10 The Workshop Meeting of the Andover City Council was called to order by Mayor Julie Trude,
11 June 27, 2017, 6:00 p.m., at the Andover City Hall, 1685 Crosstown Boulevard NW, Andover,
12 Minnesota.

29 2040 COMPREHENSIVE PLAN UPDATES

31 Mr. Berkowitz welcomed City Councilmembers and Planning and Zoning Commissioners to the
32 joint meeting; adding this format allows City staff to provide planning updates to both groups at
33 the same time.

35 Mr. Berkowitz stated City staff have been gathering background information for the
36 Comprehensive Plan, which is due to the Metropolitan Council in 2018. He added the City
37 Council's direction for the Transportation Plan was to base the update on the City's current plan,
38 which was approved in 2009. He noted reviews by City staff have shown the Transportation
39 Plan is a good document to follow.

41 a. Transportation Plan Update

43 Mr. Berkowitz added City staff hopes to identify hot spots - intersections or areas of concern - as
44 well as review potential roadway improvements and how the County roads system would be
45. affected. He added Anoka County is reviewing transportation analysis zones to determine future
46 improvements. He noted County representatives have asked what concerns the City has moving

1 forward, and City staff identified Hanson Boulevard as a potential 4 -lane road north to 161"
2 Avenue.

4 Mr. Berkowitz stated other potential 4 -lane roadways are Round Lake Boulevard and 7th Avenue.
5 He added these three north/south corridors are critical for the City's economic growth and
6 transportation system. He noted a railroad tracks overpass at Bunker Lake Boulevard was also
7 discussed.
8
9 Mr. Berkowitz stated Anoka County wants to give Crosstown Boulevard back to the City of
10 Andover, but in its current condition, the City is not interested in taking that roadway.
11
12 Mayor Trude stated Crosstown Boulevard and Andover Boulevard need to stay on the radar, in
13 terms of capacity for turn lanes.

15 Mr. Berkowitz stated City Administrator Jim Dickinson is part of the Highway 10 Corridor
16 Coalition, and they have also been discussing plans for Highway 65, that could involve a hybrid
17 freeway configuration.

19 Mayor Trude asked when the Transportation Plan will be ready for public review and comment.
20 Mr. Berkowitz stated the Transportation Plan draft is being prepared for review at an upcoming
21 City Council meeting. He added plans are being made for additional public workshops.

23 Mayor Trude asked whether the trails plan will be ready for review. Mr. Berkowitz confirmed
24 this. He added the trails plan will go to the Planning and Zoning Commission for their review
25 after Anoka County has provided their input.

27 Councilmember Goodrich stated he has received comments from residents about conditions and
28 maintenance on County Roads. Mr. Berkowitz stated that is a County funding issue, and Anoka
29 County representatives have indicated they are trying to initiate more projects by seeking
30 additional funding sources, other than Federal aid that are available to cities and counties.

32 Commissioner Peterson asked what traffic areas of concerns will be addressed in the
33 Transportation Plan, such as Crosstown Boulevard. Councilmember Holtus asked whether the
34 County wants to turn back Crosstown Boulevard to the City to avoid paying for improvements,
35 such as the proposed roundabout. Mr. Berkowitz stated City staff has reviewed hot spots with
36 the County and identified them in the Transportation Plan, and funding was sought and rejected
37 for the Crosstown Boulevard/Nightingale Street intersection. He added the County asked for the
38 City's grant solicitation information on a proposed roundabout, but that is not moving forward.

1 Mr. Berkowitz stated the City has indicated that any Crosstown Boulevard improvements are to
2 be undertaken by the County. He added other potential County projects in addition to a proposed
3 roundabout at Nightingale Street, are two pedestrian access underpasses.

5 Commissioner Peterson stated pedestrian access and the trail system are important assets, and
6 changes to the 2009 trails plan are necessary. Mr. Berkowitz stated trails adjacent to County
7 roads have been identified for improvements. He added neighborhoods have expressed interest
8 in new trails, although the trails system is currently very extensive. He noted it is important to
9 identify any potential gaps, and to build the trail system from the center out.

11 Commissioner Peterson stated there have been some nice enhancements to the trail system along
12 Hanson Boulevard. Mayor Trude stated the City Council had indicated the trail should remain
13 on the east side of Hanson Boulevard. Mr. Berkowitz stated there will be a continuous trail
14 system on the east side of Hanson Boulevard through Andover, extending from Coon Rapids in
15 the south up to 159th Avenue in Andover. He added the pedestrian underpass at Bunker Lake
16 Boulevard provides a trail connection to Bunker Hills trails.

18 Commissioner Nemeth stated he has been in contact with Commissioner Scott Schulte of the
19 Anoka County Board of Commissioners, regarding Round Lake Boulevard. He added a.5 -mile
20 stretch of the 4 -lane roadway narrows to 2 lanes, which creates a bottleneck. He noted
21 Commissioner Schulte, who is the County Board's Transportation Chairperson agreed to review
22 it. Mr. Berkowitz stated the County has not put in for any regional solicitation for improving
23 that section of roadway.

25 Mayor Trude stated she has received questions from residents about a potential railroad tracks
26 underpass.
27
28 Commissioner Nemeth stated the Round Lake Boulevard bottleneck situation is a
29 disappointment, because the roadway only narrows for %z mile, but causes major traffic back-ups.
30 He added he understands it is an issue of funding, but he was hoping the County would be
31 willing to help fix that.

33 Commissioner Peterson asked whether the County has indicated where they intend to use
34 funding generated from the sales tax dollars. Mr. Berkowitz stated they have also generated
35 funds from the leased vehicle tax, but they have not identified where the funding will go. He
36 added the City of Andover should lobby for the County to consider projects within Andover,
37 such as Round Lake Boulevard, which is a viable project that could move forward without
38 utilizing State funding.

40 Councilmember Holtus asked why Round Lake Boulevard was designed that way. Mr.
41 Berkowitz stated different funding sources were used for the intersection improvements, and

1 additional funding was not available to finish the project as there were other priorities at that
2 time.

4 Mayor Trude stated Crosstown Boulevard by Clocktower Commons, which is a City road has
5 major back-ups during heavy traffic due to lack of left turn lanes. She added she has heard from
6 residents that it is difficult to turn left onto Yellow Pine Street from Crosstown Boulevard. She
7 noted Hanson Boulevard will be closing for construction, and many drivers will use Crosstown
8 Boulevard.

10 Mr. Berkowitz stated City staff is hoping that Hanson Boulevard will stay open during
11 construction, as it is an important corridor. He added the intersection of Crosstown Boulevard
12 and Bluebird Street will have to be addressed.
13
14 Mayor Trude stated Clocktower Commons will continue to be developed, and activity will
15 increase, so drivers will end up using Yellow Pine Street and other routes to get to Hanson
16 Boulevard. She reiterated the need for turn lanes or bypass lanes.
17
18 Commissioner Koehler stated he is concerned about traffic on Crosstown Boulevard at the Fire
19 Station during heavy congestion. He added the entrance to the Fire Station could be completely
20 blocked, and this will be a problem if emergency vehicles need to exit that parking lot quickly.
21 He noted something should be done about that.
22
23 Mr. Berkowitz stated there is an interim design for that area in the Transportation Plan, that
24 would transition more of a free right turn, and could potentially be another roundabout candidate.
25
26 Commissioner Koehler stated this area is also dangerous for pedestrians who get in the way of
27 cars that are making a right-hand turn, because they cannot always see oncoming traffic on
28 Crosstown Boulevard. He added the City has done a fantastic job on its streets.

30 Councilmember Holthus stated she would like to see a pedestrian crosswalk of some kind at
31 Crosstown Boulevard and Xeon Street, as it is an extremely unsafe intersection for pedestrians.
32 Mr. Berkowitz stated that is not a controlled intersection, and there are challenges for adding a
33 crosswalk when there are no controls. He added since it is a City road there is potential for a
34 crossing signal there that may work.

36 Commissioner Koehler stated regarding the Fire Station access left turns could be prohibited
37 during certain times of the day like the high school. Mr. Berkowitz stated buses could turn there
38 during school hours, but are now prohibited. He added the County had hoped to put a median at
39 that location.

1 Mayor Trude stated the viability of a potential future site plan for the Andover Boulevard
2 wetlands should be considered.

4 b. Wastewater and Sewer Plan Update
5
6 Mr. Berkowitz stated this item would be postponed to the end of the meeting if time permits.

10 c. Water Resources Management Plan Update
11
12 Mr. Berkowitz stated the City Council approved the City's current Water Resource Management
13 Plan in June 2015. He added City staff uses this important document to plan for stormwater
14 runoff design and flood control, and the City requires developers to follow the manual, which
15 requires that all water must be treated before it discharges into lakes and rivers.
16
17 Mr. Berkowitz stated Andover is a relatively new community, and the goal is to protect its
18 infrastructure. He added there are no plans to update the Water Resource Management Plan.
19
20 d. Water Supply Plan Update
21
22 Mr. Berkowitz stated the City's Water Supply Plan was submitted to the Minnesota Department
23 of Natural Resources (MnDNR) in December 2016 for review and approval. He added the Plan
24 provides water projections into 2040 and identifies areas for improvement, to ensure adequate
25 water supply in the system to serve the City of Andover. He noted DNR approval should be
26 granted within the next few months.

28 Mayor Trude asked whether there has been any feedback on the monitoring of the well in Bunker
29 Park. Mr. Berkowitz stated the DNR requested analysis of a well near Bunker Lake, to
30 determine whether there is a correlation between the well and the municipal water system. He
31 added City staff has determined that there is no correlation.

33 Mr. Berkowitz stated the Water Supply Plan identifies potential water conservation efforts and
34 irrigation system limits. He added City staff has partnered with Conserva Irrigation to improve
35 irrigation systems.

37 Councilmember Holthus stated there was concern expressed by residents at Fox Meadows about
38 the water table. Mr. Berkowitz stated the City offered residents an opportunity to put a
39 transducer in their wells during test pumping. Three of the four wells tested were in the upper
40 lying aquifer, so there was no impact. He added the fourth property was in the aquifer, and there
41 was insignificant drawdown there.

1 Commissioner Cleven asked whether sprinkler use is being limited. Mr. Berkowitz confirmed
2 that Andover is limiting residents to odd/even days, and restrictions of no watering between
3 12:00 p.m. — 6:00 p.m.

5 Commissioner Cleven stated some schools and parks have sprinklers going off in the late
6 morning. Mr. Berkowitz stated the schools have their own irrigation wells, and some City parks
7 are separate from the municipal water system.
8
9 Commissioner Cleven stated the water pressure in his neighborhood has dropped over the years,
10 possibly due to large housing developments to the north of his home. He asked whether the
11 City's anticipated growth will affect the system's water pressure, and how that can be
12 anticipated. Mr. Berkowitz stated there are many loops within the system that need to be
13 addressed that will affect future water pressure. He added City staff plans to work with a water
14 consultant to analyze pressures, and static tests can be conducted at hydrants. He noted the City
15 has 2 water towers on different elevations, and only one connection to the City's southeast area.

17 Commissioner Koehler asked whether there are any concerns regarding the quality of the City's
18 municipal water. Mr. Berkowitz stated the City of Andover won.a national award for its use of
19 fluoride. He added there are two peaking wells that are rarely used, but have higher than
20 standard Federal allowable readings.

22 Mr. Berkowitz stated there has been a recent decline in water consumption, as citizens are
23 becoming more conscious of water conservation. He added numbers at the water treatment plant
24 have drastically reduced. He noted, if Andover continues this trend, less future infrastructure
25 may be necessary.

27 Commissioner Nemeth asked whether there have been issues with watering soccer fields at Pine
28 Hills Park. Mr. Berkowitz stated he has not heard of anything.

30 e. Parks and Open Space Plan Update

32 Mr. Haas reviewed the Parks and Open Space chapter of the City's Comprehensive Plan. He
33 stated City staff plans to meet with the Park and Recreation Commission to review potential park
34 improvements.

36 Mayor Trude asked whether the City takes locations for new parks into consideration when
37 working with developers, particularly in terms of available land that is within water and sewer
38 areas. She asked about Prairie Knoll Park. Mr. Haas stated the Park and Recreation
39 Commission has indicated they are not interested in adding new parks, and Prairie Knoll Park
40 will be reviewed by the City Council this winter.

1 Wastewater and Sewer Plan Update

3 Mr. Berkowitz stated, in 2015, the City of Andover adopted the use of "Atlas 14" to analyze
4 stormwater runoff, and to provide precipitation estimates. He added this provides data related to
5 flood plain potential, developable area, and the City's sewer system. He noted Assistant City
6 Engineer Jason Law has been working on gathering wastewater system information into one
7 massive plan to determine required connections and impact downstream as well as identify new
8 development strategies.

10 Mr. Berkowitz stated, with regard to future developable area, the previous flood plain did not
11 include the entire Rural Reserve area, which is approximately 900 acres and includes a flood
12 plain that starts at South Coon Creek Drive. He added City staff is working with a stormwater
13 mitigation consultant to gain a general understanding of the flood plan, flood way and flood
14 fringe, and ways to identify them.

16 Mayor Trude stated she saw 30 -foot -high piles of dirt along Prairie Road just north of the Coon
17 Creek as part of the Catcher's Creek development. Mr. Berkowitz stated upland area must be
18 found to replace any wetland that has to be filled.
19
20 Mr. Berkowitz stated City staff is reviewing areas that can be removed from the wastewater
21 service area, which could lead to smaller rural lot sizes and lower impact on the City's
22 infrastructure.

24 Mr. Berkowitz stated affected homeowners will be consulted. Mayor Trude stated public
25 hearings will be necessary.

27 Commissioner Koehler asked whether final numbers would be available soon. Mr. Berkowitz
28 confirmed it will be ready for public review by the end of the month. He added City staff were
29 expecting to receive a draft today. Ms. Hanson stated the proposed draft Comprehensive Plan
30 will need that to go back to the Metropolitan Council for review and comment.

32 Commissioner Cleven asked if by removing a culvert the direction of water flow would change
33 since there is a certain volume of water. He added the culvert serves a purpose to channel water
34 out of an area. Mr. Berkowitz stated that is part of the analysis that was done, to determine
35 backwater and downstream water amounts, and can lead into flood fringe potential. He added
36 the culvert serves primarily as a bridge for vehicles, but there is also a headwater.

38 Mayor Trude asked whether any members of the audience wished to address this issue.

1 Al Lancette, 13880 Woodbine Street, stated his road was resurfaced and now all the tar is
2 starting to show through. Mr. Berkowitz stated that is the sealcoat. Mayor Trude asked Mr.
3 Lancette to leave his phone number so Mr. Berkowitz could call him.

5 Mayor Trude thanked City staff for providing this draft overview. She added any residents with
6 specific questions or concerns should contact City staff.

8 Commissioner Peterson asked whether there is general demand for lots smaller than 2 -acres in
9 size.
10
11 Mayor Trude stated she heard that Ham Lake lowered the lot size requirement to one acre, and
12 she would be interested to know their observations.
13
14 Councilmember Holthus stated she would like to know the total number of available lots.
15
16 Mayor Trude stated if a smaller area were to be made available by a developer, City staff could
17 provide options for development, and how to tie it in the present community.

19 DISCUSS 2040 COMPREHENSIVE PLAN UPDATE
20
21 Mr. Janish stated development of certain properties within the City have run into complications,
22 and City staff is exploring options regarding funding of infrastructure. He asked the City
23 Council to consider whether there is interest in converting the minimum lot size to something
24 other than 2.5 acres, which would provide more flexibility when working with developers.
25
26 Mr. Janish stated independent water supply for lots and developments is an important issue, and
27 he requested the City Council's feedback. He added it is an economic development tool to have
28 City water available, but it is not always feasible.
29
30 Councilmember Bukkila stated minimum lot size of 1.5 acres would be preferable to 1 acre, so
31 that would become the acceptable standard. Mr. Janish stated lacre lots have been approved by
32 PUD. He added Ham Lake is moving forward with 1 acre lots. He noted the State requires 2
33 Type 1 sites when looking at installing a septic system, separation from wells is important.

35 Mayor Trude stated she would like to see smaller road footprints for rural developments.

37 Councilmember Knight stated growth is inevitable, and the City should allow residents to do
38 what they want with their property whenever possible. He added, however, smaller lot sizes will
39 lead to transportation issues as well as the need for increased City services.

1 Councilmember Holthus stated she feels better about 1 acre lots in areas that are not already
2 developed. She added it would look odd to put a new one acre property in an established
3 neighborhood.

5 Ms. Hanson stated there could be a transition buffer zone between the 2.5 acre lots and smaller
6 lots.

8 Commissioner Koehler stated it is important not to destroy the aesthetic of a neighborhood. He
9 added residents have a reasonable expectation that their neighborhood will stay the same, and a
10 buffer zone makes sense. He asked how many lots are projected for future development, based
11 on current zoning, and how that would change if the zoning changed.
12
13 Mr. Janish stated, regarding 1 -acre lots, City staff could look at transportation issues, ground
14 water mitigation, and a potential transition buffer zone, and report back to the City Council and
15 Planning and Zoning Commission.

17 Mayor Trude stated many residents have said that they what more industrial/commercial use.
18 Mr. Janish stated higher density residential would be an impact, and sewer lines might not
19 always be feasible.
20
21 Councilmember Holthus asked how much development would need to take place to make that
22 feasible. Mr. Janish stated the Atlas 14 data is making it difficult to determine how many units
23 would be available to make a sewer pipe financially feasible.

25 Councilmember Bukkila asked whether it is worth the cost and effort or if the goal is to bring in
26 more commercial/industrial capacity. She asked whether the transportation system could handle
27 it. Mr. Dickinson stated to get the same number of units in the Rural Reserve taking into
28 consideration Atlas 14, may require higher densities on developable land. He asked if the group
29 would support higher densities.

31 Mayor Trude stated the City Council has been committed to maintaining the rural aspects of
32 Andover. She added people are willing to drive a little further because of the lot sizes and rural
33 nature of the community. She expressed concern that smaller lot sizes would change the nature
34 of the City and its residents. Mr. Dickinson stated the Comprehensive Plan will guide land use,
35 and any potential proposals that meet the land use will have to be reviewed.

37 Councilmember Bukkila stated she is hesitant to go below 2.5 acres, but there is a need to
38 potentially support the system that is in place, as well as prepare for future growth.

40 Councilmember Knight stated he would not support too much density, although it is important to
41 bring customers to the City's businesses, and attract more businesses.

1 Commissioner Koehler stated he echoes everyone's comments, but wanted to stress that high
2 density does not necessarily mean more crime. He added the most comments he has heard is that
3 the City Council and Commissioners need more information to make smart decisions. He noted
4 most people want to stay away from urban growth, but the City's infrastructure would not
5 support that anyway.

7 Commissioner Nemeth stated the resounding theme is that the cart is being put before the horse.
8 He added more information, statistics and analysis are necessary. He asked about other utilities,
9 such as Centerpoint Energy and Connexus, and whether they can accommodate potential future
10 growth.

12 Commissioner Peterson stated the rural nature and natural areas of Andover can be maintained
13 even with a little higher density. He stressed the importance of preserving the natural landscape
14 of the City of Andover.
15
16 Mayor Trude asked whether there were any audience members who wished to speak.
17
18 An audience member stated most of the City's lots could not be divided into 2.5 acres due to
19 locations of septic systems. He added it is possible to get up to 8 units per acre without having a
20 high rise, and still support the infrastructure.
21
22 Mr. Dickinson indicated staff will bring forward examples of developments to demonstrate the
23 corresponding density per acre.
24
25 Commissioner Nemeth stated he agrees with Commissioner Peterson that demand and lot size
26 will drive the Comprehensive Plan going forward. He added he has spoken with residents at Fun
27 Fest, and there is a lot of interest in larger lot sizes. Mayor Trude stated she has gotten those
28 calls too.

30 Commissioner Nemeth stated he would support 1.5 -acre minimum lot size as recommended by
31 Councilmember Bukkila.

33 Mayor Trude thanked the Planning and Zoning Commissioners for attending the joint work
34 meeting. The Planning and Zoning Commissioners left the meeting at 8:00 p.m.

1 DISCUSS /REVIEW STOP SIGN PETITION UNDERCLIFF STREET NW
2
3 Mr. Berkowitz stated a neighborhood petition was received from residents to re -install stop signs
4 at 138`h Lane at Underclift Street and 140`h Avenue at Underclift Street. He added 170 signatures
5 were obtained from 109 households. He noted the City of Andover follows the Minnesota
6 Manual of Uniform Traffic Control Devices (MUTCD), which provides consistent rules and
7 regulations for appropriate signage, and these two stop signs were removed in 2016 as they did
8 not meet MUTCD criteria.
9
10 Mr. Berkowitz stated letters were sent in June 2016 to residents within 300 feet of the
11 intersections, and Councilmembers were contacted by residents. He added the City Council
12 visited the intersection on a bus tour, and in November 2016, voted to remove the signs by
13 November 21, 2016.

15 Mr. Berkowitz stated the MUTCD Manual is used consistently within the City of Andover for
16 decisions related to traffic signage, and liability is a concern.

18 Mary Froberg, 3788 — 139`h Lane, stated she lives near one of the intersections, and organized
19 the petition. She added residents on Woodbine Street overwhelmingly supported the petition.
20 She added there was an accident after the signs were taken out, as a driver was expecting to see a
21 sign there.

23 Rick Kielty, 3689 - 138`h Lane, stated many residents have been parking on Underclift Street to
24 slow traffic speeds. He added Underclift Street has become a cut -through route for drivers
25 wanting to avoid Round Lake Boulevard and Bunker Lake Boulevard.

27 Ms. Froberg stated residents are worried about high traffic speeds, and there are many children in
28 the neighborhood. She added the stop signs were put there to make the neighborhood safer.

30 Commander Brian Podany, Anoka County Sheriffs Office, stated, regarding the 2 crashes that
31 have occurred since the signs were removed, one crash was caused when a driver turned onto
32 Underclift Street and did not see an oncoming car and the other crash had a fatality, and it was
33 alcohol-related.
34
35 Mr. Kielty stated, in his opinion, the fatal accident would not have happened if the stop signs
36 were still there, because the driver would not have been able to accelerate as quickly.

38 Commander Podany stated the speed radar trailer has been used at this location due to speed
39 complaints, and the most recent time period was May14-18, 2017. He added the speed limit is
40 30 mph. He noted an average daily vehicle count of 1,493 with the majority of vehicles in the
41 26-30 mph range.

1 Mr. Kielty stated a lot of vehicles were going by, and the speed trailer was not lighting up. He
2 added he loved having it in the neighborhood. Commander Podany stated the trailer was moved
3 around because there was concern that it was not picking up speeds. He confirmed that the speed
4 sign indicator can have a calming effect.
5
6 Mr. Kielty stated he believes removing the stop signs on Underclift Street has made the
7 neighborhood less safe.
8
9 Kori Kielty, 3689 138th Lane, stated there are often cars parked on Underclift Street that make it
10 difficult to see oncoming traffic. She added she does not feel safe walking to the park anymore.
11
12 Al Lancette, 13880 Woodbine Street, stated he has lived in his house for 31 years, and the stop
13 signs were there for a reason. He added the cars coming up Underclift Street have nothing to
14 slow them down now, so they accelerate to get as much speed as they can.
15
16 Mr. Kielty asked what was the time of day when the City Council visited the neighborhood on
17 their bus tour. Mr. Berkowitz stated it was around 5:30-6:00 p.m., and they stayed for about 10
18 minutes. He added he also went to the neighborhood that day between 3:30-4:00 p.m. to observe
19 traffic with Councilmember Bukkila.

21 Mr. Berkowitz stated they visited the intersection of 140th Avenue and Underclift Street, and not
22 one car came to a complete stop. He added stop signs can give a false sense of security, if
23 drivers use anintersection often and never see another vehicle.

25 Councilmember Bukkila stated this is a driver behavior issue, and it's very unfortunate. She
26 added the City, like all other cities, must follow a set of rules and procedures that will determine
27 which precedents to take. She added a measure of consistency is required to prevent liability
28 issues for the City. She noted she did not see anything in this neighborhood that would warrant
29 stop signs, so it is important to use the manual for consistency.

31 Councilmember Holthus stated she has driven on Underclift Street for many years, and it doesn't
32 seem right without the stop signs. She added she believes people stopped at the stop signs.

34 Mr. Berkowitz stated the City Council could direct City staff to do another traffic study on
35 Underclift Street. He added usually the speeders are residents of the neighborhood.

37 Mr. Kielty asked whether the signs will be put back. Mayor Trude stated this is the first such
38 discussion the City Council has had, and whatever is decided will affect the whole City. She
39 added whatever is done here will set a precedent for other neighborhoods with signed
40 intersections.

1 Councilmember Goodrich stated he is a retired law enforcement officer, and he agrees it is
2 generally residents of the neighborhood who are the violators. He added it is a dangerous
3 assumption that stop signs will make things safe, and numerous research initiatives have proven
4 otherwise. He noted the City Council must make a decision based on data, taking everything
5 into consideration, and what the outcome will mean for the City as a whole.
6
7 Chief Streich stated Mr. Kielty has indicated he believes Underclift Street has become a cut -
8 through street for traffic trying to avoid the main roads. He added it would be helpful to do more
9 research, and provide justification and data to come up with a different solution.
10
11 Commander Podany stated traffic counts taken in this location were consistent both before and
12 after the stop signs were removed. He added the claim that this has become a cut -through route
13 is not consistent with this data, as the volume of traffic would have changed.
14
15 Mayor Trude thanked the residents who came to the meeting. She stated the City Council would
16 not make a decision tonight, but more information and data would be collected and the MUTCD
17 Manual guidelines would be used for purposes of consistency and liability.

19 Mr. Kielty asked when a decision would be made. Mr. Dickinson stated further data would be
20 collected and analyzed, and this matter would probably be ready for further review by the second
21 Council meeting in August. He added it would be unwise to move forward with a course of
22 action to the City Council without substantiation.

24 Councilmember Holthus stated, even though it goes against the data, she cannot imagine
25 Underclift Street without the two stop signs. She added she does not believe it is a safe situation,
26 and she supports whatever action is necessary to make it a safe situation.

28 Ms. Froberg stated she would ensure that every resident who signed the petition has the Non -
29 Emergency dispatch phone number, and make sure that they are reporting any incidents of
30 speeding on Underclift Street.

32 Mr. Kielty asked whether City staff can provide data related to accidents and citations on
33 Underclift Street during the last 20 years, or at least when the signs were still there. Commander
34 Podany stated that could possibly be done.

38 Fire Chief Streich reviewed the proposed adoption of a new "All Hazard" emergency operations
39 plan for the City of Andover. He added the plan is designed to give City staff a set of procedures
40 for when disaster strikes within the community, and to minimize risk whenever possible.

1 Chief Streich stated the upper level of Lift Station 1 is being converted into the Emergency
2 Operations Center for the City. He added the use of this location will ensure continuity of
3 government operations.

5 Chief Streich will provide copies of the draft plan for the City Council's review and
6 consideration. He added the plan is required by State Statute to have City Council approval and
7 signatures.

9 Mr. Dickinson stated public safety is generally the first concern in an emergency situation. He
10 added, if such a situation occurs, the City Councilmembers can expect a phone call from him.
11 He added the phone call will indicate that either he has important information or he requires the
12 City Council's presence. He noted the City has not had an emergency declaration since 2007.
13
14 Chief Streich stated the Plan will be implemented in the case of a natural disaster or explosion,
15 but also in case of an emergency like the City of Blaine's recent water loss.

17 DISCUSS LOT SPLIT ISSUES

19 Mr. Janish reported staff was approached by an individual interested in acquiring a portion of
20 16659 Eldorado Street NW, which is currently zoned R-1 Single Family -Rural. Deeded acreage
21 for the parcel is 10.21 acres. He explained the potential owner has proposed to split the property
22 roughly in half to create approximately two 5 -acre parcels. It was noted that in the R-1 district,
23 the minimum lot size is 2.5 acres. Mr. Janish stated as the property exists today, several items,
24 one being street frontage, do not meet City requirements. Because of this, staff is looking for
25 direction from the City Council relating to the following questions:
26 1. Temporary or permanent cul-de-sac;
27 2. Would 166th Avenue be constructed to City standards; if not, what standards;
28 3. Who would pay for the roadway construction; and,
29 4. Would an easement or right-of-way be required for future extension of the roadway.
30
31 Mayor Trude requested clarification regarding a small section on the south edge of the property.
32 Mr. Janish stated that is showing up on the plat as a right-of-way, or unimproved roadway which
33 could be improved to City standards in the case of a lot split or cul-de-sac.

35 Mr. Berkowitz stated the City could consider allowing a gravel road, but that has not been done
36 for at least 20 years.

38 Mr. Janish stated a potential roadway has identified off 166th Avenue, near an adjacent property
39 with steeper slopes and a wetland area. He added if this were to be a permanent cul-de-sac, there
40 would be potential for future development of adjacent property. He noted City staff is looking
41 for guidance and direction regarding a permanent or temporary cul-de-sac; what standards would

1 apply; who would pay for the roadway; would an easement or right-of-way be required for future
2 development and extension of the roadway.

4 Mr. Janish stated acreage of adjacent properties has been identified, and not many of the lots
5 would have the potential to be split in the future. He added this parcel is proposed to be split into
6 two 5 -acre lots, with potential for further division.

8 Mayor Trude asked whether a plat was submitted. Mr. Berkowitz stated there was a temporary
9 cul-de-sac sign on 168`h Avenue, so there must have been a plat at one time.
10
11 Councilmember Knight asked whether 166`h Avenue is drivable. Mr. Janish confirmed that it
12 appears to be more of a driveway.
13
14 Mayor Trude asked whether anyone has talked to the owner of 16601 Eldorado Street, as his
15 driveway might be a road. An audience member stated the home is a rental property.

17 Mr. Janish stated the plat was done in 2000.

19 Councilmember Bukkila asked whether a road easement could be done if the home were to be
20 facing the correct way. Mr. Janish stated that depends upon current codes, and this is not a
21 typical City lot with roadway. He added this is an unimproved roadway with insufficient
22 frontage. He noted, historically, when a cul-de-sac is built, an easement is granted to the City
23 and then the parcel can be split.

25 Mayor Trude stated she is concerned about this happening in the Rural Reserve area if it can
26 happen here. Mr. Berowitz stated that is a different zoning district.

28 Councilmember Bukkila stated this is already a subdivision, and there may be unique lot splits
29 but there cannot be more frontage on Eldorado Street. She asked how many lots would be
30 created if the road were to go north and meet up with 168u Avenue. Mr. Janish stated City staff
31 did not look at that because it could be a PUD.

33 Councilmember Bukkila stated she would support 2.5 acre lots to keep it from getting complex.
34 Mr. Berkowitz stated a roadway easement would work because it would encompass the 2.5
35 acres. He asked who would pay for the roadway easement.

37 Councilmember Bukkila stated escrow might be an option, and the land to the north of this
38 property will potentially be developed. Mr. Berkowitz agreed, adding some other kind of
39 agreement might be a possibility. He added the owner would have to build the road if this were a
40 standalone development, and since it would be a local street, it would be outside of the
41 Transportation Plan. He noted the City's policy has always been that the next property must be

1 accessible so it can be developed, and there are endless possibilities if there is a roadway
2 connection.

4 Councilmember Knight asked whether it would be in the owner's best interest to get a roadway
5 easement, in terms of value. Mr. Berkowitz stated the value of the lot would be the cost of the
6 road.

8 Mayor Trude stated this does not sound like a new plat or development. Mr. Janish agreed,
9 adding it is necessary to analyze whether requirements are met, and since they are not met other
10 questions are being triggered.

12 Councilmember Bukkila stated there must be the potential for the street to go all the way through
13 to meet other needs. She added road improvements are not necessary right now, but there is the
14 potential to further subdivide land to continue that road through some day.

16 Councilmember Holthus stated she is concerned that 166' Avenue will have two houses. She
17 added she is not concerned about making the roadway connection to the north as there is wetland
18 there. Councilmember Bukkila stated there will need to be improvements, but it is important to
19 figure out how to make the development go through. She added 166'' Avenue would not be a
20 permanent cul-de-sac. Mr. Janish stated a variance would be required.

26 Craig Swalchick owner, of 851 - 138`h Ave. NW, thanked the Council for their time. He
27 acknowledged that his situation requires a public hearing. His family has owned an outlot on Palm
28 Street due to owning the house next to it. That home was sold separately from the outlot due to the
29 new owners not wanting to purchase the outlot. Two years ago staff helped him to possibly position
30 the outlot as buildable. He was able to confirm that it was not a wetland property and also had a
31 DNR review. Mr. Swalchick stated he has spent thousands of dollars to come up with a grading
32 plan, "just to sell the outlot as a buildable lot." His concern is about the requirement to grade the lot
33 and considers it to be "over -and -above." He also stated there are no health and safety concerns other
34 than some potential trespassing; activity happening there. Mr. Swalchick confirmed he pays a lawn
35 service to keep the lot mowed. He stated the grading plan requires fill to be brought in before a
36 house is built, however, a builder would then likely remove the fill to build a house. He has a
37 potential buyer, with a contractor, and they agree that doing the grading now would be a waste of
38 dollars, and therefore it is an unnecessary obstacle. He felt staff has been supportive, until recently
39 when he has encountered more roadblocks.

41 Mayor Trude noted outlots are not usually considered buildable.

43 Mr. Swalchick stated he feels that it's denying him viable use of the property.

45 Mayor Trude indicated Mr. Swalchick is entering the zone of where one becomes a developer and it
46 is much more difficult to navigate.

1 Mr. Dickinson confirmed he had provided the resident with information on how to navigate the
2 process of developing the property. He agreed it is a unique outlot and that it has been attached to
3 the adjacent lot since 1994. This kind of work is typically done with builders/developers. He
4 understands it's cumbersome for the regular homeowner. When someone wants to build a home,
5 City staff is trying to ensure the lot can be built upon. Mr. Dickinson did not recommend approval,
6 because that assigns the obligation to the next buyer. He noted the owner is trying to sell the
7 property, right now, as a "buildable lot" and there is a difference in price between a buildable lot and
8 a potentially buildable lot.

DISCUSS APPEAL OF FENCE PERMIT DENW11444 —141sT LANE NW
5 The Heilman's have requested to place a fence within a drainage and utility easement/dry pond in
6 their back yard. They requested a site meeting and it was confirmed by Mr. Berkowitz, and
7 previously by Kameron Kytonen, Natural Resource Technician, that staff could not approve the
8 permit, as requested, due to the pond impact.
9
10 During Resident's Forum at the May 2, 2017 City Council meeting, Tasa Heilman requested the City
11 Council approve the fence placement. On May 16, 2017, the Heilman's formally applied for the
12 fence permit, which was denied.
13
14 Mayor Trude asked for confirmation as to the location of the trail as it related to the map that was
15 shown by Mr. Berkowitz.
16
17 Staff recommended denying the appeal on the basis that City Code does not allow fences to be
18 constructed or placed in drainage areas, ponds or wetlands. The pond handles storm water runoff for
19 approximately 11.3 acres of land.
20
21 Mr. Berkowitz pointed out the City is responsible to protect homes in the City from flooding. It also
22 protects run-off from going into the water supply. He confirmed the maximum fence height allowed
23 in the front yard is 4 feet high and a fence could be built in a limited area, but not where the set
24 879.27 elevation of the pond area is located.

26 Councilmember Bukkila asked if a fence could be built on the rear fence line. Mr. Berkowitz
27 confirmed that is correct, but the fence would not be able to "tie in" across the backyard.

29 Mayor Trude asked if any plantings could be done. It was confirmed there could be no plantings in
30 the pond area.

32 Councilmember Bukkila asked about split rail fence and Mr. Berkowitz also stated this would not be
33 permitted in the easement area. She wondered if the delineation would help address safety issues for
34 their children.

36 Mayor Trude invited the applicant to come forward to the podium.

38 Ms. Heilman showed a photo of the dip in the yard that is the drainage pond. She stated she assumed
39 the Council was prepared to deny the request. She asked the Council to look at the request as an
40 individual request. She did not believe that a chain link fence would have a negative impact and the
41 request was motivated due to the creek being in the back yard and safety issues of having 3 young
42 children.

1 Mayor Trude thanked the applicant for her information. She also wanted to make something clear to
2 the public watching, and that was the family did come to the Council before the purchase of their
3 home and they could have elected to back out of the purchase before the sale was final.

6 were made in the Heilman's lot.

13 Mr. Berkowitz explained in the 2017 Capital Improvement Plan is Phase I of the Public Works
14 Relocation/Expansion. The first step in the process is to hire an architect to begin the space needs
15 study, preliminary design and high-level cost estimations to make a determination on whether to
16 move forward with construction. The next step for 2018 is to continue to move forward by going
17 into full design and preparation of the bid documents. The budget for 2017 is $50,000 for analysis
18 and then the budget in 2018 is $450,000 for design.
19
20 Mr. Dickinson indicated Phase I - vehicle maintenance - is the City's biggest need. Staff proposes
21 the City will continue to use the buildings that exist as long as they are viable.
22
23 Councilmember Goodrich confirmed the maintenance facility building needed is long overdue.
24 Councilmember Knight asked about the Recycling Center. Mr. Berkowitz confirmed the Recycling
25 Center will stay, at least for now.

27 Mayor Trude indicated the center of the site plan will not come to fruition until many more years
28 from now.

30 Mr. Berkowitz confirmed there will be fencing along Nightingale Street and City staff would be
31 meeting with neighboring residents.

33 Councilmember Knight asked for an explanation of the term, "flexible open space." Mr. Berkowitz
34 confirmed the area would be open for multiple purposes to be determined at a later date, focusing on
35 gathering areas for the community.

37 Councilmember Goodrich encouraged staff to keep security in mind as plans are developed. Mr.
38 Berkowitz indicated there are plans for video cameras and access cards.

40 Councilmember Holthus asked about the timeline for completion. Mr. Berkowitz stated it would be
41 determined by the Council and the budget. Mr. Dickinson reiterated it will be a Council decision.

28 City Staff updated the Council on the administration and city department activities, legislative
29 updates, updates on development/CIP projects, and meeting reminders/community events.

31 (City Administrator) Mr. Dickinson has been part of the Highway 10 Work Group on behalf of the
32 Council. He also attended the Metro Mayors Association Operating Committee meeting. Census
33 discussions are starting. The City has permitted over 60 new homes. There is significant
34 commercial construction at the intersection of Hanson Boulevard and Bunker Lake Boulevard. Fun
35 Fest will be held in the community the following weekend.

37 (Public Works/City Engineer) Mr. Berkowitz stated Public Works is involved in getting the City
38 Campus cleaned up for Fun Fest. The Woodland Creek Golf Course project is moving forward. He
39 noted the rain really impacts that property and is slowing progress. As the dirt is moved they are
40 finding a significant number of golf balls. They are hopeful that it will be dry enough in July to
41 proceed. Once the vegetation fills out it will look really nice. It was on the market for years to be
42 sold and then not maintained. City staff has been creative. Mr. Berkowitz asked for patience
43 because it may take a couple of years for vegetation to flourish. At Fox Meadows Park, the grading

is done and then irrigation will go in. Mid -August is the seeding date target. Street reconstruction in
the City is moving along pretty well. Country Oaks North will have a lot of movement by fall. And
there will be another housing development with lots available by fall. Trail improvements are also
progressing.

8 (WDE Site) Mayor Trude noted the meeting the next day with the Pollution Control Agency
9 regarding the WDE site clean-up. She stated residents will likely not seethe excavation. City staff
10 and the Council will see to it that the money set aside by the legislature goes toward the clean-up
11 itself and not for only engineering.

DISCUSSION
Claims totaling $208,743.29 on disbursement edit lists #I — #2 from 06/30/17 to 07/14/17 have been issued and
released.
Claims totaling $812,257.80 on disbursement edit list #3 dated 07/18/17 will be issued and released upon
approval.
BUDGET IMPACT
The edit lists consist of routine payments with expenses being charged to various department budgets and
projects.
ACTION REQUESTED
The Andover City Council is requested to approve total claims in the amount of $1,021,001.09. Please note
that Council Meeting minutes will be used as documented approval.

INTRODUCTION
The City Council is requested to approve the Declaration of Encroachment Easement, Conditions &
Covenants for 1825 —158`h Lane NW.
DISCUSSION
Resident at 1825 — 158`h Lane NW is constructing an above ground pool and would like to build a 5
foot wide deck around the north end of the pool in which the deck posts would be placed in an
existing drainage and utility easement that is for cross yard drainage.
Staff has reviewed the request to encroach in the easement identified on the attached lot survey and
have determined that the placement of such improvements will not affect overland flow of storm
water nor impact any storm water pond design requirements, therefore recommends the approval of
the attached Declaration of Encroachment Easement, Conditions and Covenants for 1825 — 1581h
Lane NW.
ACTION REQUIRED
The City Council is requested to approve the Declaration of Encroachment Easement, Conditions &
Covenants for 1825 — 158h Lane NW.

DECLARATION OF ENCROACHMENT EASEMENT,
CONDITIONS AND COVENANTS
THIS AGREEMENT, entered into and made effective as of the date fully executed by
all parties, is by and between Dane L. Froiland and Dena L. Froiland, husband and wife, 1825
1581 Lane NW, Andover, Minnesota 55304, owners of said property noted below (hereinafter
"Owner"), and the City of Andover, a Minnesota Municipal Corporation with its principal place
of business located at 1685 Crosstown Boulevard NW, Andover, MN 55304 (hereinafter the
"City").
WHEREAS, Owner is the fee owner of 1825 158th Lane NW (Lot 2, Block 2, Woodland
Crossings; PIN: 15 32 24 43 0073), Andover, Anoka County, Minnesota (hereinafter the
"Property"); and
WHEREAS, the City has a drainage and utility easement that currently exists on
northerly 20' of said Property (hereinafter "Drainage and Utility Easement"); and
WHEREAS, Owner desires to construct a deck around a pool (hereinafter
"Improvements") within the existing Drainage and Utility Easement; and
WHEREAS, the City is willing to acknowledge and agree to an encroachment of the
Drainage and Utility Easement for said Improvements of no more than 5', maintaining a free and
clear 15' wide Drainage and Utility Easement on the northerly portion of the property, with the
underside of the deck within the southerly 5' of said Drainage and Utility Easement remaining
open with no lattice work, fencing or other material further limiting access beneath the decking,
contingent upon Owner agreeing to abide by certain conditions; and
WHEREAS, Owner is aware the area is for drainage and utility purposes and that City
access and/or minor maintenance may be required in said easement, resulting in the requested
removal of the Improvements.
NOW, THEREFORE, in consideration of the foregoing and the City's consent and
approval to the encroachment into the Drainage and Utility Easement, Owner hereby agrees as
follows:
I. To hold the City harmless and indemnify the City from any and all liabilities, and
defend against lawsuits, expenses, damages, acts or failures to act, attorney's fees and court
costs, which may arise as a result of Owner, or her successors in interest, constructing and
maintaining said Improvements upon, in, or around the Drainage and Utility Easement of the
City.
2. The City shall not be held responsible for any damage to said Improvements
whatsoever as a result of the City exercising its rights to access, excavate, repair, construct or
maintain any public improvements within said Drainage and Utility Easement.
3. Any additional cost to maintain, repair or replace the public infrastructure within
the Drainage and Utility Easement due to the Owner's encroachment within said Drainage and
Utility Easement shall be the sole responsibility of Owner or their successors in interest to the
extent the cost exceeds the costs the City would incur if the Improvements did not encroach into
the Drainage and Utility Easement.
4. In the event the Property is abandoned or vacated, the City may terminate this
Agreement upon ten (10) days written notice to Owner.
5. Owner hereby covenants and agrees that Owner will not permit or allow any
mechanic or materialman's liens to be placed on or affect the Drainage and Utility Easement.
Notwithstanding the previous sentence, however, in the event any such lien shall be so placed on
the Drainage and Utility Easement, Owner shall take all steps necessary to see that it is removed
within thirty (30) days of its being filed.
6. The City may require evidence of insurance from Owner, in amount the City
deems reasonable and necessary in its sole discretion, to cover the indemnification required
herein.
7. The parties hereto represent, wan -ant and agree that each has been represented by
their own counsel, or has had the right to be so represented but declined any such representation;
that they have thoroughly read and understand the terms of this Agreement; that they have
conferred with their respective attorneys on any questions in regard to this Agreement, or had the
right to confer with an attorney but have declined to do so; and have voluntarily entered into this
Agreement.
8. This Agreement shall not be construed more strictly against one party than against
any other party by virtue of the fact that the Agreement may have been drafted or prepared by
counsel for one of the parties, it being recognized that all parties to this Agreement have
contributed substantially and materially to the negotiations and/or preparation of this Agreement.
9. This Agreement shall be construed under and enforced in accordance with the
laws of the State of Minnesota.
10. If any provision of this Agreement shall be determined by any court or
governmental agency to be invalid or unenforceable, the remainder of this Agreement and the
application of such provision to other persons or circumstances shall not be affected thereby, and
shall remain enforceable to the greatest extent permitted by law.
11. Any notice required or permitted to be given in accordance with the terms of this
Agreement may be given by first class U.S. Mail, postage prepaid, overnight courier or by
personal service, to the other party at the address set forth in the first paragraph of this
Agreement, or at such other address as either party, or their successors or assigns, may hereafter
designate to the other party in writing.

BNSF Railroad have been preserved for an emergency access across the railroad. At this time, the
developer is requesting the outlots become a buildable lot, as shown on the final plat. The request is
based on the attached letters from BNSF discussing the permanent removal of this particular crossing.
City Council is asked to discuss and determine if the outlots shall remain as an emergency access across
the railroad or allow the outlots to become a buildable lot of record.
The final plat complies with the approved preliminary plat other than the discussion regarding the outlots
Park Dedication and Trail Fees
The developer will be required to pay park dedication and trail fees for the lots at the time building
permits are issued.
ACTION REQUESTED
The Council is asked to discuss the outlots and adopt the attached resolution approving the final plat with
conditions. The resolution may need to be amended to reflect City Councils decision regarding the
outlots.

A RESOLUTION APPROVING THE FINAL PLAT FOR COUNTRY OAKS NORTH THIRD
ADDITION FOR THE PROPERTY LEGALLY DESCRIBED AS;
Country Oaks North Second Addition Outlet B
WHEREAS, the City Council approved the preliminary plat for Country Oaks North on November 17,
2015; and
WHEREAS, the City Council approved the final plat for Country Oaks North Second Addition on June 7,
2016; and
WHEREAS, the final plat of Country Oaks North Third Addition conforms to the approved preliminary
plat for Country Oaks North.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Andover to hereby approves
the final plat for Country Oaks North Third Addition contingent upon the following:
1. The lot configurations for the Country Oaks North Third shall conform to the Country Oaks
North Second Addition preliminary plat approved by City Council on November 17, 2015, with
the exception of Outlet A and Outlot B, which shall be combined to create Lot 1, Block 4.
2. Separate Vehicle Maintenance Access Agreements shall be provided per approved grading plan
as shown in Exhibit A. The agreements must be approved by the City Attorney and recorded at
the County with the final plat.
3. Park dedication and trail fees shall be paid on a per unit basis at the rate in effect at the time of
final plat approval and subject to increase as provided by state statute. Payments shall be made in
accordance to the recorded Assessment Agreement.
4. A Development Agreement and Assessment Agreement shall be executed and recorded at the
County with the final plat.
5. Contingent upon staff review and approval for compliance with City ordinances, policies and
guidelines.

'thank you for speaking with me regarding the crossing located at DOT Number
061584M at Milepost Location MI' 128.23 at or near Andover, Minnesota. As you may
know. BNSF is in the process ol'reviewing public and private crossings across its system
as a part of our grade crossing safety program. During our discussion you verified that
after a recent sale of land to SW Investments, I.I.C, there are dil'ferent landowners
currently owning on either side ol'the railroad track and that your property on the cast
side ol'the railroad track can be accessed from Ward Lake Drive and the property west of
the railroad track can be accessed from Wintergreen Street NW. In light of'this access,
we mutually agreed that BNSF would permanently remove the crossing noted above.
Currently there is a contract agreement for this crossing, BNSF Contract Number
CX5015, dated January 13, 1986. I am Ibnvarding this Letter Agreement to our Law
Department for further review. In exchange for BNSF's permanent removal of this
redundant access, you agreed to release BNSF from any obligation it may have no\a or
may hereafter have to construct and maintain this crossing or any future crossings across
your property.

In regard to your inquiry about the establishment of a new at -grade crossing for a
proposed city road (167t"), connecting Ward Lake Dr. and Hanson Blvd., located north
of the 16151 Ave NW crossing and south of the Ward Lake Drive NW crossing, BNSF will
not allow a new crossing to be established across its tracks unless the City of Andover
is willing to close two existing crossings within their City limits or partner with adjacent
cities to close two existing crossings located on BNSF's tracks.
Since 2000 BNSF has actively sought the closure and removal of at -grade crossings
across our system to pronote at -grade crossing safety on BNSF's railroad network. By
doing this, BNSF has been able to significantly reduce the number of at -grade crossing
collisions that occur at crossings of our railroad.
BNSF is willing to discuss an overpass at this particular location as an alternative to an
at -grade crossing.
Should the City wish to continue discussions, I am willing to schedule a meeting with
myself and a MNDOT Rail Coordinator to discuss the City's proposal.

Shoreland Management Regulations
The property is located within the shoreland area.The Shoreland Management Code is adopted
by the City pursuant to Minnesota Regulations that apply to the shorelands of public water
bodies. The City of Andover is the governing body of code. As required by the Andover
Shoreland Management code, the Department of Natural Resources (DNR) has received notice
of the variance request. At this time, staff has not received comment from DNR staff.
According to the Shoreland Regulations, unsewered single family lots on Recreational
Development Lakes such as Round Lake are required to be a minimum of 20,000 square feet
with a lot width of 100 feet. This section of the code is attached for your review. However,
stricter regulations in the Rl Single Family Rural district supersedes the Shoreland Regulations.
Variance Review
Mr. Wameka submitted a letter and is proposing a variance to reduce the lot width at the front
yard setback from 300 feet to 150 feet for the purpose of subdividing the property into two (2)
lots. The letter addresses the practical difficulties and is attached for your review.
The existing lot meets code requirements for lot width, depth and area. If the lot is further
subdivided, the lots will require variances. Existing and proposed lot measurements are as
follows and the variances are highlighted in yellow:

difficulties in complying with the official control. "Practical difficulties" as used in

1. The property owner proposed to use the property in a reasonable manner not permitted
by an official control.
• The proposed lot widths meet the intent and regulations of the City Code pertaining to
Shoreland Management provisions. However, the City has placed stricter provisions
on lots zoned Rural Residential limiting the further subdivision of the land because the
lots will not meet the required 300 foot width at the front yard setback.
• Required lot widths at the public right-of-way is 50 feet. Forty (40) feet from the right-
of-way the lot width is required to be 300 feet. The proposed lot widths of 150 feet
and 180 feet provide ample access and room to construct a home while still leaving
enough of a buffer space between the neighboring properties.
2. The plight of the property owner is due to circumstances unique to the property not
created by the landowner.
The property owner purchased the existing property in 1977. When the lot was created
in July 1977, it was subdivided in such a way that the lot size and depth exceeds the
existing requirements in the rural residential and shoreland management area.

retain the rural character. The southern X roperty line will be setback at least 245 feet
from the existing structure at 4050 147 Lane NW. This is shown on the attached map.
There will be no floodplain, wetland or natural waterways impacted if an additional
home is constructed on the proposed lot. The existing contour/elevations of the
property provide the opportunity for an additional building pad. The vegetation, lower
elevation and floodplain on the property to the south provide a natural buffer between
the lots.
4. Economic considerations alone do not constitute practical difficulties.
• The applicant is not considering the proposed variances because of economic reasons.
Public Comments
Staff received phone calls and emails regarding the variance requests. Attached for your review
are letters and a petition submitted by the public that are part of the public record.
Planning and Zoning Commission Recommendation
On May 9, 2017, the Commission held a public hearing. Meeting minutes are attached for your
review. Four (4) individuals spoke opposing the variance request with the belief that the variance
would have a negative impact to the rural character of the neighborhood, negative effect on the
value of the surrounding homes, increased density, and the style of the new home would not be
compatible to the existing architecture.
The Commission recommends denial of the variance requests on a 3 — 1 vote (3 absent) with the
findings that the practical difficulties were not unique to the property and there is too much of an
impact on the rural neighborhood.
ACTION REQUESTED
The City Council is asked to review the variance requests, compare the variance requests with
the review criteria of City Code 12-14-7, take into consideration the recommendation of the
Commission and approve or deny the requests based on findings of fact. Staff drafted
resolutions with potential findings of fact the Council may want to consider when approving or
denying the variance requests.

Neighboring properties within the subdivision have a minimum of 330 feet; thus the existing
lot retains the rural character of the neighborhood. A smaller frontage will have an impact to
the rural neighborhood.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Andover hereby denies
the variance requests to reduce the lot width at the front yard setback.

3. Lot split approval is contingent upon all city requirements for lot splits is met.

We believe that both lots A and B are in harmony with the general purposes
and intent of the official control and are consistent with the comprehensive
plan. Both lots A and B more than meet the minimum requirements of 150
feet depth as they are approximately 880 feet in depth. We also believe that
both lots A and B exceed the minimum requirement of 2 1/2 acres. We
believe that lot A with 180 feet width and lot B with 150 feet width are in
harmony with the surrounding neighborhood. Lot B meets the density
requirement. Proposed lot width allows more than enough width for home
construction and will still retain much open area. There would be no further
subdivision of the property as there is and will not be MUSA for this area.
Both lots A and B exceed the lot depth and lot area requirements.
We feel this is the highest and best use and a reasonable use of the property
not permitted under an official control. The obstacle to the division of these
lots is due to circumstances unique to these properties not created by the
landowner. These existing properties are much deeper than what is required
by code. This variance will not alter the essential character of the locality.
Both lots would still exceed 2 1/2 acres minimum and still meet density
requirements in the rural residential district. Property directly to the south of
Lot B has a substantial drainage ditch directly adjacent to the south lot line
of lot B which would preclude any additional construction adjacent to the
south of lot B.

We just received a copy of our variance request that we submitted along with a copy of a petition and a
letter. We would like to respond to these items:
PETITION
Many of the names on the petition are from the same household. We count 13 households (or 12 given
to the fact that one household asked for their names to be removed) out of approximately 50
households from this immediate area. We have spoken to both some who signed the petition and some
who would not. Some of the individuals who signed the petition were lead to believe that we were
splitting a 2 %2 acre lot and that as such the variance would allow other people to split 2 /2 acre lots.
When they were informed that it was a 6 acre lot being split into two 3 acre lots
many then felt it is a reasonable use and that the variance does not open up the neighborhood to
massive lot splitting. In speaking to the people who did not sign the petition the ones we spoke to felt
that it was perfectly reasonable to have a new home in that corner and they did not feel that it would
compromise the openness of the area.
We understand that one of the actual signers of the petition has withdrawn their signature.
THOM JORDAN LETTER
He says: Even though the lot is listed at 5.9 acres.
We say: Many lots in this development and throughout the City include low or wet areas. It is
the responsibility of Anoka County to determine lot size. Anoka County determined that the
size of the subject lot to be split is approximately 6 acres.
He says: Splitting the land area into 1 %2 acre.
We say: The 6 acre lot is being split into two 3 acre parcels.
He says: He is concerned the reduced acreage would not support private sewer and water.
We say: The new lot is more than adequate to provide private sewer and water and has been
studied by city engineering and cleared in that respect.
He says: He is concerned that granting this variance to allow splitting this lot would set a precedent for
allowing additional lot split requests.
We say: that there are almost no 6 acre lots in this development that would be forthcoming with
additional requests for lot splits.
He says: We all have wells and would not want to risk contamination.
We say: This is a disingenuous statement.
He says: Houses in this development that are of a style and size that are not similar to houses that are
being built today.
We say: that new homes being built today are of a style and size that would fit in this
neighborhood. Except the duplex created by a variance next to Mr. Jordan.
We also bought our home in this area because we like the environment, being on the lake and the
openness . It seems clear to us that the lot split is more than reasonable; will not change the character
of the area, and will retain comparable openness.
We continue to have several builders approach us about this very desirable and unique property on the
lake. In addition the City of Andover has approached us to buy the open property. The more that we
have been approached the more it was clear to us that it just makes common sense to split.

We are writing about the variance request for the property located at 14791 Blackfoot St NW, Andover, MN.
Our understanding is the owner wants to split their lot which currently has —300 feet of road frontage and is
listed at —5.9 acres. We are concerned about the following items:
• Even though the lot is listed at —5.9 acres, it is clear from an area view of the plat map that —50% of the lot is
actually in the lake and/or cattails. This would bring the actual land area of the lot to 3 acres or below. The road
frontage would be reduced to —150 feet +/- per lot if split.
• Splitting the land area into —1 Y2 acre lots would be below the development minimum requirement of 2 Y2 acres
and below the minimum road frontage of 300 feet.
• We are concerned the reduced acreage would not support an additional septic system and would cause risk to
the lake and ground water.
• We are concerned that granting this variance to allow splitting the lot would set a precedent for additional lot
split requests in this development.
• We all have wells in the development and would not want to risk water contamination and/or low water levels
due to additional pressure on the water table.
• Houses in this development are of a style and size that are not at all similar to houses being built today. We feel
any new style home would not fit with the environment of the current houses in the area.
We request that before any further consideration is given to this variance that the city contact the Minnesota
Department of Natural Resources and the local Soil and Water Conservation District to review the potential
impact of this variance request. Also we request that you have a land surveyor determine the actual buildable
land area of the lot.
We bought our home in this area because we like the environment of homes being on the current amount of
acreage and the low profile design of the homes. We would not like to see the density of homes increased in
this neighborhood.

As a direct neighbor to the resident requesting the lot width variance at 14791 Blackfoot St NW,
I am concerned about and absolutely oppose forward action.
The requested variance would open the possibility of a lot split, thereby causing:
1. A decline in privacy to my home and property.
2. A decline in our property value.
3. A loss of cohesion in our neighborhood.
4. Sets a precedent for other home owners to split their property, a beginning to turn Lunds
Round Lake Estates into Anywhere, USA.
Lunds Round Lake Estates exemplifies that which Andover places high esteem: space, nature,
and the resident's access to it. It's the reason my husband and I moved from Northeast
Minneapolis to Andover to raise our family.
I respectfully request that the Planning Committee consider my voice, and the voices of my
neighbors, and oppose this variance in order to preserve the natural state and space that is
afforded with the zoning and current residence of Lunds Round Lake Estates.

As the individual who circulated the petition, I would like to address the response letter by Mr. and Mrs.
Warneka dated May 8th, 2017; specifically, I would like to respond to their claims against the petition.
Firstly, it is unclear what 50 households the applicants are referring to. According to the plat map that I have reviewed, the applicants' home
is a part of Lunds Round Lake Estates, which has 25 homes; it has 33 homes, if you count the north side of 149th Street NW, which was
included in the petition area.
Secondly, the facts of the petition are as follows:
- 22 households were talked to.
- 16 signed immediately.
- After the fact, 1 household became neutral, and 2 added themselves via email/letter.
- Therefore, 17 out of 22 households oppose the variance request. In other words, of the households talked to,
77% oppose the variance that Mr. and Mrs. Warneka are requesting because it will alter the essential character
of the locality.
Further, Mr. and Mrs. Warneka claim "some of the individuals who have signed the petition were led to believe
that we were splitting a 2 1/2 acre lot and that as such the variance would allow other people to split 2 1/2 acre
lots."
As the individual who circulated the petition, I attest that I did nothing of the sort. I was clear when
talking with my neighbors, that this is not a petition about how much acreage the applicants have; in fact,
I informed my neighbors that the applicants believe they have the acreage. I informed my neighbors, as is
clearly printed on the petition, that this opposition is about the variance request for lot width reduction
thereby allowing for closer together, thinner lots, which would alter the essential character of our locality.
Our locality was founded on three requirements: lot width, lot depth, and lot acreage. These three in
combination allow for the essential character of our locality -- space and nature. Space from multiple driveways,
space from multiple houses, space from each other, all of which allows for nature to abound. Reducing the lot
width by half, as the applicants are asking for, would detrimentally affect the essential character and feel of our
neighborhood. It is the primary reason my husband and I moved our family to this particular location in
Andover, and we did not move to some other city, or even some other neighborhood within Andover.
In conclusion, I respectfully urge the City Council to uphold the Planning Committee's recommendation and
decline the variance.

I am writing in regards to the variance request for the property located at 14791 Blackfoot St NW. I have lived
in this neighborhood for almost 30 years at 4325 149th Av NW. I am not close enough to this property for this
to directly effect me, but I do have some concerns about granting a variance, especially when it concerns the
front yard and setback. I think development should stay as was intended when this neighborhood was
established.
People who come to my house for the first time always remark on what a beautiful neighborhood this is, we
have large well kept lots, similar houses and open spaces. My concern is that if we start making exceptions we
are climbing a slippery slope, we make an exception once, what happens the next time? I would hate to see our
neighborhood sliced and diced into small parcels with McMansions squeezed together.
Another important consideration is what impact will this have on Round Lake? The lake supports many
different species of wildlife who's habitat we need to preserve.

Thank you for answering our request for information regarding the above mentioned
variance request. My wife and I have spent a good share of the past several months in
our Florida home and have been out of the loop regarding the happenings back in
Andover. We did receive the notice of the public hearing for variance request in our
forwarded mail last week, which did not tell us much, so it is very helpful to learn the
whole story.
I see that there is a neighborhood petition included in the information packet. Had we
been in Andover, my wife and I would have added our names to the opposition. We have
lived in our current Andover home for thirty seven years and are concerned that any
subdivision of lots in Lund's Round Lake Estates would dramatically change the quiet,
rural nature of the community as well as negatively affect the natural wildlife habitat that is
nurtured and preserved by neighboring Kelsey Round Lake Park and Round Lake itself to
the east of the property. Any variance that results in a subdivision of existing lots would
also set a precedent for further variance requests that could lead to even further
degradation of the current amenities of our neighborhood.
Therefore, we wish to go on the record as opposing the variance request

Dear Mayor Trude and City Council Members:
Our family chose to move to this particular neighborhood due to the lot sizes, wildlife, and natural
setting. We took great care in finding a neighborhood that valued larger acreage per home and a respect
for the wildlife in this area. Specifically, we were looking for a mature wooded lot with 3 or more acres,
and a water view. If Mr. Warenka is allowed to split his acreage, this will indeed set a precedent for
other homeowners in our neighborhood. We believe the splitting of acreage would greatly change the
overall character and desirability of this area. As homeowners decide to split their properties our overall
home value would decrease along with the plethora of wildlife. The natural aesthetic of our
neighborhood would also change significantly with this first split, if allowed. Currently, there is a
wonderful view of Round Lake along Blackfoot Street. If homeowners are allowed to split their acreage,
for additional housing, those views will be lost completely for all who enjoy walking and biking this area.
Along with our concerns regarding this variance, we feel that if such a precedent were set, eventually
the change in neighborhood density could affect overall well water usage. We greatly appreciated
Andover's Planning and Zoning Committee identifying that "the rules were put in place when the
residents bought their property and it is the Commission's obligation to uphold those expectations." It
was also noted by a committee member that there was a" belief the variance request would have too
much impact on the neighborhood."
We respectfully urge the City Council to uphold the Planning and Zoning Commission's recommendation
and decline this variance request.

Hello,
After considering many options in the North Metro area, we chose to move our family to Lund's Round
Lake Estates in Andover in 2002. The most significant factors in choosing this location were, and still
are, the lot size requirements, distance between the homes, and open space in the neighborhood.
Before we purchased our home we asked about the potential of lots being split in this area and were
referred to the current zoning rules which indicate the development's various lot configurations don't
surpass all size requirements to allow for a split. Some may have enough acreage but not enough
frontage length while others have enough frontage but not enough acreage, etc. Our previous
neighborhood in Blaine consisted of houses close together with relatively smaller lots/yards similar to
the homes in the neighborhood south of where we live today. We specifically chose not to live in that
type of environment as we enjoy the open space, lower traffic levels, and lower light levels at night in
our current neighborhood all of which add uniqueness and value to the homes in this area.
We are concerned about the variance request for the property located at 14791 Blackfoot St NW,
Andover, MN. Our understanding is the owner wants to split their lot which currently has —330 feet of
frontage at the setback and is listed at —5.9 acres. The variance request presented during the Planning
and Zoning Commission meeting revealed the intent to reduce the frontage at the setback to two lots of
180 feet and 150 feet width.
The requested split reduces the frontage requirement by 40% to 50%. While we might understand a 5%
or even 10% variance, this request is so large that it seems unreasonable based on the current zoning
requirements. We live directly across the street from the property in question and feel that adding
another home to a lot that is currently only slightly above the requirement for one home would have a
negative impact on the land values and unique setting we have in this neighborhood today.
We would not like to see the density of homes increased in this neighborhood. Houses in this
development are of a style and size that are not at all similar to houses being built today. We feel any
new style home would not fit with the environment of the current houses in the area. In addition, we
are concerned that granting this variance to allow splitting the lot could set a precedent for additional
lot split requests in this development based on a variance to either frontage or acreage. Due to the
various concerns mentioned above, we are not in favor of the variance request for splitting the lot at
14791 Blackfoot St NW.
In closing we respectfully urge the City Council to uphold the Planning and Zoning Commission's
recommendation and decline this variance request.

2 PUBLICHEARING. Variance Request— 14791 Blackfoot Street NW—LeRoy and
3 Sandra Warneka
5 Ms. Hanson presented the variance request to reduce the required width of the lot at the
6 front yard setback. She noted that staff has not received comment from DNR staff and
7 that it is typical not to receive a response. Mr. Warneka submitted a letter and proposes a
8 variance to reduce the width at the front yard setback from 300 feet to 150 feet for the
9 purpose of subdividing the property into two lots. One lot would have a 150 -foot width
10 and the other a 180 -foot width. The variance meets the City Code requirements for size
11 and depth. Ms. Hanson outlined the City Code criteria that states, "variances may be
12 granted when the applicant for the variance establishes that there are practical difficulties
13 in complying with the official control." The definition of "practical difficulties" was
14 further described by Ms. Hanson. The lotwas originally created in 1977 and the drainage
15 and utility easement in the neighboring property was explained. The ARC reviewed the
16 proposed variance requests and had no comments pertaining to the request. Staff also
17 received phone calls and emails regarding the variance requests.

19 There was supplemental information to the report which included an additional letter in
20 opposition to the variance.

22 Vice Chairperson Nemeth asked if the variance was approved and if the applicant splits
23 the lot, would it just be an administrative matter. Ms. Hanson replied that was correct.
24 The applicant would need to have the appropriate buildable area, have soil borings done,
25 contract for a professional survey, etc. She clarified that each lot would have to be a
26 minimum of 2.5 acres, proven by survey, and that the Coon Creek Watershed District
27 would not need to review the matter.

29 Commission Koehler commented that if the variance was approved at the meeting, the
30 Commissioners would not be approving a smaller size lot, only a smaller size width.

32 Commissioner Sims asked about the history of the City's 300 -foot lot width. Ms. Hanson
33 indicated that the standard had changed some time ago and it was previously 330 feet.
34 Ms. Hanson stated that there have been variances in the past for lot width under different
35 circumstances. In this development, all lots are zoned R-1, and directly to the south, the
36 lots are R-4.

38 Motion by Koehler, seconded by Peterson, to open the public hearing at 7:20 p.m.

43 Katie Shaw of 4050 147th Lane NW, expressed concern about the maintaining of a 300-
44 foot lot width because it creates an "environment of space." The distance between the
45 properties is significant in their development.

2 Tom Jordan of 14800 Blackfoot Street NW, stated that his concern is the precedent that
3 would be set in the neighborhood and the effect on the values of the surrounding homes
4 based on the lot size that surrounds them. By splitting the lots, there is an increase in
5 density, and he asserted there would also be a change in character and the value of the
6 homes. Homes built today are very different in style. He also noted that there is a lot of
7 wildlife going through their development.
9 Lee Warneka of 14791 Blackfoot Street NW, stated that he felt that some of his
10 neighbors had been misled by other neighbors and that [too] much had been made about
11 the open area. He pointed out that there will be a lot of open area because of the drainage
12 ditch to the south. Mr. Warneka showed photographs of his property. He believes that
13 there is a nice, large building pad area that is available and that the property will
14 accommodate two 2.5 acre lots.

16 Commissioner Koehler asked for clarification as to the location where the photographs
17 were taken. Mr. Warneka described the location.

19 Mr. Warneka stated that one home in the neighborhood had been turned into a duplex via
20 a variance. Commissioner Koehler asked about identifying the duplex. Ms. Hanson
21 indicated that she would research this question.

23 Ben Shaw of 4050 147th Lane NW, lives south of the property for which the variance has
24 been requested. He showed an Anoka County plat that demonstrated that the property for
25 which the variance has been requested might not be 5 acres in size. He also felt that the
26 variance would change the essential character of the neighborhood.

28 Heather Myers of 4115 147th Lane NW, wanted to clarify that her home was not a
29 duplex, but that it was remodeled and an addition created to accommodate a mother -in -
30 law suite. She noted that there is not an outside entrance.

32 Tom Jordan of 14800 Blackfoot Street NW, stated that his home was one of 2 homes that
33 were shown in the photographs across the street from the property for which the variance
34 is being requested. The house next to his is the one further away. He asked the
35 Cormnissioners to consider [housing] density due to residents being on well water.

37 Katie Shaw wanted to address the assertion that the neighbors were being misled. Her
38 primary concerns related to the potential for setting precedence. She also stated that the
39 open land referred to in the photographs actually showed her land.

41 Derek Jordan of 14800 Blackfoot Street NW, asked for clarification regarding the
42 applicant being approached by builders and the City [regarding purchase of the property].
43 Ms. Hanson stated at this time the City was not interested in the property, but she was not
44 sure about what might have come up in the past.

2 carried on a 5 -ayes, 0 -nays, 2 -absent vote (Cleven and Daninger).
4 Commissioner Koehler asked if the City knew the size of the property. Ms. Hanson
5 replied she did not and that the applicant would be required to have a licensed survey and
6 must meet the 2.5 -acre minimum for each lot.
8 In response to Commissioner Peterson's question, Ms. Hanson stated that it is up to the
9 applicant to prove the "plight of the property owner."

11 Commissioner Koehler stated that the issue of open space has nothing to do with the City
12 Code. He expressed his belief that homeowners have an expectation that everyone is
13 expected to play by the same rules. He was not comfortable that the lot split did not meet
14 City Code.

16 Ms. Hanson stated that if the variances are approved, the home owner has to act within
17 one year or the variance will become void. If the acreage minimum is not met, the
18 variance goes away. She believes that there is sufficient high ground for septic, well and
19 a building pad.

21 Commissioner Koehler commented that the approval of other variances should not have a
22 bearing on the decision making and that the Commission should look at the issue on the
23 basis of the argument.

I am writing to ask you to uphold the Planning and Zoning Commission's 4-1
recommendation to deny the variance for a lot width reduction at 14791 Blackfoot Street
NW, allowing a lot split to occur. I do this for the following reasons:
1) The estimated acreage of this lot is overstated
2) The fact that the variance simply does not meet two of the four conditions to establish
"practical difficulties" in complying with the official control
• the circumstances are not unique to the property
• the variance will change the essential character of the locality
3) The potential to set an unwanted precedent
For the record, my wife and I live directly to the south of the subject property, moved into the
neighborhood in 2010 from NE Minneapolis, love the open space and feel of Andover, and
hope to raise our two children through adulthood in this house and city. The potential for a
lot split in this neighborhood where we understood things were platted specifically to prevent
such an occurrence has taken an emotional toll on us and I think much of the neighborhood.

The variance requestor has stated in letters to the Planning and Zoning Commission for the
May 9'h meeting that they have 6 acres. This comes from the Anoka County GIS website
where 14791 Blackfoot Street is listed at 5.99 "Estimated Acres." No survey has been
conducted. The website does make it clear that "The Anoka County Surveyors Office' does
not calculate the acreage of private property. However, an approximate acreage is listed
with the Property Information box located on the Anoka County GISWeb application. The
best method to determine an accurate acreage is to hire a licensed Land Surveyor."
As a lakeshore property owner myself, I have been interested in the actual boundaries of our
property as the lake rises and falls. The MN DNR and other sources would suggest that for
a lake such as Round Lake, the shoreline owners would own the lakebed should it dry up.
My visit to the Anoka County Surveyor's office on 23June2017 indicated that it might not be
that clear and "would likely all end up in court." The Surveyor's office was.quite helpful and
explained the "+/-" lot depths on our lots are because our lots "vary with the lake" and
therefore the acreage varies as well. As we talked about the height of the lake this year and
the number of cattails shown in our lot, they even suggested a visit to the assessor to see if
we could pay less tax.
Why is all of this important? It is important because our lots are dependent on Round Lake
• the circumstances are not unique to the property
The landowner did not create these circumstances, but bought into them as they existed
from the beginning of the plat for Lund's Round Lake Estates in 1977.
The circumstances are simply not unique to 14791 Blackfoot Street. A quick search of the
neighborhoods in the R-1 zoning district surrounding Round Lake and Kelsey Round Lake
Park on the GIS website yields multiple properties exhibiting acreage but not lot width:

The point here is not the specifics of any one property or comparison. The point is that one
does not need to scour the large R-1 zone of Andover to find similar properties. In a very
short distance of less than 10 blocks, there are quite a few properties that are similar. It can
be concluded then that 14791 is not unique in the R-1 zone.
• the variance will change the essential character of the locality
Allowing a lot width reduction and lot split, with subsequent development will absolutely
change this neighborhood. As you walk, bike or drive the streets around Lund's Round Lake
Estates (as well as neighborhoods to the north), the houses are far apart with plenty of
woods and open space between them. They are generally the same size and style, and are
harmonious with the awesome amount of nature we are so fortunate to enjoy.
My wife and I chose to move to Andover, and in particular this section of Andover, because
of the spacious, natural feel of the neighborhood and the amount of land between houses.
When we left Minneapolis we deliberately did not move to Fridley, Coon Rapids, or Blaine
where the houses are so much closer together. Andover's schools were a selling point, but
we did not want to live in the much newer neighborhood to the south of us or other
developments in the city, settling instead for a 1978 build because of the character of this
special place in Andover.
Allowing this variance would create two "spaghetti" lots with widths 50% of the other homes
in the area. It would also create the two closest houses in the immediate neighborhood
(14791 Blackfoot and the new home), splitting the -3 acres of land that exists. It would be a
true anomaly for Lund's.
I believe the amount of feedback the Planning and Zoning Commission received was a direct
testament to the neighborhood's understanding that the character of Lund's will be
undesirably and irreversibly changed.
3) The potential to set an unwanted precedent
On this point I will be brief. Great consideration should be given to allowing variances at
50% of a zoning requirement as critical as width, depth or acreage. It should be noted that
the example properties noted above were only lots with potential acreage but not width.
There may be numerous other properties in the R-1 zone that meet width (300') and depth
(150'), but not acreage (2.5 ac). How will the Council respond when someone else wants a
variance?
In summary, I strongly oppose this variance request for the reasons outlined above. The
acreage is not there, the property is not unique in its' circumstances, the variance will
undeniably change our neighborhood, and this could set a very unfortunate precedent for
our future.
Andover's residents recently remarked at the best things in Andover: strong neighborhoods,
small town feel, open space and a rural nature, quietness and peacefulness to name a few.
The top serious issues noted were too much growth and high taxes. We are a microcosm of
that sentiment. I urge you to uphold the Planning and Zoning Commission's
recommendation and deny the variance at 14791 Blackfoot Street.

This unfortunate situation in our neighborhood is ABSOLUTELY not personal.
My late wife and 1(scott abelson) are friends with lee and sandy wameka .
I am to passionate for my neighborhood and beautiful round lake, to remain neutral on this
matter.
First,we are against this variance and the building of one dwelling not to mention two
dwellings.
My address is 14870 blackfoot st.
1) susie and 1 moved to our home over 25 years ago blackfoot st, reasons it is so beautiful and
completely developed as far as dwellings,
Knowing we all have privacy woods between neighbors, always love how beautiful riding bike
or driving east on 147L.n. blackfoot st sunrise and nature , wild life, this would be gone, this will
change the ESSENTRAL charactor of our neighborhood, and neighbors that live next door and
across the street from subject will be incredibly affected if this is passed, again the view is gone,
the privacy is gone , the whole charactor of our beautiful blackfoot st and round lake would be
gone, and never the same again.
2) are we not trying to preserve the wildlife and beautiful of round lake?
3) first thing be for even having this variance vote a property must be surveyd
There may be 1.5 ac between blackfoot st and water lake, gussing is not acceptable for property
lines.
4) this must be considered, most important thing a mayor
or council members MUST
consider and ALWAYS stay away from is PRECEDENCE
