Carlberg, Community Development Director SUBJECT: Approval of Minutes — January 8, 2013 DATE: March 12, 2013 REQUEST The Planning and Zoning Commission is requested to approve the minutes from the January 8, 2013 workshop and the January 8, 2013 regular meetings. The Planning and Zoning Commission did not approve these minutes at the February 12, 2013 meeting due to a lack of quorum. There were two members absent from the January 8th meeting and two members resigned or were not reappointed to a position prior to the February 12`h meeting leaving only three (3) eligible Commissioners to approve the minutes. Staff discussed this issue with the City Attorney. Based on the discussion the three (3) Commissioners in attendance at the January 8th meeting should approve the minutes. The above narrative describes the circumstances as to why a quorum is not able to approve the minutes and is hereby noted for the record. PLANNING AND ZONING COMMISSION WORKSHOP MEETING JANUARY 8, 2013 The Workshop Meeting of the Andover Planning and Zoning Commission was called to order by Chairperson Daninger on January 8, 2013, 6:00 p.m., at the Andover City Hall, 1685 Crosstown Boulevard NW, Andover, Minnesota. Commissioners present: Chairperson Daninger, Commissioners Dennis Cleveland, Valerie Holthus, Steve Peterson, and Michael Steel. Commissioners absent: Lynae Gudmundson and Kyle Nemeth Also present: City Planner Stephanie Hanson Associate Planner Andrew Liska Others DISCUSS CITY CODE 12 -I2 PERMITTED, CONDITIONAL AND PROHIBITED USES City Planner Hanson stated the Planning Commission had left off their last discussions on the use table on line 61. Chair Daninger stated the goal of the Planning Commission was to eliminate the blank areas in the land use table. City Planner Hanson stated that 61 "Keeping up to five farm animals, plus one additional farm animal per above 5 acres on residential properties 5 acres or greater up to a maximum of 20 animals" should now read "Farm animals up to 5 per acre, plus one additional farm animal per acre above 5 acres on residential properties 5 acres or greater up to 20 animals and definition under City Code 12 -2. City Planner Hanson stated that 62 "Keeping of more farm animals than allowed as a permitted use on residential properties 5 acres or greater in compliance with Title 5 and definition under City Code 12 -2" should now read "Farm animals greater than allowed as a permitted use on residential properties 5 acres or greater in compliance with Title 5 and definition under City Code 12 -2" Andover Planning and Zoning Commission Workshop Meeting Minutes — January 8, 2013 Page 2 City Planner Hanson stated that 63 "Keeping of poultry on residential properties without municipal sewer and water in compliance with Title 5" should now read "Poultry on residential properties without municipal sewer and water in compliance with Title 5 and definition under City Code 12 -2." Commissioner Peterson noted that 63 should include "City Code" before "Title 5." City Planner Hanson noted staff is not proposing any changes to 64 "Landfills." City Planner Hanson stated that 65, 66, and 67 all deal with liquor licenses and the proposed change in adding "in compliance with City Code 3 -1" will make the table easier to use. Commissioner Cleveland noted that 65 "Liquor licenses" includes the zoning classification GR. Commission discussed and Chair Daninger feels that it should be mentioned and discussed. Following discussion, Chair Daninger suggested leaving it as a conditional use. City Planner Hanson noted staff is not proposing any changes to 68 "Lumberyards." City Planner Hanson noted staff is not proposing any changes to 69 "Manufacturing." City Planner Hanson noted that number 70 "Manufactured homes and modular homes, provided they are developed under a planned unit development and the complex is at least 20 acres" should be changed from a permitted use to a planned unit development. Associate Planner Liska noted that this change is to reflect the definition in the uses table as it mentions "planned unit development" in the definition it should be "PUD" in the uses table rather than a permitted use. City Planner Hanson noted staff is not proposing any changes to 71 "Marinas." City Planner Hanson noted staff is not proposing any changes to 72 "Medical and dental clinics." Chair Daninger asked if you cannot have a dentist office in your house. City Planner Hanson confirmed that was correct. City Planner Hanson noted that number 73 "Medical clinic — 24 hour operation' should be discussed based on the changes to the Code regarding continuous use and non - continuous use based on zoning districts. Chair Daninger stated that it would be nice to have a 24 hour clinic. Commissioner Peterson asked where "Limited Business" was located in the City. Chair Daninger questioned how to define "medical clinic." Andover Planning and Zoning Commission Workshop Meeting Minutes —January 8, 2013 Page 3 Commissioner Cleveland stated that in looking at 72, you cannot have a doctor's office or dental clinic in your house but if you are a psychologist you can have an office in your house. They can be Psychiatrists, which are medical doctors. Cleveland mentioned that this is a very common practice for this field. Chair Daninger stated that this may be covered under businesses. Chair Daninger stated that 73 should be flagged to be revisited. The updated use table for continuous and non - continuous use is needed as the current Code for 73 seems to be conflicting for some of the zoning districts. City Planner Hanson noted that 74 "Mini Storage" should include "(indoor storage only)" as to not allow exterior storage. City Planner Hanson noted that 75 "Mortuaries and funeral homes" should include "(without crematorium)" as crematoriums are covered separately in the uses table. City Planner Hanson noted no change for 76 "Multiple dwellings" and 77 "Offices." Commissioner Peterson asked for additional clarification regarding 76 and the requirements for a planned unit development. Chair Daninger explained that the PUD is beneficial as they are more flexible. City Planner Hanson noted that number 78 "Open, off street parking space" should be deleted as it is covered more in depth in 12 -13 -8. City Planner Hanson noted that number 79 "Outdoor display — only during operating hours" should be deleted as it has been combined with number 81. Chair Daninger asked why number 81 "Outdoor display, storage, and sales — during operating hours only" does not include Neighborhood Business (NB) and Industrial (I). Planner Hanson stated that it could be changed. Chair Daninger stated that in 80 "Outdoor display, storage, and sales" shouldn't be allowed in NB but SC doesn't seem unreasonable. Commissioner Holthus questioned what the definition of limited business is and asked if it limited use. She noted the very few businesses are designated as this type today. Chair Daninger stated that additional research should be done on the Limited Business classification and noted that the category could be built for the future. Commissioner Peterson questioned if there was a specific purpose in mind with this zoning classification. City Planner Hanson noted that gas stations should be considered when looking at the zoning districts and the uses in them. Chair Daninger suggested allowing NB and SC through a conditional use. Commissioner Peterson agreed with Chair Daninger. Andover Planning and Zoning Commission Workshop Meeting Minutes — January 8, 2013 Page 4 City Planner Hanson mentioned that Frattallone's Ace Hardware has requested a change in Code to allow for outdoor display, storage, and sales. Chair Daninger noted that the conditional use permits are fair to businesses. Rather than going ahead with plans without guidance, they can go through the process so both the business and community can reach an agreement. He noted that he is in favor of conditional use permits for this district. Chair Daninger noted that based on discussions 81 "Outdoor display, storage, and sales — during operating hours only" have the same conditional use permits allowed in the zoning districts as 80. City Planner Hanson noted staff is not proposing any changes to 82 "Outdoor theatres." City Planner Hanson noted staff is not proposing any changes to 83 "Pawnbrokers — as defined in Title 3, Chapter 4 of the City Code." Chair Daninger questioned why pawnbrokers couldn't be located in SC and I. He noted the same for Precious metal dealers. City Planner Hanson noted staff is not proposing any changes to 84 "Precious metal dealers — as defined in City Code 3 -4." Chair Daninger proposed changing to allow pawnbrokers and precious metal dealers in both Shopping Center and Industrial zoned districts. City Planner Hanson noted staff is not proposing any changes to 85 "Principle buildings exceeding height maximum subject to City Code 12 -3 -5." City Planner Hanson noted 86 "Private dog kennel license (2.5 acre minimum lot size required)" should include "in compliance with City Code 54A." City Planner Hanson noted that 87 "Private garages" should be deleted as it is covered in 48 regarding accessory structures. DISCUSS ITEMS ON PLANNING COMMISSION AGENDA Chair Daninger mentioned that he will be stepping down on the first item due to potential conflict of interest as he does business with Kottkes. Chair Daninger provided a brief background on the property and mentioned that this item is not regarding ponds, tire storage, or any other uses and only regarding the stockpiled fill on the property. Commissioner Steel stated how City Code 12 -14 -6 B regarding criteria for granting conditional use permits. He states he is uncomfortable with the current language. Chair Daninger suggested that Commissioner Steel voice his concerns tonight at the Planning Commission meeting but also encouraged him to work with the Code as it is written, for the time being. Chair Daninger noted that the Planning Commission will pick up on 88 next time. OTHER BUSINESS No other business. Motion by Cleveland, seconded by Steel, to approve the minutes as presented. Motion carried on a 4 -ayes, 0 -nays, 1- present ( Holthus), 2- absent (Commissioners Nemeth, Gudmundson) vote. December 11, 2012 Regular Meeting. Commissioner Steel noted on page 2, the wording "No one wished to address the Panning Commission" should be changed to Planning Commission. Motion by Cleveland, seconded by Steel, to approve the minutes as amended. Motion carried on a 4 -ayes, 0 -nays, 1- present (Commissioner Holthus), 2- absent (Commissioners Nemeth, Gudmundson) vote. PUBLICHEARING. Conditional Use Permit (13 -01) for Automobile Service Station —1716 Bunker Lake Boulevard NW — Christian Brothers Automotive. Chairperson Daninger stepped down from this item due to conflict of interest. Vice Chairperson Holthus presided over the meeting. ft Regular Andover Planning and Zoning Commission Meeting Minutes — January 8, 2013 Page 2 Associate Planner Liska noted the purpose of this item is to hold a public hearing and take input on a Conditional Use Permit (13- 01).allowing an automobile service station (auto repair and service). Associate Planner Liska reviewed the proposed conditional use permit with the Commission. Commissioner Peterson asked staff what the Sunset clause would encompass. Mr. Liska reviewed the clause with the Commission. Commissioner Steel asked if there were any environmental issues with the soil. Mr. Liska referred the question to the applicant. Motion by Cleveland, seconded by Peterson, to open the public hearing at 7:10 p.m. Motion carried on a 4 -ayes, 0 -nays, 2- absent (Commissioners Nemeth, Gudmundson) vote. Jonathan Wakefield, Director of New Store Development for Christian Brothers Automotive, made a presentation to the Commission. Mr. Wakefield noted they have done environmental and asbestos surveys and both came back clean. Commissioner Steel asked what type of certification the technicians will have. Mr. Wakefield stated since they are not a repair shop they need to hire top -notch technicians that know the diagnostic equipment they have. He explained to the Commission the requirements. Commissioner Cleveland asked if they have technicians certified for hybrid vehicles. Mr. Wakefield indicated he was not sure and would need to check into it and report back to City Staff. Commissioner Cleveland asked if there are other stores like this in Minnesota. Mr. Wakefield stated this was the first one in Minnesota. Commissioner Peterson asked why the parking stalls in the back of the lot are double stacking stalls. Mr. Wakefield stated they have to have the capacity to handle the vehicles for different loads on different days. They placed the double stacking stalls in the back of the property to hide it from the road and will use it as needed. Commissioner Peterson asked what the main types of service they will be performing. Mr. Wakefield stated their niche is right after the warranty runs out to vehicles that are ten to twelve years old. He listed some of the services to the Commission. Regular Andover Planning and Zoning Commission Meeting Minutes — January 8, 2013 Page 3 Commissioner Peterson asked about the signage requested and wondered if it will be allowed over the doors. Mr. Wakefield stated ideally they want Christian Brothers Automotive on both the east and west side of the building. They also like to have a pylon sign out front but will conform the sign to the City standards. Commissioner Peterson wondered if the access to the property should not be offset from the secondary Kwik Trips' access for safety purposes, he also felt the access may need to be offset so it is not located on the curve. Mr. Wakefield stated when they met with staff a few months ago, there was concern regarding coming around the curve and having adequate reaction time and that is one of the reasons it was offset. He noted they reacted to the staff comments and have tried to conform to what staff wanted. There was no public input Motion by Cleveland, seconded by Steel, to close the public hearing at 7:30 p.m. Motion carried on a 4 -ayes, 0 -nays, 2- absent (Commissioners Nemeth, Gudmundson) vote. Motion by Cleveland, seconded by Steel, to recommend to the City Council approval of the Conditional Use Permit (13 -01). Further discussion: Commissioner Peterson asked if he could make a change to Item 5 in the resolution, "vehicles awaiting service should not be parked outside overnight" should be amended to include "vehicles that have been serviced, awaiting pickup ". Commissioner Cleveland accepted the amendment with the following changes: "Vehicles shall not be parked outside overnight ". Motion carried on a 4 -ayes, 0 -nays, 2- absent (Commissioners Nemeth, Gudmundson) vote. City Planner Hanson stated that this item would be before the Council at the January 15, 2013 City Council meeting. Chairperson Daninger resumed presiding over the meeting. PUBLIC HEARING: Conditional Use Permit Amendment (13 -02) —Storage of Black Dirt (2,800 cubic yards) used for Norlex Turf —16563 Hanson Boulevard NW. City Planner Hanson noted the purpose of this item is to hold a public hearing and take input on a Conditional Use Pen-nit Amendment (13 -02) extending the stockpile /storage of black dirt for Norlex Turf. City Planner Hanson reviewed the proposed Conditional Use Permit Amendment with the Commission. Regular Andover Planning and Zoning Commission Meeting Minutes — January 8, 2013 Page 4 Commissioner Steel stated he was concerned about some wording in the amendment. There should not be any traffic congestion issues or depreciation of property values surrounding this area. He would like staff to review this. Chairperson Daninger asked how many cubic yards were placed there in the original permit. Mr. Dennis Kuiken, 16563 Hanson Boulevard NW, noted it was 10,000. Motion by Holthus, seconded by Cleveland, to open the public hearing at 7:35 p.m. Motion carried on a 5 -ayes, 0 -nays, 2- absent (Nemeth, Gudmundson) vote. Mr. Kuiken was open to questions of the Commission. He noted his intention was to build a berm on the property to hide his shed from view. He did not realize he needed a permit. He noted he plans to sell the dirt because it is nicer than he thought it would be. Commissioner Holthus asked if the intent all along was to build a berm. Mr. Kuiken stated it was. Commissioner Steel stated in one of the photos in the packet there is a semi- trailer and wondered what the purpose of that was. Mr. Kuiken noted it was for storage only and will be painted if it remains there. Chairperson Daninger stated some of his concerns are stockpiling without a permit, a CUP is needed anytime be stockpiles dirt. If this happens again, Mr. Kuiken will need a Conditional Use Permit. Mr. Kuiken indicated he understood. Chairperson Daninger noted Mr. Kuiken needs all the permits and he also needs to check with all the regulatory agents such as the MN Pollution Control Agency. Mr. Kuiken indicated he understood that. Chairperson Daninger wanted to make it clear that they both understand the rules and that this will not happen again. He wanted to make sure that after two years the pile will be removed. Mr. Kuiken guaranteed that and if it is still there in two years he will move the pile. Chairperson Daninger noted Mr. Kuiken will need to control the dust, slope and silt fence if needed. Mr. Kuiken indicated he understood. Commissioner Cleveland wondered if the dirt came about suddenly so there was not any lead time. Mr. Kuiken stated he was working with the City on a land purchase and they were going to need the sand but that fell apart and he was lucky enough the North Pine wanted the sand for another job so they ended up buying it back so when that happened the people purchasing the sand wanted to bring in some dirt fill so he thought he could build a berm without a permit. He did not think building a berm was a stockpile. I Regular Andover Planning and Zoning Commission Meeting Minutes — January 8, 2013 Page 5 There was no public input. Motion by Cleveland, seconded by Holthus, to close the public hearing at 7:49 p.m. Motion carried on a 5 -ayes, 0 -nays, 2- absent (Commissioners Nemeth, Gudmundson) vote. Commissioner Cleveland stated he was in favor of granting the Conditional Use Permit Amendment. This is not the first time they have had to do this but he would like this to be the last time. Ms. Hanson stated if they are to recommend approval of this along with the Resolution, item two should have a deadline date of May 1, 2013. Chairperson Daninger noted he made it very clear what his concerns were and Mr. Kuiken made it very clear about his promises and guarantees what he will do. He tried to look at the totality of this and felt that by making a recommendation of approval, they will be able to correct this quicker and control it better than if it is denied. Motion by Cleveland, seconded by Holthus, to recommend to the City Council approval of the Conditional Use Permit Amendment with the change to Item two. Motion carried on a 5 -ayes, 0 -nays, 2- absent (Commissioners Nemeth, Gudmundson) vote. City Planner Hanson stated that this item would be before the Council at the January, 2013 City Council meeting. OTHER BUSINESS. City Planner Hanson indicated there was no other business. Commissioner Peterson asked if there was any update on the proposed Wal -Mart project. Ms. Hanson indicated the City has been waiting for comments from Anoka County Transportation Department and they have received those and have been forwarded to MFRA and the City is waiting for comments at this time. Commissioner Steel stated he would like to have a follow up whenever possible concerning the word usages that are in the Code. Chairperson Daninger thought that would be a great work session topic. Commissioner Holthus thanked staff for a wonderful job done on the yearly report. ADJOURNMENT. The Planning and Zoning Commission is requested to approve the minutes from the February 12, 2013 regular meeting. =l PLANNING AND ZONING COMMISSION WORKSHOP MEETING FEBRUARYI2, 2013 The Workshop Meeting of the Andover Planning and Zoning Commission was called to order by Chairperson Daninger on February 12, 2013, 6:00 p.m., at the Andover City Hall, 1685 Crosstown Boulevard NW, Andover, Minnesota. Commissioners present: Chairperson Daninger, Commissioners Tim Cleven, Valerie Holthus, Bert Koehler, Kyle Nemeth, Lynae Gudmundson (arrived at 6:05 p.m.), and Steve Peterson. Commissioners absent: None Also present: City Planner Stephanie Hanson Associate Planner, Andrew Liska Others OATH OF OFFICE Commissioner's Cleven and Koehler read the Oath of Office. Chairperson Daninger went over the role of the Planning and Zoning Commission with the new Commissioners. Commissioner Lynae Gudmundson arrived at 6:05 p.m. and read the Oath of Office. DISCUSS CITY CODE 12 -12 PERMITTED, CONDITIONAL AND PROHIBITED USES City Planner Hanson reviewed City Code 12 -12 Permitted, Conditional and Prohibited Uses with the Commission. The Commission and staff started review of the City Code where they left off from the last workshop meeting. Andover Planning and Zoning Commission Workshop Meeting Minutes — February 12, 2013 Page 2 Item 88 — Professional Studios Mr. Liska explained a studio could be in the home and in the work place. They need to differentiate between the two. Commissioner Nemeth wondered if they were supposed to define what kinds of studio's are permitted in residential areas. Commissioner Cleven thought they needed to because a photo studio could be allowed but a radio station they may not want to have in a residential area. Commissioner Gudmundson asked if they should make this conditional. Commissioner Koehler wondered if intemet studios should be a part of these. Chairperson Daninger thought they should highlight this item for further discussion after they look at the rest of the items. Item 89 — 92 are looking at public utilities without changes. The Commission did not have any issues. Item 93 is covered in Item 113 so the recommendation is to remove this item and cover it in Item 113. The Commission agreed. Item 94 - Boat and Recreational Vehicle Sales Staff wondered if recreational vehicles should be allowed to be sold in the Shopping Center District. Commissioner Steve Peterson asked where vehicle sales are located in Andover. Ms. Hanson stated General Business allows new vehicle sales otherwise all other zones are by conditional use only. Chairperson Daninger stated he would be ok with permitted but he wondered how it could be sold if no outdoor sales is permitted in the Shopping Center zone. Item 95 is referencing Code to make it more accessible. Item 96 - Rental Businesses Mr. Liska stated an "I (Interim Use)" is being proposed in the neighborhood and shopping zones. He noted they could make it conditional until Interim Use is available. Chairperson Daninger indicated Interim Use is preferred on this item. Consensus was to leave it blank until the Interim Use Permit is available to use. Commissioner Koehler thought they should define rental business in the City Code because they have a lot of rentals in the City. Andover Planning and Zoning Commission Workshop Meeting Minutes — February 12, 2013 Page 3 Item 97 - Repair Services Ms. Hanson indicated this was not automobile repair. She reviewed the Code with the Commission. The Commission wondered if this should be allowed in residential areas. Chairperson Daninger thought this was covered under limited business. One more step stricter than a neighborhood business. Ms. Hanson reviewed the definitions of Limited Business and Neighborhood Business. Chairperson Daninger stated Limited Business is more transitional than Neighborhood Business. Commissioner Gudmundson asked what they were allowing in the residential area, could this item go into this area. She thought this should be permitted in Limited Business. Item 98 & 99 — no proposed change. Chairperson Daninger wondered where a resort would be permitted in the City. It was decided that a resort did not need to be on a lake, it could be on a large parcel of land with activities such as horse riding. The Commission thought this needed to have a Conditional Use Permit. The Commissioner would not mind putting it in the R -11R -2 District with a CUP. Commissioner Gudmundson wondered if they could put Item 99 into Item 53154 (hotels, motels). Commissioner Holthus thought it should be a Conditional Use in R -1 and R -2 and General Recreation and not permitted in the other zones. Chairperson Daninger and the Commission agreed. Item 100 —Multiple Dwellings Mr. Liska stated this should be permitted across all residential according to the law but not allow them in other districts. Item 10 1 — Restaurants & Cafes — No proposed change. Chairperson Daninger thought this should be pennitted in Industrial Zone. Item 102 & 103 — Added to list for discussion Item 104 — No changes Item 105 — All blanks should be Conditional Use Permit except in the General Recreation Zone. Item 106 — Second Hand Businesses - No changes. The Commission thought it could be allowed in General Business and Industrial zones with a Conditional Use Permit. Item 107 — Single Family Residential Building Detached — No changes needed. Commissioner Holthus wondered what types of buildings these would be. She did not if they were multiple units in one dwelling that it would make sense to have this permitted in M -1 and M -2. Ms. Hanson indicated this item was regarding garages and staff will clean up the language on it. She indicated the definition could be changed to Residential Detached Buildings. The Commission agreed. Item 108 — The Commission thought by removing the PUD option and keeping it in the M -1 and M -2 zone only, should update this item, they suggested it be removed from all other zones. Item 109 — Retail Trade and Service — Staff indicated they will look at the definition, clean it up and bring back to the Commission with the other items for further review. OTHER BUSINESS. None. January 8, 2013 Chairperson Daninger indicated there was not a quorum so he thought they should table the minutes until they find out how to approve them. Commissioner Holthus stated on page three of the Workshop minutes from January 8`h, the last paragraph should be changed to read "What is the definition of Limited Business and is it necessary to continue having the zoning Limited Business there is only 1.7 acres of limited business land in the City and they really can't develop anything more on that piece ". Mr. Liska reviewed the staff report with the Commission. Commissioner Gudmundson asked if the Conditional Use Permit was just for Frattalone's or the Downtown Center. Mr. Liska indicated it was for the Downtown Center. Commissioner Gudmundson wondered how that will work with other Conditional Use Permits other businesses would have. Mr. Liska stated a Special Use Permit was granted to the downtown center as a whole so all of the businesses are allowed to display, store and sell in the front area, with the amended CUP, they are including side and rear locations but that is with City approval. Commissioner Holthus indicated they needed to have fire standards in the front of the building in order to have storage there. Mr. Liska indicated that was correct and the fire code would remain in place throughout the area. Commissioner Peterson asked if in the front of the building, Frattalone's is allowed to store items outside. Mr. Liska indicated that was correct. Commissioner Nemeth stated on the map in area number two, the storage will be encroaching in the driveway and he asked for clarification on this. He also wondered if 24 feet will allow two vehicles to pass each other in that area. Mr. Liska stated they are well over the minimum requirements for the driveway. Commissioner Holthus asked what the items would be that would be stored on the east end next to the driveway. Commissioner Kohler asked was there any stipulation or guidelines as to how high the items can be stacked. Mr. Liska indicated that was something that could be included in the resolution. Mr. Michael Frattalone, 3527 North Lexington Avenue, Arden Hills, made a short presentation to the Commission. Commissioner Holthus asked what types of products would the business plan to sell on the east end. Mr. Frattalone indicated they would be palletized products. Commissioner Holthus asked what types of products will be sold in area #1. Mr. Frattalone indicated this would be excess stock and nothing would be sold in this area, just storage. Mr. Frattalone indicated the location is far from the garden center and would be inconvenient and could be a hazard for the customers. Chairperson Daninger wondered what the anticipated height will be for the pallets in area #1. Mr. Frattalone indicated a large pallet of mulch might be six foot tall and do not tip over easily. The more they can stack pallets of dirt on top of each other the smaller the footprint and could make the area look better. He thought the maximum would be seven feet high and that would be stacking two pallets on each other. Commissioner Kohler asked if Mr. Frattalone thought if any of the products would be higher than the fence. Mr. Frattalone did not think it would and did not think they have ever peaked over the fence. Commissioner Cleven asked on the unwrapped product, is there a plan to replace the product back onto the pallet if a customer removed it from the pallet and did not purchase it. Mr. Frattalone stated they do clean up the area periodically during the day. Commissioner Gudmundson asked if there was any thought to expanding the garden center fence to include the stacks outside of the fence. Mr. Frattalone indicated he has not because the bags are very heavy and would not be easy to move from behind the fence to a vehicle. Commissioner Peterson asked if there has been any thought to moving the extra product to another area so there is less likelihood of theft. Mr. Frattalone indicated most of the product is stored within the fence and if it can be seen from the road there is less likelihood of theft or vandalism. Commissioner Peterson stated it looked like if there is anything on the front sidewalk could a wheelchair get by. He did not think it looked ADA accessible. Commissioner Koehler stated in area #1, how deep are the pallets going to go in the area. Mr. Frattalone indicated it would be one deep with potentially two pallets high. Commissioner Nemeth stated he would like to install some kind of height requirement in area #1 so it does not exceed the height of the fence. Chairperson Daninger asked if there was a timeline for these areas. Mr. Frattalone indicated in the winter they do not have any outdoor storage. He noted he could work with staff on this. Chairperson Daninger asked if there were any plans on enclosing their garbage area. Mr. Frattalone indicated he would be willing to do that. Commissioner Nemeth stated he would like to see the height limit added to the resolution but he would also like to see something put into the resolution that items in the back of the fence are not stacked above the fence line, everything is below it. The Commission discussed the parking area and problems and obstacles that could occur with flow through traffic. Commissioner Cleven wondered if an emergency vehicle could make it through the area with the storage located in the parking area. Chairperson Daninger was not sure but he thought staff would make sure that emergency vehicles would have adequate room to maneuver through the area. Commissioner Gudmundson stated she had some concerns aesthetically, primarily the views for all the neighboring properties and she thought they needed to give some consideration for them and what it might do to their property values because she did not think allowing all the items to be stacked up outside will be a pleasing look for the area. She stated she would like Frattalone's to expand their fence along the side minimally to cover the stuff that goes up next to the garden center and maybe fence in the stuff in the back also. She thought the idea of using restriping where the parking was on the side is also a great idea and would take care of her safety concerns. Commissioner Peterson thought Frattalone's could move the driveway so it goes straight south into the intersection and restripe part of the existing driveway as a loading area. He agreed with the fencing in of area #1. The Commission discussed the pros and cons of extending the fence in the garden center. Motion by Holthus, seconded by Koehler, to recommend to the City Council approval of Resolution No. _, with the stipulation that product on pallets is not to be above a safe height, which will be determined by staff and allowing good transportation flow in the driveway on the east side of the hardware store with the understanding that staff will review the amount of parking spaces required and possibly eliminate those west of the bank. Amendment two is to identify the dates when outdoor sales will occur and have those dates of outdoor sales be consistent with what they have previously indicated for other businesses in the City. Amendment three is to be certain that entrances comply with ADA regulations. Motion carried on a 6 -ayes, 1 -nays ( Gudmundson), 0- absent vote. City Planner Hanson stated that this item would be before the Council at the February 19, 2013 City Council meeting. Regular Andover Planning and Zoning Commission Meeting Minutes — February 12, 2013 Page 5 PUBLIC HEARING: SKETCH PLAN REVIEW— ANDOVER BOULEVARD NW AND PRAIRIE ROAD NW —MARK SMITH. City Planner Hanson noted the purpose of this item is to hold a public hearing and take input on a sketch plan review at Andover Boulevard NW and Prairie Road NW. City Planner Hanson reviewed the proposed sketch plan with the Commission. Commissioner Holthus asked if there is adequate space for 66 feet of right of way. Ms. Hanson indicated there was and the applicant has already addressed this in the new sketch plan. Commissioner Holthus asked if the trail easement could be extended further west to meet up with Prairie Road. Ms. Hanson thought that was the intent. Commissioner Holthus wondered if the developer could move the narrow access to the south two lots over and have it be on the lot line then changing the configuration of those two lots to one lot. That would give the developer more space to make the one lot on the corner larger. She indicated that would take away one of the lots but it would solve the problem and change the access point to the park to be better, in her opinion. Commissioner Nemeth asked on the flood fringe that is outlined, is that preliminary. Ms. Hanson stated the developer will need to have the wetland delineation verified this spring and certify where the boundaries are. Commissioner Gudmundson asked why would there be some question about getting the sewer and water down to the southern portion. She wondered if it was topography. Ms. Hanson indicated that was correct. Commissioner Holthus asked if wetland mitigation would solve the sewer and water problem. Ms. Hanson indicated it will need further investigation. Commissioner Peterson asked if they had enough right away on Andover Boulevard and Prairie Road for future expansion. Ms. Hanson indicated additional right of way may need to be given for future expansion. Commissioner Peterson asked how the topography affects the buildable lots. Ms. Hanson indicated it might on the southern portion of the property because of the flood fringe. Commissioner Peterson asked if the proposed park will be an expansion of existing facilities already in the park there. Ms. Hanson stated it would be. Commissioner Holthus wondered if the County is giving any consideration at all to do some improvements along Andover Boulevard to possibility have a trail or widening it to Regular Andover Planning and Zoning Commission Meeting Minutes — February 12, 2013 Page 6 have a shoulder for a trail. Ms. Hanson stated she did not know but could get the Commission that information. Commissioner Gudmundson asked if west of the park if that was a pond. Mr. Smith, developer, indicated it was a small wetland. The Commission discussed with staff cul -de -sac length and variances. Mr. John Stevens, 14464 Flintwood Street, stated looking at the plat, his only concern is where the park is located. He wondered what is going to be the deterrence to slow traffic through the area with the park there. He also wondered how the City could deter residents from using the streets in the development as a cut through to avoid the traffic backup on Prairie Road and Andover Boulevard. He also wondered if the truck traffic will be funneled from Evergreen to the development and out. Mr. Jeff Johnson, 14315 Prairie Road, stated he has seven acres and he wondered if this area gets developed what will happen to his land. He indicated he did not want to be forgotten so in the future if he wants to develop he will be able to. Chairperson Daninger thought Mr. Johnson should sit down with staff and discuss his development possibilities. Mr. Mark Smith, 2120 Otter Lake Drive, Lino Lakes, indicated he was available for comment. Chairperson Daninger asked whose idea was it to put the park where it is. Mr. Smith indicated when Hickory Meadows was developed, the Park Commission thought the park should go there, and he did not think that was the best place for it because of the location. Mr. Smith indicated he would move the park anywhere that the Planning Commission would want it. Commissioner Gudmundson thought the park would be better in the southern area of the development and to connect a trail to it. Chairperson Daninger thought this should be reviewed. Commissioner Gudmundson thought if the park were moved, they could reconfigure the central section and take care of the straight road access through and still get all the lots and make the area more scenic and preserve some trees and nature. Commissioner Gudmundson wondered if they could do some berming along Prairie and Andover Boulevard to avoid mismatched fences in the future. Regular Andover Planning and Zoning Commission Meeting Minutes —February 12, 2013 Page 7 Motion by Holthus, seconded by Gudmundson, to close the public hearing at 8:45 p.m. Motion carried on a 7 -ayes, 0 -nays, 0- absent vote. Chairperson Daninger reviewed the discussion and recommendations made during the public hearing, including berming, trees, park and cul -de -sac. He indicated he was really concerned about the four way stop and that it will become a cheater road. He thought staff needed to review this further. He also noted that he did not want to see any request for lot variances because they are large lots. Commissioner Peterson thought there should be some preservation of wetlands if possible. Commissioner Nemeth concurred and made a suggestion to answer the issue with the park. He thought they could look at putting a in some three way stops to slow down traffic. Commissioner Peterson stated none of the north/south roads line up and he thought if they could line up better they could install an all way or 4 way stop to discourage people cutting through the development. Commissioner Holthus would like to see the City consider widening Andover Boulevard to allow a trail to make it safer. City Planner Hanson stated that this item would be before the Council at the March 5, 2013 City Council meeting. OTHER B USINESS. City Planner Hanson updated the Planning Commission on related items. Commissioner Gudmundson asked if they have a Conditional Use Permit for the entire Shopping Center District, why did it ever come before the Commission for Time to Thrift to give them another one, would they not have been covered to put their stuff outside. Associate Planner Liska indicated he was not sure why that was. Chairperson Daninger thought it was a safety issue because it needed to be sprinkled in order to do it. Ms. Hanson indicated staff would take a look at it and get back to the Planning Commission on it. Commissioner Peterson stated Todd Haas had an open house for the new park proposed on 16155 and Tulip and he wanted to commend staff on a nice job on the plan. ADJOURNMENT. DATE: March 12, 2013 INTRODUCTION The Planning Commission is asked to review a Preliminary Plat for Hickory Meadows 2 "d Addition. The proposed plat contains 10 urban residential lots. DISCUSSION Conformance with Local Plans and Ordinances 1. The property is located in the Metropolitan Urban Service Area (MUSA). The property is currently zoned R -4, Single Family Urban Residential. The project conforms to the R -4 Zoning District requirements. Street Access Public street access to the 2 "d addition would be provided from Evergreen Street NW. The street will conform to the city's standards (33 feet wide within 60 feet of right -of -way). The street would be stubbed to the west side of the plat to allow future extension of the street. A temporary cul -de -sac will be required for 143`d Lane NW. Anoka County Highway Department (ACHD) Staff is waiting for comments from the ACHD. A condition of approval requires the applicant to conform to the requirements of the Anoka County Highway Department. Sewer and Water Access The trunk sewer and water lines are located in this area and will be extended to serve the plat. F000dplain A significant area of the 100 year floodplain (which consists both the floodway and flood fringe areas) and the 500 year floodplain exist along Coon Creek, as shown on the grading plan. Portions of the 100 year flood fringe and the 500 year floodplain areas will need to be removed from the floodplain due to the proposed construction of homes within the area. It will be the responsibility of the developer to apply for a Letter of Map Amendment (LOMA) through FEMA for approval to allow homes to be constructed. Without this LOMA, homeowners will have to purchase flood insurance. Staff is recommending that the condition of the final plat is that it cannot be recorded until FEMA approves the LOMA. There are two proposed rain gardens located towards the end of the temporary cul -de -sac. The Coon Creek Watershed District adopted new rules that require infiltration to reduce the volume of water entering water bodies. The rain gardens will provide for the required infiltration. Staff recommends an agreement be required for each of these four parcels and recorded at Anoka County with the final plat. The agreement will state that the property owners are responsible for the maintenance of the rain gardens. Pedestrian Access A pedestrian trail is being proposed between Lots 3 and 4, Block 2. This trail will eventually link to the proposed trail along Coon Creek. The Andover Comprehensive Plan shows regional trails both along the creek and along Andover Boulevard. Construction of a trail along the creek would be complicated by the location of wetland and floodplain. Further investigation and investment will need to be authorized by the City Council to pursue this location. It is important to note that the trail along Coon Creek would be a regional trail paid for out of the City's trail fund. Staff recommends the existing 100 foot trail easement along Coon Creek be shown on the preliminary plat. Tree Preservation Tree preservation is shown along the eastern side of the proposed plat as well as areas along the southern side of Lots 2 and 3, Block 2. There is also a small area of trees to be preserved on Lot 1, Block 1. A majority of the trees within the plat are proposed to be removed to allow grading of the site. Park and Recreation Commission Recommendation The Park and Recreation Commission will review the preliminary plat at the March 7th meeting. Park Commission is recommending cash in lieu of park land and trails. Lots Each of the 10 lots meets the minimum lot width, depth and area requirements of the R -4 Zoning District. ACTION REQUESTED The Planning Commission is asked to hold a public hearing, review the proposed preliminary plat and to make a recommendation to the City Council. Sheet 6: Label NWL and HWL elevations for the two created ponds between the lot pads and Coon Creek. HWL will prestnnably be equal to the F1WL for Coon Creek. 302. Sheet 6: Add the line types for the floodway and flood fringe into the legend. 303. Sheet 9: Change "flood plain" to "flood fringe" in the legend. 304. Preliminary Plat: Show the trail easement that is along Coon Creek. 305. The east west sheet is to be indicated as 14' )rd Lane NW on all sheets where necessary. 306. Maintenance agreements for the rail gardens will be required for the 4 lots along 143rd Lane NW. A copy of the template will be e- mailed to the developer's engineer. The agreements will need to be recorded with the final plat at Anoka County. Note: It is a requirement that the Developer respond to each of these items in writing when re- submitting the revised plat to the City.
