Public Works Director/Parks Coordinator SUBJECT: Discuss Sale of Park Laud - Engineering DATE: September 15, 2015 INTRODUCTION The City Council is requested to discuss selling of public property currently designated as park as requested by the Park and Recreation Commission. DISCUSSION This item is a continuation from the May 26, 2015 City Council Workshop regarding the sale of park land. The two parks previously discussed are as follows: Cedar Crest Park located at 3909-174' Lane NW (Park 32A on City Park Map). This parcel is a platted lot as part of Cedar Crest Estates and is 0.88 acres in size. Note: The County Assessor's Office found a Conveyance of Forfeited Lands dated 9/4/1981 to the City of Andover exclusively for park purposes. To remove the park designation tag on Cedar Crest Park (PIN 05-32-24-33-0018), the City of Andover would need to reconvey the property to the County so it goes back into tax forfeit status. It would then go back on the forfeit inventory list and would be available to purchase on a future land sale for a non- specified use. This would require payment of the market value and based on current county tax data, the market value is set at $60,000. • Landlocked Park located at 15543 Prairie Road NW (Park 72D on City Park Map). Currently there is no access to the parcel and approximately three quarters of the parcel is wetland. The parcel is 2.15 acres in size. Note: The City acquired this by Quit Claim Deed from the County dated 10/28/1980 and since this is a non-specified use parcel, the City could sell or auction the parcel off. Based on current county tax data, the market value is set at $20,000. CONSIDER PARCELS TO SELL Mr. Haas reviewed the two parcels that should be considered as potential parcels to sell are: • Cedar Crest Park located at 3909 —174`" Lane NW (Park 32A on City Park Map) $60,000 is market value according to Anoka County records. The City may wish to let this parcel go back to Anoka County to sell. • Landlocked Park located at 15543 Prairie Road NW (Park 72D on City Park Map) $20,000 is market value according to Anoka County records. The adjacent neighbors will be notified to see if any have interest in purchasing. It will be necessary for the Park Commission to make recommendation to the City Council. The recommendation regarding the two parcels is scheduled to be discussed at the City Council joint meeting that is scheduled on May 26, 2015. The consensus of the Commission was to recommend to the City Council to sell the two parcels. Motion by Commissioner Butler seconded by Commissioner Miskowiec, to recommend to the City Council the two parcels Cedar Crest Park reconvey back to County and Landlocked Park be sold with proceeds coming back to the Park Capital Improvement Budget. 6 -ayes, 0 -nays, I -absent (Lewnau) vote. UPDATE ON JOINT MEETING WITH CITY COUNCIL ON MAY 26, 2015 Mr. Haas reviewed t e� eeting has been uled with the City Council which will start at 6:00 pm. Discuss the Selling of Park Property The Park Commission and City Council reviewed parks that are not being used in the City and what they can do to improve them. It was noted some of the land has restrictions and would not provide funds to the City. JO Mayor Trude thought this was beautiful- open space land but we may not be able to put anything in it. Chairperson Stenzel thought this park was forfeited property that would go back to the County for sale to then get back on the tax role. Landlock Park Mayor Trude thought the only way they could sell would be for a neighboring lot to purchase it. Councilmember Holthus wondered if the neighboring lots could purchase it and than do a ]ot split to expand their lots. Commissioner Lindahl stated this is listed as a park but not park dedicated and he did not think a buildable lot could be made out of this because it is low land. Chairperson Stenzel stated at their last meeting they voted to sell this piece and get it off the park roll. He thought maybe an adjoining parcel might want to expand their lot by Q purchasing this. He noted this park is completely landlocked. Mr. Dickinson thought this might be costly selling this parcel because there are a lot of expenses associated with selling it. Mr. Dickinson stated they could look at costs to see what it would be to sell them. Ms. Gmba has contacted a couple of the associations but has determined that the fee that the associations would like to charge for advertising is too high. Currently the City allows businesses to advertise through the City at the ice arena and field house (see attachment). Also attached is the current Park Advertising Policy for Sunshine Park, Eveland Fields and Andover Station North Ball Field Facility and a copy of the agreement with the Lease. Note: As per the agreement the City receives 10% of the proceeds from each advertisement sign per year. ACTION REQUIRED The City Council is requested to discuss amending the Park Advertising Policy to allow businesses to advertise directly with the City in the parks and/or facilities. Advertising signs shall only be allowed on the outfield fences of baseball and softball fields at Sunshine Park, Eveland/Andover High School Fields, and Andover Station North. 2. Ball Field and Scoreboard Advertising Signs: Ball field advertising and scoreboard advertising signs shall be permitted in all districts subject to the provisions of this chapter and with the following conditions: a) Ball field advertising signs shall not be visible from adjacent residential properties when viewed at ground level. b) Scoreboard advertising signs shall be placed in such a way so m to minimize to the greatest possible extent the exposure to adjacent residential properties. c) Ball field scoreboard advertising signs shall not be illuminated when not in use for ball games. 3. Only the City or a party or parties who have a valid lease agreement with the City shall place signs in the approved parks. 4. Signs shall be no larger in size of 5' high by 10' wide. 5. The signs shall be designed so as not to inhibit the ability of players to see the ball in play. 6. Signs shall not be placed prior to April I' and shall be removed by November I' each year. 7. Signs relating to politics, tobacco, alcohol, gambling, and adult oriented uses are prohibited, as are signs containing offensive or obscene language. 8. The content of all signs shall be subject to approval by the City of Andover before installation. 9. Signs shall be installed and removed by the City of Andover. Carlberg, Community Development Director SUBJECT: Discuss Accessory Dwelling Units DATE: September 15, 2015 REQUEST The City Council is requested to discuss and provide direction to staff on the City Council's desire to amend the City Code to allow accessory dwelling units. There have been recent inquiries as well as articles in metro newspapers regarding accessory dwelling units often referred to as'gmnny flats. Attached is a recent article that appeared in the StarTribune in August. Many cities are changing their codes to allow accessory dwelling units. Andover does not currently allow accessory dwelling units but does allow guest houses. The City allows guest houses in accordance with Section 12-13-14. The provisions are as follows: 12-13-14: GUESTHOUSES: A. Guesthouses, for purpose of this title, shall be an accessory building detached from the principal building where accommodations for sleeping are provided but no kitchen facilities are provided. The intended use is for persons visiting the occupants of the principal building and shall not be used as a rental property. (Amd. 4/18/06, Ord. 325A) B. Guesthouses shall be permitted in all residential districts, shall be located the required depth of the rear yard or more from the principal building, and shall conform to the side yard requirements for the principal building. Carlberg 'Granny flats' may find a home in Inver Grove Heights The City Council has given a preliminary OK to accessory dwelling units in single-family areas. ay road nemn sp .lro nes rT... e:Order Reprint ` Inver Grove Heights is considering joining other Twin Cities suburbs in allowing "granny flats" in single-family neighborhoods under certain conditions. "Granny flats," formally called accessory dwelling units, are second residences that homeowners can create as an addition to their houses or in a garage or other structure on their property. They typically enable seniors to live near family members but also can provide affordable housing to young singles and families. In Dakota County, cities that allow them include Eagan, Apple Valley, Lakeville and Fampington, according to Inver Grove Heights planning officials. Inver Grove Heights' zoning code now allows only one dwelling unit — defined as living, bath and sleeping spaces and a kitchen — per lot in single-family areas. Residents can add living, bath and sleeping spaces to single-family homes but not a second kitchen, because that would constitute a second dwelling unit. An amendment to the city's zoning code that would let single-family homeowners add a second, accessory dwelling unit received unanimous City Council approval on Monday. A third and final vote could take place at the council's next meeting, on Aug. 24, if city staff completes research on council questions regarding possible rental of accessory dwelling units and occupancy by nonfamily members. Citywide approach The council is taking a citywide approach to regulating granny flats in response to a request from a resident. He and his wife want to convert the second floor of a detached, unused garage on their 2.7 -acre property into a full living space for their daughter and son-in-law. The couple moved into his basement a couple of years ago, and the resident explained that he and his wife wanted to help them, while the younger couple would help them stay in their house longer. The amendment would allow detached accessory dwelling units only on lots that are at least I acre in size and that do not have municipal sewer and water service. The unit would have to use the same septic system and well as the principal residence. Skogh believes his existing septic system and well could serve the accessory unit proposed for his garage and meet other requirements of the amendment, City Planner Allan Hunting said. "There isn't anything so far that has made it impossible for them to meet the code requirements, at least as I understand it," Hunting said in an interview. Proposed requirements Further provisions of the amendment would require a granny flat to be 250 to 1,000 square feet and to house no more than three people. The unit would have to have at least two off- street parking spaces in addition to the one off-street space required for the primary residence. The property owner would have to live in the primary residence or the accessory unit. The unit the owner does not occupy would require a rental license. Owners would have to register their accessory dwelling units with the city. The units would have to be a subordinate part of a single-family home and the design would have to be similar to the primary residence and be compatible with surrounding homes. The city has received several inquiries about accessory units and proposals to include them in new homes or remodeling projects, but the current code required eliminating full kitchens planned in accessory spaces, Hunting stated in a report to the council. Some properties in the city may have unapproved granny flats, likely in homes built in the 1950s and 1960s that included full kitchens in their basements, according to discussion of the granny flat amendment before the city's planning commission. The number of such properties isn't known. In addition to the Dakota County cities that allow granny flats, other metro -area suburbs that have given the OK include Bloomington, Shoreview, Richfield, Roseville and Plymouth, according to the summary Hunting prepared. Monthly reporting of the City Budget progress to the Governing body is a recommended financial practice and often viewed positively by rating agencies. DISCUSSION Attached is the General Fund Revenue & Expenditure Budget Summary - Budget Year The following represents Administration's directives and departmental expectations that are in place again for 2015: 1. Expenditure budgets while approved, expenses are to meet with the spirit that needs are fulfilled first, expansions of service and special requests are to be reviewed with City Administration before proceeding. 2. Departments are to be committed to search for the best possible prices when purchasing goods and services. 3. Departments are to be committed to continually searching out new efficiencies and to challenge the status quo of how the City provides services. 4. Departments are to be committed to searching out collaborative opportunities to facilitate efficient and cost-effective utilization of governmental assets and personnel. 5. Departments are to be committed to developing effective, consistent and ongoing communications with City residents, businesses and other stakeholders. 6. Departments are to be cognizant that services provided are subject to available revenues and should not commit to services that are not sustainable. The Council is requested to receive a presentation and provide direction to staff. They are required to work four shifts per month and make call-backs. This keeps them in "good standing" status. • Duty Crews handle the calls for the day with the FT staff.
