Councilmembers present: Sheri Bukkila, Julie Trude, and Tony Howard Councilmember absent: Mayor Gamache Also present: City Administrator, Jim Dickinson Community Development Director, Dave Carlberg OTHER TOPICS Community Development Director Carlberg; stated he had recently received inquiries regarding backyard chickens from the Andover Backyard Chicken Group.. There are other communities that allow residents to maintain chickens on urban lots but currently Andover does not. He sent the group information on how to request a text amendment to the City Code. zld address this subject when a formal request is made. Community Development Director Carlberg stated he received a complaint from a resident from the townhomes near Target regarding the noise of the trucks being loaded and unloaded between 4:30 a.m. and 7 :00 a.m. The resident pointed out City Ordinance 12 -13 -9 references noise from loading and unloading activities is prohibited from 7:00 p.m. to 7:00 a.m. if audible in a residential district. The-Sheriff s Office has taken decibel readings and the level is 40 decibels, which is significantly lower than the 75 decibel reading of the traffic on the road. Mr. Carlberg asked the Council if the hours-that are outlined in City Ordinance 12 -13 -9 are reasonable and if they should be reviewed. Mr. Carlberg stated Target has modified its delivery times and loading and unloading activity to accommodate residents but asked if it is unreasonable to expect them to do these activities from 7:00 a.m. to 7:00 p.m. only. Councilmember Trude asked if it was the noise level itself or more the type of noise that was created that the resident was concerned with. Councilmember Bukkila stated all noise is audible to a degree and the layout of an area can impact how the noise is carried. Andover City Council Workshop Meeting Minutes — June 25, 2013 Page 2 1 Community Development Director Carlberg stated the resident wants the City to enforce City 2 Ordinance 12 -13 -9 and not allow any loading and unloading from 7:00 p.m. to 7:00 a.m. because 3 it creates audible noise during these hours. 4 5 City Administrator Dickinson stated the City had talked with another resident in this area and 6 they stated the rumble of the unloading and loading could be heard but it is not as loud as the 7 noise from the traffic. They also stated that the townhomes are adjacent to Target so he would 8 expect to be able to hear some of these sounds. 9 10 Councilmember Trade asked if there is something that could be changed with the dock that 11 would reduce these sounds. 12 13 Community Development Director Carlberg clarified that the resident wants no noise between 14 the hours of 7:00 p.m. and 7:00 a.m. 15 16 Councilmember Bukkila stated that is unreasonable in a business district. The noise level is less 17 than that of a car driving by so the City should not overly restrict this activity. 18 19 Councilmember Trade stated she does not discount that there is noise but she would like a better 20 understanding of what the residents concerns are and look into it to determine if there is 21 something that can be done to resolve the issue. 22 23 Community Development Director Carlberg suggested the City continue to follow the MPCA 24 regulations regarding noise and look at amending City Ordinance 12 -13 -9. Because both 25 regulations are in place the City is expected to follow the most restrictive and that would shut 26 down all activities in the business district from 7:00 p.m. to 7:00 a.m. 27 28 Acting Mayor Knight asked what other communities followed for noise control. 29 30 Community Development Director Carlberg stated most communities have adopted the MPCA 31 standards. 32 33 It was the consensus of the Council to ask City Staff to bring forward a request to amend City 34 Ordinance 12 -13 -9 to comply with the MPCA standards and regulations. 35 36 DISCUSS CITY CODE 12 -12 PERMITTED CONDITIONAL AND PROHIBITED USES 37 38 Community Development Director Carlberg stated the Planning Commission has been working 39 on the City's Land Use Chart for the past year and is requesting the City Council to review. He 40 stated the category M -2, Multiple Dwelling — High Density, would be added to the chart. Line 41 Item 3, Agricultural Uses -urban, is adding it as a permitted use on all residential lots. 42 43 Councilmember Bukkila asked if this would include the City's community gardens. Andover City Council Workshop Meeting Minutes —June 25, 2013 Page 3 Community Development Director Carlberg stated the community gardens are over 5 -acres and Item 3 is for urban agriculture in residential zones. 4 Acting Mayor Knight asked how agricultural uses are defined. Community Development Director Carlberg clarified the difference between the rural agriculture and urban agriculture is determined by the lot size. The intention of the revised land use chart is to promote agricultural uses in the urban areas. 10 Councilmember Bukkila stated the City should not have to list everything that a person could do 11 but rather those things that are restricted. 12 13 Councilmember Trude stated Councilmember Bukkila had a point and the old charts had done a 14 better job. 15 16 Community Development Director Carlberg clarified the changes made to the chart had been 17 done to improve it and make things more clear. The chart now references the appropriate City 18 Codes. Line Item 3 provides more opportunities for residents. 19 20 Councilmember Bukkila stated those things, such as gardens and pools, that are permitted should 21 be pulled out and only those things that are not permitted should be listed. This would make it 22 easier for the average resident to determine what is allowed on their property. 23 24 Community Development Director Carlberg stated the only change to Line Item 5, pertaining to 25 incidental repair, processing, and storage, is the addition of the words "commercial or industrial'. 26 There are no changes to the uses and where it would be permitted. 27 28 Councilmember Trude asked for clarification on why this line item had been added to the chart. 29 30 Community Development Director Carlberg stated Line Item 5 is included to clarify that an 31 incidental use for a business could not become the principle use if it were considered a non- 32 permitted use for that zone. He clarified that incidental uses are permitted as long as they do not 33 exceed thirty percent (30 %) of the floor area of the business. He stated the only change to Line 34 Item 6- antennas in excess of 35 feet in height, is the addition of a reference to the appropriate 35 City Code. 36 37 Councilmember Trude asked if this included short wave radio antennas. 38 39 Community Development Director Carlberg stated there are other provisions in the City Code for 40 those types of things. The change to Line Item 9, pertaining to automotive service stations, is a 41 reference to the appropriate City Code. 42 Andover City Council Workshop Meeting Minutes —June 25, 2013 Page 4 1 Councilmember Bukkila stated she would prefer the have this chart separated into residential and 2 commercial /industrial uses so that it would be easier to follow and understand. Residents are 3 only going to be interested in reviewing those items that will pertain to them and it needs to be 4 easy enough for people to understand. 5 6 Councilmember Trade suggested separating the chart and also grouping items together such as 7 all items pertaining to animals or automotives. She suggested a format similar to the City of 8 Blaine's. 9 10 City Administrator Dickinson stated the chart could be manipulated to achieve what the Council 11 is suggesting. Once the charts are separated then there would most likely be line items that could 12 be removed from each chart. He stated City Code Chapter 12 contains narrative pertaining to the 13 land uses and the chart would be at the end of the section as a reference tool. 14 15 Councilmember Howard stated as a technology driven society the City should be able to offer an 16 interactive tool for both residents and businesses to find those items they are interested in. 17 18 Community Development Director Carlberg asked if the Council would like to continue with 19 using the chart or if they would like to see the information written out in a paragraph format. 20 21 Councilmember Bukkila stated the quick reference of the chart is good to have but she would 22 like to see it in written form as well. Residents should be able to easily find those items that 23 pertain to their property. 24 25 City Administrator Dickinson stated staff could work on the reorganization for a future Council 26 workshop. 27 28 Councilmember Trade stated the language should be standardized or a reference sheet included 29 such as all things pertaining to cars be labeled as either car or automotive or an index that would 30 let someone know if they are looking for car information to see automotive. 31 32 Community Development Director Carlberg stated Bed and Breakfast is a new category and is a 33 permitted use in residential zones R- 1, R -2, R -3, R -4, and R -5. The definition of a bed and 34 breakfast is also included. 35 36 Councilmember Bukkila stated the definition should include the room is rented for money or a 37 fee. 38 39 It was the consensus of the Council to include language pertaining to the rental of the room for a 40 fee in the definition of bed and breakfast. 41 42 Community Development Director Carlberg stated the only change to Line Item 11, bulk fuel 43 storage, is the inclusion of the appropriate City Code reference. Andover City Council Workshop Meeting Minutes —June 25, 2013 Page 5 1 Councilmember Trude asked why bulk fuel storage is a permitted use in the R -1 zone. 2 3 Community Development Director Carlberg stated there are areas of the City that currently have 4 bulk fuel storage and they are zoned R -1. By allowing this as a permitted use in this zone then 5 these areas would not become non - conforming. 6 7 Community Development Director Carlberg stated Line Item 12, business schools, would be 8 deleted and all the colleges, vocational schools, and business schools would be grouped together. 9 10 Councilmember Trude stated there is a difference in the type of school that is operated. A small 11 school that teaches only a few students could operate in a strip mall location but a vocational 12 school that teaches small engine repair should be located in a larger commercial or industrial 13 area. The Blaine City Code does not treat these institutions the same and Andover should review 14 this before grouping them together. She suggested allowing Business schools in the R -1, R -2, R- 15 3, R -4, R -5, M -1, M -2, GR and LB zones. She also suggested the City define a college, business 16 school, and vocational school. 17 18 Community Development Director Carlberg stated these types of schools are being grouped 19 together to consolidate them. 20 21 Councilmember Trude stated she would not want to regulate a small school or small business 22 that teaches a few students out of their home and make them pay a $1,000 fee. 23 24 Community Development Director Carlberg stated that if a large college were to purchase a 25 parcel to build a school or operate a school they would still need to go through the Conditional 26 Use process and meet all of the City's other codes and regulations. 27 28 Councilmember Bukkila suggested regulating the schools based on the number of students they 29 would have. 30 31 It was the consensus of the Council to set Line Item 12 aside and discuss this at a future 32 workshop. 33 34 Community Development Director Carlberg asked if the Council wanted to change "car wash" to 35 "automotive wash" to be consistent. 36 37 It was the consensus of the Council to leave the descriptions as "car wash ". 38 39 Community Development Director Carlberg stated the Planning Commission had concerns and 40 discussions regarding Line Item 18, the sale of Christmas trees. He suggested the Council 41 consider adding language that would allow those businesses that have an approved garden center 42 with a CUP to sell Christmas trees without having to apply for an IUP. He stated a fee schedule 43 for all IUP items would need to be developed. Andover City Council Workshop Meeting Minutes —June 25, 2013 Page 6 1 Councilmember Trude stated she would not recommend the sale of Christmas trees in residential 2 zones. 3 4 It was the consensus of the City Council to change the sale of Christmas trees in residential zones 5 from an IUP to a prohibited use. 6 7 Community Development Director Carlberg stated Line Item #20- churches exceeding maximum 8 up to 45 feet in height, would be changed to #85 and line #20 would be removed. 9 10 Acting Mayor Knight asked if this height would include those buildings that had wind turbines. 11 12 Community Development Director Carlberg stated the City has separate codes that specifically 13 address wind turbines. 14 15 Acting Mayor Knight asked if horses are included in the commercial animal training category in 16 Line Item #23. 17 18 Community Development Director Carlberg stated horses are allowed on parcels that are 2.5- 19 acres or larger and animal training is not permitted on the R -4, R -5, M -1, and M -2 zones. 20 21 Acting Mayor Knight asked if bees are also covered in the City Code. 22 23 Community Development Director Carlberg stated bees are referenced in City Code Title 5 and 24 they have their own code. 25 26 Councilmember Trude suggested that all items pertaining to animals be grouped together for 27 easier reference. 28 29 Councilmember Trude asked if a commercial greenhouse would be a permitted use on lots 30 smaller than 2- acres. 31 32 Community Development Director Carlberg clarified that a commercial greenhouse would be 33 one that brings in products from other sources and sells them, such as a nursery. This does not 34 include those properties that grow their items on their property and sell them, such as those sold 35 at garage sales. There is a property in the R -4 district that is a nursery and sells products. 36 37 Councilmember Bukkila stated a definition of commercial greenhouse should be included. 38 39 Community Development Director Carlberg stated the language for Line Item #26 was cleaned 40 up. He explained the reason this use is listed as a conditional use in the R -1 district is because a 41 portion of Bunker Hills Regional Park is located in the R -1 zone. Line Item #27 and #28 are 42 being combined and changed to a conditional use in the GB, LB, NB, SC, and GR. 43 Andover City Council Workshop Meeting Minutes —June 25, 2013 Page 7 1 Councilmember Trade suggested removing the "not including therapeutic massage 2 establishments." 3 4 Acting Mayor Knight asked if this would cover therapeutic animals. 5 6 Community Development Director Carlberg stated therapeutic massage establishments are 7 covered under home occupation and therapeutic animals are also covered under a different 8 section. 9 10 It was the consensus of the Council to remove the phrase "not including therapeutic massage 11 establishments" from Line Item #27. 12 13 Community Development Director Carlberg stated Line Item #29, commercial riding stables, 14 listed a conditional use in the R -1 district so that Bunker Hills Regional Park would be in 15 compliance. He suggested for Line Item #31, pertaining to the round barn, change it to a 16 conditional use in the M -2 district since the property had been rezoned to M -2. This way the 17 property would not be a non - conforming parcel. 18 19 It was the consensus of the Council to change Line Item #31- related to craft and antique 20 businesses, making it a conditional use in the M -2 district and not permitted in the R -4 district. 21 22 Community Development Director Carlberg stated Line Item #33 -dance halls, and #34- dancing, 23 are being combined to cover restaurants or other establishments with live entertainment. This is 24 in reference to internal entertainment not for outside venues. 25 26 Councilmember Bukkila asked if this line item could be removed. She suggested the City not 27 regulate what occurs inside of a business as long as it is respectable and does not fall under the 28 adult entertainment regulations. 29 30 Community Development Director Carlberg stated the City has adult entertainment regulations 31 that would pertain to these types of businesses. He clarified the Council would like to have Line 32 Item #34 changed to restaurant with live entertainment. 33 34 Community Development Director Carlberg stated Line Item #36 was changed to allow drop in 35 daycare centers as a permitted accessory in the LB, NB, SC, GB, and I zones. 36 37 Councilmember Bukkila asked if this is regulated by the number of children or if these are 38 licensed by the County. 39 40 Community Development Director Carlberg stated State Statute regulates daycare centers. The 41 City has to allow for centers with 12 or fewer children for home occupation daycares. 42 Andover City Council Workshop Meeting Minutes —June 25, 2013 Page 8 1 Councilmember Bukkila suggested having Line Item #37 and #38 as interim uses rather than as 2 permitted uses with a reapplication date of every 5- years. 3 4 Councilmember Trude suggested changing this to a non - permitted use in the multi - family 5 districts. 6 7 It was the consensus of the Council to change Line Item #37 and #38 to interim use and not 8 permitted in the multi - family districts. 9 10 Community Development Director Carlberg stated Line Item #40 refers to the dry cleaning 11 processing not the locations where the items are just dropped off. There use to be concerns with 12 the chemicals involved in dry cleaning but the process now is cleaner. The City has also limited 13 the number of locations that a dry cleaning process center can service to four (4). 14 15 Councilmember Trude stated she would like to change this to a non - permitted use in the 16 shopping center or neighborhood business districts. The City should do more research before 17 changing where this process can occur. 18 19 Councilmember Howard suggested allowing this as a permitted use in the commercial districts. 20 21 It was the consensus of the Council to change Line Item #40 to a conditional use in the GB and I 22 Districts and a prohibited use in the NB and SC Districts. 23 24 Community Development Director Carlberg stated the Planning Commission recommends 25 adding two (2) line items for electrical vehicle charging stations, for commercial and residential 26 use. 27 28 Councilmember Trude stated this is not needed at this time. 29 30 Councilmember Bukkila stated this should be considered a retail service and it would be 31 regulated by other State, County, and City codes. She would not like to see these as a conditional 32 use with a fee but as a permitted use that would be regulated by building codes or service station 33 codes. 34 35 Councilmember Trude suggested staff forward additional information to the Council before these 36 line items are added. 37 38 It was the consensus of the Council to remove the line items referencing electrical vehicle 39 charging stations until the Council reviews additional information. 40 41 Community Development Director Carlberg stated Line Item #41 was changed to include middle 42 and intermediate schools. 43 Andover City Council Workshop Meeting Minutes — June 25, 2013 Page 9 1 Councilmember Trude suggested changing this to pre -K to 12. This would cover all schools, 2 including some daycares. 3 4 Acting Mayor Knight stated daycares are not schools and they are regulated by different codes. 5 6 Councilmember Bukkila asked why there is a line item for schools if they are permitted in all 7 districts. 8 9 It was the consensus of the Council to change the description for Line Item #41 to schools K to 10 12. 11 12 Councilmember Bukkila asked what essential service structures were in Line Item #42. 13 14 Councilmember Trude stated this would be considered part of the utilities and should be covered 15 by Line Items #91 and #92. 16 17 It was the consensus of the Council to eliminate Line Item #42. 18 19 Community Development Director Carlberg stated Line Item #43- related to excavation greater 20 than 400 cubic yards was changed to an interim use so that end dates could be included with the 21 permits. Line Item #48 removed the word "garages" and changes it to "accessory structures ". 22 23 Councilmember Bukkila stated the garages should still be included and listed as part of Line Item 24 #48. 25 26 It was the consensus of the Council to include garages in the description for Line Item #48. 27 28 Community Development Director Carlberg stated driving ranges were removed from Line Item 29 #50 and added to Line Item #49 and putting courses are included with commercial recreation. 30 Line Item #50 would be removed from the list. 31 32 Councilmember Bukkila asked why driving ranges are not considered commercial recreation. 33 34 Councilmember Trude suggested making driving ranges a prohibited use in residential zones. 35 36 Councilmember Bukkila explained that golf courses have driving ranges so they would be 37 included with the golf course category. 38 39 Councilmember Trude stated she would agree with a driving range as part of a golf course in a 40 residential area but she would not like to see a stand -alone driving range in a residential area. 41 She suggested changing the wording to read "golf courses with driving ranges ". 42 Andover City Council Workshop Meeting Minutes — June 25, 2013 Page 10 1 Councilmember Bukkila stated golf courses should not be permitted in the multi - family districts. 2 These areas are designed for higher density and the City needs to have these areas. 3 4 It was the consensus of the Council to combine Line Items #49 and #50 and designate this as a 5 conditional use in all districts. 6 7 Councilmember Trude asked if a business such as Grand Slam would be considered commercial 8 recreation and covered by Line Item #26. 9 10 Community Development Director Carlberg stated this type of business would be considered 11 retail trade and service and covered by other regulations and conditional use permits. 12 13 Councilmember Bukkila stated the City should be more concerned with regulating outdoor 14 activities that impact the City rather than those things that occur inside of a business. 15 Community Development Director Carlberg suggested changing the word for the description for 16 Line Item 927 to include "indoor /outdoor ". 17 18 Councilmember Bukkila asked if this could be separated into two line items; one for indoor and 19 one for outdoor. The indoor could be designated as permitted and the outdoor designated as 20 conditional. 21 22 It was the consensus of the Council to separate Line Item #27 into two line items; one for indoor 23 commercial recreation with permitted use and one for outdoor commercial recreation with 24 conditional use. 25 26 Councilmember Trude asked for clarification on what would be considered clubs or lodges as 27 part of Line Item #21. 28 29 Community Development Director Carlberg stated these would include those organizations that 30 have members such as the Eagles, fraternal or support groups. 31 32 Councilmember Trude stated these types of organizations are generally open to the public and 33 she would like to see this designated as a prohibited use in residential and multi - family districts. 34 35 It was the consensus of the Council to flag Line Item #21 for further discussion at a future 36 workshop. 37 38 The City Council recessed at 8:09 p.m. 39 40 The City Council reconvened at 8:18 p.m. 41 42 Community Development Director Carlberg explained Line Item #51- highway construction 43 materials, was changed from a conditional use to an interim use in all districts. Andover City Council Workshop Meeting Minutes — June 25, 2013 Page 11 1 Councilmember Trude asked why this would be an interim use in all districts. 2 3 City Administrator Dickinson stated construction might occur in any of the districts that would 4 require the storage or processing of highway materials materials. Since this is listed as an 5 interim use in all districts then the City would be notified when it occurs. 6 7 Community Development Director Carlberg stated Line Item #53, hotels and motels, was 8 changed to a conditional use in NB, SC, GB, and I districts. 9 10 Councilmember Bukkila explained she would like to see the chart organized better by categories 11 and subcategories. This would make it easier to find all items pertaining to lodging, including 12 bed and breakfasts, hotels and motels. 13 14 Community Development Director Carlberg stated Line Item #55, interior storage of waste tires, 15 was changed to a conditional use in the LB, NB, SC, GB, and I districts. 16 17 Councilmember Bukkila suggested listing all items pertaining to tires together or to list Line Item 18 #55 as: tires /use — interior and exterior. 19 20 Community Development Director Carlberg stated Line Item #59 was changed to allow for up to 21 two (2) persons. 22 23 Councilmember Trude stated the word "borders" should be changed to boarders ". 24 25 Acting Mayor Knight asked why the City is regulating this item. 26 27 Councilmember Bukkila stated if a family decides to rent to a friend that has two (2) children 28 then this would be considered a code violation but a family who has 12 children would not be in 29 violation of the code. She stated she does not agree with this and the Council should review it. 30 31 City Administrator Dickinson stated the language used is standard language. There would not be 32 a problem unless there were complaints and this does exclude family members as defined by the 33 City. If there are more than a couple of rooms rented then the property should really be 34 considered a rental property. 35 36 Councilmember Trude stated the City should also define boarders. The City has had this 37 regulation in place since 1970 and there have been no complaints. She suggested leaving the 38 description in place. 39 40 Councilmember Bukkila suggested language be added that excluded minor children and add the 41 term adult. 42 43 Councilmember Trude suggested changing it to read no more than two (2) family units. Andover City Council Workshop Meeting Minutes — June 25, 2013 Page 12 1 2 It was the consensus of the Council to leave Line Item #59 as it is currently written and to 3 monitor and address in the future if problems arise. 4 5 Community Development Director Carlberg stated in Line Items #60, #61, #62, and #63 -all 6 related to animals, the phrase "keeping of was removed and additional clarification regarding 7 the acreage requirements was added. 8 9 Councilmember Trade stated Line Item #63 should be changed to "with neither municipal sewer 10 or water ". 11 12 It was the consensus of the Council to continue discussions on the Land Use Chart at a future 13 workshop, starting on Line Item #70- manufactured homes. 14 15 Councilmember Trade suggested staff move forward with the interim use permit process. 16 17 Councilmember Bukkila stated she would like to see the chart reorganized for the next 18 workshop. 19 20 Councilmember Trade stated portable classrooms should be an interim use and not a conditional 21 use. 22 23 2014 -2018 CIP DISCUSSION & 2013 CIP PROGRESS REPORT 24 25 City Administrator Dickinson reviewed the CIP progress report provided to the City Council. He 26 stated there are concerns with the 2013 roof replacements under facility management. After 27 farther evaluation it was determined that the City Hall roof is in greater need of repair than 28 originally budgeted for. If the roof replacement for City Hall exceeds budget then the roof for 29 Fire Station #2 would be done at another time. 30 31 Councilmember Trade asked if there would be soundproofing or insulation added to the Council 32 Chambers. 33 34 City Administrator Dickinson stated this would be an additional cost but staff could look at 35 options to have this done on the interior of the building. He explained the City Council would be 36 discussing the Parks CIP at the next workshop. 37 38 City Administrator Dickinson stated the sidewalk along Quinn Street would be difficult to do and 39 may be more costly than originally thought due to the grade and number of utilities present. 40 41 Councilmember Trade asked if a 3 -foot sidewalk would be better in this area instead of the 42 standard 5 -foot. The 2 Council discussed moving the sidewalk adjacent to the curb. City Administrator Dickinson 3 stated a request ordering the project would be included on the next City Council agenda. 4 5 Councilmember Trude stated having a sidewalk would be better than none and she would agree 6 with moving the sidewalk adjacent to the curb. 7 8 Councilmember Trude asked staff to look at the Hidden Creek Park and consider mowing the 9 Bunker Lake Boulevard area. 10 11 Councilmember Howard stated the boulevards along Hanson Boulevard look bad on the eest 12 side. He asked if this could be mowed to the fence. 13 14 City Administrator Dickinson stated the County is responsible for mowing along Hanson 15 Boulevard but staff could talk to them. 16 17 Councilmember Trude stated she would like to have Hanson Boulevard added to a future agenda 18 for discussion by the City Council. Councilmember Trude stated the fences and properties along 19 this street are not being maintained properly. 20 21 Councilmember Bukkila stated the problem with fences wais not just along Hanson Boulevard 22 but throughout the City. 23 24 2014 BUDGET DEVELOPMENT DISCUSSION 25 26 City Administrator Dickinson stated the preliminary Anoka County Assessor taxable market 27 value figures for Andover had been 4.4% decrease but this figure has been updated to a 2.9% 28 decrease in total taxable market value. He stated the fund balance at the end of last year was 29 close to 56 %. The staffing requests received include a new hire for the fire department and a 30 new hire for public works. The recently added Building Official could function as a building 31 inspector and fire inspector. He also stated staff is reviewing cost of living increases and this 32 will be discussed at a future workshop. The City will have its mid -year health insurance review 33 and the results will be brought to the Council at a future workshop as well. Staff is currently 34 working on the Sheriff s contract. The City would like to keep it status quo and the Sheriff 35 Department is requesting a 2.27% increase. They have stated their health insurance costs have 36 risen 8% but a recent Anoka Union article disputes this. 37 38 Councilmember Trude asked if Laura Landes is still working with other cities and if the portion 39 that Andover pays for her services is still acceptable. 40 41 City Administrator Dickinson stated even when Ms. Landes is unable to handle something 42 directly there are others that have helped the City. Ms. Landes still does work with the 43 neighborhoods to resolve problems before they escalate to the City level. He stated assessment rates might need to be reviewed by the City Council. Councilmember Bukkila stated City Engineer Berkowitz had told the Council the City is not where it should be with road repair and maintenance. She asked if this was still an accurate statement. City Administrator Dickinson stated the City has fallen behind, especially with crack fill and seal coating. MnDOT has been evaluating products for seal coating and once a new product has been identified then the City will again move forward with these projects. 2013 BUDGET IMPLEMENTATION GENERAL FUND BUDGET PROGRESS REPORT — MAY 2013 City Administrator Dickinson reviewed the 2013 general fund budget progress report. Councilmember Bukkila asked why the assessing budget under general government was at 95 %. City Administrator Dickinson clarified this had to do with the timing of when the contract payment was made this year. City Administrator Dickinson stated the City had budgeted for 35 new homes this year and the total so far is 65. He explained the City might not have this type of growth next year. Hickory Meadows may not open a second addition due to the soil borings it received. He also stated the development the City has been working on is reaching the 120 day deadline and the developer may not grant an extension. The City will need to determine if the project will be approved or denied. If the project is denied then he would not be able to reapply for 1 -year. If the City decides to approve the project there will be several conditions that will need to be met. Councilmember Howard asked what could be done to entice the Holasek's into discussions regarding the development of their property. City Administrator Dickinson stated they are currently in discussions with developers and have one of the properties listed with a broker. MAY 2013 CITY INVESTMENTS RE VIEW City Administrator Dickinson stated a summary report of the City Investment Portfolio to the Governing body is a recommended practice and often viewed positively by rating agencies. PRESENTATION— CROOKED LAKE AREA ASSOCIATION Mr. Dan Anderson, Crooked Lake Area Association, made a presentation to the Council regarding recent Crooked Lake activities, thanked the Council for the city contribution toward milfoil treatment and reviewed the mission of the organization. The Council thanked Mr. Anderson for the presentation. DISCUSS /APPROVE ASSESSMENT ABATEMENT RESOLUTION 2619 & 2623 138TH AVENUE NW Mr. Dickinson explained Gloria and William Fink had sold their property on a contract for deed in 2004. The new owners had requested to be hooked up to city water in late 2010 and the water main area and connection charges were assessed in 2012. Since then the property has yet to be hooked up. The new owners defaulted on the contract for deed and the property has been returned to the Finks. The Finks have no intention to hook -up to city water and have asked to process an abatement of the special assessments and for the City to refund the previous paid assessments (two years) less city expenses. It should be noted that the Finks have been making the payments related to these special assessments. Councilmember Trude asked for confirmation that there was no hook -up. Mr. Dickinson stated that is correct. DISCUSS /APPROVE RESOLUTION CONCERNING COMMENCEMENT OF RENEWAL PROCEEDINGS UNDER THE FEDERAL CABLE ACT Mr. Dickinson stated Cable Television Franchisee Comcast of Minnesota, Inc. submitted notification of the franchise renewal process and its intent to renew the franchise with the Quad Cities Cable Communications Commission member cities, which includes Andover. Mr. Dickinson reviewed the staff report with the Council. Councilmember Trude stated she would like to move this forward. She explained the plans that QCTV is working on for future access and cable presentation. She thought QCTV was moving in the right direction. Motion by Bukkila, Seconded by Howard, to approve Resolution R060 -13, "A Resolution Concerning Commencement of Renewal Proceedings Under the Federal Cable Act". Motion carried unanimously. SCHEDULE JULYEDA WORKSHOP MEETING Mr. Dickinson requested the Council schedule an EDA Workshop Meeting to discuss topics as detailed in the staff report. The Council asked if this could be scheduled for another night. Mr. Dickinson indicated he would find a new night and bring it back for the Council to approve on July 16th. The Council thought the meeting could be held on July 23`a at 4:00 p.m. or 4:30 p.m. before the Council Workshop, if possible. SCHEDULE AUGUST EDA MEETING Mr. Dickinson requested the Council schedule an EDA Meeting to discuss topics as detailed in the staff report. (Library on the Go) Councilmember Trude stated Library on the Go will be at the Andover Fun Fest along with close to a hundred crafters at the Community Center. DISCUSSION During the summer of 2012, South Coon Creek Drive NW was reconstructed. In accordance with the Roadway Reconstruction Assessment Policy, twenty -five percent (25 %) of the total project costs are being assessed to the benefiting properties. The total project costs used for the assessment calculations exclude the following items: • Water main costs (Trunk Water Fund and assessable water stub costs) • Sanitary Sewer costs (Trunk Sewer Fund, will be assessed back to future developer) • Bridge Scour protection (Road and Bridge Fund) • Extra Depth and Width of pavement over standard City section (Road and Bridge Fund) The project was divided into rural and urban areas for purposes of the assessment calculation breakdowns. As a part of this project, residents without existing water service were provided the option of extending a water service stub to their property for potential future hookup. Eleven properties petitioned the City for extension of a water service stub to their property with the actual costs of the hookup to be assessed to them accordingly. The following table depicts the assessable costs, feasibility assessment amount per unit, actual assessment amount per unit for the urban and rural areas, and actual assessment amount per unit for the water service stubs. The developer is proposing the revised preliminary plat/PUD to change the style of housing from attached twin home units to single family houses /units because the change in the real estate market over the past few years supports the sale of single family homes. The easements will meet the width requirements in City Code and will provide sufficient area for drainage and utilities. Landscaping Plan The attached landscaping plan illustrates the planting screen from the Burlington Northern Railroad that was approved as part of the original plat and PUD. The plan requires the planting of sixty -five (65) 8' — 10' white pines along the eastern property line. In addition to the white pines, the original landscape plan included various plantings for each of the twin home sites. Staff is recommending the white pines be planted to screen from the railroad. Staff has determined that the white pines can be planted within the 10- foot drainage and utility easement on the furthest most eastern portion of the lots. This has been added as a condition of approval in the attached resolution. Homeowner's Association A Homeowner's Association was created to maintain the landscaped areas (lawn service, irrigation, snow removal, and plantings) and exteriors (gutters, roofing, and siding of the twin homes). Of the 18 lots, the developer owns 12 lots and 6 lots have been purchased in which twin homes have been constructed that are part of the homeowner's association. According to the Common Interest Community Number 221, Country Oaks West Townhomes Declaration, written consent of the Eligible Mortgagees representing at least sixty -seven (67%) percent of the Lots that are subject to first mortgages, (based upon one vote per first mortgage owned) shall be required to abandon or terminate the common interest community, subject to any greater requirements contained in the Act. In addition, the Articles of Incorporation of Country Oaks West Townhomes Association, Inc. Article VII Dissolution states This Association may be dissolved with the assets given in writing and signed by owners representing units to which at least eighty (80%) percent of the votes are allocated and eighty (8001o) percent of the first mortgages of units, (each mortgage having one vote per unit finances). Mr. Wold has made contact with the current twin home owners to discuss the options of either the dissolution of the homeowner's association or for the remaining 6 homeowners to be responsible for the existing association or form an association of their own. It is the understanding of staff that Mr. Wold is working out the details with the homeowners to dissolve the association. If City Council makes a motion to approve the revised preliminary plat/PUD amendment, staff recommends that a condition be included that requires the developer to have come to a decision regarding the future of the existing Homeowner's Association prior to the submittal of the final plat. Conformance with Local Plans and Ordinances 1. The property is located in the Metropolitan Urban Service Area (MUSA) and within the current stage of sewer expansion. 2. The property. is currently zoned M -1, Multiple Dwelling Medium Density. 3. The proposed project requires Planned Unit Development Review to establish standards unique to this development. The Planning Commission is asked to review the proposed P.U.D. based on City Code 13 —3, "Planned Unit Development. " City Code 13 -3 -11 identifies Desirable PUD Design Qualities that are sought in any PUD proposal. These qualities are listed below. A. Achieves efficiency in the provision of streets and utilities and preserves area to achieve the elements of design qualities described in this Chapter. B. Provides convenient and safe access for vehicles and pedestrians and all types of activity that are anticipated to be a part of the proposed development. C. Provides a buffer between different uses, adjacent properties, roadways, between backyards of back -to -back lots. D. Preserves existing stands of trees and/or significant trees. E. Provides considerable landscaping treatments that compliment the overall design and contribute toward an overall landscaping theme. F. Preserves significant usable space on individual lots or through the provision of open space within the development. G. Provides an attractive streetscape through the use of undulating topography, landscaping, decorative street lighting, decorative mailbox groupings, retaining walls, boulders, fencing, area identification signs, etc. H. The proposed structures within the development demonstrate quality architectural design and the use of high quality building materials for unique design and detailing. I. The lasting quality of the development will be ensured by design, maintenance and use guidelines established through an owners association. Planning Commission Recommendation The Planning Commission recommended approval with additional conditions for City Council to take into consideration: 1. Additional tree planting should be required along the eastern property line of the single - family lots to tie into the existing tree plantings on the twin home lots. 2. The developer should be responsible for the separation of the existing irrigations systems for the twin homes. 3. The expense of title work for the twin home owners should be taken on by the developer. 4. Developer should have some sort of arrangement of the responsibilities of the dissolution of the Homeowner's Association. WHEREAS, the applicant has requested a variance to City Code 11 -3 -3G. to exceed the 500 foot maximum cul -de -sac length, and; WHEREAS, the Planning Commission recommends approval of the variance based on the finding that wetlands to the west, a railroad to the east and no involvement from properties to the north prevent another street connection at this time. Additionally, there is potential for the collector street to continue north and eliminate the variance in the future. City Planner Hanson noted the purpose of this item is to hold a public hearing and take input on the revised preliminary plat and Planned Unit Development (PUD) of Country Oaks West 2nd Addition, Block 1, Lots 12 -23. City Planner Hanson reviewed the proposed preliminary plat with the Commission. Commissioner Nemeth asked if the tree line will interfere with the utility easement. Ms. Hanson indicated it would not. Commissioner Nemeth stated the property is currently zoned M -1, Multiple Dwelling, medium density so would that area need to be rezoned. Ms. Hanson indicated it would not need to be rezoned because single family is allowed as a part of a PUD. Commissioner Nemeth asked if there is an approval process that needs to be done by the City in order to disband an association. Ms. Hanson stated there is a process that would need to be followed for disbanding it and the City Attorney would be involved in it. Mr. Carlberg stated it comes down to if the entire association would be disbanded or would the association be restructured. Commissioner Peterson stated the lot width was seventy -five feet for the proposed homes and he wondered if this was a sufficient lot width. He thought the other lots in the development were eighty- ninety feet. Ms. Hanson thought seventy -five feet was sufficient, the developer would be able to meet setback requirements for the home. Commissioner Peterson asked what the benefit is to the City for making the change in the PUD, if any. Ms. Hanson stated with a PUD the design criteria for the original PUD with Regular Andover Planning and Zoning Commission Meeting Minutes —May 14, 2013 Page 6 the twin homes was architectural and landscaping design and these two design criteria would also be in place with the single family home. Commissioner Gudmundson asked if these are twin homes and not townhomes. Her concern would be for those people who already own them, if in the future they do not get their legal description correct they would be in for a very expensive issue. She wondered if there are common elements how that will get divided. Mr. Carlberg stated the developer will need to engage the three existing buildings or units and make some determinations on that association, dissolving it and are they going to want to remain so they can take care of their comment elements. There needs to be some additional discussion between the developer and property owners Commissioner Holthus asked if there was a fence between the houses and railroad tracks. She indicated she would like to see fencing as part of the plan because these are starter homes with lots of kids. Ms. Hanson did not believe there was fencing proposed throughout the development. Commissioner Gudmundson asked if there was any feedback from the other six owners. Ms. Hanson indicated she has not heard from any of the owners. Motion by Holthus, seconded by Gudmundson, to open the public hearing at 8:12 p.m. Motion carried on a 7 -ayes, 0 -nays, 0- absent vote. Mr. Scott Wold, JABBS Development, was at the meeting to answer questions. He made a presentation to the Commission. There was discussion regarding the problems with the association and how Mr. Wold was caring for the open area of the development. Commissioner Nemeth asked if these types of designs in the packet what will be used as the standard design. Mr. Wold stated these are typical of what has been built in the development previously. These will be City standard. Commissioner Peterson asked what the price point will be for the homes. Mr. Wold thought they would start at $215,000 and run over the $300,000. Commissioner Peterson asked if the trees that are already planted in the utility easement. Mr. Wold stated they butt right up to the gas line easement. Ms. Hanson stated it was her understanding the trees were planted on the western side of the pipeline and the new trees will be planted on the eastern side of the pipeline. Chairperson Daninger asked what the benefit of the City would be. Mr. Wold stated the benefit to the City would be a built up neighborhood where taxes will be paid by owners. He thought it was a benefit to build out the property and people living there now were hoping to have homes built to screen their homes from the railroad tracks. He hoped that made sense to do this. He was concerned they might create a real issue without knowing how the issue with the association is going to be resolved before they resolve something. He thought there were more shared things besides landscaping needs such as roofs, driveways, siding and they need to figure out how to deal with those. Chairperson Daninger was concerned with single - family homes being built along the railroad tracks because of possible small children. Motion by Koehler, seconded by Gudmundson, to close the public hearing at 8:41 p.m. Motion carried on a 7 -ayes, 0 -nays, 0- absent vote. Commissioner Peterson stated they needed to add another requirement of extra trees to blend the two tree lines together. He would also like to see a fence being installed. Commissioner Holthus indicated a fence is very important to her at the back of the lots because there are a lot of kids in the neighborhoods and the railroad track is right there and very dangerous. Ms. Hanson indicated the fence can be placed on the property line except where the pipeline crosses, no fence could ever be built there. Commissioner Gudmundson indicated there are a lot of homes in Andover along the railroad tracks and they have never required fences to be installed before for them. She felt the trees would be an adequate barrier. She would like to see the irrigation issue added and thought the developer should take care of that and make sure each individual property is up and running on their own. She thought that punishing the six people that own houses there now is not good and they should not allow that to happen. The City should also make sure that they have correct ownership rights. Chairperson Daninger thought whatever needs to be done, needs to be defined before he can approve this. He stated there are so many little details that he was not even sure what should be added. Commissioner Koehler suggested those issues, irrigation and roof and maintenance, be addressed but he suggested they detail those out as two separate points. Chairperson Daninger thought a condition in the motion should read "any issues dealing with the homeowners association need to be resolved." The Commission agreed. Motion by Holthus, seconded by Peterson, to recommend to the City Council accepting the revised preliminary plat with the following additions: 1. Suggested change in the landscaping plan 2. Addition of a low maintenance chain link fence to follow the line of the train tracks 3. There should be an arrangement of the responsibilities of the dissolution of the Homeowners Association 4. Further Discussion: Commissioner Koehler asked if they wanted to hold the developer responsible for splitting out some of these things for people who have not been paying their bills because he has already been covering them and now the City is asking him to pay to split them out and put in an irrigation system for them when they have not been holding up their end of the agreement. He can see the developer being held to split this out because the owner had an expectation when they bought the home but the developer had an expectation that they were going to pay the homeowners dues and some of them have not. He did not feel this was fair. Commissioner Gudmundson thought that the developer could take legal action on his own if he needed to. Commissioner Nemeth did not think a fence would be needed because the trees grow quickly and it would become difficult for people to get past the trees to the railroad tracks. Commissioner Gudmundson agreed. Commissioner Cleven concurred. Commissioner Koehler felt the fence was overkill. Mr. Wold stated when dealing with single - family homes some will want fences and some will not. Some will want chain link, some will want wood and some will take the fence down. He stated because these are single - family homes he cannot enforce fencing to remain. Chairperson Daninger thought an alternative may be to place a berm along the railroad tracks. Commissioner Holthus indicated she would not want to amend her motion. Motion failed on a 3 -ayes (Holthus, Koehler, Peterson), 4 -nays (Nemeth, Gudmundson, Cleven, Daninger), 0- absent vote. Commissioner Cleven stated he did not see the need for a fence and a fence cannot be built in the easement so the fence would be built right next to the trees and he felt it was not needed. Another issue he has with the proposal is dealing with the law aspects of legalities and he thought they were trying to dictate things the association should be taking care of Chairperson Daninger stated he did not have enough information to make an informative decision on this. There is not enough here for him to agree to change the PUD. Commissioner Gudmundson stated they are getting something because they will be getting the development done sooner than later. Community Development Director Carlberg reviewed the proposed Preliminary Plat/PUD Review with the Commission. Commissioner Gudmundson asked for clarification on the process. Mr. Carlberg reviewed with the Commission the process the City will take regarding this plat. Commissioner Gudmundson asked if there has been any interest from builders the way it is platted for townhomes. Mr. Carlberg indicated there has not. He noted that the EDA has had this on the market for over a year and a half in the 8- plex/4 -plex concept. There is not a market for this type of design at this time. He also noted that mailings to adjacent property owners were sent out and no one had any issues with what was being proposed. Commissioner Nemeth thanked staff for providing the sketch plan. He stated in regard to confirming with local plans and ordinances, the property is located within the MUSA area and it says it is within the current stage of sewer expansion, he was under the assumption that the area already had sewer. DATE: July 16, 2013 REQUEST The City Council is requested to review and approve an amendment to the City Code 12- 13- 9(A)(3), Hours of Loading and Unloading and City Code 5 -6 -2, Noises Prohibited. The Commission is also requested to seek public input by holding a public hearing on the proposed amendment in accordance with Section 12 -14 -8 of the City Code. BACKGROUND A recent noise complaint related to nighttime unloading activities at the Target Store from a resident in the neighborhood located south of the store and across Station Parkway has caused the City to review and evaluate the City Code related to the hours of loading and unloading activities. City Code 12- 13 -9(A) (3), Hours Of Loading And Unloading states, Where noise from loading or unloading activity is audible in a residential district, the activity shall terminate between the hours of seven o'clock (7:00) P.M. and seven o'clock (7:00) A.M. The issue is the vagueness and subjectivity of the term "audible ". The current procedure of the City upon receiving a noise complaint is to have the Anoka County Sheriff's Office conduct sound testing in the area of the complainant /receiving property to determine the decibel level of the sound. Once those readings are received, Staff applies those to the levels defined in City Code 5 -6 -4 as stated in the table below. These noise standards are consistent with the standards of the Minnesota Pollution Control Agency (MPCA). 5 -6 -4: RECEIVING LAND USE STANDARDS: A. No person shall operate or cause or permit to be operated any source of noise in such a manner as to create a noise level exceeding the limit set in Table 1 for the receiving land use category specified when measured at a point of normal human activity of the receiving land use. L50: A sound level, expressed in decibels (dBA), which is exceeded fifty percent (50 %) of the time for a one hour period, as measured by a sound level meter having characteristics as specified in the latest standards, S1.4, of the American National Standards Institute and using generally accepted test procedures adopted by the MPCA. If the noise levels exceed these standards, the City will cite the owner of the property. In the case of the Target Store noise complaint, the sound testing results showed a reading of 40 -45 decibels during the nighttime hours which are below the threshold for nighttime noise standards. However, in applying the strictest interpretation of City Code 12- 13 -9(A) (3) related to the unloading activity being "audible" in a residential district, Target Store is in violation of the Code. City Code 5- 6 -2(E), Noises Prohibited, states as follows: No person shall make or cause to be made any distinctly and loudly audible noise that unreasonably annoys, disturbs, injures, or endangers the comfort, health, peace, safety, or welfare of any persons or precludes their enjoyment of property or affects their property's value. The general prohibition is not limited by the specific restrictions of the following: E. Loading, Unloading, Unpacking: No person shall create loud and excessive noise in loading, unloading, or unpacking any vehicle. The proposed amendment would tie the decibel levels in City Code 5 -6 -4 to this section of the Code in an effort to set a measurable standard for hours of loading and unloading activities. It should be noted that the City Code is being re- evaluated not only due to the unloading activity at the Target Store, but also to loading and unloading operations of several businesses that could and will be impacted by strict interpretation of the current Code. This would also include businesses that do not have a defined loading and unloading area where they receive deliveries at the front of the store or may even be loading a customer's vehicle that could be audible from an adjacent residential area. PLANNING COMMISSION RECOMMENDATION The Planning and Zoning Commission held a public hearing at their July 9, 2013 meeting and upon taking public testimony recommends to the City Council the approval of the attached ordinance amendment to City Code 12 -13 -9 and 5 -6 -2 as modified by the Commission at the meeting. D. Defective Vehicles Or Loads: No person shall use any vehicle so out of repair or so loaded as to create loud and unnecessary grating, grinding, rattling, or other noise. E. Loading, Unloading, Unpacking: No person shall create loud and excessive noise in loading, unloading, or unpacking any vehicle in excess of the standards provided in Section 5 -6 -4 of the Cites F. Radios, Phonographs, Paging Systems: No person shall use or operate or permit the use or operation of any radio receiving set, musical instrument, phonograph, paging system, machine, or other device for the production or reproduction of sound in a distinctly and loudly audible manner as to unreasonably disturb the peace, quiet, and comfort of any person nearby. Operation of any such set, instrument, phonograph, machine, or other device between the hours of ten o'clock (10:00) P.M. and seven o'clock (7:00) A.M. in such a manner as to be plainly audible at the property line of the structure or building in which it is located, in the hallway or apartment adjacent, or at a distance of fifty feet (50'), if the source is located outside a structure or building, shall be prima facie evidence of a violation of this section. G. Noisy Parties Or Gatherings: When a police officer determines that a gathering is creating an excessive noise disturbance, the officer may order all persons present, other than the owner or tenant of the premises where the disturbance is occurring, to disperse immediately. No person shall refuse to leave after being ordered by a police officer to do so. Every owner or tenant of such premises who has knowledge of the disturbance shall make every effort to see that the disturbance is stopped. H. Mr. Dave Whitney, 1902 135`h Avenue NW, stated this issue does not necessarily impact him but there are a number of other neighbors that are impacted by the noise. He noted the incoming Wal -Mart could pose issues with noise in that area. Mr. Whitney explained he was a truck driver and knows what kind of noise the trucks can make. He reviewed the different types of noise being made. Ms. Hanson stated regardless of whether the windows are open or not she hears the noise. This is a year round noise they have to put up with. Commissioner Koehler stated in the letter, Attachment A, there is not one city listed that states anything audible and there needs to be some balance. He did not know of any other recommendation other than the one put forth by a national organization. There has to be some guideline and not just what I can hear and what you can here. Commissioner Nemeth stated other than the time, he was not an expert regarding decibel levels but would suggest changes be made to some of the decibel levels. Mr. Carlberg stated the levels are MPCA standards and he would suggest they City not change them as they are widely used and recognized. Commissioner Cleven stated the standards being used are nationally recognized and the levels they have are considered to be within boundaries. The issue with noise they are talking about seems to be with trucks dropping their trailers. He thought if the noise persisted for more than six minutes, the resident should call the sheriff to have the offender cited. Commissioner Peterson thought in the future with development next to commercial areas they should consider buffering for noise. Mr. Carlberg indicated they do take a decibel reading at the property line of the receiving property. Commissioner Koehler asked if staff knew the details of the Anoka County Sheriff's report on the decibel levels. Mr. Carlberg stated a deputy of the Sheriff's Office came out on two different nights and took readings for at least an hour in order to get accurate readings. Motion by Koehler, seconded by Cleven, to recommend to the City Council approval of the Zoning Text Amendment including the change in time to 10:00 p.m. to be consistent with Title 5 and Title 12. Carlberg July 9, 2013 Community Development Director David Carlberg and the entire Planning & Zoning Commission of the City of Andover — this is being submitted in reference to the Notice of Public Hearings and ask that it be made part of Public Record. I would like to go on record stating that I am strongly against the proposed City Code Amendments (to Title 5 & Title 12); and feel that the changes would not benefit the Residents of Andover as it will not enhance the quality of its citizen's lives and will not promote quite neighborhoods — it quite frankly goes against the City of Andover's Vision statement'. I do not feel it is unreasonable for the area businesses to be expected to follow the City Code — as written, by having a designated time in which nearby resident's (and most likely customers of their businesses) can actually have a break from the excessive noise and get some quality sleep. It should be noted that other neighboring Minnesota and Wisconsin communities2, such as Bloomington, Cambridge, LaCresent, Robbinsdale, and Roseville have similar Codes to Andover's existing Code, which gives the appearance that the existing Code isn't unreasonable; and that businesses in those communities can be successful without causing such unreasonable disturbances. I am a newer resident of Andover; and these proposed changes appears to be the result of an inquiry regarding the noise caused by the neighboring business activity occurring outside of the existing City Code 12 -13 -9 "Off Street Loading & Unloading Areas." Item 4t3 currently requires "Where noise from loading or unloading activity is audible in a residential district, the activity shall terminate between the hours of seven o'clock (7:00) P.M. and seven o'clock (7:00) A M ". The inquiry was made in order to ensure the neighboring Businesses (Target) would be expected to follow the existing City Code; however, the Planning & Zoning Commission has taken it upon itself to re -word the Code rather than deal with the continued violations. Although the Commission believes the revisions would more accurately reflect how it was "intended to be interpreted "; however, the Residents believe this is to appease Big Business and would cause a decrease in the quality of our lives and a decrease in our property values if businesses were allowed to continuously disturb its residents at all hours of the night. More specifically, the noise caused by the loading and unloading of tractor - trailers is inhumane when it occurs in the middle of the night (e.g. 11:47 pm, 12:10 am, 4:10 am, 4:40 am, 5:30 am, 6:33 am), and without a minimum of eight hours in- between one night and the next morning. It is not sufficient for the Commission to just change the Code's language, when they are without first -hand knowledge of what the Residents have been subjected to while Big Business violates existing ordinances. I am requesting that the Commission either leave the Code, as written, and enforce it, or go back to the preverbal drawing -board and come -up with a more viable solution, but not without true consideration for all of the Residents of Andover. (referred to as "nighttime hours ") shall meet the following standards: (1) Off- street loading and unloading during nighttime hours shall take place within a completely enclosed and roofed structure with the exterior doors shut at all times. 1011.12 Additional Standards for Specific Uses in All Districts — E — (1)(b) Traffic: The site plan shall provide vehicular circulation routes away from residential areas and avoid commercial vehicle ingress and egress from local residential streets to commercial property sites. In the site plan review and approval process, every reasonable effort must be made to design the site circulation so that service vehicles over 1 ton capacity do not use routes which bring vehicles between a building and a residential district boundary. The site plan shall also provide pedestrian access routes using walks or paths, including where practical, connections to adjacent residential areas. Service vehicles over 1 ton capacity which enter or exit the site between the hours of 10:00 P.M. and 7:00 A.M. shall use a designated route approved by the City. Deliveries and /or delivery truck access, in and on the site during the hours of 10.00 P.M. to 7:00 A.M., shall be limited to single unit, 2 axle vehicles not in excess of 26,000 pounds gross weight. The designated route shall keep vehicles at least 300 feet away from any residential district boundary, or be completely screened by a building, wall, landscaped berm, fence, or combination thereof to a point 14 feet above the ground at the outside edge of the truck route lane and to a point 5 feet above the first floor (main level) of the adjacent residences. (f) Off - Street Loading: Off - street loading shall be as listed in Chapter 1019 (Parking Area Use) of this Title and servicing space shall be designated for each store unit in the shopping district. Such loading space shall be designed so as not to conflict with movement of vehicular traffic to and from parking areas. (ii) Any commercial loading dock within 300 feet of a residential district which is to be used for any reason by vehicles or equipment between the hours of 10:00 P.M. and 7:00 A.M. shall be within a completely enclosed and roofed structure. All loading and unloading operations shall occur with the exterior doors shut at all times.
