PLANNING AND ZONING COMMISSION MEETING — JULY 812014 The Regular Bi- Monthly Meeting of the Andover Planning and Zoning Commission was called to order by Chairperson Holthus on July 8, 2014, 7:00 p.m., at the Andover City Hall, 1685 Crosstown Boulevard NW, Andover, Minnesota. Commissioners present: Chairperson Holthus, Commissioners Timothy Cleven, Bert Koehler IV, Kyle Nemeth and Steve Peterson. Commissioners absent: Commissioners Dean Daninger and Lynae Gudmundson. Also present: Community Development Director Dave Carlberg City Planner Stephanie Hanson Others APPROVAL OF MINUTES. June 10, 2014 Motion by Commissioner Koehler, seconded by Commissioner Peterson, to approve the minutes as presented. Motion carried on a 5 -ayes, 0 -nays, 2- absent (Daninger, Gudmundson) vote. PUBLIC HEARING: Consider rezoning 52 acres from RI — Single Family Rural to R4 —Single Family Urban located south of Crosstown Boulevard and Xeon Street NW — Tony Emmerich Construction. City Planner Hanson noted the purpose of this item is to hold a public hearing and take input on a request to rezone the parcels located directly south of Sophie's South and east of Winslow Hill's residential developments from R -1 Single Family Rural to R -4 Single Family Urban as requested by Tom Emmerich Construction. City Planner Hanson reviewed the proposed rezoning with the Commission. Motion by Commissioner Nemeth, seconded by Commissioner Cleven, to open the public hearing at 7:04 p.m. Motion carried on a 5 -ayes, 0 -nays, 2- absent (Daninger, Gudmundson) vote. Regular Andover Planning and Zoning Commission Meeting Minutes —July 8, 2014 Page 2 Mr. Ron Smolik, 1295 148`h Lane NW, Andover, asked if there would be any water pumped out to put in City utilities similar to what had been done with the Sophie's South development. This had caused flooding initially and then the water table took several years to recover. He also expressed concerns about the removal of the mature trees and the quality of the homes that would be put into this development. Mr. John Derence, 15070 Yellow Pine Street NW, Andover, expressed concerns about the quality of homes that would go into the proposed developments because he feels anything that is less than $400,000 would be trashing the surrounding neighborhoods. He also expressed concerns about the lack of parkland being proposed and the lot configurations are not consistent with the neighborhood or straight along the back portion of the property. Community Development Director Carlberg stated the input that was received at the previous public hearing and tonight would be included in the staff reports for the plat and design reviews of this project. He clarified many of the concerns at this time will be discussed at a future public hearing and tonight the Commission is to recommend approval or denial of the rezoning the property. He also stated there would be more opportunities for public input during the preliminary plat reviews. Mr. Larry Olson, Tommy Emmerich Construction, 1875 Station Parkway, Andover, stated the family that currently owns the property determined the property that they would sell and this established the property lines for the four (4) parcels that would be considered Winslows Woods. He explained the homes would not be trashy or trash the surrounding neighborhoods and the lot sizes are designed to match the lot sizes in the surrounding area. Mr. Brent Jagers, 15069 Yellow Pine Street NW, Andover, expressed concerns about the value of the homes that would be in this development because the homes would not be able to be big based on the lot sizes. Commissioner Koehler clarified the objective of the Planning Commission at this time was to determine if rezoning the property would be in line with characteristics of the surrounding neighborhood and the City's Comprehensive Plan. Community Development Director Carlberg also explained the value of the homes could not be dictated by the City and the proposed lots meet the requirements for the R -4 Zoning District. Mr. Smolik stated he is against lots this small because it would not allow a large enough home that would be of higher value. Chairperson Holthus stated the design of the homes, the landscaping plan, the irrigation, and other information would be looked at and discussed during the preliminary and final Regular Andover Planning and Zoning Commission Meeting Minutes — July 8, 2014 Page 3 plat process. She also stated the Parks and Recreation Commission had discussed this development and there would be a park component to this development. Motion by Commissioner Koehler, seconded by Commissioner Cleven, to close the public hearing at 7:30 p.m. Motion carried on a 5 -ayes, 0 -nays, 2- absent (Daninger, Gudmundson) vote. Motion by Commissioner Peterson, seconded by Commissioner Koehler, to recommend to the City Council approval of rezoning the 52 acres located directly south of Sophie's South residential development from R -1 Single Family Rural to R -4 Single Family Urban as requested by Tony Emmerich Construction, based on the fact that the property is located within MUSA, water and sewer are available to the property, and the requested rezoning is in harmony with the Comprehensive Plan. Motion carried on a 5 -ayes, 0- nays, 2- absent (Daninger, Gudmundson) vote. City Planner Hanson stated that this item would be before the Council at the July 15, 2014 City Council meeting. PUBLIC HEARING: Consider a Preliminary Plat for a 4 -lot residential development known as Winslow Woods located on I50 Lane and Yellow Pine Street — Tony Emmerich Construction. City Planner Hanson noted the purpose of this item is to hold a public hearing and take input on the preliminary plat for Winslow Woods located on 150`h Lane and Yellow Pine Street and comprised of four urban lots and one outlot proposed by Tony Emmerich Construction. City Planner Hanson reviewed the proposed preliminary plat with the Commission. Commissioner Koehler asked how these lots compared in size to the surrounding lots. City Planner Hanson explained the proposed lots were at minimum 1/4 acre and the surrounding lots were somewhat larger. Chairperson Holthus asked if the City had any code requirements for landscaping. Community Development Director Carlberg explained they would need to put two (2) trees on each lot but there are no other requirements. Commissioner Peterson asked if there would be any impacts on the water table since the property was prepared to be hooked up to City services. City Planner Hanson stated there would not be any flooding impacts with this phase of the development. Utilities are already in place for these lots. When Phase 2 is done the City Engineer would review the project for potential impacts. Regular Andover Planning and Zoning Commission Meeting Minutes — July 8, 2014 Page 4 Motion by Commissioner Koehler, seconded by Commissioner Nemeth, to open the public hearing at 7:40 p.m. Motion carried on a 5 -ayes, 0 -nays, 2- absent (Daninger, Gudmundson) vote. Mr. Derence stated the lots were too narrow to allow for an adequate sized home and he would like to see these lots wider and deeper. Mr. Smolik clarified the water table would not be lowered with this development. Community Development Director Carlberg stated this was correct for this development but it may be done with phase two (2) of the development. Mr. Olson clarified the lots exceed the minimum standard for the R -4 District and are about 1/3 -acre. The homes will be similar to those found in the surrounding neighborhoods and he explained the value of home is not based on the size. The builder will determine the price point for the homes. He also stated the rear property line had been determined by the seller not the developer. The builder will be developing the lots individually so that as many trees as possible are saved. Motion by Commissioner Nemeth, seconded by Commissioner Koehler, to close the public hearing at 7:52 p.m. Motion carried on a 5 -ayes, 0 -nays, 2- absent (Daninger, Gudmundson) vote. Commissioner Koehler pointed out the lots to the north of this development are approximately 13,000 square feet and the proposed lots are 12,900 - square feet so they are similar to the surrounding area. Motion by Commissioner Koehler, seconded by Commissioner Nemeth, to recommend to the City Council approval of the preliminary plat for Winslow Woods located on 1501h Lane and Yellow Pine Street comprised of four urban lots and one outlot proposed by Tony Emmerich Construction. Motion carried on a 5 -ayes, 0 -nays, 2- absent (Daninger, Gudmundson) vote. City Planner Hanson stated that this item would be before the Council at the July 15, 2014 City Council meeting. PUBLIC HEARING: Consider Registered Land Survey —17605 & 17477 Hanson Boulevard NW —Max Fenna, Jr. Community Development Director Carlberg noted the purpose of this item is to hold a public hearing and take input on a Registered Land Survey (RLS) for properties located at 17605 and 17477 Hanson Boulevard NW as requested by Max Fenna Jr. Community Development Director Carlberg reviewed the proposed RLS with the Commission. Community Development Director Carlberg explained there is currently one (1) title certificate and in order to separate the two descriptions into two titles a registered land survey would have to be approved by the City. Motion by Commissioner Nemeth, seconded by Commissioner Peterson, to recommend to the City Council approval of a Registered Land Survey (RLS) for properties located at 17605 and 17477 Hanson Boulevard NW as requested by Max Fenna, Jr. Motion carried on a 5 -ayes, 0 -nays, 2- absent (Daninger, Gudmundson) vote. Community Development Director Carlberg stated that this item would be before the Council at the July 15, 2014 City Council meeting. PUBLIC HEARING: Consider Registered Land Survey — 3200 South Coon Creek Drive — City of Andover. Community Development Director Carlberg noted the purpose of this item is to hold a public hearing and take input on a Registered Land Survey (RLS) proposed by the City for property located at 3200 South Coon Creek Drive. Community Development Director Carlberg reviewed the proposed RLS with the Commission. Commissioner Koehler asked if there was a developer interested in this property. Community Development Director Carlberg explained the City was currently working with a developer who is interested in acquiring the property. Commissioner Peterson asked how the location and size of the property for development had been determined. Community Development Director Carlberg stated this portion of the property (Tract A) was the highest and not wetland area. The remaining parcel is not buildable and would be reestablished as wetland. Chairperson Holthus asked if townhomes were considered for this area. Community Development Director Carlberg stated townhomes had been considered but market Regular Andover Planning and Zoning Commission Meeting Minutes — July 8, 2014 Page 6 conditions dictate the construction of single family homes. The adjacent property owners were also supportive of single - family homes. Commissioner Peterson asked for clarification on what the passive trail for the property would be. Community Development Director Carlberg stated the main access would be an outlot to the west of the proposed homes and it would be a grass trail that goes along the perimeter. This trail is intended more for the neighborhood use but is also available for public use. This area will not be urbanized because it is intended to be a wetland restoration area. Motion by Commissioner Koehler, seconded by Commissioner Peterson, to open the public hearing at 8:09 p.m. Motion carried on a 5 -ayes, 0 -nays, 2- absent (Daninger, Gudmundson) vote. Mr. Bill Hentges, 3061 142 "d Lane NW was concerned about this area being a wildlife corridor and asked the Planning Commission to establish setbacks from the creek to protect this area. Motion by Commissioner Koehler, seconded by Commissioner Peterson, to close the public hearing at 8:12 p.m. Motion carried on a 5 -ayes, 0 -nays, 2- absent (Daninger, Gudmundson) vote. Community Development Director Carlberg explained approval of the registered land survey would create two (2) tracts of land and the development of what would be Tract A would go through the platting process and be developed into 5 -6 single family homes. During this process the setback and trail access would be reviewed. Motion by Commissioner Nemeth, seconded by Commissioner Koehler, to recommend to the City Council approval of a Registered Land Survey (RLS) for the property located at 3200 South Coon Creek Drive as proposed by the City. Motion carried on a 5 -ayes, 0- nays, 2- absent (Daninger, Gudmundson) vote. Community Development Director Carlberg stated that this item would be before the Council at the July 15, 2014 City Council meeting. PUBLIC HEARING: Consider an Amended Conditional Use Permit to Revise and approved Planned Unit Development known as Clocktower Commons —BDT Holdings, LLC and BDT Land, LLC. Community Development Director Carlberg noted the purpose of this item is to hold a public hearing and take input on a request by BDT Holdings, LLC and BDT Land, LLC, the current owners of the Andover Clocktower Commons, to amend the existing approved Conditional Use Permit (CUP) to revise the approved Planned Unit Development (PUD) on Lots 3 -5, Block 1, Andover Clocktower Commons. Regular Andover Planning and Zoning Commission Meeting Minutes — July 8, 2014 Page 7 Community Development Director Carlberg reviewed the proposed CUP amendments and PUD revisions with the Commission. Commissioner Cleven asked if there would be additional retention ponds constructed as part of this development. Community Development Director Carlberg stated that there would be additional ponding needed and the retention ponds would be reviewed as part of the commercial site plan review process. Commissioner Peterson asked for background on the clock tower. Community Development Director Carlberg explained the original design was for a stand -alone clock tower and landscape features on the corner and the developer is now requesting to incorporate the clock tower into the building and alternative landscaping along the corner that will incorporate the pond, a trail, and benches. Mr. Carlberg noted that at a March 25, 2014 worksession the City Council was supportive of these changes. Commissioner Peterson asked if there would be any changes to the trail along Crosstown Boulevard or Hanson Boulevard. Community Development Director Carlberg stated there was no intention to move the trail and the right -of -way was already established. Commissioner Peterson clarified the building along Crosstown Boulevard would be accessed from the parking lot and not the street. He asked to see a rendering of the building. Chairperson Holthus asked what the impacts would be if the building met all the setbacks. Community Development Director Carlberg explained this would impact the parking lot and the amount of parking would not meet the City's parking requirements. The availability of parking was a consideration when reducing the number of proposed buildings from three (3) to two (2). Chairperson Holthus asked who would be responsible for maintaining the southwest corner wetland area. Community Development Director Carlberg explained the landowners would continue to maintain this area along with any additional landscaping done for the project. Commissioner Peterson asked what changes were proposed for the drive -thru at The Bean. Community Development Director Carlberg explained the current drive -thru requires drivers to circle the entire building. The proposed changes would make this a more user friendly access and it would not affect delivery trucks or other traffic circulation in the parking lot. Motion by Commissioner Koehler, seconded by Commissioner Peterson, to open the public hearing at 8:34 p,m. Motion carried on a 5 -ayes, 0 -nays, 2- absent (Daninger, Gudmundson) vote. Regular Andover Planning and Zoning Commission Meeting Minutes — July 8, 2014 Page 8 Mr. Darren Lazan, representing the Andover Clocktower Commons Development, provided the Planning Commission with an overview of the project and all proposed changes. He also stated the amended CUP should reflect the additional access point off Crosstown Boulevard that had been constructed. Mr. Tom Roberts, 11015 Bell Oaks Rd, Eden Prairie, explained the type of building that could be constructed on Lot 4 and that it could change based on the type of business going into the building. The corner of Lot 4 would be set up to look like a park with a trail that allows pedestrians and bikers to cut through without going to the intersection of Hanson and Crosstown. They would like to incorporate an electronic sign into the clock tower that would allow for advertising by the tenants so that they do not have to allow the roll away temporary signage. Commissioner Cleven asked if the back elevation of the building would be facing Crosstown Boulevard. Mr. Lazan stated the back elevation would contain glass emergency /fire access doors to enhance the look of the building and it would face Crosstown Boulevard. Commissioner Nemeth asked if the current structures would be refurbished to match the new buildings. Mr. Lazan explained they would be using the same color palate and materials to construct the new buildings but they would not be refurbishing the current structures. Commissioner Peterson asked why a drive -thru was being requested when they did not have a tenant identified for the building yet. Mr. Lazan explained they had a drive -thru approved for the other parcels and would like to have this option available when a tenant is identified. Commissioner Peterson stated the previous landscape plan had more trees and landscaping. He asked if there were other features that could be added to the current proposal. Mr. Lazan explained the original landscape plan included several trees that have since been removed because they were either diseased or damaged and they would not be able to add any features to the pond since it was an infiltration pond and considered a "dry" pond. Commissioner Koehler complimented the design. He asked if the developers had talked to the current tenants about the use of a digital sign versus a monument sign. Mr. Lazan stated they talked to the current tenants but felt this was a way for them to advertise their location and any specials they may have. Commissioner Peterson asked what the benefit would be for the City by approving these amendments. Mr. Lazan explained the landscaping features would improve the overall look of the corner, the trail would move pedestrian and bike traffic away from the corner and the development would build overall excitement to potential tenants to be in Andover. r Regular Andover Planning and Zoning Commission Meeting Minutes —July 8, 2014 Page 9 Chairperson Holthus asked if the pond would be mowed since it was considered a "dry" pond and where the monument sign would be located. Mr. Lazan explained it would continue to be maintained and it would look similar to the pond owned by the City across the road and the monument sign would be located in front of the pond, closer to the corner. Motion by Commissioner Koehler, seconded by Commissioner Nemeth, to close the public hearing at 9:03 p.m. Motion carried on a 5 -ayes, 0 -nays, 2- absent (Daninger, Gudmundson) vote. Commissioner Koehler asked why the setbacks were in the City Code. Community Development Director Carlberg stated this was to allow for landscape features and trail along the roadway in addition to creating separation from buildings and the roadway. Motion by Commissioner Koehler, seconded by Commissioner Nemeth, to recommend to the City Council approval of request by BDT Holdings, LLC and BDT Land, LLC, to amend the existing approved Conditional Use Permit (CUP) to revise the approved Planned Unit Development (PUD) on Lots 3 -5, Block 1, Andover Clocktower Commons. Community Development Director Carlberg stated that this item would be before the Council at the July 15, 2014 City Council meeting. OTHER BUSINESS. Community Development Director Carlberg stated the City Council had approved the variance request on Aztec Street for the 8 -foot fence as recommended by the Planning Commission at their June meeting. He asked the Planning Commission if they would like to change the August 12 meeting due to the primary election being held that day. They could either meet at 8:01 p.m. or change the night of the meeting to August 11 at 7:00 p.m. It was the consensus of the Planning Commission to change the August 12, 2014 regular meeting to Monday, August 11, 2014 at 7:00 p.m. Commissioner Nemeth asked if there was anyone interested in the property on the corner of Bunker Lake Boulevard and Hanson Boulevard and also with the old "Tom Thumb" property up on 7`h Avenue. Community Development Director Carlberg stated there was interest in the property on Bunker Lake Boulevard and an agent was marketing the old "Tom Thumb" property. Community Development Director Carlberg stated the trail was lower than the property in one area and the Developers would like the City to participate in raising this section. Hanson, City Planner SUBJECT: PUBLIC HEARING: Preliminary Plat/Planned Unit Development (PUD) known as Carson Ridge, a single - family urban residential development located at14123 Prairie Road NW. DATE: August 11, 2014 INTRODUCTION The Planning and Zoning Commission is asked to review the preliminary plat/PUD for Carson Ridge. The plat contains 18 -urban lots as proposed by TH Construction of Anoka. DISCUSSION Conformance with Local and Regional Plans and Ordinances 1. The property is located within the 2020 Metropolitan Urban Service Area (MUSA). The Andover Comprehensive Plan allows for the parcels to develop into urban lots at a density of 1.75 to 3.6 single family homes per acre. A PUD allows a maximum density of 4 single family homes per acre. The density of the proposed plat is 1.80 single family homes per acre. 2. The property is zoned Single Family Rural Residential (R -1). A rezoning to Single Family Urban Residential (R -4) is required for the project to move forward. 3. The proposed project requires a PUD review to establish standards unique to this development. The Planning and Zoning Commission is asked to review the proposed PUD based on City Code 13 -3, Planned Unit Development. Access Access will be provided from Ilex St NW as shown on the plat. If future development occurs to the north, the development will gain access to Prairie Rd NW. Utilities Trunk sewer and water lines are located south of the land within the Shadowbrook development and will be available to extend to this development. Floodplain and Wetlands A significant amount of floodplain exists along the eastern side of the property. The wetland delineation has been completed. The full report has been submitted as part of the preliminary plat. Coon Creek Watershed District (CCWD) The CCWD has reviewed and approved the grading plan, hydrology calculations and soils report. Coordination with other Agencies The developer and /or owner are responsible to obtain all necessary permits (Minnesota Department of Natural Resources, U.S. Army Corp of Engineers, Coon Creek Watershed District, Minnesota Pollution Control Agency, LGU and any other agency that may have an interest in the site). Planning and Zoning Commission and City Council Sketch Plan Review Meeting minutes are attached for your review from the November 12, 2013 Planning and Zoning Commission meeting and the November 19, 2013 City Council meeting. Park and Recreation Commission The Park and Recreation Commission reviewed the sketch plan at their November 7, 2013 meeting. The Commission recommended cash in lieu of land dedication. The Commission will also review the preliminary plat on August 21, 2014. Trail System A 20 foot trail easement has been identified at the western end of the 1415L Avenue NW cul -de- sac, between Lots 8 and 9, Block 1. This trail will link to the trail system along Prairie Road. The developer is responsible for the paving of the trail which will be installed along with the street and utility construction. Planned Unit Development (PUD) Review Applicable Ordinances City Code 13 -3 -9 regulates the findings that are required for a PUD to be approved: 1. The proposed development is not in conflict with the goals of the Comprehensive Plan of the City. 2. The proposed development is designed in such a manner as to form a desirable and unified environment within its own boundaries. 3. Provides a tree line buffer between backyards of back -to -back lots. D. Preserves existing stands of trees and /or significant trees and provides additional tree plantings. E. The proposed structures within the development demonstrate quality architectural design and the use of high quality building materials for unique design and detailing. Homes The two housing styles, ranch -style and two- story, and color - schemes are proposed as shown in the attached Building Elevations. The homes provide a substantial amount of stone on the front elevation as well as maintenance free siding, hardy board, vinyl shakes and columns at the entrances of each structure. The homes will also have a three stall attached garage. The home styles will minimize the distance from the front of the garage to the front of the home. 91 iij Tree Preservation Plan The attached Tree Plan illustrates trees to be preserved, tree removals and additional tree plantings. The developer is preserving as many existing trees possible to provide a buffer between neighboring properties and to provide a screening from Prairie Road. Tree removal will occur in grading/drainage areas, building pads and for the construction of streets and utilities. Additional tree plantings will occur on the two corners lots of Ilex Street and 141St Avenue and along the northern property boundary to provide additional screening from the rural property to the north. These plantings may not impede the intersection site triangle area within 15 feet from the intersecting street right of way lines. Staff Recommendation As part of the platting process, the property will need to be rezoned to R4- Single Family Urban. Typically a rezoning public hearing is held prior to the preliminary plat public hearing. In this instance, a public hearing notice was not published because of staff oversight. Therefore, staff recommends the Commission hold the public hearing for the preliminary plat/PUD request this evening and then table the item until the August 26, 2014 Planning and Zoning Commission meeting. At the next meeting, it is recommended the public hearing be continued and then the Commission makes a recommendation to City Council. City Planner Hanson noted the purpose of this item is to hold a public hearing and take input on a Sketch Plan for an eighteen (18) lot urban residential development located at 14123 Prairie Road NW, as requested by TH Construction. City Planner Hanson reviewed the proposed sketch plan with the Commission. Commissioner Holthus asked if the existing residence on Lot 1, Block 1 will stay. Ms. Hanson indicated it would. Commissioner Gudmundson asked north of the ghost plat, if this has been coordinated with this development. Ms. Hanson indicated it will not be as the Catcher's Creek project is north of Coon Creek.. Commissioner Peterson asked if Prairie Road will be reconstructed. Mr. Carlberg was not sure of the reconstruction schedule for Prairie Road but indicated there is no access plan for this development onto Prairie Road. Commissioner Holthus stated since Prairie Road is a collector street and State Aid road, does the State have any criteria as to how many side streets can have access to it. Mr. Carlberg stated they try to limit the number of accesses onto Prairie Road. Motion by Nemeth, seconded by Koehler, to open the public hearing at 7:57 p.m. Motion carried on a 6 -ayes, 0 -nays, 0- present, 1- absent (Cleven) vote. Ms. Pixie Stockal, 601 140`i' Lane NW, stated her concern with this project is that all of the traffic will come onto 140"' Lane and she wondered if there was a way they could do something so there is one egress into that development from Prairie Road because there will be a lot of traffic and there are currently a lot of children there. Mr. Carlberg stated there is a ghost plat and future development will warrant a future access onto Prairie Road and 1401h does have capacity for additional traffic. Ms. Stockal asked if there was a way to slow the traffic down. Chairperson Daninger stated if there is an issue with speeding, the residents can contact the Sheriff's Department. Ms. Stockal wondered what will happen to the existing buildings on the property if this is developed. Mr. Carlberg indicated the applicant can address the question. Mr. Mark Madden, 14122 Prairie Road, stated he likes the sketch plan but his only concern is the fencing along Prairie Road. His concern will be with the new houses in this development will put up fencing that will look bad. Mr. Carlberg reviewed the City Ordinance with the Commission. He noted the problem is that there is no uniform fencing regulations so as long as the fence is maintained, any type of fence can be installed. He stated this has been a concern of the look of the community. Mx. Todd Wold, 463 1401h Lane, asked if the developer is connected with the original Shadowbrook development. He was concerned because of the covenants in the existing development and if they will continue into this development. Mr. Ed Gritton, 14157 Prairie Road, stated he lived next to this property and one of his concerns is they own some horses and with the lot lines butting up to his lot line, what is he to anticipate with future homeowners and his horses, what will he be faced with. He wondered how he will be protected. Mr. Carlberg stated they have ordinances regarding keeping horses that also covers the manure management responsibilities of the horse owners that Mr. Gritton would have to comply with. Mr. Griffon stated the concern is the additional cost he may have to incur with manure maintenance. Mr. Carlberg stated if there will be an area where manure will be stored on the property he suggested moving it to the north or east on the property. Mr-. Tony Hennen, 617 Main Street, Anoka, applicant, reviewed with the Commission the price point of homes he builds. Chairperson Daninger noted the covenants will be different than Shadowbrook because it is a different development. Commissioner Holthus asked if the existing home will remain, will it be reversed or what will happen. Mr. Hennen stated the house will stay as it is with the driveway coming off Prairie Road, it will be hooked up to City sewer and water, and the other buildings will be removed. Commissioner Peterson asked if the existing house is removed in the future and a new home is constructed, would there be enough frontage area off the cul -de -sac to build a new structure. Mr. Carlberg indicated there would be enough frontage on that site to build a new home. Commissioner Gudmundson asked if there will be covenants or restrictions on the development. Mr. Hennen indicated there will be covenants put in place but it will not be a continuation of the Shadowbrook development. Chairperson Daninger asked if a fence will be placed on the existing home facing Prairie Road. Mr. Hennen indicated that will be the front of the home so a tall fence cannot be placed along Prairie Road. Chairperson Daninger indicated this issue was seen City wide but thought Mr. Madden may want to meet with City staff to discuss it further. Mr. Jerry Stockel, 601 140'h Lane, asked if they will be notified by mail for the next meeting. Mr. Carlberg stated this will go before the City Council on November 19a' but future meetings will have public notifications. Mr. Wold wondered how quickly the developer plans on moving forward with this project. Chairperson Daninger thought the applicant would want to start as soon as this project is approved. SKETCH PLAN REVIEW — 18 LOT SINGLE FAMILY URBAN RESIDENTIAL DEVELOPMENT —14123 PRAIRIE ROAD NW— TH CONSTRUCTION Mr. Carlberg stated the City Council is asked to review a residential sketch plan for an 18 -lot single family urban residential development as requested by Mr. Tony Hennen of TH Construction. Mr. Carlberg reviewed the staff report with the Council. Mayor Gamache asked if Plan B would place the homes closer to the front of the lot and not the back. Mr. Carlberg stated the standard 35 foot front yard setback could be maintained with this plan. They would be losing three feet off the back of the yard. Mayor Gamache stated the back yards will be backing up to another back yard and because it is only three feet, he wondered if it is better to move the house forward three feet because the entire neighborhood will be that way rather than shortening the back yard. Councilmember Trude stated that would require a PUD because it is a lot of variances. She did not know if they wanted to lower the community standard that much. Councilmember Trude thought the sketch plan is trying to get too much into a little amount of land. She wondered if this developer could try to purchase land from adjacent property owners. Mr. Carlberg stated the developer has met with the adjoining property owner and they have not come to an agreement for purchase. Mr. Carlberg stated there are a couple of options to be looked at. One is to grant variances, another is to look at doing a PUD with options of landscaping or berming and enhanced design standards. The City Council and staff reviewed options for the sketch plan to see what could possibly be done to improve the development without granting variances. Mayor Gamache asked if it requires this development to be a PUD because of the variances. Mr. Carlberg indicated it did not, the lots can be granted a depth of a three -foot variance in the back yard and when they come to preluninary plat, the lots will be listed with a three -foot variance. These are buildable lots but they are not able to gain the necessary property to meet the minimum lot depth requirements. Regular Andover City Council Meeting Minutes —November 19, 2013 Page 5 Councilmember Trude thought it was an economic reason and stated this could be a development that met all of the City's requirements if it were not for the eight additional lots. Mr. Carlberg stated the Council could require this to be a PUD and ask the developer for berming or landscaping as a part of it. Councilmember Trude thought by doing a PUD, a precedent would not be set. She stated three feet could be quite a difference in a backyard when they abut homes. She thought this was imposing a lot on the existing neighborhood. Councilmember Howard stated he would be comfortable with the developer doing this if Lots 8 and 9 were shifted a little bit to give the lots more than the required buildable space because then they get something for letting the lots be little bit shorter. He indicated he is still comfortable with the project. Councilmember Howard thought the lots lines could be pushed to the west to allow more space for the internal lots. Councilmember Knight wondered if Lots 10 -14 were elongated east to west would that help. Mayor Gamache thought that would take care of just one side of the road. Mr. Carlberg noted the only thing that could be done would be to shift the road and either make one side comply and the other side a greater deviation or variance. But, bigger lots cannot be created by pushing them east or west, the problem is with north and south. Councilmember Howard stated there is the opportunity to go wider with the house rather than deeper. Mr. Carlberg agreed but noted it would not meet the lot depth minimum. He explained the lots need depth because they do not meet the 130 feet. They meet the buildability requirements, the width and the area because they went a little wider to make up for the deviation in depth; the only deviation is the three -foot depth. Councilmember Trude thought seventy-five percent of the lots need some kind of a variance and there should be some amenity or something similar to a PUD. Otherwise, the City standards will mean nothing and she is concerned about that. Mayor Gamache stated he would be fine with the front being moved forward because they have always pushed the front yards back more than other cities. He thought in order to make it fit the neighborhood behind this development, they need to make the back yard the proper size. Mr. Carlberg thought it sounded like a PUD was the right way to go to make this fit into the neighborhood but the question would be, what is the benefit to the City by allowing the deviation or new standard. Councilmember Trude thought this needed to go PUD because if the requirements for a variance were looked at they could not justify that it was not economic. She thought Mayor Gamache had some points that would be acceptable to people who five in the area and increasing the density of plantings would make it match some of the neighboring properties. In addition, maybe they look at the fence issue that was brought up at the Planning Commission meeting. She is also Regular Andover City Council Meeting Minutes— November 19, 2013 Page 6 concerned with the trail connection taking out a lot of trees. She thought this should go back to the drawing board. Councilmember Knight agreed. Councilmember Howard indicated this should likely be a PUD with some amenities given to the City. Mayor Gamache stated there was discussion about a trail that runs along the creek. Councilmember Trude stated the trail makes a nice walking loop for people in the area and she would hate to see trees lost because of the trail but thought the developer could come back with a PUD with additional plantings and preserve the space in the back yard with the existing homes. Mr. Hennen indicated he would review his options based on the Council input. NAMING OF 40 ACRE SPORTS COMPLEX/3535 —161sT AVENUE NfK /12 -31 Mr. BBrkowitz stated the City Council is requested to approve the naming of the 40 Acre Sports Mr. Berkowitz'xeviewed the staff report with the Council. Mayor Gamache tho ht one of the things they lack in the City is a tie to the history of the City. He thought it was impo ant they begin to look at this. He stated the land was previously owned by Mr. Royce Bennett and . ey should seriously think about tying back to some of the people that started this City when it was 0 ow Township, going back and bringing some of those names into the places now being used. Councilmember Tiede stated she liked'the Park Commission's idea of using the name of the family that owned the land on the trail thr6 gh the woods or one of the fields but when it comes down to it, it is hard to find where the field `s She thought the idea of the suggested name "Pine Hills North" was a good name. Councilmember Knight stated he liked the name "Veteran's Memorial." Councilmember Trude thought there were plans to put a park on Veterans Memo ial Boulevard. Councilmember Howard liked tying back to tradition. \ The City Council felt this item should be discussed when al\the, ci lmembers are at the meeting. Mx. Dickinson indicated staff would bring the topic back at the second co cil meeting in January. SITE CONDITION AND LOCATION The property borders Prairie Road on the west, the residential subdivision of Shadowbrook on the south, a rural home site to the north and wetlands /Coon Creek to the east. It is the Southwest Quarter of Section 25, Twp. 32, R25. It contains an existing home on outbuildings along Prairie Road. The existing home will remain and the outbuilding will be removed. Vehicle Access to the newly developed lots will be from Ilex Street NW, which was stubbed in along with sewer and water connections for this project during the Shadow Brook development. Vehicles will come into the site from Prairie Road by turning off on Juniper Street, and taking 140`h Lane NW to Ilex Street NW. D. ZONING The property is currently zoned as R- 1Single Family Rural. Property to the south and west is zoned as R4 — Single Family Urban and to the north is R -1, Single Family Rural. The proposed zoning is R -4 Single Family Urban/PUD. E. DEVELOPMENT STANDARDS The setbacks and standards proposed are the same as the R4 District except the front yard setback will be 30 feet instead of 35 feet. The corner Lot street setback will be 25 feet instead of 35 feet also. The home styles will be such to minimize the distance from the front of the garage to the fi•ont of the home. This will increase the distance from the real lot line to the rear of the home. The street was built so that lots abutting Prairie Road would be served and connected to 141St Avenue NW backing now or in the future to Prairie Road. F. LANDSCAPING The wooded areas on the west side of the project around the existing home, the south line of the property and wherever possible will be preserved. Trees will be planted as per species and location per the attached Attachment A. G. HOME DESIGN STANDARDS The homes built in this development will be enhanced architecturally to provide an aesthetically pleasing environment for its residents.
