Motion carried 6 The Shops @ Andover, 13650 Hanson Boulevard- Twins Cities Dental has received their Certificate of Occupancy. The last space in the building has been rented out to SportClips. SportClips permit application has been reviewed and staff is waiting on the SAC determination by Met Council. Estates at Arbor Oaks/Trident Development, 1753 156" Lane — In the process of renting out units. Daycare Interest — A daycare facility has expressed interest in locating in Andover and has been given an extension for one particular location. Restaurants/Fast Food — Currently staff is aware of two companies continuing to look for land to locate in Andover. Andover Economic Development Authority Meeting Minutes —September 19, 2017 Page 2 1 Upper Midwest Athletic Construction — A CUP was granted. Staff is waiting for the 2 Commercial Site Plan to be submitted. 3 4 Andover Cinema, 1836 Bunker Lake Boulevard — A CUP was granted for liquor sales and an 5 On -Sale Liquor License was issued. 6 7 Pack Leader Behavior & Training — Received a CUP for Commercial Animal Training at 8 158257 1h Avenue. Final inspection and parking lot improvements are complete. 9 10 Overall Marketing — Staff continues to work with parties interested in investing in Andover. 11 The City will have a booth at the upcoming UpRiver Commercial Broker Event. There will be 12 over 100 brokers attending and an update given on the County as a whole. 13 14 Northern Natural Gas/Centerpoint Energy — Tank installation is in progress. 15 16 Interest in Hughes Industrial Park — Businesses continue to show some interest in the area. 17 18 Clocktower Commons — The clock will be a physical part of the last building. Staff is in the 19 process of working with the owner on the placement of an electronic message board. 20 21 Open to Business — The 2017 first half year report was reviewed. 137 clients have been served 22 as part of the program with 28 businesses or residents interested in starting a business or location 23 in Andover. 24 25 Commissioner Bukkila requested the financing part of the report show in what city the clients 26 that received funding are in. 27 28 Commissioner Twistol suggested the City send a letter or proclamation to the businesses in 29 Andover expressing appreciation for them. 30 31 3121 1611 Avenue — An individual is interested in the location for a doggie daycare/boarding 32 facility. The EDA saw this as a positive and directed staff to continue working with the 33 individual. 34 35 DISCUSS PRESBYTERIANHOMES REQUEST FOR LOW-INCOME RENTAL 36 CLASSIFICATION FOR THE FARMSTEAD FACILITY 37 38 Mr. Dickinson stated Presbyterian Homes is requesting the City's consideration of a Low - 39 Income Rental Classification (LIRC) for their Farmstead facility. Mr. Dickinson reviewed the 40 request with the EDA. The contract would expire in 2029. The State standard would require 28 41 units to be low income. There is also an annual compliance review. 42 43 Motion by Holthus, Seconded by Goodrich recommending to City Council approval of the 44 agreement allowing for a Low -Income Classification for the Farmstead facility. Mr. Dickinson indicated there is another target area staff would like the EDA to consider pursuing properties in. The area was discussed. The EDA directed staff to pursue the properties in the other target area. Mr. Dickinson stated staff will continue to monitor both target areas. OTHER BUSINESS There was none. (763) 755-5100 FAX (763) 755-8923 • WWW.CI.ANDOVER.MN.US TO: FROM: SUBJECT: DATE: President and EDA Commission Members Jim Dickinson, Executive Director Approve LMCIT Liability Coverage - EDA November 21, 2017 INTRODUCTION The League of Minnesota Cities Insurance Trust (LMCIT) requests that participating EDA's annually decide whether or not to waive the statutory tort liability limits established by Minnesota Statutes 466.04. DISCUSSION Attached is the "LMCIT Liability Coverage — Waiver Form" provided by the LMCIT, which provides a description of the options available to the City of Andover EDA. Currently the City of Andover EDA DOES NOT WAIVE the monetary limits on municipal tort liability established by Minnesota Statutes 466.04. I am recommending continuing with the past practice. BUDGETIMPACT No budget impact if the EDA does not waive limits. ACTION REQUESTED The City of Andover EDA is requested to not waive the monetary limits on tort liability established by Minnesota Statutes 466.04. ,IpWly submitted, \\ Jim CONNECTING & INNOVATING SINCE 1913 LIABILITY COVERAGE - WAIVER FORM LMCIT members purchasing coverage must complete and return this form to LMCIT before the effective date of the coverage. Please return the completed form to your underwriter or email to pstech@lmc.org This decision must be made by the member's governing body every year. You may also wish to discuss these issues with your attorney. League of Minnesota Cities Insurance Trust (LMCIT) members that obtain liability coverage from LMCIT must decide whether to waive the statutory tort liability limits to the extent of the coverage purchased. The decision has the following effects: If the member does not waive the statutory tort limits, an individual claimant would be able to recover no more than $500,000 on any claim to which the statutory tort limits apply. The total all claimants would be able to recover for a single occurrence to which the statutory tort limits apply would be limited to $1,500,000. These statutory tort limits apply regardless of whether the city purchases the optional excess liability coverage. If the member waives the statutory tort limits and does not purchase excess liability coverage, a single claimant could potentially recover up to $2,000,000 for a single occurrence. (Under this option, the tort cap liability limits are waived to the extent of the member's liability coverage limits, and the LMCIT per occurrence limit is $2 million.) The total all claimants would be able to recover for a single occurrence to which the statutory tort limits apply would also be limited to $2,000,000, regardless of the number of claimants. a If the member waives the statutory tort limits and purchases excess liability coverage, a single claimant could potentially recover an amount up to the limit of the coverage purchased. ANDOVER COMMERCIAL PROJECTS • The Shops @ Andover, 13650 Hanson Boulevard NW —Natural Nails, Dunkin Donuts, Joy Kitchen is open. Twin Cities Dental is open. The company would like to relocate from their current Andover location at Round Lake Blvd. and 16151 Ave. NW.
