The Planning and Zoning Commission is requested to approve the minutes from the June 11, 2013 workshop. - ► PLANNING AND ZONING COMMISSION MEETING — MAY 14, 2013 The Regular Bi- Monthly Meeting of the Andover Planning and Zoning Commission was called to order by Chairperson Daninger on May 14, 2013, 7:00 p.m., at the Andover City Hall, 1685 Crosstown Boulevard NW, Andover, Minnesota. Commissioners present: Chairperson Daninger, Commissioners Timothy Cleven, Valerie Holthus, Kyle Nemeth, Lynae Gudmundson, Bert Koehler and Steve Peterson. Commissioners absent: None Also present: Community Development Director Dave Carlberg City Planner Stephanie Hanson Associate Planner Andrew Liska Others APPROVAL OFMINUTES. March 12, 2013 Regular Minutes Commissioner Koehler indicated his name was misspelled and asked to have it corrected. Motion by Holthus, seconded by Koehler, to approve the minutes as amended. Motion carried on a 6 -ayes, 0 -nays, 1- present ( Cleven), 0- absent vote. April 9, 2013 Workshop Motion by Holthus, seconded by Cleven, to approve the minutes as presented. Motion carried on a 5 -ayes, 0 -nays, 2- present (Koehler, Peterson), 0- absent vote. APPOINTMENT OF CHAIR AND VICE CHAIR Chairperson Daninger stated this item does not need to be on the agenda after further review the appointments are good through 2013. PUBLIC HEARING: CONDITIONAL USE PERMIT —15238 — 71H AVENUE NW— TEMPORARY DOCK ON THE RUM RIVER — PATRICIA RYSDAMIPETER MILLER Associate Planner Liska noted the purpose of this item is to hold a public hearing and take input on a conditional use permit allowing a temporary dock on the Rum River. The applicants are seeking this structure for the docking of kayaks and canoes. Regular Andover Planning and Zoning Commission Meeting Minutes — May 14, 2013 Page 2 Mr. Liska reviewed the proposed Conditional Use Permit application with the Commission, Motion by Holthus, seconded by Koehler, to open the public hearing at 7:07 p.m. Motion carried on a 7 -ayes, 0 -nays, 0- absent vote. Mr. Lyle Bradley, 15202 71h Avenue NW, stated he had an issue with this because the Rum River is one of the most remarkable rivers in Minnesota because it is not plagued by docks. He stated he was against docks on the river and there is a lot of wildlife habitat on the river. He thought before they start looking at docks on the river they should look at the real meaning of a small river like this is necessary that they keep it looking well and servicing well. Mr. Peter Miller, 15238 71h Avenue NW, was at the meeting for questions. He stated they purchased the house last fall and have done significant canoeing and kayaking and that brought them to this house. He stated there are a number of small docks up and down the river and felt it was consistent with what they saw on the river. He stated they value wildlife and he shares the desire that they not make this a big change on the river. He stated there are plenty of small fishing boats on the river and thought at some point they may end up having a small boat or pontoon so they were hoping the size would not get reduced too much. Mr. Miller explained the dock and how the different sections provide stability. Commissioner Holthus asked what the intent is by having such a large area. Is it to just stabilize the sections that the kayak and canoe will be attached to. Mr. Miller explained the intent for the dock and why they need a large area. Commissioner Holthus asked if Mr. Miller has measured other docks along the river. Mr. Miller indicated he had not. Commissioner Peterson stated the applicants letter states the dock will be anchored with chains or in the riverbed. Mr. Miller indicated it would probably be anchored to a tree or pilings up above high water line because they cannot anchor anything under the high water level as they cannot destroy the riverbed. Commissioner Peterson asked where the closest dock is to his property. Mr. Miller thought there was one within a mile upstream. Commissioner Cleven stated in the interconnection points, on the wings that create the area for the kayaks and canoes, how would it be any different connection point than what there would be at the single connection point. Mr. Miller stated the connectors were different, one was an in the air connector to help get in and out of the kayak and the one at the end of the dock is slightly underwater. Regular Andover Planning and Zoning Commission Meeting Minutes — May 14, 2013 Page 3 Commissioner Nemeth asked how additional boats will be docked when not in use. Mr. Miller stated they will be stored on shore when not in use. He stated they will use the dock just to get in and out of the watercraft. Motion by Holthus, seconded by Gudmundson, to close the public hearing at 7:20 p.m. Motion carried on a 7 -ayes, 0 -nays, 0- absent vote. Commissioner Gudmundson stated she did not know a lot about docks but thought by taking out the two sections it would be less intrusive. Commissioner Koehler stated he did not see a structural purpose to it. He understood the need for the length based on what Mr. Miller would eventually like to put there but he did not see this as a stability issue. Commissioner Peterson stated he did not have a problem with the twenty -foot length. Commissioner Holthus stated thinking about the future intent of boats she felt the application would need to take out only one section of the dock, which would still provide stability for access. Commissioner Nemeth agreed but would prefer that if in the future the applicant does have a boat that it not allowed to be docked there except temporarily and needs to be brought onshore. He did not want to see this as being an obstruction to others on the river. Commissioner Cleven stated he would go with the recommendation of the DNR and to remove both sections. He stated there would be a total distance of twelve feet for loading and unloading of passengers off a boat or pontoon if needed. Motion by Gudmundson, seconded by Cleven, to recommend to the City Council approval of the Conditional Use Permit taking out two of the middle sections of the dock. Commissioner Koehler asked for clarification on the reasoning for removing two of the sections versus one. Commissioner Gudmundson stated she was going along with the DNR on this because she did not understand this issue enough. Chairperson Daninger stated he would not agree with the motion because he felt the applicant was going through the proper process. Motion failed on a 3 -ayes (Nemeth, Gudmundson, Cleven) 4 nays (Peterson, Holthus, Koehler, Daninger), 0- absent vote. Commissioner Nemeth stated he would like to see this approved as is. Chairperson Daninger indicated he would like to also see this approved as is. It may be excessive but he thought City Council will work with the applicant on the size. Regular Andover Planning and Zoning Commission Meeting Minutes — May 14, 2013 Page 4 Commissioner Koehler stated he voted no because he does not know what else is on the river and this may be the smallest dock on it but he did not know. He did not know how to weight out the pros and cons. He did not know if it should be smaller or bigger on the river. He would like to see what the differences are. Commissioner Holthus stated she has been on the river and there are docks but the biggest problem the river has is erosion. It is a river that needs a lot of work. She indicated that she does know a little about the floating docks and they are unstable if too small and she is recommending taking out one section and felt it would still provide stability. Motion by Holthus, seconded by Nemeth, to allow this conditional use permit removing one of the 4'x 8'sections. Motion carried on a 5 -ayes, 2 -nays (Gudmundson, Peterson), 0- absent vote. City Planner Hanson stated that this item would be before the Council at the May 21, 2013 City Council meeting. PUBLIC HEARING: CONDITIONAL USE PERMIT — MINING AND LAND RECLAMATION— NE CORNER OF BUNKER LAKE BLVD AND 7W AVENUE NW — NORTH PINE AGGREGATE City Planner Hanson stated the property owner and applicant as proposing to borrow (mine) up to 60,000 cubic yards of sand and replace it (land reclamation) with 20,000 cubic yards of black dirt. City Code 12 -12 requires a conditional use permit for mining and/or land reclamation of more than 400 cubic yards of material on a property. City Planner Hanson reviewed the proposed Conditional Use Permit with the Commission. Commissioner Holthus asked if the owner and North Pine Aggregate researched the possibility of mining the area and getting the CUP with the City before they submitted bids to the County and if that was a factor in reviewing the CUP application. Ms. Hanson indicated it did not matter. There was discussion regarding the removal and replacing of fill on the property. Motion by Holthus, seconded by Peterson, to open the public hearing at 7:45 p.m. Motion carried on a 7 -ayes, 0 -nays, 0- absent vote. Mr. Brent Jensen and Mr. Glen Sonsteby were at the meeting to answer questions. Commissioner Nemeth asked if there was a specific amount of fill that they planned to take out. Mr. Jensen stated there is a plan that was submitted to City staff. They planned on cutting out six or seven feet. He explained the process with the Commission. Regular Andover Planning and Zoning Commission Meeting Minutes — May 14, 2013 Page 5 Mr. Sonsteby stated the dirt that will be removed is mostly on the hillside. It is not level land so when it is done the land will have a more level effect. Motion by Holthus, seconded by Cleven, to close the public hearing at 7:52 p.m. Motion carried on a 7 -ayes, 0 -nays, 0- absent vote. Commissioner Nemeth asked what the Commission's role is in this item. Chairperson Daninger explained the things the Commission looks at to see if it affects others in the City or their neighbors. Motion by Holthus, seconded by Gudmundson, to recommend to the City Council approval of the Conditional Use Permit application. Motion carried on a 7 -ayes, 0 -nays, 0- absent vote. City Planner Hanson stated that this item would be before the Council at the May 21, 2013 City Council meeting. PUBLIC HEARING: PRELIMINARY PLATIPUD AMENDMENT —COUNTRY OAKS WEST (2ND ADDITION) — 161 sr A VENUE NW AND WINTERGREEN STREET NW — JABBS DEVELOPMENT CO. City Planner Hanson noted the purpose of this item is to hold a public hearing and take input on the revised preliminary plat and Planned Unit Development (PUD) of Country Oaks West 2nd Addition, Block 1, Lots 12 -23. City Planner Hanson reviewed the proposed preliminary plat with the Commission. Commissioner Nemeth asked if the tree line will interfere with the utility easement. Ms. Hanson indicated it would not. Commissioner Nemeth stated the property is currently zoned M -1, Multiple Dwelling, medium density so would that area need to be rezoned. Ms. Hanson indicated it would not need to be rezoned because single family is allowed as a part of a PUD. Commissioner Nemeth asked if there is an approval process that needs to be done by the City in order to disband an association. Ms. Hanson stated there is a process that would need to be followed for disbanding it and the City Attorney would be involved in it. Mr. Carlberg stated it comes down to if the entire association would be disbanded or would the association be restructured. Commissioner Peterson stated the lot width was seventy -five feet for the proposed homes and he wondered if this was a sufficient lot width. He thought the other lots in the development were eighty- ninety feet. Ms. Hanson thought seventy -five feet was sufficient, the developer would be able to meet setback requirements for the home. Commissioner Peterson asked what the benefit is to the City for making the change in the PUD, if any. Ms. Hanson stated with a PUD the design criteria for the original PUD with Regular Andover Planning and Zoning Commission Meeting Minutes — May 14, 2013 Page 6 the twin homes was architectural and landscaping design and these two design criteria would also be in place with the single family home. Commissioner Gudmundson asked if these are twin homes and not townhomes. Her concern would be for those people who already own them, if in the future they do not get their legal description correct they would be in for a very expensive issue. She wondered if there are common elements how that will get divided. Mr. Carlberg stated the developer will need to engage the three existing buildings or units and make some determinations on that association, dissolving it and are they going to want to remain so they can take care of their comment elements. There needs to be some additional discussion between the developer and property owners. Commissioner Holthus asked if there was a fence between the houses and railroad tracks. She indicated she would like to see fencing as part of the plan because these are starter homes with lots of kids. Ms. Hanson did not believe there was fencing proposed throughout the development. Commissioner Gudmundson asked if there was any feedback from the other six owners. Ms. Hanson indicated she has not heard from any of the owners. Motion by Holthus, seconded by Gudmundson, to open the public hearing at 8:12 p.m. Motion carried on a 7 -ayes, 0 -nays, 0- absent vote. Mr. Scott Wold, JABBS Development, was at the meeting to answer questions. He made a presentation to the Commission. There was discussion regarding the problems with the association and how Mr. Wold was caring for the open area of the development. Commissioner Nemeth asked if these types of designs in the packet what will be used as the standard design. Mr. Wold stated these are typical of what has been built in the development previously. These will be City standard. Commissioner Peterson asked what the price point will be for the homes. Mr. Wold thought they would start at $215,000 and run over the $300,000. Commissioner Peterson asked if the trees that are already planted in the utility easement. Mr. Wold stated they butt right up to the gas line easement. Ms. Hanson stated it was her understanding the trees were planted on the western side of the pipeline and the new trees will be planted on the eastern side of the pipeline. Chairperson Daninger asked what the benefit of the City would be. Mr. Wold stated the benefit to the City would be a built up neighborhood where taxes will be paid by owners. He thought it was a benefit to build out the property and people living there now were hoping to have homes built to screen their homes from the railroad tracks. He hoped that made sense to do this. Regular Andover Planning and Zoning Commission Meeting Minutes — May 14, 2013 Page 7 Chairperson Daninger sensed the developer's frustration regarding the association. He was concerned they might create a real issue without knowing how the issue with the association is going to be resolved before they resolve something. He thought there were more shared things besides landscaping needs such as roofs, driveways, siding and they need to figure out how to deal with those. Chairperson Daninger was concerned with single - family homes being built along the railroad tracks because of possible small children. Motion by Koehler, seconded by Gudmundson, to close the public hearing at 8:41 p.m. Motion carried on a 7 -ayes, 0 -nays, 0- absent vote. Commissioner Peterson stated they needed to add another requirement of extra trees to blend the two tree lines together. He would also like to see a fence being installed. Commissioner Holthus indicated a fence is very important to her at the back of the lots because there are a lot of kids in the neighborhoods and the railroad track is right there and very dangerous. Ms. Hanson indicated the fence can be placed on the property line except where the pipeline crosses, no fence could ever be built there. Commissioner Gudmundson indicated there are a lot of homes in Andover along the railroad tracks and they have never required fences to be installed before for them. She felt the trees would be an adequate barrier. She would like to see the irrigation issue added and thought the developer should take care of that and make sure each individual property is up and running on their own. She thought that punishing the six people that own houses there now is not good and they should not allow that to happen. The City should also make sure that they have correct ownership rights. Chairperson Daninger thought whatever needs to be done, needs to be defined before he can approve this. He stated there are so many little details that he was not even sure what should be added. Commissioner Koehler suggested those issues, irrigation and roof and maintenance, be addressed but he suggested they detail those out as two separate points. Chairperson Daninger thought a condition in the motion should read "any issues dealing with the homeowners association need to be resolved." The Commission agreed. Motion by Holthus, seconded by Peterson, to recommend to the City Council accepting the revised preliminary plat with the following additions: 1, Suggested change in the landscaping plan 2. Addition of a low maintenance chain link fence to follow the line of the train tracks 3. There should be an arrangement of the responsibilities of the dissolution of the Homeowners Association 4. The developer should be held responsible for the separation of the irrigation system Regular Andover Planning and Zoning Commission Meeting Minutes — May 14, 2013 Page 8 5. Have appropriate legal title for each property owner with the expense of appropriate title taken on by the developer. Further Discussion: Commissioner Koehler asked if they wanted to hold the developer responsible for splitting out some of these things for people who have not been paying their bills because he has already been covering them and now the City is asking him to pay to split them out and put in an irrigation system for them when they have not been holding up their end of the agreement. He can see the developer being held to split this out because the owner had an expectation when they bought the home but the developer had an expectation that they were going to pay the homeowners dues and some of them have not. He did not feel this was fair. Commissioner Gudmundson thought that the developer could take legal action on his own if he needed to. Commissioner Nemeth did not think a fence would be needed because the trees grow quickly and it would become difficult for people to get past the trees to the railroad tracks. Commissioner Gudmundson agreed. Commissioner Cleven concurred. Commissioner Koehler felt the fence was overkill. Mr. Wold stated when dealing with single - family homes some will want fences and some will not. Some will want chain link, some will want wood and some will take the fence down. He stated because these are single - family homes he cannot enforce fencing to remain. Chairperson Daninger thought an alternative may be to place a berm along the railroad tracks. Commissioner Holthus indicated she would not want to amend her motion. Motion failed on a 3 -ayes (Holthus, Koehler, Peterson), 0 -nays (Nemeth, Gudmundson, Cleven, Daninger), 0- absent vote. Commissioner Cleven stated he did not see the need for a fence and a fence cannot be built in the easement so the fence would be built right next to the trees and he felt it was not needed. Another issue he has with the proposal is dealing with the law aspects of legalities and he thought they were trying to dictate things the association should be taking care of. Chairperson Daninger stated he did not have enough information to make an informative decision on this. There is not enough here for him to agree to change the PUD. Commissioner Gudmundson stated they are getting something because they will be getting the development done sooner than later. Motion by Holthus, seconded by Gudmundson, to recommend to the City Council accepting the revised preliminary plat with the following additions: 1. Ms. Hanson noted they would like to discuss this item with the City Attorney so this item will be postponed until a future Council meeting. PUBLIC HEARING: PRELIMINARY PLATIPUD REVIEW— PARKSIDE AT ANDOVER STATION(4THADDITION) — NORTHEAST CORNER OF139rH AVENUE AND LINNET STREET — ANDOVER ECONOMIC DEVELOPMENT AUTHORITY Community Development Director Carlberg noted the Planning and Zoning Commission is asked to review the revised Preliminary Plat and Planned Unit Development (PUD) of Parkside at Andover Station as requested by the Andover Economic Development Authority (EDA). Community Development Director Carlberg reviewed the proposed Preliminary Plat/PUD Review with the Commission. Commissioner Gudmundson asked for clarification on the process. Mr. Carlberg reviewed with the Commission the process the City will take regarding this plat. Commissioner Gudmundson asked if there has been any interest from builders the way it is platted for townhomes. Mr. Carlberg indicated there has not. He noted that the EDA has had this on the market for over a year and a half in the 8- plex /4 -plex concept. There is not a market for this type of design at this time. He also noted that mailings to adjacent property owners were sent out and no one had any issues with what was being proposed. Commissioner Nemeth thanked staff for providing the sketch plan. He stated in regard to confirming with local plans and ordinances, the property is located within the MUSA area and it says it is within the current stage of sewer expansion, he was under the assumption that the area already had sewer. Mr. Carlberg indicated it does. Commissioner Nemeth stated on the resolution Item 1, it states "all previous conditions of resolution R- 052 -05, not modified by this resolution," He asked what those conditions were. Mr. Carlberg stated the conditions are listed on resolution R- 052 -05 that was included in the packet. This was approved for the entire project. What they are revising is the 1.8 acre site. Regular Andover Planning and Zoning Commission Meeting Minutes — May 14, 2013 Page 10 Commissioner Peterson stated in the past few months they have revised some of the lots and he wondered if they were the lots immediately west of the proposed change. Mr. Carlberg stated the area to the west was revised. Commissioner Peterson thought at first this would be a great area for high- density housing because residents could walk to many places but with senior housing he did not think there would be a lot residents walking to many places. Commissioner Peterson asked if there were any thoughts of doing any two -story buildings. Mr. Carlberg indicated there was not. Commissioner Cleven stated if this is assisted living he would think people would still walk, especially to Wal -Mart. His only question is dealing with the setback areas, the wings of the building looks like it is encroaching over the setback lines and he wondered if there was any concern regarding this. Mr. Carlberg stated the building is located within the required setbacks. What is encroaching in the setbacks is the sidewalks around the building which is permitted. Motion by Holthus, seconded by Cleven, to open the public hearing at 9 :20 p.m. Motion carried on a 7 -ayes, 0 -nays, 0- absent vote. There was no public input. Motion by Holthus, seconded by Nemeth, to close the public hearing at 9:21 p.m. Motion carried on a 7 -ayes, 0 -nays, 0- absent vote. Chairperson Daninger asked when they will be oversaturating the City with this type of housing. Mr. Carlberg thought the market and demand for senior housing would be needed well into the future as the population ages. Chairperson Daninger stated in regards to the holding pond, he suggested it be fenced in for safety reasons. Mr. Carlberg indicated there has not been any discussion regarding fencing of storm water ponds. He stated they will be looking at landscaping in the area. Commissioner Koehler assumed the sidewalks and trails are handicap accessible. Mr. Carlberg indicated they are and any new ones will be. Commissioner Peterson asked how someone gets from the front door to the sidewalk. Mr. Carlberg stated they will review this with the site plan approval and provide a safe access. Motion by Holthus, seconded by Nemeth, to recommend to the City Council approval of the revised preliminary plat and planned development review at Parkside of Andover Station with the following revisions: 1. To allow easy pedestrian traffic to 139`h Street NW Regular Andover Planning and Zoning Commission Meeting Minutes — May 14, 2013 Page 11 2. To include a fence or some type of barrier between the facility and holding ponds to the north Further Discussion: Commissioner Gudmundson thought this was an odd spot for this type of use and was not cohesive to the area and she did not have any concrete evidence at this point but did not think it would help the property values and would much rather see it remain townhouses. Motion carried on a 6 -ayes, 1 -nays ( Gudmundson), 0- absent vote. City Planner Hanson stated that this item would be before the Council at the May 21, 2013 City Council meeting. OTHER B USINESS. Retail Sales and Services: Ms. Hanson stated the City definition is very lengthy, she reviewed other cities definitions and recorded popular ones. Chairperson Daninger asked if shortening the definition would be safe to do. Mr. Carlberg indicated it would be fine. Commissioner Holthus stated he preferred business over stores and shops, Commissioner Nemeth suggested merging the first and third definition "Means a business having as its primary function the supply of merchandise or wares the end consumer" or "Stores and shops selling the personal services or goods over the counter." Andover Planning and Zoning Commission Workshop Meeting Minutes — May 14, 2013 Page 2 Commissioner Koehler wondered if "the end consumer" would be appropriate. He would like to leave "over the counter" out of the definition. Chairperson Daninger stated he would be happy with any of them because all of the three definitions are better than what they already have. Commissioner Koehler stated he would like the definition to be general enough so they do not paint themselves into a corner and he thought common sense prevailed. The Commission decided on the definition of: "Means a business having as its primary function the supply of merchandise, wares and or personal services to the consumer." Andover Definition of Studio: Ms. Hanson thought they should keep the definition and rename it professional studio and delete "or used for radio or television broadcasting" Commissioner Gudmundson wondered if this would change the zone for the use or does it take care of the issues that were discussed at the previous meetings. Commissioner Koehler stated his concern was internet broadcasting. He thought it was limiting because calling out two types of broadcasting was leaving out the internet broadcasting. By taking out the wording it leaves the door wide open for interpretation. He thought they could fall back on common sense because if they try to nail this down, it might take a long time to figure out. Chairperson Daninger asked if they wanted to allow someone the ability to set up a broadcasting booth in their home. Commissioner Koehler stated people are doing that now. Commissioner Gudmundson asked if by allowing this, it would cause interference to others because other businesses do not necessarily interfere with neighbors. There was discussion regarding ramifications associated with radio or television broadcasting in residential zones. Commissioner Gudmundson thought if they left it in the definition it would be allowed in residential zones and could cause problems. Commissioner Koehler thought by leaving the word broadcasting in the definition it would not infringe on anyone's right to free speech. He noted he would be fine with if being removed or left in. The Commission agreed with staff's suggestion by removing "or used for radio or television broadcasting" from the definition. Ms. Hanson stated part of this has to do with some changes to the table and rental of equipment associated to the primary use of the property. Mr. Carlberg thought it was agreed that it was fine as is in the industrial district but may need to be redefined in other districts. He thought in certain districts interim use may be appropriate. Chairperson Daninger stated his understanding on this item was to change to the definition and to change the designation in the neighborhood business and shopping center district have them as interim uses. Mr. Carlberg thought someone could lease a space in a shopping center and have rentals as a business. Commissioner Gudmundson did not think anyone would lease a space in a district that would have an interim use where they would have to come before the City monthly, they would rather have a conditional use permit. Commissioner Gudmundson thought there needed to be a minor change associated "with" the primary use rather that "to" the primary use. Ms. Hanson thought there would need to be two different definitions for this and she would work on this and bring it back for further discussion. Item 107— Single Family Residential Building (Detached) Ms. Hanson stated there was other business dealing with Interim Use on Item 107, Mr. Carlberg reviewed this item with the Commission. He asked if the Commission wanted to be consistent within the districts. Commissioner Holthus asked if staff would like to have this changed to a PUD rather than permitted in M -1 and M -2 and R -5 districts. She wondered if this would make it more restrictive. Mr. Carlberg thought it would be appropriate to put it in those districts. There was discussion regarding examples of PUD review of developments and the control the City would have. The Commission agreed that in Districts M -1, M -2 and R -5 the chart should be changed to PUD. There was discussion on how the City interacts with the Met Council and the requirements made by the Met Council to the City. Commissioners absent: Dean Daninger and Lynae Gudmundson Also present: Community Development Director Dave Carlberg City Planner Stephanie Hanson Others DISCUSS CITY CODE 12 -12: PERMITTED, CONDITIONAL AND PROHIBITED USES Define Bed and Breakfast City Planner Hanson reviewed the definition with the Commission. Acting Chairperson Holthus thought the proposed definition was good and did not think it needed to be changed. She thought R -1, R -2 and R -3 all made sense to have Bed and Breakfast allowed. She did not see this being a problem in any residential areas. Community Development Director Carlberg wondered if this should have a CUP on it so the City can place restrictions on it. Commissioner Peterson thought if it is in a residential area they should have a CUP in order to regulate parking or other concerns in the area. Commissioner Nemeth did not think this should fit into the Multi - family district. Define Resort 1 Andover Planning and Zoning Commission Workshop Meeting Minutes — June 11, 2013 Page 2 City Planner Hanson explained the Commission needed to define "Resorts" in the City. She indicated right now they would only be allowed in the GR District with a CUP. Acting Chairperson Holthus indicated she liked something open ended and not restrictive. She thought this should be conditional in more districts because it is too restrictive and would not allow retreats or other non -water related recreation. She would like this to be conditional in R -1, R -2, R -3 and in GR. Community Development Director Carlberg indicated if they would allow this as a conditional use in R -4 it would allow conditions on the property and would make sense to him. Commissioner Peterson stated he did not see a resort in the R -3 or R -4 districts because he did not think anyone would want to have a resort on a small parcel of land. Commissioner Koehler stated a resort could encompass more than recreational, it could be an inside recreation where people come and learn but parking could become an issue. He thought it could be hard to get a resort in an R -4 area but it could be done. Commissioner Cleven asked what would prevent someone from purchase multi properties in the R -4 District to make a resort. Mr. Carlberg explained the City process and indicated it could happen but the purchaser would need to go before the Council for approval. He thought a CUP would be useful. Commissioner Koehler thought every zoning district the Commission designates should have a CUP. Acting Chairperson Holthus thought it should be allowed in all single family districts with a CUP. Consensus of the Commission was to allow resorts in all single family districts (R -1 through R -4) and General Recreation with a CUP. Commissioner Nemeth stated he would merge the two proposed definitions for Resorts because they usually have food and most have entertainment so they could add "and/or" to the definition. Item 10 (Barbershops and Beauty Salons) and 102 (Retail Trade and Services) City Planner Hanson indicated previously the Commission wanted to remove Item 10 and only have Item 102 in the Code but Item 102 will not allow a barbershop or beauty salons in the residential districts so she thought Item 10 should stay in the City Code. Item 39 (Drive in businesses or Businesses with a drive through window) and Item 46 (Financial Institutions) City Planner Hanson read the definition for these items and noted that according to the table, financial institutions with a drive -thru are only allowed in the shopping center and general business districts. Commissioner Koehler wondered if the City would want a bank with a drive through in the Limited Business District and driving through a parking lot. He wondered if they want to keep some businesses separate. Community Development Director Carlberg thought they should have a CUP attached to this item whether or not it is in the LB District. Acting Chairperson Holthus thought Item 39 must have something other than an "X" in Districts LB and I. She preferred placing a "C" in all of the areas from LB to I. Item 88 (Professional Studio) City Planner Hanson stated this was defined at the last meeting but the Commission needs to indicate what districts it should go in. She suggested this to be put in the same districts as the barbershop and beauty salons. Acting Chairperson Holthus thought it should be a CUP in all residential districts because there are so many different kinds of studios. Community Development Director Carlberg stated they have defined what a professional studio is. Ms. Hanson read the current definition to the Commission. Commissioner Koehler wondered why this would not be in the residential districts as permitted because it is already in the definition as permitted for home based businesses. Commissioner Koehler wondered if they changed the definition to CUP, would the existing businesses be grandfathered in. Mr. Carlberg indicated they would be. Mr. Carlberg stated the definition indicates photo studio and professional office but not Professional Studio so the definition would not necessarily apply. He stated they could adjust the definition to either remove the wording or include new wording for Professional Studios. Andover Planning and Zoning Commission Workshop Meeting Minutes —June 11, 2013 Page 4 Mr. Carlberg did not think they wanted to mess with the home occupation definition section so they need to have Item 88 permitted with an asterisk, indicating it is a home occupation. Acting Chairperson Holthus wondered if they should allow this in the multi- family district. Mr. Carlberg thought everything in the residential districts should be permitted and leave the GR with an "X." OTHER BUSINESS. Loading Dock Hours Community Development Director Carlberg indicated this item is in regards to complaints from a resident about Target loading and unloading from trucks late at night. He noted the City sent the Sheriff's Department out to the site to take an audible reading and it was at 40 decibels late at night, which is not loud and City regulations indicate the reading cannot be more than 50 decibels. He thought the Commission needed to adjust the City Code to reflect audible readings rather than time. Mr. Carlberg thought the definition should read: "...the activity shall terminate when the decibel level exceeds City Code regulations," rather than indicating a specific time period. Acting Chairperson Holthus asked if staff could come up with different wording for the definition and include MPCA definition for noise and bring it back for further discussion. Mr. Carlberg indicated they can do this. Acting Chairperson Holthus wondered if the resident was living in the townhomes before Target was constructed. Mr. Carlberg indicated the townhomes were constructed first so the resident could have been there first but he did not know why all of a sudden issues are coming up. Chickens Community Development Director Carlberg stated the whole backyard urban chicken issue has come up again. City position is not to allow chickens in backyards in urban districts. He noted there may be some discussion coming forward in the near future to allow this in the City. Item 40 (Electrical Vehicle Charging Stations) City Planner Hanson indicated the Commission needs to decide which districts to include this in. She wondered if these are going to be permitted. He wondered if residents will be allowed to have them or will this just be for commercial areas. Mr. Carlberg thought this would be in commercial areas only. Commissioner Cleven stated there is a push to get the electric charging stations proposed in the gas stations but also possibilities in commercial shopping areas. He noted a few other states have already starting installing electric charging stations and regulations are changing. Mr. Carlberg indicated if these stations are to be stand alone and not associated with gas stations this should be conditional use in commercial districts only and permitted accessory in residential. He indicated the Code would need to have two separate lines created, one with commercial and one without the commercial designation. Acting Chairperson Holthus wondered if it would be conditional in General Recreation. Mr. Carlberg indicated it was. Hours of Operation: The hours of operation shall be approved by the City Council. F. Parking: Parking requirements shall be asset out in section 1243 -10 of this title. G. Non- sewered Areas: In non - sewered areas, the septic system shall be in compliance with Title 10, Chapter 4 of this code. A beauty shop /barber shop shall be considered the equivalent to one bedroom in terms of usage under Title 10, Chapter 4 of this code. H. Occupancy By Owner: The beauty shop /barber shop shall be owner occupied. I. Termination of Use Upon Sale of Property: Upon sale of the premises for which the Conditional Use Permit is granted, such permit shall terminate. City Code 12 -14 -6 B. provides the following criteria for granting conditional use permits: 1. In granting a Conditional Use Permit, the City Council shall consider the advice and recommendation of the Planning and Zoning Commission and: a. The effect of the proposed use upon the health, safety, morals and general welfare of occupants of surrounding lands. b. Existing and anticipated traffic conditions, including parking facilities on adjacent streets and land. c. Hanson, City Planne � SUBJECT: PUBLIC HEARING: Preliminary Plat of Catcher's Creek, a single - family urban residential development located at the southeast comer of Andover Boulevard NW and Prairie Road NW. DATE: July 9, 2013 INTRODUCTION The Planning Commission is asked to review a Preliminary Plat for Catcher's Creek. The proposed plat contains 70 urban residential lots as proposed by Mark Smith. DISCUSSION Conformance with Local Plans and Ordinances 1. The property is located in the Metropolitan Urban Service Area (MUSA). 2. The property is currently zoned R -1, Single Family Rural Residential. However, the comprehensive land use plan has it guided as transitional residential which contains properties within the MUSA currently zoned rural but guided for urban development. A rezoning of the properties to R-4 Single Family Urban accomplishes this request. Street Access Public street access to Catcher's Creek would be provided from Prairie Road NW and possibly from the east through the Hickory Meadows 2 "a Addition. The street will conform to the city's standards (33 feet wide within 60 feet of right -of -way). Anoka County Highway Department (ACRD) ACHD has provided comments. A condition of approval requires the applicant to conform to the requirements of the Anoka County Highway Department. Sewer and Water Access The trunk sewer and water lines are located in this area and will be extended to serve the plat. Coon Creek Watershed District The Coon Creek Watershed District completed the review of the preliminary plat. Their comments have been attached for your review. The applicant will need to satisfactorily address all comments prior to the submittal of the final plat. There are wetlands and floodplains on the property. The applicant is proposing to impact 7,995 square feet of wetland. The mitigation will be done through wetland bank credits. A significant area of the 100 year floodplain (which consists both the floodway and flood fringe areas) and the 500 year floodplain exist along Coon Creek, as shown on the grading plan. Portions of the 100 year flood fringe and the 500 year floodplain areas will need to be removed from the floodplain due to the proposed construction of homes within the area. It will be the responsibility of the developer to apply for a Letter of Map Amendment (LOMA) through FEMA for approval to allow homes to be constructed. Without this LOMA, homeowners most likely will have to purchase flood insurance. Staff is recommending that a condition of the final plat is to allow the plat to be recorded but building permits can not be issued until FEMA approves the LOMA. Trails A bikeway /pedestrian trail is being proposed on the east side of Lot 1, Block 6. This trail will eventually link to the proposed future trail along Coon Creek. The Andover Comprehensive Plan shows regional trails both along the creek and along Andover Boulevard. Construction of a trail along the creek may be challanging by the location of wetland and floodplain. Further investigation will need to be authorized by the City Council to pursue this location. It is important to note that the trail along Coon Creek would be a regional trail paid for out of the City's trail fund and/or potential MNDNR grant funds. Tree Preservation/Landscaping A more detailed landscaping plan must be submitted that shows tree spacing, removal and species of trees to be planted in the development. Also, the landscaping plan shall show the type of landscape screening to be provided on the multiple frontage lots along Prairie Road and Andover Blvd as required by City Code Title 12, Chapter 13. Tree preservation is shown along the southern side of the proposed plat as well as various areas throughout the plat. A majority of the trees within the plat are proposed to be removed to allow grading and drainage of the site. Park and Recreation Commission Recommendation The Park and Recreation Commission reviewed the sketch plan at the February 21, 2013 meeting at which time it was discussed to take some of the dedication as land to extend the park in the Hickory Meadows development. The Commission will review the preliminary plat at the July 18, 2013 meeting to make a final recommendation to City Council. Lots Each of the 70 lots meets the minimum lot width, depth and area requirements of the R -4 Zoning District. ACTION REQUESTED The Planning Commission is asked to hold a public hearing, review the proposed preliminary plat and to make a recommendation to the City Council. The Andover Engineering Department will determine when all items have been addressed. 3. Coon Creek Watershed District comments shall be satisfactorily addressed and the permit has been issued prior to any grading of the site. 4. A detailed Landscape Plan shall be submitted that shows tree spacing and species of trees to be planted in the development. The landscaping plan shall show the type of landscape screening to be provided on the multiple frontage lots along Prairie Road and Andover Blvd as required by City Code Title 12, Chapter 13. The Landscape Plan shall be approved by the Andover Natural Resources Technician prior to any grading of the site. 5. The applicant shall be responsible for the cost of construction of all improvements proposed as a part of the preliminary plat. 6. Approval is contingent upon the applicant providing public easements of sufficient size to allow construction of public streets, sanitary sewer and water utilities to serve the plat in compliance with the City Code. 7. Building permits will not be issued until the final plat has been recorded with Anoka County and the Federal Emergency Management Agency (FEMA) approves the request for a Letter of Map Amendment (LOMA) on the lots that are impacted by the floodplain. 8. No grading of the site shall be allowed until written permission has been received to grade on the property located west of the proposed Holly Street NW is obtained and placed on file with the City. 9. Temporary cul -de -sac easement(s) shall be provided for all streets that extend and dead end at a distance greater than two hundred and ten (210) feet from an adjacent intersection. 10. A one hundred (100) foot trail easement along the north side of Coon Creek shall be shown on the preliminary plat. 11. Such plat approval is contingent upon the rezoning of the properties to accompany single family urban development. 12. Separate easement documents will be required for each proposed vehicle maintenance access. 13. Prior to final plat recording at Anoka County, a development agreement acceptable to the City Attorney must be executed by the Developer. Need to identify on the plan the sight triangle in the southeast corner of the intersection of Prairie road NW and Andover Boulevard NW as per Anoka County Highway Department. Engineering Staff has received a drawing of the sight triangle from the Developer's Engineer (Hedlund Engineering). The Developer's Engineer will identify this sight triangle on the next submittal of the preliminary plat that would be presented to the Andover City Council. Note: Approval of the sight triangle will be necessary by the Anoka County Highway Department. 23. Pending. Comments are forth coming from the Anoka County Highway Department (ACHD) for their review as grading and access removal will take place in County right of way. The Developer will need to submit a copy of the revised plans to Anoka County Highway Department for their review and comments. 32. Not done. All plans where appropriate. The drainage and utility easement in Block 6 Lots 1 -10 will need to be adjusted so that it is consistent with the designated or designed 100 year flood for all areas. Still need to fix Lot 10, Block 6 to follow the 100 year flood elevation contour of 379.0. Also it may be worthwhile to adjust the drainage and 1 utility easement on Lot 1 Block 10 closer to the 100 year flood elevation of 879.0 to allow for additional space for the homeowner. 37. Not done. Sheets CG -1.0 and CG1.2. Need to identify proposed elevations and contours. Also how will the drainage in ditch along Andover Boulevard function. Need to discuss further with ACRD. This is pending review by the Anoka County Highway Department. Updated plans will be sent by the Developer's Engineer (Hedlund Engineering) to the Anoka County Highway Department. 40. Not done. All sheets where appropriate. Some modifications will necessary regarding the existing retaining wall located on the west of Lot 1 Block 1. The retaining wall will need to be modified and tapered to match in with existing and proposed grading. The wall along both sides of the driveway will need to be removed. The following comments have yet to be completed in regards to Review #2: 207. Not Done. Sheet CG1.0, CG1.3: The low floors on Lots 1 and 2, Block 5 do not meet the 2' separation requirement. Either raise the low floors, or submit Darcy's Law calculations showing the low floors will not be impacted during a 100 -year storm event. The lot by lot tabulation was updated, but not the grading, drainage, and erosion control plan. It will be necessary to be revised the grading plan so that it is consistent with the lot by lot tabulation. The Engineering staff will verify once the plan has been revised. The following comments are in regards to Review #3: 301. Sheet C4.1: Correct pipe slopes for storm sewer between CBMH 103 to FES 201 to match drainage calcs. Use 0.30% for both pipe runs to minimize sump discharged in infiltration basin. 302. Sheet CG 1.0: A flat bench at least 20' wide at the top of the creek bank needs to remain for construction of the future trail in the southeast corner of the project. 303. Sheet CG 1.0 and CG 1.2: Remove the overflow cross section from CG 1.0, and add additional detail to the overflow cross section detail on sheet CG 1.2. Detail shall show a cross section showing a 20' wide rip rap width with a 12' bottom, and 4' side slopes (refer to marked up plan sheets). Rip rap shall extend to the bottom of the infiltration basin. 304. Sheet CG 1.0: Call out seed mix for restoration on the infiltration shelf and in the area in the southeast corner of the project where the large excavation is. 305. Sheet CG -1.3. It will be required to submit documentation to the City that the Developer has written permission to trespass and grade on the property west of Holly Street NW and south of 143rd Avenue NW. The following comments are related to the Hydrology Report Review #2: 203. Provide an analysis in regards to infiltration requirements if there is enough volume provided in this development to allow for the elimination of the two rain gardens in the Hickory Meadows 2nd Addition. The required infiltration volume for that HM 2nd Addition can be provided by the City or CCWD if you do not have access to their calculations. We would like to be able to show that the proposed infiltration shelf designed with this project could accommodate the Hickory Meadows 2nd Addition infiltration volume requirements so the two currently proposed rain gardens on that site can be eliminated. Historically the Coon Creek Watershed District has accepted the argument that if some water 2 cannot be routed to an infiltration basin, then the water that DOES get there is essentially over treated. So if the required volume of runoff water from the 1" rainfall event is provided in the infiltration shelf, it is possible that the rain gardens proposed with Hickory Meadows 2nd Addition will not be required. Hydrology Review #3: Sufficient time was not allowed to review the hydrology portion of the submittal prior to sending the staff memo out to the Planning and Zoning Commission. Staff will be evaluating the hydrology over the next few days. The Coon Creek Watershed District is also in the process of reviewing the hydrology portion of the project. Note: It is a requirement that the Developer respond to each of these items in writing when re- submitting the revised plat to the City. The ditch is County Ditch 57. The ditch has not been inspected. There are approximately 0 acres of existing agricultural land affected by this ditch. The project site is tributary to County Ditch 57. PAN 13 -045 Catchers Creek, Page 2 of 6 The trend in land use for this drainage area is toward residential. There are not flooding concerns downstream. Alternatives to additional drainage considered and reviewed include storage and infiltration. The ditch was last repaired in 2001. The ditch is not in need of repair. Floodplain: There is floodplain on the property according to FEMA. The District model predicts the 100 -year elevation for the subwatershed at 878.1 feet. The FEMA map predicts the 100 -year elevation for the property at 879 feet. The floodplain is impacted in the proposed development. The total floodplain impact is 3.9 acre -feet, within the flood /fringeway. Compensatory storage is provided. However, the compensatory storage in the southeast corner meant to provide floodplain mitigation needs to drain down to be able to receive water during a storm event and not be continuously full. It is unclear how flood water will access and drain out of the mitigation area. The applicant is advised to run the 100 -year elevation for interior pond using the NOAA Atlas 14 information as shown in the following web link. http: //hdsc.nws.noaa.gov /hdsc /Rfds /pfds map cont.html ?bkmrk =mn Groundwater: The applicant did not submit a complete geotechnical report. The geotechnical report was missing half of the pages. Complete information has not been provided to substantiate low floor elevations. Based on HWL, low floor elevations do not meet the criteria for the City of Andover (3 ft above mottled soil elevation, 2 ft above 100- year). Historic Sites: The proposed project does not include sites of historic or archeological significance. Local Planning & Zoning: The proposed project is consistent with local planning and zoning. There is an approved local water plan. Maintenance: The proposed project does not include a ditch maintenance easement or utility line crossings. A drainage and utility easement is provided for the storm water /infiltration ponds shown on the drainage plan. The compensatory storage construction abutting the creek comes right to the top of bank making the transit of a backhoe for ditch maintenance impossible. There needs to be a 20' minimum width between the top of the ditch bank and the compensatory storage for a maintenance access way. It is unknown if adjacent property owners have been notified of the proposed changes in drainage and have acknowledged the proposed changes. The applicant is proposing grading on the property to the East and West. No documentation has been provided to verify that permission has been granted for such encroachments. Soils & Erosion Control: Soils affected by the proposal are Sartell, Markey, Rifle, Zimmerman and Alluvial Land. Stabilizing vegetation is proposed for disturbed areas within two weeks of rough grading. Adjacent properties are protected from sediment deposition. All wetlands, waterbodies, ponds, infiltration basins and water conveyance PAN 13 -045 Catchers Creek, Page 3 of 6 systems are not protected from erosion and sedimentation. Project site is greater than 1 acre; an NPDES permit is required. Stormwater & Hydraulics: The applicant is not meeting the volume management requirement equivalent to infiltrating runoff from the first inch of precipitation. Stormwater leaving the site is discharged into a well defined receiving channel or pipe and routed to a public drainage system. Drainage sensitive uses exist downstream from the proposed site. It is unclear if the rate of post development runoff from the site does exceed predevelopment rates, or rates which would interfere with sensitive downstream land uses. The proposed pond is a combination pond which is attached to the adjacent Hickory Meadows pond and proposes to use the existing outlet in Hickory Meadows pond. Water Quality: Project does include new impervious drainage areas greater than 1 acre. All discharges into wetlands are pretreated by a sediment basin/water quality pond and are not designed correctly. The proposal may detrimentally affect the existing water quality of the receiving water. The proposal will not cause extreme fluctuations of water levels or temperature changes. Wildlife: The proposed phase does not include endangered & threatened species, rare natural communities, colonial waterbird nesting sites, migratory waterfowl concentration areas, deer wintering areas, wildlife travel corridors. No substantial adverse alteration or significant detrimental impact on a species food supply, security or reproductive cycle or the alteration or removal of a plant species will occur. Wetlands: Wetlands do exist on -site according to the NWI, Soil Survey and 1987 Manual Midwest Regional Supplement. The wetland boundary has been reviewed. Staff will be issuing and approval of the wetland boundary application. The project is not exempt. The proposed project is not wetland dependent. The applicant is proposing 7995 square feet of wetland impact in one location. Three project alternatives have been provided. The applicant is pursuing sequencing flexibility. Wetland Replacement:The applicant is proposing replacement of impacted wetlands at a 2:1 ratio. The applicant is proposing mitigation via wetland bank credits. The project proposes restoration of all disturbed areas to pre - construction elevations and land use. PAN 13 -045 Catchers Creek, Page 4 of 6 There are no proposed permanent wetland impacts. Escrows: Escrows have not been paid. $1500 + ($200 per acre * 29 Acres) + (180 if adjacent to ditch * 18010 _ $9,100 ISSUES /CONCERNS: F000dplain: It is unclear how the floodwater will access and drain out of the floodplain mitigation area. The compensatory storage in the southeast corner of the development will need to drain completely to ensure adequate compensatory storage has been provided in the flood fringe. Groundwater: The low floor elevations do not meet the criteria for the City of Andover (3 ft above mottled soil elevation, 2 ft above 100 - year). The low floor elevations of 883ft of Lots 1 and 2 of Block 5 do not meet the requirement of 2ft above the high water level of 881.7ft. Backwater in the storm sewer system also causes the low floor elevations of 883ft of Lots 5 through 10 of Block 4 to not meet the requirement of 2ft above the high water level of 881.7ft. Stormwater & Hydraulics: The applicant is not meeting the volume management requirement equivalent to infiltrating runoff from the first inch of precipitation. The applicant has shown that the infiltration shelf 1 SH is adequately sized for infiltrating runoff from the first inch of precipitation. However, runoff from subcatchments 4S and 6AS are not routed to the infiltration shelf 1 SH and are not infiltrated. If applicants can not meet this requirement due to site constraints in its entirety, they must meet it to the greatest extent practical and explain why it can not be met. The runoff that discharges from the storm sewer system must be pretreated before the infiltration shelf so the infiltration shelf does not get clogged. The applicant is not meeting the rate control requirement for preconstruction subcatchment IF and post construction subcatchment IFS. It is unclear if the applicant is meeting the rate control requirement for runoff draining southward to Coon Creek expressed in Table 1 in the hydraulic study. Although the peak discharges from the individual subwatersheds that drain southward to Coon Creek occur at different times, the applicant should consider the combined hydrographs to identify what the total peak discharge is for pre and post construction conditions. A post construction test on the infiltration basin will be required to verify the assumed infiltration rates are obtained. The applicant must acknowledge that they will conduct a post construction test on the infiltration basin by filling the basin to a minimum depth of 6 inches with water and monitor the time necessary to drain. The Coon Creek Watershed District shall be notified prior to the test to witness the results. The post development HydroCAD model does not reflect the plans provided. Subcatchment 2CS and the primary outflow of the Depressional Area 2BB should not be PAN 13 -045 Catchers Creek, Page 5 of 6 routed through the depressional Area 2AB. They should be routed to the infiltration shelf 1 SH according the storm sewer layout in the plans that were provided. The utility plans were not provided for the entire development to confirm that device information in the model reflects the plans for the development. Soils & Erosion Control: The pond and infiltration basins are not protected from erosion and sedimentation during construction. After initial grading the District requires that ponds and infiltration basins be completely surrounded by erosion control measures to prevent the basin from clogging. Curb and gutter inlet protection is not included in the erosion control plans. RECOMMENDATION: Table with 25 Stipulations Stipulations: 1. Receipt of escrows. 2. The applicant must acknowledge that they will conduct a post construction test on the infiltration basin by filling the basin to a minimum depth of 6 inches with water and monitor the time necessary to drain. The Coon Creek Watershed District shall be notified prior to the test to witness the results. 3. After initial grading completely surround the proposed infiltration basin and pond with erosion control measures to prevent the basin and pond from clogging. 4. If site will be accessed from East on proposed 143`d avenue at all provide a Rock construction entrance. If not place a note on the plans identifying that no access is provided until streets and utilities are completed. 5. Provide a note on the grading plan to prevent equipment traffic and activities which could compact the soils in the proposed infiltration areas. 6. Include a minimum 20' maintenance travel way between the top of the ditch and any proposed construction within the ditch easement. Provide language of the easement along Coon Creek. Clearly identify areas of proposed fill within the 100 year flood elevation. Provide detail and identify area where applicant intends to access proposed floodplain mitigation. Include methods and means of restoring this area to preconstruction conditions after activities cease. a. It is recommended that this access be at the shortest possible crossing of wetland. 10. Add curb and gutter inlet protection to erosion control plans and legend. 11. Extend riprap at outlet to proposed SW pond to bottom of basin. 12. Provide detail of overflow between infiltration basin to primary SW pond to verify that adjacent slopes are not at risk of washout. a. Consider providing a controlled structure overflow rather than proposed spillway. 13. Provide complete Geotechnical Exploration and Review report. 14. Provide utility plans that show storm sewer information for the entire site clearly labeled (pipe inverts, slopes, diameters, outlet structure elevations, emergency overflow elevations, etc). 15. Provide details on how floodwater will access the compensatory storage and how it will drain to ensure adequate storage has been provided in the flood fringe. 17. Correct the routing in the HydroCAD model to reflect the plans and storm sewer configuration. Corrections are needed to the routing of Subcatchment 2CS and the primary outflow of the Depressional Area 2BB. These should be routed to the infiltration shelf 1 SH. Also, check all the devices routing information and confirm that all devices are modeled correctly. 18. Make all necessary changes to the design and Hydraulic study in order to provide stormwater runoff calculations that show the site is meeting the volume management requirement equivalent to infiltrating runoff from the first inch of precipitation. 19. Make all necessary changes to Hydraulic study and provide stormwater runoff calculations that show the site is meeting the total rate control requirement for drainage sensitive areas. Include rate comparison for predevelopment watershed IF and post development watershed IFS. Include the peak discharge for the combined hydrographs for pre and post development conditions for the runoff that drains southward to coon creek. 20. Run the Atlas 14 100 -year precipitation in the model for the interior pond. 21. Include a pretreatment device prior to runoff discharged from the storm sewer system into any infiltration areas. 22. Provided written documentation which shows that it is allowable to combine the Catchers Creek pond with the Hickory Meadows pond and to grade off of the Catchers Creek property. 23. Provide written documentation which shows permission has been granted for grading on to adjacent Western property. 24. Adjust grading and low floor elevations to meet the requirement of 28 above the 100 -year elevation as needed. a. Verify that HWL for infiltration area is the same as the connected pond. 25. The right of access along CR16 east of Prairie Road should be dedicated to Anoka County. If there are any existing driveways or field access points onto CR 16 within the boundaries of this plat, they shall be removed and the ditch section restored to match existing depth, slope, and grade. It appears that there are sight distance deficiencies for the Intersection Sight Comer requirements at the CR16/Prairie Road intersection, with the obstructions being trees in the SE quadrant, and an existing structure in the SW quadrant. The City and/or the Developer should ensure that clearing andlor grading is completed to satisfy the Sight Corner requirements to the fullest extent possible for this development. Please note no signs or plantings will be permitted within the county right of way, and care should be exercised when locating signs, plantings, berms, etc. outside of the county right of way, so as not to create any new sight obstructions for this intersection. As proposed, this sketch plan development consists of 75 Single Family lots. REVIETV OF MARK SIVITH SKETCH PLAN Mr. Haas reviewed, the Commission is requested to review and determine the park dedication requirements for the proposed Mark Smith Sketch Plan. A copy of the sketch plan was provided for Commission review. Mr. Haas provided a map showing the location of the property. He noted the sketch plan does indicate the existing park boundaries of Hickory Meadows Park along with the additional park property the developer would like to dedicate to the City, which would be adjacent to the existing Hickory Meadows Park. The location of a park in this area was suggested by the Commission during the sketch plan review back in 2006. Minutes from the September 7, 2006 Park Commission meeting were provided as a reference. Regular Andover Park & Recreation Commission tbfeeting Minutes — February 21, 2013 Page 2 Mr. Haas stated Staff has reviewed the sketch plan and recommends not taking any more property than is necessary to fulfill the future planned improvements that are identified in the Future Facilities Chart for Hickory Meadows Park. The drawing identifies a smaller area which may accomplish the goal of the park which could include enough area for a small shelter and a half basketball court. Any property the Commission requests to be dedicated will be calculated based on the formula per City Code 11 -3 -7 (C). The more land required to be dedicated the lesser the park dedication fee portion will be. It was noted the preliminary plat for this area will be brought before the Commission at its March 2, 2013 meeting. Mr. Haas stated he is looking for a recommendation on what would be done with the additional parkland. Commissioner Miskowiec asked what the total acreage would be with the two parcels. Mr. Haas stated between .5 acres and .75 acres. Mr. Haas stated this would be considered a mini park as no parking lot or field would be part of the park. Chair Butler asked about the connection to the trail by Coon Creek and noted it would be east of the park. Mr. Haas stated staff is looking at the Hickory Meadows 2nd Addition taking a trail easement through one of the lots for access to the trail. Chair Butler stated that trail connection would only benefit approximately twelve homes and it may be better for those residents to access the north access to the trail. Mr. Haas stated the traffic will be under 1000 cars per day for that area. Chair Butler reminded the Commission that a small park was added to this area a few years ago. Mr. Mark Smith, 2120 Otter Lake Drive, Lino Lakes, is the property owner for this parcel. He suggested a gap be added so people could walk between the properties. Commissioner Lindahl stated if a connection to a trail is constructed there is quite a bit of maintenance needed for that connection. The Commission is requested to review the proposed preliminary plat and give direction as to park dedication requirements to the City Council. Chair Butler suggested following staff's recommendation and taking the small lot for expansion of Hickory Meadows Park. The Commission will have another opportunity to review this project as part of the preliminary plat review. DATE: July 9, 2013 REQUEST The Planning and Zoning Commission is requested to review and consider an amendment to the City Code 12- 13- 9(A)(3), Hours of Loading and Unloading and City Code 5 -6 -2, Noises Prohibited. The Commission is also requested to seek public input by holding a public hearing on the proposed amendment in accordance with Section 12 -14 -8 of the City Code. BACKGROUND A recent noise complaint related to nighttime unloading activities at the Target Store from a resident in the neighborhood located south of the store and across Station Parkway has caused the City to review and evaluate the City Code related to the hours of loading and unloading activities. City Code 12- 13- 9(A)(3), Hours Of Loading And Unloading states, Where noise from loading or unloading activity is audible in a residential district, the activity shall terminate between the hours of seven o'clock (7:00) P.M. and seven o'clock (7:00) A.M. The issue is the vagueness and subjectivity of the term "audible ". The current procedure of the City upon receiving a noise complaint is to have the Anoka County Sheriff's Office conduct sound testing in the area of the complainant /receiving property to determine the decibel level of the sound. Once those readings are received, Staff applies those to the levels defined in City Code 5 -6 -4 as stated in the table below. These noise standards are consistent with the standards of the Minnesota Pollution Control Agency (MPCA). City Code 5- 6 -2(E), Noises Prohibited, states as follows: No person shall make or cause to be made any distinctly and loudly audible noise that unreasonably annoys, disturbs, injures, or endangers the comfort, health, peace, safety, or welfare of any persons or precludes their enjoyment of property or affects their property's value. The general prohibition is not limited by the specific restrictions of the following: E. Loading, Unloading, Unpacking: No person shall create loud and excessive noise in loading, unloading, or unpacking any vehicle. The proposed amendment would tie the decibel levels in City Code 5 -6 -4 to this section of the Code in an effort to set a measurable standard for hours of loading and unloading activities. It should be noted that the City Code is being re- evaluated not only due to the unloading activity at the Target Store, but also to loading and unloading operations of several businesses that could and will be impacted by strict interpretation of the current Code. This would also include businesses that do not have a defined loading and unloading area where they receive deliveries at the front of the store or may even be loading a customer's vehicle that could be audible from an adjacent residential area. ACTION Upon holding a public hearing and taking public testimony, recommend to the City Council the approval of the attached ordinance amendment to City Code 12 -13 -9 and 5 -6 -2 as be modified by the Commission at the meeting. CITY CODE TITLE 5: POLICE REGULATIONS CHAPTER 6: NOISE CONTROL 5 -6 -2: NOISES PROHIBITED: No person shall make or cause to be made any distinctly and loudly audible noise that unreasonably annoys, disturbs, injures, or endangers the comfort, health, peace, safety, or welfare of any persons or precludes their enjoyment of property or affects their property's value. The general prohibition is not limited by the specific restrictions of the following: A. Motor Vehicles: No person shall operate a motor vehicle in the city in violation of the motor vehicle noise limits of the Minnesota Pollution Control Agency. B. Horns, Audible Signaling Devices: No person shall sound any signaling device on any vehicle except as a warning of danger, as required by Minnesota Statutes Section 169.68, as amended. C. Exhaust: No person shall discharge the exhaust, or permit the discharge of the exhaust, of any steam engine, motor boat, motor vehicle, or snowmobile except through a muffler or other device that effectively prevents loud or explosive noises therefrom and complies with all applicable state laws and regulations. D. Defective Vehicles Or Loads: No person shall use any vehicle so out of repair or so loaded as to create loud and unnecessary grating, grinding, rattling, or other noise. E. Loading, Unloading, Unpacking: No person shall create loud and excessive noise in loading, unloading, or unpacking any vehicle in excess of the standards provided in Section 5 -6 -4 of the City Code. F. Radios, Phonographs, Paging Systems: No person shall use or operate or permit the use or operation of any radio receiving set, musical instrument, phonograph, paging system, machine, or other device for the production or reproduction of sound in a distinctly and loudly audible manner as to unreasonably disturb the peace, quiet, and comfort of any person nearby. Operation of any such set, instrument, phonograph, machine, or other device between the hours of ten o'clock (10:00) P.M. and seven o'clock (7:00) A.M. in such a manner as to be plainly audible at the property line of the structure or building in which it is located, in the hallway or apartment adjacent, or at a distance of fifty feet (50'), if the source is located outside a structure or building, shall be prima facie evidence of a violation of this section. G. Noisy Parties Or Gatherings: When a police officer determines that a gathering is creating an excessive noise disturbance, the officer may order all persons present, other than the owner or tenant of the premises where the disturbance is occurring, to disperse immediately. No person shall refuse to leave after being ordered by a police officer to do so. Every owner or tenant of such premises who has knowledge of the disturbance shall make every effort to see that the disturbance is stopped. H. Loudspeakers, Amplifiers For Advertising: No person shall operate or permit the use or operation of any loudspeaker, sound amplifier, or other device for the production or reproduction of sound on a street or other public place for the purpose of commercial advertising or attracting the attention of the public to any commercial establishment or vehicle. I. Adjacent To Schools, Churches And Hospitals: No person shall create any excessive noise on a street, alley, or public grounds adjacent to any school, institution of learning, church, or hospital when the noise unreasonably interferes with the working of the institution or disturbs or unduly annoys its occupants or residents and when conspicuous signs indicate the presence of such institution. All other Titles, Chapters and Sections of the City Code shall remain as written and adopted by the Andover City Council. Adopted by the City Council of the City of Andover on this day of 2013. Gamache, Mayor Michelle Hartner, Deputy City Clerk July 9, 2013 Community Development Director David Carlberg and the entire Planning & Zoning Commission of the City of Andover — this is being submitted in reference to the Notice of Public Hearings and ask that it be made part of Public Record. I would like to go on record stating that I am strongly against the proposed City Code Amendments (to Title 5 & Title 12); and feel that the changes would not benefit the Residents of Andover as it will not enhance the quality of its citizen's lives and will not promote quite neighborhoods — it quite frankly goes against the City of Andover's Vision statement'. I do not feel it is unreasonable for the area businesses to be expected to follow the City Code — as written, by having a designated time in which nearby resident's (and most likely customers of their businesses) can actually have a break from the excessive noise and get some quality sleep. It should be noted that other neighboring Minnesota and Wisconsin communities2, such as Bloomington, Cambridge, LaCresent, Robbinsdale, and Roseville have similar Codes to Andover's existing Code, which gives the appearance that the existing Code isn't unreasonable; and that businesses in those communities can be successful without causing such unreasonable disturbances. I am a newer resident of Andover; and these proposed changes appears to be the result of an inquiry regarding the noise caused by the neighboring business activity occurring outside of the existing City Code 12 -13 -9 "Off Street Loading & Unloading Areas." Item 43 currently requires "Where noise front loading or unloading activity is audible in a residential district, the activity shall terminate between the hours of seven o'clock (7:00) P.M. and seven o'clock (7.00) A M ". The inquiry was made in order to ensure the neighboring Businesses (Target) would be expected to follow the existing City Code; however, the Planning & Zoning Commission has taken it upon itself to re -word the Code rather than deal with the continued violations. Although the Commission believes the revisions would more accurately reflect how it was "intended to be interpreted "; however, the Residents believe this is to appease Big Business and would cause a decrease in the quality of our lives and a decrease in our property values if businesses were allowed to continuously disturb its residents at all hours of the night. More specifically, the noise caused by the loading and unloading of tractor - trailers is inhumane when it occurs in the middle of the night (e.g. 11:47 pm, 12:10 am, 4:10 am, 4:40 am, 5:30 am, 6:33 am), and without a minimum of eight hours in- between one night and the next morning. It is not sufficient for the Commission to just change the Code's language, when they are without first -hand knowledge of what the Residents have been subjected to while Big Business violates existing ordinances. 1 am requesting that the Commission either leave the Code, as written, and enforce it, or go back to the preverbal drawing -board and come -up with a more viable solution, but not without true consideration for all of the Residents of Andover. Bloomington: SEC. 21.301.06. PARKING AND LOADING — (j)(4) Noise. Where noise from loading or unloading activity is audible in a residential district, pursuant to Section 10.30 of this Code, Public Nuisance Noises Prohibited, the activity sholl terminate between the hours of 10:00 p.m. and 7:00 a.m. Cambridge: Loading /Unloading Trucks — There are various restrictions on the volume of noise from the loading and unloading of trucks from 9 p.m. - 7a.m. (9 a.m. on Saturdays, Sundays and Holidays) although there are exceptions for certain types of stores and facilities such as schools as well as along certain streets in commercial oreos that are not designated as noise- sensitive zones. Call the ECC at the police non - emergency number, 617- 349 -3300, and o police unit will respond and stop excessive noise unless the activity is permitted. LaCresent. WI: § 93.03 NOISE — B (7) — Construction activities; loading and unloading. Engaging in or permitting construction activities including but not limited to the use of any kind of electric, diesel or gas powered machine or other power equipment including motor vehicles in connection with the erection, demolition, alteration or repair of any building on weekdays (Mondays through Fridays) except between the hours of 7:00 a.m. to 6:00 p.m. and on all other days and all holidays except between the hours of 8:00 a.m. to 6:00 p.m., unless in case of urgent necessity in the interest of public health and safety, and then only with a permit issued by the Building Official which permit may be granted for a period not to exceed three days or less while the emergency exists but which permit may be renewed. Robbinsdale: 1305.05. Special loading zones,. There is reserved for loading and unloading of passengers orcommodities, during the hours between 8:00 o'clock a.m. and 6:00 o'clock p.m, except on Sundays and legal holidays, spaces of proper and adequate length wherever the city councli directs the police department to establish and mark a loading zone, and when and to the extent so marked. Roseville: 405.02; SPECIFIC RESTRICTIONS — D — loading, Unloading, Unpacking: No person shall create loud and excessive noise in loading, unloading or unpacking any vehicle. 707.15: OTHER OBLIGATIONS — C — The loading or unloading of trucks must be done solely within the defined permit area unless specifically authorized by the permit. 1005.06 REGIONAL BUSINESS (RB) DISTRICT — H — Standards for Nighttime Activities: Uses that involve deliveries or other activities between the hours of 10:00 P.M. and 7:00 A.M. (referred to as "nighttime hours ") shall meet the following standards: (1) Off - street loading and unloading during nighttime hours shall take place within a completely enclosed and roofed structure with the exterior doors shut at all times. 1011,12 Additional Standards for Specific Uses in All Districts — E — (1)(b( Trafflc: The site plan shall provide vehicular circulation routes away from residential areas and avoid commercial vehicle ingress and egress from local residential streets to commercial property sites. In the site plan review and approval process, every reasonable effort must be made to design the site circulation so that service vehicles over 1 ton capacity do not use routes which bring vehicles between a building and a residential district boundary. The site pion shall also provide pedestrian access routes using walks or paths, including where practical, connections to adjacent residential areas. Service vehicles over 1 ton capacity which enter or exit the site between the hours of 10:00 P.M. and 7:OOA.M. shall use a designated route approved by the City. Deliveries and /or delivery truck access, in and on the site during the hours of 10:00 P.M. to 7:00 A.M., shall be limited to single unit, 2 axle vehicles not in excess of 26,000 pounds gross weight. The designated route shall keep vehicles at least 300 feet away from any residential district boundary, or be completely screened by a building, wall, landscaped berm, fence, or combination thereof to a point 14 feet above the ground at the outside edge of the truck route lane and to a point 5 feet above the first floor (main level) of the adjacent residences. (f) Off- Street Loading: Off - street loading shall be as listed in Chapter 1019 (Parking Area Use) of this Title and servicing space shall be designated for each store unit in the shopping district. Such loading space shall be designed so as not to conflict with movement of vehicular traffic to and from parking areas. (ii) Any commercial loading dock within 300 feet of a residential district which is to be used for any reason by vehicles or equipment between the hours of 10:00 P.M. and 7:00 A.M. shall be within a completely enclosed and roofed structure. Ali loading and unloading operations shall occur with the exterior doors shut at all times.
