The Planning and Zoning Commission is requested to approve the minutes from the January 8, 2013 regular meeting. 1 1 1 • e � 1 a 0 PLANNING AND ZONING COMMISSION WORKSHOP MEETING JANUARY 8, 2013 The Workshop Meeting of the Andover Planning and Zoning Commission was called to order by Chairperson Daninger on January 8, 2013, 6:00 p.m., at the Andover City Hall, 1685 Crosstown Boulevard NW, Andover, Minnesota. Commissioners present: Chairperson Daninger, Commissioners Dennis Cleveland, Valerie Holthus, Steve Peterson, and Michael Steel. Commissioners absent: Lynae Gudmundson and Kyle Nemeth Also present: City Planner Stephanie Hanson Associate Planner Andrew Liska Others DISCUSS CITY CODE 12 -12 PERMITTED, CONDITIONAL AND PROHIBITED USES City Planner Hanson stated the Planning Commission had left off their last discussions on the use table on line 61. Chair Daninger stated the goal of the Planning Commission was to eliminate the blank areas in the land use table. City Planner Hanson stated that 61 "Keeping up to five farm animals, plus one additional farm animal per above 5 acres on residential properties 5 acres or greater up to a maximum of 20 animals" should now read "Farm animals up to 5 per acre, plus one additional farm animal per acre above 5 acres on residential properties 5 acres or greater up to 20 animals and definition under City Code 12 -2. City Planner Hanson stated that 62 "Keeping of more farm animals than allowed as a permitted use on residential properties 5 acres or greater in compliance with Title 5 and definition under City Code 12 -2" should now read "Farm animals greater than allowed as a permitted use on residential properties 5 acres or greater in compliance with Title 5 and definition under City Code 12 -2" Andover Planning and Zoning Commission Workshop Meeting Minutes —January 8, 2013 Page 2 City Planner Hanson stated that 63 "Keeping of poultry on residential properties without municipal sewer and water in compliance with Title 5" should now read "Poultry on residential properties without municipal sewer and water in compliance with Title 5 and definition under City Code 12 -2." Commissioner Peterson noted that 63 should include "City Code" before "Title 5." City Planner Hanson noted staff is not proposing any changes to 64 "Landfills." City Planner Hanson stated that 65, 66, and 67 all deal with liquor licenses and the proposed change in adding "in compliance with City Code 3 -1" will make the table easier to use. Commissioner Cleveland noted that 65 "Liquor licenses" includes the zoning classification GR. Commission discussed and Chair Daninger feels that it should be mentioned and discussed. Following discussion, Chair Daninger suggested leaving it as a conditional use. City Planner Hanson noted staff is not proposing any changes to 68 "Lumberyards." City Planner Hanson noted staff is not proposing any changes to 69 "Manufacturing." City Planner Hanson noted that number 70 "Manufactured homes and modular homes, provided they are developed under a planned unit development and the complex is at least 20 acres" should be changed from a permitted use to a planned unit development. Associate Planner Liska noted that this change is to reflect the definition in the uses table as it mentions "planned unit development" in the definition it should be "PUD" in the uses table rather than a permitted use. City Planner Hanson noted staff is not proposing any changes to 71 "Marinas." City Planner Hanson noted staff is not proposing any changes to 72 "Medical and dental clinics." Chair Daninger asked if you cannot have a dentist office in your house. City Planner Hanson confirmed that was correct. City Planner Hanson noted that number 73 "Medical clinic — 24 hour operation" should be discussed based on the changes to the Code regarding continuous use and non - continuous use based on zoning districts. Chair Daninger stated that it would be nice to have a 24 hour clinic. Commissioner Peterson asked where "Limited Business" was located in the City. Chair Daninger questioned how to define "medical clinic." Andover Planning and Zoning Commission Workshop Meeting Minutes —January 8, 2013 Page 3 Commissioner Cleveland stated that in looking at 72, you cannot have a doctor's office or dental clinic in your house but if you are a psychologist you can have an office in your house. They can be Psychiatrists, which are medical doctors. Cleveland mentioned that this is a very common practice for this field. Chair Daninger stated that this may be covered under businesses. Chair Daninger stated that 73 should be flagged to be revisited. The updated use table for continuous and non - continuous use is needed as the current Code for 73 seems to be conflicting for some of the zoning districts. City Planner Hanson noted that 74 "Mini Storage" should include "(indoor storage only)" as to not allow exterior storage. City Planner Hanson noted that 75 "Mortuaries and funeral homes" should include "(without crematorium)" as crematoriums are covered separately in the uses table. City Planner Hanson noted no change for 76 "Multiple dwellings" and 77 "Offices." Commissioner Peterson asked for additional clarification regarding 76 and the requirements for a planned unit development. Chair Daninger explained that the PUD is beneficial as they are more flexible. City Planner Hanson noted that number 78 "Open, off street parking space" should be deleted as it is covered more in depth in 12 -13 -8. City Planner Hanson noted that number 79 "Outdoor display — only during operating hours" should be deleted as it has been combined with number 81. Chair Daninger asked why number 81 "Outdoor display, storage, and sales — during operating hours only" does not include Neighborhood Business (NB) and Industrial (1). Planner Hanson stated that it could be changed. Chair Daninger stated that in 80 "Outdoor display, storage, and sales" shouldn't be allowed in NB but SC doesn't seem unreasonable. Commissioner Holthus questioned what the definition of limited business is and asked if it limited use. She noted the very few businesses are designated as this type today. Chair Daninger stated that additional research should be done on the Limited Business classification and noted that the category could be built for the future. Commissioner Peterson questioned if there was a specific purpose in mind with this zoning classification. City Planner Hanson noted that gas stations should be considered when looking at the zoning districts and the uses in them. Chair Daninger suggested allowing NB and SC through a conditional use. Commissioner Peterson agreed with Chair Daninger. Andover Planning and Zoning Commission Workshop Meeting Minutes — January 8, 2013 Page 4 City Planner Hanson mentioned that Frattallone's Ace Hardware has requested a change in Code to allow for outdoor display, storage, and sales. Chair Daninger noted that the conditional use permits are fair to businesses. Rather than going ahead with plans without guidance, they can go through the process so both the business and community can reach an agreement. He noted that he is in favor of conditional use permits for this district. Chair Daninger noted that based on discussions 81 "Outdoor display, storage, and sales — during operating hours only" have the same conditional use permits allowed in the zoning districts as 80. City Planner Hanson noted staff is not proposing any changes to 82 "Outdoor theatres." City Planner Hanson noted staff is not proposing any changes to 83 "Pawnbrokers — as defined in Title 3, Chapter 4 of the City Code." Chair Daninger questioned why pawnbrokers couldn't be located in SC and I. He noted the same for Precious metal dealers. City Planner Hanson noted staff is not proposing any changes to 84 "Precious metal dealers — as defined in City Code 3 -4." Chair Daninger proposed changing to allow pawnbrokers and precious metal dealers in both Shopping Center and Industrial zoned districts. City Planner Hanson noted staff is not proposing any changes to 85 "Principle buildings exceeding height maximum subject to City Code 12 -3 -5." City Planner Hanson noted 86 "Private dog kennel license (2.5 acre minimum lot size required)" should include "in compliance with City Code 5 -IA." City Planner Hanson noted that 87 "Private garages" should be deleted as it is covered in 48 regarding accessory structures. DISCUSS ITEMS ON PLANNING COMMISSIONAGENDA Chair Daninger mentioned that he will be stepping down on the first item due to a potential conflict of interest as he does business with Kottkes. Chair Daninger provided a brief background on the property and mentioned that this item is not regarding ponds, tire storage, or any other uses and only regarding the stockpiled fill on the property. Commissioner Steel stated how City Code 12 -14 -6 B regarding criteria for granting conditional use permits. He states he is uncomfortable with the current language. Chair Daninger suggested that Commissioner Steel voice his concerns tonight at the Planning Commission meeting but also encouraged him to work with the Code as it is written, for the time being. Chair Daninger noted that the Planning Commission will pick up on 88 next time. OTHER BUSINESS No other business. December 11, 2012 Regular Meeting. Commissioner Steel noted on page 2, the wording "No one wished to address the Panning Commission" should be changed to Planning Commission. PUBLIC HEARING: Conditional Use Permit (13 -01) for Automobile Service Station —1716 Bunker Lake Boulevard NW— Christian Brothers Automotive. Chairperson Daninger stepped down from this item due to conflict of interest. Vice Chairperson Holthus presided over the meeting. Regular Andover Planning and Zoning Commission Meeting Minutes —January 8, 2013 Page 2 Associate Planner Liska noted the purpose of this item is to hold a public hearing and take input on a Conditional Use Permit (13 -01) allowing an automobile service station (auto repair and service). Associate Planner Liska reviewed the proposed conditional use permit with the Commission. Commissioner Peterson asked staff what the Sunset clause would encompass. Mr. Liska reviewed the clause with the Commission. Commissioner Steel asked if there were any environmental issues with the soil. Mr. Liska referred the question to the applicant. Motion by Cleveland, seconded by Peterson, to open the public hearing at 7:10 p.m. Motion carried on a 4 -ayes, 0 -nays, 2- absent (Commissioners Nemeth, Gudmundson) vote. Jonathan Wakefield, Director of New Store Development for Christian Brothers Automotive, made a presentation to the Commission. Mr. Wakefield noted they have done environmental and asbestos surveys and both came back clean. Commissioner Steel asked what type of certification the technicians will have. Mr. Wakefield stated since they are not a repair shop they need to hire top -notch technicians that know the diagnostic equipment they have. He explained to the Commission the requirements. Commissioner Cleveland asked if they have technicians certified for hybrid vehicles. Mr. Wakefield indicated he was not sure and would need to check into it and report back to City Staff. Commissioner Cleveland asked if there are other stores like this in Minnesota. Mr. Wakefield stated this was the first one in Minnesota. Commissioner Peterson asked why the parking stalls in the back of the lot are double stacking stalls. Mr. Wakefield stated they have to have the capacity to handle the vehicles for different loads on different days. They placed the double stacking stalls in the back of the property to hide it from the road and will use it as needed. Commissioner Peterson asked what the main types of service they will be performing. Mr. Wakefield stated their niche is right after the warranty runs out to vehicles that are ten to twelve years old. He listed some of the services to the Gommission. Regular Andover Planning and Zoning Commission Meeting Minutes —January 8, 2013 Page 3 Commissioner Peterson asked about the signage requested and wondered if it will be allowed over the doors. Mr. Wakefield stated ideally they want Christian Brothers Automotive on both the east and west side of the building. They also like to have a pylon sign out front but will conform the sign to the City standards. Commissioner Peterson wondered if the access to the property should not be offset from the secondary Kwik Trips' access for safety purposes, he also felt the access may need to be offset so it is not located on the curve. Mr. Wakefield stated when they met with staff a few months ago, there was concern regarding coming around the curve and having adequate reaction time and that is one of the reasons it was offset. He noted they reacted to the staff comments and have tried to conform to what staff wanted. There was no public input. Motion by Cleveland, seconded by Steel, to close the public hearing at 7:30 p.m. Motion carried on a 4 -ayes, 0 -nays, 2- absent (Commissioners Nemeth, Gudmundson) vote. Motion by Cleveland, seconded by Steel, to recommend to the City Council approval of the Conditional Use Permit (13 -01). Further discussion: Commissioner Peterson asked if he could make a change to Item 5 in the resolution, "vehicles awaiting service should not be parked outside overnight" should be amended to include "vehicles that have been serviced, awaiting pickup ". Commissioner Cleveland accepted the amendment with the following changes: "Vehicles shall not be parked outside overnight ". Motion carried on a 4 -ayes, 0 -nays, 2- absent (Commissioners Nemeth, Gudmundson) vote. City Planner Hanson stated that this item would be before the Council at the January 15, 2013 City Council meeting. Chairperson Daninger resumed presiding over the meeting. PUBLIC HEARING: Conditional Use Permit Amendment (13 -02) —Storage of Black Dirt (2,800 cubic yards) used for Norlex Turf —16563 Hanson Boulevard NW. City Planner Hanson noted the purpose of this item is to hold a public hearing and take input on a Conditional Use Permit Amendment (13 -02) extending the stockpile /storage of black dirt for Norlex Turf. City Planner Hanson reviewed the proposed Conditional Use Permit Amendment with the Commission. Regular Andover Planning and Zoning Commission Meeting Minutes — January 8, 2013 Page 4 Commissioner Steel stated he was concerned about some wording in the amendment. There should not be any traffic congestion issues or depreciation of property values surrounding this area. He would like staff to review this. Chairperson Daninger asked how many cubic yards were placed there in the original permit. Mr. Dennis Kuiken, 16563 Hanson Boulevard NW, noted it was 10,000. Motion by Holthus, seconded by Cleveland, to open the public hearing at 7:35 p.m. Motion carried on a 5 -ayes, 0 -nays, 2- absent (Nemeth, Gudmundson) vote. Mr. Kuiken was open to questions of the Commission. He noted his intention was to build a berm on the property to hide his shed from view. He did not realize he needed a permit. He noted he plans to sell the dirt because it is nicer than he thought it would be. Commissioner Holthus asked if the intent all along was to build a berm. Mr. Kuiken stated it was. Commissioner Steel stated in one of the photos in the packet there is a semi - trailer and wondered what the purpose of that was. Mr. Kuiken noted it was for storage only and will be painted if it remains there. Chairperson Daninger stated some of his concerns are stockpiling without a permit, a CUP is needed anytime he stockpiles dirt. If this happens again, Mr. Kuiken will need Conditional Use Permit. Mr. Kuiken indicated he understood. Chairperson Daninger noted Mr. Kuiken needs all the permits and he also needs to check with all the regulatory agents such as the MN Pollution Control Agency. Mr. Kuiken indicated he understood that. Chairperson Daninger wanted to make it clear that they both understand the rules and that this will not happen again. He wanted to make sure that after two years the pile will be removed. Mr. Kuiken guaranteed that and if it is still there in two years he will move the pile. Chairperson Daninger noted Mr. Kuiken will need to control the dust, slope and silt fence if needed. Mr. Kuiken indicated he understood. Commissioner Cleveland wondered if the dirt came about suddenly so there was not any lead time. Mr. Kuiken stated he was working with the City on a land purchase and they were going to need the sand but that fell apart and he was lucky enough the North Pine wanted the sand for another job so they ended up buying it back so when that happened the people purchasing the sand wanted to bring in some dirt fill so he thought he could build a berm without a permit. Motion by Cleveland, seconded by Holthus, to close the public hearing at 7:49 p.m. Motion carried on a 5 -ayes, 0 -nays, 2- absent (Commissioners Nemeth, Gudmundson) vote. Commissioner Cleveland stated he was in favor of granting the Conditional Use Permit Amendment. This is not the first time they have had to do this but he would like this to be the last time. Ms. Hanson stated if they are to recommend approval of this along with the Resolution, item two should have a deadline date of May 1, 2013. Chairperson Daninger noted he made it very clear what his concerns were and Mr. Kuiken made it very clear about his promises and guarantees what he will do. He tried to look at the totality of this and felt that by making a recommendation of approval, they will be able to correct this quicker and control it better than if it is denied. Motion by Cleveland, seconded by Holthus, to recommend to the City Council approval of the Conditional Use Permit Amendment with the change to Item two. Motion carried on a 5 -ayes, 0 -nays, 2- absent (Commissioners Nemeth, Gudmundson) vote. City Planner Hanson stated that this item would be before the Council at the January, 2013 City Council meeting. OTHER BUSINESS. City Planner Hanson indicated there was no other business. Commissioner Peterson asked if there was any update on the proposed Wal -Mart project. Ms. Hanson indicated the City has been waiting for comments from Anoka County Transportation Department and they have received those and have been forwarded to MFRA and the City is waiting for comments at this time. Commissioner Steel stated he would like to have a follow up whenever possible concerning the word usages that are in the Code. Chairperson Daninger thought that would be a great work session topic. Commissioner Holthus thanked staff for a wonderful job done on the yearly report. ADJOURNMENT. L SUBJECT: PUBLIC HEARING: Conditional Use Permit Amendment (13 -03) regarding outdoor display, storage, and sales located at 13735 Round Lake Boulevard NW - Planning DATE: February 12, 2013 INTRODUCTION The applicant, Mike Frattallone of Frattallone's Ace Hardware, is seeking to amend the special use /conditional use permit issued in 1988 to expand the permitted outdoor displays, sales, and storage at 13735 Round Lake Blvd NW to include side and rear locations with City approval. The conditional use permit replaced the special use permit in 2004, thus the conditional use permit amendment request is being applied for. The permitting and amending processes remain the same; only the title of the permit has changed. BACKGROUND The special use /conditional use permit resolution (R254 -88) approved in 1988 permitting outdoor display, sales, and storage for the Andover Downtown Center reads as follows: NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Andover to hereby approve the special use permit requested by the Andover Limited Partnership, on lots 1, 2, and 3 of Block 1 of the Downtown Center, for outdoor displays, sales, and storage during mall operating hours, with the following Conditions: 1. Outdoor displays, sales, and storage shall be conducted during posted mall operating hours only. 2. The location of the sales are to be restricted to the front locations of the mall parking lot, excluding the back receiving and loading areas. 3. If the outdoor displays or sales are kept over night and if display areas are not well lit, that reflective materials be placed on the displays so as to help illustrate the displays for safety purposes. 4. The special use permit shall be subject to an annual review by the Planning and Zoning Commission and the City Council. In 2002, Frattallone's submitted a Commercial Site Plan that was approved administratively which permitted the use of the garden center. With the approval of the garden center, several stipulations were to be followed including: Condition 5: No retail goods or landscaping materials shall be stacked or stored outside of or above the fence. The applicant is seeking to amend the special use /conditional use permit to allow for expanded outdoor display, sales, and storage specifically in side and rear locations. The original special use /conditional use permit allowed this only for "front locations of the mall parking lot." The Commercial Site Plan in 2002 expanded display, sales, and storage to side locations but within the fenced garden center. The applicant is now requesting display, sales, and storage in the side location outside of the fenced garden center as well as the rear location along the fenced border along the northern property line. Both proposed locations for display, sales, and storage will not encroach in the drive lane access. All other aspects of the original permit will remain unchanged. DISCUSSION City Code 12 -14 -6 C states that an amended application shall be handled in a similar manner as that of a new conditional use permit. City Code 12 -14 -6 B. provides the following criteria for granting conditional use permits: 1. In granting a Conditional Use Permit, the City Council shall consider the advice and recommendation of the Planning and Zoning Commission and: a. The effect of the proposed use upon the health, safety, morals and general welfare of occupants of surrounding lands. b. Existing and anticipated traffic conditions, including parking facilities on adjacent streets and land. c. The effect on values of property and scenic views in the surrounding area, and the effect of the proposed use on the Comprehensive Plan. 2. If it shall determine by resolution that the proposed use will not be detrimental to the health, safety, morals, or general welfare of the community, nor will cause serious traffic congestion or hazards, nor will seriously depreciate surrounding property values, and that said use is in harmony with the general purpose and intent of this title and the Comprehensive Plan, the City Council may grant such permits. COUNCIL DIRECTION The applicant, Mike Frattallone, initially requested a zoning text amendment to expand outdoor display, sales, and storage and this was brought to the Council Workshop on January 22, 2013. Council did not find the zoning text amendment favorable but suggested amending the special use /conditional use permit from 1988. Based on Council's position, Mr. Frattallone has retracted his zoning text amendment request and has applied for an amendment to said permit. ACTION REQUESTED The Planning Commission is asked to hold a public hearing and provide a recommendation to the City Council regarding the special use /conditional use permit amendment request. R A RESOLUTION AMENDING THE SPECIAL USE /CONDITIONAL USE PERMIT TO EXPAND THE ALLOWABLE AREAS FOR OUTDOOR DISPLAYS, SALES, AND STORAGE ON THE PROPERTY LEGALLY DESCRIBED AS FOLLOWS: LOTS I & 2, BLOCK 1, DOWNTOWN CENTER AND LOT 1, BLOCK 1, ANDOVER CENTER WHEREAS, A Special Use Permit was granted in 1988 to the above replatted legally described properties for outdoor display, sales and storage; and WHEREAS, the City of Andover in 2004 amended the City Code to replace the term Special Use Permit with Conditional Use Permit to be consistent with State Law; and WHEREAS, with this terminology change the process and procedure remains the same; WHEREAS, the Special Use Permit granted in 1988 on said property is hereby deemed to be a Conditional Use Permit and may be amended through the Conditional Use Permit process; and WHEREAS, the Planning and Zoning Commission held a public hearing and has reviewed the request and recommends approval of the amended Conditional Use Permit; and WHEREAS, the Planning and Zoning Commission finds the request would not have a detrimental effect upon the health, safety, and general welfare of the City of Andover; and WHEREAS, the Planning and Zoning Commission recommends to the City Council the approval of the amended Conditional Use Permit; and NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Andover does hereby approve the amended Conditional Use Permit on the above legally described property for outdoor displays, sales and storage with the following conditions: 1. Frattallone: General Terms of the Commercial Site Plan Approval This letter will serve as administrative approval by the City of Andover that you would be allowed to put up a greenhouse (hoop house) in the fenced area on the east sile—of your hardware store from April 15`� through September I" each year. You would also be allowed to use the same area to sell plants and nursery products inside the fenced area from April 15a' through September I" each year, as well as for pumpkin sales in the fall, and Christmas tree sales between Thanksgiving and Christmas. The City will allow these uses of the area as long as you are in compliance with the conditions that have been veritten in this letter. Physical Improvements to the Site Some of the physical improvements that you have indicated that you are planning include a new 6 foot high black tubular steel (looks like wrought iron) fence around the entire garden center area (47' x 107'). Also, wo twelve foot wide sates would be installed along the easterly fence line (open during business hours). v During the staffs review, there -vas general consensus that there was a need to have the owner of the property make some modifizations to one of the driveway curb islands that exist in front of the hardware store. This would need to be reconstructed by the owner of the property, but would be a condition of your site plan approval. I am attaching a photo and diagram of the curb island /driveway that will need to be modified to prevent the traffic entering the site from encountering an unsafe condition. Also, staff felt there should be a couple of safety improvements along the edge of the fenced garden center. The first would be to stripe an area eight feet wide along the entire fenced area to allow for people walking and either loading or unloading to have a place to temporarily park. The second would be to install a stop sign at the southeast corner of the garden center to stop people driving along the easterly side of the garden center before they enter the main drivev; ay for the shopping center. The City of Andover will alloy the Garden Center to open and become an annually renewable operation provided that there are no significant chances fromI the way fac operation is currently being reviewed and. approved. If significant changes are made, City staff would like td review them with the stole manager each spring, prior to opening the garden center. It is expected that you hill wort: with the landlord and City to achieve the listed requirements of this Commercial Site Plan approval. Frattallone's Garden Center (Commerical Site Plan Review) Conditions to adhere to for the Barden center Page 2 1. Gate access, exiting on the east side is recommended and the gates need to remain open during business hours. The gates would also be restricted to either be sliding, or if hinged, be opened fully and secured to stay fully open during business hours. 2. A striped area for pedestrians shall be painted on the pavement for a distance of 3 feet from the proposed fencing on the south and east sides. This is to provide a safe area in which customers may temporarily park to load and unload goods being purchased. 3. No long term parking shall be allowed anywhere along the fenced area (only temporary loading and unloading is allowed). There will need to be no parking signs installed along the fence to prevent people from parking there. The locations of these signs will need to be shown on the site plan on file with the City. 4. No signs (except "No Parking —Bv Order of the Fire Chief') shall be attached to the fence. 5. No retail goods or landscaping materials shall be stacked or stored outside of, or above the fence. 6. The owner of the store shall perform regular maintenance within and around the garden center to prevent blowing trash. The green house shall be routinely maintained and kept in a like new appearance. No tattered or ripped plastic covering shall be allowed. If not kept in a new appearance, the hoop house shall be removed. 8. Supplemental lighting shall be added along the easterly side of the garden center fence to illuminate the area to avoid potential conflicts between vehicles and customers. 9. There area few pallets stored outside of the outdoor storage area on the north side of the store. These shall be moved to inside of the fenced area out of sight. Sincerely, Will Neumeister` Director of Community Development 0 _madly I i en -! .y- 1/25/2013 Dear Mayor, Council Members and Planning Committed Members, Frattallone's Ace Hardware would like to request an amendment to the SUP of 1988 for our site at 13735 Round Lake Blvd. After working with the staff from the city, Frattallone's is requesting the following. • We would like to retain storage and outdoor sales in the following areas- northern most area along the fence, not to impede on the flow of traffic around back of building- area #1, the eastern run of the garden center fence (outside of the fence) not to impede on traffic flow between bank and our site- area #2 and lastly, the front or southern sidewalk on our property - area #3, not to impede on the walking traffic that is using the sidewalk now. • We will discontinue use of the parking area that is on the eastern most side of the lot between the bank and our site- area #4. • We will use the fenced in area in the rear of our building to store as much product as possible thus keeping the center clean while still allowing us to progress as a business. • All empty pallets will be removed in a timely fashion and nothing will be stored outside just for the sake of storage. Everything will be for sale and most products are sold many times daily. • We will make every effort to provide a safe and clean environment for the city and the mall itself. Please see pictures that will describe the locations of sales and storage more clearly. Frattallone's Ace Hardware success is highly correlated to the use of the outdoor sales area. That area is one of the reasons we are profitable and without it we will really be pinched- most likely to the point of not being profitable. DISCUSS RECONSIDERING VARIANCE REQUEST 113873 LINNET STREET NW Mr. Carlberg explained the City Council, at the November 27, 2012 workshop, briefly discussed the variance request to the frequency of allowing lot splits as provided in 13 -1 -3 of the City Code for the property at 15873 Linnet Street NW. On December 18, 2012, the Council directed staff to place this item on a workshop agenda to further discuss the decision to deny the request. Mr. Carlberg reviewed the report with the Council. Councilmember Trude stated the situations the Council sees as a concern are when a person has property held for a long time, when the area develops around them, so that they get stuck with assessments, and the City does not get the money back until the land is developed. Councilmember Trude addressed her concerns with the rest of the Council and staff regarding multiple lot splits on a lot. She suggested staff attach conditions regarding drainage and other concerns that would normally be addressed during platting. Councilmember Trude suggested allowing one lot split per year if the following conditions are met: 1. Only a small development is proposed by a property owner who has owned their property for more than 5 years. 2. The City infrastructure, such as sewer, water and streets are in place. 3. Conditions are attached to the split regarding drainage and other concerns normally addressed during platting. She added that the City would benefit from the payment of assessments and from the additional home that could be built on a new lot, especially during this time when there is a shortage of lots for families wanting to build a new home in Andover. Mr. Carlberg stated the concern he would see is the economics as the reason for wanting to do splits. He thought there should be a code amendment if the Council wanted to grant a split. He liked the one year time period but if the Council is going to require all those conditions staff wants to see about drainage, the price of a split is getting into the same costs as a plat. Staff discussed with the Council lot splits and what type of requirements would be needed. Mr, Berkowitz stated if they could put the right requirements on a lot split, staff would be in favor of lot splits once a year. Councilmember Knight did not think they needed to have a set time limit on lot splits if the applicant meets the requirements. DISCUSS AMENDMENT TO THE CITY CODE 12 -12 — OUTDOOR DISPLA Y,. STORA GE AND SALES IN THE SC DISTRICT Andover City Council Workshop Meeting Minutes — January 22, 2013 Page 8 Mr. Carlberg explained the City Council is requested to discuss an amendment to the City Code 12 -12 for Outdoor Display, Storage and Sales in the SC, Shopping Center District as requested by Frattallone's Ace Hardware. Mr. Carlberg reviewed the report with the Council. The Council discussed with staff the areas where Frattallone's Ace Hardware is maintaining their landscaping inventory outside and alternative areas where it could be stored. Mr. Carlberg stated Mr. Frattallone has requested a text amendment to allow outdoor storage and sales. If this is approved and the CUP is applied for, the Council can then regulate where the storage is located. Councilmember Bukkila indicated her concern is could a fire truck be able to get through to the back of the building. Mayor Gamache asked if they are talking about Shopping Center Zoning District only. Mr. Carlberg indicated that is correct. Mr. Carlberg stated he would notify the business owner. Councilmember Trude wondered if there were mall bays the owner could rent within the shopping center. Mayor Gamache did not think there was any other area. Councilmember Trude indicated her only problem is the covering up of parking areas. Councilmember Bukkila suggested Mr. Carlberg sit down with Mr. Frattallone, discuss his file, before the Council takes action on this. Councilmember Trude suggested they amend what was allowed only to the property by striking the clause that does not allow storage along the side or behind the building on the current SUP. Staff indicated they will meet with Mr. Frattallone to review the issue. Hanson, City Planner SUBJECT: PUBLIC HEARING: Residential Sketch Plan for property located at the southeast corner of Andover Boulevard and Prairie Road NW. DATE: February 12, 2013 INTRODUCTION The Planning Commission is asked to review a residential sketch plan for a single family urban residential development including all of the outlined properties shown on the attached location map. DISCUSSION The sketch plan is intended to illustrate how the entire area can be developed. It is important to note that not all of the property owners in this area are interested in development at this time. Background The applicant, Mr. Mark Smith submitted a sketch plan on January 11, 2013 for review. The Andover Review Committee (ARC) reviewed the sketch plan and submitted comments to Mr. Smith. These comments have been attached for your review. Staff suggests the comments be reviewed as part of the sketch plan process. Mr. Smith and staff met to discuss the comments. Mr. Smith has responded to at least some of the comments by resubmitting a sketch plan with changes associated to the staff comments. The attached sketch plan reflects these changes. Public Works and Engineering staff are currently reviewing the updated sketch plan. Staff assumes comments will be made available to the Planning Commission at the time of the public hearing. Conformance with Local and Regional Plans and Ordinances 1. The property is located within the 2020 MUSA Boundary and within the current stage of sewer expansion. The property is zoned Single Family Rural Residential (R -1). A rezoning to Single Family Urban Residential (R -4) will be necessary to allow the project to move forward. Access Access would be provided from Prairie Road NW as shown on the attached sketch plan. Eventually the development will gain access to Andover Boulevard through Hickory Meadows 2 Addition, located east of this development. Sixty six (66') feet of right -of -way may be required for the local street at the Prairie Road intersection. This would allow sufficient space for three lanes of traffic. The access to Prairie Road is approximately 767 feet from the intersection of Andover Boulevard. This location provides adequate spacing between the intersections and would provide an alignment to the west for future development. The Anoka County Highway Department is in the process of reviewing the sketch plan; therefore staff has not received a written review letter. Utilities Trunk sewer and water lines are located east of the land within the Hickory Meadows development. It is undetermined at this time if the improvements will be constructed privately or if the developer will petition the city for public improvements. As part of the preliminary plat process, the applicants engineer will need to evaluate if the southern cul -de -sac can be served with sewer and if it is feasible. Lots Some of the lots may need to be adjusted to meet the minimum requirements of the R -4 Zoning District. This includes: Lot size requirements is 11,400 square foot. When the preliminary plat is submitted all of the proposed and sketched lots will be required to meet the R -4 requirements. However, double frontage lots must have additional depth for screen planting along the rear lot line of 10 feet. 2. There are two odd shaped lots. These lots may not provide enough buildable area to position an average home; this will need to be verified during the preliminary plat process. 3. Lots must be 80 feet wide at the front yard setback. Corner lots must be at least 90 feet wide at the front setback line. The preliminary plat will need to include the front setback line for each parcel. 4. Corner lots must be a minimum of 100 feet wide as measured at the building setback line or 90 feet wide for back to back lots. 5. There are a number of existing homes within the sketch plan. The preliminary plat will need to illustrate and address each structure. Floodplain and Wetlands A significant amount of floodplain exists along the north side of Coon Creek. Flood fringe, flood way and wetland areas were delineated in 2004. The delineation needs to be updated and officially approved this coming growing season. Areas of floodway and flood fringe are shown in the southwestern area of the sketch plan. It is important to note that a separate process involving the Federal Emergency Management Agency (FEMA) would need to be completed before a preliminary plat for lots that propose floodway impact could be reviewed by the City. If this area of the sketch plan can be developed, it will most likely be part of a fixture phase after the process with FEMA has been completed. Coon Creek Watershed District (CCWD) Once the overall layout of the sketch has been agreed upon, the developers will prepare a grading plan, hydrology calculations and a soils report that will be reviewed by the City, an engineering consultant and the CCWD. The CCWD will need to have reviewed the preliminary plat and the developer will need to address any issues that are raised during that review before a public hearing will be scheduled for the preliminary plat. Southwest Corner of Sketch Plan The two properties at the southwest corner of the sketch plan are not proposed for development at this time. However, it is important that these properties be evaluated and that a street connection is provided at a location that will allow efficient development to occur in the future. The proposed street connection near the entrance from Prairie Road is angled to avoid the existing home at 14367 Prairie Road. The location of streets beyond this point and the resulting lots will likely be affected by field delineation of the floodplain and any proposed floodway impact/mitigation in the future along with any wetlands that do exist. Trail System It should be noted that a 100 foot trail easement presently exists on the north side of Coon Creek on the properties east of the development. It has yet to be determined the exact location of a future trail along the creek. It should also be noted that the location for trail connection through the neighborhoods has yet to be determined. It will either be through this development or Hickory Meadows 2nd Addition. Park and Recreation Commission The Park and Recreation Commission will review the sketch plan at their February 21 st meeting. Coordination with other Agencies The developer and/or owner are responsible to obtain all necessary permits (Minnesota Department of Natural Resources, U.S. Army Corp of Engineers, Coon Creek Watershed District, Minnesota Pollution Control Agency, LGU and any other agency that may have an interest in the site). Initial contact shall be made with the City Engineering Department regarding this item. ACTION REQUESTED The Planning Commission is asked to hold a public hearing and informally advise the applicant on adjustments to the proposed project to conform with local ordinances and review criteria. The Applicant will be required to make application for a rezoning of the parcels from R1- Single Family Rural to R4- Single Family Urban 2. R4 Single Family Urban requires lots to be 11,400 square feet. It appears there are numerous lots that do not meet the required lot size. 3. R4 Single Family Urban lots are required to have a lot width of 80 feet at the front setback. This needs to be verified that all lots meets this requirement. 4. Block 5, Lot 1 does not appear to be buildable because of the odd size of the lot. This needs to be verified that a house can be placed on the lot while meeting all setbacks. Public Works Director DATE: January 24, 2013 REFERENCE: Mark Smith Sketch Plan /SE Corner of Andover Boulevard NW & Prairie Road NW /Review #1 Listed below are comments based on the proposed sketch plan for your review. 1. The delineation of the wetland identified on sketch plan will need to be approved by the Coon Creek Watershed District and indicated on the plan as such. There is no indication on the sketch plan that the Coon Creek Watershed District has approved the wetland boundaries. 2. The developer is responsible to obtain the necessary permits from the Coon Creek Watershed District, DNR, U.S. Army Corps of Engineers, MPCA or any other agency that is interested in the site. 3. Need to meet the requirements of the City of Andover Water Resource Management Plan. 4. The developer will be required to receive approval from the Federal Emergency Management Agency (FEMA) before the final plat can be recorded due to the impacts to the flood fringe and floodway areas. 5. A buffer strip will be required for wetlands and storm water areas. Some of the lots in the development may be impacted by the floodplain areas, wetlands and /or buffer strip areas. The developer's surveyor /engineer will need to evaluate this closer to see if lots can be made buildable due to these impacts. 6. Need to submit a tree protection plan with the submittal of the preliminary plat. 7 See comments from the Anoka County Highway Department in regard to the development. It may be necessary for the developer to contact the ACHD to obtain a copy of the comments. No direct driveway access from lots will be allowed to Andover Boulevard NW and Prairie Road NW. Arrangements to modify the driveways will need to be identified on the preliminary plat. 8. It will be necessary to identify all existing driveways and structures that will be removed on the sketch plan. 9. A 20 foot radius corner is required for the intersection right -of -ways within the sketch plan where a city street intersects with another city street. A 30 foot radius corner is required for the intersection right of way where the City street intersects with a County road (Andover Boulevard NW) and City collector street (Prairie Road NW). 10. All str ets are required to be public. 11. A vari %nce may be required for the proposed cul -de -sac at th� south end of the sketch plan due to the length as it appears to exceed the 500 foot maximum requirement. 12. The Engineering Department is recommending that the proposed street that is accessing to Prairie Road NW be shifted further south to accommodate a future street that could be constructed to serve the area west of Prairie Road NW. Turn lanes on Prairie Road NW to access this development will be required to provide safer turning movements for vehicles. See sketch plan as to a recommended street and lot layout. 13. Need to indicate the existing right -of -way width and all existing drainage and utility easements within 100 feet of the site. 14. Are there any existing easements (private or public) that need to be vacated? If there are, they should be clearly indicated on the sketch plan so that it can be determined if the easement needs to be vacated. 15. Drainage and utility easements in the preliminary plat will need to be provided to allow utilities to be looped as required in various portions of the development. This will be determined as part of the preliminary plat. 16. Drainage and utility easements will be required for all ponding areas. This will be evaluated as part of the preliminary plat. 17. A preliminary sanitary sewer and water main layout will be reviewed later as part of the preliminary plat submittal. 18. A bikeway /walkway trail is planned to be constructed along the north side of Coon Creek between Prairie Road and the Hickory Meadows development. A trail easement has already been dedicated along Coon Creek in the Hickory Meadows development. It will be necessary to identify this existing location of the easement on the sketch plan and provide a trail detail easement as part of the preliminary plat. 19. A trail and /or an emergency vehicle access will be necessary to provide access to the proposed trail along Coon Creek. The location will need to be determined as part of the preliminary plat preparation. 20. It will be necessary for the developer to sketch the undeveloped adjacent property on the east side of Prairie Road NW and north of Coon Creek so that there access to the property for future development. 21. Park & Recreation Commission will need to review and determine if a park is necessary or a cash dedication will be recommended in lieu of land. It appears that a combination of land and cash will be recommended since additional park land may be necessary adjacent to the existing park in Hickory Meadows. 22. Need to meet requirements of all City Codes that apply specifically City Code Section 11, 23. When beginning the platting process the plat, the grading plan and all other plans must utilize the Anoka County coordinate system and datum so the information can be transferred to the City's GIS mapping. 24. When the final plat is approved and recorded, the developer must submit a digital copy of the plan. 25. See additional comments on the plan. 26. Additional comments pending further review.
