Motion carried 4 25 ayes, 1 absent (Goodrich). 26 27 APPROVE OFFICIAL DEPOSITORIES & BANKS 28 29 Mr. Dickinson explained that the City Council is required by state law to annually approve a 30 resolution designating the City's official depositories, supplemental depositories of investments and 31 designating an individual(s) as the approval authority for collateral transactions. He noted the 32 resolution is the same as in years past with small exception. 33 34 This year's resolution identifies that both the City Administrator and Finance Manager have the 35 approval authority for the release and acceptance of all collateral to be held by the City in 36 conjunction with City funds on deposit with authorized institutions. 37 38 It was noted the spelling of the word "Manager" was spelled "Manger" in the resolution. 39 40 Motion by Holthus, Seconded by Bukkila, to approve Resolution No. R006-17 designating 41 depositories of City Funds and supplemental depositories of City Funds for investment purposes 42 only. Motion carried 4 ayes, 1 absent (Goodrich). 43 Regular Andover City Council Meeting Minutes — danuary 3, 2017 Page 3 DESIGNATE OFFICIAL NEWSPAPER 2 3 Mr. Dickinson explained that two proposals had been received, one from the Anoka County Record 4 and one from the Anoka County Union. Both proposals were reviewed by staff. The proposal from 5 the Anoka County Record is forfree/no charge, and although cheaper, the circulation is limited along 6 with its community recognition. The staff recommends use of the Anoka County Union for 2017. 7 Costs were about $8,000 this last year, but that was higher than the previous year. 9 Motion by Holthus, Seconded by Knight, to approve the Anoka County Union as the City's 10 official newspaper for 2017. Motion carried 4 ayes, 1 absent (Goodrich). 11 12 APPOINT VICE MAYOR 13 14 Mayor Trude recommended Councilmember Holthus be appointed as the Vice Mayor for the 15 Andover City Council for 2017. This would be in keeping with rotating Councilmembers to 16 different roles. 17 18 Motion by Trude, Seconded by Bukkila, to appoint Councilmember Holthus as Vice Mayor for 19 2017. Motion carried 4 ayes, 1 absent (Goodrich). 20 21 APPOINT STANDING COMMITTEES 22 23 Mayor Trude expressed her desire to change appointments to give a broader range of exposure to 24 Councilmembers as a whole. 25 26 The following were approved and reviewed: 27 28 Special Committees: 29 Public Works Committee: Councilmember Bukkila (Chair) & Councilmember Holthus 30 Newsletter Committee: Councilmember Knight (Chair) & Councilmember Goodrich 31 32 Standing Committee: 33 Finance & Personnel Committee: Entire Council 34 35 City Appointed Representatives in 2017: 36 Fire Relief Association: Councilmember Bukkila 37 Andover Community Center Advisory Commission: Councilmember Holthus, Mayor Trude 38 alternate 39 Anoka -Hennepin Community Education Advisory Board: Councilmember Knight 40 QCTV Commission: Councilmember Goodrich & City Administrator Jim Dickinson 41 Youth First: Stephanie Wallin and City Administrator Jim Dickinson 42 43 It was noted the name of the Finance & Personnel Committee was misspelled. "Personal" should Regular Andover City Council Meeting Minutes — danuary 3, 2017 Page 4 1 be changed to "Personnel." 3 Motion by Holthus, Seconded by Knight, to approve the committee appointments as recommended 4 by Mayor Trude. Motion carried 4 ayes, 1 absent (Goodrich). Mayor Trude noted Councilmembers have outside duties as well as formal committee appointments and she appreciates their service in all areas. 9 CONSIDER INTERIM USE PERMITISTOCKPILE/PRESERVE AT OAK VIEW/AANSON 10 BUILDERSINC. 11 12 City Planner Stephanie Hanson explained Hanson Builders Inc. is seeking an IUP to store up to 13 4,000 cubic yards of soil. 14 15 The soil is excess dirt from the Preserve at Oak View development and will be used for future 16 custom grading of the lots as approved as part of the PUD plan. The stockpile of dirt is existing and 17 there are no changes that would be made to the existing pile, except for minor subtractions and 18 additions of dirt. The build out of the development is expected within 2-3 years; therefore, the 19 applicant requested the IUP to expire November 30, 2019. 20 21 The stockpile will need to be graded to acceptable slopes and reviewed by the City of Andover 22 Engineering Department. The stockpile of dirt has been reviewed by the Coon Creek Watershed 23 District and will not require a watershed permit. She showed a current photograph and commented 24 that a 3:1 slope is required. 25 26 Ms. Hanson reviewed the information with the Council. 27 28 Mayor Trude noted the well-established trees at the entrance to the development. 29 30 There was much discussion about the slope requirements of the City as well as OSHA and NPDES 31 guidelines. Because the proposed revised resolution was received just right before the meeting, the 32 Council discussed postponement of a vote to let staff and the developer work through the details. 33 34 Discussion ensued including review of a photograph and the very steep conditions on one section of 35 the stockpile in its current state. 36 37 Councilmember Holthus asked if vegetation will take hold because the stockpile is sand. The 38 response from Darren Lazan, Landform was that was why silt is used. 39 40 Councilmember Knight asked if there is a danger to children due to the current slope. The response 41 was yes, and the stockpile is in a residential area, but they would be trespassing. 42 43 Mr. Berkowitz recommended a 3:1 ratio for the slope, to be consistent with other developments but 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 Regular Andover City Council Meeting Minutes —January 3, 2017 Page 5 this would mean the stockpile would be distributed more throughout the lot. Councilmember Bukkila felt the Council was debating something that had not yet been agreed upon between City staff and the developer, Mr. Lazan stated they had not had enough time to react to the document yet, he stated he has never had stockpile requirements like that before, and it would limit their ability to manage the soil. Mayor Trude asked about other comparable projects in the City and had concerns about having a problem with the resolution coming up right before the meeting. She also had concerns about the big drop off that currently exists and the safety issues surrounding that. Mr. Lazan stated he would order work to be done to correct the big slope the next day. Motion by Holthus, Seconded by Bukkila, to table the NP request to the next meeting of the City Council with the understanding that the steep slope would be addressed the following day. Motion carried 4 ayes, 1 absent (Goodrich). There was some additional discussion about short-term safety and next steps to prepare for presentation at a future Council meeting. SELECT POSSIBLE JOINT MEETING DATES WITH LOWER RUM RIVER WHO AND MEMBER CITIES Mr. Berkowitz requested the Council look at two dates that can be submitted to the other cities for consideration. The Council discussed the draft agenda and the available dates of March 8 and 22, 2017. No formal motion was made. SELECT 2017 LOCAL BOARD OFAPPEAL & EQ UALIZA TION DA TES Mr. Dickinson requested the Council to look at two dates that can be submitted to Anoka County for the Local Board of Appeal and Equalization. The Council indicated April 17th and April 24th as available dates. No formal motion was made. ADMINISTRATOR'S REPORT City Staff updated the Council on the administration and city department activities, legislative Regular Andover City Council Meeting Minutes —January 3, 2017 Page 6 updates, updates on development/CIP projects, and meeting reminders/community events. 3 (Meetings) Mr. Dickinson stated the Metropolitan Council SAC Task Force met on December 20`x' 4 and will meet again the following week. The Met Council Weekly Digest will give updates in print. 5 He has been asked to serve as chair of the North Metro Mayors Operating Committee for one more 6 year. 8 (Recycling) Mr. Dickinson indicated staff is working through the transition after the retirement and 9 departure of staff. The Associate Planner position was appointed this evening and interviews will be 10 occurring for the City's recycling position in the near future. 11 12 (Homes) Mr. Dickinson stated there were 111 new single-family homes permitted during the 13 year along with the 66 unit senior building, making a total of 177 units for 2016. 14 15 (Community Development) Mr. Janish commented he had been working at the City for 6 weeks and 16 it has been great working with the staff and there is much to learn with. He has been processing 17 single-family rental items, preparing promotional items for the North Suburban Home Show, 18 working on a Comprehensive Plan amendment, addressing code violations and making related site 19 visits. He has also been interviewed by the local newspaper. 20 21 Mayor Trude welcomed Mr. Janish to the City staff. 22 23 Mr. Dickinson thanked Mr. Janish for being willing to take on other responsibilities including City 24 code enforcement with Mr. Brett Angell's departure. 25 26 Mayor Trude commented she expected he would enjoy working with the Open Space Commission. 27 28 (Community Development) Mr. Berkowitz stated maintaining ice on the City's outdoor rinks has 29 been challenging in the last few weeks with the snow, ice, and rain. He noted City crews are 30 working hard to address the slippery road spots and that when it gets cold, the salt does not work. He 31 urged residents to use caution. Mr. Berkowitz was excited to see a lot of ice rink activity over the 32 holiday break. 33 34 Councilmember Knight expressed concern for slips and falls by residents. 35 36 Mayor Trude thanked the staff for getting out at night to take care of the roads for residents. 37 38 MAYOR/COUNCIL INPUT 39 40 (Heart Safe Communities) Mayor Trude encouraged residents to watch the newsletter for AED 41 training. She encouraged those being interviewed to take a few minutes to look at the meeting minutes and learn about the role of the commissioners. (Commercial Construction) Mayor Trude indicated Dunkin' Donuts was starting construction, but there is still not much activity at Joy's Kitchen. DISCUSSION CenterPoint Energy has reviewed the attached assessment roll and agrees with the assessment amount and is waiving the right to an assessment hearing. The next step in the process is to notify CenterPoint Energy on assessment payment options and certify the assessment with Anoka County if CenterPoint Energy elects not to pay the amount in full at this time. BUDGETIMPACT The entire project cost has been assessed to CenterPoint Energy for water main improvements to 14327 7th Avenue NW. ACTION REQUIRED The City Council is requested to approve the resolution waiving the public hearing and adopting the assessment roll for Project 15-44, 14327 7th Ave. NW/CenterPoint Energy Site Water Main Extension. This has been a very effective reconstruction method since the City began the process back in 1996. These projects include three separate roadways sections, therefore, three separate assessment rates have been determined based upon the roadway improvements in front of each adjacent property (existing ditches to remain, existing bituminous curb replaced with concrete curb, existing concrete curb being replaced). The proposed assessment rates associated to the attached map are as follow: Red Area $7,800.00 (Replace Concrete Curb & Gutter) Green Area $7,740.00 (Replace Bituminous Curb w./Concrete Curb & Gutter) Blue Area $4,140.00 (Rural Section with No Curb) A neighborhood informational meeting was held on November 15, 2016 with the residents to discuss the project and answer preliminary questions and receive comments. Attached is an email that was received regarding the project. Staff has also received phone calls from a number of residents. BUDGETIMPACT The project would be funded from a combination of special assessments and City funds. Twenty-five percent of the total project costs based upon a standard roadway section would be assessed to the benefiting properties fronting along the improvements as identified in the City's Roadway Reconstruction Assessment Policy. In regards to the proposed assesment for road repairs on 168th lane N.W. This street is classified as a state aid road and has been since at least the 70's or 80's. It wasn't classified as state aid so these monies could be added to the general road fund..It was most likely classified because someone realized that at some point it would become a heavily traveled road and the residents of that street should not be responible for repairs on a street that is used more like a county road. This was the case in about 1991 when it was proposed to redo this road. I recall Ken Ortel, who was on the council or maybe mayor; saying something to the effect "why are you complaining its a state aid road a won't cost you anything". As I recall we did end up paying for storm sewer.. When this work was done in 91-92 the city was the one in charge of inspections and quality control. The west end, the newer end; is in worst shape than the east end which is older and installed with lesser standards than the west end. Our end, the west; started going to hell not many years after completion. Even the curbs are junk and should have out lasted the road surface by 2 to 11 figure. This had to be a lack of quality control and inspection. Why I don't know, maybe someone had a reason to look the other way. I would guess a normal city neighborhood street is about 90% resident traffic and maybe 10% out of neighborhood. Our street is more the reverse, 10% local residents and 90% out of area. PLUS at least 12- 15school buses coming and going twice a day for about 11 months a year AND the parents driving their kids to and from school -Then there is the garbage truck issue, likely a dozen HUGE trucks every week -Back in the day it was 4-5 cars, no school buses and one sgl. axel garbage truck. I'm no math expert but anyone should be able to understand you dont use the same formula for all the streets in Andover. Praire road, 157th, 173rd, and 168th are not typical city streets. If you are charging typical city streets 25% then I would think a formula based on traffic would put the heavy out of neighborhood traffic streets at maybe 5%, for sure not more than 10% of the cost.. Ham Lake manned up and paid all for 157th while Andover patted itself on the back for dropping to 20%.. Do the right thing and give this road the same state aid it had in 1991. I live on 168th Lane and have a few question please. 1. Since I live on 168th, a state aid route, we I be paying below the expected 25% cost? Assessments are based upon a standard City street section for state aid routes, so essentially it would be based on the design if the pavement depth and width was the same as a standard City street. The assessments would be based upon paying 25% of those standard costs. 168h Lane may be wider and paved deeper than a standard street because it is a higher volume roadway. We would only consider a 33' wide roadway with 3" of bituminous in the assessment calculations. The final dimensions/depths of the roadway will be determined in the design process. 2. I have a pond in my yard because of street water run off. My feeling is with a wider street the run off will increase and flood my yard. Can we look at this please? Yes, this will be considered and analyzed. We will look at what, if any, improvements may be needed to mitigate any possible increases in runoff. 3. Do you have a senior citizen discount? There is no a discount, but there is a senior citizen deferral process, which is dependent upon income. 4. My wife and I will be retired in a few months with limited income. Is there a chance the city of Andover might have a job opening for me where I could help pay for the street assessment? The City Council adopted a policy that has been in place and used since 2006 where 25% of the entire project costs related to a street reconstruction project are assessed to the benefitting properties (those fronting along the improvements). This would include concrete curb and gutter in areas defined in the policy, driveway apron replacement for that portion impacted by construction (whether it's concrete, bituminous, pavers, etc); storm sewer improvement costs, minor ditch grading/cleaning, subgrade correction, restoration, paving costs, and any other items necessary to complete the project. There is no distinction within a neighborhood for different assessment rates based upon the fact of it you do or do not have concrete curb and gutter in front of your property. Concrete curb and gutter is considered as a part of the storm drainage system, similar to how a ditch would be considered as a part of the storm drainage system in front of certain properties. The OLD policy did differentiate between properties with and without concrete curb and gutter, and it was decided by the City Council when this policy was put in place that it was more equitable to assess 25% of the entire cost of the improvements to the entire neighborhood as all properties benefit from the street improvements and any necessary associated drainage improvements. The reason that we have two separate projects this coming year (one for the majority of the neighborhood and a separate one for 168th Lane) is 168th Lane is a municipal state aid route, and even though we will bid and construct the projects together, we need to keep track of the project costs separately for that segment as we can submit for funding reimbursement through MnDOT utilizing the City's Municipal State Aid Funds. It does not have anything to do with the fact that there is or is not concrete curb and gutter on that section of roadway. Hopefully this answers your questions that you had. What arrangements are planned to adjust assessments for the areas that will be getting curb and gutter vs. the areas not receiving curb and gutter? As you know Lund's Evergreen Estates is a mix of areas with and without ditches. The cost per foot of reconstruction for with and without curb and gutter are significantly different. It isn't equitable to charge properties for curb and gutter that they don't receive. The last time this came up in 2006, Mr. Berkowitz and I had a long series of discussions on how this could be handled. The solution that I believe Mr. Berkowitz agreed to at that time was, for accounting purposes, run two separate projects simultaneously. This is similar to what you are already doing with 168th Lane and Lund's Evergreen Estates. That way each area could be assessed at a rate appropriate for what is received. University Avenue from 157h Avenue to Constance Boulevard has been identified in the Capital Improvement Plan for an overlay in the spring/ summer of 2017. This is a joint project that would be completed with the City of Ham Lake. The enclosed map depicts the proposed project area. When a roadway is initially designed, it is assumed that an overlay is completed when it is approximately 20 years old. This stretch of roadway was paved in 1993, or approximately 23 years ago. An overlay helps prolong the life of the roadway and defer the need for a more expensive total reconstruction. This overlay is expected to extend the life of the streets in this area another 15+ years before a full reconstruction would be considered. The City also has a street reconstruction program where the entire roadway and deteriorated curb and gutter is replaced when roadways get to a point where an overlay would no longer be beneficial. The project would consist of milling approximately 2" of the existing bituminous roadway and paving a new 2" overlay. Seventy-five (75%) of the total project costs for the overlay would be funded through the City's Road and Bridge fund and the remaining twenty-five (25%) of the total project costs would be assessed to the benefiting properties in accordance with the City's Assessment Manual. "Benefiting properties" is defined as those properties fronting along / addressed along the roadways being overlayed. There are seven properties within Andover that meet this criteria for this project. This project would be jointly funded between Ham Lake and Andover. The total estimated project cost is $104,800, of which 50%, or approximately $52,400 is attributed to the City of Andover. 25% of that amount ($13,100) would be assessed to the seven parcels within Andover fronting along these improvements. This equates to an estimated assessment amount of $1,880 per property fronting along the improvements. The actual assessment amount will be based upon bids from contractors and actual project costs which will not be determined until the project is completed. The assessment process is required to follow Minnesota Statute 429. The City will prepare a feasibility report that will be presented to the City Council outlining the aforementioned estimated project costs. The City Council will then schedule a public hearing for the project, at which point formal comments can be given to the City Council at a regularly scheduled meeting (tentatively scheduled for January 17, 2017). At that point, the City Council will formally decide if the project will move forward. Should the project proceed as proposed, final plans will be prepared and bids will be solicited from contractors. Construction would begin late spring / early summer and be completed over the summer months. We expect that there will be minor construction related inconvenience with this project, though you will have access to your neighborhood / property at all times. Once the project is completed and all costs are determined, the City Council will formally declare the costs for the project (including actual assessment amounts based upon actual project costs, not estimated) and schedule the final assessment hearing. At this hearing there is an opportunity for residents to provide comments regarding the completed project. Once the assessment hearing is held, the City Council will formally adopt the final assessment amounts. You will be notified by mail when the initial public hearing and the final assessment hearing are scheduled. Once the final assessment amount has been determined, a letter will be sent to you detailing the final amount and your payment options. In general, you will have the option to pay the assessment in full interest free within 30 days of the final assessment hearing in the fall of 2017, or you will have the option to pay the assessment with your property taxes over a five year period with market rate interest included (the past several years this has been around 5%). On January 4, 2017, the Applicant submitted a letter. It is attached for your review. City staff has also attached the OSHA Requriements for Sloping and Benching that is mentioned in the Applicants letter. The attached OSHA regulations are specifically for maximum allowable slopes for trenches to ensure safety during open excavations. The proposed IUP is specifically for the stockpiling of soils. City staff visited the site on January 3 and January 6. Attached are the photos for your review. City staff is recommending a slope no less than 3:1 for the proposed project. The requirement of a 3:1 slope is similar to requirements from previously approved IUP's for stockpiles that exist within newly created residential developments. We had what we thought was a simple request until late yesterday when we received additional conditions from staff, conditions that make the solution we contemplated for several months unworkable. Hanson Builders look forward to working to resolve staff concerns and moving forward at the next meeting. As we discussed, there are two predominant reasons for managing the side slopes of a stockpile; Safety Depending on material being stockpiled, and the slopes maintained, stockpiles can become a safety issue for workers or individuals that may climb on the piles without permission. We recognize the concerns expressed by staff on the current conditions, and will work to resolve the very steep slopes that were documented on January 3, 2017. There are standards for safe slopes in the industry, and the condition proposed by staff considerably exceed those standards, and make the solution we are proposing unmanageable. The Occupational Safety and Health Administration (OSHA) sets standards for safe conditions with respect to open excavations. Based on the soil types we have on-site, and for excavations less than 20 feet, the standard MAXIMUM slope is 1.5:1, or 1.5 horizontal feet for every 1 vertical foot. There are measures for maintaining slopes steeper than this, and this is predominantly used in excavation slopes which are arguably more critical than a stockpile condition, so we believe it is a safe standard. We have attached the OSHA section of law we cited in the January 3rd meeting. Erosion Control Typically, soil slopes are maintained, or managed, to control erosion. These standards are well documented in the Minnesota Pollution Control Agency (MPCA) National Pollutant Discharge Elimination System (NPDES) permit requirements for this, and all construction sites. The NPDES guidelines do not specifically address slope requirements for stockpiles, but the guidelines do address the requirements for stabilizing construction sites. Section IV of the Construction Activities outlines measures necessary to erosion control. Part IV is included for your reference. Our application may be unique to prior Interim Use Permit (IUP) applicants in that we are not asking to store materials relatively untouched and for a longer term, as done between phases of a project as previous projects have requested. The solution we outlined, and are seeking a permit to allow, essentially allows Hanson to effectively and actively manage sand fill, as well as importlexport in a single, safe location as has been done since we broke ground this summer. This solution removes hundreds of large trucks from the road delivering individual stockpiles to homes during several phases of their construction. It allows a place to store excess dirt without leaving the site, again in trucks, and most importantly it keeps the sloped conditions managed in one location versus distributed throughout the 13 home sites in the project. This is an extremely cost effective process for the builder, and ultimately the homeowners. We are simply asking this IUP consider this more as an active working stockpile than an interim storage of materials, just as we have for the last 6 We respectfully request the city consider the proposed use and allow the condition related to slopes to read as follows: Slopes shall be maintained within OSHA VIIIA sloping requirements, and maintained in accordance with NPDES IV.B.2 requirements. CONSTRUCTION ACTIVITY REQUIREMENTS IV.A. STORMWATER POLLUTION PREVENTION PLAN The Permittee(s) must implement the SWPPP and the requirements of this part. The BMPs identified in the SWPPP and in this permit must be selected, installed, and maintained in an appropriate and functional manner that is in accordance with relevant manufacturer specifications and accepted engineering practices. IV.B. EROSION PREVENTION PRACTICES 1. The Permittee(s) must plan for and implement appropriate BMPs such as construction phasing, vegetative buffer strips, horizontal slope grading, inspection and maintenance of Part IV.E. and other construction practices that minimize erosion as necessary to comply with this permit and protect waters of the state. The location of areas not to be disturbed must be delineated (e.g., with flags, stakes, signs, silt fence etc.) on the project site before work begins. The Permittee(s) must minimize the need for disturbance of portions of the project that have steep slopes. For those sloped areas which must be disturbed, the Permittee(s) must use techniques such as phasing and stabilization practices designed for steep slopes (e.g., slope draining and terracing). 2. The Permittee(s) must stabilize all exposed soil areas (including stockpiles). Stabilization must be initiated immediately to limit soil erosion whenever any construction activity has permanently or temporarily ceased on any portion of the site and will not resume for a period exceeding 14 calendar days. Stabilization must be completed no later than 14 calendar days after the construction activity in that portion of the site has temporarily or permanently ceased. For Public Waters that the Minnesota Department of Natural Resources has promulgated "work in water restrictions" during specified fish spawning time frames, all exposed soil areas that are within 200 feet of the water's edge, and drain to these waters must complete the stabilization activities within 24 hours during the restriction period. Temporary stockpiles without significant silt, clay or organic components (e.g., clean aggregate stockpiles, demolition concrete stockpiles, sand stockpiles) and the constructed base components of roads, parking lots and similar surfaces are exempt from this requirement but must be in compliance with Part IV.C.S. 3. If using stormwater conveyance channels ,the Permittee(s) must design the channels to route water around unstabilized areas on the site and to reduce erosion, unless infeasible. The Permittee(s) must use erosion controls and velocity dissipation devices such as check dams, sediment traps, riprap, or grouted riprap at outlets within and along the length of any constructed stormwater conveyance channel, and at any outlet, to provide a non-erosive flow velocity, to minimize erosion of channels and their embankments, outlets, adjacent stream banks, slopes, and downstream waters during discharge conditions. 4. The Permittee(s) must stabilize the normal wetted perimeter of anytemporary or permanent drainage ditch or Swale that drains water from any portion of the construction site, or diverts water around the site, within 200 lineal feet from the property edge, or from the point of discharge into any surface water. Stabilization of the last 200 lineal feet must be completed within 24 hours after connecting to a surface water or property edge. The Permittee(s) shall complete stabilization of the remaining portions of any temporary or permanent ditches or swales within 14 calendar days after connecting to a surface water or property edge and construction in that portion of the ditch has temporarily or permanently ceased. Temporary or permanent ditches or swales that are being used as a sediment containment system during construction (with properly designed rock -ditch checks, bio rolls, silt dikes, etc.) do not need to be stabilized during the temporary period of its use as a sediment containment system. These areas must be stabilized within 24 hours after no longer being used as a sediment containment system. Applying mulch, hydromulch, tackifier, polyacrylamide or similar erosion prevention practices is not acceptable stabilization in any part of a temporary or permanent drainage ditch or swale. 5. Pipe outlets must be provided with temporary or permanent energy dissipation within 24 hours after connection to a surface water. 6. Unless infeasible due to lack of pervious or vegetated areas, the Permittee(s) must direct discharges from BMPs to vegetated areas of the site (including any natural buffers) in order to increase sediment removal and maximize stormwater infiltration. The Permittee(s) must use velocity dissipation devices if necessary to prevent erosion when directing stormwater to vegetated areas. IV.C. SEDIMENT CONTROL PRACTICES 1. The Permittee(s) must employ Sediment control practices as necessary to minimize sediment from entering surface waters, including curb and gutter systems and storm sewer inlets. a. Temporary or permanent drainage ditches and sediment basins that are designed as part of a sediment containment system (e.g., ditches with rock -check dams) require sediment control practices only as appropriate for site conditions. b. If the down gradient sediment controls are overloaded (based on frequent failure or excessive maintenance requirement), the Permittee(s) must install additional upgradient sediment control practices or redundant BMPs to eliminate the overloading, and the SWPPP must be amended to identify these additional practices as required in Part 111.13 1.-3. 2. Sediment control practices must be established on all down gradient perimeters and be located upgradient of any buffer zones. The perimeter sediment control practice must be in place before any upgradient land -disturbing activities begin. These practices shall remain in place until Final Stabilization has been established in accordance with Part IV.G. A floating silt curtain placed in the water is not a sediment control BMP to satisfy perimeter control requirements in this part except when working on a shoreline and below the waterline. In those cases, a floating silt curtain can be used as a perimeter control practice if the floating silt curtain is installed as close to shore as possible. Immediately after the short term construction activity (e.g. installation of rip rap along the shoreline) in that area is complete, an upland perimeter control practice must be installed if exposed soils still drain to the surface water. 3. The Permittee(s) shall re -install all sediment control practices that have been adjusted or removed to accommodate short-term activities such as clearing or grubbing, or passage of vehicles, immediately after the short-term activity has been completed. The Permittee(s) shall complete any short-term activity that requires removal of sediment control practices as quickly as possible. The Permittee(s) must re -install sediment control practices before the next precipitation event even if the short-term activity is not complete. 4. All storm drain inlets must be protected by appropriate BMPs during construction until all sources with potential for discharging to the inlet have been stabilized. Inlet protection may be removed for a particular inlet if a specific safety concern (street flooding/freezing) has been identified by the Permittee(s) or the jurisdictional authority (e.g., city/county/township/MnDOT engineer).The Permittee(s) must document the need for removal in the SWPPP. 5. The requirements of this appendix apply when the design of sloping and benching protective systems is to be performed in accordance with the requirements setforth in § 1926.652(b)(2). (b) Definitions. Actual slope means the slope to which an excavation face is excavated. Distress means that the soil is in a condition where a cave-in is imminent or is likely to occur. Distress is evidenced by such phenomena as the development of fissures in the face of or adjacent to an open excavation; the subsidence of the edge of an excavation; the slumping of material from the face or the bulging or heaving of material from the bottom of an excavation; the spalling of material from the face of an excavation; and ravelling, i.e., small amounts of material such as pebbles or little clumps of material suddenly separating from the face of an excavation and trickling or rolling down into the excavation. Maximum allowable slope means the steepest incline of an excavation face that is acceptable for the most favorable site conditions as protection against cave-ins, and is expressed as the ratio of horizontal distance to vertical rise (H:V). Short term exposure means a period of time less than or equal to 24 hours that an excavation is open. (c) Requirements- (1) Soil classiFcation. Soil and rock deposits shall be classified in accordance with appendix A to subpart P of part 1926. (2) Maximum allowableslope. The maximum allowable slope for a soil or rock deposit shall be determined from Table B-1 of this appendix. (3) Actualslope. (i) The actual slope shall not be steeper than the maximum allowable slope. (ii) The actual slope shall be less steep than the maximum allowable slope, when there are signs of distress. If that situation occurs, the slope shall be cut back to an actual slope which is at least 1/2 horizontal to one vertical (1/2H:1V) less steep than the maximum allowable slope. (iii) When surcharge loads from stored material or equipment, operating equipment, or traffic are present, a competent person shall determine the degree to which the actual slope must be reduced below the maximum allowable slope, and shall assure that such reduction is achieved. Currently the Sheriff's Office staff is covering for the cities of Fridley, Anoka, and Columbia Heights due to no CPST in their fire or police departments. We also support surrounding agencies during staffing shortages, maternity leaves, or an unmanageable amount of appointments.
