Mr. Berkowitz explained the City Council is requested to discuss the proposed draft goals and
policies for the P Generation Water Resource Management Plan 13 -27.
Mr. Berkowitz reviewed the
Councilmember Howard asked how the plan has—thanged. Mr. Berkowitz stated the plan is the
same: A few .years ago they decided they_needed consistency in their rules. He stated because of
Atlas 14, staff feels it is better that they - started a few years ago because they are now seeing the
one hundred year flood elevation going up a little bit.
Councilmember Howard asked if the developers are following the plan. Mr. Berkowitz stated
they are going by the City's- plan-and also the Coon Creek Watershed District's plan.
Councilmember Knight stated some of the other communities are having aquifer problems and
he wondered if they will be having the same issues in the future. Mr. Berkowitz stated staff just
met with the Coon Creek Watershed District and it was concluded that the DNR's plan of
Ground Water Evaluation does not currently include Andover.
Mr. Berkowitz stated many communities are discussing the option of using surface water for
drinking. He noted Ramsey went through that discussion a few years back.
Councilmember Trude asked if surface water would be a shallow well or a pond. Mr. Berkowitz

1 stated it would be from a pond.

3 Councilmember Trude wondered if they needed to start looking at alternatives for the rural area
4 of Andover. Mr. Berkowitz stated the problem used to be with washing machines using a lot of
5 water but now washing machines are being designed to use less than 20 gallons of water per load
6 which has helped a lot.

8 Councilmember Knight thought a lot the water problems now in the state have to do with the
9 production of ethanol.
10
11 Councilmember Bukkila asked whether the City has any choices in this or is this the way it is.
12 Mr. Berkowitz stated they try to keep it to a minimum when taking language from statutory
13 regulations.

15 Mr. Haas stated the City needs to make sure they have clean water. He stated the Lower Rum
16 WMO went bare minimum and the Coon Creek Watershed District will likely be more
17 restrictive.

19 Councilmember Knight asked if they can mandate rain gardens. Mr. Berkowitz stated it is a best
20 management practice that a developer can use if they need to meet a requirement of infiltration.
21 As a best management practice, a developer needs to come forward asking for a rain garden and
22 the Council reviews it to see if it is the best way to manage the water infiltration.

24 Councilmember Trude stated on the first page, Goals, under Item C it states: "to protect and
25 enhance.. and maybe it should read "to protect or enhance..." so it is not mandatory.

27 Councilmember Bukkila asked if there is a purpose to this discussion or is this being presented as
28 something new that the Council needs to follow. Mr. Berkowitz stated it is both.

30 Mr. Dickinson reviewed the reason for this discussion and noted it is also an educational piece
31 for future review of developments.

33 Councilmember Bukkila stated she would rather have staff review this and decide what needed
34 to be added or removed to be in conformance with what the State Statute dictates.

36 Staff reviewed examples of the one hundred year elevation requirements in different
37 developments in the City.

39 Mr. Dickinson wondered on Item E, what was meant by "provide a mechanism..." Mr.
40 Berkowitz stated this is left vague to leave options open.

42 Councilmember Trude .wondered if in the rural areas of the City, they should be more
43 environmentally friendly and have each site take care of its own run off. She thought this would
44 save money because if there are drainage ditches in the rural areas, they would not need curb and

1 gutters. Mr. Haas stated there is a lot of maintenance involved with keeping drainage ditches
2 open, which adds up in costs. He stated they really need to weigh out the costs.

4 Mr. Berkowitz stated the edge of the road deteriorates without curb and if curb is not put in, then
5 gravel needs to be placed and maintained. Councilmember Trade stated this is something the
6 City needs to look at further and review.

8 Councilmember Bukkila stated her concern is maintenance and upkeep. Mr. Berkowitz noted
9 they try not to dictate what the developer does with their developments but if the Council wanted
10 to discuss this further or make changes, staff is fine with that.

12 DISCUSS MAILBOX REQUIREMENTS FOR NEW DEVELOPMENTS
13
14 Mr. Berkowitz explained the City Council is requested to discuss mailbox requirements or
15 mailbox styles for new developments.
16
17 Mr. Berkowitz reviewed the staff report with the Council.
18
19 Councilmembers Knight and Howard stated they did not like the large cluster style mailboxes.
20 Councilmember Bukkila stated lock boxes are great but too expensive for most people.
21
22 Councilmember Knight asked what they do with newspaper boxes. Mr. Berkowitz indicated the
23 newspaper boxes need to be placed at the same height as the mailbox or higher because those
24 boxes are what the Public Works Department hits.

26 Mr. Berkowitz stated it is generally up to the developer to decide what they want to do as long as
27 it meets the City's requirements.

29 Councilmembers Bukkila and Howard stated they would be okay with mega cluster mailboxes if
30 it was half the size of what was presented. Councilmember Trade indicated she liked cluster
31 mailboxes because they were durable, looked nice, and the mail people like them.

33 DISCUSS CONCRETE CURB & GUTTER OF PARKING LOTS IN PARKS

35 Mr. Berkowitz explained the City Council is requested to discuss concrete curb and gutter for
36 parking lots in City Parks.

38 Mr. Berkowitz reviewed the staff report with the Council, also a map of Prairie Knoll Park was
39 displayed.

41 Councilmember Bukkila stated this needs to be practical, not pretty. Mr. Dickinson stated the
42 City might get some backlash from commercial developers because it is a requirement for the
43 commercial developers.

Councilmember Bukkila stated she would be okay with doing this for recreational purposes.
Councilmember Howard stated he would be comfortable with putting curb along the inside of the
parking lot to keep vehicles off the park.
Mr. Berkowitz stated the cost to curb both parking lots is $25,000.
Councilmembers Howard, Knight, and Bukkila felt rather than using curb, they should add more
vegetation around the parking area to deter people from driving where they are not supposed to
drive.
Mr. Dickinson asked if they needed to do a code amendment or do they do this individually as
projects are approved. The Council felt it should be approved individually.
DISCUSSIREVIEW CITY CODE AMENDMENTS — 12 -2 -2 DEFINITIONS; 12 -12

ADMINISTRATION & ENFORCEMENT
Mr. Carlberg explained the City Council is requested to continue the discussion of City Code 12-
12 Permitted, Conditional and Prohibited Uses.
Mr. Carlberg reviewed the staff report with the Council.
Councilmember Bukkila stated she would like to see "Group Family Daycare Facility" listed as
"Daycare Facility — Group Family." Mr. Carlberg stated that was a good idea.
Councilmember Bukkila thought the headings needed to be categorized by keywords.
Councilmember Trude liked the idea of using in large headings with subheadings such as
"Animals; Dwellings; Storage; etc..."
Councilmember Bukkila reviewed a list of sections she thought should be put into the chart,
which would help people better find things they are looking for. Mr. Carlberg thanked her for
the thoroughness of the list.
Councilmember Trude wondered if they are putting some things in the chart that do not belong
there. Mr. Carlberg stated some are listed in the chart because they need a conditional use
permit.
Educational Institution or Facility
Mr. Carlberg reviewed the current definition with the Council.
Councilmember Trude thought there needed to be a better definition for this item. She thought

I this was too broad and should not include K -12. She noted the City of Blaine's definition really
2 defines the items.

4 Mr. Dickinson stated if it is listed as conditional in residential districts, the Council could deny or
5 approve the item, if appropriate. Councilmember Trude thought putting one definition in the
6 ordinance for everything could hurt the community.

8 Mr. Dickinson stated he thought the Council's intention was to get rid of the definition and use
9 the description. One title will be K -12 and the other will be Post - Secondary with conditional use
10 in business areas, otherwise K -12 is permitted in all other areas except the M -1 & M -2 Districts.

12 The Council discussed with staff the confusion of the chart in regard to education.
13
14 Mr. Carlberg stated a previous discussion that the Council and staff had was to exclude them
15 from the commercial district because they did not want to lose the tax base. The Council thought
16 that was a good point. Mr. Carlberg noted a business like Sylvan Learning Center would be
17 allowed because it is service related and would still produce a tax base.

19 Mr. Carlberg stated the Council removed publicly owned and operated property except as in the
20 amended, but he wondered how they will deal with these things because they are not allowed in
21 any district now. He would like to put this back in. The Council agreed with this suggestion.

23 Mr. Carlberg stated they do not address private utilities, only public utilities. They need to have
24 a public utility and a private utility line, which would be permitted. In the definition, they need
25 to be addressed. He noted they include transmission lines and gas pipelines that are listed as
26 permitted but should be conditional. The Council asked staff to correct this.

28 DISCUSSIRE VIEW COMMUNITY SUR VEY

30 Mr. Dickinson explained an Andover City Council 2013 -2014 Goal is to "pursue a community
31 survey to determine resident support for current city services and programs." At the October
32 City Council workshop, Council direction was to start this process to assist the Council on
33 gauging public opinion of current services and support for future capital projects.

35 Councilmember Knight stated question 4 "what do you think is the most serious issue facing the
36 City of Andover today ?" is going to be hard to tabulate because it is not a multiple choice
37 question. Mr. Dickinson stated this is what they had on the previous survey and noted last time
38 the primary concern was City growth.

40 Councilmember Bukkila stated she had an issue with question 77 that asks about property tax
41 increases. She thought the question was important but was a voter question and they do not
42 know what lifestyle situation each resident has. She would like to be more transparent on the
43 question, not complicated.

Councilmember Knight stated he had an issue with questions 51 through 57 related to enforcing
city codes because he thought it would be too complicated to go over by phone. Mr. Dickinson
stated these questions were in the last two surveys it does not seem like you are on the phone that
long when taking this type of survey.
Councilmember Trude thought question 60 maybe too complicated also, but she thought that was
an important issue to cover.
Councilmember Howard stated he thought question 47 about whether there should be a vehicle
over pass constructed over the railroad tracks on Bunker Lake Boulevard was an important
question to ask but should include dollar amounts for people to answer. Mr. Dickinson noted if
dollars are added to the questions, people may start to add them up and decide it is all too
expensive. Consensus was to seek financial support.
Councilmember Trude thought they should add a question asking if the person would use or does
use that route. Consensus was to add that question.
Councilmember Trude thought question 63 about open space areas should have a question added
"Do you think ... open space should be accessible." She thought another question should ask if
open space should be large parcels or small areas in the urban area.
The Council agreed to add the questions.
Councilmember Trude asked if they should add a question if people would want to spend more
money on trails or parks. Councilmember Bukkila would like to have those split up and ask both
questions.
Mr. Dickinson stated they could add questions within questions 64 -68, depending on the
responses.
Councilmember Howard stated he would rather have questions about trails than parks.
Councilmember Trude thought they may need an open ended trail question such as "If a trail is
added, where would it be." Mr. Dickinson stated a person would need to be educated on trails in
order to indicate where they should go.
Councilmember Bukkila thought the trail question should focus on access to school trail systems.
Mr. Dickinson wondered if they should add the question: "Should the City expand the trails ?"
The Council supported that question.
Mr. Dickinson summarized the area of trails and parks in the survey, noting the trail questions
will come first, followed by park related questions.
Councilmember Knight thought they should have a few questions regarding city services, what is
being offered, and what should be offered. Mr. Dickinson thought this was already covered in

the survey.
Councilmember Bukkila thought the question on text messaging for updates should not be asked.
She stated she liked question 88 about email distributions, but would like to remove question 89
regarding texting.
Councilmember Trade stated she would like to know if the residents know about the City's
Facebook page and to remove all other questions regarding social media.
2013 GENERAL FUND B UDGET PROGRESS REPORT PRE A UDIT DECEMBER 2013
Mr. Dickinson reviewed the 2013 general fund budget with the Council, highlighting both
positive and negative budget variances.
DECEMBER 2013 CITY INVESTMENTS REPORT
Mr. Dickinson reviewed the December 2013 City investments with the Council, identifying that
the city has a very large debt service payment on February 1, 2014.
OTHER BUSINESS
Councilmember Trade stated the Council needs to keep in mind possible people to invite to
apply for the EDA board.

16 Natural Resources Technician Kytonen provided a presentation on the National Pollutant Discharge
17 Elimination System (NPDES) regulations as set forth by the Minnesota Pollution Control Agency
18 (MPCA) and updated the Council on the inspection process for the City's stormwater infrastructure.

20 Natural Resources Technician Kytonen reviewed a PowerPoint presentation with the Council and
21 noted there is a requirement to hold a public meeting as part of our storm water permit to receive
22 public feedback. He reviewed the pollutants and maintenance challenges the City has.
23
24 Councilmember Trude asked if it was typical to see residents mow their lawns close to collection
25 ponds and other outfall utilities in the City.
26
27 Natural Resources Technician Kytonen explained residents are not allowed to put grass clippings in
28 these collection ponds. He stated this accelerates algae growth and makes filtration less effective.
29 He stated in the case of illicit discharges the source is identified and penalties or fines may be
30 enforced. He stated the City sweeps all the streets twice a year and then sweeps in some areas as
31 needed. He explained the GEO Moose GIS system the City uses and what information is available
32 for all the storm water outfalls in the City. This information is then shared with the Public Works
33 Department so they can determine what maintenance needs to be done.

35 Councilmember Trude clarified that the City employees would be properly identified if they were
36 doing work in residential yards.

38 Natural Resources Technician Kytonen stated in cases where the City is removing trees the resident
39 would be notified prior to the work being done.

41 Councilmember Howard asked if cameras are used in the inspection process and if elevations are
42 checked.

1 Natural Resources Technician Kytonen stated the inspections are mostly visual. They look at the
2 ends for sediment and blockage. If an outfall is failing then cameras may be used to determine what
3 the problem could be. If there is a backup then the City would look at elevations. The City does not
4 have the equipment to look at elevations so this would be contracted out.
Councilmember Knight asked staff to explain the storm water utility bill residents received
earlier this year.
9 City Administrator Dickinson stated those bills are for the storm water utility and the funds are
10 used to maintain that utility infrastructure. In 2003 the City implemented the Storm Water Utility
11 Fund and at that time funds were removed from the General Fund and put into that utility
12 account. The City removed the maintenance of these systems from the levy and it is now a fee
13 based system based on the type of property that is contributing to the system.

15 City Engineer Berkowitz stated in 2003 the MPDES permit started the process of the City
16 maintaining and inspecting the storm water and sewer systems. Maintenance has also increased
17 with the increased use of the street sweeper and the inspection process has increased. Everyone
18 in the City has storm water sewer or some storm water that leaves the site and it goes to an area
19 that the City is responsible for. The money is utilized to maintain or improve storm water
20 quality.

22 Councilmember Bukkila asked if the City has looked at the cost analysis of having a jet /vac truck
23 versus outsourcing.

25 City Engineer Berkowitz stated it has been beneficial for the City to have their own truck. There
26 has been discussion about the need for a larger truck. The truck the City has is not big enough to
27 handle the large sanitary lines in the City. He clarified the Sanitary Sewer Utility and the Storm
28 Water Utility pay for the equipment that the City needs to clean the system. He also stated the
29 requirements for the MPDES permit process is more and more strict and the City is required to
30 maintain more things. The City needs to meet State and Federal regulations.

32 Councilmember Trude stated the City has been doing this long enough that the process is less
33 labor intensive than it was years ago, especially with the mapping being completed.

35 City Engineer Berkowitz stated the City is working to be as efficient as possible but the
36 requirements become more restrictive and more staff time is needed to get the work done.

38 Councilmember Trude asked if there are things residents could do to help maintain and improve
39 the City's outfalls.

41 Natural Resources Technician Kytonen stated there is information on the City's website
42 including keeping outfalls clean and keep grass clipping out of ponds. The City is also working
43 on an Adopt -a -Pond program.

1 City Administrator Dickinson stated this was a public meeting and it should be noted there is no
2 one present at the meeting.

4 HOLD PUBLIC HEARING / ORDER PLANS & SPECIFICATIONS / 14 -2 & 14 -2A / 2014
5 STREET RECONSTRUCTION & 159TH AVENUE NW CULVERT REPLACEMENT
6
7 City Engineer Berkowitz stated the City's 2014 -2018 Capital Improvement Plan (CIP) identified the
8 reconstruction of Makah Street NW from 159th Avenue NW to Roanoke Street NW (7h Avenue
9 NW), and 159t1i Avenue NW from Makah Street NW to 7th Avenue NW.
10
11 City Engineer Berkowitz reviewed the information with the Council including the areas included in
12 the project, the estimated project costs and estimated assessment per lot of $6,500. He also
13 explained the timeline for the project, explaining it would be broken into two phases so that school
14 bus service is not interrupted. The lane width on 157th Avenue will be reduced 2 -feet on each side
15 and this will have less impact on the residential yards and have a calming or slowing effect on traffic
16 speeds.

18 Councilmember Trude asked how many units are being assessed and what the lot sizes are in this
19 project area.
20
21 City Engineer Berkowitz explained there is a total of 23 units being assessed. Most of the lots in
22 this project are 2.5 -acres to 5 -acres with the exception of one lot that is about 8- acres, which will
23 be assessed as two (2) units.

25 Councilmember Knight asked if the cemetery would be included in the assessments.
26
27 City Engineer Berkowitz explained the cemetery entrance is on 7th Avenue and would not be
28 included in the assessment for this project.

30 Mayor Gamache stated the residential meeting held in December had been well attended by
31 residents. He asked if there were any concerns brought up at that time that had not been
32 addressed.

34 City Engineer Berkowitz explained there had been discussions regarding the in ground sprinkler
35 systems residents have and one resident was disappointed the project would be happening this year
36 because he had hoped to sell his house this summer.

4 ordering the improvement of projects 14 -2, 2014 Street Reconstruction, and 14 -2A, 159h Avenue
5 NW culvert replacement and directing preparation of final plans and specifications. Motion carried
6 unanimously. (See Resolution R009 -14)

8 PUBLIC HEARING. VACATION OF EASEMENT — 1711 139TH LANE NW —
9 MEASUREMENT SPECIALTIES

11 Community Development Director Carlberg presented the request of Measurement Specialties
12 Inc. to vacate drainage and utility easements over, under, and across parts of Lots 1 and 2, Block
13 1, Parkside at Andover Station North. He explained the parking lot of the proposed project
14 would be located in this area and the easement would need to be vacated before these plans could
15 be approved.

17 Motion by Councilmember Bukkila, Seconded by Knight, to open the public hearing at 7:48 p.m.

7 Community Development Director Carlberg stated the City's Comprehensive Plan update will be
8 reviewed by the Met Council February 12`s and back to the City for approval February 18t'. He
9 stated the City is currently working on the 16fl' Annual Suburban Home Improvement Show and

13 City Administrator Dickinson stated the Polar Plunge fundraiser for the Special Olympics will be
14 held at Crooked Lake this Saturday.

18 (League of Minnesota Women Voters) Councilmember Trude stated on February 10`l', the
19 League of Minnesota Women Voters has asked Attorney Tony Palumbo to speak about elderly
20 abuse. This meeting is schedule for 6:30 p.m. at the Andover City Hall Council Chambers.

22 (Update on Charity Events) Mayor Gamache thanked everyone who had attended the Mayors
23 Snowmobile Run. They were able to raise over $2,000 for Youth First. The Northstar Alumni
24 Hockey Game was on Saturday and they were able to raise money for charity at the event.

26 (Hope for Youth) Councilmember Bukkila stated Councilmember Knight had asked where the
27 City was with youth homelessness. She provided information for Hope for Youth in Anoka.
28 This is a non - profit organization that is working to help homeless youth by providing a place for
29 them to go. She stated they have a website and Facebook page. They are looking for donations
30 including household products.

32 (Public Works Department) Councilmember Knight commended the Public Works Department
33 for their hard work during the difficult winter. Mayor Gamache reminded residents to keep cars
34 and trailers off the roads during a snow event so the streets can be properly plowed.

Claims totaling $138,011.20 on disbursement edit list #1 - 2 from 02/12/14 to 02/14/14 have been issued and
released.
Claims totaling $215,939.54 on. disbursement edit lists #3 dated 02/18/14 will be issued and released upon
approval.
BUDGET IMPACT
The edit lists consist of routine payments with expenses being charged to various department budgets and
projects.
ACTION REQUESTED
The Andover City Council is requested to approve total claims in the amount of $353,950.74. Please note

INTRODUCTION
The City Council is requested to accept the petition, ordered amended assessment roll and adopt
the amended assessment roll for Project 14 -20, 13526 Crooked Lake Boulevard NW.
DISCUSSION
Attached are the following:
• Petition from property owner requesting hookup to municipal water.
• Amended assessment roll for the property 13526 Crooked Lake Blvd NW.
• Previous deferred assessment roll for the property at 13526 Crooked Lake Boulevard
NW.
Note: The improvement of water main was installed as part of the street reconstruction of
Crooked Lake Blvd NW (Project 95 -14). The City Council as part of Resolution 282 -97
approved that the water main assessment would not be levied until such time the connection is
requested by the property owner. It was also approved as part of the same resolution that interest
will not be accrued until property owner requests connection.
BUDGET IMPACT
The $5,350.00 will be assessed to 13526 Crooked Lake Boulevard NW over a 10 -year period.
ACTION REQUIRED
The City Council is requested to approve the resolutions accepting the petition, ordering
amended assessment roll and adopting the amended assessment roll for Project 14 -20, water
main at 13526 Crooked Lake Boulevard NW.

A RESOLUTION DECLARING ADEQUACY OF PETITION AND ORDERING
AMENDED ASSESSMENT ROLL FOR WATER MAIN FOR PROJECT NO.
14 -20 IN THE AREA OF 13526 CROOKED LAKE BOULEVARD NW.
WHEREAS, the City Council has received a petition, dated February 7.
2014 requesting the construction of improvements; and
WHEREAS, such petition has been validated to represent the signatures of
100% of the affected property owners requesting such improvement.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Andover that:
1. The petition is hereby declared to be 100% of owners of property affected,
thereby making the petition unanimous.
2. Escrow amount for feasibility report is 0
3. The proposed improvement is hereby referred to the City Engineer and he is
instructed to provide the City Council with a feasibility report.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
ANDOVER, MINNESOTA:
1. Such proposed assessment, a copy of which is attached hereto and made part
hereof, is hereby accepted and shall constitute the special assessment against
the lands named therein, and each tract of land therein included is hereby found
to be benefited by the proposed improvement in the amount of the assessment
levied against it.
2. Such assessment shall be payable in equal annual installments, extending over a
period of 10 years, the first of the installments to be payable on or before the
1 st Monday in January, 2015 and shall bear interest at a rate of 4.5 percent
per annum from the date of the adoption of this assessment resolution.
3. The owner of any property so assessed may, at any time prior to certification of
the'assessment or the first installment thereof to the county auditor, pay the
whole of the assessment on such property, with interest accrued to the date of
payment, to the municipal treasurer, except that no interest shall be charged if the
entire assessment is paid within 30 days from the adoption thereof; and, except
as hereinafter provided, the owner may at any time prior to November 15 of any
year, prepay to the treasurer of the municipality having levied said assessments,
the whole_ assessment remaining due with interest accrued to December 31 of
the year in which said prepayment is made.

City Council at a regular meeting this 18th day of February 2014, with

against, whereupon said resolution was declared passed.

Approve Resolution Designating 2014 City of Andover Board of Appeal and
Equalization

INTRODUCTION
Minnesota Statutes sets forth the process and procedures for municipalities to conduct an annual
Board of Appeal and Equalization within their respective municipality. Each year the City of
Andover has conducted a local Board of Appeal and Equalization rather than an Anoka County
Assessor open book review.
DISCUSSION
The Anoka County Assessor, pursuant to statute, shall fix a day and time when the board or the
board of equalization shall meet in the assessment districts of the county. Notwithstanding any
law or city charter to the contrary, a city board of equalization shall be referred to as a board of
appeal and equalization. On or before February 15 of each year the assessor shall give written
notice of the time to the city or town clerk. The meetings must be held between April 1 and May
31 each year. The clerk shall give published and posted notice of the meeting (April 29, 2014) at
least ten days before the date of the meeting.
The attached resolution identifies City Administrator /City Clerk Jim Dickinson as and Alternate
to the Board. This is done in the event a trained member of the City Council is not able to attend.

Dan is retiring after working 19 years for the City of Andover. Dan was hired as the first full -
time Fire Chief in March of 1995. During Dan's time with the City of Andover the Fire
Department has earned an excellent reputation because of the men and women he has hired and
trained under his direction.
The Human Resources department would like to advertise and recruit candidates for this position.

Dear Jim:
It is with mixed emotions and feelings that I write this letter to inform you that I plan to
retire from my position as the Fire Chief for the City of Andover on May 28, 2014.
1 have thoroughly enjoyed my time here since being hired as the first full time Fire Chief
in March of 1995. 1 will miss the hard working and very dedicated staff who have worked
so diligently with past and present Mayors and City Councils to build a wonderful place
to live and work. It is hard to believe how fast the time has gone but like everything else
changes occur and people move on.
I leave the fire department knowing that Andover has some of the very best paid on call
staff who have trained tirelessly and usually without complaining, to become a first class
fire and EMS department. The reputation earned by this department has occurred
because of the men and women who are the backbone of our service to the residents of
Andover and that should not go unnoticed. I personally want to thank you for the
support and guidance you have extended to me and the firefighters so we can perform
our jobs with the best equipment, buildings and vehicles available for the job.
I would also like to say how fortunate the fire department is to have two other fulltime
staff that are both very dedicated and work hard to do their jobs, sometimes without
much notice or praise. Both Fire Marshal Robbie Bartholomew and Administrative
Assistant Nanci Libor are the best there is at their positions and we are so very lucky to
have them here in Andover.
I would also like to sincerely thank all of those who served as City Council members
during my tenure here. The fire department would not be where it is today without the
vision and understanding from the City Councils regarding what level of emergency
services they would like us to provide for the citizens of Andover.

made by the code enforcement officer and the building official to determine
compliance with this chapter of all premises proposed to be licensed, and by the
County Sheriff's Department of all persons listed on the license application. Please

SUBJECT: Comprehensive Plan Amendment (CPA) (13 -01) Final Approval of the following
Amendments to the City of Andover Comprehensive Plan:
to Include 83 -acres into the Metropolitan Urban Service (MUSA) Area;
to Change 83 -acres of land from RR — Rural Residential Density to URL — Urban Residential
Low Density;
to Change 6.39 acres of land from GC — General Commercial to URM — Urban Residential
Medium Density; and,
to Change the Density Range for URL - Urban Residential Low Density and URM - Urban
Residential Medium Density.
DISCUSSION
On October 15, 2013, City Council approved Resolution R094 -13, amending the Comprehensive
Land Use Plan for the City of Andover. The resolution is attached for your review. City Council
approval was subject to the review by the Met Council.
METROPOLITAN COUNCIL ACTION
On February 12, 2014, the Met Council approved the City of Andover CPA. Attached for your
review is Met Councils action. Once the Met Council has taken action on the amendment, the
City Council must adopt the comprehensive plan in final form. Attached is the section from the
Met Council Local Planning Handbook outlining the approval process.
Next Step in the Approval Process
After the City Council formally approves the CPA, staff will submit an electronic copy and a
hard copy of the comprehensive plan update to Met Council.
Met Council File Name and File Number
The Met Council report originally was titled as it appeared on the CPA submittal (MUSA
Expansion, Land Use and Density Range Changes), but during internal review of the report, it
was asked that report title be revised /shortened. Met Council staff chose to name the CPA Grey
Oaks Development. City staff contacted the Met Council with concerns with the name (Grey
Oaks) and suggested it be renamed Country Oaks North CPA; however, Met Council staff stated
the name will remain as Grey Oaks because internally the CPA will only be referred by its'
Review File No. 20326 -5. The attached action letter from Met Council indicates the file number
(20326 -5) and the file name as Grey Oaks Development CPA.
ACTION REQUESTED
The City Council is asked to formally adopt the Andover Comprehensive Plan Amendments as
proposed and adopted in Resolution R094 -13 and identified as Metropolitan Council Review File
20326 -5 in the Post Council Action Letter dated February 13, 2014.

WHEREAS, Merril and Viola Putnam and The Ganter Family Limited Partnership has petitioned
the City of Andover to include their 83 — acres of property into the MUSA and to change the
land use designation from Rural Residential (RR) to Urban Residential Low Density (URL), and;
WHEREAS, the property is not within the MUSA, and;
WHEREAS, analysis of the City's sanitary sewer and water trunk system has determined that
sufficient capacity exists to serve the subject property, and;
WHEREAS, Povlitski Properties LLP has petitioned the City of Andover to change the land use
designation of 6.39 — acres from General Commercial (GC) to Urban Residential Medium
Density (URM),
WHEREAS, the property is within the MUSA, and;
WHEREAS, analysis of the City's sanitary sewer and water trunk system has determined that
sufficient capacity exists to serve the subject property, and;
WHEREAS, the City of Andover has petitioned to change to density range of the Urban
Residential Low Density (URL) and the Urban Residential Medium Density (URM), and;
WHEREAS, a public hearing was held pursuant to state statutes, and;
WHEREAS, the Planning and Zoning Commission recommends to the City Council approval of
the amendment to change the land use designation of 6.39 — acres from General Conunercial
(GC) to Urban Residential Medium Density (URM) as requested, and;

WHEREAS, the Planning and Zoning Commission recommends to the City Council approval of
the amendment to change to density range of the Urban Residential Low Density (URL) and the
Urban Residential Medium Density (URM), and;
WHEREAS, the Planning and Zoning Commission recommends to the City Council denial of the
amendment to include 83 — acres of property into the MUSA and to change the land use
designation from Rural Residential (RR) to Urban Residential Low Density (URL) as requested,
and;
WHEREAS, the Planning and Zoning Commission denial is based on the criteria established in
the Andover Comprehensive Plan concerning land use changes, and:
WHEREAS, the Planning and Zoning Commission agreed the land use change to urban would
not be compatible with the surrounding rural land uses; the public street system is not adequate
to serve the properties and an additional street connection is needed to the west connecting to
Hanson Boulevard NW to alleviate traffic issues/burdens on Wintergreen Street NW.
WHEREAS, the Council finds the proposed changes will not be detrimental to the health, safety,
morals and general welfare of the occupants of the surrounding land and is consistent with the
criteria established in the Andover Comprehensive Plan, and;
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Andover has
received the recommendation of the Planning and Zoning Commission and adopts the following
amendments to the Comprehensive Plan, subject to review by the Metropolitan Council:
1. Include of 83 -acres into the MUSA and change the land use of 83 -acres from RR- Rural
Residential Density to URL — Urban Residential Low Density.
2. The integration of MUSA for the 83 -acres shall conform to the Sewer Staging Plan in
Exhibit C.
3. Change 6.39 acres of land from GC — General Commercial to URM — Urban Residential
Medium Density.
4. Change the Density Range for URL - Urban Residential Low Density and URM - Urban
Residential Medium Density.
Adopted by the City Council of the City of Andover on this 15th day of October, 2013.

findings before taking final action. If the amendment conforms to the
regional systems policy plans, the Metropolitan Council will direct
that the municipality may put its comprehensive plan amendment
into effect. If there are no issues, the amendment may be placed on
the Community Development Committee and Council consent
agendas.
Local citizens, staff, local officials and other interested parties are
welcome to attend meetings of the full Metropolitan Council or of any
of the standing committees, including the community development
committee. Most presentations and discussion occur at committee
meetings.

plan, one electronic copy and one hardcopy of that plan and the
official controls implementing the plan must be submitted to the
Council. The electronic copy should be organized as one unified

Local governmental units cannot adopt any official controls or fiscal
devices that conflict with their comprehensive plans or which permit
activity in conflict with the metropolitan system plans. If local

Land use districts are established to ensure compatible development and to protect
natural resoyrces and amenities. The district definitions provided below are intended to
state their purpose, provide location criteria and describe the relationship of each district
with other land uses.
RESIDENTIAL LAND USE DISTRICTS
Rural Residential (RR) district provides an area for low intensity residential
development in areas outside of the Municipal Urban Service Area (MUSA) that will not
be served by municipal sewer and water. The minimum lot size is 2.5 acres to provide
sufficient space for on site sewer and water facilities and to prevent dense development
that would create an adverse impact on municipal and regional infrastructure. However,
smaller acreage lots exist in areas subdivided prior to 1978 and in the two previously
approved rural planned unit developments: Nightingale Preserve and Timber River
Estates. This district must be protected from higher intensity land uses, including the
Urban Residential Low Density Land Use District, with appropriate transitions. This
district also accommodates agricultural land uses.

Urban Residential Low Density (URL) district is established to create cohesive
neighborhoods of single - family detached housing within the MUSA and with access to
municipal sewer and water. Residential lots within this district are sized to allow
efficient utilization of municipal infrastructure as well as to provide an area large enough
to accommodate housing market demands. These neighborhoods must be protected
from higher intensity uses with appropriate transitions. These transitions include natural
features such as trees, wetlands, streams or major changes in topography. Man -made
elements such as streets, parks or earth berms in combination with landscaping are
also appropriate. When adjacent to arterial roadways, additional setback distance,
landscaping and berming are required. Facilities that generate noise, traffic, and /or
glare also require major separation from these neighborhoods.

Urban Residential- Medium Density (URM) district provides areas suitable for a variety
of attached and detached dwelling units. The URM district helps to address the need
for life cycle housing with increased density and smaller lot sizes. This district, with
appropriate transitions, can serve as a buffer between lower density residential and
commercial districts and may also be appropriate along higher volume transportation
corridors, such as collector and arterial streets. These neighborhoods are created as
part of a planned unit development that ensures efficient distribution of density and to
achieve appropriate transitions between uses of different intensity and transportation
corridors. These transitions are achieved with a combination of landscaping, berming,
physical separation and preservation of natural features.

At its meeting on February 12, 2014, the Metropolitan Council reviewed the City's Comprehensive Plan
Amendment (CPA), based on the staff report. The amendment expands the Metropolitan Urban Services
Area (MUSA) and reguides 83 acres to "Urban Residential Low Density (URL)" north of Wintergreen
Street and also reguides 6.39 acres from "General Commercial" to "Urban Residential Medium (URM)."
In addition, the amendment changes the density ranges for URL and URM land use designation in the
City.
The Council found that the CPA conforms to the regional system plans for transportation, wastewater,
and parks, is consistent with the 2030 Regional Development Framework and Council policies, and is
compatible with the plans of adjacent jurisdictions. Therefore, the City may place the CPA into effect.
A copy of the staff report to the Council is attached for your records. The Council will append the
amendment, submission form and supplemental information to the City's plan in the Council's files. If

INTRODUCTION
Larry Emmerich, developer of the proposed White Pine Wilderness 2nd Addition is requesting to
be allowed to clear trees prior to the preliminary plat public hearing and plan approval.
DISCUSSION
Current policy and past practice does not allow a developer or property owner to clear trees on a
site while the project is under preliminary plat review. A property owner that is not developing
their property is allowed to clear any time between the months of July through the end of March.
There are benefits in clearing the trees by the end of March to protect against the spread of insect
and disease concerns.
If the City Council agrees to allow the clearing then staff would send out letters to the adjacent
properties notifying them of the work that will be completed. The expense of such mailings and
staff time would be borne by the developer. Prior to any clearing a site meeting with the City's
Natural Resource Technician would be required.
ACTION REQUIRED
The City Council is requested to review the Larry Emmerich 's requested to remove trees on his
development site prior to preliminary plat approval.
