MINUTES
10 The Workshop Meeting of the Andover City Council was called to order by Mayor Julie Trude,
11 February 28, 2017, 6:00 p.m., at the Andover City Hall; +1685 Crosstown Boulevard NW,
12 Andover, Minnesota.

25 Mr. Dickinson introduced to the Council the new Associate Planner, Dan Krumwiede.

27 COMPREHENSIVE PLAN UPDATE DISCUSSIONS

29 Ms. Hanson explained the Packer Family has requested a Conditional Use Permit (CUP) to split
30 their land. The Planning and Zoning Commission really liked this plan and would like it to move
31 forward. She noted she has been working very closing with the Met Council on this item and
32 they have already reviewed it and are on board with the plan. She stated the Met Council like the
33 way it is proposed because it is very simple.

35 Ms. Hanson stated what is being proposed is to add to the current Comprehensive Plan an
36 amendment allowing for density, of one unit per ten acres in Rural Reserve Residential areas.
37 The Met Council already allowsfor this in their policies, allowing people to further subdivide
38 their land as long as there is a`zoning ordinance with provisions in it providing for future urban
39 development. She stated they would need to approve the Comprehensive Plan amendment and
40 then create a zoning district which will be Rural Reserve Residential (RRR) and have the
41 regulations in there with mechanisms providing for future urban development. She stated she is
42 proposing a five acre lot minimum to keep very minimal impact in that area. Some of the things
43 they will need to look at in the zoning code is requiring applicants to put the building pad in an
44 area that it can be further subdivided in the fixture, this will require some type of ghost plating so
45 they have a general idea on how the lot can be laid out and would keep in compliance of
46 ordinance provisions.

1 Mr. Dickinson reviewed with the Council how the new Rural Reserve Residential District would
2 look.

4 Councilmember Bukkila stated her only concern would be with people coming forward in the
5 future and the Council would not have enough guidance to make an informative decision. Mayor
6 Trude wondered if the Council would want more rules regarding this.
7
8 Ms. Hanson drew an example on the white board and stated their provision would allow
9 someone to subdivide to five acres per lot, but would still need to keep the density to four units
10 for forty acres of land. This will still be considered Rural Reserve and will not lose that
11 designation. Mr. Dickinson stated the applicant will still need to ghost plat the parcel to show
12 what it could look like in the future if developed.

14 Mayor Trude stated the Council liked that the residents can build on their inheritance but
15 wondered if they would want to open this up for selling off the land and chipping the rural
16 reserve down. Mr. Dickinson stated the home would still need to be on road frontage and would
17 still have to maintain the four houses per forty -acre rule.

19 Mayor Trude wondered if a street came through like Veterans Memorial would they be able to
20 split off more land. Mr. Dickinson stated that would be up to the Council to decide and he did
21 not think this will be a big deal. He thought it would be unfeasible for that type of situation to
22 happen.

24 Mayor Trude wondered if this could be done on the fringes of the Rural Reserve because she did
25 not want this to include the entire Rural Reserve area. Ms. Hanson stated this would need to be
26 done throughout the entire Rural Reserve area and must be part of the Zoning Code. Mr.
27 Dickinson stated the Comprehensive Plan has to be put in place first and then they will have to
28 go and add language to the Zoning Code.

30 Councilmember Bukkila asked if there will be language in this stating that there needed to be
31 frontage road in order to split and develop. Ms. Hanson stated they could. Mr. Berkowitz
32 thought that was already in the City Code.

34 Councilmember Holthus asked if on a forty -acre parcel would there be 350 feet of frontage. Mr.
35 Berkowitz indicated there would be.

37 Councilmember Holthus asked what the MUSA potential is to expand into the Rural Reserve.
38 Mr. Berkowitz stated they are looking at the new Atlas 14 restrictions and are working with the
39 Coon Creek Watershed District on the potential of what impacts the Atlas 14 will have on the
40 Rural Reserve. He stated the current model shows a huge area within inundated with water.
41 Some culverts throughout the farm ditches could be lowered with the potential of alleviating
42 some of that impact. He stated the biggest challenge will be what will Atlas 14 impacts have on
43 that area and how will it develop.

1 Councilmember Knight asked what the Met Council's goal was in setting the rules in the area.
2 Mr. Dickinson stated right now the City rules are stricter than the Met Council rules and the City
3 is trying to be compatible with Met Council rules to allow one in ten in the Rural Reserve.

5 Councilmember Goodrich stated he wanted to let people do as much as they can without getting
6 jammed up. He wondered if there were any thoughts on one per eight or having five acres
7 across. Ms. Hanson stated the one unit per ten acres is Met Council policy.
8
9 Mayor Trude wondered if the City can push the Met Council on this. Ms. Hanson stated they
10 would likely not be successful pushing the Met Council on their policy as it is consistently
11 applied.

13 Ms. Hanson stated the next step will be a public hearing in March and then off to Met Council if
14 the Council approves moving this forward. The City Council unanimously agreed to have staff
15 move this item forward.

17 Ms. Hanson and Mr. Krumwiede left the meeting.

19 COMMUNITY S UR VEY DISCUSSIONS
20
21 Mr. Dickinson explained during the City of Andover 2017 Budget and 2017-2021 CIP
22 development discussions, there was a desire to pursue a community survey to determine resident
23 support for current city services, programs and potential capital projects. At the January
24 workshop, the City Council instructed Administration to proceed forward with a 2017
25 community survey.

27 Mr. Dickinson reviewed changes he has made to the survey questions for 2017. He noted
28 Councilmember Holthus asked to remove "issues facing" from the beginning paragraph in the
29 survey.

31 Councilmember Holthus indicated she would like to change question 4 from "issue" to
32 something else, like "challenge". The Council thought "challenge" was a better word than
33 "issue".

35 Mayor Trude thought they could replace iteml3, "One level housing for seniors maintained by
36 an association" with the new item below 7 "Association Maintained Housing". Councilmember
37 Bukkila wondered if the question is too long and as she looks at the question she wonders what
38 the purpose of the question is. Mr. Dickinson stated the question asks if the City has too much,
39 too little or enough of a particular type of housing. Councilmember Bukkila thought the question
40 ends up being too vague and thought this should be two different questions.

42 Councilmember Bukkila stated she did not understand what "move up" housing meant. Mr.
43 Dickinson stated this would be mid-range housing.

1 The Council thought the survey wording for item 9 should be changed from "move up" housing
2 to "mid-range housing". Mr. Dickinson stated they have "Starter homes for young families",
3 maybe they could change the item to "Move up housing for growing families". Mayor Trude
4 asked what the goal for this was. Was it a guide to help the City Council guide their decisions or
5 for staff working with people on land development. She wondered if this was like a market
6 study. Councilmember Holthus thought this would be helpful for developers in trying to figure
7 out what types of homes are needed in the City.

9 Councilmember Knight stated there is not any category for multiple housing. Mr. Dickinson
10 stated apartments and townhomes are listed. Mr. Dickinson stated they could ask Mr.
11 Leatherman what he thought when he arrived.

13 Mr. Dickinson stated questions 44 through 50 should be removed because he did not think
14 commuting and the Bunker overpass was relevant at this time.
15
16 Mr. Dickinson stated he added a question for dangerous dogs/cats and removed upkeep of
17 boulevards. He also added a question for tall grass, if there was too much, not enough or too
18 little. Councilmember Holthus stated she would like to add a question of weeds because she was
19 not concerned about tall grass but more about weeds.

21 Mr. Dickinson stated he would like to remove questions 61-62 because they are not relevant.

23 The Council and staff reviewed questions 63 through 65.

25 Mr. Dickinson stated question 64, list the four open spaces and ask if the resident has visited any
26 of the four. Councilmember Bukkila thought this question has a language issue in terms of open
27 space. Either the question is asking about open space or about parks. Mr. Dickinson stated it is
28 related to open space and the park names listed will be replaced with open space names.

30 Mayor Trude thought they should remove question 65. Mr. Dickinson stated the Park and
31 Recreation Commission wants this left in but he could take it out if the Council wants it
32 removed. Mayor Trude stated she did not think this would help them make decisions.

34 Mr. Dickinson stated they should remove questions 66 because they are not purchasing anymore
35 open space in the City.

37 Mr. Dickinson stated he added a question between 68 and 69 "What could the City do to enhance
38 your use of the city trails". He also added a question after 69, a money question on trails. The
39 City Council indicated they would like that. Mr. Dickinson noted that no more than three money
40 questions should be asked within a survey.

42 Councilmember Goodrich stated he would like to give residents the thought that nothing is for
43 free and if they want added amenities in the City they will need to pay for them.

1 Councilmember Bukkila noted her son is still complaining two years later about the wood chips
2 in the park and will not use the park anymore. She wondered if a question could be directed to
3 something like if the use of a park has changed because of something that has changed in the
4 park.

6 The Council and staff discussed safety changes in the parks.
7
8 Mr. Dickinson stated they could add a question at the beginning of the park and recreation
9 section "Do you use City parks, if not, why not, what would you improve in the parks" then
10 transition into the park and recreation questions.
11
12 Mr. Peter Leatherman from Morris/Leatherman arrived at the meeting at 6:55 p.m.
13
14 The Council updated Mr. Leatherman on the progress of the items they are discussing.
15
16 Mr. Leatherman thought on question 70, if the person being asked the question indicated the
17 parks as being good, fair or poor then find out what needs to be improved which would then tap
18 into further questions. The Council thought that was a good change.
19
20 Mr. Dickinson stated he added the new question "How safe do you feel when visiting your
21 neighborhood park?" Councilmember Bukkila thought the question should be changed to how
22 safe do you feel your neighborhood park is after hours and also ask the input of the residents
23 around the park rather than users of the parks. Mr. Leatherman stated this is a good question but
24 if there is a concern about safety there needs to be a follow-up question, why are the parks not
25 safe.

27 Mr. Dickinson stated the next changes he made are to the questions in regard to the meeting he
28 had with the Community Center Advisory Commission and the Park and Recreation
29 Commission.

31 Councilmember Bukkila stated she did not like these questions because they are so vague in
32 terms of indoor/outdoor activity and some people might only think of the YMCA amenities
33 rather than what is needed at the Community Center. Mayor Trude thought they wanted to know
34 if all the activities are being met. Councilmember Bukkila thought this question is not isolated to
35 the city campus, it says the city as a whole.

37 Mr. Leatherman stated he was at the Park and Recreation Commission meeting and as this
38 question is set up now, it is a fishing expedition and will likely not be fruitful. If they have
39 specific amenities that the Council would like to see if there is support for in the Community
40 then it should be asked in a specific context. He thought there was a hesitancy of the Park and
41 Recreation Commission that if they asked a specific question they would get a no answer.

43 Mr. Leatherman stated at the end of the day it has to be grounded in what the community would
44 support that requires additional taxes. He stated he would phrase it in a manner of "would you

1 support an increase in your property taxes or the use of City funding to do x, y, z", whatever
2 those specific things are and if they support any of those things then he would ask "how much
3 would you be willing to see your property taxes increase for that purpose". He stated this will
4 give the Council an indication of what the residents want and how much they would be willing to
5 pay for additional amenities.
7 Mayor Trude stated that is a good question but they do not have an equation of if they want to do
8 A, B or C, they are talking about if they do a second sheet of ice it wouldn't be just a second
9 sheet of ice, it would be a multi -use indoor facility. She wondered how they would gauge what
10 the uses are that the community would want to see in there. Mr. Leatherman asked what things
11 the Council was thinking about.

13 Mr. Dickinson stated there is the expansion of the Community Center itself for field house use or
14 dry floor activities, storage (they would not ask about the storage part). It is also ice, an
15 additional court for basketball. Councilmember Knight stated it could also be additional space
16 for more activities. Councilmember Bukkila stated she liked the Teen Center question because it
17 was very specific. She stated she did not like the comparison to other cities because those with
18 amenities have twice the population and tax revenues. She felt the question was a set up for
19 failure and felt when asking for comparisons it sets them up for failure and did not think the
20 question had any value.

22 Mayor Trude thought one of the issues they run into is they have kids going to different schools
23 with different amenities and the kids going to other schools besides Andover are being taken care
24 of by the other cities also so she did not want to pit the kids going to Andover or the other
25 schools with a survey question that would not apply.

27 Mr. Leatherman stated he cannot think of a community that would support an additional sheet of
28 ice in the way it is phrased because hockey parents are a tiny piece of the population as a whole.
29 They either ask the question specifically and gauge it or it is something they need to do and don't
30 ask the question because if asked he thought the question would be answered in a way that would
31 box the Council into a position of not being able to do it at all.

33 Councilmember Holthus did not think they should have a hockey related question. Mayor Trude
34 stated they have not asked a specific question before about other sports and did not think they
35 should have a hockey specific question either.

37 Mayor Trude asked how they can gauge general support of activities in the City. Mr.
38 Leatherman stated this needs definition to have a meaningful support. Mayor Trude asked if the
39 question "would you support additional facilities for organized activities for youth, seniors or
40 adults". Could that question work. Mr. Leatherman indicated that was helpful in order to put it
41 into context. He stated he did not want to give the Council a response that is vague. It is a waste
42 of a question and they needed to create a context of what the Council wants an answer to.

44 Councilmember Bukkila asked if there should be a question in regard to each of the activities and

1 a yes or no answer for each of them. Mr. Dickinson thought they should talk about an expansion
2 of the city facilities to provide for additional activities.

4 Councilmember Holthus thought the question needed to have an introductory educational
5 question such as "As you know the Community Center has xyz and the YMCA has xyz, do you
6 support an expansion of either the YMCA or the Community Center." They should start off with
7 a statement describing what each of the entities are and provide.
8 Mr. Dickinson reviewed the introduction they have in the survey regarding the YMCA and
9 Community Center.

11 Mr. Leatherman stated he has tried to think of a way to get them data that is useful and not box
12 them in. He suggested after the Community Center use, they go through a specific list in the
13 community: Do you think there is: adequate field house space, adequate amount of ice, athletic
14 fields, meeting room space or is there too much, too little, etc. and then ask the question "would
15 you support additional City funding or additional facilities in the City." "How much would you
16 be willing to support" and if they support additional funding, ask them what specific amenities
17 would they support additional funding for, after they have already grounded it with the specific
18 facilities they are talking about.

20 The Council thought that was great but Mayor Trude thought it was so specific. Mr. Leatherman
21 stated he was not going to ask them to spend money, he was asking if they felt the City had
22 enough or not enough or too much. It will be a scale on that. Councilmember Goodrich thought
23 that would give them a good indication of what the residents want.

25 The Council requested they remove indoor/outdoor activity sections and leave in
26 YMCA/Community Center questions.

28 After question 81, add the question "The City of Andover is considering taking on a role of
29 facilitating the coordination of community volunteers. Should the City have a role in
30 coordinating community volunteers?"

32 Mayor Trude thought a question to ask is how do they let people give back to their community if
33 they want to and should they do that. Councilmember Bukkila stated that is typically a volunteer
34 coordinator position in Government services. She wondered what would be the point of having a
35 volunteer and do they want to pay an employee to coordinate them. She stated there is a cost
36 factor to volunteerism. Mr. Leatherman stated they could ask a question like "do you feel there
37 is enough volunteer opportunities in the community". The follow up could be "would the City
38 have a role", or something like that. He stated he would work through questions for this and the
39 Council can review them in the draft.

41 Mr. Dickinson stated he removed questions 82 and 83 from the survey.

43 Mayor Trude thought the question after 87 should be reworded to find out what is more useful in
44 the newsletter and if they want more information in each newsletter or more frequent

3 Mr. Leatherman stated 70 to 80 percent of people will say it is fine the way it is. If there is
4 something missing they will tell the surveyors. He thought they could ask people to rate the
5 format, appearance and the content of the newsletter. If content is rated good, fair or poor, then
6 they could ask another question such as "what would you want to see improved or added to the
7 content of the newsletter".
8 Mr. Dickinson stated he added a new question "Would you support a local government news
9 program". Councilmember Bukkila did not think this said anything to her, she wondered if it
10 could be changed to something else. Mr. Leatherman suggested "How likely would you watch
11 an Andover government news program on cable tv."

13 Mr. Dickinson stated questions 97, and 98 are not relevant and should be removed.

15 Mr. Dickinson stated going back to questions 6-19, "move up" housing is middle of the road
16 housing and the Council thought this could be changed to mid-range housing. Mr. Leatherman
17 stated people do know what "move up" housing means but it can be changed if the Council likes.
18 He stated there is language they use to explain this to people who do not know what it means.

20 The Council requested changing higher cost housing to "executive housing".

22 Mr. Dickinson stated in regard to question 64, he thought it might help to have an opening
23 paragraph telling people what open space is. He stated after indicating the four open spaces the
24 City has to ask the person if they have visited any of them and if yes, which have they visited.
25 He thought they should list the four open spaces leading to the awareness of this.

27 Mr. Dickinson stated after the next Council meeting he thought the Council could have a short
28 workshop meeting to discuss changes to the survey questions.

30 The Council thanked Mr. Leatherman for attending their workshop meeting.

38 DISCUSS CITY TREE PRUNINGAND REMOVAL PROCESS

40 Mr. Berkowitz explained the City Council is requested to discuss with Public Works staff tree
41 pruning and tree removal practices within the City right-of-way, City owned property and City
42 parks.

44 Mr. Berkowitz reviewed the staff report with the Council.

1 Councilmember Goodrich stated he is in support of the policy they have. He stated he likes the
2 fact that they do not allow new trees and shrubs so close to the road. If there is a risk of safety
3 and vehicles then the trees need to be removed.

Mr. Grode made a tree presentation to the City Council.

7 Mr. Becker made a public works, street department tree removal presentation to the City
8 Council.
10 Mayor Trude stated the Council appreciated what staff does.

12 CITY COMMUNICATIONS DISCUSSION
13
14 Mr. Dickinson explained communication in government serves to communicate and deliver
15 messages directly to citizens and encourage citizen involvement; and to provide a mechanism for
16 interaction and feedback from citizens.
17
18 Mr. Dickinson stated currently the City of Andover has many different ways in which we
19 communicate with the residents including: the City Website, email, Facebook, Twitter, City
20 Newsletter, electronic message boards, QCTV and print materials. The City Council is requested
21 to discuss current City communications.

23 Mayor Trude stated two people, Anna Dirkswager from Open Space Commission and Angela
24 Marinello from the Park and Recreation Commission are interested in providing some input
25 about communication. She stated Councilmember Knight has suggested making the newsletter
26 with more content and a nicer looking one. She asked if there was someone on staff who could
27 put information out continually to the public to keep them updated on what is happening in the
28 City. Mr. Dickinson stated he was cautious about what goes out to the public because anytime
29 they put information out there is a cause and effect involved and he needs to make sure they are
30 ready to deal with the responses. Mayor Trude stated people are big on information and want to
31 know what is going on.

33 Mr. Dickinson stated in regard to County roadwork they are pushing the questions out to the
34 County website where they have the resources and people who can handle it. He noted there are
35 very few followers on Twitter and they do have a Facebook page where they post information.
36 The newsletter goes out six times a year.

38 Mayor Trude stated in regard to the newsletter they may want to look at producing eight issues.
39 People want to know more about open space and they do not really talk about what is going on at
40 the Community Center. Mr. Dickinson stated whatever is submitted regarding the Community
41 Center they include in the newsletter.

43 Councilmember Knight suggested they put in a middle page to the newsletter and include more
44 content. Mr. Dickinson stated they can increase the size of the newsletter but they need to find

out what kind of things people are looking for to add to the newsletter and thought that is where
the community survey will come into play and become helpful.
Councilmember Holthus stated when she looks at other city newsletters she notices the color and
that there are photos and the City newsletter is not the same quality look. Mr. Dickinson stated
they could change the newsletter if that is the Council's desire. Mayor Trude stated they did try
to do a sample newsletter a few years ago, that had glossy black and white with pictures and
there was not any feedback regarding it.
Mayor Trude stated they can change items but they need to find someone who is willing to work
on the newsletter to make it better with more content. She thought it would be fun to tag some of
the children's activities in the City. Mr. Dickinson stated they can look at this further but
currently they are budgeted for publishing the newsletter six times a year.
Mayor Trude stated she did not like the formatting and layout that has been done on the
newsletter and thought this could be improved. Councilmember Bukkila did not think subjects
were grouped appropriately together. Mr. Dickinson stated they can have this published
elsewhere, they are using ECM primarily for the mailing component, the bulk rate ship. He
stated they could have the newsletter farmed out and formatted. He stated he would have
someone seek out proposals for this, if that is the direction.
Mr. Dickinson stated the message boards try to focus on City, City Partner or City sponsored
events.

Mr. Dickinson reviewed the December 2016 Budget with the Council.

The Regular Bi -Monthly Meeting of the Andover City Council was called to order by Mayor Julie
Trude, March 7, 2017, 7:00 p.m., at the Andover City Hall, 1685 Crosstown Boulevard NW,
Andover, Minnesota.

26 Mr. Janish reviewed the information with the Council. The applicant proposed to have liquor sales
27 at a new establishment known as Joy Kitchen, located in the Shops@Andover. The
28 Shops@Andover building is located at the intersection of Bunker Lake Boulevard and Hanson
29 Boulevard.

31 City Code 12-12 requires a Conditional Use Permit (CUP) for liquor sales in the Industrial District.
32 Once a CUP is approved, the applicant will be required to obtain a liquor license that will be issued
33 by the City Council. In granting a Conditional Use Permit, the City Council considers the advice and
34 recommendation of the Planning and Zoning Commission and the effect of the proposed use upon
35 the health, safety, moral and general welfare of occupants of surrounding lands. Staff believes the
36 CUP will not affect the health, safety, moral and general welfare of the occupants of surrounding
37 lands. Existing and anticipated traffic conditions, including parking facilities on adjacent streets and
38 land must also be considered. Staff believes the CUP will not generate additional traffic to the
39 commercial area. Parking facilities are adequate and provide the required number of parking spaces
40as-required by -City -Code.- The effect on values of property and scenic views in the surrounding- area, - -- -.
41 and the effect of the proposed use on the Comprehensive Plan must also be considered. Restaurants
42 are a permitted use within the commercial districts and liquor sales are allowed with a CUP and
43 liquor license. Staff believes the CUP will not have a negative effect on surrounding property
44 values.

2 The Planning and Zoning Commissionmade their recommendation on February 28, 2017 when they
3 held a public hearing regarding the CUP request in which there was no public input. The Planning
4 and Zoning Commission recommended approval on a 5-0 (2 absent) vote.

6 In considering the request, Mayor Trude inquired if hard liquor would be served. Mr. Dickinson
7 confirmed that the license would be for beer and wine and would be considered as the next agenda
8 item.

10 Motion by Holthus, Seconded by Knight, to approve Resolution No. R020-17, approving the
11 Conditional Use Permit request for liquor sales located at 13650 Hanson Blvd NW, Suite 102.

17 Mr. Dickinson explained Tsang Cheong Kwok has applied for an On -Sale Wine License for Joy
18 Kitchen located at 13650 Hanson Boulevard NW, Suite 102.

20 The Sheriffs Office has completed their background investigation. The investigation came back
21 satisfactory.

23 Motion by Holthus, Seconded by Bukkila, to approve the liquor license for the period of March 8,
24 2017 through December 31, 2017. Motion carried unanimously.

26 The owner of Joy Kitchen stated the restaurant will serve Japanese, Chinese and Thai food. They
27 hope the restaurant will open to the public in April, if all goes well.

29 Mayor Trude commented that Dunkin' Donuts should be open in a few weeks and she is looking
30 forward to the cuisine at Joy Kitchen.

32 CONSIDER CLASSIFYING DANGEROUS DOG1147607THAVENUENW

34 Mr. Dickinson reviewed the staff report with the Council. He noted the owners were not in
35 attendance at the meeting.

37 The City Council was requested to receive a presentation, gather testimony and to consider adopting
38 the resolution declaring a Pitbull, named Titus, a dangerous dog.

-40--Police-reports-and-correspondence-were-provided to -the-Council-explaining-the-circumstances-of-
41 incidents with the dog. February 23, 2017 in a police report dog owner Leopoldo Silguero stated to a
42 deputy that the dog had been relocated. In Mr. Dickinson's opinion, due to the severity of the attack,
43 administration decided to hold the public hearing to determine whether or not to classify Titus as a
44 dangerous dog in the City of Andover, in the event the dog ever returns to the City.

2 To declare an animal a dangerous dog/cat, the criteria are as follows: 1. without provocation,
3 inflicted substantial bodily harm on a human being on public or private property; or 2. without
4 provocation, killed or inflicted substantial bodily harm on a domestic animal while off the owner's
5 property; or 3. been found potentially dangerous, and after the owner has been notified that the
6 dog/cat is potentially dangerous, the dog/cat aggressively bites, attacks, or endangers the safety of
7 humans or domestic animals. Emphasis was placed on criteria number 2.
9 Mr. Baumgartner also noted no one was there to testify. He noted that the police report would be
10 evidence to criteria number 2. He stated he had also reviewed the letter submitted by the dog owner.

12 Mayor Trude restated there was no one in the audience at the time of the discussion item.

14 Mr. Baumgartner confirmed the Council was entitled to name Titus, if it so choses, as a dangerous
15 dog.

17 Mr. Silguero had been informed of the time and place of this meeting and could appear to provide
18 testimony. The following is a chronology leading to this hearing: February 18, 2017—Police report
19 stating said dog ran onto the neighbor's property and attacked a Toy Poodle causing significant
20 injury. Due to his injuries, the Toy Poodle was euthanized. February 22, 2017 — "potentially
21 dangerous" dog notification was sent to Mr. Silguero. February 23, 2017 — Police report stating the
22 Deputy followed up with Mr. Silguero who stated his Pitbull Titus has been relocated. February 27,
23 2017 — "dangerous dog" hearing notification for the Pitbull Titus was sent to Mr. Silgureo.

25 Motion by Goodrich, Seconded by Holthus, to approve Resolution No. R021-17, declaring a dog
26 owned by Leopoldo Silguero, 14760 7 t Avenue NW, as a dangerous dog pursuant to City Code Title
27 5, Chapter 1, Section 5 -IA -1 1.

29 Mr. Baumgartner indicated this motion is taking all of the evidence into consideration. Each
30 councilmember outwardly acknowledged that they considered all of the facts in the case.

34 Mayor Trude reiterated this dog is no longer in the state of Minnesota. Mr. Dickinson clarified this
35 action was taken by the City, not an action taken by individuals in the neighborhood.

--40Mr–Dickinson-described amendments -to -the -Bunker - Hills -Regional-P-ark Master -Plan -Amendment. -
41 These included: a road reconstruction project, Activity Center/Maintenance Garage– city water and
- 42 sewer, 2 new outdoor gathering areas to handle other activities/outdoor seating (a second seating area
43 would be in the place of the greenhouse, which is no longer actively used that way), and trail access
44 to Goldenrod Street at a better and safer access point to connect to the Activities Center. Other

1 capitol items would be paving the trail on the north side of the development to make a trail
2 connection, cold storage at the current Activities Center, expansion of water and sewer at the central
3 maintenance shop, upgrades to the bathroom area, storage and cold storage. The overall budget for
4 the project would be $6.2 million. It was noted these upgrades will have the possibility of getting
5 outside grant funding.

7 Councilmember Knight wondered why 100 additional outdoor seats would be helpful. Mayor Trude
8 indicated there is a lot of demand for family events outdoors such as weddings and graduations.

10 Councilmember Holthus asked if residents could currently drink from a drinking fountain at the
11 Activities Center. Mr. Dickinson stated he did not know exactly why water quality has been an
12 issue.

14 Councilmember Holthus stated she is supportive of additional outdoor space, better water and new
15 trails.

17 Motion by Holthus, Seconded by Knight, to approve Resolution No. R017-17, in support of the
18 Anoka County's Bunker Hills Regional Park Master Plan Amendment. Motion approved
19 unanimously.

21 AWARD CITY CONTRACT FOR EMERALD ASH BORER (EAB) INJECTIONS/15-28

23 Councilmember Bukkila asked for a budget clarification regarding the City's EAB program,
24 specifically as to whether or not this was an annual budget item or recurring item. Mr. Dickinson
25 indicated the City had set aside $5,000 and if it is not used, it will be set aside again next year.
26 Further clarification brought forward that it is a pool of $5,000, with a one-time access by residents.

28 Mr. Dickinson stated for a resident's expense of $100.00, the City would pay up to 20% with a
29 maximum of $75 per property on a first come -first serve basis. He indicated the treatments can be
30 very effective. The company identified will guarantee the health of the ash tree for up to 3 years.
31 Mr. Dickinson continued by commenting that he is not typically in favor of City expenditures on
32 private property, but it is a majority issue and he is in favor of a discounted rate. His support is for a
33 one-time program, but not an annual allotment for reimbursement.

35 Mayor Trude noted she sees it as a carrot like the City did for Oak Wilt and she was able to save
36 trees on her property. Councilmember Holthus also commented she was able to save a lot of oak
37 trees on her property through that same program. Councilmember Knight recounted that Ham Lake
38 went through this last year with the Emerald Ash Borer.

19 ADMINISTRATOR'S REPORT

21 City Staff updated the Council on the administration and city department activities, legislative
22 updates, updates on development/CIP projects, and meeting reminders/community events.
23
24 (Meetings) Mr. Dickinson recounted recent meetings he had attended. He continues involvement
25 with legislative issues both locally and on the State level related to the State Metro Governance
26 Transparency Initiative. The public meeting on Hanson Boulevard reconstruction was not well
27 attended, with only about 50-60 residents there. Mr. Dickinson felt there were good comments and
28 discussion. Concerns were raised regarding planned detours and trails on both sides of Hanson
29 Boulevard as well as sound walls and issues related to powerline easements. Other recent
30 involvement in the community includes the Youth First Board and the Mayors' Prayer Breakfast.
31 Mr. Dickinson was also recently interviewed for the League of Minnesota Cities for their newsletter
32 where he talked about the Andover Community Center and other kinds of partnerships the City is
33 involved in.

35 (Development) Mr. Janish indicated that they were finishing plans and specs on projects. The City
36 is hearing from different developers regarding interest. Smaller businesses are looking for 1 and 2
37 acre lots, City staff are offering additional information about locating in the City of Andover. Comp
38 Plan amendment work has begun. The North Suburban Home Improvement Show is planned for the
39 coming Saturday, and they are hoping for a good turn -out.

42 (Mayor) Mayor Trude indicated residents are happy with those they hired from vendors at the Home
43 Show. The Parade of Homes has started. Ten homes are open for viewing in the City. The Mayors'
44 Prayer Breakfast was a nice fundraiser. There will be upcoming detours related to road closures and

reconstruction of Bunker Lake Boulevard. The National Mayors Water Challenge is being launched
April 3rd -at Mall of America. She would like to see if Minnesota can get a few more Minnesota
cities on the map. April is the month when people can sign up on-line.
Following the City Council meeting, the Council held a Workshop regarding the upcoming survey to
residents.

precincts equally represented.

BUDGET IMPACT

INTRODUCTION
The City Council is requested to approve the resolution removing the existing No Parking signs
which were used to regulate parking along both sides 168`h Lane NW during the school year
between Zion Street NW and Verdin Street NW.
DISCUSSION
The No Parking signs that currently exist were installed in 2004 to keep vehicles from parking on
the street during the hours of 8:30 am -10:00 am and 3:30 pm -4:30 pm, Monday — Friday from
September 15` -June 15`h during the school year. With entire length of 168`" Avenue NW now being
posted No Parking between Round Lake Boulevard NW and Verdin Street NW these special No
Parking signs used during the school year will no longer be needed and now are recommended to be
removed. These existing No Parking signs will be removed once the construction begins along this
section sometime in May.
Note: There is a new resolution on the agenda approving No Parking along both sides of 168`h Lane
NW that is required as part of the reconstruction of this MSA road.
ACTION REQUIRED
The City Council is requested to approve the resolution removing the existing No Parking which
was used to regulate parking along 168`h Lane NW during the school year between Zion Street NW
and Verdin Street NW.

INTRODUCTION
The City Council is requested to approve a resolution designating no parking for Project 17-11 along
168 Lane NW between 350 feet west of Crocus Street NW to Verdin Street NW as part of the street
reconstruction project.
DISCUSSION
168`h Lane NW from Round Lake Boulevard NW to Verdin Street NW is scheduled for construction
this summer as a Municipal State Aid (MSA) street. The project is anticipated to be constructed this
spring or early summer.
Since this street segment is a designated as a MSA street, state aid funds will be utilized to finance this
project along with assessments to the benefitting property owners. With the reconstruction of this
roadway, State Aid requires that parking be restricted along this segment. A No Parking resolution is
required to be approved by the City Council prior to the plan being approved by MSA. Note: The
segment of 168 Lane NW between Round Lake Boulevard NW and 350 west of Crocus Street NW
was previously approved as part of the MSA street construction back in 1991 (Project 91-14).
ACTION REQUIRED
The City Council is requested to approve the resolution designating no parking for Project 17-11, 168th
Lane NW Street Reconstruction Project.

DISCUSSION
A joint project between the City of Andover and the City of Coon Rapids is moving forward to
reconstruct 133`d Avenue NW between Crooked Lake Boulevard and Gladiola Street. The attached
agreement defines the responsibilities and cost for each party relative to the reconstruction project.
Staff and the City Attorney have reviewed the agreement and recommend approval.

AGREEMENT
FOR RECONSTRUCTION OF 133RD AVENEUE BETWEEN CROOKED LAKE BOULEVARD
AND GLADIOLA STREET
This Agreement is made and entered into this _ day of 2017, by
and between the City of Andover, a Minnesota municipal corporation, 1685 Crosstown
Boulevard NW, Andover, Minnesota 55304, hereinafter referred to as the "Andover," and the
City of Coon Rapids, a Minnesota municipal corporation, 11155 Robinson Drive, Coon Rapids,
Minnesota 55433, hereinafter referred to as the "Coon Rapids"
WITNESSETH
WHEREAS, 133rd Avenue NW between Crooked Lake Boulevard and Gladiola Street
NW is a border street between Coon Rapids and Andover; and
WHEREAS, Coon Rapids is proposing to reconstruct 133`d Avenue NW between
Crooked Lake Boulevard and Gladiola Street NW and Andover is in agreement to said
reconstruction of 133`d Avenue; and
WHEREAS, the project will provide an improved street to the residents of Coon Rapids
and Andover in that area: and
WHEREAS, Coon Rapids and Andover have funding for said proposed reconstruction;
and
WHEREAS, it is in the best interest of the parties to collaborate on the reconstruction of
133rd Avenue NW.
NOW, THEREFORE, IT IS MUTUALLY STIPULATED AND AGREED AS FOLLOWS:
L PURPOSE
The parties have joined together for the purpose of reconstructing 133th Avenue NW
between Crooked Lake Boulevard and Gladiola Street NW, hereinafter referred to as the
"Project", in the cities of Coon Rapids and Andover. Further, it is the intent of this agreement to
provide for the planning, engineering, and capital costs necessary to complete the Project and
provide for the operation and maintenance of the Project.
11. METHODS
A. Preliminary Planning/Approval
Coon Rapids, in consultation with Andover, shall provide for the planning, engineering,
construction, and construction administration for the Project.
B. Design
Coon Rapid_ s shall be responsible for all engineering and design services and will
prepare plans and specifications for the Project in consultation with Andover. Coon Rapids shall
not go out for bids until such time as Andover has approved, in writing, the plans and
specifications for the Project.
C. Bidding/Construction
Coon Rapids shall do the calling for all bids and the accepting of all bid proposals, and
shall cause the construction of the Project in conformance with the approved plans and
specifications. The award of the bid to the lowest responsible bidder shall be made in
consultation with Andover prior to the execution of the construction contract. After receipt of all
necessary governmental approvals, Coon Rapids shall cause the commencement of the
Project's construction and shall manage the Project through to completion.
III. COST ALLOCATION
A. The contract costs of the work or, if the work is not contracted, the cost of all
labor, materials, and equipment rental required to complete the work, shall constitute the
actual "Construction Costs" and shall be so referred to herein. Construction Costs shall not
include engineering related City staff time, overhead, or any other costs that are not
specifically part of a contract for services. "Estimated Costs" are good faith projections of the
costs which will be incurred for this Project.
B. Coon Rapids and Andover shall split equally the final Construction Costs related
to the reconstruction of 133th Avenue NW from Crooked Lake Boulevard to Gladiola Street as
follows:
The Construction Costs are estimated at $75,000.00.
ii. Engineering and construction administration costs shall be paid by
Andover in the amount of twenty percent (20%) based on the final
Construction Cost.
C. Andover shall reimburse Coon Rapids in full for its portion of the Construction
Cost plus 20% within 30 days of written invoice sent to Andover.
IV. TERM / TERMINATION
This Agreement shall continue in full force and effect until terminated as hereinafter
provided.
V. CONTRACTS AND PURCHASES
A. All contracts let and purchases made pursuant to this Agreement shall be made
by Coon Rapids in conformance to State laws. All contracts shall require payment and
performance bonds in the full amount of the contract naming both Coon Rapids and Andover.
All contracts shall contain the following indemnification paragraph:
i. The Contractor agrees that it will hold harmless, indemnify, and defend
Coon Rapids and Andover, its council members, officers, agents and
- ------ employees against any and all claims, expenses, losses, damages or
lawsuits for damages arising from or related to the negligent provision, or
failure to provide, services hereunder.
B. All contracts shall include the insurance requirements as set forth in Exhibit B,
which is attached hereto and incorporated herein.
VI. STRICT ACCOUNTABILITY
A strict accounting shall be made of all funds and report of all receipts and
disbursements shall be made upon request by either party.
VII. MAINTENANCE OF IMPROVEMENTS
The Cities hereby agree that 133rd Avenue from Crooked Lake Boulevard to Gladiola
Street shall be plowed by either City based on which City arrives to the area first in any
particular snow fall event. Each City shall be responsible for the street maintenance for its half
of the road from centerline. Future costs for crack sealing and chip sealing shall be split equally
between the two Cities.
X. NOTICE
For purposes of delivery of any notices hereunder, the notice shall be effective if
delivered to the City Administrator of Andover, 1685 Crosstown Boulevard NW, Andover,
Minnesota 55304, on behalf of the County, and to the City Manager for the city of Coon Rapids,
11155 Robinson Drive, Coon Rapids, Minnesota 55433, on behalf of the City.
XI. INDEMNIFICATION
Coon Rapids and Andover mutually agree to indemnify and hold harmless each other
from any claims, losses, costs, expenses or damages resulting from the acts or omissions of the
respective officers, agents, or employees relating to activities conducted by either party under
this Agreement.
XII. ENTIRE AGREEMENT / REQUIREMENT OF WRITING
It is understood and agreed that the entire agreement of the parties is contained herein
and that this Agreement supersedes all oral agreements and all negotiations between the
parties relating to the subject matter thereof, as well as any previous agreement presently in
effect between the parties to the subject matter thereof. Any alterations, variations, or
modifications of the provisions of this Agreement shall be valid only when they have been
reduced to writing and duly signed by the parties.

CONSTRUCTION/MAINTENANCE
INSURANCE REQUIREMENTS
The Contractor shall obtain and maintain in full force for the duration of the contract the
insurance designated as follows.
Worker's Compensation: The Contractor shall take out and maintain during the life of the
contract, Worker's Compensation Insurance for all of his employees employed at the work site.
If any employees are engaged in hazardous work not covered by Worker's Compensation
Insurance, the Contractor shall provide adequate protection from Employer's Liability Insurance
for protection of employees not otherwise protected.
Liability Insurance Requirements (Liability and Auto): Contractor shall maintain commercial
general liability (CGL), and if necessary commercial umbrella insurance, with a limit of not less
than $1,000,000 each occurrence. If such CGL insurance contains a general aggregate limit,
the general aggregate limit shall be not less than $2,000,000 and the aggregate limit shall apply
on a per -project basis. The CGL insurance shall cover liability arising from premises, operations,
independent Contractors, products -completed operations, personal injury and advertising injury,
and Contractually -assumed liability. The City of Coon Rapids and City of Andover shall be
named as an additional insured under the CGL.
Contractor shall maintain automobile liability insurance, and if necessary, umbrella liability
insurance with a limit of not less than $1,000,000 each accident. If such insurance contains a
general aggregate limit, the general aggregate limit shall be not less than $2,000,000. The
insurance shall cover liability arising out of any auto, including owned, hired, and non -owned
autos.
A certificate of insurance acceptable to Coon Rapids shall be filed with the Coon Rapids prior to
the commencement of the work. The certificate and the required insurance policies shall contain
a provision that the coverage afforded under the Contract will not be canceled or allowed to
expire until at least 30 days prior written notice has been given to Coon Rapids.
Fire Insurance: The Contractor shall carry full insurance against loss by fire and wind damage
upon all material in place or stored at the site for installation. This provision does not exclude
material partially paid for by the Owner. This insurance shall be for the full insurable value of the
material and shall be kept in full force until final acceptance and payment of the work by the
Owner.
If any section of the work entails special hazards the Contractor shall provide riders to the Public
Liability and Property Damage Insurance to provide protection from these special hazards.

Andover Comprehensive Plan Amendment (CPA) — Rural Reserve Land Use
Density Changes

BACKGROUND
At the October 25, 2016 City Council work session, City Council discussed a CPA request by
Jake and Jon Packer to allow the subdivision of land within the Rural Reserve District into
parcels smaller than what is currently allowed in the Comprehensive Plan. City Council
provided direction to staff to proceed with a CPA and ordinance to address future development
within the rural reserve area.
At the February 28, 2017 City Council work session, staff proposed changes to the City Council.
City Council supported the proposed changes. The draft meeting minutes are attached for your
review.
DISCUSSION
Comprehensive Plan
According to the Andover Comprehensive Plan, the Rural Reserve District was designated as an
area to accommodate future urban growth beyond the planned Municipal Urban Service Area
(MUSA). Lot splits of less than one unit/house per 20 acres and subdivisions of less than 1
unit/house per 40 acres is prohibited to prevent this area from rural residential development that
would preclude orderly MUSA expansion. The city has reached an agreement with the
Metropolitan Council (Met Council) that areas designated for residential development in the
Rural Reserve will be developed at 3 units/houses per net acre once MUSA is available.
Flexible Development
The Met Council supports densities of 1 unit/house per 10 acres in the rural reserve area.
Density beyond this is supported by Met Council; however, it requires provisions such as an
ordinance to allow for future wastewater service at a minimum density of 3 units/houses per acre.
Staff is proposing to retain a density of 1 unit/house per 10 acres; however with the adoption of
an ordinance, the minimum lot size may be reduced to 5 acres as long as the provisions in the
ordinance are addressed at the time of the lot split or subdivision. Planning tools that would need
to be considered in the ordinance include requirements of build -out plans (ghost platting), the
location of building pads that allow for future subdivision of the land into urban lots, and the use
of deed restrictions, easements, and/or covenants to protect the remaining land for future
development. The intent of the ordinance is to allow subdivision of land while preserving the
land for future urban development.
The following proposed language will be added to the Comprehensive Plan:

expansion. There are opportunities to allow for rural residential lot splits and development,
but requires the majority of the land be preserved for future urban development. A new
zoning district that reflects the recommended base and density options. lot sizes and typical
uses is needed to implement this plan category.
In the future, a new trunk sewer line will connect to the Coon Rapids Interceptor, a regional trunk
sewer line located near the intersection of Crooked and Bunker Lake Boulevards. The city has
reached agreement with the Metropolitan Council that areas designated for residential development
in the Rural Reserve will be developed at three units per net acre once MUSA becomes
available (subtracting parks, wetlands, floodplain, water bodies, arterial roads, and other areas
restricted from development)

Met Council
City staff and the Met Council have been collaborating throughout the process to ensure
compliancy with the Council policies. Met Council staff reviewed the proposed CPA and support
the proposed language. It is common to submit the CPA to Met Council prior to the completion
of the ordinance changes. However, once Met Council approves the CPA, it will not go into
effect until the City Council adopts the ordinance that coincides with the CPA. Met Council
does not need to review or approve the ordinance; however City Staff must provide them with a
copy once it is approved by City Council.
According to the Metropolitan Council, there are 28 communities in the metropolitan area that
are designated for future wastewater service, including Andover; 22 of which have some type of
ordinances in place that allows higher density development while preserving open space for
future expansion of municipal services. The variations in these ordinances differ among
communities to reflect their original intent for adopting the ordinance. Some communities wish
to preserve expanses of undeveloped land, while others have landscapes that are restricted by
limiting features, and still others have planned to accommodate future growth. The Andover
CPA proposal is similar to what the other communities have adopted.
Proposed Schedule
Once the CPA is submitted to the Met Council, staff will begin to work on the zoning ordinance
that coincides with the CPA. The following is the tentative schedule for the CPA and the zoning
changes:
March 21, 2017 City Council review of the CPA
March 22, 2017 If CPA is approved by City Council, it will be submitted to the Met
Council for the formal review and approval process
March 28, 2017 City Council will review the proposed zoning changes at the work session
April 11, 2017 Public hearing at PZ for the proposed zoning changes
April 2017 Met Council will formally act on the CPA
May 2, 2017 City Council will act on the proposed zoning changes
Planning and Zoning Commission Recommendation
The Commission held a public hearing on March 14, 2017. A draft of the meeting minutes are
attached for your review. There were public comments. Andover resident Mr. Chadwick, Jr.
was not in attendance but submitted an email with his comments that became part of the public
record. His email is attached for your review. The Commission recommended approval of the
CPA request with a 5 - 0 vote (2 absent).
ACTION REQUIRED
Staff recommends City Council consider the proposed CPA. If approved by the City Council,
this amendment will be forwarded to the Metropolitan Council for their approval.

WHEREAS, a public hearing was held pursuant to state statutes, and;

morals and general welfare of the occupants of the surrounding land.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Andover has
received the recommendation of the Planning and Zoning Commission and adopts the following

Land use districts are established to ensure compatible development and to protect
natural resources and amenities. The district definitions provided below are intended to
state their purpose, provide location criteria and describe the relationship of each district
with other land uses.

Rural Residential (RR) district provides an area for low intensity residential
development in areas outside of the Municipal Urban Service Area (MUSA) that will not
be served by municipal sewer and water. The minimum lot size is 2.5 acres to provide
sufficient space for on site sewer and water facilities and to prevent dense development
that would create -an -adverse impact on municipal and regional infrastructure. However, —
smaller acreage lots exist in areas subdivided prior to 1978 and in the two previously
approved rural planned unit developments: Nightingale Preserve and Timber River

SEWER STAGING PLAN
Undeveloped land within the Municipal Urban Service Area is divided into five
yeargrowth stages based primarily on the proximity of municipal sewer and
water. Thegrowth stages are intended to provide a reasonable estimate of urban
growth to theyear 2030. Property owners may choose not to develop even if their
property is shownwithin the current growth stage. Property owners seeking to
develop sooner thanshown on the Staging Plan may petition the city to change
the growth stage designation. These changes are at the discretion of the City
Council. The Staging Plan Map is represented on Figure 2.5. Figure 2.6
summarizes the map by providing theamount of acreage within each land use
district in each of the five year stages. TheMetropolitan Council also requests
information that summarizes the density of future development in each residential
land use district. This information is provided in Figure2.7.

8 City Planner Hanson reviewed the proposed Comprehensive Plan Amendment with the
9 Commission. The CPA request is being made by Jake and Jon Packer to allow the

23 Ms. Hanson stated that approximately 130 notices regarding the public hearing were sent
24 out to residents. There were 10 inquiries.

26 Commissioner Koehler asked what the future was of this land. Ms. Hanson stated that
27 somewhere down the road this area is planned for urban development when services
28 become available.

30 Commissioner Peterson asked about getting access to the remaining 20 acres if there
31 were 4 - 5 acre parcels [along 161St]. Ms. Hanson stated that will happen at the time of
32 the plat work. As part of that, they will have to plan for how the lots would be accessed,
33 which is part of the zoning code.

35 Chairperson Daninger clarified that "rural reserve" really means urban development,
36 specifically higher density development once municipal utilities become available. This
37 action does not change that.

42 Mike Olson, 3052 153`d Avenue, asked a series of questions, starting with what are the
43 road frontage requirements. Ms. Hanson responded 300 ft. Mr. Olson inquired about
44 the dirt road on the south. Ms. Hanson stated all lots within the city require road
45 frontage. He continued by asking if there are services available now on the south side.

1 Ms. Hanson stated that rural reserve lots are served by individual septic and well. Mr.
2 Olson asked if there was a Master Plan for the area. Ms. Hanson stated that there was a
3 sketch plan at one time. He followed up by asking if there would then be a need to
4 amend the Comp Plan and why do that now. He asked if property owners had
5 approached the City and would these changes hinder potential future development. He
6 expressed that he did not want to set up a potential situation that would be a hindrance
7 down the road to a bigger plan for the site. He recommended doing a master plan first.
8 As a neighbor, he would like to see a coordinated approach to looking at the whole
9 spectrum of possibilities. He also wondered about getting access to the road from the
10 rural reserve area and if there would need to be an easement.

12 Lee Packer, 3074 161 st Ave, spoke on behalf of the Packer family and stated that their
13 parcels had been in their family since the 1930s. On the 40 acres in question, his
14 grandparents had a house there. He has been involved with the land since 1992. Their
15 family did not have a choice at the time and their land was put in the rural reserve area.
16 Splitting up the land inherited by the family equals 8 acres a piece and they are trying to
17 find a way to continue to enjoy the family property. The plan has always been to use
18 their land this way so that they can preserve their lifestyle. If the area is fully developed,
19 their family is not interested in staying there. In the current term, they would like to
20 enjoy the land and his sons would like to build homes on the land. He noted that the
21 amendment gives his family the ability to continue using the land that has been in the
22 family for 70 years.

24 Mr. Olson came back to the podium and acknowledged his support for a long-term
25 resident wanting to do something with their property. He stated he was trying to make
26 sense of the proposed change without pressing the issue.

28 Chairperson Daninger stated that there will be time for forward thinking about the Master
29 Plan.

34 Mr. Peterson asked what was known about the soils on the site of the 40 acres. Ms.
35 Hanson confirmed that the Packer site is buildable, but there is a lot of area in the rural
36 reserve area that has a lot of peat.

38 Commissioner Sims asked if a property owner could sell all of their land to a developer.
39 Ms. Hanson replied that they could but a developer would be held to the same
40 requirements of the rural reserve area, they would also need to meet the density
41 requirements.

44 -considerations-are- going to be applied throughout the entire rural reserve area.

1 Commissioner Koehler asked if the MUSA line follows the outside edge related to the
2 rural reserve. Ms. Hanson confirmed that it follows the outline, including on the edge of
3 Round Lake.
5 Mr. Hudson asked Ms. Hanson if she had checked with other Cities with similar
6 situations. Ms. Hanson confirmed that she had similar circumstances when she worked
7 in Forest Lake. He followed up by asking if there was a demand for mid-size lots. Ms.
8 Hanson stated that was the case.
10 Commissioner Sims asked if there had been feedback from the written notices. Ms.
11 Hanson confirmed that the City had to notify residents all around rural reserve area. She
12 indicated she received calls about the public hearing notice; they wanted clarification and
13 information on the proposal. There was one resident opposed. The email was submitted
14 and will become part of the public record.

16 Commissioner Koehler asked what happens after approval. Ms. Hanson stated there will
17 be a need to set up zoning regulations to allow for the 5 acre lot splits. She indicated that
18 the process is hoped to be completed by the beginning of May. There would be another
19 public hearing process.

21 Commissioner Sims inquired as to how many unique land owners were in the rural
22 reserve area. Ms. Hanson believes there were less than one dozen and they will be
23 involved in the discussions of the rural reserve area during the 2018 Comp Plan update.

26 Resolution No. amending the comprehensive land use plan of the City of Andover
27 to include the following: within the rural reserve residential land use, to allow one unit
28 per ten acres with the opportunity to allow one unit per five acres with the compliance of

32 City Planner Hanson stated that this item would be before the Council at the Tuesday,
33 March 21, 2017 City Council meeting.

35 OTHER BUSINESS

37 So far in 2017, the City has issued 22 single family housing permits. Dunkin Donuts will
38 be opening by the end of the week, following one more fire inspection. At the Shoppes
39 at Andover, Joy Kitchen will open mid-April. The movie theatre has requested a building
40 permit to redo the seating to have luxury recliners; as a result there will be one-half the
41 amount of seats. Walgreens is being remodeled to add a minute -type clinic. The Estates
42 at Arbor Oaks is undergoing inspections. Of note is the catering kitchen was changed to
43 a commercial kitchen with the ability to serve meals to all the residents of the complex.
44 Online permitting so far has yielded 145 online permits in the amount of $7;800. --Online
45 permitting saves residents money.

The Workshop Meeting of the Andover City Council was called to order by Mayor Julie Trude,
February 28, 2017, 6:00 p.m., at the Andover City Hall, 1685 Crosstown Boulevard NW,
Andover, Minnesota.

Mr. Dickinson introduced to the Council the new Associate Planner, Dan Krumwiede.
Ms. Hanson explained the Packer Family has requested a Conditional Use Permit (CUP) to split
their land. The Plaiming and Zoning Commission really liked this plan and would like it to move
forward.She noted she has been working very closing with the Met Council on this item and
they have --already reviewed it and are on board with the plan. She stated the Met Council like the
way it is proposed because it isN,ery simple,
Ms. Hanson stated What is be proposed is to add to the current Comprehensive Plan an
amendment allowing for density of one unit per ten acres in Rural Reserve Residential areas.
The Met Council already a116ws°for this in their policies, allowing people to further subdivide
their land as long as there is':,a zoning ordinance with provisions in it providing for future urban
development. She stated they would need to approve the Comprehensive Plan amendment and
then create a zoning district which will be Rural Reserve Residential (RRR) and have the
regulations in there with mechanisms providing for future urban development. She stated she is
proposing a five acre lot minimum to keep very minimal impact in that area. Some of the things
they will need to look at in the zoning code is requiring applicants to put the building pad in an
area that it can be further subdivided in the future, this will require some type of ghost plating so
they have a general idea on how the lot can be laid out and would keep in compliance of
ordinance provisions.

3 Councilmember Bukkila stated her only concern would be with people coming forward in the
4 fixture and the Council would not have enough guidance to make an informative decision. Mayor
5 Trude wondered if the Council would want more rules regarding this.

7 Ms. Hanson drew an example on the white board and stated their provision would allow
8 someone to subdivide to five acres per lot, but would still need to keep the density to four units
9 for forty acres of land. This will still be considered Rural Reserve and will not lose that
10 designation. Mr. Dickinson stated the applicant will still need to ghost plat the parcel to show
11 what it could look like in the future if developed.

13 Mayor Trude stated the Council liked that the residents can build on their inheritance but
14 wondered if they would want to open this up for selling off the land and chipping the rural
15 reserve down. Mr. Dickinson stated the home would still need to be on road frontage and would
16 still have to maintain the four houses per forty -acre rule.

18 Mayor Trude wondered if a street came through like Veterans Memorial would they be able to
19 split off more land. Mr. Dickinson stated that would be up to the Council to decide and he did
20 not think this will be a big deal. He thought it would be unfeasible for that type of situation to
21 happen.

23 Mayor Trude wondered if this could be done on the fringes of the Rural Reserve because she did
24 not want this to include the entire Rural Reserve area. Ms. Hanson stated this would need to be
25 done throughout the entire Rural Reserve area and must be part of the Zoning Code. Mr.
26 Dickinson stated the Comprehensive Plan has to be put in place first and then they will have to
27 go and add language to the Zoning Code.

29 Councilmember Bukkila asked if there will be language in this stating that there needed to be
30 frontage road in order to split and develop. Ms. Hanson stated they could. Mr. Berkowitz
31 thought that was already in the City Code.

33 Councilmember Holthus asked if on a forty -acre parcel would there be 350 feet of frontage. Mr.
34 Berkowitz indicated there would be.

36 Councilmember Holthus asked what the MUSA potential is to expand into the Rural Reserve.
37 Mr. Berkowitz stated they are looking at the new Atlas 14 restrictions and are working with the
38 Coon Creek Watershed District on the potential of what impacts the Atlas 14 will have on the

4 jammed up. He wondered if there were any thoughts on one per eight or having five acres
5 across. Ms. Hanson stated the one unit per ten acres is Met Council policy.

7 Mayor Trude wondered if the City can push the Met Council on this. Ms. Hanson stated they
8 would likely not be successful pushing the Met Council on their policy as it is consistently
9 applied.

11 Ms. Hanson stated the next step will be a public hearing in March and then off to Met Council if
12 the Council approves moving this forward. The City Council unanimously agreed to have staff
13 move this item forward.

19 Mr. Dickinson explained during the City of Andover 2017 Budget and 2017-2021 CIP
20 development discussions, there was a desire to pursue a community survey to determine resident
21 support for current city services, programs and potential capital projects. At the January
22 workshop, the City Council instructed Administration to proceed forward with a 2017
23 community survey.

25 Mr. Dickinson reviewed changes he has made to the survey questions for 2017. He noted
26 Councilmember Holthus asked to remove "issues facing" from the beginning paragraph in the
27 survey.

29 Councilmember Holthus indicated she would like to change question 4 from "issue" to
30 something else, like "challenge". The Council thought "challenge" was a better word than
31 "issue".

33 Mayor Trude thought they could replace item13, "One level housing for seniors maintained by
34 an association" with the new item below 7 "Association Maintained Housing". Councilmember
35 Bukkila wondered if the question is too long and as she looks at the question she wonders what
36 the purpose of the question is. Mr. Dickinson stated the question asks if the City has too much,
37 too little or enough of a particular type of housing. Councilmember Bukkila thought the question
38 ends up being too vague and thought this should be two different questions.

40 Councilmember Bukkila stated she did not understand what "move up" housing meant. Mr.
41 Dickinson stated this would be mid-range housing.

43 The Council thought the survey wording for item 9 should be changed from "move up" housing
44 to "mid-range housing". Mr. Dickinson stated they have "Starter homes for young families",

Good morning.
Amending the Comp Plan to allow 1 unit per 10 acres is what is allowed by the Met Council in the rural reserve areas.
The amendment will also allow for further subdivision down to 1 unit per 5 acres IF the subdivision complies with the
zoning code. They will need to show ghost platting, preserve the majority of the land as open space and the overall
density is no more than 1 unit per ten acres. The density itself is not changing.
For example, for a 40 acre parcel:
Met Council policy allows for 1 unit per 10 acres in the rural reserve area. On a 40 acre parcel , this allows for 4-10 acre
lots. With the new provisions, the density stays the same. On a 40 acre parcel, this allows 4 - 5 acre lots and the
remaining 30 acres is preserved as open space and cannot be further subdivided until sewer/water is available for urban
density.
The rural reserve area will not be broken down to 5 acre parcels. Each parcel needs 300 feet of improved street
frontage, the density of the existing parcels must remain at 1 unit per 10 acres, and there is a vast majority of the
property that has deep peat which makes subdivision at such a low density cost prohibitive. This type of subdivision will
most likely happen along existing roadways such as 161st and potentially Round Lake Blvd.
As the City begins the process of the 2018 Comprehensive Plan Update, the rural reserve area will be the hot topic.
There are many issues that will need to be addressed by City Council as they plan for the future of the rural reserve area.

Could you please clarify what the intent is in altering the RRR in Andover which looks like according to my
interpretation that once a sewer is put in , will be developed into one third acre lots. is this correct and if so
where is the impetus for this? the city? the state? the county? or the landowners (Fields et. al.) that might serve
to profit immensely by the sale of this land. It is my understanding that the vast majority of the property sits on
thick peat which would have to be excavated and filled prior to home construction. This property does
currently serve as a buffer from urban blight and functions as a habitat for large numbers of deer, turkey,
waterfowl, etc.

INTRODUCTION
This item is in regard to recommending to the Anoka County Board of Commissioners an individual or
individuals to serve as a manager on the Coon Creek Watershed District (CCWD).
There are two managers (Nick Phelps and Scott Bromley) whose term expires on May 27, 2017 for the Coon
Creek Watershed District Board. Mr. Phelps lives in hydrologic subunit 4 and Mr. Bromley lives hydrologic
subunit 2 of the Coon Creek Watershed District. Staff has not received any correspondence from Mr. Phelps's
and Mr. Bromley's indicating their interest in continuing to serve on the Board of Managers.
At this point, no individuals in Andover have shown interest to serve on the Board. Individuals were given
deadline of last Wednesday, March 15, 2017 at 4:30 pm to submit indicating their interest.
An article was placed in the current Andover Newsletter for March -April. Anoka County had previously placed
a public notice in the Anoka County Record and Forest Lake Times.
Note: In order for names submitted to the county to be considered a list under the statutory definition, the list
must contain the names of at least three nominees eligible to be appointed (see attached county letter).
ACTION REQUIRED
No action is necessary since no individual or individuals have indicated interest in serving on the Coon Creek
Watershed District board.

In accordance with the provisions of Minn. Stat. § 103B.227, Anoka County in
January 2017 published a notice that terms will expire for two managers on the
Coon Creek Watershed District Board of Managers. The notice publication
requirement applies because Coon Creek Watershed District is considered a
watershed management organization. The published notice states that persons
interested in being appointed may submit their names to the appointing authority,
which is the county board, for a watershed district appointment. For your
information, a copy of the notice is enclosed:
In appointing a'manager to the Coon Creek Watershed District, Minn. Stat.
§ 103D.311 is applicable. 'This statute requires a countyboard, upon the
expiration of a term, to appoint a manager for a watershed district from a list of
persons nominated jointly or severally by the'cities and municipalities within the
district if a list(s) is submitted 60 days before the manager's term of office expires
or to appoint a manager who resides in a city that fails to submit a list. The
vacancies expire on May 27, 2017. In order for the county to accept nominations,
they must be received by Tuesday, March 28, 2017. If there is a desire to submit
a listjointlyfor a manager appointment, you may wish to conferwith affected cities
and jointly submit the list. The cities with territory located in the Coon Creek
Watershed District are Andover, Blaine, Columbus, Coon Rapids, Fridley, Ham
Lake, and Spring Lake Park.
In order for names submitted to the county to be considered a list under the
statutory definition, the list must contain the names of at least three nominees
eligible to be appointed. To be eligible for an appointment, a nominee must reside
within the watershed district boundaries, be eligible to vote in the district, and not
