PLANNING AND ZONING COMMISSION WORKSHOP MEETING OCTOBER 13, 2015 The Workshop Meeting of the Andover Planning and Zoning Commission was called to order by Chairperson Daninger on October 13, 2015, 6:00 p.m., at the Andover City Hall, 1685 Crosstown Boulevard NW, Andover, Minnesota. Commissioners present: Chairperson Daninger, Commissioners Lynae Gudmundson, Bert Koehler, and Kyle Nemeth. Commissioners absent: Commissioner Tim Cleven, Steve Peterson and Jeff Sims. Also present: Community Development Director Dave Carlberg City Planner Stephanie Hanson Others DISCUSS A CCESSOR Y D WELLING UNITS Ms. Hanson stated at the September 15, 2015 City Council work session, Council discussed an article in the Star Tribune "Granny Flats" may find a new home in Inver Grove Heights. The City Council indicated they would like further review and discussion on these types of accessory dwellings from the Planning Commission and brought back to the City Council for further review. Mr. Carlberg reviewed with the Commission the discussion that happened at the September 15, 2015 City Council workshop meeting. Ms. Hanson stated in many of the cities they reviewed the ordinances were very similar. She stated Farmington allows them through CUP's but have never approved a CUP for one. Commissioner Koehler asked if Farmington has denied a CUP for one. Ms. Hanson indicated they have. Commissioner Koehler asked how many cars are allowed in driveways today in Andover. Ms. Hanson stated they do not have any requirement other than they need to park on hard surface. Commissioner Koehler stated he saw a handout that goes out to new residents that states "two cars per driveway ". Commissioner Nemeth stated he has seen that too. Chairperson Daninger thought that was a covenant for the neighborhood association. Andover Planning and Zoning Commission Workshop Meeting Minutes — October 13, 2015 Page 2 Commissioner Koehler indicated this is on the City's website but he could not find it anywhere in the City Code. Mr. Carlberg indicated he would check into this. Mr. Carlberg stated the Commission should discuss where they would want see these types of structures allowed in the City. Council discussed possibly allowing them in the rural areas where there is more room. Commissioner Nemeth asked if the structures would possibly overtax the city water and sewer systems. Commissioner Koehler stated he had the same concern and that other utilities such as gas and electric could be affected as well. He thought there needs to be a check on all of these things by all of the proper authorities. Mr. Carlberg stated if these would be allowed only in the rural areas they would not burden the city systems because they would be on private septic systems and wells. Chairperson Daninger asked how they would deal with these in an R -4 District. He thought there would be setback issues and other issues associated with it. Mr. Carlberg stated they could have a dwelling above the garage or in the basement of a home. Commissioner Gudmundson stated they would want to do CUP's on these because if they did not set any boundaries on what they could potentially build then their rural area is going to end up looking like Isanti County. She thought they would want to look at what they are proposing and building and thought they would like a permit placed on this. Mr. Carlberg stated they could put conditions on them. Commissioner Nemeth stated he would like to then have a sunset clause placed on these in case the property gets sold. Mr. Carlberg did not think that would work because of the cost associated with the building on the structures. Commissioner Koehler stated they would need to tie up the language enough that the new homeowner would be painted into certain conditions where they could use that dwelling so it would not have to be removed. He stated another concern he had was for other utilities such as electrical and natural gas. Chairperson Daninger did not think that would be enough of an issue because that is coming into developments where sewer is going as well. Commissioner Nemeth stated they just had Centerpoint Energy come in asking for more capacity for tanks. Commissioner Gudmundson thought a CUP would be needed in order to address all of the possible concerns and issues. Commissioner Koehler stated a CUP needs to have some guidance. Mr. Carlberg reviewed some of the other cities requirements where the structures are allowed with the Commission. Commissioner Koehler thought there needed to be some regulation around what residential zoning they will allow these on. Andover Planning and Zoning Commission Workshop Meeting Minutes — October 13, 2015 Page 3 The Commission discussed where in the City the structures should be allowed and requirements needed. The Commission thought the best procedure for allowing these types of structures in the City would be with a CUP. Staff indicated they would bring this information forward to the City Council for further discussion. DISCUSS PUD REQUIREMENTS, CONTINUED Ms. Hanson stated at the September 9, 2015 work session, the Planning and Zoning Commission discussed the intent of PUD's. During the discussion, it was suggested that staff provide a list for the Commission to reference when reviewing PUD's. Commissioner Koehler stated the idea of a list was not to come up with an exclusive all encompassing list but just something to get them thinking in the right direction. He thought they should have a checklist of things the City wants to avoid when looking at a PUD. Commissioner Nemeth stated he would like to add three items to the list. First one being "No item that requires City or Association maintenance ", such as roundabouts with center island plantings. The second one is related to parks and do they want to ask for a certain size of a park in a PUD. Mr. Carlberg stated the Park Commission has a City wide plan where parks are to be located. They would not take a park with a PUD but open space could be preserved by allowing clustering within the development. There was discussion about Homeowner Associations and PUD's. Mr. Carlberg stated in order to allow a homeowner association in a PUD the PUD needs to be larger with enough units to support the HOA. He cited examples of failures such as Country Oaks West. Commissioner Nemeth stated he really liked having a developer's narrative about compliance with the City Code, 13 -3 -11 and thought for the Commission this should be front and foremost. Addressing how are they complying and meeting City requirements. He thought that needs to come from the developer in marketing their development to the Commission. Chairperson Daninger stated the lists are nice and he likes the points discussed but no two PUD's are alike. He thought as they see more PUD's they will get better and people get more experienced. He thought the list will help but as they see more of these come forward they will get more experienced and better. Commissioner Nemeth agreed with Commissioner Koehler that if they have a list, they will remember to ask questions. Andover Planning and Zoning Commission Workshop Meeting Minutes — October 13, 2015 Page 4 Commissioner Nemeth stated he noticed Anoka is now requiring traffic studies with their new developments as part of their approval process and he thought that might be helpful for new developments with not enough arterial roads to possibly meet the demands. He thought this would give them something else to think about. Mr. Carlberg stated traffic studies are expensive and they have been done but typically only with very large residential developments in the City that require Environmental Assessment Worksheets and commercial developments such as Wal -Mart in the City. OTHER BUSINESS Community Development Director Carlberg updated the Planning Commission on related items. PLANNING AND ZONING COMMISSION MEETING — OCTOBER 13, 2015 The Regular Bi- Monthly Meeting of the Andover Planning and Zoning Commission was called to order by Chairperson Daninger on October 13, 2015, 7:00 p.m., at the Andover City Hall, 1685 Crosstown Boulevard NW, Andover, Minnesota. Commissioners present: Commissioners Lynae Gudmundson, Bert Koehler IV, Steve Peterson, and Kyle Nemeth. Commissioners absent: Commissioner Tim Cleven and Jeff Sims. Also present: Community Development Director Dave Carlberg City Planner Stephanie Hanson Others APPROVAL OF MINUTES September 8, 2015 Workshop Minutes, September 8, 2015 Regular Minutes and September 22, 2015 Regular Minutes. Commissioner Nemeth stated on the September 8, 2015 Workshop minutes on page one, 3`d sentence "...Coon Raids used to have..." Page two, fifth paragraph starting with Commissioner Cleven, 4 sentence "City's idea of permanent like a PUD on the property ". Seventh paragraph, 2nd sentence "Commissioner Koehler stated that is why he is suggesting converting it to..." Paragraph eight, "Commissioner Nemeth thought they were setting a president by approving those without setting a sunset clause on them." Commissioner Nemeth stated on the September 22, 2015 regular minutes, page one, fourth paragraph, fourth sentence "...if the lots to the north and south were rezoned..." Motion by Nemeth, seconded by Peterson, to approve the minutes as amended. Commissioner Gudmundson indicated she was voting present on the September 8, 2015 Regular meeting minutes. Regular Andover Planning and Zoning Commission Meeting Minutes — October 13, 2015 Page 2 PUBLIC HEARING: Consider Adoption of Andover City Code Title 14, Chapter 1 Floodplain Regulations, including the effective Flood Insurance Rate Maps (FIRM) for the City of Andover and Flood Insurance Study (FIS) report. City Planner Hanson noted the purpose of this item is to hold a public hearing and take input on the Adoption of Andover City Code Title 14, Chapter 1 Floodplain Regulations, including the effective Flood Insurance Rate Maps (FIRM) for the City of Andover and Flood Insurance Study (FIS) Report. City Planner Hanson reviewed the staff report with the Commission. Commissioner Gudmundson asked in the seventeen pages is there any new language. Ms. Hanson stated there is new language that needs to be adopted. Commissioner Nemeth stated in 2011 FEMA provided Anoka County communities with preliminary copies and he wondered if there was additional studying that needed to take place between then and now. Ms. Hanson stated it has taken that many years to get the maps correct for each of the communities in Anoka County. Commissioner Peterson asked if the flood plains have been expanded and have the areas been expanded or reduced. Ms. Hanson stated some of the boundaries have changed. There is more detail in the maps now. Motion by Gudmundson, seconded by Nemeth, to open the public hearing at 7:10 p.m. Motion carried on a 5 -ayes, 0 -nays, 0- present, 2- absent (Cleven, Sims) vote. No one wished to address the Commission. Motion by Gudmundson, seconded by Nemeth, to close the public hearing at 7:11 p.m. Motion carried on a 5 -ayes, 0 -nays, 0- present, 2- absent (Cleven, Sims) vote. Motion by Nemeth, seconded by Peterson, to recommend the City Council adopt the updated floodplain ordinance along with the Official Zoning Map, Flood Insurance Rate Map panels all dated December 16, 2015 and all prepared by the Federal Emergency Management Agency. Commissioner Koehler asked if anyone has made a Federal Floodplain Insurance claim. Chairperson Daninger and city staff indicated they were not aware of any. Motion carried on a 5 -ayes, 0 -nays, 0- present, 2- absent (Cleven, Sims) vote. City Planner Hanson stated that this item would be before the Council at the November 2, 2015 City Council meeting. Mr. Carlberg noted they will be having an October 27`h Planning Commission meeting to review a land use change /comp plan amendment. Commissioner Nemeth asked Mr. Carlberg if there were any other new businesses planning on coming to Andover that he is aware of. Mr. Carlberg stated there is nothing he could release at this time but does expect more projects to come up next year. Hanson, City Planner SUBJECT: Public Hearing: Comprehensive Plan Amendment (CPA) (15 -03) — Change Land Use Designation from Urban Residential High (URH) Density to Neighborhood Commercial (NC) –13725 Crosstown Dr NW and 2604 138`h Avenue NW – City of Andover DATE: October 27, 2015 INTRODUCTION The City of Andover is requesting a Comprehensive Plan Amendment to change the land use designation on a 1.57 acre parcel from URH to NC. The properties are located at the former site of Stop and Shop, on the NE comer of Bunker Lake Blvd NW and Crosstown Dr NW. DISCUSSION Consider to Change 1.57 acres of land from URH – Urban Residential High Density to NC – Neighborhood Commercial: The existing properties are owned by the City of Andover (triangle portion) and the Andover Economic Development Authority (old Stop N' Shop location). The attached map shows the location of the properties. The triangle portion has been owned by the City of Andover for numerous years. The old Stop N' Shop property was purchased by the EDA in December 2012, with the intent to continue a commercial use on the property by means of redevelopment. Prior to 2001, the property land use was NC. At some point during the 1998 Comprehensive Plan update, the land use was changed to URH; however, the zoning remained as NB – Neighborhood Business. Amending the land use would allow the continued use of the property as commercial and would ensure consistency between the Comprehensive Plan and Zoning Code. Andover Retail Market Analysis In 2012, a retail market analysis for the City of Andover was completed by the McComb Group, Ltd. The analysis was completed to determine the future demand for commercial land needed in Andover. Andover's commercial /retail areas were analyzed; one of which was Bunker Lake Blvd between Hanson Blvd and Round Lake Blvd, known as Andover's retail hub. According to the research, the Bunker Lake corridor supports an additional 33,000 gross leasable area of professional offices by year 2020. At the time of the Retail Market Analysis, there were five (5) professional offices in the Bunker Lake Blvd area. The amended land use change will support the need for additional land to provide retail and professional services to the community. Review Criteria The Comprehensive Plan establishes criteria for review of amendment concerning a proposed land use change. The Planning and Zoning Commission should consider the amendment based on the following criteria: 1. Conditions have changed since the present land use designation was established such to warrant the proposed amendment or the present land use designation is in error. With the support of the Andover Retail Market Analysis, it is advantageous for the City of Andover to continue to provide the existing and future residents of the community with retail and professional services within the community. The change of the land use will ensure the property will continue as a commercial use and the property will be in compliant with current zoning regulations. The existing zoning designation is NB — Neighborhood Business in which permitted uses include offices, commercial daycare centers, and salons. These are uses that the majority of the business and traffic is generated during day hours with little to no activity in the evenings and weekends. Also, prior to 2001, the land use for this particular parcel was commercial, as are the surrounding lands to the west. During the 1998 Comprehensive Plan Update, the land use changed to Urban Residential High Density. Staff researched the reasoning for the land use change but did not find discussions in the previous meeting minutes for the change. Although the land use changed, the property continued to operate as a commercial use with the Stop N Shop gas station and the zoning remained as Neighborhood Business. The proposed land use is compatible with surrounding land uses and with the goals, objectives and policies in the Comprehensive Plan. The land uses on the properties to the west are NC — Neighborhood Commercial and LC — Limited Commercial. The continued commercial use of the property is typical of an intersection located in a main retail /commercial hub. The proposed CPA is compatible with the goals, objectives and policies of the Comprehensive Plan. The Comprehensive Plan lists goals and objectives for the community. One of the goals is to encourage appropriate economic growth and redevelopment. This can be achieved by creating commercial land uses along Bunker Lake Blvd, selecting strategic locations for neighborhood and community commercial sites and establishing design standards for such uses that promote quality site design and compatible land use arrangements. The objectives can be met by maintaining the existing commercial nodes along Bunker Lake Blvd, promoting redevelopment of existing commercial properties, and providing commercial development opportunities. There is capacity of public systems, facilities, and service to serve the proposed land use and capacity of these systems to serve other planned land uses is not adversely affected. Traffic generation from the proposed land uses will generally occur during weekday business hours. The existing road system can withstand the proposed traffic demands from neighborhood service oriented business. The number of trips will be less than the past Stop N' Shop gas station. The City of Andover public utilities has capacity for these types of uses. Next Step in CPA Process If the proposed changes are approved by the City Council, city staff will make the necessary map changes in the Comprehensive Plan. The CPA will then be submitted to the Metropolitan Council for review and approval. Since the CPA land use change is less than 80 acres, the Metropolitan Council will conduct an administrative review. Staff hopes the CPA will be finalized no later than November 30, 2015. Staff Recommendation Staff recommends the Planning and Zoning Commission hold a public hearing, consider the proposed CPA and to make a recommendation of approval to the City Council. If approved by the City Council, this amendment will be forwarded to the Metropolitan Council for their approval. The proposed CPA is as follows: 1.
