Adjournment k C I T Y 0 F raver PLANNING AND ZONING COMMISSION WORKSHOP MEETING MAY14, 2013 The Workshop Meeting of the Andover Planning and Zoning Commission was called to order by Chairperson Daninger on May 14, 2013, 6:00 p.m., at the Andover City Hall, 1685 Crosstown Boulevard NW, Andover, Minnesota. Commissioners present: Chairperson Daninger, Commissioners Tim Cleven, Lynae Gudmundson, Valerie Holthus, Bert Koehler, Kyle Nemeth, and Steve Peterson. Commissioners absent: None Also present: Community Development Director Dave Carlberg © City Planner Stephanie Hanson Others DISCUSS CITY CODE 12 -12 PERMITTED, CONDITIONAL AND PROHIBITED USES City Planner Hanson stated there were some definitions they need to further define and discuss. Retail Sales and Services: Ms. Hanson stated the City definition is very lengthy, she reviewed other cities definitions and recorded popular ones. Chairperson Daninger asked if shortening the definition would be safe to do. Mr. Carlberg indicated it would be fine. Commissioner Holthus stated she preferred business over stores and shops. Commissioner Nemeth suggested merging the first and third definition "Means a business having as its primary function the supply of merchandise or wares the end consumer" or "Stores and shops selling the personal services or goods over the counter." Andover Planning and Zoning Commission Workshop Meeting Minutes — May 14, 2013 Page 2 © Commissioner Koehler wondered if "the end consumer" would be appropriate. He would like to leave "over the counter" out of the definition. Chairperson Daninger stated he would be happy with any of them because all of the three definitions are better than what they already have. Commissioner Koehler stated he would like the definition to be general enough so they do not paint themselves into a corner and he thought common sense prevailed. The Commission decided on the definition of. "Means a business having as its primary function the supply of merchandise, wares and or personal services to the consumer." Andover Definition of Studio: Ms. Hanson thought they should keep the definition and rename it professional studio and delete "or used for radio or television broadcasting" Commissioner Gudmundson wondered if this would change the zone for the use or does it take care of the issues that were discussed at the previous meetings. Commissioner Koehler stated his concern was internet broadcasting. He thought it was limiting because calling out two types of broadcasting was leaving out the internet broadcasting. By taking out the wording it leaves the door wide open for interpretation. He thought they could fall back on common sense because if they try to nail this down, it might take a long time to figure out. Chairperson Daninger asked if they wanted to allow someone the ability to set up a broadcasting booth in their home. Commissioner Koehler stated people are doing that now. Commissioner Gudmundson asked if by allowing this, it would cause interference to others because other businesses do not necessarily interfere with neighbors. There was discussion regarding ramifications associated with radio or television broadcasting in residential zones. Commissioner Gudmundson thought if they left it in the definition it would be allowed in residential zones and could cause problems. Commissioner Koehler thought by leaving the word broadcasting in the definition it would not infringe on anyone's right to free speech. He noted he would be fine with if being removed or left in. The Commission agreed with staff's suggestion by removing "or used for radio or television broadcasting" from the definition. x Andover Planning and Zoning Commission Workshop Meeting Minutes — May 14, 2013 Page 3 ® Rental Business: Ms. Hanson stated part of this has to do with some changes to the table and rental of equipment associated to the primary use of the property. Mr. Carlberg thought it was agreed that it was fine as is in the industrial district but may need to be redefined in other districts. He thought in certain districts interim use may be appropriate. Chairperson Daninger stated his understanding on this item was to change the definition and to change the designation in the neighborhood business and shopping center district having them as interim uses. Mr. Carlberg thought someone could lease a space in a shopping center and have rentals as a business. Commissioner Gudmundson did not think anyone would lease a space in a district that would have an interim use where they would have to come before the City monthly, they would rather have a conditional use permit. Commissioner Gudmundson thought there needed to be a minor change associated "with" the primary use rather that "to" the primary use. Ms. Hanson thought there would need to be two different definitions for this and she would work on this and bring it back for further discussion. Item 107— Single Family Residential Building (Detached) Ms. Hanson stated there was other business dealing with Interim Use on Item 107. Mr. Carlberg reviewed this item with the Commission. He asked if the Commission wanted to be consistent within the districts. Commissioner Holthus asked if staff would like to have this changed to a PUD rather than permitted in M -1 and M -2 and R -5 districts. She wondered if this would make it more restrictive. Mr. Carlberg thought it would be appropriate to put it in those districts. There was discussion regarding examples of PUD review of developments and the control the City would have. The Commission agreed that in Districts M -1, M -2 and R -5 the chart should be changed to PUD. There was discussion on how the City interacts with the Met Council and the requirements made by the Met Council to the City. Commissioner Cleven asked that in the future in the meeting minutes and staff reports to not use "etc.," but to indicate "For other similar items." ADJOURNMENT. Motion by Holthus, seconded by Gudmundson, to adjourn the meeting at 6:51 p.m. Motion carried on a 7 -ayes, 0 -nays, 0- absent vote.
