Hanson, City Planner Ga SUBJECT: Approval of Minutes — April 8, 2014 DATE: May 27, 2014 REQUEST The Planning and Zoning Commission is requested to approve the minutes from the April 8, 2014 regularly scheduled meeting. PLANNING AND ZONING COMMISSION MEETING —APRIL 8, 2014 The Regular Bi- Monthly Meeting of the Andover Planning and Zoning Commission was called to order by Chairperson Holthus on April 8, 2014, 7:00 p.m., at the Andover City Hall, 1685 Crosstown Boulevard NW, Andover, Minnesota. Commissioners present: Chairperson Holthus, Commissioners Timothy Cleven, Dean Daninger, Lynae Gudmundson, Bert Koehler IV, Kyle Nemeth and Steve Peterson. Commissioners absent: None. Also present Community Development Director Dave Carlberg City Planner Stephanie Hanson Others APPROVAL OF MINUTES. March 11, 2014 Workshop Meeting Commissioner Nemeth stated on page three, paragraph nine he would like the sentence changed: "Commissioner Daninger asked if the items that were stricken previously were the changed..." Commissioner Koehler stated on page three, last paragraph, his name is misspelled. Motion by Daninger, seconded by Koehler, to approve the minutes as revised. Motion carried on a 6 -ayes, 0 -nays, 2- present (Gudmundson, Peterson), 0- absent vote. March 11, 2014 Regular Meeting Commissioner Nemeth stated on page two, seventh paragraph, second sentence from the bottom, it should read: "...there is only a stop sign... "; page three, second paragraph a comma should be added after 152nd Lane NW. Commissioner Nemeth noted on page three, fourth paragraph, second sentence towards the end should read: "...they will have a typical type of homes..."; Ninth paragraph Regular Andover Planning and Zoning Commission Meeting Minutes — April 8, 2014 Page 2 down, second sentence towards the end should read: "Council left that open as an option and they did not want to make a commitment either way." Commissioner Nemeth also made correction on page four, seventh paragraph starting with Commissioner Daninger, the second sentence, an "s" should be added after "cul -de- sac" and the third to the last sentence that states "extending Lots 54, 55, 56 to go to the back to the property line "; and on the last sentence change "speaker" to "resident." Page four, tenth paragraph where he asked the letter from the four neighbors." Motion by Daninger, seconded by Nemeth, to approve the minutes as revised. Motion carried on a 6 -ayes, 0 -nays, 1- present (Peterson), 0- absent vote. PUBLIC HEARING: Conditional Use Permit — Mining — Mark Smith — Butternut Street NW and Andover Boulevard NW. City Planner Hanson noted the purpose of this item is to hold a public hearing and take input on a Conditional Use Permit for mining located at Butternut Street NW and Andover Boulevard NW. City Planner Hanson stated Mr. Smith is proposing to borrow (mine) up to 65,000 cubic yards or materials from the properties he owns along Andover Boulevard NW and Butternut Street NW. The materials will then be transported and used on the Catcher's Creek residential development site located at the SE corner of Prairie Road NW and Andover Boulevard NW, City Code 12 -12 requires a conditional use permit for mining of more than 400 cubic yards of materials on a property. City Planner Hanson reviewed the proposed Conditional Use Permit with the Commission. Commissioner Daninger asked for clarification on this item. This was brought to the City's attention for 110,000 cubic yards but that did not go through the process, nothing was approved. Ms. Hanson indicated that was correct. Commissioner Cleven asked if the archeologist would identify the beginning twenty -foot area from the mound. Ms. Hanson stated that was correct, he would identify the boundaries of the mound. Chairperson Holthus asked at what elevation point the mound would begin. Ms. Hanson stated they did not know that and it will be something the archeologist will determine. Commissioner Nemeth asked if they approved this, it is determined it is a burial mound, and Mr. Smith spikes out the twenty feet, will this be made a condition that no excavation will be done within twenty feet of the mound as a part of the approval. Ms. Hanson stated at this point, it is not part of the grading plan and it will be determined once the plan is submitted or once it is submitted for a residential development. Regular Andover Planning and Zoning Commission Meeting Minutes —April 8, 2014 Page 3 Motion by Daninger, seconded by Gudmundson, to open the public hearing at 7:15 p.m. Motion carried on a 7 -ayes, 0 -nays, 0- absent vote. Mr. Mike O'Donnell, 14195 Alder Street NW, asked if the geological report is the same as an environmental impact study and if not, is one required. Mr. Carlberg stated the geological report and soil borings are not an environmental assessment worksheet or environmental impact statement. Staff can look at that prior to Council approval but he believed the amount of fill being removed is below the threshold for environmental review. Mr. O'Donnell asked if the material being removed is the beginning of a housing project going in there. Chairperson Holthus did not think there were any plans so far to create a development within the mining area. Mr. Carlberg stated eventually the area can be served with City sewer and water and will be developed; however, at this time, Mr. Smith is just borrowing the dirt, or removing the dirt for another project in the area. Mr. O'Donnell asked if there will be another meeting pertaining to that. Mr. Carlberg indicated there would be. Mr. O'Donnell asked what the impact on home value would be if this item were to be approved. Mr. Carlberg thought this was something the assessor or the County could address. Mr. Chet Hapka, 67 142nd Avenue NW, stated their house overlooks the area being discussed and he has some concerns about the possibility of the land being developed for housing. He thought ifthey were going to take down some vegetation, there would be some environmental concerns. Also, because it is a steep hill, a lot of soil will wash into Coon Creek if the land is cleared and there is a big downpour. This would most likely plug the creek and the whole wetland could be easily flooded. He suggested this be looked at carefully. Mr. Hapka stated with the homes on his side of the creek, there would be a buffer of some of the trees left and the trees are now gone. He was disturbed why a buffer of trees was not left along the creek. He noted there will be a lot of dust and dirt blowing around once the land is cut up and there will be a good deal of erosion and wash down. Mr. Dan Gunderson, 40 Andover Boulevard NE, Ham Lake, stated he was directly east of the property being discussed. He asked on the topographical map, if the silt fence going along the northeast corner, the low swale area, will be filled. If that is going to be left alone, it will not be a problem for him. He noted it is very low in that area. His other concern is if this is a two -fold purpose. He assumed the land is not buildable in its present form so he wondered if it will be flattened out for future houses and to fill some other land. He also thought the Planning Commission should be made aware that when the mound is reviewed, he will be pointing out the other mound on his property. He stated the mound is probably far enough away from the mining area, but should be noted. Mr. O'Donnell wondered where the location is of the burial mound. Mr. Carlberg stated the mound is a couple hundred feet from the creek. Mr. O'Donnell did not think excavation needed to be done between the mound and the creek. Mr. Carlberg stated the mining operations will not be close to the mound or creek so the comments related to drainage concerns and erosion into the creek will not be of concern. Mr. O'Donnell asked why all the trees have been removed. Chairperson Holthus thought that would be a question for the developer. Mr. David Pipp, 50 139`h Avenue NW, stated he is a board member for Cove Conservancy LLC, which owns some of the land off to the side of the area being discussed. Their biggest concern is making sure the property is not going to create a runoff problem that will plug up the creek and run off onto their property. He wondered if there are any assurance, bonds, etc., that will assure the runoff will not affect their property. Chairperson Holthus indicated the City Council will review this and the Conservancy could appear at that meeting. Mr. Pipp asked if they will receive an additional notice for additional meetings so they can attend. Mr. Carlberg indicated this is the public hearing meeting for the mining operation so there will not be any more notifications. There are a number of conditions that will have to be met before approval is given. Mr. O'Donnell asked if all the other conditions have to be made and if all of the requirements are not in yet for review or discussion, why were they even allowed to begin. Chairperson Holthus did not think the mining process had begun. Ms. Hanson indicated the grading on the site will not happen until all permits have been approved by the MPCA and the Watershed District. Mr. Carlberg noted the City does not control people's property rights to remove trees prior to getting involved in a development process of a plat or an application for that. Every property owner has the right to log on their property but once the property owner makes application to develop the property, they cannot remove trees anymore. Mr. O'Donnell asked if the property owner can grade the hill to get out the stumps. Mr. Carlberg stated as part of the approval process, they have to establish erosion control of the property. The site will be defined with limits that will prevent the concerns about erosion into the creek and those types of issues. He noted this is the first step and will go through many reviews. Motion by Koehler, seconded by Cleven, to close the public hearing at 7:38 p.m. Motion carried on a 7 -ayes, 0 -nays, 0- absent vote. Regular Andover Planning and Zoning Commission Meeting Minutes — April 8, 2014 Page 5 Mr. Mark Smith, 2120 Otter Lake Drive, Lino Lakes, was at the meeting to answer questions. Mr. Smith stated the grading will all be done within the designated area and the fencing will protect the possibility of erosion and drainage to other areas including the creek. He stated someday this site will have homes on it. Mr. Smith reviewed the site plan with the Commission and residents. Commissioner Gudmundson asked where the houses are located at that are staying on Butternut. Mr. Smith showed on the map the area where the houses will not be removed. Commissioner Cleven asked once mining is completed, will seeding be done for soil erosion control. Mr. Smith stated they will seed the site once they are done. Commissioner Koehler asked, in terms of dirt control, could the area be watered at the end of the day to reduce the possibility of dirt being kicked up overnight. Mr. Smith stated he would work with the excavator to see what could be done to reduce the issues. Commissioner Nemeth asked in regard to traffic, did Mr. Smith know how many trucks will be going in and out on a typical day. Mr. Smith did not think it would be very many trucks, possibly four or five trucks maximum each day going back and forth. Commissioner Nemeth asked what the timeframe would be on this. Mr. Smith stated they would start in June and hoped to be done by the fall. Commissioner Peterson asked as far as the work being done, will it be weekdays only. Mr. Smith stated there may be some Saturday half days with weekday hours until five or six P.M. Commissioner Peterson asked, as far as the remaining trees, will those be removed. Mr. Smith stated no trees will be affected in the area they will be mining as they have been removed. Commissioner Daninger suggested putting in the resolution some kind of time limit. He also asked if Mr. Smith was going to sweep the streets or if the City will. Mr. Smith stated they planned on sweeping the streets every day. Chairperson Holthus asked why the amount is being reduced from the initial request. Mr. Carlberg stated there were discussions regarding what is needed to develop the Catchers Creek project to the west, which was figured to be 65,000 cubic yards so city staff suggested limiting the amount and also takes it out of the area of the potential burial mound and away from the creek. Regular Andover Planning and Zoning Commission Meeting Minutes — April 8, 2014 Page 6 Chairperson Holthus asked if there were seasonal weight restrictions on Andover Boulevard. Mr. Smith stated there are weight restrictions that should be lifted by June. Commissioner Gudmundson asked where the rest of the fill will come from if only 65,000 cubic yards will be removed. Mr. Smith stated he will probably come back with a site plan showing housing instead of just a mining plan. Commissioner Gudmundson asked if it is determined that the mound is a burial site, could there be other requirements. Ms. Hanson stated the requirement is the twenty -foot buffer around the mound. Ms. Hanson noted the Coon Creek Watershed District will put a time on when it needs to be reestablished with vegetation, which will typically be December 1, 2014. Mr. Carlberg thought hours of operation should be considered. Motion by Koehler, seconded by Cleven, to recommend to the City Council approval of the proposed Conditional Use Permit for mining located at Butternut Street NW and Andover Boulevard NW, contingent on: 1. The geotechnical report shall include the seasonal high water mark for each boring and boring locations shall be shown on the grading plan. 2. Hydrology report shall be submitted identifying the existing drainage area and discharge rates and the proposed drainage areas and post drainage discharge rates. 3. Hours of operation shall be 7:00 a.m. to 6:00 p.m., M -F; 5:00 a.m. to 1:00 pm on Saturday and no dirt removal on Sunday. 4. Deadline to finish by December 1, 2014 or when the Coon Creek Watershed District advises it shall be done. Motion carried on a 7 -ayes, 0 -nays, 0- absent vote. City Planner Hanson stated that this item would be before the Council at the April 15, 2014 City Council meeting. PUBLIC HEARING: Consider Amendments to the City Code 12 -2 -2, Definitions; 12- 12, Permitted, Conditional and Prohibited Uses and 12 -14, Administration and Enforcement. Community Development Director Carlberg noted the purpose of this item is to hold a public hearing and take input on proposed Amendments to the City Code 12 -2 -2, Definitions; 12 -12, Permitted, Conditional and Prohibited Uses and 12 -14, Administration and Enforcement. Community Development Director Carlberg reviewed the proposed amendments to the City Code 12 -2 -2 with the Commission. Regular Andover Planning and Zoning Commission Meeting Minutes —April 8, 2014 Page 7 Chairperson Holthus stated at the very end of the residential, there are twelve points listed and she wondered if there should be a heading above them mentioning what they are. Mr. Carlberg indicated those are footnotes and staff could mark those as notes. Commissioner Peterson referenced the interim use permit section, termination language, item three, change in the City's zoning regulations; and asked if the language is specific enough to warrant a termination of an interim use. Mr. Carlberg stated there are two scenarios that could happen; an interim use that becomes a permitted use or the use could be prohibited specifically and if someone had an interim use in place, the permit would be voided. Commissioner Peterson wondered if the language should be changed to read: "a change in the City's zoning regulation that impacts the use." Commissioner Koehler stated to be very clear, they cannot approve an interim use permit that goes beyond five years. Mr. Carlberg indicated that was correct. Commissioner Peterson suggested under item three, the wording be changed to: "a change in the City's zoning regulations that impacts the current usage." Commissioner Koehler disagreed. Commissioner Daninger stated his concern is how they would define "impact." Commissioner Cleven stated if they changed the wording to "a change in the City's zoning regulations that is relative to the interim...," if it is anything that has to do with the interim, he agreed. Commissioner Koehler stated he disagreed because what happens if the change is relative but actually expands the person's rights within the permit. He wondered if they are going to terminate the residents permit because the City gave them more rights. Commissioner Cleven stated it is a change and that is what it is saying "if there is any change then it terminates it." Commissioner Koehler disagreed. Commissioner Cleven stated anything that is relative to the process to the interim should be included. Commissioner Koehler thought the City may be terminating someone's interim use permit when the intention was to expand it. Commissioner Peterson stated as it is written now, you could have something that is totally unrelated to the interim use and the fact that a zoning regulation has changed in any way could be a setback. If read, as is, any change terminates the interim use. There was discussion between the Commission members regarding the verbiage of Interim Use. Chairperson Holthus wondered if the following wording would work: "A change in the City's zoning regulations that relates to the current interim use." Commissioner Gudmundson wondered if wording could be changed to: "a change in the zoning regulation for that particular property." Commissioner Koehler suggested adding: "a change in the City's zoning regulations and notification to the permit holder." He wondered if that was a way to get around it. He stated the intent is if it is affecting the use, whether it be permitting it or excluding it, then it affects the permit. Commissioner Cleven stated the way it is written now, there will be a change in the zoning regulation and no longer are any interim permits in the City valid. Commissioner Koehler asked if they could add the verbiage "upon City approval" to make the issue go away. Mr. Carlberg suggested the wording to say: "A change in the city's zoning regulations that permits or excludes the use." Commissioner Cleven thought the wording was too broad and people who do not want something to happen in the City will find something to stop an interim use. Commissioner Nemeth agreed with Chairperson Holthus' wording as stated earlier because that makes the most sense to him. Motion by Nemeth, seconded by Daninger, to open the public hearing at 8:30 p.m. Motion carried on a 7 -ayes, 0 -nays, 0- absent vote. There was no public input. Motion by Daninger, seconded by Nemeth, to close the public hearing at 8:30 p.m. Motion carried on a 7 -ayes, 0 -nays, 0- absent vote. Commissioner Nemeth stated when they discussed this at the workshop last month, one of the items mentioned was to repeal the 12 -12 quote and he wondered if they had to first repeal that before a motion could be made. Mr. Carlberg stated they are working with the City Attorney on that issue so at the City Council meeting, they may repeal 12 -12 and this verbiage will be put in its place. Motion by Nemeth, seconded by Gudmundson, to recommend to the City Council approval of the amendment to City Code 12 -2 -2 definitions along with the conditional and prohibited uses of 12 -14 and making a change under the termination part to include under number three, "A change in the city's zoning regulations that relates to the current interim use." Commissioner Koehler stated he did not agree with this because they may be canceling someone's permit when the change in zoning regulations approved by the City Council was meant to help, not remove their permit. He stated it removes the ability from the City Council and Zoning Commission to actually enforce the laws with a little bit of common sense instead of an automatic termination of someone's permit because they made a change in an attempt to assist them. He stated the language means that the City has to terminate the permit even if a change is made in the regulation to help them. Regular Andover Planning and Zoning Commission Meeting Minutes — April 8, 2014 Page 9 Commissioner Peterson thought it did the same before but he wondered if Commissioner Koehler had different language. Commissioner Koehler indicated he did but was not going to make a motion on this yet. His intention was to return common sense to the City Council and Zoning Commission by simply stating the following: "A change in the City's zoning regulations and with City Council notification to the permit holder" Commissioner Nemeth thought that would be a lot of work for the City Council. He thought even if it benefits them, it created more paperwork for staff. Commissioner Koehler indicated he was trying to stop the automatic termination of every related permit to a zoning regulation change. Commissioner Daninger called the order to motion. Motion failed on a 3 -ayes, 4 -nays (Daninger, Holthus, Koehler, Peterson), 0- absent vote. Motion by Daninger, seconded by Koehler, to recommend to the City Council approval of item as presented. Motion failed on a 3 -ayes, 4 -nays ( Cleven, Gudmundson, Nemeth, Peterson), 0- absent vote. Motion by Peterson, seconded by Koehler, to recommend to the City Council approval of the item changing number three in section E to: "A change in the City's Zoning Regulation and with notification by the C;4y Gouneil to the holder- of termination to the interim use holder from the City." Commissioner Koehler stated he wanted to make sure it is very clear that the City Council would be required to notify the permit holder only in the instance that they wanted the permit to be nullified or revoked. Commissioner Cleven thought that wording should be included in the motion. Chairperson Holthus reviewed and amended the motion to read: "A change in the City's Zoning Regulation and with notification to the interim use holder from the City." Chairperson Holthus asked Commissioner Koehler if this wording is a friendly amendment to the original motion. Commissioner Koehler stated this is exactly what he intended to say. He liked the wording "notification from the City" rather than the City Council. There was discussion between City staff and the Commission on what the motion meant. Commissioner Gudmundson thought this would need to be clearer if it were to move forward because if the Commission does not even understand it, they cannot be putting this out there for the City to interpret. Chairperson Holthus added verbiage to the motion to read: "A change in the City's Zoning Regulation that relates to the current interim use and has been notified..." She Regular Andover Planning and Zoning Commission Meeting Minutes —April 8, 2014 Page 10 thought this needed to be discussed further for correct verbiage and indicated she would like to put this motion to a vote. Commissioner Koehler stated he was trying to change the language so that someone could not come to the City and demand that someone else's permit be terminated because there was a change in the City Zoning Regulation that related to the permit, even if the intention was not to terminate the permit. He was looking to change the verbiage to say that if they make a change to the zoning regulations, it does not automatically terminate someone's permit without them making a conscious willful decision to do so. He would like to see control lay with the City rather than the residents. Chairperson Holthus reread the proposed motion for a vote. Commissioner Koehler asked to amend the verbiage to include "and with notification of termination to the permit holder by the City." He stated this will make it clear that they are not talking about having to notify everyone that has a permit, only the ones they want to terminate. Motion failed on a 3 -ayes, 4 -nays (Daninger, Cleven, Gudmundson, Nemeth), 0- absent vote. Commissioner Peterson stated Mr. Carlberg had suggested a change in the City Zoning Regulation that either permits or excludes the interim use. Mr. Carlberg stated as he thought of that, there could be a conditional use permit change so he would suggest: "A change in the city's zoning regulations that changes the use of the property," otherwise he would suggest leaving it alone and let staff interpret it like the other cities do. Motion by Nemeth, seconded by Gudmundson, to recommend to the City Council approval of the amendments to City Code 12 -2, along with the Permitted Conditional and Prohibited Uses of 12 -14 and make a change, termination (E)(3), "A change in the city's zoning regulations that changes the uses of the property; or" Commissioner Koehler stated he has the same issue because their hands are tied and if they make a change to the property that has nothing to do with the permit, they are terminating someone's permit. Commissioner Peterson stated if it is now a permitted use, then they do not need the interim use permit any longer, it is now a permitted use. Motion carried on a 4 -ayes, 3 -nays (Daninger, Koehler, Peterson), 0- absent vote. Community Development Carlberg stated that this item would be before the Council at the April 15, 2014 City Council meeting. OTHER BUSINESS. Hanson, City Planner SUBJECT: Public Hearing: Rezoning request to change the zoning from R -1 Single Family Rural to R -4 Single Family Urban for two (2) parcels totaling forty (40) acres known as PIN'S 11- 32 -24 -43 -0001 and a portion of 11- 32 -24 -41 -0002 — Country Oaks North plat DATE: May 27, 2014 INTRODUCTION The Planning and Zoning Commission is requested to review the proposed request to rezone the parcels located directly north of Country Oaks West residential development from R -1 Single Family Rural to R -4 Single Family Urban as requested by SW Land, LLC. DISCUSSION In February 2014, the Metropolitan Council and the City of Andover City Council approved a Comprehensive Plan Amendment (CPA) that extended the Metropolitan Urban Service Area (MUSA) to service the 40 acres and changed the land use from RR -Rural Residential to URL — Urban Residential Low density. The adopted CPA allows for the parcel to develop into urban lots at a density of 1.75 to 3.6 single family homes per acre. As with all rezonings, the City must meet one of the two following findings that are provided by state statute: 1. The original zoning was in error. 2. The character of the area or times and conditions have changed to such an extent to warrant the Rezoning. Hanson, City Planner SUBJECT: PUBLIC HEARING: Preliminary Plat known as Country Oaks North, a single- family urban residential development located north of 161 st Avenue NW and Wintergreen Street NW DATE: May 27, 2014 INTRODUCTION The Planning Commission is asked to review the preliminary plat for Country Oaks North. The plat contains 64 -urban lots as proposed by SW Land, LLC. DISCUSSION Background City staff completed review #3 for the preliminary plat on May 21, 2014. Staff comments are attached for your review. On May 23, 2014, the developer resubmitted the plat for review #4. The resubmitted plat addresses staff comments and is attached for your review. City staff is currently reviewing the plat. Conformance with Local and Regional Plans and Ordinances 1. The property is located within the 2020 Metropolitan Urban Service Area (MUSA). In February 2014, the Metropolitan Council and the City of Andover City Council approved a Comprehensive Plan Amendment (CPA) that extended the Metropolitan Urban Service Area (MUSA) to service this particular 40 acres and the 40 acres located directly north. Also, the land use was changed from RR -Rural Residential to URL — Urban Residential Low. The adopted CPA allows for the parcels to develop into urban lots at a density of 1.75 to 3.6 single family homes per acre. The density of the proposed plat is 1.84 single family homes per acre. 2. The property is zoned Single Family Rural Residential (R -1). A rezoning to Single Family Urban Residential (R -4) is required for the project to move forward. Access Access will be provided from Wintergreen Street NW via 161 st Avenue NW /County Road 20. The City of Andover Transportation Plan (adopted in May 2009) depicts Wintergreen Street as a Municipal State Aid (MSA) designation and proposes a future connection to Hanson Boulevard and Ward Lake Drive. The Transportation Plan map has been attached for your review. MSA routes require a Sixty -six (66) foot right -of -way as shown on the preliminary plat. The Anoka County Highway Department is in the process of reviewing the preliminary plat; therefore staff has not received a written review letter from county staff. Utilities Trunk sewer and water lines are located south of the land within the Country Oaks West development. Lots Lots will need to meet the minimum requirements of the R -4 Zoning District. All the proposed lots exceed the minimum lot size requirements. Minimum lot size requirements are as follows: Lot size: 11,400 square feet Lot width: 80 feet Corner Lot Width: 90 feet Lot depth: 130 feet In the NE comer of the plat there is an Outlot A. Outlot A will be owned by the City of Andover. The intention of the outlet is to provide emergency vehicle access across the railroad tracks. When the property directly to north develops, an additional 20 feet by 180 feet will be provided for the emergency vehicle access point. Floodplain and Wetlands There is a minimal amount of wetlands and floodplain as part of this plat. Wetlands will be required to be delineated and the report will need to be submitted as part of the preliminary plat process. Trail System It should be noted that a trail exists on the east side of Evergreen Street. The trail will be extended to the north as part of the development. Tree Preservation As part of the sketch plan review process, City Council recommended the developer preserve the existing trees which would be used as a buffer between the urban and rural lots; in particular, the trees bordering the west and east side of the plat. As part of the preliminary plat, a tree pros ervation/l andscaping plan is required. The developer will be required to submit a detailed plan depicting areas where trees will be removed, areas where trees will be protected, and showing the type of landscape screening to be provided as a means of buffering from the railway and rural areas. The developer is making every effort to protect the trees; however there are storm water challenges that may impact existing trees and /or the usability of some of the lots; in particular block 2, lots 9 -13 and Block 3, lots 3 -6. The developer initially proposed to construct storm water pipe across these lots rather than place it at the back of the lots. The intention was to protect the existing trees. During staff review, the concern was raised that placing the storm water pipe across the yards limits the use of these properties because the rear yard would then have a drainage and utility easement upon it. Fencing, decks, and accessory structures cannot be placed within drainage and utility easements. The attached revised plat depicts the removal of the existing trees to preserve the use of the rear yards on these particular lots. The developer has suggested he would plant additional trees along 2 the railway to act as a buffer. Staff recommends the Planning and Zoning Commission discuss and make a recommendation to City Council whether the existing trees should be preserved or should the use of the rear yards be preserved on these particular lots. Park and Recreation Commission Recommendation The Park and Recreation Commission reviewed the sketch plan at their September 5, 2013 meeting and recommended the taking of cash in lieu of land. The Commission will also review the preliminary plat at the June 5, 2014 meeting. Lower Rum River Watershed Management Organization ( LRRWMO) LRRWMO has received the plat and is in the process of reviewing the grading plan, hydrology calculations and soils report. As part of the platting process, the developer will need to address any issues that are raised during the review. Coordination with other Agencies The developer and /or owner are responsible to obtain all necessary permits (Minnesota Department of Natural Resources, U.S. Army Corp of Engineers, Coon Creek Watershed District, Minnesota Pollution Control Agency, LGU and any other agency that may have an interest in the site). Initial contact shall be made with the City Engineering Department regarding this item. SKETCH PLAN REVIEW The Planning and Zoning Commission and City Council reviewed the sketch plan in September 2013. The City Council meeting minutes are attached for your review. Sheet C301: All driveway grades must be no greater than 8 %. Lot 1, Block 3 has a grade of 10.3 %. 318. All plans where appropriate. Make sure that all text is readable and does not overlap other labels I text. There is still overlapping text in several areas on C301 and C401. The following comments are in regards to Review #4: 401. Sheet C201 and C202 and all sheets were appropriate: Revise easements to match all other plan sheets and comments. Specifically need to look at the following areas: • Lots 5, 6, Block 1 — need D &UE for drainage Swale south of petroleum easement • Lots 9 -14, Block 1 — extend D &LIE west so its 10' off west plat line. Any rear yard cross drainage in this area is minimal to the point it's not worth encumbering these lots with additional easements. • Lots 1 / 2, 8 / 9, Block 2 — make sure 100 -year HWL is within D &LIE • Lots 2 / 3, 6 / 7, Block 3 — make sure 100 -year HWL is within D &UE • Lots 9 -13, Block 3 — see comments below, extend out D &UE closer to Swale shown on grading plan • Block 4 — all lots backing up to Pond 3P. Sheet C301: Move the drainage Swale on the west side of the plat north to the future lot line in the plat to the west. It's currently going right through the middle of a lot in the ghost plat. 403. Sheet C301: Look at driveway grade on Lot 12, Block 1. It's currently labeled as 0.3 %. 404. Sheet C301: Revised grading / contours on Lots 4 -10, Block 1 to something similar to what is marked up on the plans. Put a high point on the lot line of Lots 9/10 so additional D &UE are not required on these lots. Currently the contours on several of these lots make it look like there would be a swale with drainage going across the rear of the yards where there is currently not D &UE. Try to get drainage to go across the pipeline easement and south to the wetland if possible to limit D &UE for cross yard drainage. The D &UE on Lots 5/6, Block 1 will need to be adjusted to account for the discharge swale for the storm sewer outlet. 405. Sheet C301: In the rear of Lots 9 -13, Block 3 there is a dashed line with grades labeled. Is this an existing low / swale area? If this is where the drainage will run, then D &UE can be reduced on these lots and extended to within 10' of this swale area. 406. Sheet C301: For all rear yard drainage areas (Block 2, 3, 4), make sure that the 100 - year HWL is encompassed within the D &UE. Around Pond 3P it appears easements can be reduced quite a bit by extending down to the HWL. 407. Sheet C301: HWL's for Ponds 9P and 7P do not match Hydrocad reports. 408. Sheet C301: Can't read HWL's for Pond 10P, 11 P (overlapping text). 409. Sheet C301 & C401: Move the storm sewer pipe between Lots 13 & 14, Block 4 west between Lots 15 & 16, Block 4. This will eliminate the storm sewer in the rear of these yards and put it in the street. Adjust the VMA and D &UE accordingly. 410. Sheet C301: The VMA slopes should not exceed 10 %. Look at VMA for Pond 10P, 11 P, and 3P (east side). 411. Sheet C301: Refer to red lined mark ups of contour lines on C301. In general, try to round out contours and make sure it makes sense where the computer tied into existing contours. 412. Sheet C301: Add additional proposed contour line labels to Block 2. 413. Sheet C301 & C401: Storm sewer at south end of plat was deleted. If the desire is to delete the run that was discharging into Pond 7P, then the existing system to the south needs to be analyzed to make sure that it can handle the additional flow, as well as looking at the HWL of the pond that system discharges into to make sure it does not impact the existing low floor elevations around it. Otherwise, put two catch basins back in this location. Coordinate this with the Hydrology Report / Model. 414. Sheet C301: For Lot 8, Block 2 (and all lots within the plat); make sure that the Lowest Opening is at least 1' above the EOF elevation. 415. Sheet C301: Review the driveway grade (3.3 %) and lot corner elevation for the southeast corner of Lot 3, Block 2. Elevation doesn't seem to match grading contours. 416. Sheet C301: IN the northwest corner of the plat, an EOF of 911.3 is listed. Is this for Pond 8P? If so, the property line just to the south of this is at a higher elevation, which would control before the 911.3 elevation. 417. Sheet C301: Between lots 1 and 2, Block 2, there's an EOF of 914.2. This seems incorrect as the elevations rise as you go south along the lot line. 418. Sheet C302: Correct the background color on detail 4/C302. 419. Sheet C401: The IE for FES 500 is 2' above the existing grade at the petroleum easement. Increase pipe grade to daylight closer to existing ground elevation. 420. Sheet C401: Pipe diameter between CBMH 120 and CBMH 102 should be 15 ". 425, Sheet C401: Raise the IE for FES 001 up to about 902 + /- (currently 899.05). Get it closer to the I for FES 100. 426. Sheet C401: Move system from CBMH 004 to FES 001 into the roadway and between lots 15 &16, Block 4. Pipe sizes should be 15" (plan says 12") between CB 004 and FES 001. 427. Drainage and Utility Easements and the Lot by Lot tabulation will be reviewed in further detail once changes have been made. 428. Additional Comments Pending Further Review. The following comments are related to the Hydrology Report Review #4: 1. For Pond 3P, Device #5 should be routed to Device #1 (not be a primary outlet). Also need to route a 15" culvert into the model upstream of the orifice and weir wall as this MAY control the discharge when water if flowing over the weir wall. Revise HWL in plans if necessary. 2. For Pond 4P, the rim elevation for Device 2 does not match the utility plans. Revise one of the other, and HWL's if necessary. 3. For Pond 8P, the outlet device in the model is a 15" culvert. In the plans it's 18" at 0.5 %. Revise as necessary. 4. For Pond 10P, the rim elevation for Device 2 does not match the utility plans. Revise one of the other, and HWL's if necessary. 5. For Pond 12P, the rim elevation for Device 2 does not match the utility plans. Revise one of the other, and HWL's if necessary. 6. Revise storm sewer calculations to account for drainage area to CBMH 104 and CB 148. Revise tributary area map as well. 7. In storm sewer calcs, pipe size should be 15" for CBMH 120 to CBMH 102. 8. Councilmember Bukkila arrived at 7:06 p.m. ANOKA COUNTYSHERIPF 'SDEPARTMENTMONTHLYREPORT Commander Halweg presented the July 2013 Anoka County Sheriff s Department monthly report to the Council. SKETCH PLAN REVIEW — CO UNTR I' OAKS NORTH Mr. Carlberg explained the City Council is asked to review a residential sketch plan for a single family urban residential development known as Country Oaks North requested by N1r. Scott Wold. Regular Andover City Council Meeting Minutes —September 17, 2013 Page 3 Mr. Carlberg reviewed the information with the Council. Councilmember Trude stated an ordinance was approved a couple of years ago and has not been applied in this situation. She thought this was something they wanted to keep in mind because it has to deal with new developments that buffer urban development from rural property. The ordinance came about as Miller's Woods was developing. She stated the Council has a lot of discretion on what is considered a buffer. She thought there needed to be a bigger global viewpoint regarding this because there are multiple land owners and some do not want growth in this area. Mr. Carlberg reviewed how the additional 150 units of sewer and water became available. Councilmember Trude thought it would be helpful, in the future, to have written input from the two properties to the west if they do not want to see development because the Council is going to have to figure out the road and access. She noted the City cannot be putting a dotted line through the Selmer property unless that road easement can be purchased before the open space is purchased. She stated she was trying to put the pieces together, this is a very large project that cannot be isolated on forty acres, and they have some bigger issues to sort out. Mr. Carlberg agreed and thought the developer will need to rework the plans for buffering and transportation. Mayor Gamache stated the ordinance in place references buffering between rural and urban neighborhoods but it does not talk about buffering between the development and open space. Mayor Gamache stated because there is not yet a neighborhood in the open area, can the City request certain types of buffers based on future development. City Attorney Baumgartner stated it is hard to plan for the future because they do not know what is going to go in there. He thought the ordinance would need to be applied to what is there now and then whatever may come in after that would need to provide the buffering also. There was discussion regarding the pipeline easement and how the development is being shown as developing around the pipeline easement. Councilmember Trude noted the City will need to discuss the issue of the pipeline easement and the railroad with the Met Council as well because of the density requirements they have requested. Councilmember Trude thought the buffering ordinance was overlooked with this proposed development. Mr. Carlberg noted the ordinance will not need to be reviewed until the development moves forward beyond the sketch plan when buffering is reviewed by City staff the ordinance references buffering for preliminary plats. He thought it was a good idea to bring this up now so the developer gets an idea of what the future plans will need to look like. Mr. Scott Wold stated they did a pretty good job buffering Country Oaks West. He stated they have buffered the lots along the railroad tracks in this plan, have a pretty good buffer with the wooded area on the west, and there will be screening to the homes to the north. Also to the west, Mr. Kuiken has Regular Andover City Council Meeting Minutes —September 17, 2013 Page 4 a dirt bike track that will also be buffered from this development. He noted the house pads will be by the proposed road and the rest of the lot area will be deeply wooded. Mayor Gamache asked if the Kuiken property is wooded. Mr. Wold indicated there are not a lot of woods on that property but the dirt bike track is open. Mr. Wold indicated he will keep as many trees as buffers on the west as possible. Councilmember Trade stated deeper lots will need to be done along the Kuiken property because she is not sure if it is appropriate to have a development come in and take away another property owner's rights. She noted the hunting would go away but she did not think a recreation should be taken away. She thought the City needed to be fair with all property owners. Mr. Wold stated the reason for curved roads in the development is so they do not become straight "raceways." He stated the road will need to go to the north because of the pipeline and wetlands so he would like to keep the curves in the road. Councilmember Howard thought the emergency access that crosses the railroad tracks should be on this forty acre parcel because they do not know when the property to the north will be developed. Mr. Carlberg indicated the Ganter property to the north has requested to be included in the Comprehensive Plan Amendment to expand the urban service area in that area as well. Councilmember Trade stressed there needed to be some buffering on this property to meet the ordinance. She stated if the Selmer property becomes open space the Kuiken property will not be able to be developed for anything. Mr. Carlberg stated it would not be able to develop as urban but could be developed as rural. Councilmember Bukkila noted if they approved the proposed plan and the Selmer land was open space, it would landlock the Kuiken property as it would not have access to any roads. Mr. Berkowitz stated if the Selmer property were to develop, the City would require them to provide access to development areas around them. He stated if the property were to become open space, the City would request a roadway easement so the Kuiken property could develop. Councilmember Bukkila indicated she would want to see some type of buffering on this property to drown out the noise from the bike hack. Mr. Wold asked for direction on the type of buffering the Council wanted. There was discussion between the Council and the developer regarding possible buffering on the property. Councilmember Trade wondered if the City could request a gated access going across the railroad tracks from Burlington Northern for a possible second access into the development. Mr. Berkowitz stated if the Council wanted to pursue this as a second access, staff can contact Burlington Northern and see what their response would be. Regular Andover City Conned Meeting Minutes —September 17, 2013 Page 5 Councilmember Trude thought if Mr. Wold would like to redraw the plans with more cul -de -sacs, she would not mind that because people do like living on cul -de -sacs. Councilmember Howard stated he would like to see the road run a little more straight so on the next project, the lots can be a little deeper along the railroad tracks. Mr. Mike Babineau, 16480 Wintergreen Street, expressed his concerns about rezoning from R -4 to R -1 at the Planning Commission. He wondered how a road would go forward to the Kuiken property if the Selmer property will be open space. Mayor Gamache noted they would need to work on plans to make part of the Selmer property a road easement. Mr. Pete Steiger, 16473 Wintergreen Street, stated when he bought the property he bought it with the understanding it was zoned R -1 and he would like to keep the same zoning. He indicated he does not want the wildlife to go away. Ms. Elizabeth Foerg, 16527 Sycamore Street NW, stated this does not meet the R -1 zoning for the area. She stated if this is changed to 12 to 16 lots at 2.5 acres per lot, she would be fine with it. She stated if the City is planning to change this from R -1 to R -4 zoning, are they planning to notify all the residents in the R -1 area because they are all impacted if the zoning is changed. She thought this should be a City-wide notification. If the zoning is changed in this area, the City is opening it up to change the zoning in all of the City's R -I areas. She wondered why the City needed to max out the sewer and water capacities and thought the City should keep these resources open for future use. Ms. Foerg noted the railroad is not a buffer and they have dealt with noise in the past from other developments being created. She noted tree buffers will not survive development, especially with only a 25 -foot buffer. Mr. Richard Kuiken, 16541 Hanson Boulevard, stated he has the 40 acres to the west. He stated the dirt bike track has been on the property for 20 years and he keeps the riding to a minimum, two days a week. He did not think a buffer along the property line will work. He stated he is willing to work with the neighbors and City on a schedule for riding his bikes. He noted he does not want to be required to stop his recreational enjoyment. Councilmember Trude thought Mr. Kuiken should work with the developer on the buffering. Mr. Kuiken noted the tree buffer will be nice but will not cut down on the noise. Councilmember Bukkila asked if Mr. Kuiken would be willing to berm his land. Mr. Kuiken stated he would not be against it but if they did a berm along the property lines, he would not want to have his track shut down. He stated the issue is not just the five or six lots; it will be everyone that moves into the proposed new development that would hear the noise and likely make issue of it. He noted there is not any noise on the track after dark and he is willing to make accommodations for time. Mayor Gamachc reviewed what the Council needed to do regarding this item. Mr. Carlberg stated Regular Andover City Council Meeting Minutes — September 17, 2013 Page 6 the Comprehensive Plan Amendment will be sent to the Met Council for review and approval and then if approved, the developer will move forward with potential changes to the development for Council revietiv and approval. Councilmember Trude stated the Met Council has been pushing the City to increase development and with review, the City found they had more flow capacity because of more efficient use of water. That is the reason more sewer and water capacity was found. Mr. Berkowitz reviewed the process the City went through in finding the additional capacity in the City. Councilmember Bukkila asked if the extra 150 units could be used elsewhere in the City. Mr. Berkowitz indicated it could not; it is only for this sewer line, Mayor Gamache asked if a fence could be installed along the development and the Kuiken property to hide the area and address trespassing concerns. Mr. Carlberg did not think a fence would control the noise; he thought the preservation of trees would be the best thing for buffering. Councilmember Knight thought evergreens would provide more noise barrier than other trees. Mr. Wold stated he did not know if a wood fence would work because of how far it would need to go. He thought ,a tree buffer would be best because it would keep people away from the railroad track as well buffer noise from the dirt bike track. He noted development is being done next to gun clubs in other cities and people get used to the noise. Councilmember Howard asked if they could ask Met Council to drop the density requirement on this property since they are gaining units on this property in order to help the Grey Oaks development that is struggling. Mr. Carlberg indicated their goal is 3 units per acre and the Met Council did not care where development is at, as long as development is at 3 units per acre overall. SCHEDULE OCTOBER EDA MEETING Mr. Dickinson requested the Council schedule an EDA meeting in October. Hanson, City Planner SUBJECT: PUBLIC HEARING: Sketch Plan for a 26 -lot urban residential development located at139th Avenue NW and Martin Street NW DATE: May 27, 2014 INTRODUCTION The Planning Commission is asked to review a residential sketch plan for a single family urban residential development as requested by Povlitzki Properties, LLC. DISCUSSION The property owner /applicant, Mr. Brad Povlitzki has submitted a sketch plan for review. The Andover Review Committee (ARC) reviewed the sketch plan and submitted comments to Mr. Povlitzki. These comments have been attached for your review. Staff suggests the comments be reviewed as part of the sketch plan process. Conformance with Local and Regional Plans and Ordinances 1. The property is located within the 2020 MUSA Boundary and within the current stage of sewer expansion. 2. The property is zoned General Business (GB). A rezoning to Multiple Dwelling Medium Density (M -1) will be necessary to allow the project to move forward. 3. A Comprehensive Plan Amendment (CPA) was approved by the Metropolitan Council and City Council in February 2014 to change the land use from General Business to Medium Density Residential. Access Access would be provided from 139`h Avenue NW and Martin Street NW. Martin Street NW will be extended to the south with two (2) cul -de -sacs to access some of the lots while some of the lots will be accessed from 139`l' Avenue NW. The Anoka County Highway Department has reviewed the sketch plan and has no comments since it does not abut county roads. Utilities Sewer and water lines are located along 139`h Avenue NW and will be extended south along Martin Street NW to serve the rest of the development. Lots The proposed lot sizes do not meet the minimum requirements of the M -1 Zoning District. However, the property owner will request a Planned Unit Development (PUD) as part of the preliminary plat. It is proposed the PUD request will be consistent with the PUD standards approved as part of the residential development located directly to the north of this site known as Parkside at Andover Station 3rd Addition. This includes the following: Lot Size: 6,000 square feet Lot Width: 60 feet Lot Depth: 100 feet Side yard Setback: 5 feet Front yard Setback: 20 feet Park and Recreation Commission The Park and Recreation Commission will review the sketch plan at their June 5, 2014 regular meeting. Floodway and Wetlands There appears to be wetlands within the proposed development area and a portion of the lots may be located within the 500 -year floodway. A wetland delineation will be required and must be approved by the Coon Creek Watershed District (CCWD) as part of the preliminary platting process. Coon Creek Watershed District (CCWD) Once the overall layout of the sketch has been agreed upon, the developers will prepare a grading plan, hydrology calculations and a soils report that will be reviewed by the City, an engineering consultant and the CCWD. The CCWD will need to have reviewed the preliminary plat and the developer will need to address any issues that are raised during that review before a public hearing will be scheduled for the preliminary plat. Coordination with other Agencies The developer and /or owner are responsible to obtain all necessary permits (Minnesota Department of Natural Resources, U.S. Army Corp of Engineers, Coon Creek Watershed District, Minnesota Pollution Control Agency, LGU and any other agency that may have an interest in the site). Initial contact shall be made with the City Engineering Department regarding this item. ACTION REQUESTED The Planning Commission is asked to hold a public hearing and informally advise the applicant on adjustments to the proposed project and the proposed PUD standards. A wetland delineation will be required which must be approved by the Coon Creek Watershed District (CCWD). There is no indication on the sketch plan that the CCWD has approved the wetland boundaries. Need to identify wetland boundaries on the next submittal of the sketch plan. If no wetlands exist, then it will be necessary to indicate such on the legend of the sketch plan. 2. The developer is responsible to obtain the necessary permits from the CCWD, DNR, U.S. Army Corps of Engineers, MPCA or any other agency that is interested in the site. 3. Need to meet the requirements of the City of Andover Water Resource Management Plan. Based on the timing of the storm water design for the development, the Developer's Engineer must incorporate new Atlas 14 rainfall events at part of the design. 4. A buffer strip will be required for wetlands and storm water ponding areas. Some of the lots in the development may be impacted by wetlands and/or buffer strip areas. The developer's surveyor /engineer will need to evaluate to ensure lots can be made buildable due to these impacts. 5. Need to submit a tree protection plan with the submittal of the preliminary plat. 6. A copy of the sketch plan should be forwarded to the Anoka County Highway Department for their review even though the property is not adjacent to a County road. 7. A 20 foot radius corner is required for the intersection right -of -ways within the sketch plan where a city street intersects with another city street. Also where the cul -de -sac intersects with the straight portion of the street shall also be rounded at a radius of not less than 20 feet. 8. As part of the preliminary plat, drainage and utility easements will need to be provided to allow watermain to be looped as required in the development so there are no dead ends. Need to discuss further with the Engineering Department as part of the preliminary plat approval submittal. 9. Drainage and utility easements will be required for all ponding areas. This will be evaluated as part of the preliminary plat submittal. 10.A preliminary sanitary sewer and water main layout will be reviewed later as part of the preliminary plat submittal. 11.A number of lots do not meet the width and lot depth required as per code. Need to discuss this further with the Planning Department as far as the PUD requirements. 12. The materials will be stored on the 20 acre parcel located northeast of 16541 Hanson Blvd NW. The stockpile of materials will be approximately 8 -10 feet high with 4:1 slopes. DISCUSSION City Code section 12 -12 requires an interim use permit for the storage of street construction materials. The street construction materials are part of the County Oaks North grading plan submitted by SW Land, LLC. The Country Oaks North project will have an excess amount of materials that require this interim use permit to store. The storage of the material will be used for a future street connection of 167`h Avenue NW out to Hanson Blvd NW. The storage will occur on a land - locked parcel that is the location of a former dirt bike track. Engineering Department Review The Engineering Department completed a review of the original plan that reflected the storage of street construction materials at the property NW of 16541 Hanson Blvd. The May 22, 2014 Engineering Department Comment Letter is attached for your review. Transportation Materials will be moved to the site from the east, where the Country Oaks North development is proposed. Interim Use Permit Standards The Planning Commission shall recommend an interim use permit and the Council shall issue such interim use permit only if it finds that such use at the proposed location: I . Will not create an excess burden on parks, streets, and other public facilities; 2. Will not be injurious to the surrounding neighborhood or otherwise harm the public health, safety, and general welfare; 3. Will not have a negative effect on the values of property and scenic views; 4. Will not impose additional unreasonable costs on the public; 5. Will be subjected to, by agreement with the owner, any conditions that the City Council has deemed appropriate for the permission of the use, including a condition that the owner may be required to provide appropriate financial surety to cover the cost of removing the interim use and any interim structures upon the expiration of the interim use permit; Planning and Zoning Commission Review The Planning and Zoning Commission will need to consider whether the proposed use is acceptable based on the interim use permit standards listed above, whether conditions are necessary, or whether the proposed use cannot be made to meet the interim use permit standards. ACTION REQUESTED The Commission is asked to hold a public hearing, review the proposed interim use permit application and make a recommendation to the City Council. If the Planning and Zoning Commission recommends approval, staff suggests the conditions in the attached resolution be approved. The materials will be added to the NE side of the property just off of the curb in order to raise a lower area to curb level. The home pad will be moved to the area where the fill will be added to provide a more private building site than what was previously planned. DISCUSSION Engineering Department Review The Engineering Department completed a review of the original plan that reflected the land reclamation to add fill to the NE side of the property. The May 13, 2014 Engineering Department comment letter is attached for your review. Transportation The materials will be coming from an ongoing project located at 159'x' Avenue and Makah Street where there is an excess amount of fill at the location of a City project. Materials will be moved to the site by going North on 7 °i Ave, East on County Road 158, and South on Inca Street. DATE: May 27, 2014 BACKGROUND Over the past few months, staff has discussed several amendments to the City Code needed for clarification and clean up /consistency purposes. The following is a review of each code amendment being proposed. Code 9 -8 -2, Definition of Rental Dwelling In accordance with City Code 9 -8 -2, the definition of rental dwelling is as follows: RENTAL DWELLING: Means any dwelling or dwelling unit used for residential occupancy by one or more persons who are not the owner or a member of the owner's immediate family. "Rental dwelling" does not include hotels, motels, and hospitals. The Andover Review Committee (ARC) has had several discussions of how senior housing projects such as the Farmstead, Arbor Oaks and now the newly opened Cherrywood of Andover advanced living facility fit into the definition of rental dwelling. Based on the current definition of "rental dwelling" as stated above, City Code 9 -8 -3 requires these facilities to be licensed as multi - family rental dwellings. ARC has discussed the need to license these facilities per City Code requirements when these facilities require other agency licensing and also have staff on hand to address code issues. The City's multi - family licensing program that was implemented in the 1990's was intended to address rental dwellings in the Crosstown Boulevard /Drive, Bunker Lake Boulevard area and not senior housing facilities. The ARC is proposing the definition be amended as follows: RENTAL DWELLING: Means any dwelling or dwelling unit used for residential occupancy by one or more persons who are not the owner or a member of the owner's immediate family. "Rental dwelling" does not include hotels, motels, senior living facilities, and hospitals. 11 -3 -4, Easements On January 2, 2013, the City Council adopted a code amendment to City Code 11 -1 -5 (Easements to be Dedicated) and 11 -3 -4 (Easements). Both these sections of the City Code are in Title 11, Subdivision Regulations. Both sections were to provide consistent language on the dedication of drainage and utility easements. The change or amendment was the reduction of the required ten foot (10') easement along the front and rear lot lines to five feet (5') on lots served by municipal services. However, it was discovered that language that was adopted was not consistent between these two sections and in fact language was left out of I1 -3 -4 in the approved /adopted ordinance amendment as shown below: 11 -1 -5: EASEMENTS TO BE DEDICATED: A. Dedication Of Easements: Final plats shall identify and dedicate all easements for utilities, drainage, street rights -of -way, surface water ponding and such other public uses as shall be found necessary, convenient or desirable by the City to ensure the timely extension of utilities to adjacent properties. Land reclamation, mining and soil processing prior to the new IUP regulations were permitted with the issuance of a Conditional Use Permit. These sections of the City Code were requirements for "specific conditional uses ". With the adoption of the amendment implementing IUP regulations, these sections should have been changed from specific conditional uses to specific interim uses. Staff is proposing these sections be eliminated from 12 -8 and a new section of the City Code be added in 12 -16 identifying them as specific interim uses. A terminology change is also proposed to 12 -16 to eliminate soil processing and adding Highway Construction Materials (temporary processing and storage) to be consistent with the newly adopted land use table, City Code 12 -12. Reference corrections and changes have also been made to the land use table City Code 12 -12. In addition, excavation (mining) has also been added to the residential use table. Conditional Use Permit Required For Certain Materials: All uses, including pipelines associated with the bulk storage of oil, gasoline, liquid fertilizer, chemicals and similar liquids shall require a Conditional Use Permit in order that the governing body may have some assurance that fire, explosion or water or soil contamination hazards are not present that would be detrimental to the public health, safety and general welfare. All tanks that could contain hazardous and /or flammable liquids having a capacity in excess of one thousand (1,000) gallons shall be required to obtain a Conditional Use Permit and a permit from the Fire Department prior to installation. Exceptions are noted below. All public agencies (including school districts, city, county and state) shall be entitled to apply for a Conditional Use Permit for a tank regardless of the zoning district that they are located in. B. The governing body may require the development of diking around said tanks, suitably sealed, to hold a leakage capacity equal to one hundred fifteen percent (115 %) of the tank capacity. C. Prohibitions All liquid storage tanks not listed as a Conditional Use in the Uses table (refer to Section 12 -13) or as an Exception (as noted in Section 12 -8 -7 D.) shall be prohibited. D. Exceptions. The provisions of this subchapter do not apply to: 1. Existing home heating oil tanks, including those located in basements, cellars, if the storage tank is located upon or above the surface of the floor; 2. Septic tanks. 3. Small (20 -30 lb.) propane tanks used on barbeque grills. E. Installation, Alteration, Repair or Removal Permits. 1. The installation, alteration, repair or removal of any liquid storage system governed by this subchapter requires permits issued by the Fire Chief pursuant to the provisions of the Minnesota State Fire Code and any other applicable code, ordinance, statute, rule or National Fire Prevention Association Standards; 2. Permits and fees. The issuance of permits and the collection of fees shall be in accordance with the fee schedule adopted by the City Council in the amount provided by the fee resolution, set forth in this code; 3. The Fire Chief may deny a permit to persons not capable of performing pursuant to ordinance requirements. 12- 8 -6--3: EXTERIOR STORAGE: In all districts excluding residential districts, the governing body may order the owner of property to apply for a Conditional Use Permit to conduct an open storage use, including existing uses, provided it is found that said use constitutes a threat to the public health, safety, convenience, morals or general welfare. 12 -8 --7 4: AUTOMOBILE SERVICE STATION The regulation of automobile service stations strives to achieve compatibility of these stations with adjacent and abutting land uses. In addition, such regulation is intended to protect the public health, safety and general welfare by mitigating and potentially detrimental aspects of automobile service stations, including potential traffic hazards, noise, light glare at night, outdoor storage of merchandise, indiscriminate advertising, environmental health hazards, and the like. Automobile service stations shall be subject to the following: A. All new buildings, the site, tanks, piping and dispensing stations, shall comply with the current provisions of the International Building Code, Minnesota State Fire Code, and all provisions related to underground liquid storage systems required in Section 12 -8 -7 2 of this code. B. Building permits shall not be issued for new construction or remodeling of facilities unless Fire Department approval has been received. C. Hours of operation will be approved by the City Council. D. The site plan shall show parking areas for customers, employees, service vehicles and those needing repair and no other areas of the site will be allowed vehicle parking. No vehicle shall be parked awaiting service longer than ten (10) days. Inoperable vehicles are regulated per section 6 -5 of City Code. E. Pump islands are subject to setback requirements. F. Exterior storage and sales shall only be allowed as approved through the Conditional Use Permit. The permit shall include, as a condition thereof, a finished grade plan which will not adversely affect the adjacent land, and as conditions thereof shall: A. Regulate the type of fill permitted: B. Include a program for rodent control; C. Include a plan for fire control; D. Provide for general maintenance of the site; E. Provide planned controls of vehicular ingress and egress; and F. Provide for control of material disbursed from wind or hauling of material to or from the site. 12 -16 -2: MINING: In all districts, the conduct of mining shall be permitted only upon issuance of a Interim Use Permit. Such pen-nit shall include, as a condition thereof: A. A plan for finished grade which will not adversely affect the surrounding land or the development of the site on which the mining is being conducted; and B. The route of trucks moving to and from the site. 12 -16 -3: HIGHWAY CONSTRUCTION MATERIALS (TEMPORARY PROCESSING AND STORAGE: A. Site Plan Requirements: The temporary processing and storage of sand gravel or other materials shall be permitted only by Interim Use Permit. Such Interim Use Permit shall include a site Ulan showing: 1. Where the processing is to be done; 2. The location of the plant; 3. Disposal of water; 4. Route of trucks moving to and from the site in removing processed material from the site. B. Term Of Permit: Such permit shall be granted for a specified period All other Titles, Chapters and Sections of the City Code shall remain as written and adopted by the Andover City Council.
