PLANNING AND ZONING COMMISSION MEETING — MARCH 12, 2013 The Regular Bi- Monthly Meeting of the Andover Planning and Zoning Commission was called to order by Chairperson Daninger on March 12, 2013, 7:00 p.m., at the Andover City Hall, 1685 Crosstown Boulevard NW, Andover, Minnesota. Commissioners present: Chairperson Daninger, Commissioners Valerie Holthus, Bert Koehler, Kyle Nemeth, Lynae Gudmundson, and Steve Peterson. Commissioners absent: Commissioner Tim Cleven Also present: City Planner Stephanie Hanson Others APPROVAL OF MINUTES. January 8, 2013 There were no changes. Motion by Holthus, seconded by Peterson, to approve the minutes as presented. Motion carried on a 4 -ayes, 0 -nays, 2- present (Commissioners Nemeth and Gudmundson), 1- absent (Commissioner Cleven) vote. February 12, 2013 Commissioner Nemeth stated he had a couple of changes to the workshop meeting. Page 2, first paragraph, third sentence "studio's" should be "studios." Page three, seventh paragraph down, Item 100, it should state "Mr. Liska stated this should be permitted across all residential zones..." Page 4, second paragraph down, "Commissioner Holthus wondered what types of buildings these would be, she did note if they were multiple units." Commissioner Nemeth stated on the regular meeting, page 7, paragraph four, second sentence, he made a comment "He thought they could look at putting a in some three way stops." Regular Andover Planning and Zoning Commission Meeting Minutes — March 12, 2013 Page 2 Motion by Nemeth, seconded by Gudmundson, to approve the minutes as revised above. Motion carried on a 6 -ayes, 0 -nays, 0- present, 1- absent (Commissioner Cleven) vote. PUBLIC HEARING: PRELIMINARY PLAT —HICKORY MEADOWS 2N° ADDITION— TOLLBERG HOMES City Planner Hanson noted the purpose of this item is to hold a public hearing and take input on Hickory Meadows 2nd Addition Preliminary Plat. City Planner Hanson reviewed the proposed preliminary plat with the Commission. Commissioner Nemeth asked if the trail along Coon Creek does not come into fruition, what happens to the property there, does the easement go away or will it remain. Ms. Hanson indicated this is also a drainage /utility easement so it will remain. Commissioner Peterson asked on the trail, it looks there is a small wetland in the middle of the trail easement and if a trail was built there, would the City fill in the wetland and buy wetland credits. Ms. Hanson stated she was not sure of that process but would check with the Engineering and Public Works Departments to clarify how that would actually work. Commissioner Peterson asked what is the minimum lot width in this R4 District. Ms. Hanson indicated it is 80 feet at the front setback. Motion by Holthus, seconded by Kohler, to open the public hearing at 7:14 p.m. Motion carried on a 6 -ayes, 0 -nays, 1- absent (Commissioner Cleven) vote. Mr. Nate Buffbam, 202 144`h Avenue NW, asked regarding Lot 7, it seems like a big portion of the lot will cross over a big pond and he wondered how the development will remedy that situation. He also stated with additional homes, they would like pedestrian access to the Prairie Road sidewalk. Mr. Nathan Jones, 2285 Jarvis Hills Drive, Little Canada, representing Tollberg Homes, reviewed the preliminary plat with the Commission. He noted regarding Lot 7, there is a little wetland on that lot and with the first part of the development, wetland was created to mitigate the two -for -one impact on Lot 7. They have approvals with the watershed district for that. He indicated there will be a retaining wall along where the pond is, approximately 8 feet tall and 70 feet long. This will make that lot buildable. Chairperson Daninger stated 8 feet by 70 feet is pretty high up and he wondered what type of material will be used. Mr. Jones stated it will be a keystone locking type of stone. Chairperson Daninger asked if Mr. Jones was aware of the request to provide the LOMA. Mr. Jones stated he did but they need to have a copy of the recorded plat to submit for the LOMA. He stated they are not opposing staff's recommendation of requiring the LOMA Regular Andover Planning and Zoning Commission Meeting Minutes —March 12, 2013 Page 3 but the timing might not work out so they need to make that contingent upon a building permit or certificate of occupancy, or something at a later date that allows them to proceed with their LOMA application. Chairperson Daninger asked if the rain gardens are new in the plat, his concern is with the maintenance agreement for them. He wondered who is going to take care of the rain gardens until the lots are sold. Mr. Jones stated the developer would be responsible for the maintenance until the lots are sold. Commissioner Holthus asked regarding maintaining the rain gardens, do they need to be dredged and replanted or what kinds of maintenance needs to be done. Mr. Jones stated typically it is some weeding and mulching. Mr. Jones stated the temporary cul -de -sac would be on Lots 8 and 1, and the adjacent property to the west has gone before the Commission for a sketch plan and he was not sure what the owner's time frame is for developing that property but it sounds like the owner would be interested in developing that as soon as possible. If, in fact, that does go through, they would not want to put in a temporary cul -de -sac to have it ripped out in a year or less so they would like to avoid the temporary cul -de -sac, if possible. Mr. Louis Ramone, 192 144`h Lane, wondered if the City has some type of regulations as to the type of houses allowed. Chairperson Daninger stated the Commission looks at the lot size and not at the size of a home being built on the site. Based on the size of the lots and history, he thought these will be substantially larger homes or higher value homes. Ms. Hanson stated the City cannot put a requirement on value but the City does have size requirements. Mr. Ramone indicated they are in urgent need of trails in this area because they like to bike and the roads are dangerous. Motion by Holthus, seconded by Gudmundson, to close the public hearing at 7:32 p.m. Motion carried on a 6 -ayes, 0 -nays, 1- absent (Commissioner Cleven) vote. Chairperson Daninger recapped what was discussed during the public hearing. Commissioner Holthus asked if they move to recommend approval of the preliminary plat, do they have to have within the motion that it is contingent on the LOMA application. Chairperson Daninger stated they can do that but he thought there will be some answers on how to do that before it goes the City Council. Commissioner Gudmundson asked if they needed to add some type of maintenance agreement before the lots are sold regarding the rain gardens in the motion. Chairperson Daninger indicated they could do that. Regular Andover Planning and Zoning Commission Meeting Minutes —March 12, 2013 Page 4 Commissioner Peterson noted on Block 2, Lot 1, there is a ten -foot trail easement connecting the north side of the lot down to Coon Creek. He wondered if this should be extended north to Block 1, Lot 1. He thought by doing this they can make a great connection to the park. Commissioner Nemeth stated they have the proposed trail next to Lot 1, Block 2 and there is a trail easement between Lots 3 and 4. He wondered why there was a duplication of the trail. Ms. Hanson noted there will only be one trail but the plat is showing two possible locations so the City has a couple of options. Motion by Holthus, seconded by Koehler, to recommend the City Council approve the Preliminary Plat of Hickory Meadows 2 "d Addition, contingent on the LOMA Application procedure and extending the trail easement as discussed, Block 1, Lot 1, to extend farther north up to the park so the recommendation would include another overlay easement on top the current easements already existing. Motion carried on a 6 -ayes, 0- nays, 1- absent (Commissioner Cleven) vote. City Planner Hanson stated that this item would be before the Council at the March 19, 2013, City Council meeting. OTHER BUSINESS. City Planner Hanson updated the Planning Commission on related items. ADJOURNMENT. PLANNING AND ZONING COMMISSION WORKSHOP MEETING APRIL 9, 2013 The Workshop Meeting of the Andover Planning and Zoning Commission was called to order by Chairperson Daninger on April 9, 2013, 6:00 p.m., at the Andover City Hall, 1685 Crosstown Boulevard NW, Andover, Minnesota. Commissioners present: Chairperson Daninger, Commissioners Tim Cleven, Lynae Gudmundson, Valerie Holthus, and Kyle Nemeth Commissioners absent: Commissioners Bert Koehler and Steve Peterson Also present: Community Development Director Dave Carlberg City Planner Stephanie Hanson Others DISCUSS CITY CODE 12 -12 PERMITTED, CONDITIONAL AND PROHIBITED USES City Development Director Carlberg reviewed the previous workshop meetings with the Commission in order to start working on changes to the City Code 12 -12 along with how the IUP (Interim Use Permit) definition came about. He noted that he reviewed other cities codes to see how they handled interim use items. ITEM 5 — ANY INCIDENTAL REPAIR, PROCESSING, AND STORAGE NECESSARY TO CONDUCT A PERMITTED, COMMERCIAL OR INDUSTRIAL USE Mr. Carlberg noted this item goes back to the original City Code from 1970. He noted he thought this was a catch all in case something was needed to be done on the side that was needed to have the principal business to operate. This does not become the main business use. He thought it was good to leave this item in the code. Commissioner Nemeth thought this was discussed previously to allow repairs to be done if needed at a retail business. Staff suggested leaving this item as is. The Commission agreed. Andover Planning and Zoning Commission Workshop Meeting Minutes —April 9, 2013 Page 2 Chair Daninger asked for a definition of this item. He wondered why it would not just be permitted. Mr. Carlberg said they do not want it to be the main use, it would be an accessory to the main use. ITEM 18 — CHRISTMAS TREE SALES City Planner Hanson indicated this item would be an item to be considered as an IUP (Interim Use Permit) but staff needed to know what districts would this include. Mr. Carlberg did not think it should be an IUP in the Shopping Center District but would be ideal to allow a Cub Scout group to be approved for an IUP to sell Christmas trees in a parking lot. He noted this is also marked in the residential district. He stated there are so many scenarios and how the City should regulate them. Commission Gudmundson asked if there are any regulations for seasonal sales on farm property. Mr. Carlberg stated there are regulations regarding selling agricultural products grown on the property. Commissioner Holthus wondered if this item could be left as a separate item and continue the CUP. Mr. Carlberg stated the only problem with that is a sunset clause cannot be put on the CUP. Commissioner Nemeth thought this would be more of a temporary thing and a CUP may not be appropriate. Mr. Carlberg stated they need to differentiate between a business that has a defined garden center out of their retail operation versus a stand alone, seasonal operation doing business out of a parking lot. That type could have an IUP attached to it with a timeframe. The Commission and staff discussed possible businesses where an IUP would be appropriate. Mr. Carlberg noted that if a business has a CUP and goes out of business, the next business that came in would be covered under the CUP but if there was an IUP with the business, it would be done if a business were to fold and would not follow through to the new business. The Commission's suggestion was to eliminate Item 18 and combine everything under Item 81 and will be an NP (Interim Use Permit), which will cover all the different business scenarios discussed. ITEMS 23 & 24 — COMMERCIAL ANIMAL TRAINING AND COMMERCIAL DOG KENNEL LICENSE Andover Planning and Zoning Commission Workshop Meeting Minutes —April 9, 2013 Page 3 Commissioner Holthus indicated she would like to see the code for this. Mr. Carlberg indicated the City allows three dogs on a property without a kennel license but if there are more than three dogs the resident needs to apply for a kennel license. This is all related to animal control of dogs and cats, commercial and non - commercial. Ms. Hanson read Code 5 -1A to the Commission. There were no changes made to this item. ITEM 25 — COMMERCIAL GREENHOUSE Ms. Hanson noted she looked at some other cities codes regarding commercial greenhouse definitions and she did not see anything. Commission Gudmundson wondered why this was not permitted in the business districts. Mr. Carlberg thought it was because the property was already designated as commercial property. Chairperson Daninger thought they should remove this from the high density residential district but leave it as a CUP in the other areas. Commission Gudmundson wondered if they should put an "I" in the residential district for commercial greenhouse. Commissioner Holthus did not see this as a temporary use. Mr. Carlberg stated nothing prevents anyone from growing things. He noted Bonnie Dehn's business is considered agricultural but if they brought in plants to sell, it would be considered commercial. Commissioner Holthus thought they may need to define what commercial greenhouse is. Mr. Carlberg thought the definition should say "A greenhouse that allows product not raised on site to be sold." Commissioner Holthus asked if there was a definition for commercial. Mr. Carlberg did not think there was. There was no decision that was needed to be made on this item. Continuous vs. Non Continuous Mr. Carlberg stated the question the Commission wanted to discuss was if they wanted to allow a business to be open for 24 hours. Do they want to allow hotels and restaurants in the GB district with a CUP. Commissioner Gunderson asked what the criteria would be for this. She thought a CUP followed the property, would that allow another business to come in if the business given the CUP were to close and build something that would not be in character with the area. A Andover Planning and Zoning Commission Workshop Meeting Minutes — April 9, 2013 Page 4 Chairperson Daninger stated for him to do the IUP, it needs to make sense. He was more concerned with a hotel coming into Andover; without continuous business this would never happen. Commissioner Holthus stated there is a PA (Permitted Accessory). She thought a waterpark could be considered a permitted accessory. Commissioner Gudmundson thought this was the only way to do this. Chairperson Daninger indicated there is a cause and effect of this. He noted that a restaurant may be affected by this. Chairperson Daninger thought it would affect other businesses besides a hotel. He thought this could prohibit a business from getting established in Andover. Commissioner Gudmundson thought this has already happened. Commissioner Holthus thought it is a matter of common sense that hotels are always open 24 hours. Chairperson Daninger thought a CUP would allow the hotel to be open 24 hours. Mr. Carlberg indicated Item 54 did not have anything across the board until they added C's to it. Chairperson Daninger reviewed what the Commission discussed for Item 54. ITEM 34 — RESTAURANT OR OTHER ESTABLISHMENT WITH LIVE ENTERTAINMENT Ms. Hanson indicated she did not find any definition for this in other cities. Mr. Carlberg indicated restaurants are a permitted use in the commercial areas under 101. He wondered if they even needed the line. Chairperson Daninger indicated if there is noise outside, that would be taken care of under the noise ordinance so he did not think this was necessary. Mr. Carlberg wondered why they would need to regulate entertainment. Commissioner Holthus thought there would be other areas in the City Code that would regulate adult entertainment in the City. She thought that they could remove the line. The Commission decided to remove Item 34 from the City Code. ITEM 36 — DAYCARE CENTERS (DROP IN) Ms. Hanson did not find any definitions on this item in other cities. The Commission decided this did not need to be defined. ITEM 40 — DRY CLEANING PROCESSING Mr. Carlberg stated they have defined this in the City Code. The Commission thought this definition was ok in City Code but they should put a "C" in the Industrial Zone. Andover Planning and Zoning Commission Workshop Meeting Minutes — April 9, 2013 Page 5 BED AND BREAKFAST Ms. Hanson indicated this was not in the City Code and the Commission wondered if this should be allowed in the City. Mr. Carlberg wondered what the difference in definitions would be with a resort and bed and breakfast. Commissioner Gudmundson wondered why they would have a separate definition for this item when it is not included in the Resort Code. She thought all of the details would be worked out in the CUP. The Commission discussed and reviewed possible businesses that could be included as a bed and breakfast such as scrapbook retreats, etc. Commissioner Holthus thought they could include bed and breakfast in the resort definition. Mr. Carlberg did not know if this would work because the resort definition indicates recreational activities and you would not want this in a high density residential district. Chairperson Daninger thought they could include this in the resort definition but have a separate paragraph with a definition so it can be included in the R -4 District. Staff indicated they would work on the definition and bring it back to the Commission for review. ITEM 55 — INTERIOR STORAGE OF MORE THAN S TIRES Ms. Hanson stated this was brought up because of other uses such as bicycle shops that have tires stored on premises. Mr. Carlberg noted Tires Plus keeps tires on site for pick up. Commissioner Holthus thought they could put "Automotive" in there. Commissioner Nemeth was not sure that would encompass agricultural tires or other large tires. Chairperson Daninger thought they should leave this as is because usually a business will need to go before the Commission to get approval. The Commission felt this was ok as written. ITEM 59 — HOW TO ADDRESS BUSINESSES THAT MAY HAVE MAINTENANCE /SECURITY PERSON LIVING ON SITE Ms. Hanson stated she reviewed this code and it is fine as written. She read the part of code. The Commission agreed. Andover Planning and Zoning Commission Workshop Meeting Minutes — April 9, 2013 Page 6 ITEM 73 — MEDICAL CLINICS Mr. Carlberg indicated it would be interesting to see how a 24 hour clinic concept would be dealt with. Chairperson Daninger stated this is a specific business, defined as a medical center. He thought this would have a CUP in order to have additional discussion on business use, hours, traffic, etc. when brought before the Planning Commission and City Council. It would have additional requirements before approval. ITEM SS — PROFESSIONAL STUDIOS Ms. Hanson reviewed the definition. She stated she looked around and did not see anything specific to professional studios. She thought the question was if people could have professional studios as home occupations. Chairperson Daninger wondered if this should be permitted in the residential districts. Commissioner Holthus indicated Item 53 defines the studio. Commissioner Gudmundson thought this item would deal with professional studios in commercial areas. Commissioner Cleven thought the reason for this was because the current code lists radio or television broadcasting with antennas as part of the definition for studio. Mr. Carlberg thought staff should look at other cities codes in order to bring back for a revised definition. Commission agreed. ITEM 96 — RENTAL BUSINESS Ms. Hanson indicated there was no information in other city codes. Chairperson Daninger thought this was a prime area for interim use. Commissioner Gudmundson asked why this would not include a "C." Mr. Carlberg stated he could see a hardware store having rental equipment as part of their business but would not want to see a rental business in a neighborhood business area. This would be allowed in GB and I districts. Commissioner Gudmundson did not know why they would choose to restrict this type of business in neighborhood business areas. Commissioner Holthus thought this should be "C" in all areas except residential. She recommended removing "I" and "P." Commissioner Gudmundson agreed. Chairperson Daninger thought they may want to define the rental business like they do medical centers. Mr. Carlberg thought they could make it an interim use. Andover Planning and Zoning Commission Workshop Meeting Minutes —April 9, 2013 Page 7 Commissioner Gudmundson wondered if they could have both "C" and "I" in one district. Mr. Carlberg stated they could not because it would be considered capricious and hard to determine which businesses would be considered a "C" and which would be an 411.15 Mr. Carlberg thought staff needed to look at this item more closely and bring it back to the Commission. The Commission agreed. ITEM 99 — RESORTS Done in a previous item. ITEM 102 — RETAIL TRADE AND SERVICES Ms. Hanson thought the Commission wanted to discuss this more because of the Christmas Trees in the definition and other uses. Chairperson Daninger thought they needed to define what retail trade and services is and what is permitted. The Commission thought it made sense to be in the general business district. Mr. Carlberg stated they could make this a conditional use permit based on its use. He wondered what the Commission wants to define because there are a lot of retail services listed. Mr. Carlberg thought the way it is written as a definition is ok but staff should review this further and mark duplicate items that are listed elsewhere in the Code for the Commission to review and discuss. The Commission agreed. OTHER BUSINESS. Community Development Director Carlberg updated the Planning Commission on related items. Commissioner Holthus asked what the situation with Walmart was. Mr. Carlberg indicated Walmart closed on the property on April 3, 2013 and the demo and building permits were almost ready to be issued. Mr. Carlberg stated Christian Bros. had a ground breaking on Sunday, April 7, 2013. ADJOURNMENT. Chairperson Daninger and Vice Chairperson Holthus were appointed on April 10, 2012; therefore their terms expire in 2014. There is no need to take action on this item. 1685 CROSSTOWN BOULEVARD N.W. • ANDOVER, MINNESOTA 55304 • (763) 755 -5100 FAX (763) 755 -8923 • WWW.ANDOVERMN.GOV TO: Planning and Zoning Commissioners FROM: Andrew Liska, Associate Planner A6,, SUBJECT: PUBLIC HEARING: Conditional Use Permit (13 -05) regarding temporary floating dock on Rum River - Planning DATE: 14 May 2013 INTRODUCTION The applicants, Peter Miller and Patricia Rysdam of 15238 — 7th Ave NW, are seeking approval of a conditional use permit allowing a temporary dock on the Rum River. The applicants are seeking this structure for the docking of kayaks and canoes. DISCUSSION City Code 13 -5 -5 Scenic River District Regulations and Requirements states temporary docks on the Rum River are a conditional use. City Code 12 -14 -6 B. provides the following criteria for granting conditional use permits: 1. In granting a Conditional Use Permit, the City Council shall consider the advice and recommendation of the Planning and Zoning Commission and: a. The effect of the proposed use upon the health, safety, morals and general welfare of occupants of surrounding lands. b. Existing and anticipated traffic conditions, including parking facilities on adjacent streets and land. c. The effect on values of property and scenic views in the surrounding area, and the effect of the proposed use on the Comprehensive Plan. 2. If it shall determine by resolution that the proposed use will not be detrimental to the health, safety, morals, or general welfare of the community, nor will cause serious traffic congestion or hazards, nor will seriously depreciate surrounding property values, and that said use is in harmony with the general purpose and intent of this title and the Comprehensive Plan, the City Council may grant such permits. DNR COMMENTS The classification of the Rum River as a Wild and Scenic River requires a thirty (30) day review from the Minnesota Department of Natural Resource. The application was submitted to Kate Drewry, the North Metro Area Hydrologist and she stated the proposed dock configuration meets the DNR's general criteria and no additional permitting is required. She commented that the dock structure seems excessive given its purpose of docking canoes and kayaks, specifically the two four (4') foot by eight (8') foot dock sections in the middle of the dock between the walkway and the docking area. The purpose of the dock could be achieved without these two sections and being a Wild and Scenic River reducing unnecessary dock sections may be desired. ACTION REQUESTED The Planning Commission is asked to hold a public hearing and provide a recommendation to the City Council regarding the conditional use permit request. We have learned that a permit is required due to the Rum being a MN Wild and Scenic River. We have consulted with the DNR and believe we have a design that meets standards. This dock is a design intended primarily for kayaks and canoes. The design sheet shows the kayak slip at one end. The dock will have a temporary walkway to the shore. Both will be removed in winter. We plan to anchor the dock with cables to a points as close as allowable to the dock, attaching to concrete pilings sunk into the earth (not extending above the surface except as needed for the cables to attach). We do not have neighbors directly across the river. Our nearest neighbors do not have a clear view of the place we plan to put the dock. Numerous neighbors up and down the river from us have similar small docks. We actually were attracted to the area after canoeing here and see- ing this and other places along the river. We believe this dock will not have a detrimental effect on health, safety, and welfare of the surrounding area. The dock will not intrude significantly on water traffic and is of dimensions recommended by the DNR. Seeing other docks in- creased the property value of this place for us and we expect it to not harm values for others in this area. Dock installations and their associated uses are factors in this deterioration. Studies of lakes in the Midwest show that docks and boat lifts may shade out important aquatic plants and eliminate critical habitat where fish spawn, feed, grow, and find shelter from predators. Shoreline views may also suffer when large dock systems are installed. Also, there is a growing concern about the private use of the water surface if docks and associated ,ter 0 r ++ structures extend too far, cover too much surface area, or span the retire owned frontage, The proliferation of dock configurations and dimensions is a concern to the DNR. The dock configuration does meet the general DNR criteria to proceed without a DNR Public Waters permit. The City may of course impose more restrictive requirements based on specific site considerations and the location on a Wild and Scenic River. I have no particular recommendations in that regard other than to observe that the dock structure does seem overly large to accommodate the stated purpose of dockage for a couple of canoes \kayaks. DATE: May 14, 2013 INTRODUCTION The property owner and applicant are proposing to borrow (mine) up to 60,000 cubic yards of sand and replace it (land reclamation) with 20,000 cubic yards of black dirt. City Code 12 -12 requires a conditional use permit for mining and/or land reclamation of more than 400 cubic yards of material on a property. DISCUSSION The applicant has been awarded the bid from the Anoka County Highway Department to reconstruct 1.5 miles of Bunker Lake Blvd (County Road 116) and '/z mile of 7th Avenue NE (County Road 7). Up to 60,000 cubic yards would be mined from the site to be used for the reconstruction project. Up to 20,000 cubic yards of black dirt would then be placed back on the site. The mining and land reclamation sites are shown on the attachments. The reconstruction street project began in April so the mining and land reclamation will begin as soon as the CUP is issued. Engineering Department Review During the review process, the Engineering Department had some concerns regarding the lowering of the site elevation and how it will affect future buildability of the site. Staff met with Glenn Sonsteby (Power of Attorney for real estate transactions for the property owner Rosella Sonsteby) and Brent Jensen with North Pine Aggregate to discuss the possible implications of removing 60,000 cubic yards of material. On the west side of the property, buildings may be limited to slab on grade; in the center and east side of the property structure styles may be restricted unless elevation changes are made. Glen Sonsteby and Brent Jensen are aware of the concerns; however they have chosen to move forward with the project. The Engineering Department has provided the attached memorandum to bring this to the attention of the property owner and applicant. Lower Rum River Watershed Management Organization ( LRRWMO) A permit from the LRRWMO is also required for the proposed project. The permit is required prior to the commencement of work. Silt fence and seeding to establish groundcover after project completion will be required through the LRRWMO pen-nit. Transportation Bunker Lake Blvd will be closed to through traffic during construction which will allow the material to be safely moved from the site. Conditional Use Permit Criteria City Code 12 -14 -6 B. provides the following criteria for granting conditional use pen-nits: 1. In granting a Conditional Use Permit, the City Council shall consider the advice and recommendation of the Planning and Zoning Commission and: a. The effect of the proposed use upon the health, safety, morals and general welfare of occupants of surrounding lands. b. Existing and anticipated traffic conditions, including parking facilities on adjacent streets and land. c. The effect on values of property and scenic views in the surrounding area, and the effect of the proposed use on the Comprehensive Plan. 2. If it shall determine by resolution that the proposed use will not be detrimental to the health, safety, morals, or general welfare of the community, nor will cause serious traffic congestion or hazards, nor will seriously depreciate surrounding property values, and that said use is in harmony with the general purpose and intent of this title and the Comprehensive Plan, the City Council may grant such permits. Planning Commission Review The Planning Commission will need to consider whether the proposed use is acceptable based on the conditional use permit criteria listed above, whether other conditions are necessary, or whether the proposed use cannot be made to meet the conditional use permit criteria. Hanson, City Planner *� SUBJECT: PUBLIC HEARING: Revised Preliminary Plat and Planned Unit Development Review of Country Oaks West 2nd Addition, Block 1, Lots 12 -23 DATE: May 14, 2013 INTRODUCTION The Planning and Zoning Commission is asked to review the revised preliminary plat and Planned Unit Development (PUD) of Country Oaks West 2°d Addition, Block 1, Lots 12 -23, DISCUSSION The developer is proposing the revised preliminary plat /PUD to change the style of housing from attached twin home units to single family houses /units because the change in the real estate market over the past few years supports the sale of single family homes. The portion of the plat affected by these changes is shown in the attachments. This adjustment reduces the number of units from the planned 12 attached twin home units to 8 single family units. Planned Unit Development Standards The setbacks for the previously approved twin homes will remain the same however the lot width is being proposed at 75 feet. Setbacks are as follows: Item Twinhouse Standard Proposed Single Family 8,000- 19,889 sf as shown on prelim. Plat revised 10/29/04 and stamped rec'd by the City Min. Lot Width 10/29/04 75 ft Front Setback 25 feet 25 ft Side Setback 10 feet 10 ft Rear Setback 65 feet minimum 65 ft min Single Family Unit Design The developer is proposing different styles of single family homes. Each home style will have a number of architectural and color options that will be applied to prevent repetition. Attached are photos of examples of the types of homes and architectural standards that may be constructed on the lots. Buildability A grading plan has been prepared illustrating the low floor elevations of each unit. Sufficient information has been provided to demonstrate that single family homes can be constructed as proposed. Easements Existing easements will be vacated and be re- dedicated as part of the final plat. The easements will meet the width requirements in City Code and will provide sufficient area for drainage and utilities. Landscaping Plan The attached landscaping plan illustrates the planting screen from the Burlington Northern Railroad that was approved as part of the original plat and PUD. The plans require; the planting of sixty -five (65) 8' — 10' white pines along the eastern property line. In addition to the white pines, the original landscape plan included various plantings for each of the twin home sites. Staff is recommending the white pines be planted to screen from the railroad. Staff has determined that the white pines can be planted within the 10- foot drainage and utility easement on the furthest most eastern portion of the lots. This has been added as a condition of approval in the attached resolution. Homeowners Association A homeowners association was created to maintain the landscaped areas and exteriors of the twin homes. Currently there are three (3) twin homes constructed that are part of the homeowner's association. The current twin home owners are delinquent on paying the associations dues; however the developer has continued the up keep of the properties by providing lawn and snow removal services. The developer is proposing to disband the association; however, would give the twin home owners the option to contract with the developer for continued lawn and snow removal services. Conformance with Local Plans and Ordinances 1. The property is located in the Metropolitan Urban Service Area (MUSA) and within the current stage of sewer expansion. 2. The property is currently zoned M -1, Multiple Dwelling Medium Density. 3. The proposed project requires Planned Unit Development Review to establish standards unique to this development. The Planning Commission is asked to review the proposed P.U.D. based on City Code 13 —3, "Planned Unit Development, " City Code 13 -3 -11 identifies Desirable PUD Design Qualities that are sought in any PUD proposal. These qualities are listed below. A. Achieves efficiency in the provision of streets and utilities and preserves area to achieve the elements of design qualities described in this Chapter. B. Provides convenient and safe access for vehicles and pedestrians and all types of activity that are anticipated to be a part of the proposed development. C. Provides a buffer between different uses, adjacent properties, roadways, between backyards of back -to -back lots. D. Preserves existing stands of trees and /or significant trees. E. Provides considerable landscaping treatments that compliment the overall design and contribute toward an overall landscaping theme. F. Preserves significant usable space on individual lots or through the provision of open space within the development. G. Provides an attractive streetscape through the use of undulating topography, landscaping, decorative street lighting, decorative mailbox groupings, retaining walls, boulders, fencing, area identification signs, etc. H. The proposed structures within the development demonstrate quality architectural design and the use of high quality building materials for unique design and detailing. I. The lasting quality of the development will be ensured by design, maintenance and use guidelines established through an owners association. Planning Commission Review The Planning Commission will need to consider whether the proposed changes meet the intent of a planned unit development and design criteria. ACTION REQUESTED The Planning Commission is asked to hold a public hearing, review the proposed preliminary plat and PUD amendment, and make a recommendation to the City Council. Contingent upon staff review and approval for compliance with City ordinances, policies and guidelines. 9. The drainage and utility easements shall be vacated at the time of the final plat. 10. The developer will be required to enter into a development contract as part of the final plat. WHEREAS, the applicant has requested a variance to City Code 11 31 -2 to allow lots to front on a collector street, and; WHEREAS, the Planning Commission recommends approval of the variance based on the finding that the location of wetlands on the property eliminates any other method of providing access at the north end of the proposed project and the anticipated daily traffic on the collector street falls within the definition of a minor collector street as recommended by the Planning Commission, and; «'HEREAS, the applicant has requested a variance to City Code 11- 3 -6F.to allow Lots 1,2 and 3 of Block 2 to be double frontage lots, and; WHEREAS, the Planning Commission recommends approval of the variance based on the finding that by allowing these lots to have double frontage, the driveways can access an interior local street instead of the collector street. WHEREAS, the applicant has requested a variance to City Code 11 -3 -3G. to exceed the 500 foot maximum cul -de -sac length, and; WHEREAS, the Planning Commission recommends approval of the variance based on the finding that wetlands to the west, a railroad to the east and no involvement from properties to the north prevent another street connection at this time. Additionally, there is potential for the collector street to continue north and eliminate the variance in the future. WHEREAS, the Planning Commission has reviewed the request and has determined that said request meets the criteria of City Code 13 Planned Unit Development with the following findings: WHEREAS, as a result of such public hearing, the Planning and Commission recommended to the City Council approval of the plat, and; NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Andover has received the recommendation of the Planning Commission and approves the preliminary plat for one hundred lots with the following conditions: 1. Carlberg, Community Development Director L SUBJECT: PUBLIC HEARING: Revised Preliminary Plat and Planned Unit Development Review of Parkside at Andover Station in the northeast quarter of Section 34, Township 32, Range 24, Anoka County, Minnesota. DATE: May 14, 2013 INTRODUCTION The Planning and Zoning Commission is asked to review the revised Preliminary Plat and Planned Unit Development (PUD) of Parkside at Andover Station as requested by the Andover Economic Development Authority (EDA). DISCUSSION The Andover EDA has been working with Cherrywood Advanced Living, Inc. to develop plans for a 20 unit assisted living senior housing project on 1.8 acres located on the northeast corner of 139"' Avenue NW and Linnet Street NW. This area was originally proposed to be developed as three 8- plexes similar to the units that have been developed to the east. Market conditions have changed in the area and there is a continuing need for life cycle housing including various forms of senior housing which includes assisted living facilities. Cherrywood Advanced Living, Inc. upon the approval of the platting of the property will be submitting a commercial site plan for City approval. In addition to a site plan being submitted, a grading drainage and erosion control plan and a landscape plan will be submitted as well. The proposed project will meet the required setbacks of the original preliminary plat and Planned Unit Development from 2005. Planned Unit Development Standards The setbacks previously approved were as follows: Building Setback from East Property Line - 20 feet Building Setback from North Property Line — 30 feet Building Setback from 139`h Avenue NW - 20 feet Building Setback from Linnet Street - 25 feet Unit Style The builder is proposing to build a 20 unit assisted living senior housing project. The building will be one level and will be designed to incorporate materials to match into the adjacent neighborhoods. Buildability Soil borings have been completed. A grading plan will be prepared with the Commercial Site Plan process. Sufficient information has been provided to demonstrate the project can be constructed as proposed. Streets Public streets have been constructed providing interior access through the development. The streets meet the City's typical urban street requirements (33 feet wide within a 60 foot wide right -of -way) which will allow parking on both sides of the street. Pedestrian Access A bituminous trail has been constructed along the south side of 139`h Avenue NW and along the west side of Linnet Street NW. The trails link the proposed project as well as the neighborhood to the west to the community park to the north and the commercial development to the east and south. Easements Easements are provided at the perimeter of each building site as shown on the attached Preliminary Plat. The easements will provide sufficient area for drainage and utilities. There are some existing easements that will need to be vacated that were dedicated and constructed with the design and layout of the 8 -plex building concept. Conformance with Local Plans and Ordinances 1. The property is located in the Metropolitan Urban Service Area (MUSA) and within the current stage of sewer expansion. A previous Comprehensive Plan Amendment changed the land use designation of the property from General Business to Urban Residential Medium Density. 2. The property is currently zoned M -1, Multiple Dwelling Medium Density. Staff Recommendation Staff recommends approval of the revised Preliminary Plat and Planned Unit Development subject to the conditions of the attached resolution. NO. • 9nhb IN • Nsm le4a Nt2 88404 CITY OF ANDOVER COUNTY OF ANOKA STATE OF MINNESOTA RE& NO R052 -05 A RESOLUTION APPROVING THE PRELIMINARY PLAT WITH PLANNED UNIT DEVELOPMENT REVIEW OF "PARKSIDE AT ANDOVER STATION' FOR PROPERTY LOCATED IN SECTION 34, TOWNSHIP 32, RANGE 24, ANOKA COUNTY, MINNESOTA, DESCRIBED AS IN THE NORTH HALF OF THE NORTHEAST QUARTER OF SECTION 34, TOWNSHIP 32 RANGE 24, ANOKA COUNTY MINNESOTA AS SHOWN ON THE ATTACHED PRELIMINARY PLAT WHEREAS, Bruggeman Homes has requested approval of a preliminary plat with Planned Unit Development Review of Parkside at Andover Station; and WHEREAS, the Andover Review Committee has reviewed the preliminary plat; and WHEREAS, pursuant to published and mailed notice thereof, the Planning Commission has conducted a public hearing on said plat; and WHEREAS, the Planning Commission has reviewed the request and has determined that said request meets the criteria of City Code 13 Planned Unit Development with the following findings: 1. The project is efficiently designed and preserves space to provide common open space, preserve trees, implement an attractive landscaping theme and provide buffering from the single family neighborhood to the west. 2. The project provides pedestrian connections that will match the design standards established for Andover Station. 3. The project provides an attractive streetscape through the arrangement of structures, landscaping, lighting and trails. 4. The structures provide quality architectural design and low maintenance materials that will reduce maintenance costs and allow the project to remain attractive and well maintained into the future. WHEREAS, the applicant has requested approval of a variance to City Code 11 -3 -3G. to allow a street terminating in a cul -de -sac to exceed 500 feet in length; and WHEREAS, the Planning Commission recommends approval of the variance based on the following findings: 1. A loop street providing a second access point will be completed as a public project at the time the community park to the north is developed. WHEREAS, the applicant has requested approval of a variance to City Code 9 -1 -4. to allow similar structures within 300 feet of one another; and WHEREAS, the Planning Commission recommends approval of the variance based on the following findings: 1. The proposed project has been designed to provide two types of housing and arranged to provide some variety within a unified overall theme. This design utilizes similar materials to reduce maintenance costs to allow the project to remain attractive and well maintained into the future. WHEREAS, the applicant has requested approval of a variance to City Code 11 -3 -3. to allow lots with less than 100 feet of buildable lot depth and lots with less than 116.5 feet of buildable lot depth adjacent to wetlands ; and WHEREAS, the Planning Commission recommends approval of the variance based on the following findings: 1. These standards were established to allow sufficient rear yard space for single family developments. The design of the proposed units, the relationship of lot boxes to common open space and reduced setbacks result in a different kind of neighborhood design. WHEREAS, the Planning Commission finds the request would not have a detrimental effect on the property values and scenic views of the surrounding area, and; WHEREAS, as a result of such public hearing, the Planning Commission recommends to the City Council the approval of the plat, and; NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Andover hereby agrees with the recommendation of the Planning and Zoning Commission and approves the Preliminary Plat with Planned Unit Development Review, with the following conditions: 1. The Preliminary Plat shall conform to the plans revised January 28, 2005 and stamped received on February 23, 2005 except to be modified as follows: a. To create a separate lot of record between the rear yards of Lots I -10, Block 2 and the side yards of Lots 11 -33, Block 2 to be owned by the homeowners association for recreation purposes for all owners within said association. 2. The development shall conform to City Code Titles 11, 12, and 13, as well as Exhibit B "Parkside at Andover Station Design Standards ". Exhibit B shall regulate when in conflict with the City Code. 3. Exhibit B shall regulate the lot dimensions, setbacks, area identification sign and landscaping plan for the proposed development. 4. A variance to City Code 11 -3 -3G. to allow a street terminating in a cul -de -sac to exceed 500 feet in length is hereby approved. 5. A variance to City Code 9 -1 -4. to allow similar structures within 300 feet of one another is hereby approved. 6. A variance to allow lots with less than 100 feet of buildable lot depth and lots with less than 116.5 feet of buildable lot depth adjacent to a wetland is hereby approved. 7. The developer obtains all necessary permits from the Coon Creek Watershed District, DNR, Corps of Engineers, LGU, MPCA, Anoka County Highway Department and any other agency that may be interested in the site. 8. Park dedication and trail fees shall be based paid on a per unit basis at the rate in effect at the time of preliminary plat approval. This payment shall be based on the number of units on the final plat(s) and shall be made prior to the City's release of the final plat(s). �. Contingent upon staff review and approval for compliance with City ordinances, policies and guidelines. 10. Such plat approval is contingent upon a development agreement acceptable to the City Attorney. 11. A property owners association shall be created with the following documents provided to the City Attorney for review and approval prior to being recorded with the final plat in accordance with City Code 11 -2 -3: a. Articles of Incorporation b. By -laws of the association c.
