PLANNING AND ZONING COMMISSION MEETING — AUGUST]], 2014 The Regular Bi- Monthly Meeting of the Andover Planning and Zoning Commission was called to order by Chairperson Holthus on August 11, 2014, 7:00 p.m., at the Andover City Hall, 1685 Crosstown Boulevard NW, Andover, Minnesota. Commissioners present: Chairperson Holthus, Commissioners Timothy Cleven, Dean Daninger, Lynae Gudmundson, Bert Koehler IV, Kyle Nemeth and Steve Peterson. Commissioners absent: None. Also present: Community Development Director Dave Carlberg City Planner Stephanie Hanson Others APPROVAL OF MINUTES. July 8, 2014 Commissioner Nemeth indicated he had a few changes. He noted a change on page 2, third paragraph, second sentence from the bottom, "approval or denial of the property." Page 4, third paragraph down, "Mr. Smolek 6wified asked if the water table would be lowered ", the Community Development Director actually did the clarification. The fourth paragraph down, third sentence, "He explained the value of the home is not based on the size of the lot". Page 6, last paragraph, second sentence from the end "approved conditional use permit and to revise the approved planning unit development on lots three through five ". Page nine, fifth paragraph down with the motion, third sentence from the end should read "amend the existing approved Conditional Use Permit, and to revise the approved Plan Unit Development." Chairperson Holthus stated on page one, first paragraph under public hearing it states Tom Emmerich Construction and should be Tony Emmerich Construction. Page two, it shows Tommy Emmerich Construction and needs to change to Tony. Motion by Nemeth, seconded by Peterson, to approve the minutes as presented. Motion carried on a 6 -ayes, 0 -nays, 1- present ( Daninger), 0- absent vote. Regular Andover Planning and Zoning Commission Meeting Minutes —August 11, 2014 Page 2 PUBLIC HEARING: Consider the Preliminary Plat of the Carson Ridge Planned Unit Development —18 Lot Single Family Urban Residential Development Located at 14123 Prairie Road NW— TH Construction. City Planner Hanson noted the purpose of this item is to hold a public hearing and take input on the Preliminary Plat of the Carson Ridge Planned Unit Development. City Planner Hanson reviewed the proposed Preliminary Plat with the Commission. Commissioner Nemeth asked in regards to the cul -de -sac length, 500 hundred feet is the maximum that is usually set up. Mr. Carlberg stated that is a maximum requirement of the City's subdivision code, however there are several in the City that are longer where variances have been granted. Commissioner Nemeth asked if the Public Works Department reviewed this and were there any comments regarding the 598 feet. Ms. Hanson stated they did not have any comments regarding the length of the cul -de -sac. Commissioner Gudmundson asked if there have been any changes made to the plans since last reviewed by them. Ms. Hanson stated there has not, the only thing that changed was it has now come back as a PUD. Commissioner Koehler stated when this was discussed in 2013, there was some question as to whether or not the developer had talked to adjacent property owners to see if there was property available for sale and he wondered if there was any information on this. Ms. Hanson indicated the developer could answer this question. Commissioner Peterson stated on Lot 6 it looks like there is a tree line which ends at Lot 7 and he wondered why this would stop and asked if they are planting additional trees on Lot 7. Ms. Hanson thought the developer could answer that question as well. Commissioner Peterson asked if there are additional enhancements on the plan since changing to a PUD. Ms. Hanson stated the enhancement is they are trying to save as many trees as possible along with some additional plantings and architectural standards will be higher than other areas. Commissioner Daninger stated in a PUD there is always give and take and he wondered what was in exchange by the developer for a PUD. He would like to hear from the developer in regards to this. Commissioner Nemeth wondered with the minimum lot depth change, 127 feet versus 130 feet, are there any concerns regarding safety or accessibility that came up when reviewed by staff. Ms. Hanson stated they do not have any concerns. Regular Andover Planning and Zoning Commission Meeting Minutes —August]], 2014 Page 3 Commissioner Koehler asked if there is any reason why the setbacks and lot depth are set where they are besides aesthetics. He wondered if there was something the City was concerned about. Ms. Hanson stated there was not. Motion by Daninger, seconded by Koehler, to open the public hearing at 7:20 p.m. Motion carried on a 7 -ayes, 0 -nays, 0- absent vote. There was an email submitted from Thomas and Susan Chounard, 14123 Prairie Rd NW regarding this item. Mr. Ed Gritton, 14157 Prairie Road NW, stated he had lots of concerns, most are personal. He stated he has been trying to market his property for the last ten to fifteen years without success. He stated his concern is this limits his ability to market his property. The other concerns have to do with their owning horses and he wondered what kind of problems this will cause to them personally with their livestock. It will create a financial issue for them because they are going to have to put up substantial fencing to secure their animals from the incoming neighborhood bordering their property. There are also other maintenance impacts such as what to do with the manure created. The biggest concern is the inability to market their property because of the way the plan is drawn up. Ms. Tricia Stanaway, 472 140'' Lane NW, stated her concern is this is a big cul -de -sac with a lot of traffic coming out and her driveway will be at the end of the road. She stated there will be a lot of added traffic coining out and she wondered if there will be some additional traffic control at the intersection such as a three way stop sign or something else. She wondered if it would help with fewer houses or if they could not make it a cul -de -sac and bring the road out to Prairie Road, which would help alleviate some traffic coming through. Also on the corner of Ilex and 1401h Lane is a bus stop for elementary students and a safety concern for her. Mrs. Sandy Roslin, 486 140th Lane NW, agreed with Ms. Stanaway. She stated there is also a family with three children and one of the children has special needs and they play in the cul -de -sac, which will now be Ilex Street and is a safety concern for her. Mrs. Jean Streeter, 289 141" Avenue NW, stated their land abuts this property and there is a wetland area. They watched all of the trees across the creek being torn out and she wants to make sure the trees are not removed to the boundary on this property. She would like assurance that all the trees will not be removed because it is wildlife devastation. Mrs. Kathy Larson, 14237 Olive Street NW, felt the same way as the other residents. She stated they watched the entire comer be torn down and wildlife was not considered and she hopes the wildlife will be considered in this plan. She thought this will be a lot of houses thrown into a little area and Prairie Road is already a speedway. She wondered why this development is going in when the development on the corner has not even been started. Regular Andover Planning and Zoning Commission Meeting Minutes — August 11, 2014 Page 4 Mr. Everett Frederick, 609 142 °a Avenue NW, stated it looks like the developers are using all that vacant land for a parking lot for equipment and he wondered what, if anything is going to happen soon. Ms. Hanson indicated she would update Mr. Frederic after the meeting. Mr. Tony Hennen, TH construction, 617 East Main Street, Anoka, was at the meeting to answer questions. Commissioner Daninger wondered what Mr. Hennen felt he was giving to get this PUD. Mr. Hennen indicated this is not a large development so there is not a lot more that can be done. They are going to be doing more tree plantings and also put nicer looking houses in there with the base point of $400,000. Mr. Hennen stated the tree line ends at Lot 7 because the City needs to have adequate drainage areas within the development. He noted he did not want to remove trees but was asked by the City Engineering Department to meet City standards. Commissioner Peterson stated it did not look like on Lot 6 any trees were planted or removed so the tree line might want to be continued from there. Mr. Hennen stated that could be a possibility depending on what the City wants. He did not see a problem with additional trees. He did not think there would be an issue with the horses because people like to look at them. He stated he would also work with the property owner on fencing. Commissioner Gudmundson wondered how the houses will be different than the ones east of this development. Mr. Hennen stated he would make sure they keep up the architectural standards and will be consistent with homes surrounding this development. Commissioner Gudmundson wondered if Mr. Hennen has talked to the property owner to the north about purchasing the parcel. Mr. Hennen stated he did talk to the owner's wife and she was not sure if they would want to sell seven feet to him or not. Commissioner Nemeth stated they received an email from Susan Chounard, and she was not aware of a path or bike trail going in and she requested a fence be installed. He wondered if the residents were aware of a proposed trail going in. Mr. Hennen stated since the first sketch plan there was discussion with the Park Commission regarding a trail going in. Commissioner Nemeth wondered what the price point will be for the homes. Mr. Hennen stated it would be from $400,000 and up. Commissioner Nemeth stated he did not have a big issue with the back yard setback but the front setback concerns him and be asked why Mr. Hennen would want the homes closer to the street. Mr. Hennen stated some of the Councilmembers were concerned Regular Andover Planning and Zoning Commission Meeting Minutes — August 11, 2014 Page 5 with the smaller backyards so he suggested moving the homes five feet closer to the road to make the backyards larger. Commissioner Nemeth stated the plan is showing two trees sitting on the corners of each lot and he wondered if this was where they were going to be planted. Mr. Hennen stated they would not be planted in the City Right -of -Way, it was just to show trees on the lots. Commissioner Koehler asked if there were any plans to put decks on the homes. Mr. Hennen stated decks may be added to the model homes but he would leave that up to the people purchasing the homes. Mrs. Sandy Roslin stated the only concern of the neighbors is when Shadowbrook first went in the homes were in the $500,000 range and there were not many homes built so the price range went down. The sign out on Prairie Road stated homes will be starting at $300,000 and not $400,000. Their concern is that the houses will not sell at $400,000 and the developer will start to lower the house base to get people to purchase. She wondered how they could make the developer not lower the home values if they do not sell. Mr. Ed Gritton stated when the developer approached his wife for the additional seven feet of land and they approached their lender to see if they could sell or give the developer that property, the lender told them they could not do that. He stated with regard to the fencing, it will have to be something that will prevent toys and children from going into their property with the horses. Commissioner Daninger asked staff if the street width could be reduced. Mr. Carlberg stated they did not have any discussion about reducing the street width and there would also be an issue with the transition coming up Ilex Street. Commissioner Daninger asked if the shape of the cul -de -sac was due to the existing home there. Mr. Carlberg stated the location of where it stops is. The design of the bulb is for better lot design and the lots meeting the minimum lot requirements. Commissioner Daninger stated he wanted to make sure at the next meeting the ghost plat to the north is addressed. Mr. Carlberg reviewed the ghost plat adjoining this development. Chair Holthus asked when the traffic control plans would be discussed. Mr. Carlberg reviewed with the Commission traffic control changes for the area. Motion by Gudmundson, Seconded by Nemeth, to continue the public hearing until the August 26, 2014 Planning Commissioner Meeting. Motion carried on a 7 -ayes, 0 -nays, 0- absent vote. Hanson, City Planner SUBJECT: Public Hearing: Rezoning request to change the zoning from R -1 Single Family Rural to R -4 Single Family Urban for ten (10) acres located at 14123 Prairie Road NW – PIN's 25- 32 -24 -34 -0003 and 25- 32 -24 -34 -0004 — Carson Ridge plat DATE: August 26, 2014 INTRODUCTION The Planning and Zoning Commission is requested to review the proposed request to rezone ten (10) acres from R -1 Single Family Rural to R -4 Single Family Urban as requested by TH Construction of Anoka. DISCUSSION The rezoning will allow for the parcels to develop into urban lots at a density of 1.75 to 3.6 single family homes per acre. As with all rezonings, the City must meet one of the two following findings that are provided by state statute: 1. The original zoning was in error. 2. The character of the area or times and conditions have changed to such an extent to warrant the Rezoning. The property is located within the Metropolitan Urban Service Area (MUSA) and also within the current stage of sewer expansion. Times and conditions have changed with the extension of municipal sewer and water into this area of the City. It has been requested by the property owner to rezone the property from R -1 Single Family Rural to R -4 Single Family Urban. The rezoning would allow the property owner to request an urban residential development and utilize the available municipal sewer and water services in the area. ACTION REQUESTED The Planning and Zoning Commission is asked to hold a public hearing to gather public input and consider recommending approval of the rezoning request based on the fact that the property is located within the MUSA, water and sewer are available to the property, and the request is in harmony with the Andover Comprehensive Plan. City Planner Hanson noted the purpose of this item is to hold a public hearing and take input on the Preliminary Plat of the Carson Ridge Planned Unit Development. City Planner Hanson reviewed the proposed Preliminary Plat with the Commission. Commissioner Nemeth asked in regards to the cul -de -sac length, 500 hundred feet is the maximum that is usually set up. Mr. Carlberg stated that is a requirement of the sub- division code however there are several in the City that are longer where variances have been granted. Commissioner Nemeth asked if the City Works Department reviewed this and were there any comments regarding the 598 feet. Ms. Hanson stated they did not have any comments regarding the length of the cul -de -sac. Commissioner Gudmundson asked if there have been any changes made to the plans since last reviewed by them. Ms. Hanson stated there has not, the only thing that changed was it has now come back as a PUD. Commissioner Koehler stated when this was discussed in 2013, there was some question as to whether or not the developer had talked to adjacent property owners to see if there was property available for sale and he wondered if there was any information on this. Ms. Hanson indicated the developer could answer this question. Commissioner Peterson stated on Lot 6 it looks like there is a tree line which ends at Lot 7 and he wondered why this would stop and asked if they are planting additional trees on Lot 7. Ms. Hanson thought the builder could answer that question as well. Commissioner Peterson asked if there are additional enhancements on the plan since changing to a PUD. Ms. Hanson stated the enhancement is they are trying to save as many trees as possible along with some additional plantings and architectural standards will be higher than other areas. Commissioner Daninger stated in a PUD there is always give and take and he wondered what was in exchange by the developer for a PUD. He would like to hear from the developer in regards to this. Commissioner Nemeth wondered with the minimum lot depth change, 127 vs 130 feet, is there any concerns regarding safety or accessibility that came up when reviewed by staff. Ms. Hanson stated they do not have any concerns. Regular Andover Planning and Zoning Commission Meeting DRAFT Minutes — August 11, 2014 Page 3 Commissioner Koehler asked if there is any reason why the setbacks and lot depth are set where they are besides aesthetics. He wondered if there was something the City was concerned about. Ms. Hanson stated there was not. Motion by Daninger, seconded by Koehler, to open the public hearing at 7:20 p.m. Motion carried on a 7 -ayes, 0 -nays, 0- absent vote. There was an email submitted from Thomas and Susan Chouinard, 14123 Prairie Rd NW regarding this item. Mr. Ed Gritton, 14157 Prairie Street, stated he had lots of concerns, most are personal. He stated he has been trying to market his property for the last ten to fifteen years without success. He stated his concern is this limits his ability to market his property. The other concerns have to do with their owning horses and he wondered what kind of problems this will cause to them personally with their livestock. It will create a financial issue for them because they are going to have to put up substantial fencing to secure their animals from the incoming neighborhood bordering their property. There are also other maintenance impacts such as what to do with the manure created. The biggest concern is the inability to market their property because of the way the plan is drawn up. Ms. Tricia Stanaway, 472 140th Lane NW, stated her concern is this is a big cul -de -sac with a lot of traffic coming out and her driveway will be at the end of the road. She stated there will be a lot of added traffic coming out and she wondered if there will be some additional traffic control at the intersection such as a three way stop sign or something else. She wondered if it would help with less houses or if they could not make it a cul -de -sac and bring the road out to Prairie Road, which would help alleviate some traffic coming through. Also on the corner of Ilex and 1401h Lane is a bus stop for elementary students and a safety concern for her. Mrs. Sandy Roselyn, 486 140th Lane NW, agreed with Ms. Stanaway. She stated there is also a family with three children and one of the children is special needs and they play in the cul -de -sac, which will now be Ilex Street and is a safety concern for her. Mrs. Jean Streeter, 289 141 st, stated their land abuts this property and there is a wetland area. They watched all of the trees across the creek being torn out and she wants to make sure the trees are not removed to the boundary on this property. She would like assurance that all the trees will not be removed because it is wildlife devastation. Mrs. Kathy Larson, Olive Street, felt the same way as the other residents. She stated they watched the entire corner be torn down and wildlife was not considered and she hopes the wildlife will be considered in this plan. She thought this will be a lot of houses thrown into a little area and Prairie Road is already a speedway. She wondered why this development is going in when the development on the corner has not even been started. Regular Andover Planning and Zoning Commission Meeting DRAFT Minutes — August 11, 2014 Page 4 Mr. E. Ben Frederic, 609 142nd Avenue NW, stated it looks like the developers are using all that vacant land for a parking lot for equipment and he wondered what, if anything is going to happen soon. Ms. Hanson indicated she would update Mr. Frederic after the meeting. Mr. Tony Hennen, TH construction, 617 East Main Street, Anoka, was at the meeting to answer questions. Commissioner Daninger wondered what Mr. Hennen felt he was giving to get this PUD. Mr. Hennen indicated this is not a large development so there is not a lot more that can be done. They are going to be doing more tree plantings and also put nicer looking houses in there with the base point of $400,000. Mr. Hennen stated the tree line ends at Lot 7 because the City needs to have adequate drainage areas within the development. He noted he did not want to remove trees but was asked by the City Engineering Department to meet City standards. Commissioner Peterson stated it did not look like on Lot 6 any trees were planted or removed so the tree line might want to be continued from there. Mr. Hennen stated that could be a possibility depending on what the City wants. He did not see a problem with additional trees. He did not think there would be an issue with the horses because people like to look at them. He stated he would also work with the property owner on fencing. Commissioner Gudmundson wondered how the houses will be different than the ones east of this development. Mr. Hennen stated he would make sure they keep up the architectural standards and will be consistent with homes surrounding this development. Commissioner Gudmundson wondered if Mr. Hennen has talked to the property owner to the north about purchasing the parcel. Mr. Hennen stated he did talk to the owner's wife and she was not sure if they would want to sell seven feet to him or not. Commissioner Nemeth stated they received an email from Susan Chouinard, and she was not aware of a path or bike trail going in and she requested a fence be installed. He wondered if the residents were aware of a proposed trail going in. Mr. Hennen stated since the first sketch plan there was discussion with the Park Commission regarding a trail going in. Commissioner Nemeth wondered what the price point will be for the homes. Mr. Hennen stated it would be from $400,000 and up. Commissioner Nemeth stated he did not have a big issue with the back yard setback but the front setback concern him and he asked why Mr. Hennen would want the homes closer to the street. Mr. Hennen stated some of the Councilmembers were concerned with the smaller backyards so he suggested moving the homes five feet closer to the road to make the backyards larger. Regular Andover Planning and Zoning Commission Meeting DRAFT Minutes — August 11, 2014 Page 5 Commissioner Nemeth stated the plan is showing two trees sitting on the corners of each lot and he wondered if this was where they were going to be planted. Mr. Hennen stated they would not be planted in the City Right -of -Way, it was just to show trees on the lots. Commissioner Koehler asked if there were any plans to put decks on the homes. Mr. Hennen stated decks may be added to the model homes but he would leave that up to the people purchasing the homes. Mrs. Roselyn stated the only concern of the neighbors is when Shadowbrook first went in the homes were in the $500,000 range and there were not many homes built so the price range went down. The sign out on Prairie Road stated homes will be starting at $300,000 and not $400,000. Their concern is that the houses will not sell at $400,000 and the developer will start to lower the house base to get people to purchase. She wondered how they could make the developer not lower the home values if they do not sell. Mr. Ed Gritton stated when the developer approached his wife for the additional seven feet of land and they approached their lender to see if they could sell or give the developer that property and the lender told them they could not do that. He stated with regard to the fencing, it will have to be something that will prevent toys and children from going into their property with the horses. Commissioner Daninger asked staff if the street width could be reduced to 33 feet. Mr. Carlberg stated they did not have any discussion about reducing the street width and there would also be an issue with the transition coming up Ilex Street. Commissioner Daninger asked if the shape of the cul -de -sac was due to the existing home there. Mr. Carlberg stated the location of where it stops is. The design of the bulb is for better lot design and requirements. Commissioner Daninger stated he wanted to make sure at the next meeting the ghost plat to the north is addressed. Mr. Carlberg reviewed the ghost plat adjoining this development. Chair Holthus asked when the traffic control plans be discussed. Mr. Carlberg reviewed with the Commission traffic control changes for the area. Motion by Gudmundson, Seconded by Nemeth, to continue the public hearing until the August 26, 2014 Planning Commissioner Meeting. Motion carried on a 7 -ayes, 0 -nays, 0- absent vote. OTHER BUSINESS. Community Development Director Carlberg updated the Planning Commission on related items. Regular Andover Planning and Zoning Commission Meeting Minutes — November 12, 2013 Page 5 PUBLIC HEARING: Consider a Sketch Plan for an eighteen (18) lot urban residential development located at 14123 Prairie Road NW, as requested by TH Construction. City Planner Hanson noted the purpose of this item is to hold a public hearing and take input on a Sketch Plan for an eighteen (18) lot urban residential development located at 14123 Prairie Road NW, as requested by TH Construction. City Planner Hanson reviewed the proposed sketch plan with the Commission. Commissioner Holthus asked if the existing residence on Lot 1, Block 1 will stay. Ms. Hanson indicated it would. Commissioner Gudmundson asked north of the ghost plat, if this has been coordinated with this development. Ms. Hanson indicated it will not be as the Catcher's Creek project is north of Coon Creek.. Commissioner Peterson asked if Prairie Road will be reconstructed. Mr. Carlberg was not sure of the reconstruction schedule for Prairie Road but indicated there is no access plan for this development onto Prairie Road. Commissioner Holthus stated since Prairie Road is a collector street and State Aid road, does the State have any criteria as to how many side streets can have access to it. Mr. Carlberg stated they try to limit the number of accesses onto Prairie Road. Motion by Nemeth, seconded by Koehler, to open the public hearing at 7:57 p.m. Motion carried on a 6 -ayes, 0 -nays, 0- present, 1- absent (Cleven) vote. Ms. Pixie Stockal, 601 140th Lane NW, stated her concern with this project is that all of the traffic will come onto 140th Lane and she wondered if there was a way they could do something so there is one egress into that development from Prairie Road because there will be a lot of traffic and there are currently a lot of children there. Mr. Carlberg stated there is a ghost plat and future development will warrant a future access onto Prairie Road and 140th does have capacity for additional traffic. Ms. Stockal asked if there was a way to slow the traffic down. Chairperson Daninger stated if there is an issue with speeding, the residents can contact the Sheriff's Department. Ms. Stockal wondered what will happen to the existing buildings on the property if this is developed. Mr. Carlberg indicated the applicant can address the question. Mr. Mark Madden, 14122 Prairie Road, stated he likes the sketch plan but his only concern is the fencing along Prairie Road. He thought the fences were atrocious and he Regular Andover Planning and Zoning Commission Meeting Minutes —November 12, 2013 Page 6 wondered if there was a way to prevent fencing abutting major roadways. His concern will be with the new houses in this development will put up fencing that will look bad. Mr. Carlberg reviewed the City Ordinance with the Commission. He noted the problem is that there is no uniform fencing regulations so as long as the fence is maintained, any type of fence can be installed. He stated this has been a concern of the look of the community. lure. Todd Wold, 463 140`h Lane, asked if the developer is connected with the original Shadowbrook development. He was concerned because of the covenants in the existing development and if they will continue into this development. Mr. Ed Gritton, 14157 Prairie Road, stated he lived next to this property and one of his concerns is they own some horses and with the lot lines butting up to his lot line, what is he to anticipate with future homeowners and his horses, what will he be faced with. He wondered how he will be protected. Mr. Carlberg stated they have ordinances regarding keeping horses that also covers the manure management responsibilities of the horse owners that Mr. Gritton would have to comply with. Mr. Gritton stated the concern is the additional cost he may have to incur with manure maintenance. Mr. Carlberg stated if there will be an area where manure will be stored on the property he suggested moving it to the north or east on the property. Mr. Tony Hennen, 617 Main Street, Anoka, applicant, reviewed with the Commission the price point of homes he builds. Chairperson Daninger noted the covenants will be different than Shadowbrook because it is a different development. Commissioner Holthus asked if the existing home will remain, will it be reversed or what will happen. Mr. Hennen stated the house will stay as it is with the driveway coming off Prairie Road, it will be hooked up to City sewer and water, and the other buildings will be removed. Commissioner Peterson asked if the existing house is removed in the future and a new home is constructed, would there be enough frontage area off the cul -de -sac to build a new structure. IVIr•. Carlberg indicated there would be enough frontage on that site to build a new home. Commissioner Gudmundson asked if there will be covenants or restrictions on the development. Mr. Hennen indicated there will be covenants put in place but it will not be a continuation of the Shadowbrook development. Chairperson Daninger asked if a fence will be placed on the existing home facing Prairie Road. Mr. Hennen indicated that will be the front of the home so a tall fence cannot be placed along Prairie Road. Regular Andover Planning and Zoning Commission Meeting Minutes —November 12, 2013 Page 7 Mr. Madden asked how they can address the fence situation along Prairie Road. Chairperson Daninger indicated this issue was seen City wide but thought Mr. Madden may want to meet with City staff to discuss it further. Mr. Carlberg suggested going before the City Council and discuss it during resident forum or to call or email the Council. Mr. Jerry Stockel, 601 140th Lane, asked if they will be notified by mail for the next meeting. Mr. Carlberg stated this will go before the City Council on November 19rh but future meetings will have public notifications. Mr. Wold wondered how quickly the developer plans on moving forward with this project. Chairperson Daninger thought the applicant would want to start as soon as this project is approved. SKETCH PLAN REVIEW — 18 LOT SINGLE FAMILY URBAN RESIDENTIAL DEVELOPMENT —14123 PRAIRIE ROAD NW— TH CONSTRUCTION Mr. Carlberg stated the City Council is asked to review a residential sketch plan for an 18 -lot single family urban residential development as requested by Mr. Tony Hennen of TH Construction. Mr. Carlberg reviewed the staff report with the Council Mayor Gamache asked if Plan B would place the homes closer to the front of the lot and not the back. Mr. Carlberg stated the standard 35 foot front yard setback could be maintained with this plan. They would be losing three feet off the back of the yard. Mayor Gamache stated the back yards will be backing up to another back yard and because it is only three feet, he wondered if it is better to move the house forward three feet because the entire neighborhood will be that way rather than shortening the back yard. Councilmember Trude stated that would require a PUD because it is a lot of variances. She did not know if they wanted to lower the community standard that much. Councilmember Trude thought the sketch plan is trying to get too much into a little amount of land. She wondered if this developer could try to purchase land from adjacent property owners. Mr. Carlberg stated the developer has met with the adjoining property owner and they have not come to an agreement for purchase. Mr. Carlberg stated there are a couple of options to be looked at. One is to grant variances, another is to look at doing a PUD with options of landscaping or berniing and enhanced design standards. The City Council and staff reviewed options for the sketch plan to see what could possibly be done to improve the development without granting variances. Mayor Gamache asked if it requires this development to be a PUD because of the variances. Mr. Carlberg indicated it did not, the lots can be granted a depth of a three -foot variance in the back yard and when they come to preliminary plat, the lots will be listed with a three -foot variance. These are buildable lots but they are not able to gain the necessary property to meet the minimum lot depth requirements. Regular Andover City Council Meeting Minutes— November 19, 2013 Page 5 Councilmember Trude thought it was an economic reason and stated this could be a development that met all of the City's requirements if it were not for the eight additional lots. Mr. Carlberg stated the Council could require this to be a PUD and ask the developer for berming or landscaping as a part of it. Councilmember Trude thought by doing a PUD, a precedent would not be set. She stated three feet could be quite a difference in a backyard when they abut homes. She thought this was imposing a lot on the existing neighborhood. Councilmember Howard stated he would be comfortable with the developer doing this if Lots 8 and 9 were shifted a little bit to give the lots more than the required buildable space because then they get something for letting the lots be little bit shorter. He indicated he is still comfortable with the project. Councilmember Howard thought the lots lines could be pushed to the west to allow more space for the internal lots. Councilmember Knight wondered if Lots 10 -14 were elongated east to west would that help. Mayor Gamache thought that would take care of just one side of the road. Mr. Carlberg noted the only thing that could be done would be to shift the road and either make one side comply and the other side a greater deviation or variance. But, bigger lots cannot be created by pushing them east or west, the problem is with north and south. Councilmember Howard stated there is the opportunity to go wider with the house rather than deeper. Mr. Carlberg agreed but noted it would not meet the lot depth minimum. He explained the lots need depth because they do not meet the 130 feet. They meet the buildability requirements, the width and the area because they went a little wider to make up for the deviation in depth; the only deviation is the three -foot depth. Councilmember Trude thought seventy-five percent of the lots need some kind of a variance and there should be some amenity or something similar to a PUD. Otherwise, the City standards will mean nothing and she is concerned about that. Mayor Gamache stated he would be fine with the front being moved forward because they have always pushed the front yards back more than other cities. He thought in order to make it fit the neighborhood behind this development, they need to make the back yard the proper size. Mr. Carlberg thought it sounded like a PUD was the right way to go to make this fit into the neighborhood but the question would be, what is the benefit to the City by allowing the deviation or new standard. Councilmember Trude thought this needed to go PUD because if the requirements for a variance were looked at they could not justify that it was not economic. She thought Mayor Gamache had some points that would be acceptable to people who live in the area and increasing the density of plantings would make it match some of the neighboring properties. In addition, maybe they look at the fence issue that was brought up at the Planning Commission meeting. Councilmember Trude stated the trail makes a nice walking loop for people in the area and she would hate to see trees lost because of the trail but thought the developer could come back with a PUD with additional plantings and preserve the space in the back yard with the existing homes. We are the current owners of the existing home on this plat. We believe this development is nicely platted and should be a beautiful addition to the neighborhood. We do have one concern. With talking to the developer at first there was never a mention about a bike /walking path. We do understand this was a request /requirement by a committee at the city. Our request of the city /developer would be to put a privacy fence along the bike /walking trail on the north side of our house, as it will be very close to our home. Hanson, City Planner SUBJECT: PUBLIC HEARING: Preliminary Plat known as Winslow Woods 2 "d Addition, a single- family urban residential development located east of Hanson Boulevard NW and 150`h Lane NW DATE: August 26, 2014 INTRODUCTION The Planning and Zoning Commission is asked to review the preliminary plat for Winslow Woods 2 "d Addition. The plat contains 18 -urban lots and 1- outlot as proposed by Tony Emmerich Construction. DISCUSSION Background In March 2014 the Planning and Zoning Commission and City Council reviewed the sketch plan for a 52 -acre development known as Winslow Woods. The City Council minutes are attached for your review. The developer will be developing the properties in phases. The four (4) lot plat for Winslow Woods was approved by City Council on July 15, 2014. The eighteen (18) lots known as Winslow Woods 2 "d Addition will be accessed from 1501h Lane NW through the Winslow Hills development. Conformance with Local and Regional Plans and Ordinances 1. The property is located within the 2020 Metropolitan Urban Service Area (MUSA). 2. The property is zoned Single Family Urban Residential (R -4). Access The 18 lots will be accessed through Winslow Hills by 150`h Lane. Future phases of Winslow Woods will be accessed through Sophie's South by Xeon Street. The future connection of Xeon Street to 150`h Lane will need to be further discussed during the next phases of development. Utilities Trunk sewer and water lines are located within Winslow Hill's developments and will be extended to serve the Winslow Woods 2 "d Addition plat. Lots All the proposed lots meet the minimum lot size requirements for the R -4 zoning district. Minimum lot size requirements are as follows: Lot size: 11,400 square feet Lot width: 80 feet Corner Lot Width: 90 feet Lot depth: 130 feet E Tree Preservation The developer is making every effort to preserve as many existing trees as possible. Numerous trees will be preserved in the rear yards. Tree removal will occur for building pads, drainage areas and street and utility construction. Park and Recreation Commission Recommendation The Park and Recreation Commission reviewed the plat at the August 21, 2014 meeting. Cash in lieu of land will be required for the 18- buildable lots. Park dedication for outlot A will be satisfied with the plat known as Winslow Woods 3'a Addition. On February 27, 2014, the Commission discussed a future trail connection at some point along the eastern portion of the plat; the exact location has not been determined. This trail would eventually serve the residential areas to the east; possibly through a tunnel system located beneath the railroad tracks. This discussion will continue during the next phases of development. Coon Creek Watershed District (CCWD) CCWD received the plat. It has been placed on the August 25, 2014 meeting agenda. The developer will need to address the conditions as part of the platting process. Conditions include establishing an escrow and to ensure vegetation will be installed to disturbed areas within two weeks of rough grading. ACTION REQUESTED The Planning and Zoning Commission is asked to hold a public hearing, review the proposed preliminary plat and to make a recommendation to the City Council. Ntr. Carlberg reviewed the staff report with the Council. Councilmember 13uldita asked if the property all the way to the south is the same property owner. Mr. Carlberg indicated the developer before the ConRCiI has a purchase agreement to purchase what is depicted in black lines around the property on the map. The ghost plat areas are being retained by the property owner at this point. Councilmember Bukkila wondered what planning was clone to extend Leon Street down farther tlrrouglr the ghost plat. Mr. Carlberg reviewed the street plan with the Council. Councilmember Knight thought a Wi itergreen Street connection would look frumy. TAr. Carlberg stated it is up to the Council to direct the developer as to what connections they would like to see with the roads. City Staff reviewed the Street connection with the Council. Mayor Gamache noted the majority of the traffic will need to be directed down \eon Street. He stated one of the three issues brought up is the road connection of Wintergreen Street. Con tic ilmember TrUde indicated she did not want Wintergreen Street connected because it will become a shortcut. Nlayor Gamache indicated lie would prefer theyhave some connection; but it did not need to be directly connected there could he a jog in the road to slow traffic down. Councilmember Bukkila stated she would prefer Wintergreen Street to go through on a more direct angle and to provide another access to Set north. CounClmemberBukkila stated the ultimate routes for this neighborhood are not going to bemade or broken on the Street. N1r. Carlberg stated there is cun�e.nlly a sign on the cul -de -sac indicating it is temporary. Councilmernber Tnule felt that once the Count received the Federal Grant for reconstruction of Hanson Boulevard, there will be medians and the County will eliminate left hand turns onto Hanson Boulevard Nlayor Gamache thought some would be eliminated but there will still be some available such as 14S`h Lane. He stated on the drawing they do not have Xeon Street going down to 150`h Lane. %Mr. Carlberg stated staffs comments reRardinR that, were to nv to make that Xeon Street connection to 150'h Lane. However, the developer is only purchasing what is within the. black lines. Mayor Gamache suggested the developer go back to the owner to try to purchase the land just past 150"' Lane in order to construct the road. Mayor Gamache stated the stretch where they have double frontage lots, he would prefer the sketch with ttuee cul -de -sacs instead. He would like to not put any driveway access onto ,Peon Street, and to keep that open. Coll 11--i Imember Trade agreed. Nlr. Carlberg stated the three cul -de -sac sketch is one of the original sketches submitted by the developer and staffs effort generally is to eliminate cul -de -sacs or try to avoid them. Councilmernber Trude stated on the east side of the plan are two sets of railroad tracks and one set becomes a parking lot for Burlington Northern trains so any home on the end of the cul de sac will be up against the tracks, but the cul -de -sac lots seem to be a little deeper and dive more buffer. On the other plan, there was the potential for an entire Nvall of fences in back yards so people are going to live in a narrow area with either the railroad tracks behind them or the busy street behind them with a Nvall of fences so driving in the neighborhood would not look attractive. She stated they need to look at what kind of neighborhoods they are building. Councilmernber Bukkila thought that was a good point. The development needs a buffer from the railroad tracks. She stated they have no buffer at all along the railroad tracks and she is looking at deeper lot depth by the railroad tracks. Councilmernber lunight stated in the next ten years the train traffic is going to increase steadily especially if they start bringing oil in from the north, so he agreed there needed to be a buffer. Mr. Carlberg stated there will be a trail on Xeon Street on the west side and eventually there will be a connection onto the tracks to the south. NMI-. Haas wondered if the rest of the Council is interested in a trail going east, and then under the railroad tracks. CouncilnnennberTrude indicated she would be interested. Nit. Haas stated they will need to work with the developer on where the best place for a crossing would be based on the soil conditions. Councilmember Trude stated the issue with a Wintergreen Street connection is that it brings very little value to the project and she thought it decreased the quality of the neighborhood. She would like staff to look at getting a right turn lane on Crosstown Boulevard for Y61ow Pine Street as a part of this he Cause most of the car; will be turnin « ill ere to come into the devetopment. She thought the neighborhood was nice with a street that curves and access to the park with the trail. She stated any time a street is Put in between a row of homes, it separates those people as far as sense of community. She stated by extending the street they will lose a couple of nice lots and she wondered if the benefit of adding the pavement and slicing up the neighborhood was worth it when they do have more connections now than they did in the past. She stated this is corulecting into Winslow Hills so it is very well connected into the community and they are providing more egress for Sophie's South than they have in the past. She thought the connection would devalue the neighborhood and the lots it would cut through would be devalued. She did not think the connection would add much. Mayor Gamache reviewed the possible Wintergreen Street connection. He did not think that a road would be that much of a disturbance. Councilmember Trude disaureed and indicated it would split the conuuunity up in that development. She stated they already have the railroad tracks and a busy street and the only choice lots in the development are on Street A. Councilmember Kr4oht wondered about going straight west with Wintergreen Street. Mr. Carlbem, indicated they would not be able to connect Wintergreen Street to Crosstown Boulevard. Councilmember Bukkila stated in order to have a reasonable access to the park for the kids, if someone is anywhere west of this neighborhood they will not go to this park. If they keep thecut iu the street everyone to the west would have to go clown to Bluebird Street to the park to the south. The only other route would be to get onto I 501 Lane and go east to the park. When talking about value there is a huge value if there is a safe mobile passage on the residential streets for families to get to the nearest park. If they have to go the other way to get to the other park you are devaluing everyone to the west. There was further discussion regarding the park with staff and the Council. Councilmember Howard stated lie is okaywith connecting Wintergreen Street because it is another avenue for public safety and he did not think it hurt the plan and it was always intended to go through. Councilmember Knight stated he could live with Wintergreen Street going through. City Staff reviewed with the City Council street configurations and connections. Councilmember Bukkila stated her concern is not to have blind angles or speed on the curve. where there is pail, access. hti-. There is currently only one. connection point between Sopbie's South and this development, which is Xeon Street. Mr. Dickinson stated that will be a requirement before the developer comes back for a preliminary plat. Councilmember Trude stated she would like to see more energy put into making sure the land is connected then a street, because in the long run the land will be more valuable to the community. Nlavor Gamache asked if everyone would prefer the tlufee cul -de -sacs over the road shown on the proposed sketch. Councilmember Howard wondered if the water utility will be okay for the three cul -de -sacs. Nlr. Dickinson stated that would be a question for the developer's engineer and he thought the water utility should be Looped in that area. COmletlmernber BuW- la stated the cut -de -sacs are not her fast choice but she would concede if they are going to get deeper lots with more bufferinc, along the railroad tracks. \ /Ir. Carlberg stated the minimum depth is 130 feet and he thought the lots shown are around 140-150 feet deep. Vh. Lary Olson, representing the developer, stated they are tookinc, at the three cut -de -sacs atong the tracks to minimize the number of lots that back tip dircctly to the tracks. He stated they are also looking at additional buffering along 111e tracks. Councilmember Howard wondered if the lots in the cul -de -sacs are standard depth lots. Mr. Olson indicated they are deeper. Councilmember Trade asked what Mr. Olson and his design team have seen as issues. Mr. Olson thought the Council had lit on most of the issues. His team has concluded on the Wintergreen Street connection that it is more street to .maintain and chops up the area because of the odd angles. It isolates the lots to the west if Wintergreen Street connects. He explained what type of lots people like to live on and if the cul -de -sacs were to be removed it would take away those lots. Another thing is that by making the Wintergreen Street connection, it will mean another street the kids will need to cross to get to the park. %,layor Gamache asked if the developer is fine with the trail along Street A that runs to the park. Mr. Olson stated they are fine with it. ivlayor Gamache asked if there were no driveway accesses to Xeon Street would the developer push out the boundaries for those lots. Mi.. Olson stated if the Park Commission wanted it for park, it would be fine with them but it really does not make sensebecause it is all wetland. If the lots are extended through, people would need to go out to Xeon Street to get t - to their back yard and some people would not be able to get to their back yard because they would have to cross someone else's yarcl. In Sophie's South there are already ten driveways with access to Xeon Street, he would prefer a buildable lot with access to Xeon Street. Couocihmember LukkIla stated she would not have any interesl in buying the wetland area because it would not be any use to them. The Council reviewed with the developer the areas within the development that are considered v"'- lands. Mayor Gamache wondered if there was unanimous a«reement to not have driveway access onto Leon Street. Councilmember Trude thought it depended on what the Park Commission thought because they are going to look at this again Councilmember Howard stated lie is okay with one lot on there but wondered if it would be possible to look at acquiring some more or putting a trail through there. Mayor Gamache stated the reason he thou alit there should not be any more driveway accesses onto Xeon Street is that eventually Xeon Street will go all the way to Andover Boulevard and with the layout of Hanson Boulevard in the future, Xeon Street will probably get more busier. %Mayor Gamache stated another item the Council would like to see happen is Leon Street going all the way to 150`h Lane. It would benefit the development because 150`' Lane will not end and wait until the nest development comes in. Cott ncilmember Knialit stated they want the three cul -de -sacs sketch. Collncilnlednber Trude slated this witl enable fewer double frontage lots and fewer lots against a fence. %Mr. Cailbera asked if the applicant is willing to do a revised sketch and bring it back for finther discussion. Mayon Gamache thought that miaht be the main issue on the plan. Nlr. Carlbern thought the applicant was leaning towards revising the sketch and brinaina it back for further review. Nor. Carlberg reviewed what has happened with the sketch plan after it went to the Planning Commission. uh. Jim Traver, 1 134 152 °a Lane, stated he is close to the park in Sophie's South and one- of the original sinners of the proposal for additional park land presented to the Plarmina and Zoni nn Commission. Their concern is with the park and the comununity. He stated the park already gets a lot of use and is a nice park with 3 -4 lots unsold in Sophie's South. The park is going to get even more use with 102 lots being developed to the south. He stated they looked at the plans and thought if lot 59 was eliminated, it could be used as an extension of the park in some way. They could also make their own natural trails. He thought i f the cul -de -sac on Street E could be shortened with part: land at the end, it would allow access to Leon Street and the City could have their tunnel underneath the railroad tracks. Mr. Traver stated being in Sophie's South, he would prefer Winternreen Street not be extended because it will not benefit either development. He thought it would cut up the neighborhoods. Hanson, City Planner SUBJECT: PUBLIC HEARING: Prelim[ a single - family urban residential 161" Avenue NW DATE: August 26, 2014 iary Plat known as White Pine Wilderness 2 "d Addition, development located north of 161 s` Avenue NW at 1341 INTRODUCTION The Planning and Zoning Commission is asked to review the preliminary plat for White Pine Wilderness 2 "d Addition. The plat contains 16 -urban lots and 1- outlot as proposed by L & K Emmerich LLC. DISCUSSION The Andover Review Committee has reviewed the preliminary plat. Staff comments have been submitted to the developer. The developer has made revisions according to staff comments and will continue to work with city staff to satisfy all continents. Conformance with Local and Regional Plans and Ordinances 1. The property is located within the 2020 Metropolitan Urban Service Area (MUSA). 2. The property is zoned Single Family Urban Residential (R -4). This parcel is allowed to develop into urban lots at a density of 1.75 — 3.6 single family homes per acre. The proposed density for the 2 "a Addition (16 platted lots) is 1.62 units per acre. However, when outlot A is developed, the overall density increases to 1.90 units per acre. Access The 16 lots will be accessed by the extension of 161 st Lane NW to the east. A future phase of White Pine Wilderness will be accessed by extending the Zilla Street NW, as shown on the attached preliminary plat. Utilities Trunk sewer and water lines are located within White Pine Wilderness development and will be extended to serve the 2 "d Addition. The water main will also be extended within the future right -of -way to the northern boundary of the plat, connecting with the drainage and utility easement through the North Woods Preserves open space. The extension of the water main will serve future development to the north. As part of the 2 "d Addition, a drainage and utility easement to the northern boundary will be required for the installation of the water main. Lots All the proposed lots meet the minimum lot size requirements for the R -4 zoning district. Minimum lot size requirements are as follows: Lot size: 11,400 square feet Lot width: 80 feet Corner Lot Width: 90 feet Lot depth: 130 feet Floodplain and Wetlands There is a significant amount of wetlands and floodplain as part of this plat. The wetlands have been delineated and the report is being reviewed by the necessary agencies. Plat approval will be subject to the developer obtaining required permits from all necessary agencies. Tree Removal The existing property is densely vegetated. However, the majority of the trees will need to be cleared for grading/drainage areas, building pads and for the construction of streets and utilities. Trail System Currently there is an existing temporary trail easement to access the North Woods Preserve Open Space. As part of the plat 2 permanent ten (10) foot trail easements will be in place to access the open space; one on the south part of the plat and one on the north part. Park and Recreation Commission Recommendation The Park and Recreation Commission reviewed the plat at the March 6, 2014 meeting. Meeting minutes are attached for your review. Cash in lieu of land will be required for the 16- buildable lots. Park dedication for outlot A will be determined when it is platted in the future. Lower Rum River Watershed Management Organization ( LRRWMO) LRRWMO has received the plat. At the August 22, 2014 watershed meeting, the board approved the LRRWMO permit. Coordination with other Agencies The developer is responsible to obtain necessary permits from agencies that may have interest in the site. Initial contact shall be made with the City Engineering department regarding this item. ACTION REQUESTED The Planning and Zoning Commission is asked to hold a public hearing, review the proposed preliminary plat and to make a recommendation to the City Council. Motion by Lewnau, seconded by Miskowiec, to recommend appro 1 of the application for Scheduled Use of Recreational Facilities from the Andover Fire Nartment for Tuesday, June 17, and Wednesday, June 18, to hold the annual Safety Np at Purple Park from 7 a.m. to 4:30 p.m. Motion carried on a 6 -ayes, 0 -nays, 1 -absen Marinello) vote. --� CONSIDER WHITE PINE WILDERNESS 2 "rD ADDITION PRELIMINARY PLAT Mr. Haas explained that this item is in regard to determining the park dedication requirements for the preliminary plat of White Pine Wilderness 2 °d Addition, He identified the parcel of land and the nearby open space areas that the City has purchased. He identified the first phase of White Pines Wilderness I" Addition and noted that this second addition would include sewer and water utilities as well. He stated that the Commission had previously discussed accepting park dedication in the form of land for this area. He displayed the proposed Preliminary Plat submit by the developer and noted that this plat is differently configured than the plans reviewed in 2006. He stated that the Commission would need to determine whether they would like to accept park dedication in the form of land or cash or a combination of both. He provided additional information regarding the City owned open space areas including their access points and available parking. Chair Butler stated that when the Commission discussed this in 2010 his thoughts were that it would be nice to have a small park that would connect to the open space but did not believe the configuration would work with that idea. Mr. Haas identified an area where a small park could be placed near the open space. Regular Andover Park & Recreation Commission Meeting Minutes —March 6, 2014 Page 3 Chair Butler stated that there is quite a bit of open space between the two City purchases and noted that there are only 49 housing units between the two additions of the development. Commissioner Miskowiec stated that it would be nice to have another access point to the open space that has active play equipment. Mr. Haas identified a water main loop that will be created and will tie in with Country Oaks North. He stated that the water main would have a 20 -foot easement and noted that a park could be placed in the area of Lot 18. He explained that a trail could be created to lead to the open space. Commissioner Lindahl stated that because that location is more secluded it would not receive as much use from the development. Commissioner Miskowiec confirmed the location of a wetland it was confirmed that area was a DNR protected wetland. Chair Butler stated that this is not a huge development and questioned if the Commission wants a park there. Commissioner Stenzel agreed that this development is not large but noted that there are adjacent lots that could develop in the future as well. Commissioner Lindahl stated that it would be helpful to have the trail connection to the open space. Commissioner Stenzel referenced lot 31, which would provide a trail to the open space and additional area that could be used for a park. Chair Butler agreed that a small shelter or tot lot would fit in that location. Larry Emerich, 1341 1615 Avenue NW, displayed a map of the area which identifies the nearby open space areas and the land he is proposing to develop. He noted that the ghost plat that was completed with the White Pines Wilderness 1" Addition displayed a trail connection to the open space. He stated that the crossing at 1615 Avenue NW is very safe. He stated that the City currently has a trail that ends at 159`h Avenue and noted that the trail could be extended 1,000 feet to reach 1615 Avenue NW to provide people with a safe crossing, which could lead into the open space. He stated that there is also a trail that comes out at Crane Street North and would also feel comfortable with a connection to that point in order to maintain a safe connection. He explained that with the current situation, as he will begin with maybe one third of the development, he would be concerned with traffic that would come through the neighborhoods where children are playing to reach the open space. He noted that the parking lot for the open space has not yet been constructed and was concerned with the traffic and parking that would come Regular Andover Park & Recreation Commission Meeting Minutes — March 6, 2014 Page 4 through the neighborhood. He stated that he is not against a trail access or small park but was unsure that this was the right moment in time to complete those actions. He stated that the better time might be in the future when additional facilities exist. Chair Butler questioned if Mr. Emerich believed that the neighborhood would want to see a park. Mr. Emerich stated that currently there are families with small children living in the first addition of the development and advised that each family has their own play equipment in their yard. He advised that the minimum price for the development is $450,000 and the lots are larger than City standards. Commissioner Miskowiec stated that the Commission thinks in terms of community as well and questioned where residents would meet and gather within this planned development. He believed that a community gathering spot would be a draw for the development. Chair Butler thanked Mr. Emerich for his time and input. He stated that the Park Commission does not have jurisdiction over County or City trails. Commissioner Lindahl stated that he does see a potential problem with parking. Commissioner Miskowiec acknowledged that there would be a transition time before the parking lot could be constructed and agreed that there may be some short term parking issues. Commissioner Stenzel stated that he would still prefer lot 31 and confirmed that the lot extends to 161St Avenue NW and questioned if there would be sufficient space for a trail connection, park and parking lot. Mr. Haas noted the location of wetlands in that area which would not make that action possible. Chair Butler questioned if the Commission should consider waiting for a park until an adjacent parcel develops, to the north of this property, which could also provide access to the open space. He stated that at that point perhaps the desire would be for a larger park, compared to a tot lot. He stated that to begin with he was in favor of connecting to the open space and creating a small community gathering but was not in favor of accepting land because of the traffic problems that would be created for this small development. Commissioner Lindahl agreed that with two cul -de -sacs there would be traffic problems created. Mr. Haas confirmed that a trail easement for lot 31 and between lots 17 and 18 could be included in the recommendation along with cash in lieu of parkland. DISCUSS SUR VEY RES UL TS FOR HOCKEY RINK IMPR0YEMENTS /HIDDEN NORTH PARK Butler provided background information regarding the possible relocation of an or hockey rink. He noted that one possible location for that outdoor rink was Creek North Park and advised that a survey was distributed. Mr. Haase lained that the Park and Recreation Commission is requested to discuss the survey result for hockey rink improvements at Hidden Creek North Park and receive input from the eighborhood. He summarized the results of the survey for the Commission. H oted that the neighborhood was invited to attend the meeting tonight to provide input. Ndisplayed a picture of the park and identified where the hockey rinks and play equip nt could potentially be located. Chair Butler stated that h 'nterpretation of the survey results were that some of the residents were concerned wN the aesthetics of a hockey rink in that park. He also had concern with over programmin the park. Commissioner Miskowiec stated th it was nice to hear the input of the residents and the residents oppose the idea. He also ex essed concern with over programming the park. He stated that the intent was to determin if this would be a possibility and it appears more and more that this would not be a go option. Mike Olson, 13693 Hidden Creek Drive, state at he is the original owner of the home and therefore was in the home before the park wa even constructed. He stated that the hockey rink would literally be in his backyard and s opposed to that idea. He stated that they enjoy the park as it is with the ball field and lay equipment. He was concerned with lights and a hockey rink in that area during the win r months. He stated that if the money is going to be spent to create a hockey rink he beli ed that the deteriorating rink should simply be repaired rather than relocating it. Commissioner Miskowiec explained that the Crooked Lake rink School District land and the City runs into the issue of spending City funds on School trict property. He explained that it what is driving this possible relocation. Chair Butler confirmed that the Commission is just investigating possible locations.
