PLANNING AND ZONING COMMISSION WORKSHOP — DECEMBER 13, 2011
The Andover Planning and Zoning Commission Workshop was called to order by
Chairperson Daninger on December 13, 2011, 6:05 p.m., at the Andover City Hall, 1685
Crosstown Boulevard NW, Andover, Minnesota.
Commissioners present: Chairperson Daninger, Commissioners Dennis Cleveland,
Lynae Gudmundson, Valerie Holthus, Tim Kirchoff, and
Michael Olsen.
Commissioners absent: Commissioner Devon Walton.
Also present: Community Development Director, Dave Carlberg

PLANNING COMMISSION'S RESPONSIBILITIES IN REVIEWING VARJANCES
Mr. Bednarz summarized the staff report.
Commissioner Kirchoff stated that the recent variance request for a porch addition would
have required the applicant to remove a portion of the existing deck or reduce the size of
the addition to meet the requirements.
Mr. Bednarz stated that relocating the addition to the rear of the home was also an option.
Commissioner Cleveland stated that the question is whether relocating the porch to the
rear of the home constitutes practical difficulty.
Commissioner Gudmundson noted that the variance for the porch addition was approved
by Council.
Commissioner Cleveland stated that he struggled with the variance request for the
existing accessory structure located in an easement and close to the property line.
He added that the use was reasonable but the location was not.
Commissioner Olsen asked if the order of the findings in the resolution format could be
changed. He stated it would be beneficial to discuss whether the Commission believed a
variance request was reasonable first.
Mr. Bednarz stated the format was from the League of Minnesota Cities model resolution
but could be changed.

Commissioner Gudmundson stated that the finding related to the intent of the ordinance
was an issue. She noted that in previous discussion the Commission had identified that
every variance goes against the intent ordinance.
Mr. Bednarz stated that staff reports will provide a description of the intent of the
ordinance as it relates to each variance request. He added that in the case of the porch
variance the side yard setback was the issue. The intent of that ordinance is to preserve
adequate separation between structures.
Commissioner Gudmundson stated that it is a question of where to draw the line. The
recent porch variance request was for less than two feet. She asked what if the request
was three or more feet.
Mr. Carlberg stated that another part of the variance test is the character of the
neighborhood. The Council saw that the porch request would not change the character of
the neighborhood and also relied upon the disturbance to the floor plan that would be
created by moving the location of the porch.
Commissioner Cleveland stated that the shed variance the Commission recently reviewed
was much easier to recommend denial because it did not follow any of the requirements.
Commissioner Gudmundson stated that she viewed the porch variance as a small
deviation from the requirements and the shed variance as a large one.
Commissioner Olsen noted the shed was located in an easement which is not permitted.
Commissioner Holthus stated that the applicant acknowledged that he was aware that a
permit was necessary and chose not to apply for it.
Commissioner Olsen stated that the Commission had worked through the findings in past
cases with affirmative responses and still considered recommending denial. He stated
the reasonableness test should come first.
Chairperson Daninger stated that the Commission should review the findings individually
and that the minutes could also help relay their discussion to the Council.
Commissioner Olsen stated that if the Commission found a variance request to be
reasonable it would become easier to complete the rest of the findings.
Commissioner Gudmundson confirmed that to approve a variance, the city needed to
determine that each of the findings could be met.
Commissioner Cleveland stated the public hearing is important. He added that the public
has a right to expect that the Commission competently reviews their requests.

Mr. Bednarz stated that the Commission discussion could begin with a general discussion
of the three tests (reasonableness, uniqueness, neighborhood character) and work toward
completion of the findings in the resolution afterward.
Commissioner Gudmundson asked if the Commission needed to complete each of the
findings in the resolution with their recommendation.
Mr. Bednarz stated that would be the ideal. However, if the Commission did not make it
to that point there should at least be enough discussion on each finding to help the
Council complete the findings.
Commissioner Holthus suggested the Commission discuss the variances generally first,
then apply the results to the resolution and determine what is left to complete.
Chairperson Daninger stated the chairman should be making notes during the discussion
to help fill in the resolution. He added that other Commissioners could do this as well.
Commissioner Kirchoff agreed that this would allow them to go through the findings one
at a time.
Commissioner Olsen noted that a general discussion of variance requests would be
effective if Commissioners voice their opinion to facilitate discussion.
Commissioner Cleveland stated it would be necessary for the Commissioners to review
the section of ordinance that applied to each variance request for an explanation of the
intent of the ordinance.
Mr. Bednarz stated that staff would also provide a summary of the intent in the staff
report.
Mr. Carlberg stated that the finding related to the Comprehensive Plan was likely to be
the least applicable in the review of variances.
Commissioner Olsen stated that financial hardship alone could not be used to justify a
variance. He stated that it did not disqualify a variance either if it was a component along
with other findings.
Commissioner Kirchoff stated that a determination of whether the request was reasonable
was most important.
Chairperson Daninger stated that the Commission has faced some difficult variance
requests recently.

Commissioner Cleveland stated the garage height variance had the nuance of being taller
than the house yet lower than the house due to the topography.
Commissioner Olsen stated that should not have been an issue.
Mr. Carlberg stated that the Commission should apply the variance criteria strictly as the
ordinance is intended. Circumstances like the curvature of a road or right -of -way
acquisition create a unique circumstance, not just a desire by the property owner.
Commissioner Cleveland recalled a variance the Commission had reviewed where most
of the rear yard was within an easement a variance was granted to allow a deck in the side
yard setback.
Chairman Daninger stated he would continue to explain the process to applicants during
the meeting so that they understand the process, including the role of the Commission to
make a recommendation and that the Council would make a final decision.
Commissioner Cleveland stated that it would be important for Commissioners to express
their thoughts, even if everyone didn't agree it would be important to the discussion and
end result.
Commissioner Holthus stated that she appreciated hearing the comments of other
Commissioners during the discussion and that her opinion can change based on the
discussion.
Commissioner Gudmundson stated that including information about the intent of the
ordinance and relationship to the Comprehensive Plan in the staff report would be
helpful.
Commissioner Cleveland stated one way to view variances is to try to determine if the
scales balance between the request and the end result.
Commissioner Gudmundson stated that the city has been lenient on commercial
applications, such as outdoor storage at the Downtown Center and the Hughes Industrial
Park.
Commissioner Olsen stated that he viewed those requests differently. He stated that
under a conditional use permit the city needed to approve applications that met city
requirements. He stated they have applied current regulations to existing sites to bring
them up to code and did not see that should be required.
Commissioner Cleveland noted that the city had created an ordinance for the Hughes
Industrial park that allowed them to gently bring older sites to date instead of forcing all
of the requirements to be met.

Chairperson Daninger stated that sometimes emotions become involved and he strict to
take a cautious approach and look at the facts in each case. He reviewed notes from the
discussion , including that staff would provide information on the intent of the ordinance
and relationship to the Comprehensive Plan in the staff report; that the chairperson would
take notes during the Commission's discussion to help complete the findings and other
Commissioners would as well; and that it was each Commissioner's responsibility to get
their questions out there, to aid the review of reasonableness, uniqueness and
neighborhood character and to ensure they had sufficient information to complete the
findings.
Commissioner Cleveland stated that the city can also place conditions on variances if
there is reason to do so.
Commissioner Kirchoff stated that he would be considering the resolution findings as the
Commission discussed variances.
Chairperson Daninger stated that if the Commission did not complete the findings that
the discussion in the minutes could also be helpful to the Council.
Commissioner Gudmundson confirmed that the Council may change the findings in the
resolution.
Mr. Carlberg noted that the Council had changed the findings significantly for the porch
addition because they approved the variance whereas the Commission had recommended
denial. He added that it was important the the Commission not indicate a desire to
approve a variance for the applicant independent of the discussion.
Chairperson Daninger stated that it was important to remember that not everyone affected
by an item may be at the meeting. He added there may be people at home with a
different point of view.

PUBLIC HEARING: Comprehensive Plan Amendment 11 -01 to change the land use
classification from Transitional Residential to Agricultural for the east half of PID#
28- 32 -24 -12 -0001.
Mr. Liska noted the purpose of this item is to hold a public hearing and take input on a
Comprehensive Plan Amendment to change the land use classification of a parcel from
Transitional Residential to Agricultural.
Mr. Liska reviewed the proposed Comprehensive Plan Amendment with the
Commission.
Commissioner Kirchoff questioned if the Ag Preserve classification had a minimum time
requirement. Staff noted there was an eight year minimum time commitment.
Commissioner Gudmundson asked when the original farmstead was classified as Ag
Preserve. Mr. Bednarz commented the property has been zoned Single Family Rural
Residential for at least the last 10 years.
Commissioner Kirchoff excused himself from the meeting at 7:06 p.m.
Commissioner Olsen inquired if the land had two separate zoning classifications at this
time. Staff indicated the east half is proposed to be changed as indicated, which was why
the request was before the Commission this evening.
Motion by Holthus, seconded by Gudmundson, to open the public hearing at 7:09 p.m.
Motion carried on a 5 -ayes, 0 -nays, 1- present ( Kirchoff), 1- absent (Walton) vote.

Commissioner Olsen did not object to the Comprehensive Plan Amendment. He felt the
request was non - controversial.

11 -01 changing the land use classification from Transitional Residential to Agricultural

Mr. Liska stated that this item would be before the Council at the December 20, 2011

Family Rural Residential to Agricultural Preserve for the east half of PID# 28- 32 -24-
12 -0001.
Mr. Liska noted the purpose of this item is to hold a public hearing and take input on a
rezoning to change the zoning designation from Single Family Rural Residential to
Agricultural Preserve.
Mr. Liska reviewed the proposed rezoning with the Commission.
Motion by Holthus, seconded by Gudmundson, to open the public hearing at 7:09 p.m.

PUBLIC HEARING: Preliminary Plat of Woodland Crossings Third Addition to
convert six detached townhouse lots into five R -4 Single Family Urban Residential lots.
Mr. Bednarz noted the purpose of this item is to hold a public hearing and take input on
the preliminary plat of Woodland Crossings Third Addition converting six detached
townhouse lots into five R -4 Single Family Urban Residential lots.
Mr. Bednarz reviewed the proposed preliminary plat with the Commission.
Commissioner Kirchoff returned to the meeting at 7:16 p.m.
Commissioner Olsen questioned if the site would be regraded. Mr. Bednarz noted the
site has been graded and would be reviewed on a site -by -site basis when building permits
were requested.
Commissioner Olsen asked if the City needed to have these lots removed from the
homeowners association. Mr. Bednarz explained this was a condition for approval
requiring the developer submit documentation that this has been completed to the City.
Commissioner Holthus inquired if there were any other affects on the homeowner's
association. Mr. Bednarz stated there would be fewer units within the homeowners
association.
Commissioner Gudmundson questioned the amount of money that would be refunded to
the developer in park dedication and trail fees. Mr. Bednarz explained the City would be
refunding $2,944 in park dedication fees and $671 for trail fees.
Chairperson Daninger asked if the vegetation for the plat had been reviewed. Mr.
Bednarz stated there would be no more vegetation than required by City Ordinance which
is 2 trees per lot.
Commissioner Gudmundson inquired if the park dedication fees were earmarked for any
City projects. Mr. Bednarz was not aware that the dollars were earmarked for a specific
project.
Motion by Kirchoff, seconded by Holthus, to open the public hearing at 7:21 p.m.
Motion carried on a 6 -ayes, 0 -nays, 1- absent (Walton) vote.
John Hale, 15827 Killdeer Street, explained he supported the conversion of the property
back to single family residential.
Louanna Drazkowski, 15798 Jay Street, also supported the change in the parcels.

Chairperson Daninger asked if developer was aware of the condition for approval
requiring the current water service to the site to be turned off. Byron Westlund,
Woodland Development Corporation, explained he was aware of the City's policy. He
expressed concern with the fact that the road would be tore up again, but he would follow
through with the City's requirement.
Commissioner Holthus indicates she was on the Commission when the request for the
change to townhomes first came before the City. She was pleased this parcel would be
single family homes again.
Chairperson Daninger agreed, stating this was a better fit.
Motion by Holthus, seconded by Olsen, to recommend the Council approve the
Preliminary Plat of Woodland Crossings Third Addition to convert six detached
townhouse lots into five R -4 Single Family Urban Residential Lots. Motion carried on a
6 -ayes, 0 -nays, 1- absent (Walton) vote.
Mr. Bednarz stated that this item would be before the Council at the December 20, 2011
City Council meeting.

SUBJECT: PUBLIC HEARING: Conditional Use Permit (12 -01) for temporary storage of
highway construction materials at 16563 Hanson Boulevard NW.
DATE: January 10, 2012
INTRODUCTION
The applicant is requesting temporary storage of approximately 11,000 cubic yards of tire chips
on the subject property. City Code 12 -12 requires a conditional use permit for storage of
highway construction materials.
DISCUSSION
The applicant is a subcontractor to the principal contractor with the Anoka County Highway
Department. The county is planning to reconstruct a portion of Hanson Boulevard beginning in
the spring of 2012. The project will include replacing portions of the road bed with tire chips. It
is anticipated that the project will be completed by July 1, 2012.
Approximately 9,000 cubic yards of tire chips were hauled to the subject property in December
2011. On December 15`h staff notified the applicant that a permit from the city was required and
asked that no additional material be hauled to the site. An additional 2,000 cubic yards are
waiting at another site to be brought to the subject property. All of these tire chips will be used
in the Hanson Boulevard project.
Staff met with the Anoka County Highway Department to discuss the proposed project last
Thursday. At the meeting, it was confirmed that Hanson Boulevard will be closed between 161"
Avenue NW and 1815' Avenue NW during the project. The start date is weather dependant, but
will likely begin by late April or early May 2012.
Conditional Use Permit Criteria
City Code 12 -14 -6 B. provides the following criteria for granting conditional use permits:
1. In granting a Conditional Use Permit, the City Council shall consider the advice and
recommendation of the Planning and Zoning Commission and:
a. The effect of the proposed use upon the health, safety, morals and general
welfare of occupants of surrounding lands.
b. Existing and anticipated traffic conditions, including parking facilities on
adjacent streets and land.
c. The effect on values of property and scenic views in the surrounding area, and
the effect of the proposed use on the Comprehensive Plan.
2. If it shall determine by resolution that the proposed use will not be detrimental to the
health, safety, morals, or general welfare of the community, nor will cause serious
traffic congestion or hazards, nor will seriously depreciate surrounding property values,
and that said use is in harmony with the general purpose and intent of this title and the
Comprehensive Plan, the City Council may grant such permits.
Additional Requirements
In addition to the standard conditional use permit review outlined above, additional requirements
apply to the proposed use of the subject property.
Minnesota State Fire Code & National Fire Protection Association (NFPA) Rules regulate the
size and location of the tire piles and also provide safety and security measures. The attached
Fire Department Memorandum describes these requirements. The arrangement of tire chips on
the subject property does not currently meet these requirements. A condition of approval in the
attached resolution incorporates these requirements.
The Fire Department has reviewed the attached tire storage and fence plan and finds it to be
acceptable. An inspection will also be conducted to ensure the site is arranged according to the
plan.
Lower Rum River Watershed Management Organization (LRRWMO)
Any land disturbance, including stockpiling of material, is now required to obtain a permit from
the LRRWMO. A condition of approval requires the applicant to complete this process.
Gas Pipeline
A natural gas pipeline traverses the site from northwest to southeast as shown on the attached tire
storage plan. It will be necessary for trucks to cross the pipeline to establish the second group of
tire piles. In these situations the owner of the pipeline (Koch Industries, Inc.) requires a
compacted berm over the pipeline to ensure the safety of the pipeline. The applicant is working
through this process and will be required to provide documentation of the design and inspection
before the piles shown south of the pipeline are established.
Planning Commission Review
The Planning Commission will need to consider whether the proposed use, as regulated, is
acceptable based on the conditional use permit criteria listed above, whether other conditions are
necessary, or whether the proposed use cannot be made to meet the conditional use permit
criteria.
Staff Review
If the proposed use is allowed, staff suggests the following additional conditions which have
been added to the attached resolution.
1. The applicant shall bring the site into compliance with Fire Department requirements by
February 1, 2012.
2. All tire chips shall be removed from the subject property by July 1, 2012 and the site shall be
restored to the condition that existed prior to the stockpiling of tire chips.
ACTION REQUESTED
The Commission is asked to hold a public hearing, review the proposed conditional use permit
application and make a recommendation to the City Council.

WHEREAS, North Pine Aggregate, Inc. has requested a conditional use permit for storage of tire
chips on the subject property; and
WHEREAS, City Code 12 -12 requires a conditional use permit for the storage of highway
construction materials; and
WHEREAS, the Planning Commission held a public hearing and has reviewed the request; and
WHEREAS, the Planning Commission finds:
a. the request would not have a detrimental effect upon the health, safety, morals, and
general welfare of the City of Andover and recommends to the City Council approval of the
conditional use permit as requested. OR
in
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Andover has
received the recommendation of the Planning and Zoning Commission and approves the
conditional use permit on said property with the following conditions:
1. The applicant shall bring the subject property into compliance with the Fire Department
Memorandum stamped received by the City of Andover December 23, 2011 by February
11 2012 and maintain compliance throughout the time that tire chips are stored on the
subject property.
2. The Applicant shall obtain a watershed permit from the Lower Rum River Watershed
Management Organization.
3. The applicant shall provide documentation of approval to cross the natural gas pipeline
from Koch Industries, Inc. to include the required design of the crossing and proof of
inspection.
4. All tire chips shall be removed and from the subject property by July 1, 2012 and the site
shall be restored to the condition that existed prior to the stockpiling of tire chips by that
date.

Per the Minnesota State Fire Code and NFPA Standards.
CITY OF ANDOVER
2504.1— Open Burning is prohibited in tire storage yards.
2504.2 — Cutting, Welding, or heating devices shall not be operated in tire storage area.
2505.1 — Individual piles, Tire Storage shall be restricted to individual piles not exceeding 5000 square
feet of continuous areas.
Piles shall not exceed 50,000 cubic feet in volume
Piles shall not exceed 10 feet in height.
2505.2 — Separation of piles. Individual tire storage piles shall be separated from other piles of salvage
by a clear space of at least 40 feet.
2505.4 — Distance from lot lines and buildings, Tire storage piles shall be located at least 50 feet from lot
lines and buildings.
2505.5 — Fire breaks, Storage yards shall be maintained free from combustible ground vegetation for a
distance of 40 feet from the stored material to grass and weeds; and for a distance of 100 feet
from stored product to brush and forested areas.
2505.6 —Volume more than 150,000 cubic feet, where the bulk volume of stored product is more than
150,000 cubic feet, storage arrangement shall be in accordance with the following:
1) Individual storage plies shall comply with size and separation requirements in Sections 2505.1
through 2505.5
2) Adjacent storage piles shall be considered a group, and the aggregate volume of storage piles in
a group shall not exceed 150,000 cubic feet.
Separation between groups shall be at least 75 feet wide.
2505.7 — Location of storage, Outdoor waste tire storage shall not be located under bridges, elevated
trestle, elevated roadways or elevated railroads.
2506.1— Fire Department Access, New and existing tire storage yards shall be provide with fire
apparatus access roads in accordance with Section 503 and this section.
2506.2 — Location, Fire apparatus access roads shall be located within all pile clearances identified in
sections 2505.4 and within all fire breaks required in section 2505.5. Access roadways shall be
within 150 feet of any point in the storage yard where storage piles are located, at least 20
feet from any storage pile.
2507 — Fencing
2507.1— Where the bulk volume of stored material is more than 20,000 cubic feet a firmly anchored
fence or other approved method of security that controls unauthorized access to the storage yard shall
surround the storage yard.
2507.2 — Construction, the fence shall be constructed of approved materials and shall be at least 6 feet
high and provided with gates at least 20 feet wide.
2507.3 — Locking, All gates to the storage yard shall be locked with the storage yard is not staffed.
2507.4 — Unobstructed, gateways shall be kept clear of obstructions and be fully openable at all times.
2508.1 Water Supply, a public or private fire protection water supply shall be provided in accordance
with Section 508. The water supply shall be arranged such that any part of the storage yard can be
reached by using not more than 500 feet of hose.
2508.2 Fuel fired vehicles operating in the storage yard shall be equipped with a minimum 2A:20BC
rated portable fire extinguisher.
NFPA 33
33.1.7 Piles of tires or altered tire material shall not be located beneath power lines or structures.
33.7.4 — Individual altered tire materials shall not be located on site in excess of 90 days.
Keep in mind that the area being used is in a non - hydrant area of the city, we would have to run a
tanker shuttle in the event of a fire.
In such event we would need extensive manpower, water, smothering material, heavy equipment and
operators. Ultimately, incurring a significant expense to the City of Andover.
We also have environmental issues in the event of a fire, such as run off of contaminated water from the
tire material, smoke issues and clean up.
