Adjournment X1 ANLb 6 W 0 j§!J, X PLANNING AND ZONING COMMISSION WORKSHOP MEETING JANUARY 8, 2013 The Workshop Meeting of the Andover Planning and Zoning Commission was called to order by Chairperson Daninger on January 8, 2013, 6:00 p.m., at the Andover City Hall, 1685 Crosstown Boulevard NW, Andover, Minnesota. Commissioners present: Chairperson Daninger, Commissioners Dennis Cleveland, Valerie Holthus, Steve Peterson, and Michael Steel. Commissioners absent: Lynae Gudmundson and Kyle Nemeth Also present: City Planner Stephanie Hanson Associate Planner Andrew Liska Others DISCUSS CITY CODE 12 -12 PERMITTED, CONDITIONAL AND PROHIBITED USES City Planner Hanson stated the Planning Commission had left off their last discussions on the use table on line 61. Chair Daninger stated the goal of the Planning Commission was to eliminate the blank areas in the land use table. City Planner Hanson stated that 61 "Keeping up to five farm animals, plus one additional farm animal per above 5 acres on residential properties 5 acres or greater up to a maximum of 20 animals" should now read "Farm animals up to 5 per acre, plus one additional farm animal per acre above 5 acres on residential properties 5 acres or greater up to 20 animals and definition under City Code 12 -2. City Planner Hanson stated that 62 "Keeping of more farm animals than allowed as a permitted use on residential properties 5 acres or greater in compliance with Title 5 and definition under City Code 12 -2" should now read "Farm animals greater than allowed as a permitted use on residential properties 5 acres or greater in compliance with Title 5 and definition under City Code 12 -2" Andover Planning and Zoning Commission Workshop Meeting Minutes — January 8, 2013 Page 2 © City Planner Hanson stated that 63 "Keeping of poultry on residential properties without municipal sewer and water in compliance with Title 5" should now read "Poultry on residential properties without municipal sewer and water in compliance with Title 5 and definition under City Code 12 -2." Commissioner Peterson noted that 63 should include "City Code" before "Title 5." City Planner Hanson noted staff is not proposing any changes to 64 "Landfills." City Planner Hanson stated that 65, 66, and 67 all deal with liquor licenses and the proposed change in adding "in compliance with City Code 3 -1" will make the table easier to use. Commissioner Cleveland noted that 65 "Liquor licenses" includes the zoning classification GR. Commission discussed and Chair Daninger feels that it should be mentioned and discussed. Following discussion, Chair Daninger suggested leaving it as a conditional use. City Planner Hanson noted staff is not proposing any changes to 68 "Lumberyards." City Planner Hanson noted staff is not proposing any changes to 69 "Manufacturing." City Planner Hanson noted that number 70 "Manufactured homes and modular homes, provided they are developed under a planned unit development and the complex is at least 20 acres" should be changed from a permitted use to a planned unit development. Associate Planner Liska noted that this change is to reflect the definition in the uses table as it mentions "planned unit development' in the definition it should be "PUD" in the uses table rather than a permitted use. City Planner Hanson noted staff is not proposing any changes to 71 "Marinas." City Planner Hanson noted staff is not proposing any changes to 72 "Medical and dental clinics." Chair Daninger asked if you cannot have a dentist office in your house. City Planner Hanson confirmed that was correct. City Planner Hanson noted that number 73 "Medical clinic — 24 hour operation" should be discussed based on the changes to the Code regarding continuous use and non- continuous use based on zoning districts. Chair Daninger stated that it would be nice to have a 24 hour clinic. Commissioner Peterson asked where "Limited Business" was located in the City. Chair Daninger questioned how to define "medical clinic." Andover Planning and Zoning Commission Workshop Meeting Minutes — January 8, 2013 Page 3 Commissioner Cleveland stated that in looking at 72, you cannot have a doctor's office or dental clinic in your house but if you are a psychologist you can have an office in your house. They can be Psychiatrists, which are medical doctors. Cleveland mentioned that this is a very common practice for this field. Chair Daninger stated that this may be covered under businesses. Chair Daninger stated that 73 should be flagged to be revisited. The updated use table for continuous and non - continuous use is needed as the current Code for 73 seems to be conflicting for some of the zoning districts. City Planner Hanson noted that 74 "Mini Storage" should include "(indoor storage only)" as to not allow exterior storage. City Planner Hanson noted that 75 "Mortuaries and funeral homes" should include "(without crematorium)" as crematoriums are covered separately in the uses table. City Planner Hanson noted no change for 76 "Multiple dwellings" and 77 "Offices." Commissioner Peterson asked for additional clarification regarding 76 and the requirements for a planned unit development. Chair Daninger explained that the PUD is beneficial as they are more flexible. City Planner Hanson noted that number 78 "Open, off street parking space" should be deleted as it is covered more in depth in 12 -13 -8. City Planner Hanson noted that number 79 "Outdoor display — only during operating hours" should be deleted as it has been combined with number 81. Chair Daninger asked why number 81 "Outdoor display, storage, and sales — during operating hours only" does not include Neighborhood Business (NB) and Industrial (I). Planner Hanson stated that it could be changed. Chair Daninger stated that in 80 "Outdoor display, storage, and sales" shouldn't be allowed in NB but SC doesn't seem unreasonable. Commissioner Holthus questioned what the definition of limited business is and asked if it limited use. She noted the very few businesses are designated as this type today. Chair Daninger stated that additional research should be done on the Limited Business classification and noted that the category could be built for the future. Commissioner Peterson questioned if there was a specific purpose in mind with this zoning classification. City Planner Hanson noted that gas stations should be considered when looking at the zoning districts and the uses in them. Chair Daninger suggested allowing NB and SC through a conditional use. Commissioner Peterson agreed with Chair ® Daninger. Andover Planning and Zoning Commission Workshop Meeting Minutes —January 8, 2013 Page 4 © City Planner Hanson mentioned that Frattallone's Ace Hardware has requested a change in Code to allow for outdoor display, storage, and sales. Chair Daninger noted that the conditional use permits are fair to businesses. Rather than going ahead with plans without guidance, they can go through the process so both the business and community can reach an agreement. He noted that he is in favor of conditional use permits for this district. Chair Daninger noted that based on discussions 81 "Outdoor display, storage, and sales — during operating hours only" have the same conditional use permits allowed in the zoning districts as 80. City Planner Hanson noted staff is not proposing any changes to 82 "Outdoor theatres." City Planner Hanson noted staff is not proposing any changes to 83 "Pawnbrokers — as defined in Title 3, Chapter 4 of the City Code." Chair Daninger questioned why pawnbrokers couldn't be located in SC and I. He noted the same for Precious metal dealers. City Planner Hanson noted staff is not proposing any changes to 84 "Precious metal dealers — as defined in City Code 34" Chair Daninger proposed changing to allow pawnbrokers and precious metal dealers in both Shopping Center and Industrial zoned districts. City Planner Hanson noted staff is not proposing any changes to 85 "Principle buildings exceeding height maximum subject to City Code 12 -3 -5." City Planner Hanson noted 86 "Private dog kennel license (2.5 acre minimum lot size required)" should include "in compliance with City Code 5 -1A." City Planner Hanson noted that 87 "Private garages" should be deleted as it is covered in 48 regarding accessory structures. DISCUSS ITEMS ON PLANNING COMMISSION AGENDA Chair Daninger mentioned that he will be stepping down on the first item due to a potential conflict of interest as he does business with Kottkes. Chair Daninger provided a brief background on the property and mentioned that this item is not regarding ponds, tire storage, or any other uses and only regarding the stockpiled fill on the property. Commissioner Steel stated how City Code 12 -14 -6 B regarding criteria for granting © conditional use permits. He states he is uncomfortable with the current language. Chair Daninger suggested that Commissioner Steel voice his concerns tonight at the Planning Commission meeting but also encouraged him to work with the Code as it is written, for the time being. Chair Daninger noted that the Planning Commission will pick up on 88 next time. OTHER BUSINESS No other business.
