Administrator's Report — Administration © Mayor /Council Input Adjournment E REGULAR ANDOVER CITY COUNCIL MEETING —DECEMBER 39 2013 MINUTES The Regular Bi- Monthly Meeting of the Andover City Council was called to order by Mayor Mike Gamache, December 3, 2013, 7:00 p.m., at the Andover City Hall, 1685 Crosstown Boulevard NW, Andover, Minnesota. Councilmembers present: Mike Knight, Sheri Bukkila, Julie Trade and Tony Howard Councilmember absent: None Also present: City Administrator, Jim Dickinson Community Development Director, Dave Carlberg City Attorney, Scott Baumgartner Others Q PLEDGE OF ALLEGIANCE RESIDENT FORUM No one wished to address the Council. AGENDA APPROVAL There were no changes. Motion by Trude, Seconded by Knight, to approve the Agenda as presented above. Motion carried unanimously. PUBLIC HEARING — 2014 PROPOSED LEVY AND BUDGET Mr. Dickinson explained the Council has had a number of reviews of the City of Andover 2014 Proposed Budget and continued detailed review of the General Fund Budget that is primarily supported by the proposed 2014 Tax Levy. Mr. Dickinson reviewed the information with the Council. © Motion by Knight, Seconded by Bukkila, to open the public hearing at 7:23 p.m. Motion carried unanimously. Mr. Pat & Ms. Sharon Cramer, 3277 -166t' Lane NW, stated they received their proposed taxes and © Regular Andover City Council Meeting Minutes —December 3, 2013 Page 3 their property taxes went down but the City of Andover taxes went up roughly seven percent. She wondered what was causing the City taxes to go up when their property values went down. She also wondered what the City is doing to keep costs down and maintain level spending. Mr. Dickinson showed a taxable market value chart and stated on average the total community went down 2.33 percent. At the same time they added close to 150 new housing units so the drop within the existing homes dropped significantly more than .5 percent reduction on the Cramer's property. Everything is proportionately split between everyone and the Cramer's property value did not drop as much as others so they are showing a higher tax. Councilmember Trade stated her property value went down and the bottom line on her statement shows a lower tax than last year. She stated the City has an aging tax base and the City Council is trying to keep things level and maintain costs. Mayor Gamache stated every year the Council and City staff reviews the budget and how they can cut costs. In previous years, the City had lay -offs and furloughs along with maintaining salaries. This year, there is a little bit of a jump after 2011 and 2012 and a lot of that is coming from areas that need work. They are seeing some growth in the City, which will be helpful in the long run. He © thought the City had a good staff that works with the Council to keep costs down. The City does put money aside for emergencies so they are always ready. Councilmember Bukkila stated they have tried to take a practical approach and monitor what will be needing replacement in the future. She stated over the last few years they have cut back on maintaining the roads and now are trying to build back a little into their streets so they do not need to significantly increase the tax levy to pay for declining roads. Mr. Dickinson stated they have looked at 15 year proformas for debt service at workshop meetings, they also did that for their operations and then they try to determine what will be needed so there is not a potential funding problem that arises in the future. Mr. Dickinson stated Andover ended 2012 with 52 full time employees which is lower than most communities with similar size. Councilmember Trade noted the City is looking at property values rising in the future and it will happen unevenly and depend on homes selling prices in each neighborhood. There was further discussion regarding the value of homes in Andover and how the values are determined by the County Assessor. Motion by Bukkila, Seconded by Knight, to close the public hearing at 7:50 p.m. Motion carried unanimously. Councilmember Trade complimented staff on the hard work that has been done on the budget and knew they would continue to work on the budget for the rest of the year. She noted there is not any © Regular Andover City Council Meeting Minutes — December 3, 2013 Page 4 cushion built into the budget but she has confidence in staff to balance the budget. Councilmember Knight stated staff is very prudent and he appreciated that. APPROVE CITY CODE AMENDMENTS — 12 -2 -2 DEFINITIONS, 12 -12 PERMITTED, CONDITIONAL, INTERIM AND PROHIBITED USES, 12 -14 ADMINISTRATION AND ENFORCEMENT Mr. Carlberg explained the City Council is requested to consider the ordinance amendment to the City Code. Mr. Carlberg reviewed changes and items removed from the amendment. a Item 41— Eliminate Elementary, Junior and Senior High Schools and add K -12. Items 89 — 90, were to be removed. Items 111 -112, land use items on subordinate classroom structures were permitted for primary and secondary schools in Item 111 but in Item 112 Churches was a change from Conditional Use to Interim Use and in the worksession Council wanted those two items to be treated the same. All subordinate classroom structures will now be interim use even for primary and secondary schools. Mayor Gamache asked if the chart was easier to use by staff because he did not think it would be used by residents. Mr. Carlberg reviewed the reason for using the chart. He thought they needed to condense the table more. Councilmember Trade stated their code is not searchable online and she would like to see this change made to be more dynamic. Mr. Carlberg stated that is something staff will need to look at for the future. Mayor Gamache stated there is a column that has been added indicating if the use has not been specifically listed, it is prohibited. Mr. Carlberg stated Councilmember Trade wanted that added. Councilmember Trade thought this was really broad and in her memo from June 2013 she wanted the following words added: "Uses allowed in Business Zoning Districts are prohibited in Residential Zoning Districts unless otherwise listed as permitted or allowed with a Conditional Use Permit." She thought the blanket statement was not thorough enough and what she stated should be included. Councilmember Bukkila thought there was discussion from the beginning regarding this not restricting your freedoms, it tells you what you can do. She thought that trying to flip this did not © work. Councilmember Trade agreed and thought it was safer. She would like to have the amendment cleaned up and reviewed before approval. Councilmember Trade stated she would like to see residential uses discussed only in residential, © Regular Andover City Council Meeting Minutes — December 3, 2013 Page 5 commercial uses only in commercial, agricultural uses together, home occupations together, and listing each one under those topics. Mr. Carlberg thought staff could bring back a table that is condensed but for them to comply with how they amend ordinances, there has to be the underlining, striking through in order to be done legally. Councilmember Trude thought there could be two documents. Councilmember Bukkila would like to see this more user friendly, yet legal. Councilmember Trude indicated she would like to add a couple more categories such as: animals on property, with subtopics. Categories related to buildings and public uses. Wording could be added to indicate: "Public uses including parks, open space, public utilities are allowed ". She wanted the amendment organized and cleaned up and to cut out duplicate items. Councilmember Trude stated the rental definition qid not make sense to her and should be changed per previous discussions. She also thought there needed to be more interim use permits, which Councilmember Bukkila previously requested. © Councilmember Trude thought staff could also remove Item 42. Mr. Carlberg stated staff will clean the amendment up and bring it back for further Council review in January. 2014 CDBGPROJECT/APPLICATIONREVIEW Mr. Carlberg stated 2014 CDBG applications are due at Anoka County on January 16, 2014. The City needs to determine if it will submit an application for this round of CDBG funding. Mr. Carlberg reviewed the staff report with the Council. Councilmember Trude wondered how the City knows when a well fails. Mr. Carlberg stated they are notified when a well fails when the water is sent in for testing, otherwise there is no notification. He thought there should be a neighborhood meeting to discuss the CDBG project but he did not think the City qualified for this. Councilmember Bukkila suggested sending a letter of support for Youth First programming. Mr. Dickinson stated Youth First has to apply for a different pool of money but the City will provide letters of support to any qualified group looking for funding help. Mr. Dickinson suggested submitting a planning study of some type. Councilmember Trude © wondered if they could submit a Public Works expansion planning study for funding. Mr. Dickinson suggested they look at a public facility master plan or a study to analyze underserved areas in the community that do not have water service. © Regular Andover City Council Meeting Minutes — December 3, 2013 Page 6 Mr. Carlberg stated he would contact Anoka County Community Development Department to get some parameters as to what is eligible for the planning studies and if they can include some of these and apply for future funding for them. SCHEDULE JANUARY HRA MEETING Mr. Dickinson requested the Council schedule a January HRA meeting to discuss topics as detailed in the staff report. Motion by Bukkila, Seconded by Howard, to schedule a HRA meeting on January 7, 2014, following the EDA meeting Motion carried unanimously. ADMINISTRATOR'S REPORT City Staff updated the Council on the administration and city department activities, legislative updates, updates on development/ClP projects, and meeting reminders /community events. MAYOR/COUNCIL INPUT (Community Center Event) Mayor Gamache stated there is an event on Thursday at the Community Center honoring an Andover Boy for Boys State and National Boys State Accomplishments. Governor Mark Dayton, State Representatives Peggy Scott and Brandon Peterson will be there. Councilmember Trude thought the Council could present a proclamation at the event. Mayor Gamache did not know if there would be time so they may have to do this at a Council meeting. (Winter Parking) Mayor Gamache reminded residents to not park on the streets during snow storms. (Quad City Employee) Councilmember Trude stated Taylor, the camera and video operator will be moving onto a Twin City TV station. She noted Taylor's forte is editing and he has done a really good job. She wished him well on his new venture. (Quad City TV Award) Councilmember Trude stated the Fire Chief was at a QCTV meeting Regular Andover City Council Meeting Minutes — December 3, 2013 Page 7 because they won an award at a National Conference for a public safety show. (Coon Rapids Sports) Councilmember Trude stated QCTV now has the ability to televise some Coon Rapids sports activities for those residents in the Coon Rapids school area. (Anoka Hennepin Education Advisory Council) Councilmember Trude stated she is continuing to represent Andover on the Anoka- Hennepin Education Advisory Council. They have had a lot of good discussions lately about things that are happening and they are seeing the economy pick UP. ADJOURNMENT Motion by Howard, Seconded by Bukkila, to adjourn.
