10 The Regular Bi-Monthly Meeting of the Andover City Council was called to order by Mayor Julie
11 Trude, August 2, 2017, 7:00 p.m., at the Andover City Hall, 1685 Crosstown Boulevard NW,
12 Andover, Minnesota.

Motion by Goodrich, Seconded by Knight, approval of the Consent Agenda as read. Motion carried
unanimously.
CONSIDER ARBOR OAKS SENIOR LIVING REQUESTS
7 Mr. Dickinson explained that Arbor Oaks Senior Living, LLC, is undertaking a HUD refinancing and
8 as part of that refinancing is seeking various TIF contract amendments and consents from the City of
9 Andover to complete that refinancing.

11 At the June 6 EDA meeting, City Administration & Roger Fink, representing Arbor Oaks Senior
12 Living, LLC, provided background on the request and the impacts and benefits of the potential
13 refinancing plan. Since that meeting, and with the EDA's direction, City Administration and bond
14 counsel have worked with Arbor Oaks Senior Living, LLC, representatives on TIF contract
15 amendments and consents needed to complete the refinancing. City bond counsel, Briggs & Morgan
16 and City Administration, has extensively reviewed the prepared documents. An important aspect
17 was for all the parties involved to acknowledge that to keep the stream of TIF payments coming, the
18 terms of the original development agreement must be complied with. City Administration was before
19 the Andover EDA earlier this evening and received a recommendation to the City Council for
20 approval of the documentation.

22 Mr. Dickinson reviewed the information with the Council.

24 Mayor Trude stated the matter was essentially refinancing of the property and had been reviewed by
25 the EDA at a prior meeting.

27 Motion by Bukkila, Seconded by Knight, to approve the documents that were presented and to direct
28 the City Clerk to execute the documents. Motion carried unanimously.

31 ADMINISTRATOR REPORT

33 City Staff updated the Council on the Administration and City department activities, legislative
34 updates, updates on development/CIP projects, and meeting reminders/community events.
35
36 (Mr. Dickinson) Mr. Dickinson explained his active involvement in policy decision making
37 meetings, including Met Council. Next week, a meeting of SAC Task Force is scheduled to discuss
38 charges related to sewer access. At that meeting, they hope to finalize how commercial properties
39 will be charged SAC. Sixty-four new homes have been permitted so far this year. The housing
40 market is moving well but will likely not reach the same number of permitted houses as in 2016.
41 Road reconstruction projects are on schedule. The wetland restoration is now moving along with the
42 improvement in the weather, the completion date for the project has been moved from July 1 to
43 September 15.

1 Councilmember Goodrich asked when the construction on Bunker Blvd would be ending. Mr.
2 Dickinson responded that the new date was August 19th and that it had been extended one week. He
3 encouraged City residents to refer to the Anoka County website for the latest information.

5 MAYOR/COUNCIL INPUT

7 (Night to Unite) Mayor Trude thanked residents and Councilmembers for participating in Night to
8 Unite the previous evening. She also thanked the staff for visiting the neighborhood gatherings. She
9 had visited 13 parties with those whom she was riding with. She stated that the fire department is
10 always looking for members and a few residents had indicated interest at the parties she visited. She
11 encouraged neighborhoods to still have events in the fall and not wait until next year. The Mayor
12 encouraged neighbors to work together and to watch out for each other and reduce crime.

14 Councilmember Knight commented about his pride in the City having a number of female
15 firefighters.

17 Councilmember Goodrich noted that there had been a nice gathering in his own neighborhood and
18 how good it is to meet new families.
19
20 Councilmember Bukkila indicated that law enforcement can be supportive of block parties in
21 individual neighborhoods and that she appreciated everyone's involvement.

23 Mayor Trude then indicated that the Council would be going into a closed session on two items:
24 property negotiations for PID 22-32-24-42-0007 and Public Works Union negotiations, which are
25 both allowed to be heard in a closed session.

29 Mayor Trude recessed the regular City Council meeting at 7:14 p.m. to a Closed Session of the City
30 Council to discuss the property negotiations for PID 22-32-24-42-0007 and Public Works Union
31 negotiations.

DISCUSSION
Claims totaling $187,256.04 on disbursement edit lists #1— #2 from 08/03/17 to 08/10/17 have been issued and
released.
Claims totaling $141,704.76 on disbursement edit list #3 dated 08/15/17 will be issued and released upon
approval.
BUDGET IMPACT
The edit lists consist of routine payments with expenses being charged to various department budgets and
projects.
ACTION REQUESTED
The Andover City Council is requested to approve total claims in the amount of $328,960.80. Please note that
Council Meeting minutes will be used as documented approval.

INTRODUCTION
The City Council is requested to approve a resolution designating no parking along Wintergreen
Street NW in Country Oaks North 3`d Addition Project.
DISCUSSION
With the Wintergreen Street identified as collector streets in the current Transportation Plan and the

INTRODUCTION
The City Council is requested to approve the attached roadway and drainage and utility easement at
the east end of 167th Lane NW to allow City staff to construct a proper turn around for plow trucks
and school buses.
DISCUSSION
Property owner on 167th Lane approached the City a few months ago regarding the school district
not allowing buses down 167th Lane NW due to the concern that there is not an adequate turn
around at the end of the road. Students have been walking or driven as far as 3/4 of a mile to the bus
stop on Verdin Street.
Although there is a large easement that exists to construct the turnaround as identified on the
attached drawings that location would be a major impact to one of the properties at this time. The
residents were willing to dedicate easements further west so that the impacts could be less.
Once the easements are approved Public Works crews will begin the placement of class 5 at the end
of this gravel road to provide the turnaround for plows and buses.
BUDGETIMPACT
The Road and Bridge Fund will cover the cost of the class 5 and the easement were acquired for
$1.00 per property.
ACTION REQUIRED
The City Council is requested to approve the attached roadway and drainage and utility easement at

The Building Department is recommending the addition of a window and/or door replacement permit for $75. As
Minnesota building codes and window and door replacements have become increasingly complex, a building
permit and conducting an inspection is needed.
BUDGETIMPACT
The additional revenues will help offset the operational costs of the Community Center and cover the cost of a site
inspection for window and/or door replacements.

INTRODUCTION
The applicant is seeking a CUP for a Commercial Animal Training at the existing building.
Commercial Animal Training can be allowed as a CUP in the neighborhood business district.
The approximate 2 acre parcel is located in the southwest quadrant of 7th Avenue and Valley
Drive. Staff has often heard the site referred to as the "Old Tom Thumb" site and "Old Quick,
Stop" site. The proposed building to host the commercial animal training is 3,500 square feet
and will require updating of electrical, HVAC, plumbing and parking lot improvements. All
training will take place indoors and there will be no outdoor space used for training purposes.
DISCUSSION
The applicant originally started the business by offering in-home canine training for five years
and in 2012 obtained a CUP for commercial animal training at 3131 161St Avenue NW (former
Andover Liquor). The applicant is now seeking to relocate to 15825 7" Ave NW.
Days and Hours of Operation
The applicant stated the days of operation at the facility will be Saturdays and Sundays along
with week nights, depending on the needs of the clients. On the weekends, there will be three
classes in the afternoon, each lasting one hour, and on weeknights, there will be one to two
evening classes lasting one hour. Outside of class time, the facilities will be closed. This is
strictly a space for obedience training; there will be no boarding, grooming, or other related
services. During the Planning Commission Public Hearing, folks at the hearing expressed
concern with the ability of classes to occur at any time during the day. The Planning
Commission is recommending to the City Council to include a condition of limiting class hours
to 8 am to 9:30 pm 7 days a week (Condition 45 in the draft resolution).
Traffic
It is not expected that this facility would generate large amounts of traffic and is expected that
the roadway system will receive a minimal increase in traffic and will not adversely affect the
surrounding roadways. The property currently has two access points. One is on 7th Ave and the
other is on Old Valley Drive. These two access points will continue to serve the property.
Parking
City Code 12-13-8 specifies the number of parking spaces required. In 2012, staff classified the
use as "retail store and service establishments" for the purposes of determining parking stalls.

"Retail store and service establishments" require one parking space per 200 square feet of floor
area.
The building size is 3,500 square feet. This would require 18 parking spaces. The applicant has
indicated that the property owner will refurbish the parking lot which will require a Commercial
Site Plan for the parking improvements.
Review Criteria
12-14-6 B: Criteria for Granting Conditional Use Permits:
1. In granting a Conditional Use Permit, the City Council shall consider the advice and
recommendation of the Planning and Zoning Commission and:
a. The effect of the proposed use upon the health, safety, morals, and general
welfare of occupants of surrounding lands.
b. Existing and anticipated traffic conditions, including parking facilities on adjacent
streets and land.
c. The effect on values of property and scenic view in the surrounding area, and the
effect of the proposed use on the Comprehensive Plan.
PLANNING AND ZONING COMMISSION DISCUSSION AND RECOMMENDATION
Public Hearing Summary:
• Will any outdoor training or demonstrations be conducted?
According to condition of the resolution if approved would restrict training to inside
the building.
• How long is the business expected to occupy this location: what is the term of the lease
commitment?
The City does not typically ask these questions of an applicant as this is a business
decision between the landlord and tenant. With a CUP if the use of the Commercial
Animal Training stops for a one year time period then a new CUP would be required
for a Commercial Animal Training facility.
• What will be the hours of operation?
The applicant indicated that classes tend to occur during the evenings on weekdays
and then typically during the day on weekends. The Planning Commission is
recommending the City Council consider condition 0 in the draft resolution that
would limit hours of operation to 8 am until 9:30 pm each day of the week.
• How much daily traffic to and from the building is anticipated and what will be the
primary entrance (7th Ave. or)?
The applicant noted that class sizes could be up to 15 pets, and the applicant could
carry out a few classes a day. It is believed by staff that the traffic generated by the
business would be less than the previous convenience store at the site.
• What improvements to the building exterior and surrounding landscape will be made?
The parking lot will be redone to provide for at least 18 parking stalls. It was noted
that by having someone in the building the site may not have as many "overnight
drop-offs" of items at the site.
• Will the building meet all City, County, and State codes for a commercial operation?
As the building sees improvements in electrical, plumbing, HVAC the building will
have to meet the current requirements.

• As an older building with on-site gasoline storage, has the building and grounds been
recently inspected for contamination (gasoline residue, asbestos, lead, etc.)?
A March 22, 20101etter from MPCA staff indicates that the site was "determined
that your investigation andlor cleanup has adequately addressed the petroleum tank
release at this site. The letter still allows for additional cleanup if needed and
MPCA reserved the right to reopen this file.
• What type of signage will be used on the building and on the elevated sign -post?
Signage will need to meet the sign ordinance requirements and a permit will be
required. The applicant indicated that both signs (on building and freestanding)
will be utilized. Proposed condition #4 indicates that non -related signage to the
business will need to be removed.
• Extensive Development for Fox Meadows Park improvements is ongoing; has there been
a city risk and impact assessment on the park related to this business establishment?
The thought of Dogs and Fox Meadow Park was discussed at ARC. Currently City
Code allows for dogs within city parks as long as they are on a leash and under
control.
ACTION REQUESTED
The City Council is asked to review the CUP request and consider the recommendation of
approval by the Planning and Zoning Commission.

onsite.
2. Applicant shall conduct animal training within the principal structure located South of
Valley Drive and East of 7`h Ave.
3. Commercial Site Plan (CSP) is submitted and approved for the parking lot
improvements.
4. Signage not related to the businesses occurring on the site shall be removed (taken
down) from the site.

The 3500 sq. ft. location wonderful spot, perfectly suited to expand the offerings of Pack Leader
Behavior & Training. Forthe past five years, Pack Leader Behavior & Training has offered in-home
dog training and behavior modification and group classes at 3131 1613t Ave NW to dog
owners in the Twin Cities and surrounding areas. Now, with the mae into this biggerfacility, we
can expand to server the larger customer base that have been joining PL13 for group
training and flextraining sessions to continue to educate owners and train dogs.
Physically, there will be no changes tothe facility. My needs dictate a wide opened room with no
encumbrances. This large room will be used to give group classes to dogs and owners in one hour
blocks of time. The facility can house classes of approximately 15 dogs in a class learning basic
obedience, basic manners, puppy obedience and socialization and other dog training type classes.
Owners will be with their dogs at all times. There will be no boarding, grooming or other services
sometimes associated with this type of facility. In addition, the group training classes will be
offered at a nominal fee to local shelter and rescue organizations to educate/train their foster
parents and dogs to increase the adoption rate of their animals.

1 Conditional use permits for uses not listed herein shall not be granted except where the city council determines that said
uses are similar in character to those listed herein. Within any of the following districts, no land or structure shall be
used for the following uses by districts except by conditional use permit and in accordance with the criteria as stated in
subsection 12-15-6D of this title.
2 Private sewer and water systems shall only be permitted on every other lot, or no more frequently than one private
system for each forty thousand (40,000) square feet where large lots are established. This shall not apply to lots of
record at the time this title is adopted. On each new plat, the lots are to be developed in accordance with this chapter

Concerns:
1. This former commercial location has been a derelict building for approximately 10 years
and continues to deteriorate to the point of now being a frequent community dump
site.
2. Due to the lack of reasonable property stewardship by the owners, it has continued to
deteriorate to the point of being a blight on our Andover community.
3. We do not believe that this property conforms to Andover City standards and seriously
question the viability for a commercial business of any kind without total renovation.

animal training facility at 15825 7th Avenue NW, an existing building on approximately 2
acres located in the southwest quadrant of 7`h Avenue and Valley Drive. Community
Development Director Janish reviewed the proposed commercial animal training facility
with the Commission. This use can be allowed as a CUP in the neighborhood business
district. This 3,500 -sq. ft. building is often referred to as the Old Tom Thumb site or Old
Quick Stop site.
Community Development Director Janish stated the Planning Commission is asked to
hold a public hearing and provide a recommendation to the City Council regarding the
CUP request. He referred to two supplements distributed earlier this evening including a
copy of two brochures outlining Pack Leader Behavior and Training from the applicant
and an email of questions and concerns from Robert and Faith Whiteraft, 16002 Valley
Drive NW.
Community Development Director Janish referred to a question from a Commissioner
regarding Chapter 12 Commercial/Industrial Permitted, Permitted Accessoryx
Conditional, Interim and Prohibited Uses and how animal training falls within a
neighborhood business. He referred to the Chapter's footnotes that states "for uses not
specifically identified but similar in character if related to other uses". He further noted
larger pet stores do allow for dog training and staff felt this use falls under retail or
veterinarian use with animals coming and going from the site. Community Development
Director Janish said the use will have no grooming or overnight stays and the brochure
provided refers to child pet safety courses, obedience training and others.
Chairperson Daninger referred to the submitted questions from Robert and Faith
Whitcraft and asked staff to respond. Community Development Director Janish reviewed
how outdoor training and demos would be conducted indoors, lease terms are not
specifically shared with the City, hours of operation, daily vehicle traffic is estimated to
be less than a convenience store; proposed improvements including updates to electrical,
plumbing, HVAC, that building code for commercial operations would need to be met as
part of the updates, inspection for contamination such as gasoline or asbestos, signage,
and risk and impact assessment on Fox Meadows Park.
Commissioner Koehler stated he would be recusing himself from consideration of this
item as he and the applicant have been friends for many years.
Commissioner Hudson inquired if staff knows of any concerns with the applicant's
current location. Community Development Director Janish said staff is not aware of any
concerns at the applicant's current location, however an individual this evening noted
prior to the meeting they believed that outside training was conducted at the current site,
but has not confirmed that event.
Commissioner Hudson asked if parking was based on what was done previously.
Community Development Director Janish stated parking for this site would be calculated
as the past site was calculated at 1/200 square feet.

Bob Woodcraft, 16002 Valley Drive NW, referred to his submitted email and shared
concerns about the condition of the site. He said while he was delighted to have a viable
business at this location it has been a public nuisance that should have been addressed
years ago and shared concerns about why it took so long to hold the property owner
accountable.
Joann Neve, Pack Leader Behavior & Training, LLC, 5701 Ambassador Boulevard, St.
Francis, applicant, explained classes would be held on Tuesdays 6:00-8:30 p.m.,
Wednesdays 6:00-7:00 p.m., Thursdays 6:00-8:30 p.m., Saturdays 9:00 a.m.-1:00 p.m.
and Sundays 10:00 a.m.-1:00 p.m. She reviewed class expansion possibilities but noted
she still has to work within people's schedules and that any daytime classes would likely
be seminars for dog owners only. Ms. Neve said they intended to use both signs that
would include their logo and simple text only and will be resurfacing the parking lot,
maintaining the weeds, and removing the graffiti. She said she will inform folks that
dogs are not allowed in the park.

Commissioner Cleven inquired about class length. Ms. Neve said classes last between 50
minutes to one hour and that there would not be more than 18 cars at one time.
Commissioner Nemeth asked how many classes the applicant holds currently. Ms. Neve
said she holds two classes per day with open time in between so there are not too many
dogs onsite at one time.
Commissioner Nemeth asked how many individuals are typically present. Ms. Neve said
summer is slow but attendance increases from September throughThanksgiving and then
again in the spring. She said summer classes are usually 5-8 per class; increasing to 12
per class during the winter months, adding she may add an additional staff person when
busy, to help with training.
Commissioner Nemeth referred to clean-up of dog waste. Ms. Neve saidrshe is diligent
regarding dog waste because puppies are present before all shots are complete, making
the waste potentially contagious and a health risk to all dogs onsite.

additional pavement will be needed or pavement will be removed from the site and if any
landscaping would be required to block headlights.
Mr. Whitcraft referred to overflow parking in the cul-de-sac from the park and concerns
about parking at the business occurring and asked if conditions are not followed what is
the process to address concerns. Chairperson Daninger explained the Planning
Commission makes recommendations for the City Council and how follow-up can be
done at City Hall or the Council level.
Community Development Director Janish explained if the applicant wishes to expand in
the future the City would review the possibility through a CUP. amendment which would
include public notice for another public hearing and process, site plan review, and
building permits. He added if the applicant operates differently than what is approved by
Council the City could in the worst case scenario act to revoke the CUP..
Anteneh Tsadik, 4141 160th Avenue NW, said he was pleased to see the site
improvements and stressed the importance of specific hours of operation to mitigate noise
impacts and safety concerns for this residential area.
Motion by Nemeth, seconded by Cleven'to close the public hearing at 7:51 p.m. Motion
carried on a 4 -ayes, 0 -nays, 1 -present (Koehler) 2 -absent vote, (Peterson, Sims).
Commissioner Nemeth inquired about hours of operation outlined in City Code, similar
to when Wal-Mart requested to be open 24 hours a day. Community Development
Director Janish said hours could be included as part of the CUP process and suggested
before Council consideration staff research or include language in the Resolution that
states specific hours unless' -City Code has a stricter time frame.
Chairperson Daninger asked how barking concerns would be addressed and suggested
screening or other noise buffering techniques. Community Development Director Janish
stated site plan review has not occurred yet but that parking requirements adjacent to
residential property triggers potential screening. He noted the site is surrounded by
public right-of-way and is like an island and does not really abut residential property.
Chairperson Daninger asked what other uses are allowed on this site. Community
Development Director Janish reviewed potential uses allowed by zoning.
Commissioner Nemeth suggested closing hours of 9:30 p.m.
Commissioner Cleven suggested limiting hours to 6:00 p.m. on Saturdays and Sundays.
Commissioner Nemeth referred to anticipated traffic on adjacent streets with Fox
Meadows Park. He said he is pleased to see a business moving in and improvement but
expressed concern on the number of people attending classes.

INTRODUCTION
Anoka County Sheriff's Department will present findings from a directed patrol assignment that was
conducted on Underclift Street NW north of Bunker Lake Boulevard.
DISCUSSION
Residents in the area of Underclift Street NW north of Bunker Lake Boulevard petitioned the City to
reinstall multi -way stops that were removed along Underclift Street because they did not meet
warrants at the crossroads of 138th Lane and 1401h Avenue.
This item was discussed in detail at the June 27, 2017 City Council Workshop that resulted in City
Council direction to gather more information. Meeting minutes are attached from that meeting for
your information and review. Also attached is a data sheet from the direct patrol assignment that
will be discussed in detail at the meeting.
ACTION REQUIRED
The City Council is requested review and discuss information presented and direct staff on how to
proceed.

DISCUSS /REVIEW STOP SIGN PETITION UNDER CLIFF STREET NW
Mr. Berkowitz stated a neighborhood petition was received from residents to re -install stop "signs
at 138`h Lane at Underclift Street and 1401h Avenue at Underclift Street. He added 170 signatures
were obtained from 109 households. He noted the City of Andover follows the Minnesota
Manual of Uniform Traffic Control Devices (MUTCD), which provides consistent rules and
regulations for appropriate signage, and these two stop signs were removed in 2016 as they did
not meet MUTCD criteria.
Mr. Berkowitz stated letters were sent in June 2016 to residents within 300 feet of the
intersections, and Councilmembers were contacted by residents. He added the City Council
visited the intersection on a bus tour, and in November 2016, voted to remove the signs by
November 21, 2016.
Mr. Berkowitz stated the MUTCD Manual is used consistently within the City of Andover for
decisions related to traffic signage, and liability is a concern.
Mary Froberg, 3788 — 1391h Lane, stated she lives near one of the intersections, and organized
the petition. She added residents on Woodbine Street overwhelmingly supported the petition.
She added there was an accident after the signs were taken out, as a driver was expecting to see a
sign there.
Rick Kielty, 3689 - 138`h Lane, stated many residents have been parking on Underclift Street to
slow traffic speeds. He added Underclift Street has become a cut -through route for drivers
wanting to avoid Round Lake Boulevard and Bunker Lake Boulevard.
Ms. Froberg stated residents are worried about high traffic speeds, and there are many children in
the neighborhood. She added the stop signs were put there to make the neighborhood safer.
Commander Brian Podany, Anoka County Sheriffs Office, stated, regarding the 2 crashes that
have occurred since the signs were removed, one crash was caused when a driver turned onto
Underclift Street and did not see an oncoming car and the other crash had a fatality, and it was
alcohol-related.
Mr. Kielty stated, in his opinion, the fatal accident would not have happened if the stop signs
were still there, because the driver would not have been able to accelerate as quickly.
Commander Podany stated the speed radar trailer has been used at this location due to speed
complaints, and the most recent time period was May14-18, 2017. He added the speed limit is
30 mph. He noted an average daily vehicle count of 1,493 with the majority of vehicles in the
26-30 mph range.

Mr. Kielty stated a lot of vehicles were going by, and the speed trailer was not lighting up. He
added he loved having it in the neighborhood. Commander Podany stated the trailer was moved
aroundbecause there was concern that it was not picking up speeds. He confirmed that the speed
sign indicator can have a calming effect.
Mr. Kielty stated he believes removing the stop signs on Underclift Street has made the
neighborhood less safe.
Kori Kielty, 3689 138th Lane, stated there are often cars parked on Underclift Street that make it
difficult to see oncoming traffic. She added she does not feel safe walking to the park anymore.
Al Lancette, 13880 Woodbine Street, stated he has lived in his house for 31 years, and the stop
signs were there for a reason. He added the cars coming up Underclift Street have nothing to
slow them down now, so they accelerate to get as much speed as they can.
Mr. Kielty asked what was the time of day when the City Council visited the neighborhood on
their bus tour. Mr. Berkowitz stated it was around 5:30-6:00 p.m., and they stayed for about 10
minutes. He added he also went to the neighborhood that day between 3:30-4:00 p.m. to observe
traffic with Councilmember Bukkila.
Mr. Berkowitz stated they visited the intersection of 140th Avenue and Underclift Street, and not
one car came to a complete stop. He added stop signs can give a false sense of security, if
drivers use an intersection often and never see another vehicle.
Councilmember Bukkila stated this is a driver behavior issue, and it's very unfortunate. She
added the City, like all other cities, must follow a set of rules and procedures that will determine
which precedents to take. She added a measure of consistency is required to prevent liability
issues for the City. She noted she did not see anything in this neighborhood that would warrant
stop signs, so it is important to use the manual for consistency.
Councilmember Holthus stated she has driven on Underclift Street for many years, and it doesn't
seem right without the stop signs. She added she believes people stopped at the stop signs.
Mr. Berkowitz stated the City Council could direct City staff to do another traffic study on
Underclift Street. He added usually the speeders are residents of the neighborhood.
Mr. Kielty asked whether the signs will be put back. Mayor Trude stated this is the fust such
discussion the City Council has had, and whatever is decided will affect the whole City. She
added whatever is done here will set a precedent for other neighborhoods with signed
intersections.

Councilmember Goodrich stated he is a retired law enforcement officer, and he agrees it is
generally residents of the neighborhood who are the violators. He added it is an assumption that
stop signs will make things safe, and numerous research initiatives have proven otherwise. He
noted the City Council must make a decision based on data, taking everything into consideration,
and what the outcome will mean for the City as a whole.
Chief Streich stated Mr. Kielty has indicated he believes Underclift Street has. become a cut -
through street for traffic trying to avoid the main roads. He added it would be helpful to do more
research, and provide justification and data to come up with a different solution.
Commander Podany stated traffic counts taken in this location were consistent both before and
after the stop signs were removed. He added the claim that this has become a cut -through route
is not consistent with this data, as the volume of traffic would have changed.
Mayor Trude thanked the residents who came to the meeting. She stated the City Council would
not make a decision tonight, but more information and data would be collected and the MUTCD
Manual guidelines would be used for purposes of consistency and liability.
Mr. Kielty asked when a decision would be made. Mr. Dickinson stated further data would be
collected and analyzed, and this matter would probably be ready for further review by the second
Council meeting in August. He added it would be unwise to move forward with a course of
action to the City Council without substantiation.
Councilmember Holthus stated, even though it goes against the data, she cannot imagine
Underclift Street without the two stop signs. She added she does not believe it is a safe situation,
and she supports whatever action is necessary to make it a safe situation.
Ms. Froberg stated she would ensure that every resident who signed the petition has the Non -
Emergency dispatch phone number, and make sure that they are reporting any incidents of
speeding on Underclift Street.
Mr. Kielty asked whether City staff can provide data related to accidents and citations on
Underclift Street during the last 20 years, or at least when the signs were still there. Commander
Podany stated that could possibly be done.
DISCUSS EMERGENCY OPERATIONS
Fire Chief Streich reviewed the proposed adoption of a new "All Hazard" emergency operations
plan for the City of Andover. He added the plan is designed to give City staff a set of procedures
for when disaster strikes within the community, and to .mnimie risk whenever possible.

INTRODUCTION
The City Council is requested to discuss the petition that was received to reinstall multi -way stops along
Underclift Street NW at 138 h Lane NW and 140th Avenue NW.
DISCUSSION
The City has evaluated multi -way stops throughout the City the past 6 years to determine if the locations
meet the placement through the Minnesota Manuel of Uniform Traffic Control Devices (MN MUTCD).
Through this process removal of multi -way stops have been reviewed and approved by the Public Works
Committee and the City Council.
A petition (attached) has been received from residents in the area to reinstall the multi -way stops along
Underclift Street NW at 138th Lane NW and 140th Avenue NW.
Residents within the proximity of each multi -way stop along Underclift Street NW were notified by letter
of the removal on in June 2016. The removal locations were reviewed by the City Council on a Bus Tour
Workshop on July 26, 2016. City Council formally approved removal on November 15, 2016. Removal
was completed by November 21, 2016.
ACTION REQUIRED
Staff is requesting direction on how to proceed with the petition request to reinstall stop signs along
Undercift Street NW.

determines that a special combination of geometry and
traffic volumes is present that makes it possible for right -
turning traffic on the approach to be permitted to enter the
intersection without stopping.
The design and application of Stop Beacons are described
in Section 4L.5.
2B.6 STOP Sign Applications

At intersections where a full stop is not necessary at all
times, consideration should first be given to using less
restrictive measures such as YIELD signs (see Sections 2B.8
and 2B.9).
The use of STOP signs on the minor -street approaches
should be considered if engineering judgment indicates that
a stop is always required because of one or more of the
following conditions:
A. The vehicular traffic volumes on the through street or
highway exceed 6,000 vehicles per day;
B. A restricted view exists that requires road users to stop
in order to adequately observe conflicting traffic on
the through street or highway; and/or
C. Crash records indicate that three or more crashes that
are susceptible to correction by the installation of a
STOP sign have been reported within a 12 -month
period, or that five or more such crashes have been
reported within a 2 -year period Such crashes include
right-angle collisions involving road users on the
minor -street approach failing to yield the right-of-way
to traffic on the through street or highway.
In many low volume situations with no unusual history of
intersection crashes, no control at the intersections is a cost
effective strategy. Research suggests that at most
locations, increasing the level of intersection control will not
improve safety (see FHWA-RD-81-084 Stop, Yield and No
Control at Intersections).
The use of STOP signs at grade crossings is described in
Sections 8BA and 8B.5.

211.7 Multi -Way Stop Applications
Multi -way stop control can be useful as a safety measure
at intersections if certain traffic conditions exist. Safety
concerns associated with multi -way stops include
pedestrians, bicyclists, and all road users expecting other
road users to stop. Multi -way stop control is used where the
volume of traffic on the intersecting roads is approximately
equal.
The restrictions on the use of STOP signs described in
Section 2B.4 also apply to multi -way stop applications.

The decision to install multi -way stop control should be
based on an engineering study.
The following criteria should be considered in the
engineering study for a multi -way STOP sign installation:
A.Where traffic control signals are justified, the multi -
way stop is an interim measure that can be installed
quickly to control traffic while arrangements are being
made for the installation of the traffic control signal.
B. Five or more reported crashes in a 12 -month period
that are susceptible to correction by a multi -way stop
installation. Such crashes include right -tam and left -
tum collisions as well as right-angle collisions.
G Minimum volumes:
1. The vehicular volume entering the intersection
from the major street approaches (total of both
approaches) averages at least 300 vehicles per hour
for any 8 hours of an average day; and
2. The combined vehicular, pedestrian, and bicycle
volume entering the intersection from the minor
street approaches (total of both approaches)
averages at least 200 units per hour for the same 8
hours, with an average delay to minor -street
vehicular traffic of at least 30 seconds per vehicle
during the highest hour; but
3. If the 85th -percentile approach speed of the major -
street traffic exceeds 40 mph, the minimum
vehicular volume warrents are 70 percent of the
values provided in Items 1 and 2.
D. Where no single criterion is satisfied, but where
Criteria B, C.1, and C.2 are all satisfied to 80 percent
of the minimum values. Criterion C.3 is excluded
from this condition.

A. The need to control left -turn conflicts;
B. The need to control vehicle/pedestrian conflicts near
locations that generate high pedestrian volumes;
C. Locations where a road use, after stopping, cannot
see conflicting traffic and is not able to negotiate the
intersection unless conflicting cross traffic is also
required to stop; and
D.Art intersection of two residential neighborhood
collector (through) streets of similar design and
operating characteristics where multi -way stop
control would improve traffic operational characteris-
tics of the intersection.
2B.8 YIELD Sign (111-2)
YIELD
Rt -2
The YIELD (RI -2) sign shall be a downward -pointing
equilateral triangle with a wide red border and the legend
YIELD in red on a white background.
The YIELD sign assigns right-of-way to traffic on certain
approaches to an intersection. Vehicles controlled by a
YIELD sign need to slow down to a speed that is reasonable
for the existing conditions or stop when necessary to avoid
interfering with conflicting traffic.
2139 YIELD Sign Applications
YIELD signs may be installed:
A. On the approaches to a through street or highway
where conditions are such that a full stop is not always
required.
B. At the second crossroad of a divided highway, where
the median width at the intersection is 30 feet or
greater. In this case, a STOP or YIELD sign may be
installed at the entrance to the fust roadway of a
divided highway, and a YIELD sign may be installed
at the enhance to the second roadway.
C. For a channelized tum lane that is separated from the
adjacent travel lanes by an island, even if the adjacent

lanes at the intersection are controlled by a highway
traffic control signal or by a STOP sign.
D. At an intersection where a special problem exists and
where engineering judgment indicates the problem to
be susceptible to correction by the use of the YIELD
sign.
E. Facing an entrance ramp onto a roadway, if
engineering judgment indicates that control is needed
because acceleration geometry and/or sight distance is
not adequate for merging traffic operation.
AYIELD (RI -2) sign shall be used to assign right-of-way
at the entrance to a roundabout YIELD signs at roundabouts
shall be used to control the approach roadways and shall not
be used to control the circulatory roadway.
Other than for all of the approaches to a roundabout,
YIELD signs shall not be placed on all of the approaches to
an intersection. When a YIELD sign is used at an intersec-
tion other than a roundabout, at least one other approach
to an intersection shall remain uncontrolled.
2B.10 STOP Sign or YIELD Sign Placement
STANDARD:
The STOP or YIELD sign shall be installed on the near
side of the intersection on the right-hand side of the
approach to which it applies. When the STOP or YIELD sign
is installed at this required location and the sign visibility is
restricted, a Stop Ahead sign (see Section 2C.36) shall be
installed in advance of the STOP sign or a Yield Ahead sign
(see Section 2C.36) shall be installed in advance of the
YIELD sign.
The STOP or YIELD sign shall be located as close as
practical to the intersection it regulates, while optimizing its
visibility to the road user it is intended to regulate.
STOP signs and YIELD signs shall not be mounted on the
same post
No items other than inventory stickers, sign installation
dates, and bar codes shall be affixed to the fronts of STOP or
YIELD signs, and the placement of these items shall be in
the border of the sign.
No items other than official traffic control signs,
inventory stickers, sign installation dates, anti -vandalism
stickers, and bar codes shall be mounted on the backs of
STOP or YIELD signs.
No items other than retoreflective strips (see Section
2A.21) or official traffic control signs shall be mounted on
the fronts or backs of STOP or YIELD signs supports.
Myth vs Real
Intersection Safety, Myth Versus Reality
Traffic engineering decisions about intersection
safety are often the product of factors and relation-
ships that are more complex than the casual
observer may realize. In many cases, evaluating
potential solutions to crash or violation problems
may reveal aspects of intefsection safety and effi-
ciency that are in conflict.imith
one another. In reality, traffic
engineers must always consider
a balance between managing
safety and improving intersec-
tion operations before making
their final choice for intersection
control.
Additional traffic safety measures are sometimes
necessary to offset increased traffic and speeding
through neighborhood streets. One way of improv-
ing waiting times at an intersection with a new sig-
nal Is to make sure the minor street waiting times
are less than they were before installation of the
signal, This improvement will encourage motorists
to use signals on main roads
instead of neighborhood streets.
Over the years, a number of
misconceptions about traffic -control
solutions have become apparent
This briefing sheet attempts to shed
some light on the rationale for why
certain traffic -control decisions are
appropriate and required.
The driving public has developed a number of mis-
conceptions about traffic control solutions over the
years. This brief attempts to expose some of
those myths and shed light on the rationale behind
certain traffic control decisions.
Myth 1: Installing signals always makes
intersections safer.
Reality.
The installation of unwarranted signals, or signals
that operate improperly, can create situations
where overall intersection congestion is increased,
which in tum can create aggressive driving behavior.
When more complex signal phasing causes longer
waiting times at intersections, both drivers and
pedestrians tend to become Impatient and violate
red lights, or drivers are tempted to. cut through
neighborhood streets. This subjects local residents
to a greater dsk of collisions, worse congestion and`
more air and noise pollution.
Clearly, traffic diversion to side streets is an undesir-
able side effect of long cycle lengths and conges-
tion. This diverted traffic may Increase risk on the.
side streets, but the cause of this increased safety
risk should not be attributed to the new signal.
On occasion, other traffic con-
trol options, such as stop control
or the Introduction of round-
abouts can perform as well as,
or even better than, signals in
managing both vehicle and
pedestrian traffic safety at inter-
sections. This Is particularly true when signals are
Inappropriately placed at locations where traffic
volume is relatively low. Intersections with signals
that have very low traffic volumes tend to tempt
drivers And, pedestrians to violate that red light.
Myth 2: Having a stop sign is always better
than no stop sign, OR, more stop signs are
always safer than fewer stop signs.
Reality:
Unwarranted stop signs create problems at both
the intersection and along the roadway by.
• Encouraging motorists to drive faster between
intersections in order to save time. Placing
stop signs on every low-volume local street pro-
motes speeding between the stop signs as
drivers try to offset the delays caused by stop-
ping at every intersection;
• Encouraging violation of traffic laws. As the
number of stop signs increase so that nearly
every intersection has one, the rate of stop sign
violations tends to Increase;
• Encouraging the use of alternate routes.

often causes traffic to use other neighborhood
routes to avoid a sequence of intersections
that may be controlled by stop signs; and
• Increasing the chance that drivers will disre-
gard conflicting vehicle and pedestrian traffic,
which raises the risk of collisions.
There is no evidence to indicate that stop signs
decrease the overall speed of traffic. Impatient
drivers view the additional delay caused by unwar-
ranted stop signs as "lost time" to be made up by
driving at higher speeds between stop signs.
Unwarranted stop signs breed contempt in motorists
who tend to ignore them or only slow down without
stopping. This can sometimes lead to tragic conse-
quences.
Stop signs should never be installed as a routine,

Placing four-way stop signs on roads of very

actions result which can increase safety risk at inter-
sections.
Placing four-way stop signs at every Intersection
where there were formerly only two-way stop signs
also usually increases congestion. Four-way stop
signs should only be considered after an engineer-
ing study and a capacity analysis are performed.
Generally, every State requires the installation of
traffic control devices, including stop signs, to meet
State standards of the department oftransporta-
tion.
The State standards are based on the Manual on
Uniform Traffic Control Devices (MUTCD). The
MUTCD is the national standard for traffic control
devices. It prescribes standards for the design,
location, use and operation of traffic control

Installing stop signs Instead of signals when there is
no Intersection traffic control, increasing the size or
visibility of existing stop signs, or placing them in a
better location often increases both vehicle and
pedestrian safety without the initial expense and
later maintenance costs of signals. While waiting
for signals to qualify for installation, the substantial
amount of money saved can be used to make
roads safer.
