Park and Rec Commission because it will continue to impact them for years to come. I have no problem with this. I strongly believe the rules of the city were set up for this specific reason. And that parents personal selfish feelings of their own wills should not supersede the city rules. Thus not to allow a choice group of parents at a specific age put an additional burden on legit associations. Once this is allowed for baseball it will become issues with all organizations. I will be sending a letter to Kevin on Tuesday stating that ABA will be requesting the use of the Timber Trails for at least some of the days due to the multiple needs of Fast pitch, Slow pitch as well as Legacy and ABA. And that I welcome his teams to join the ABA Association and play in the North Star League through ABA. And that ABA will be leaving the decision on his Timber Trails request to the City of Andover. My hopes are that the city will review and abide by the rules of the City when it comes to the requirements to request fields by organizations such as ABA. Unfortunately due to the needs between the 3 associations (softball, fastpitch, baseball, as well as Legacy) in Andover this summer I am unable to give you a positive decision on the Timber Trails fields. All 3 associations mentioned above have had to go and rent additional fields outside of the city fields for this upcoming summer season. We have as well compromised with each other to open field availability to each other to meet the needs of all ages of players belonging to the 3 associations. With this said the 3 associations have no fields to open up for your needs. All 3 associations have compromised with each other on field use and will submitt their template to the city as required per the city requirements. Because you are not an association nor meet the requirements set by the city I would recommend that you look at alternative fields through Anoka Hennepin School District as all 3 of our associations have had to do the same as well this year to meet all of our needs. 0 Secondly I would like to offer a solution for you and your players and that is to join the North Star program through Andover Baseball Association. Discuss Rose Park for Concrete Concession Pad and Sidewalk Improvements Date: March 22, 2018 INTRODUCTION The Park and Recreation Commission is requested to discuss the proposed plan prepared by staff for concrete concession pad and sidewalk for Rose Park. DISCUSSION Based on the discussion from the last meeting on February 22, 2018, the Park and Recreation Commission expressed interest in having a concrete pad area for a concessions truck. Attached is a drawing identifying the location of the concrete pad and the accessible ADA sidewalk that will be necessary to be constructed from the parking lot to the new shelter. The estimated cost for these improvements are as follows: • Concrete pad for concessions trailer -- $1400 (estimate) • Curb cut/pedestrian ramp with truncated domes -- $4250 (estimate) • Concrete sidewalk from parking lot to shelter -- $1400 (estimate) • Removal of existing concrete curb/grade the area -- $1000 (estimate) Rl JDGrF.T If the Commission would like to move forward with the improvements, staff will prepare a plan and contact contractors for quotes. Abusive Language; Noisy Conduct: Persons engaged in offensive, obscene or abusive language or boisterous and noisy conduct tending reasonably to arouse alarm, anger or resentment will not be allowed. �c B. Advertising, Selling And Solicitation: No advertising, unapproved selling or solicitation is allowed. An Exclusive Use Permit may be approved by the City Council and issued by the City Clerk for the selling of food, alcoholic or nonalcoholic beverages as established by City Council resolution. C. Alcoholic Beverages: Consumption or possession of alcoholic beverages is not permitted unless a permit is obtained under Subsection B of this section. D. Fires 1 : It shall be unlawful to build or attempt to build a fire except in areas designated for such purpose. No person shall drop, throw, or otherwise scatter lighted matches, burning cigarettes or cigars, tobacco, paper or other flammable material. E. Firearms And Explosives: No firearms (as defined by city ordinance) z or explosives shall be present or used unless approved by the City Council. Authorized law enforcement officials shall be exempt from this regulation. F. Gambling: Gambling shall not be allowed. G. Golfing: No person shall be allowed to golf or practice golf. ' See also title 7, chapter 3 of this code. 2 See subsection 5-4-1A of this code. 3-5-8: PEDDLER THIRTY DAY LICENSE: Peddlers shall first apply for and obtain a peddler thirty (30) day license pursuant to Section 3-5-4 of this chapter and as set forth herein. All peddler thirty -(30) day licenses are subject to the following: A. Licenses are valid for a period of thirty (30) days. B. No peddlers shall conduct activities in such a manner to impede, interfere with or otherwise obstruct motor vehicle and/or pedestrian traffic and safety. (Ord. 250A, 7-17-2001) 3-5-9: CHRISTMAS TREE SALES: Vendor shall first apply for and obtain a Christmas tree sales license pursuant to Section 3-5-4 of this chapter and as set forth herein. All Christmas tree sales vendor licenses are subject to the following: A. Licenses are valid for a period of thirty (30) days. B. Written consent of the owner of the property where the sales will occur. C. The fee for a Christmas tree sales vendor will be the same as a transient merchant license. D. Licenses will only be granted for operations in commercially zoned districts. (Ord. 2508, 11-20-2001) S-1fif: OUTDOOR FOOD AND BEVERAGE PROMOTION AND SALES EVENT LICENSE: A. Application For License; Duration: An application for a license for outdoor food and beverage promotion shall be applied for and may be granted by the city. The duration of the outdoor food and beverage promotion shall be no longer than ten (10) days. B. Document Depicting Sales Area Requirements At Site: A sketch shall be provided which details where said outdoor food and beverage promotion shall be located on the property, indicating lot boundary lines, building locations, setbacks and traffic patterns for both pedestrians and vehicles. Additional information may be required if sufficient documentation is not provided. C. County License Required: A license from the County Health and Environmental Services Department shall be applied for and granted, and a copy of such license shall be provided to the city at the time said application is completed. D. Number Of Events: Outdoor food and beverage promotions shall occur no more frequently than twice in any calendar year. E. Hours: The hours of operation shall be between seven o'clock (7:00) A.M. and eleven o'clock (11:00) P.M. and shall be mentioned in the license application. (Ord. 250A, 7-17-2001) F. Any organization, society, association or corporation desiring to solicit, or have solicited in its name, money, donations of money or property or financial assistance of any kind or desiring to sell or distribute any item of literature or merchandise for which a fee is charged or solicited from persons other than members of such organizations, upon the streets, in office or business buildings, by house to house canvass or in public places for a charitable, religious, patriotic, philanthropic or other nonprofit purpose shall be exempt from Sections 3-5-3 and 3-5-4 of this chapter, provided a sworn registration application in writing on a form furnished by the city is filed which shall include the following information: a. Name and purpose of the cause for which the license is sought. b. Names and addresses of the officers and/or directors of the organization. c. The period during which the solicitation is to be carried on. d. Whether or not any commissions, fees, wages or emoluments are to be expended in connection with such solicitation. 2. Upon the foregoing being satisfied, such organization, association or corporation shall furnish all its members, agents or representatives conducting the solicitation credentials in writing stating the name of the organization, name of agent, and the purpose of the solicitation. As mentioned at the last Park and Recreation Commission meeting, the direction from the City Council at the joint meeting in October 2017 is for Park and Recreation Commission to determine the priority of each of these parks and features within the park so that when the time comes to replace existing items or pieces of equipment (for example playground equipment) due to condition, age, ADA requirements, and/or lack of resident use, the City will have a plan in place on how to deal with each park when it is brought up for discussion by staff or the residents. By identifying the priorities for each of these parks and what items or equipment will or will not be replaced or repaired has an impact on the Existing and Future Park Facilities Chart (replacement section of the spreadsheet) could reduce the cost to the general fund to replace or repair these features. DISCUSSION The target date for draft CIP is June 1st. Also attached is a projected fund balance sheet that was prepared recently by the Finance Department for your use. The Commission should pay attention to the status of 2018 end of the year balance. Projects that are anticipated for 2018 are or will need to be identified on the spreadsheet are as follows: • Fox Meadows Park (carryover project from 2017) -- $20,000 (estimate) This amount represents the funds that are needed to be complete the improvements that were made at the park in 2017. • Sophies Park (new) -- $11,950 (estimate). Winslow Cove Phase 1 (single family residential area) is anticipated to move forward in 2018 which will include new park land that will be added to Sophies Park. Since a new trail has been recommended to constructed thru the park, now is the time to install the trail with other improvements (streets, utilities and trail along Xeon Street NW) that will be constructed by the developer. • Rose Park Shelter (new) -- $2288 (estimate) This amount represents the additional concrete that will be added around the perimeter of the shelter. Note: A sidewalk will need to be constructed to provide ADA accessibility which is estimated at $6650 (staff will obtain quotes for this work from the contractor that will be constructing the shelter). If the Commission would like to include the concrete slab for a concession trailer it is estimated to cost $1400. • Irrigation Project (already identified as a CIP project in 2018) — $45,000 (estimate) Two irrigation projects (Wild Iris and Hills of Bunker Lake West) are planned for 2018. • Terrace Park (new) -- $2300 (estimate) Since there are not enough funds within the project budget to install both what the neighborhood has requested and replace the 2-5 year old playground, the neighborhood is requesting that the City purchase and a new Spinning Whirl. Since this is not a replacement item, it would be funded from Park Dedication funds. As noted in the past there are a number of parks that do not have security lights. Also keep in mind the Public Works Parks Department has expressed concern in the past that some of the parks need to be updated with a paved surface parking lot throughout the parks system including Prairie Knoll Park. If the Commission is interested in knowing the planned improvements for all the parks, please review the most current spreadsheet that is in the Information Packet that is updated every year. BUDGETIMPACT Depending on what the Commission would like to recommend for projects, the Finance Department has indicated to Public Works Department that the ending fund balance for each of the 5 years should have a minimum positive balance of $50,000.00 or more. Consider Potential Andover Community Center and YMCA Program Ideas/Events DATE: March 22, 2018 INTRODUCTION The Park and Recreation Commission is requested to consider Andover Community Center and YMCA program ideas/events for the upcoming spring and summer season. DISCUSSION Attached with this item is Page 5 from the March 1, 2018 meeting minutes for your review as to the discussion about bringing ideas to this meeting. The full set of meeting minutes are located in the side pocket of the packet for review. Each Park and Recreation Commissioner is to prepare a list of ideas/events and bring it with you to the meeting for discussion. Once a finalized list has been prepared by the Commission, it would be forwarded to the Andover Community Center staff and the YMCA. ACTION REQUIRED The Park and Recreation Commission is requested to consider potential Andover Community Center and YMCA program ideas/events for the upcoming spring and summer season. She explained that this would make it difficult to structure the programming as was suggested. Mr. Sutherland stated that they should try to come up with four or five programs and work together to get things jumpstarted. Commissioner Butler agreed that staring small scale could be a good idea. Mr. Dickenson questioned if there would be enough of a demand to sustain long-term programming efforts if they were to start small scale. Commissioner Marinello stated that they could do a planting event perhaps for Arbor Day. She stated that she felt an event like this would be of low cost to the City. Chair Stenzel inquired if they would like to circle back on some of these ideas at the next meeting. He suggested that they come up with a few specific program ides and thoughts on how the events could be operated. Mr. Sutherland agreed that would be a good idea. Chair Stenzel suggested that a task force could be formed. Ms. Boes commented that spring and summer programming will be starting soon, so it would be a good to get things rolling sooner than later. CIIAIR'S REPORT Chair Stenzel did not have any report updates.
