Hanson, City Planner SUBJECT: Approval of Minutes — November 12, 2013 DATE: December 10, 2013 RE QUEST The Planning and Zoning Commission is requested to approve the minutes from the November 12, 2013 work session and regular meeting. PLANNING AND ZONING COMMISSION WORKSHOP MEETING NOVEMBER 12, 2013 The Workshop Meeting of the Andover Planning and Zoning Commission was called to order by Chairperson Daninger on November 12, 2013, 6:00 p.m., at the Andover City Hall, 1685 Crosstown Boulevard NW, Andover, Minnesota. Commissioners present: Chairperson Daninger, Commissioners Lynae Gudmundson (arrived at 6:03 p.m.), Valerie Holthus, Bert Koehler, Kyle Nemeth, and Steve Peterson. Commissioners absent: Commissioner Tim Cleven Also present: Community Development Director Dave Carlberg City Planner Stephanie Hanson Others DISCUSS CITY CODE 12 -12 PERMITTED, CONDITIONAL, INTERIM AND PROHIBITED USES Mr. Carlberg explained over the past year, the Planning and Zoning Commission has been working through the land use table, reviewed interim use regulations, and revised and recommended new definitions to the City Code. The City Council held three work sessions to review the proposed changes recommended by the Commission. During these work sessions, the City Council also recommended changes to the land use table and requested revisions and new definitions to support the uses listed on the table. Mr. Carlberg reviewed the City Code changes with the Commission. Commissioner Gudmundson arrived at 6:03 p.m. Commissioner Peterson was not sure if residents would know enough to look in either the residential or commercial table for what they need and he wondered if there could be some instruction included. Mr. Carlberg indicated this can be fixed in order to direct them to the correct table. Andover Planning and Zoning Commission Workshop Meeting Minutes — November 12, 2013 Page 2 Commissioner Nemeth indicated he seen Item 50A in the residential table but not in the commercial table. Mr. Carlberg noted to add it to the commercial table. He stated this will not be allowed in the Commercial District. Mr. Carlberg stated regarding "Christmas Tree Sales" the City Council wanted to exclude this in Residential Districts. The City Council indicated that cutting your own tree in the Residential District is allowed because it is considered agricultural but they did not want tree businesses setting up shop all over the City. Mr. Carlberg noted the City Council added a definition for Commercial Greenhouse and the City Council decided not to keep electrical charging stations in the table. Mr. Carlberg stated the City Council reviewed "Commercial Recreation" and removed therapeutic massage establishments. Commercial Recreation would be permitted indoors but not outdoors unless it is with a CUP. Mr. Carlberg indicated that Item 41, "Elementary, Junior and Senior High Schools" was changed to "Educational Institution or Facility" in the table. Mr. Carlberg stated wording was added to "Group Family Daycares," defining this as a State Statute. Mr. Carlberg noted the City Council deleted the definition of "Clubs" and separated them out into two different definitions, Private Clubs and Public Clubs. Mr. Carlberg explained under "Manufacturing" the word "nonalcoholic" was removed which will allow brewery's or winery's in that District. Mr. Carlberg noted the City Council added a Rental Business definition. Commissioner Holthus wondered if there should be a note /cross reference on both charts indicating there is another chart for permitted uses. Mr. Carlberg indicated they are planning on doing something like this. Commissioner Nemeth wondered what the thought process of the City Council was on Item "Club, Public" — sponsoring organization is non - profit. Mr. Carlberg indicated he was not sure. The wording was pulled from another community and the City Council liked the idea. OTHER BUSINESS. Community Development Director Carlberg updated the Planning Commission on related items. Commissioners present: Chairperson Daninger, Commissioners Lynae Gudmundson, Valerie Holthus, Bert Koehler IV, Kyle Nemeth and Steve Peterson Commissioners absent: Commissioner Timothy Cleven Also present: Community Development Director Dave Carlberg City Planner Stephanie Hanson Others APPROVAL OF MINUTES. October 8, 2013 Commissioner Holthus stated she had a clarification on page 8 "...the big demand for Andover today is single family urban lots that want to be in the Andover School District" There is not an Andover School District, it is the Andover Attendance area and Anoka — Hennepin School District. Commissioner Holthus stated there is a typo on the last page, under other business "The Council reviewed the sketch plan of Country Oaks North; they had some concerns with buffering around the pa eier perimeter ". Motion by Koehler, seconded by Nemeth, to approve the minutes as presented. Motion carried on a 6 -ayes, 0 -nays, 0- present, 1- absent ( Cleven) vote. Regular Andover Planning and Zoning Commission Meeting Minutes —November 12, 2013 Page 2 City Planner Hanson noted the purpose of this item is to hold a public hearing and take input on a Conditional Use Permit for telecommunications collocation on the existing water tower ( #1) and the construction of a shelter located in Rose Park, 14057 Rose Street NW as requested by Verizon Wireless. City Planner Hanson reviewed the proposed Conditional Use Permit with the Commission. Commissioner Nemeth asked if this is approved and another carrier comes in and wants to put an antenna on the water tower, would they be allowed to. Mr. Carlberg stated there is already another carrier on the water tower and the City allows and encourages co- location. Commissioner Gudmundson asked if there is already another carrier, where is their equipment located. Ms. Hanson indicated their equipment is in the base of the water tower but there is not adequate space for Verizon's equipment in the base of the tower so they are proposing a building to house the equipment. Commissioner Holthus asked what happens to the equipment if a carrier goes out of business. Mr. Carlberg stated there is a lease agreement with the city and the equipment would need to be removed or another carrier can take over the structure. Commissioner Peterson asked what the benefit is for the community. He also asked what the risk is. Staff suggested the applicant answer those questions. Motion by Holthus, seconded by Koehler, to open the public hearing at 7:13 p.m. Motion carried on a 6 -ayes, 0 -nays, 0- present, 1- absent (Cleven) vote. Ms. Sarah Hill, 20120 Texas Avenue, Prior Lake, MN, was at the meeting to answer questions for Verizon. Commissioner Koehler asked what type of interruptions to the public would there be for maintenance. Ms. Hill stated there will not be any interruption. There will be monthly maintenance checks on the equipment within the building. Commissioner Peterson asked what the benefit will be. Ms. Hill stated this area being heavily residential, there is capacity issues with the 4G service and by doing this it will boost the service. Commissioner Peterson stated on the structure itself part of it looks like stone and part looks like fencing. Ms. Hill stated they can use several different types of exteriors to match existing exteriors and staff had a photo to use, recommending that style. Commissioner Koehler asked if all the equipment is maintained within the structure or are there lines underground. Ms. Hill stated there will be lines brought to the structure 0 . 40 Regular Andover Planning and Zoning Commission Meeting Minutes — November 12, 2013 Page 3 underground and then run up within the water tower to the antenna. There will not be any exposed equipment that can be vandalized or seen by anyone. Commissioner Holthus stated she liked the design of this structure. She wondered how secure the fencing is and if it is vandalism proof or secure. Ms. Hill indicated this is not vandalism proof but if damaged, they will come out and repair. They also inspect the structure and fencing on their monthly maintenance checks. Chairperson Daninger asked if the antennas will be painted to match the water tower. Ms. Hill indicated anything outside of the water tower will be painted to match. Chairperson Daninger asked if any other sites were looked at for placement. Ms. Hill stated she would need to review her notes to see where else they looked but this is the ideal placement for the antennas. Chairperson Daninger asked what the life cycle is for this type of technology. Ms. Hill indicated she had not heard of anything new coming forward in the near future. Chairperson Daninger asked what the size of the equipment is. Ms. Hill stated there will be four or five cabinets, four to five feet deep along with fuse panels. Chairperson Daninger asked if it was looked at to place the equipment within the water tower in order to eliminate the outside storage building. Mr. Carlberg indicated there is not adequate space within the water tower for the equipment. Chairperson Daninger asked how the maintenance techs will access the area. Ms. Hill stated they will access the park through the access road to the north. Chairperson Daninger asked if approved, when will the equipment and antennas be installed. Ms. Hill stated they will be installing the first quarter of 2014. Commissioner Holthus noted this park is slated for reconstruction and she would like to see the building put in before that time. Motion by Holthus, seconded by Gudmundson, to close the public hearing at 7:31 p.m. Motion carried on a 6 -ayes, 0 -nays, 0- present, 1- absent (Cleven) vote. Commissioner Koehler asked outside of the structure is there anything different from the request they previously discussed. Staff indicated there was not. Motion by Holthus, seconded by Koehler, to open the public hearing at 7:35 p.m. Motion carried on a 6 -ayes, 0 -nays, 0- present, 1- absent (Cleven) vote. Chairperson Daninger asked how long they anticipated being at this site. Ms. Hill stated the lease is for 25 years. Chairperson Daninger asked if any other sites were looked at. Ms. Hill stated they have been reviewing this site for a while and did not remember if there were other sites. Chairperson Daninger asked if Ms. Hill was aware of the Andover Fun Festival in July and wondered if the project will be done before then. Ms. Hill stated she will work with staff on this item. Commissioner Nemeth asked if there is a reason why there are twelve antennas on the tower. Ms. Hill reviewed the reason for the twelve antennas. Commission Nemeth asked if the water tower space was large enough for the equipment. Ms. Hill indicated that was correct. Motion by Nemeth, seconded by Gudmundson, to close the public hearing at 7:42 p.m. Motion carried on a 6 -ayes, 0 -nays, 0- present, 1- absent (Cleven) vote. Regular Andover Planning and Zoning Commission Meeting Minutes — November 12, 2013 Page 5 PUBLIC HEARING: Consider a Sketch Plan for an eighteen (18) lot urban residential development located at 14123 Prairie Road NW, as requested by TH Construction. City Planner Hanson noted the purpose of this item is to hold a public hearing and take input on a Sketch Plan for an eighteen (18) lot urban residential development located at 14123 Prairie Road NW, as requested by TH Construction. City Planner Hanson reviewed the proposed sketch plan with the Commission. Commissioner Holthus asked if the existing residence on Lot 1, Block 1 will stay. Ms. Hanson indicated it would. Commissioner Gudmundson asked north of the ghost plat, if this has been coordinated with this development. Ms. Hanson indicated it will not be as the Catcher's Creek project is north of Coon Creek.. Commissioner Peterson asked if Prairie Road will be reconstructed. Mr. Carlberg was not sure of the reconstruction schedule for Prairie Road but indicated there is no access plan for this development onto Prairie Road. Commissioner Holthus stated since Prairie Road is a collector street and State Aid road, does the State have any criteria as to how many side streets can have access to it. Mr. Carlberg stated they try to limit the number of accesses onto Prairie Road. Motion by Nemeth, seconded by Koehler, to open the public hearing at 7:57 p.m. Motion carried on a 6 -ayes, 0 -nays, 0- present, 1- absent (Cleven) vote. Ms. Pixie Stockal, 601 1401h Lane NW, stated her concern with this project is that all of the traffic will come onto 1401h Lane and she wondered if there was a way they could do something so there is one egress into that development from Prairie Road because there will be a lot of traffic and there are currently a lot of children there. Mr. Carlberg stated there is a ghost plat and future development will warrant a future access onto Prairie Road and 140th does have capacity for additional traffic. Ms. Stockal asked if there was a way to slow the traffic down. Chairperson Daninger stated if there is an issue with speeding, the residents can contact the Sheriff's Department. Ms. Stockal wondered what will happen to the existing buildings on the property if this is developed. Mr. Carlberg indicated the applicant can address the question. Mr. Mark Madden, 14122 Prairie Road, stated he likes the sketch plan but his only concern is the fencing along Prairie Road. He thought the fences were atrocious and he Regular Andover Planning and Zoning Commission Meeting Minutes — November 12, 2013 Page 6 wondered if there was a way to prevent fencing abutting major roadways. His concern will be with the new houses in this development will put up fencing that will look bad. Mr. Carlberg reviewed the City Ordinance with the Commission. He noted the problem is that there is no uniform fencing regulations so as long as the fence is maintained, any type of fence can be installed. He stated this has been a concern of the look of the community. Mr. Todd Wold, 463 140`h Lane, asked if the developer is connected with the original Shadowbrook development. He was concerned because of the covenants in the existing development and if they will continue into this development. Mr. Ed Gritton, 14157 Prairie Road, stated he lived next to this property and one of his concerns is they own some horses and with the lot lines butting up to his lot line, what is he to anticipate with future homeowners and his horses, what will he be faced with. He wondered how he will be protected. Mr. Carlberg stated they have ordinances regarding keeping horses that also covers the manure management responsibilities of the horse owners that Mr. Gritton would have to comply with. Mr. Gritton stated the concern is the additional cost he may have to incur with manure maintenance. Mr. Carlberg stated if there will be an area where manure will be stored on the property he suggested moving it to the north or east on the property. Mr. Tony Hennen, 617 Main Street, Anoka, applicant, reviewed with the Commission the price point of homes he builds. Chairperson Daninger noted the covenants will be different than Shadowbrook because it is a different development. Commissioner Holthus asked if the existing home will remain, will it be reversed or what will happen. Mr. Hennen stated the house will stay as it is with the driveway coming off Prairie Road, it will be hooked up to City sewer and water, and the other buildings will be removed. Commissioner Peterson asked if the existing house is removed in the future and a new home is constructed, would there be enough frontage area off the cul -de -sac to build a new structure. Mr. Carlberg indicated there would be enough frontage on that site to build a new home. Commissioner Gudmundson asked if there will be covenants or restrictions on the development. Mr. Hennen indicated there will be covenants put in place but it will not be a continuation of the Shadowbrook development. Chairperson Daninger asked if a fence will be placed on the existing home facing Prairie Road. Mr. Hennen indicated that will be the front of the home so a tall fence cannot be placed along Prairie Road. Chairperson Daninger indicated this issue was seen City wide but thought Mr. Madden may want to meet with City staff to discuss it further. Mr. Carlberg suggested going before the City Council and discuss it during resident forum or to call or email the Council. Mr. Jerry Stockel, 601 140th Lane, asked if they will be notified by mail for the next meeting. Mr. Carlberg stated this will go before the City Council on November 19th but future meetings will have public notifications. Mr. Wold wondered how quickly the developer plans on moving forward with this project. Chairperson Daninger thought the applicant would want to start as soon as this project is approved. The applicant agreed. Motion by Holthus, seconded by Nemeth, to close the public hearing at 8:23 p.m. Motion carried on a 6 -ayes, 0 -nays, 0- present, 1- absent (Cleven) vote. Chairperson Daninger did not think there was a big issue with the size of the development, but there was a little bit of an issue with traffic. Commissioner Gudmundson thought the development looked nice and wondered if there could be berming on Lot 9 along Prairie Road so a fence may not be needed. City Planner Hanson stated this item would be before the Council at the November 19, 2013 City Council meeting. PUBLICHEARING. Community Development Director Carlberg noted the purpose of this item is to hold a public hearing and take input on Amendments to the City Code 12 -2 -2, Definitions; 12- 12, Permitted, Conditional and Prohibited Uses and 12 -14, Administration and Enforcement. Community Development Director Carlberg reviewed the proposed amendments with the Commission. Motion by Koehler, seconded by Nemeth, to open the public hearing at 8:33 p.m. Motion carried on a 6 -ayes, 0 -nays, 0- present, 1- absent (Cleven) vote. There was no public input. OTHER BUSINESS. Community Development Director Carlberg updated the Planning Commission on related items. Mr. Carlberg reviewed the Comprehensive Plan Amendment that was forwarded to the City Council in October. He stated the City Council approved the Amendment but with phasing in of the 83 acres over time. He noted the City Council had a concern with access into and out of the proposed development. MN.US TO: Planning and Zoning Commissioners FROM: Brett Angell, Associate Planner SUBJECT: PUBLIC HEARING: Conditional Use Permit _On -Site In Home Therapeutic Massage Services at 13847 Raven Street NW - Planning DATE: December 10, 2013 INTRODUCTION Kristine Maravelas, applicant, is seeking a conditional use permit for an in -home therapeutic massage establishment. Therapeutic massage is permitted as a conditional use in an R -4 Single Family -Urban zoned district as a Home Occupation. The 0.26 acre parcel is located North of Bunker Lake Blvd. NW. The proposed massage area will be located in a room in the basement and will require no physical changes to the interior or exterior. There will be no outdoor space used. DISCUSSION The applicant has been a massage therapist for 3 years and has worked at a variety of clinics. She opened A Healthier You in 2011 while renting space at City Chiropractic & Massage, and now would like to move her practice into her home. The clientele would be approximately 20 individuals. Days and Hours of Operation The applicant stated the days of operation at the facility will be daily from 8:00 a.m. to 9:00 p.m. Traffic Due to the small number of clients as well as the appoint -based nature of the business Raven Street, 137`h Lane NW, and Bunker Lake Boulevard NW will only receive a minimal increase in traffic and will not adversely affect the surrounding roadways. Parking City Code 12 -13 -8 specifies the number of parking spaces required for various uses. Being that the proposed space to be used for in -home therapeutic massage is also a single family home, they are considered one entity. Single Family Residential has a requirement of 2 spaces in addition to the required garage. The clients would park in the driveway of the home. Review Criteria 12 -14 -6 B: Criteria for Granting Conditional Use Permits: 1. In granting a Conditional Use Permit, the City Council shall consider the advice and recommendation of the Planning and Zoning Commission and: a. The effect of the proposed use upon the health, safety, morals, and general welfare of occupants of surrounding lands. b. Existing and anticipated traffic conditions, including parking facilities on adjacent streets and land. c. The effect on values of property and scenic view in the surrounding area, and the effect of the proposed use on the Comprehensive Plan. ACTION REQUESTED The Planning Commission is asked to hold a public hearing and provide a recommendation to the City Council regarding the conditional use permit request. Hanson, City Planner l` t A_ SUBJECT: PUBLIC HEARING: Preliminary Plat of Bent Creek Shores, a single - family urban residential development located at 13563 Crooked Lake Blvd NW DATE: December 10, 2013 INTRODUCTION The Planning Commission is asked to review a Preliminary Plat for Bent Creek Shores. The proposed preliminary plat contains 6 urban residential lots as proposed by Boulder Contracting, LLC. DISCUSSION Conformance with Local Plans and Ordinances 1. The property is located in the Metropolitan Urban Service Area (MUSA). 2. The property is currently zoned R -4, Single Family Urban Residential. Street Access The 3.04 acre parcel abuts Crooked Lake Blvd NW therefore all lots will be accessed by this road. Sewer and Water Access The sanitary sewer and water services are already available to each of the lots. Water stubs were constructed as part of the 1997 street reconstruction project for Crooked Lake Blvd NW and sewer stubs have been in place since 1975. Coon Creek Watershed District The Coon Creek Watershed District (CCWD) has reviewed the preliminary plat. The watershed may table the permit request at the December 9, 2013 watershed meeting until their comments are satisfactorily addressed. The CCWD letter is attached for your review., Lots Each of the 6 lots meets the minimum lot width of 80 feet, depth of 130 feet and the 11,400 square foot area requirement of the R -4 Zoning District. Average lot size is approximately 21,780 square feet (0.5 acre). Easements City code requires a 5 foot side, front, and rear yard easements. The plat meets code requirements; however, a 15 foot drainage and utility easement and a separate Maintenance Vehicle Access easement will be required on the north side of the plat. This will provide the City access to the storm water drainage basins to complete necessary maintenance procedures. Tree Preservation Tree preservation will occur within the floodway and flood fringe and in other various areas around the site. The city's Natural Resources Technician reviewed the plat and has provided comments. The detailed tree preservation plan is attached. Andover Review Committee (ARC) ARC completed a review of the preliminary plat and submitted comments to the developer. Staff comments dated November 25, 2013 has been attached for your review. The developer has responded to the city's comments; the attached plat addresses most of these comments. Engineering staff will begin the 2 "d review of the plat the week of December 9, 2013. As part of the approval of the preliminary plat, staff recommends that engineering comments must be satisfied prior to any grading of the site. Park and Recreation Commission Recommendation The Park and Recreation Commission will review the preliminary plat on December 19, 2013 to make a recommendation to City Council. Staff will request the Parks and Recreation Commission recommend cash dedication in lieu of land. ACTION REQUESTED The Planning Commission is asked to hold a public hearing, review the proposed preliminary plat and to make a recommendation to the City Council. XXX AN ORDINANCE AMENDING THE CITY CODE TO ADD DEFINITIONS AND UPDATE MULTIPLE SECTIONS OF FLOOD CONTROL REGULATIONS THE CITY COUNCIL OF THE CITY OF ANDOVER DOES HEREBY ORDAIN AS FOLLOWS: CITY CODE TITLE 14: FLOOD CONTROL CHAPTER 1: FLOOD CONTROL REGULATIONS 14 -1 -1: STATUTORY AUTHORIZATION: The legislature of the state has, in Minnesota statutes chapters 103F and 462, delegated the responsibility to local governmental units to adopt regulations designed to minimize flood losses. Therefore, the city council does ordain the provisions of this chapter. (Ord. 107, 2 -21 -1995) 14 -1 -2: FINDINGS OF FACT: A. EQUAL DEGREE OF ENCROACHMENT: A method of determining the location of floodway boundaries so that floodplain lands on both sides of a stream are capable of conveying a proportionate share of flood flows. FLOOD: A temporary increase in the flow or stage of a stream or in the stage of a lake that results in the inundation of normally dry areas. FLOOD FREQUENCY: The frequency for which it is expected that a specific flood stage or discharge may be equaled or exceeded. FLOOD FRINGE: That portion of the floodplain outside of the floodway. "Flood fringe" is synonymous with the term "floodway fringe" used in the flood insurance study for the city of Andover. FLOODPLAIN: The beds proper and the areas adjoining a wetland, lake or watercourse that have been or hereafter may be covered by the regional flood. FLOODPROOFING: A combination of structural provisions, changes, or adjustments to properties and structures subject to flooding, primarily for the reduction or elimination of flood damages. FLOODWAY: The bed of a wetland or lake and the channel of the watercourse and those portions of the adjoining floodplain which are reasonably required to carry and discharge the regional flood. LOWEST FLOOR: The lowest floor of the lowest enclosed area (including basement). An unfinished or flood resistant enclosure, used solely for parking of vehicles, building access, or storage in an area other than a basement area, is not considered a building's lowest floor. MANUFACTURED HOME: A structure, transportable in one or more sections, which is built on a permanent chassis and is designed for use with or without a permanent foundation when attached to the required utilities. The term "manufactured home" does not include the term "recreational vehicle." OBSTRUCTION: Any dam, wall, wharf, embankment, levee, dike, pile, abutment, projection, excavation, channel modification, culvert, building, wire, fence, stockpile, refuse, fill, structure, or matter in, along, across, or projecting into any channel, watercourse, or regulatory floodplain which may impede, retard, or change the direction of the flow of water, either in itself or by catching or collecting debris carried by such water. PRINCIPAL USE OR STRUCTURE: All uses or structures that are not accessory uses or structures. REACH: A hydraulic engineering term to describe a longitudinal segment of a stream or river influenced by a natural or manmade obstruction. In an urban area, the segment of a stream or river between two (2) consecutive bridge crossings would most typically constitute a "reach ". VEHICLE: A vehicle that is built on a single chassis, is 400 square feet or less when measured at the largest horizontal projection, is designed to be self - propelled or permanently towable by a light duty truck, and is designed primarily not for use as a permanent dwelling but as temporary living quarters for recreational, camping, travel, or seasonal use. For purposes of this Chapter, the term recreational vehicle shall be synonymous with the term travel trailer/ travel vehicle. REGIONAL FLOOD: A flood which is representative of large floods known to have occurred generally in Minnesota and reasonably characteristic of what can be expected to occur on an average frequency in the magnitude of the 100 -year recurrence interval. "Regional flood" is synonymous with the term "base flood" used in the flood insurance study. REGULATORY FLOOD PROTECTION ELEVATION: An elevation no lower than one foot (1') above the elevation of the regional flood plus any increases in flood elevation caused by encroachments on the floodplain that result from designation of a floodway. STRUCTURE: Anything constructed or erected on the ground or attached to the ground or on site utilities, including, but not limited to, buildings, factories, sheds, detached garages, cabins, manufactured homes, travel trailers /vehicles not meeting the exemption criteria specified in Subsection 14 -1 -12132 of this chapter and other similar items. VARIANCE: A modification of a specific permitted development standard required in an official control, including this chapter, to allow an alternative development standard not stated as acceptable in the official control, but only as applied to a particular property for the purpose of alleviating a hardship, practical difficulty or unique circumstances as defined and elaborated upon in the city's respective planning and zoning enabling legislation. (Ord. 107, 2 -21 -1995; amd. 2003 Code) 14 -1 -7: FLOODWAY DISTRICT (FW): A. Permitted Uses: 1. Uses Enumerated: General farming, pasture, grazing, outdoor plant nurseries, horticulture, truck farming, forestry, sod farming, and wild crop harvesting. Industrial- commercial loading areas, parking areas, and airport landing strips. Private and public golf courses, tennis courts, driving ranges, archery ranges, picnic grounds, boat launching ramps, swimming areas, parks, wildlife and nature preserves, game farms, fish hatcheries, shooting preserves, target ranges, trap and skeet ranges, hunting and fishing areas, and single or multiple purpose recreational trails. Residential lawns, gardens, parking areas, and play areas. 2. Standards: a. The use shall have a low flood damage potential. b. The use shall be permissible in the underlying zoning district. c. The use shall not obstruct flood flows or increase flood elevations and shall not involve structures, fill, obstructions, excavations or storage of materials or equipment. B. Conditional Uses: 1. Uses Enumerated: Structures accessory to the uses listed in subsection A of this section and the uses listed below. Extraction and storage of sand, gravel, and other materials. Marinas, boat rentals, docks, piers, wharves, and water control structures. Placement of fill. Railroads, streets, bridges, utility transmission lines, and pipelines. Storage yards for equipment, machinery, or materials. Placement of fill or construction of fences. Structural works for flood control such as levees, dikes and floodwalls constructed to any height where the intent is to protect individual structures and levees or dikes where the intent is to protect agricultural crops for a frequency flood event equal to or less than the 10 -year frequency flood event. Travel trailers and travel vehicles either on individual lots of record or in existing or new subdivisions or commercial or condominium type campgrounds, subject to the exemptions and provisions of Subsection 14 -1 -12B of this chapter. 2. Standards: a. Increase In Flood Stage Prohibited: No structure (temporary or permanent), fill (including fill for roads and levees), deposit, obstruction, storage of materials, or equipment, or other uses may be allowed as a conditional use that will cause any increase in the stage of the 100 -year or regional flood or cause an increase in flood damages in the reaches affected. b. Procedures And Standards: All floodway conditional uses shall be subject to the procedures and standards contained in Subsection 14 -1 -14C of this chapter. c. Permitted In Underlying Zoning District: The conditional use shall be permissible in the underlying zoning district. d. Fill: (1) Fill, dredge spoil and all similar materials deposited or stored in the floodplain shall be protected from erosion by vegetative cover, mulching, riprap or other acceptable method. (2) Dredge spoil sites and sand and gravel operations shall not be allowed in the floodway unless a long term site development plan is submitted which includes an erosion /sedimentation prevention element to the plan. (3) As an alternative, and consistent with Subsection B2d(2) of this section, dredge spoil disposal and sand and gravel operations may allow temporary, on site storage of fill or other materials which would have caused an increase to the stage of the 100year or regional flood but only after the governing body has received an appropriate plan which assures the removal of the materials from the floodway based upon the flood warning time available. The Conditional Use Permit must be title registered with the property in the office of the County Recorder. e. Accessory Structures: (1) Accessory structures shall not be designed for human habitation. (2) Accessory structures, if permitted, shall be constructed and placed on the building site so as to offer the minimum obstruction to the flow of floodwaters. (A) Whenever possible, structures shall be constructed with the longitudinal axis parallel to the direction of flood flow; and (B) So far as practicable, structures shall be placed approximately on the same flood flow lines as those of adjoining structures. (3) Accessory structures shall be elevated on fill or structurally dry flood - proofed in accordance with FP -1 or FP- 2 flood - proofing classifications in the state building code. As an alternative, an accessory structure may be flood - proofed to the FP -3 or FP -4 flood - proofing classification in the State Building Code, provided the accessory structure constitutes a minimal investment, does not exceed five hundred (500) square feet in size, and for a detached garage, the detached garage must be used solely for parking of vehicles and limited storage. All flood - proofed accessory structures must meet the following additional standards, as appropriate: (A) The structure must be adequately anchored to prevent flotation, collapse or lateral movement of the structure and shall be designed to equalize hydrostatic flood forces on exterior walls; and (B) Any mechanical and utility equipment in a structure must be elevated to or above the regulatory flood protection elevation or properly flood - proofed. (C) To allow for the equalization of hydrostatic pressure, there must be a minimum of two "automatic" openings in the outside walls of the structure having a total net area of not less than one square inch for every square foot of enclosed are subject to flooding. There must be openings on at least two sides of the structure and the bottom of all openings must be no higher than one foot above the lowest adjacent grade to the structure. Using human intervention to open a garage door prior to flooding will not satisfy this requirement for automatic openings. f. Storage Of Materials And Equipment: (1) The storage or processing of materials that are, in time of flooding, flammable, explosive, or potentially injurious to human, animal, or plant life is prohibited. (2) Storage of other materials or equipment may be allowed if readily removable from the area within the time available after a flood warning and in accordance with a plan approved by the governing body. g. Changes In Waterways: Structural works for flood control that will change the course, current, or cross section of protected wetlands or public waters shall be subject to the provisions of Minnesota Statutes Chapter 103G. Communitywide structural works for flood control intended to remove areas from the regulatory floodplain shall not be allowed in the floodway. h. Levees, Dikes And Floodwalls: A levee, dike or floodwal constructed in the floodway shall not cause an increase to the 100 - year or regional flood, and the technical analysis must assume equal conveyance or storage loss on both sides of a stream. (Ord. 107, 2 -21 -1995) 14 -1 -8: FLOOD FRINGE DISTRICT (FF): A. Permitted Uses: 1. Uses Enumerated: Permitted uses shall be those uses of land or structures listed as permitted uses in the underlying zoning use district(s). If no pre- existing, underlying zoning use districts exist, then any residential or non residential structure or use of a structure or land shall be a permitted use in the Flood Fringe District provided such use does not constitute a public nuisance. All permitted uses shall comply with the standards for flood fringe permitted uses listed in Subsection A2 of this section and the standards for all flood fringe uses listed in Subsection C of this section. 2. Standards: a. All structures, including accessory structures, must be elevated on fill so that the lowest floor, including basement floor, is at or above the regulatory flood protection elevation. The finished fill elevation for structures shall be no lower than one foot (1') below the regulatory flood protection elevation, and the fill shall extend at such elevation at least fifteen feet (15') beyond the limits of any structure erected thereon. b. As an alternative to elevation on fill, accessory structures that constitute a minimal investment and that do not exceed five hundred (500) square feet for the outside dimension at ground level may be internally flood - proofed in accordance with Subsection 14- 1-7132e(3) of this chapter. c. The cumulative placement of fill where at any one time in excess of one thousand (1,000) cubic yards of fill is located on the parcel shall be allowable only as a conditional use, unless said fill is specifically intended to elevate a structure in accordance with Subsection A2a of this section. d. The storage of any materials or equipment shall be elevated on fill to the regulatory flood protection elevation. e, The provisions of Subsection C of this section shall apply. B. Conditional Uses: 1. Uses Enumerated: Any structure that is not elevated on fill or flood - proofed in accordance with Subsections A2a and A2b of this section or any use of land that does not comply with the standards in Subsections A2c and A2d of this section shall only be allowable as a conditional use. An application for a conditional use shall be subject to the standards, criteria and evaluation procedures specified in Subsections B2 and C of this section and Subsection 14 -1 -14C of this chapter. 2. Standards: a. Alternative Elevation Methods: (1) Alternative elevation methods other than the use of fill may be utilized to elevate a structure's lowest floor above the regulatory flood protection elevation. These alternative methods may include the use of stilts, pilings, parallel walls, etc., or above grade, enclosed areas such as crawispaces or tuck -under garages. The base or floor of an enclosed area shall be considered above grade and not a structure's basement or lowest floor, if: a) the enclosed area is above grade on at least one side of the structure; b) it is designed to internally flood and is constructed with flood resistant materials; c) it is used solely for the parking of vehicles, building access or storage. (2) The above noted alternative elevation methods are subject to the following additional standards: (A) Design And Certification: The structure's design and as built condition must be certified by a registered professional engineer or architect as being in compliance with the general design standards of the state building code and, specifically, that all electrical, heating, ventilation, plumbing and air conditioning equipment and other service facilities must be at or above the regulatory flood protection elevation or designed to prevent floodwater from entering or accumulating within these components during times of flooding. (B) Specific Standards For Above grade, Enclosed Areas: Above grade, fully enclosed areas such as crawispaces or tuck under garages must be designed to internally flood, and the design plans must stipulate: i. The minimum area of openings in the walls where internal flooding is to be used as a flood - proofing technique. When openings are placed in a structure's walls to provide for entry of floodwaters to equalize pressures, the bottom of all openings shall be no higher than one foot (1') above grade. Openings may be equipped with screens, louvers, valves, or other coverings or devices; provided, that they permit the automatic entry and exit of floodwaters. ii. That the enclosed area will be designed of flood resistant materials in accordance with the FP -3 or FP -4 classifications in the State Building Code and shall be used solely for building access, parking of vehicles or storage. b. Basements: 'Basements ", as defined by Section 14 -1 -4 of this chapter, shall be subject to the following: (1) Residential basement construction shall not be allowed below the regulatory flood protection elevation. (2) Nonresidential basements may be allowed below the regulatory flood protection elevation, provided the basement is structurally dry flood - proofed in accordance with Subsection 132c of this section. c. Nonresidential Structures: All areas of nonresidential structures, including basements, to be placed below the regulatory flood protection elevation shall be flood - proofed in accordance with the structurally dry flood- proofing classifications in the state building code. Structurally dry flood - proofing must meet the FP -1 or FP -2 flood- proofing classification in the State Building Code, and this shall require making the structure watertight with the walls substantially impermeable to the passage of water and with structural components having the capability of resisting hydrodynamic loads and the effects of buoyancy. Structures flood - proofed to the FP -3 or FP -4 classification shall not be permitted. d. Fill; Erosion /Sedimentation Control Plan: When, at any one time, more than one thousand (1,000) cubic yards of fill or other similar material is located on a parcel for such activities as on site storage, landscaping, sand and gravel operations, roads, dredge spoil disposal or construction of flood control works, an erosion /sedimentation control plan must be submitted unless the city is enforcing a state approved shoreland management ordinance'. In the absence of a state approved shoreland ordinance, the plan must clearly specify methods to be used to See title 13, chapter 4 of this code, stabilize the fill on site for a flood event at a minimum of the 100 - year regional flood event. The plan must be prepared and certified by a registered professional engineer or other qualified individual acceptable to the city. The plan may incorporate alternative procedures for removal of the material from the floodplain if adequate flood warning time exists. e. Storage Of Materials And Equipment: (1) The storage or processing of materials that are, in time of flooding, flammable, explosive, or potentially injurious to human, animal, or plant life is prohibited. (2) Storage of other materials or equipment may be allowed if readily removable from the area within the time available after a flood warning and in accordance with a plan approved by the city. f. Other Standards: The provisions of Subsection C of this section shall also apply. C. Standards For All Flood Fringe Uses: 1. Access: All new principal structures must have vehicular access at or above an elevation not more than two feet (2) below the regulatory flood protection elevation. If a variance to this requirement is granted, the board of adjustment must specify limitations on the period of use or occupancy of the structure for the times of flooding and only after determining that adequate flood warning time and local flood emergency response procedures exist. 2. Commercial Uses: Accessory land uses, such as yards, railroad tracks, and parking lots, may be at elevations lower than the regulatory protection elevation. However, a permit for such facilities to be used by the employees or the general public shall not be granted in the absence of a flood warning system that provides adequate time for evacuation if the area would inundate to a depth greater then two feet (2) or be subject to flood velocities greater than four feet (4') per second upon occurrence of the regional flood. 3. Manufacturing And Industrial Uses: Measures shall be taken to minimize interference with normal plant operations especially along streams having protracted flood durations. Certain accessory land uses such as yards and parking lots may be at lower elevations subject to requirements set out in Subsection C2 of this section. In considering permit applications, due consideration shall be given to needs of an industry whose business requires that it be located in floodplain areas. 4. Fill: Fill shall be properly compacted and the slopes shall be properly protected by the use of riprap, vegetative cover or other acceptable method. The Federal Emergency Management Agency (FEMA) has established criteria for removing the special flood hazard area designation for certain structures properly elevated on fill above the 100 -year flood elevation. FEMA requirements incorporate specific fill compaction and side slope protection standards for multi- structure or multi -lot developments. These standards should be investigated prior to the initiation of site preparation if a change of special flood hazard area designation will be requested. 5. Encroachment Limit: Floodplain developments shall not adversely affect the hydraulic capacity of the channel and adjoining floodplain of any tributary watercourse or drainage system where a floodway or other encroachment limit has not been specified on the official zoning map. 6. Travel Trailers And Travel Vehicles: Standards for travel trailers and travel vehicles are contained in Subsection 14 -1 -12B of this chapter. 7. Manufactured Homes: All manufactured homes must be securely anchored to an adequately anchored foundation system that resists flotation, collapse and lateral movement. Methods of anchoring may include, but are not limited to, use of over the top or frame ties to ground anchors. This requirement is in addition to applicable state or local anchoring requirements for resisting wind forces. (Ord. 107, 2 -21 -1995) 14 -1 -9: GENERAL FLOODPLAIN DISTRICT: A. Permitted Uses: 1. Permitted uses shall include those uses permitted by Subsection 14-1 - 7A1 of this chapter. 2. All other uses shall be subject to the floodway /flood fringe evaluation criteria pursuant to Section B of this section. Section 14 -1 -7 of this chapter shall apply if the proposed use is in the floodway district, and Section 14- 1-8 of this chapter shall apply if the proposed use is in the flood fringe district. B. Procedures For Floodway And Flood Fringe Determinations Within General Floodplain District: 1. Upon receipt of an application for a Conditional Use Permit for a use within the general floodplain district, the applicant shall be required to furnish such of the following information as is deemed necessary by the zoning administrator for the determination of the regulatory flood protection elevation and whether the proposed use is within the floodway or flood fringe district: a. A typical valley cross section showing the channel of the stream, elevation of land areas adjoining each side of the channel, cross sectional areas to be occupied by the proposed development, and high water information. b. Plan (surface view) showing elevations or contours of the ground; pertinent structure, fill, or storage elevations; size, location and spatial arrangement of all proposed and existing structures on the site; location and elevations of streets; photographs showing existing land uses and vegetation upstream and downstream; and soil type. c. Profile showing the slope of the bottom of the channel or flow line of the stream for at least five hundred feet (500') in either'direction from the proposed development. d. Photographs showing existing land uses, vegetation upstream and downstream, and soil types. 2. The applicant shall be responsible to submit one copy of the above information to a designated engineer or other expert person or agency for technical assistance in determining whether the proposed use is in the floodway or flood fringe and to determine the regulatory flood protection elevation. Procedures consistent with Minnesota Regulations 1983, Parts 6120.5000 - 6120.6200 shall be followed in this expert evaluation. The designated engineer or expert is strongly encouraged to discuss the proposed technical evaluation methodology with the respective Department of Natural Resources' area hydrologist prior to commencing the analysis. The designated engineer or expert shall: a. Estimate the peak discharge of the regional flood. b. Calculate the water surface profile of the regional flood based upon a hydraulic analysis of the stream channel and overbank areas. c. Compute the floodway necessary to convey the regional flood without increasing flood stages more than five - tenths foot (05). A lesser stage increase than five- tenths foot (0.5') shall be required if, as a result of the additional stage increase, increased flood damage would result. An equal degree of encroachment on both sides of the stream within the reach shall be assumed in computing floodway boundaries. 3. The Zoning Administrator shall present the technical evaluation and findings of the designated engineer or expert to the planning and zoning commission. The Planning and Zoning Commission must formally accept the technical evaluation and the recommended floodway and/or flood fringe district boundary or deny the permit application. The City Council, prior to official action, may submit the application and all supporting data and analyses to the Federal Emergency Management Agency, the Department of Natural Resources or the Planning and Zoning Commission for review or comment. Once the floodway and flood fringe boundaries have been determined, the governing body shall refer the matter back to the zoning administrator who shall process the permit application consistent with the applicable provisions of Sections 14 -1 -7 and 14 -1 -8 of this chapter. (Ord. 107, 2 -21 -1995) 14 -1 -12: MANUFACTURED HOMES AND PARKS; TRAVEL TRAILERS AND TRAVEL VEHICLES: A. Manufactured Homes And Manufactured Home Parks: 1. Manufactured Home Parks: New manufactured home parks and expansions to existing manufactured home parks shall be subject to the provisions placed on subdivisions by Section 14 -1 -10 of this chapter. (Ord. 107, 2 -21 -1995) 2. Manufactured Homes: a. The placement of new or replacement of manufactured homes in existing manufactured home parks that are located in floodplain districts will be treated as new structures and may be placed only if elevated in compliance with Section 14 -1 -8 of this chapter. If vehicular road access for preexisting manufactured home parks is not provided in accordance with Subsection 14 -1 -8C1 of this chapter, then replacement manufactured homes will not be allowed until the property owner develops a flood warning emergency plan acceptable to the city. (Ord. 107, 2 -21 -1995; amd. 2003 Code) b. All manufactured homes must be securely anchored to an adequately anchored foundation system that resists flotation, collapse and lateral movement. Methods of anchoring may include, but are not limited to, use of over the top or frame ties to ground anchors. This requirement is in addition to applicable state or local anchoring requirements for resisting wind forces. B. Travel Trailers And Travel Vehicles: 1. Application Of Provisions: Travel trailers and travel vehicles that do not meet the exemption criteria in Subsection B2a of this section, shall be subject to the provisions of this chapter and as specifically spelled out in Subsections 62c and B2d of this section. 2. Exemptions: a. Travel trailers and travel vehicles are exempt from the provisions of this chapter if they are placed in any area listed in Subsection 13215 of this section, and further, if they meet the following criteria: (1) Have current licenses required for highway use. (Ord. 107, 2 -21 -1995) (2) Are highway ready, meaning on wheels. They are attached to the site only by quick disconnect type utilities commonly used in campgrounds and trailer parks, and the travel trailer or travel vehicle has no permanent structural type additions attached to it. (Ord. 107, 2 -21 -1995; amd. 2003 Code) (3) The travel trailer or travel vehicle and associated use must be permissible in any preexisting, underlying zoning use district. b. Areas exempted for placement of travel/recreational vehicles: (1) Individual lots or parcels of record. (2) Existing commercial recreational vehicle parks or campgrounds. (3) Existing condominium type associations. c. Travel trailers and travel vehicles exempted in Subsection 132a of this section lose this exemption when development occurs on the parcel exceeding five hundred dollars ($500.00) for a structural addition to the travel trailer /travel vehicle or an accessory structure such as a garage or storage building. The travel trailer /travel vehicle and all additions and accessory structures will then be treated as a new structure and shall be subject to the elevation /flood- proofing requirements and the use of land restrictions specified in Sections 14 -1 -7 and 14 -1 -8 of this chapter. There shall be no development or improvement on the parcel or attachment to the travel trailer /travel vehicle that hinders the removal of the travel trailer /travel vehicle to a flood free location should flooding occur. d. New commercial travel trailer or travel vehicle parks or campgrounds and new residential type subdivisions and condominium associations and the expansion of any existing similar use exceeding five (5) units or dwelling sites shall be subject to the following: (1) Any new or replacement travel trailer or travel vehicle will be allowed in the floodway or flood fringe districts, provided said trailer or vehicle and its contents are placed on fill above the regulatory flood protection elevation and properly elevated road access to the site exists in accordance with Subsection 14 -1 -8C1 of this chapter. No fill placed in the floodway to meet the requirements of this subsection shall increase flood stages of the 100 -year or regional flood. (2) All new or replacement travel trailers or travel vehicles not meeting the criteria of Subsection B2d(1) of this section may, as an alternative, be allowed as a conditional use if in accordance with the following provisions and the provisions of Subsection 14 -1 -14C of this chapter. The applicant must submit an emergency plan for the safe evacuation of all vehicles and people during the 100 -year flood. Said plan shall be prepared by a registered engineer or other qualified individual and shall demonstrate that adequate time and personnel exist to carry out the evacuation. All attendant sewage and water facilities for new or replacement travel trailers or other recreational vehicles must be protected or constructed so as not to be impaired or contaminated during times of flooding in accordance with Subsection 14 -1 -11C of this chapter. (Ord. 107, 2 -21 -1995) 14 -1 -14: PERMITS AND CERTIFICATES2: A. Use Permit: 1. Permit Required: A use permit issued by the Zoning Administrator in conformity with the provisions of this chapter shall be secured: prior to the erection, addition, or alteration of any building, structure, or portion thereof; prior to the use or change of use of a building, structure, or land; 2 See also subsections 13 -44A and B of this code. prior to the change or extension of a nonconforming use; and prior to the placement of fill, excavation of materials, or the storage of materials or equipment within the floodplain. 2. Application For Permit: Application for a use permit shall be made in duplicate to the Zoning Administrator on forms furnished by the Zoning Administrator and shall include the following where applicable: plans in duplicate drawn to scale, showing the nature, location, dimensions, and elevations of the lot; existing or proposed structures, fill, or storage of materials; and the location of the foregoing in relation to the stream channel. 3. State And Federal Permits: Prior to granting a use permit or processing an application for a Conditional Use Permit or variance, the Zoning Administrator shall determine that the applicant has obtained all necessary state and federal permits. 4. Other Certificates: The applicant shall be required to submit certification by a registered professional engineer, registered architect, or registered land surveyor that the finished fill and building elevations were accomplished in compliance with the provisions of this chapter. Flood - proofing measures shall be certified by a registered professional engineer or registered architect. 5. Notifications for Watercourse Alterations. The Zoning Administrator shall notify, in riverine situations, adjacent communities and the Commissioner of the Department of Natural Resources prior to the community authorizing any alteration or relocation of a watercourse. If the applicant has applied for a permit to work in the beds of public waters pursuant to the Minnesota Statute, Chapter 103G, this shall suffice as adequate notice to the Commissioner of Natural Resources. A copv of said notification shall also be submitted to the Chicago Regional Office of the Federal Emergency Management Agency (FEMA). 6. Notification to FEMA When Physical Changes Increase or Decrease the 100 -year Flood Elevation. As soon as is practicable, but no later than six (6) months after the date such supporting information becomes available, the Zoning Administrator shall notify the Chicago Regional Office of FEMA of the changes by submitting a copy of said technical or scientific data. B. Certificate Of Zoning Compliance: It shall be unlawful to use, occupy, or permit the use or occupancy of any building or premises or part thereof hereafter created, erected, changed, converted, altered, or enlarged in its use or structure until a certificate of zoning compliance shall have been issued by the Zoning Administrator stating that the use of the building or land conforms to the requirements of this chapter. (Ord. 107, 2 -21 -1995) C. Conditional Use Permit: 1. General Provisions: a. Applications shall be submitted to the Zoning Administrator who shall forward the application to the Planning and Zoning Commission for consideration. The Planning and Zoning Commission shall hear and forward recommendations regarding applications to the City Council for conditional uses permissible under this chapter. Upon filing with the Zoning Administrator an application for a Conditional Use Permit, the Zoning Administrator shall submit by mail to the Commissioner of Natural Resources of the state a copy of the application for proposed Conditional Use sufficiently in advance so that the Commissioner will receive at least ten (10) days' notice of the hearing. b. The City Council shall arrive at a decision on a conditional use within sixty (60) days. In granting a Conditional Use Permit, the City Council shall prescribe appropriate conditions and safeguards, in addition to those specified in Subsection C5 of this section, which are in conformity with the purposes of this chapter. Violations of such conditions and safeguards, when made a part of the terms under which the conditional use permit is granted, shall be deemed a violation of this chapter punishable under Section 14 -1 -17. A copy of all decisions granting Conditional Use Permits shall be forwarded by mail to the Commissioner of Natural Resources of the state within ten (10) days of such action. (Ord. 107, 2 -21 -1995; amd. 2003 Code) 2. Procedures: Procedures to be followed by the City Council in passing on Conditional Use Permit applications within all floodplain districts shall be as follows: a. Require the applicant to furnish such of the following information and additional information as deemed necessary by the Planning and Zoning Commission for determining the suitability of the particular site for the proposed use: (1) Plans in triplicate drawn to scale showing the nature, location, dimensions, and elevations of the lot, existing or proposed structures, fill, storage of materials, flood - proofing measures, and the relationship of the above to the location of the stream channel. (2) Specifications for building construction and materials, flood - proofing, filling, dredging, grading, channel improvement, storage of materials, water supply and sanitary facilities. b. Transmit one copy of the information described in Subsection C2a(1) of this section to a designated engineer or other expert person or agency for technical assistance, where necessary, in evaluating the proposed project in relation to flood heights and velocities, the seriousness of flood damage to the use, the adequacy of the plans for protection, and other technical matters. c. Based upon the technical evaluation of the designated engineer or expert, the planning and zoning commission shall determine the specific flood hazard at the site and evaluate the suitability of the proposed use in relation to the flood hazard. 3. Factors Considered For Approval: In passing upon conditional use applications, the City Council shall consider all relevant factors specified in other sections of this chapter, and: a. The danger of life and property due to increased flood heights or velocities caused by encroachments. b. The danger that materials may be swept onto other lands or downstream to the injury of others. c. The proposed water supply and sanitation systems and the ability of these systems to prevent disease, contamination, and unsanitary conditions. d. The susceptibility of the proposed facility and its contents to flood damage and the effect of such damage on the individual owner. e. The importance of the services provided by the proposed facility to the community. f. The requirements of the facility for a waterfront location. g. The availability of alternative locations not subject to flooding for the proposed use. h. The compatibility of the proposed use with existing development and development anticipated in the foreseeable future. i. The relationship of the proposed use to the comprehensive plan and floodplain management program for the area. j. The safety of access to the property in times of flood for ordinary and emergency vehicles. k. The expected heights, velocity, duration, rate of rise, and sediment transport of the floodwaters expected at the site. I. Such other factors which are relevant to the purposes of this chapter. 4. Time For Acting On Application: The City Council shall act on an application in the manner described above within sixty (60) days from receiving the application; except, that where additional information is required pursuant to Subsections C2 and C3 of this section, the City Council shall render a written decision within sixty (60) days from the receipt of such additional information. 5. Conditions Attached To Conditional Use Permits: Upon consideration of the factors listed above and the purposes of this chapter, the City Council shall attach such conditions to the granting of Conditional Use Permits as it deems necessary to fulfill the purposes of this chapter. Such conditions may include, but are not limited to, the following: a. Modification of waste disposal and water supply facilities. b. Limitations on period of use, occupancy, and operation. c. Imposition of operational controls, sureties, and deed restrictions. d. Requirements for construction of channel modifications, dikes, levees, and other protective measures. e. Flood- proofing measures, in accordance with the State Building Code and this chapter. The applicant shall submit a plan or document certified by a registered professional engineer or architect that the flood - proofing measures are consistent with the regulatory flood protection elevation and associated flood factors for the particular area. D. Construction And Use To Comply: Use permits, conditional use permits, or certificates of zoning compliance issued on the basis of approved plans and applications authorize only the use, arrangement, and construction set forth in such approved plans and applications and no other use, arrangement, or construction. Any use, arrangement, or construction at variance with that authorized shall be deemed a violation of this chapter and punishable as provided by Section 14 -1 -17 of this chapter. Record Of First Floor Elevation: The Building Official shall maintain a record of the elevation of the first floor (including basement) of all new structures or additions to existing structures in the floodplain districts. He /she shall also maintain a record of the elevations to which structures or additions to structures are flood - proofed. (Ord. 107, 2 -21 -1995; amd. 2003 Code) 14 -1 -17: VIOLATION; PENALTIES: Violation of the provisions of this chapter or failure to comply with any of its requirements (including violations of conditions and safeguards established in connection with grants of variances or conditional uses) shall constitute a misdemeanor and, upon conviction thereof, shall be punished as defined by law. Nothing herein contained shall prevent the city from taking such other lawful action as is necessary to prevent or remedy any violation. Such actions may include, but are not limited to: A. In responding to a suspect violation, the Zoning Administrator and the City Council may utilize the full array of enforcement actions available to it including, but not limited to, prosecution and fines, injunctions, after the fact permits, orders for corrective measures or a request to the national flood insurance program for denial of flood insurance availability to the guilty party. The city must act in good faith to enforce these official controls and to correct violations to the extent possible so as not to jeopardize its eligibility in the National Flood Insurance Program. B. When a violation is either discovered by or brought to the attention of the Zoning Administrator, the Zoning Administrator shall immediately investigate the situation and document the nature and extent of the violation of the official control. As soon as it is reasonably possible, this information will be submitted to the appropriate State Department of Natural Resources and Federal Emergency Management Agency regional office along with the city's plan of action to correct the violation to the degree possible, C. The Zoning Administrator shall notify the suspected party of the requirements of this chapter and all other official controls and the nature and extent of the suspected violation of these controls. If the structure and/or use is under construction or development, the Zoning Administrator may order the construction or development immediately halted until a proper permit or approval is granted by the city. If the construction or development is already completed, the Zoning Administrator may either: 1) issue an order identifying the corrective actions that must be made within a specified time period to bring the use or structure into compliance with the official controls; or 2) notify the responsible party to apply for an after the fact permit/development approval within a specified period of time not to exceed thirty (30) days. (Ord. 107, 2 -21 -1995; amd. 2003 Code) D. If the responsible party does not appropriately respond to the Zoning Administrator within the specified period of time, each additional day that lapses shall constitute an additional violation of this Chapter and shall be prosecuted accordingly. The Zoning Administrator shall also upon the lapse of the specified response period notify the landowner to restore the land to the condition which existed prior to the violation of this Chapter.
