The Meeting of the Andover Economic Development Authority was called to order by President
Julie Trude, October 18, 2016, 6:00 p.m., at the Andover City 'Hall, 1685 Crosstown Boulevard
NW, Andover, Minnesota.
Present: Commissioners Sheri Bukkila (arrived at 6:05 p.m.), James
Goodrich, Mike Knight, Valerie Holthus and Joyce Twistol
Absent: Commissioner Timothy Cleven
Also present: Executive Director, Jim Dickinson
Public Works Director/City Engineer, Dave Berkowitz
APPROVAL OF MINUTES
August 16, 2016, Regular Meeting: Correct as written.
Motion by Holthus, Seconded by Twistol, to approve the minutes as written. Motion carried
unanimously.
REVIEW DEVELOPMENT ACTIVITY
Mr. Dickinson reviewed the following:
Remax Results, 2677 Bunker Lake Boulevard- The exterior is 75% complete. There are mixed
reviews on the exterior of the building from the public. Photos were reviewed.
Andover Veterinary Clinic, 1730 1390 Lane — Interior finishes are near completion.
Architecturally the building looks great and fits into the area. Landscaping has not been started.
The Shoppes at Andover, 13650 Hanson Boulevard- There is one tenant finish so far, that is
AT&T Wireless. President Trude stated she had stopped in the AT&T Wireless store and
indicated they will be open for business October 24, 2016.
Estates at Arbor Oaks/Trident Development, 1753 156th Lane- Footings are complete.
Construction with concrete panels is progressing for the garage level.
The Farmstead — The parking lot is complete. Some landscaping needs to be finished.

1 Kottke's Property — Staff has been in contact with the new owner Stock Properties and their
2 representative Mid-America Real Estate. There may be some interest in the parcel next to
3 Kottkes.

5 Eight Unit Townhome Building, 1826 through 1840139`' Avenue- Permits for the last eight of
6 the townhomes in the Parkside at Andover Station Development have been issued. The building
7 will match the existing buildings as permitted under the terms of the original PUD.

9 REDEVELOPMENT UPDATES

11 Mr. Dickinson reviewed the area on Bunker Lake Boulevard between Crosstown Boulevard and
12 Crosstown Drive. Staff has updated all the numbers relevant to what the purchase prices would
13 be, costs of relocation benefits and starting looking at vacant properties.

15 DISCUSS/RECOMMEND PROPOSED 2017 EDA BUDGET

17 Mr. Dickinson reviewed the staff report. The fund balance is declining. Money is still available
18 for the monument entrance signs and ongoing maintenance around Andover Station. The new
19 owners of Festival Foods reviewed the original documents to find out who is responsible for
20 what. The EDA is responsible for the maintenance of the pond and the area around the pond.
21 Long term costs could be $4,00045,000 a year.

23 President Trude stated she thought the City was doing the mowing by the pond. Mr. Berkowitz
24 stated it's more efficient to have one company do the mowing and bill the EDA.

26 Mr. Dickinson continued the budget review.

28 Commissioner Holthus asked for an explanation on why the commissioner salaries are double.
29 Mr. Dickinson answered it is budgeted for two meetings a month.

31 Commissioner Holthus asked why the TIF dollars are declining every year. Mr. Dickinson
32 indicated Tax Increment Districts 1-1, 1-2, 1-3 and 1-4 have been decertified.

34 Motion by Twistol, Seconded by Knight recommending the proposed EDA 2017 budget to the
35 City Council.

37 Commissioner Holthus requested a change on the budget under Expenditures from "personal"
38 services to "personnel" services.

Introduction of Community Development Director
December 6, 2016
INTRODUCTION
Due to the resignation of David Carlberg on September 2, 2016, the Community Development
Department has the position of Community Development Director was available. The Human Resources
Department has completed the interview, background check and selection process to fill this position and
on November 1, 2016 Joseph Janish was appointed by the City Council as the new Community
Development Director.
Mr. Janish will be attending his first Andover EDA meeting and will be introduced to the Board.
DISCUSSION
Relative to the selection process after the review of applications, the initial interview team consisted of
the City Administrator and the Human Resources Manager. Seven applicants were interviewed. Three
selected finalists then met with the City Administrator, Building Official and Public Works Director/City
Engineer. City Administration ultimately recommended the hiring Joseph Janish as the applicant that best
matches the City's current and future mission and goals.
Mr. Janish's most recent employment was the Department of Development Director with Benton County,
Minnesota. He has also previously worked for the City of Jordan as their City Planner. Mr. Janish has a
Masters in Public Administration and a Masters in Business Administration from Hamline University,
and a BA in Local and Urban Affairs from St. Cloud State University. Also, Mr. Janish is very familiar
with Andover as he is originally from Ham Lake.

INTRODUCTION
The League of Minnesota Cities Insurance Trust (LMCIT) requests that participating EDA's
annually decide whether or not to waive the statutory tort liability limits established by
Minnesota Statutes 466.04.
DISCUSSION
Attached is the "LMCIT Liability Coverage — Waiver Form" provided by the LMCIT, which
provides a description of the options available to the City of Andover EDA. Currently the City
of Andover EDA DOES NOT WAIVE the monetary limits on municipal tort liability
established by Minnesota Statutes 466.04. I am recommending continuing with the past
practice.
BUDGETIMPACT
No budget impact if the EDA does not waive limits.
ACTION REQUESTED
The City of Andover EDA is requested to not waive the monetary limits on tort liability
established by Minnesota Statutes 466.04.

LMCIT members purchasing coverage must complete and return this form to LMCIT before the effective date of
the coverage. Please return the completed form to your underwriter or email to pstech@lmc.org
This decision must be made by the member's governing body every year. You may also wish to discuss these issues with
your attorney.
League of Minnesota Cities Insurance Trust (LMCIT) members that obtain liability coverage from LMCIT must decide
whether to waive the statutory tort liability limits to the extent of the coverage purchased. The decision has the following
effects:
If the member does not waive the statutory tort limits, an individual claimant would be able to recover no more than
$500,000 on any claim to which the statutory tort limits apply. The total all claimants would be able to recover for a
single occurrence to which the statutory tort limits apply would be limited to $1,500,000. These statutory tort limits
apply regardless of whether the city purchases the optional excess liability coverage.
If the member waives the statutory tort limits and does not purchase excess liability coverage, a single claimant could
potentially recover up to $2,000,000 for a single occurrence. (Under this option, the tort cap liability limits are waived to
the extent of the member's liability coverage limits, and the LMCIT per occurrence limit is $2 million.) The total all
claimants would be able to recover for a single occurrence to which the statutory tort limits apply would also be limited
to $2,000,000, regardless of the number of claimants.
0 If the member waives the statutory tort limits and purchases excess liability coverage, a single claimant could
potentially recover an amount up to the limit of the coverage purchased. The total all claimants would be able to
recover for a single occurrence to which the statutory tort limits apply would also be limited to the amount of coverage
purchased, regardless of the number of claimants.
Claims to which the statutory municipal tort limits do not apply are not affected by this decision.

INTRODUCTION
Staff will provide a progress report on ongoing commercial projects at the meeting.
ANDOVER COMMERCIAL PROJECTS.
• ReMax Results Office Building, 2677 Bunker Lake Boulevard NW — the building is complete
and is now occupied. The vacant parcel just north of the building has been graded and secured
for the winter months. They are planning a grand opening event for ReMax of Andover on
Thursday December 15`s from 5:00 to 7:00pm.
• Andover Veterinary Clinic, 1730 139th Lane NW— Interior final touches are near completion.
Exterior work is complete. A certificate of occupancy is anticipated soon with an early 2017
opening.
• The Shoppes at Andover, 13650 Hanson Boulevard NW — The AT&T Wireless story is open for
business. The building permit for Dunkin Donuts was issued on October 5th, the permit has yet to
be picked up, that project has been delayed as no contractor has been selected yet. Joy Kitchen —
Asian Cuisine has submitted for and been approved for a building permit, the contractor is
expected to start soon. Overall, all of the exterior work is complete.
• Estates at Arbor Oaks / Trident Development, 1753 156h Lane NW — Footings, cast -in-place
foundation walls, and concrete panels for the garage level are complete. The building is being
framed, plumbing and mechanical work is progressing.
• Eight Unit Townhome Building, 1826 through 1840 139`x` Ave. NW — Construction for the last
eight unit townhome building in the Parkside at Andover Station Development is underway. The
building will match the existing nearby buildings as permitted under the terms of the original
PUD.
• Andover Cinema, 1836 Bunker Lake Blvd NW - Staff met with the Andover Cinema owners to
discuss future seating improvements to the theatre and discuss the potential of the theatre
applying for a CUP that would allow for a beer and wine liquor license.
