Summary Budqet Format for Residents
On November 10th, Anoka County mailed the a generic notice of
proposed property tax for 1991. This notice was required under
the truth-in-taxation law. As property owners within the city,
you all should have received this notice.
Attached you will find a summary budget that is being provided to
residents who request a copy of the budget. It includes the
General Fund, the Certificate of Indebtedness Fund and a
reconciliation of the budget to the proposed tax levy.
Please let me know if you have any comments on this form.

MINUTES
A Special Meeting of the Andover CIty CouncIl was called to order by
Mayor Jim Elling on November 8, 1990; 7:00 p.m., at the Andover
City Hall, 1685 Crosstown Boulevard NW, Andover, Minnesota.

CANVASS ELECTION RESULTS
DIscussion was on the procedure for the requested recount for a
Council seat. Ms. Volk stated the results of Tuesday/s election are
to be certIfied thIs evening, and the results of the recount will have
to be certified at another meeting. Ms. West also suggested
addItIonal votIng booths be purchased. prIvacy screens be provided.
and at least two more election Judges be hired in her precinct. There
was some dIscussIon on raisIng the pay for Judges, getting more
Judges, and on adding more precincts.
Mayor Elling suggested the matter of additional votIng booths and
screenIng be added to the next Council agenda.
MOTION by Jacobson, Seconded by Perry, the ResolutIon as presented.

electIon held on the 6th day of November. 1990, In the CIty of
Andover. Mayor - Ken Orttel; Councilmembers - Marjorie Perry and Jack
McKelvey) Motion carrIed unanImously.
AWARD BID/FUEL TANKS
Mr. Stone reviewed the bIds receIved for the underground fuel tank
that wIll meet State and Federal codes. Money could be saved by
droppIng the double-wall tank; ;however, it Is felt that wIll become
mandltory in a few years anyway. The card system is extra, but he
felt It Is necessary to be abie to determIne who Is usIng the gas and
fuel. The system also computes any movement in the tanks, including
leaks. '

DIscussIon was on the cost of thIs proposal for the City to have Its
own fuel tanks versus buying gas from the local gas stations. Mr.
Stone felt the CIty has better control over how much and what goes
Into theIr equIpment. It Is also very inconvenient to get some of the
equipment to a gas statIon, and the blend of dIesel fuel used by the
City Is not always avaIlable at servIce statIons. The Clty/s cost for
bulk fuel is approxImately 35 cents per gallon less than at service
statlons.

CouncIl then dIscussed the fInancing proposal as suggested by Mr.
Stone: $15,000 budgeted under "PublIc Works BuIlding", bondIng for
$15,000, $8,000 remaIning from the Vacal unIt, and $5,150 from the
moneys left over from the 1979 FIre Department/PublIc Works BuIldIng
Bond. It was felt that this would be an appropriate use of the money
left over from the 1979 publIc safety bond sInce both PublIc Works and
the Fire Department will benefit from it.
Mr. Stone also noted the cost of removIng any soil contamInatIon Is
extra. However, there shouldn't be any contamination because the
existIng tanks are only ten years old and should not be leakIng.
MOTION by Jacobson, Seconded by Perry, authorize the Staff to draw a
ResolutIon authorizIng the transfer of approxImately $5,150 out of the
PIR Fund to be applIed to the purchase of a fiberglass tank and the
pIpIng system for PublIc Works and FIre Department. Motion carried
unanimously.
MOTION by Jacobson, Seconded by Perry, that the CIty CouncIl
authorize the purchase of a double wall fIberglass tank and pIping
system wIth pump card system and island bumpers from Zahl EquIpment
Company for a total bId price of $43,150. Council recognizes the
other bidder, Griggs Contracting for the same optIon. Their prIce is
$45,970; that the funds for this purchase come from the followIng
sources: $15,000 whIch Is budgeted under the PublIc Works BuIlding
line Item, $15,000 In bonding, $8,000 whIch remains from the purchase
of a Vacal unit which has been ordered, and the remaInIng $5,150 from
the PIR fund which funds are authorIzed under a separate Resolution.
MotIon carried unanimously.
MOTION by Jacobson to adjourn. Mayor Elling declared the meeting
adjourned at 7:38 p.m.

Format of Required Newspaper Ad
Attached please find a rough draft of the newspaper ad
required under the truth-in-taxation law. This format was
provided by the Department of Revenue. I contacted Sarah
Hackett at the League of Minnesota Cities to ask the
following question: What is the Department of Revenue's
feeling about changing the wording of the ad to include
additional information?
Sarah said the Department is going to be very strict about
varying from the prescribed format. Apparently, last year a
number of cities altered the format and, in doing so, changed
the intent/focus of the ad. Sarah also said that is was the
League's recommendation to follow the format exactly as it
was written, even though it is lacking in some information.
I am providing you a copy the ad before it is printed so that
you can answer any questions asked about the ad. The ad will
appear in the Anoka County union on Friday, November 30th.

Dear Mr. Hellings:
I am writing in response to your letter of October 15, 1990
concerning your client LeRoy Johnson. I have referred your
letter to the City zoning Administrator who has informed me that
it is the City's position that the parking of Mr. Johnson's
sanitation trucks is in violation of the Andover zoning
Ordinance. Under the parking section, 8.08, subdivision 4 sets
out the permitted uses for parking vehicles in the R-l
residential district. Mr. Johnson must conform with this
section or he is in violation of the ordinance. Since the
building was over 50% destroyed, hi~f this structure must
be in compliance with the ordinances of the City. I have
enclosed for your information a copy of the section of the
ordinance that the City believes is appropriate. If you have
any further questions, please contact me.

In the event of annexation proceedings becoming final before
the permanent 'zoning is determined, the annexed area Shall be
placed in the most restrictive district and such
classification shall be considered as an interim step pending
permanent classification.

provisions of this Ordinance are separable in accordance with the

(C) Nothing in this Ordinance shall prevent the placing of a
structure in safe condition when said structure is declared ..
unsafe by the Building Inspector.
(D) When any lawful non-conforming use of any structure or
land in any district has been changed to a conforming use, it
shall not thereafter be changed to any non-conforming use.
(E) Whenever a non-conforming structure shall have been
damaged by fire, flood, explosion, earthquake, war, riot, or
act of God, it may be reconstructed and used as before if it
be reconstructed within twelve (12) Months after such
calamity, unless the damage to the structure is fifty (50%)
percent or more of its fair market value {as estimated by the
BUildin~p~torl. in which case the reconstruction shall
be for ~in accordanc~~ith the provisions of this
Ordinanc . -
(F)' Whenever a lawful, non-conforming use of a building or
structure or land is discontinued for a period of one (1)
year, any future use of said building or structure or land
shall be in conformity with the provisions of this Ordinance.
(G) Any non-conforming open use of land lawfully existing
upon the effective date of this Ordinance may be continued
for a period of three (3) years after the effective date of
this Ordinance, whereupon such non-conforming use shall
cease.
(H) Normal maintenance of a building or other structure
containing or related to a non-conforming use is permitted,
including necessary non-structural repairs and incidental
alterations which do not extend or intensify the non-
conforming use. '
(I) A lawful non-conforming use may be changed only to a use
of the same or ~ore restricted classification.
(J) Alterations may be made to a structure containing non-
conforming residential units when they will improve the
livability thereof, provided they will not increase the
number of dwelling units or expand the existing bulk of
structure.

residential districts.

provided and constructed according to minimum standards of
City of Andover when such building is three hundred feet
(300') or more from a thoroughfare or street.
(D) Access to any street shown on the Adopted Major
Thoroughfare Plan shall require a curb curb permit as issued
by the City Building Inspector.
(E) If any plat, for which preliminary approval has been
granted by the City Council on or before October 21, 1970 is
finally approved and filed on or before October 21, 1971,
lots contained therein shall be deemed buildable lots and the
provisions of Section 4.04 shall apply. In all other cases,
the provisions and requirements of this Ordinance shall
apply.
4.05 Accessory Building and structures
(A) No accessory building or use shall be constructed or

footage of land cover of the principal, structure.
(2) The accessory buildings on a residential parcel
with a lot area of one (1 a.} acre or less, shall not
exceed seventy-five (7S%) percent of the square footage

(C) When a private garage is oriented so as to face'onto a
public right-of-way it shall not have less than the minimum
required setback for the principal structure as measured. from
the lot line. '
(D) Accessory buildings in the Residential_Districts may not
be located within ten (10') feet of the side and the rear lot
line.
'(E) "Accessory buildings in th-e ""Bus'iness"" and "Industrial"
Districts shall not be closer than ten (IO') feet from side
and rear lot lines subject to provisions for abutting
residential zone provided herein.

(F) No detached garages or other accessory buildings shall
be located nearer the front lot line than the principal
structure except as herein provided:
(1) On residential parcels with a lot area of One (1
a.) acre or more, a detached garage or accessory

(H) An accessory building may be located within the rear
yard setback provided said accessory building does not occupy
more than twenty-five (25%) percent of a required rear yard.
(I) A private garage in a residential district shall not be
utilized for business or industry. Further, that not more
than one-half (1/2) of the space may be rented for the
private vehicles of persons not resident on the premises,
except that all the space in a garage of one (1) or two (2)
car capacity may be so rented. Such garage shall not be used
for more than one (1) vehicle registered as a commercial
vehicle with the State of Minnesota. Said vehicle must be
registered to the property owner, property leasor or relative
living on the premises. The gross weight of such commercial
vehicle shall not exceed 12,000 pounds gross capacity.

In an R-l or ~-2 Single Family Residential District on a
parcel of at least three (3 a.) acres in size, one (1) truck-
tractor may be stored within an accessory building. This
shall not include the.parking of semi-trailers. (8KKK, 1-16-

(J) Vehicles exceeding 10,000 pounds gross weight shall be
parked in a garage or along the side or rear of a residential
lot. Such vehicles shall not be parked in the front yard.
(K) No permanent sheet metal, painted or unpainted accessory
building, except small garden sheds not exceeding one hundred
twenty (120) square feet, shall be allowed on parcels of
three (3 a.) acres or less in districts zoned R-3 andR-4,
within the Metropolitan Urban Service Area (MUSA) Boundary.
The foregoing shall not apply to painted and finished metal

Parking Requirements
(A) Purpose. The regulation of off-street parking spaces in
these zoning regulations is to alleviate or prevent
congestion of the public right-of-way and to promote the
safety and general welfare of the public by establishing
minimum requirements for off-street parking of motor vehicles
in accordance with the utilization of various parcels of land
or structures.
(B) Application of Off-Street parking Regulations. The
regulations and requirements set forth herein shall apply to
all off-street parking facilities including driveways,
parking lots and storage areas, in all of the zoning
districts of the City.
(C), Site Plan Drawing Necessary. All applications for a
bpilding permit or Certificate of Occupancy in all zoning
districts shall be accompanied by a site plan drawn to scale
and dimensioned indicating the location of the driveway, off-
street parking and loading spaces, and storage areas in
compliance with the requirements set forth in this Section.
( D)
General Provisions.
1. Floor Area. The term "floor area" for the purpose
of calculatlng the number of off-street parking spaces
required shall be determined on the basis of the
exterior floor area dimensions of the buildings,
structure or use. It shall not include areas used
primarily as utility rooms, maintenance areas, rest
rooms, fitting rooms, alteration rooms, window display
areas or lobbies

shall the required parking facilities allow for the
parking of semi-trailers.
Prohibited Uses:
(c) Under no circumstances shall required parking
facilities accessory to residential structures be
used for the storage of commercial vehicles or
equipment or for the parking of vehicles belonging
to the employees, owners, tenants, or customers of
business or manufacturing establishments.
(d) Required off-street parking space in any
district shall not be utilized for the open storage
of goods or for the storage of vehicles which are .
inoperable, for sale or rent.
Calculating Space.
(a) When determining the number of off-street
parking spaces, fractional results of one-half
(1/2) or more shall constitute another space.
(b) In stadiums, sports arenas,' churches and other
places of public assembly in which patrons or
spectators occupy benches, pews or other similar
seating facilities, each twenty-two (22-) inches of
such seating facilities shall be counted as one (1)
seat for the purpose of determining requirements.
(c) On a structure containing two (2) or more types
of use, each use shall be calculated separately to
determine the total number of off-street parking
spaces required, except as ptovided for under Joint
Parking and Shopping Centers.

To confirm our conversation this morning, the following is
offered as an explanation of why it is felt an Amended Special
Use Permit should be sought for Johnson Sanitation and Johnson's
Farms (hog operation).
The property in question is zoned R-l Single Family Rural
Residential and allowed therein are Agricultural Uses, both Urban
and Rural. At the time the city of Andover became a statutory
City, your landfill was already in operation and has been
continuous from that time on. Although the Ordinance has been
amended and does not now allow for a landfill, this use would be
grandpa rented in as a lawfully existing non-conforming use. The
Ordinance does not, however, allow the expansion of this use nor
increase its intensification.
Ordinance No.8 is the zoning Ordinance' and found-therein are' the
details of land uses within the City. Section 7.01-7.04 provides
what is-permitted, accessory, special-"a:nd exclud~d uses within
each zoning district. That is the section of the Ordinance which
provides for agricultural uses as noted above. It is also the
section of the Ordinance which has been amended to exclude any
new landfills.

building is constructed, it must meet such things as setbacks
from the County road, parking (if necessary), etc.
Section 4.05 deals with Accessory Buildings & Structures and at
Subsection F(l) it provides that "On residential parcels with a
lot area of one (1 a.) acre or more, a detached garage or
accessory building may be constructed closer to the front lot
line than the principal structure, however, the minimum, distance
it may be from 'the front lot line is sixty (60') feet." The
building for the sanitation operation is considered an accessory
building (the house is the principal building) and thus, would
fall under this provision of the Ordinance. When we met, it was
determined that to meet the setback from the centerline of Bunker
Lake Boulevard would pose no problem as the current building is
well beyond that point. '

This is a brief summary of. the sections of the Ordinance I feel
would apply to your request. I have also enclosed copies of
those portions cited so that you can review them for yourself.
Ordinance No. 8 is 83 pages long and I did not feel it necessary
to provide you with all that information, however, it is
available for purchase at City Hall for $3.50.
As we spoke earlier, the intent to apply for the Amended Special
Use Permit is two-fold. One, to protect yourself as property
owner and to provide a historical summary of what has happened on
this property since 1948 to the present. The second, to inform
the City as to what is occurring on the property so that we can
intelligently respond to inquiries received and ward off the
citizen complaints with accurate information. It is not intended
to deny uses already existing, remove grandparent rights, or any
such application.
As I explained to you today, in order to expedit~~his matt~~ and
attempt to meet the building season limitations, you would need
to compnte the applications, pay -the' 'fees, and "provide the names
and addresses of the property owners within "350' of your property
by Wednesday morning at the very latest. We need to FAX the
publ~c hearing notice to t~e newspaper so it can be published on
August 31st and September 7th to meet-the ordinance requirements.
You would also need to provide us with a drawing showing the two

The city Council is requested to discuss the traffic signal,
Project 90-20, at the intersection of 157th Avenue and Round Lake
Boulevard.
The County has reviewed the request by the City to install
temporaries at 157th Avenue and Round Lake Boulevard and also at
157th Avenue and CSAH 7. Enclosed is a letter from Paul Ruud
regarding installation of traffic signals at these intersections.
Jon Olson, Deputy County Engineer, will be at the meeting to
discuss the signals with the City Council.
A copy of the Joint Powers Agreement was included in your
september 18, 1990 packet. Refer to the september 18, L990 City
Council minutes regarding this item for further information.

Dear Mr. Schrantz:
We have been informed that action has been taken by the City that would
preclude the installation of a traffic signal system at the intersection of CSAH #9
(Round Lake Boulevard) and CSAH #20 (West) (157th Avenue N.W.). We further
understand that your concerns centered on a desire for signals on CSAH #7 at its
intersections with CSAH #20 and CR #58 and on more study of a new alignment of
CSAH #20 from CSAH #9 to CSAH #7.
The traffic volumes on CSAH #7 are considerably less than on CSAH #9
and signal warrants are not met on CSAH #7. We monitor these types of
intersections each year and as warrants are met, the design of a system and
scheduling of construction are included in our construction program.
Regarding a new alignment for CSAH #20, we intend to work with your staff
,__._ ~o identify a possible route, considering existing development, soil types and
wetlands. Based on this route, we will have our traffic consultant do an analysis of
expected traffic volume changes with this new link in the system.
With this information we can discuss the feasibility of constructing the new
route and under what conditions of scheduling and jurisdiction changes.

At the September 24, 1990 Board of Managers meeting, the Board
discussed establishing a Water Maintenance and Repair Fund.
Establishing such a fund requires special legislation. Currently
three watershed districts have this authority (Ramsey-Washington
Metro, Rice Creek, and Minnehaha Creek).
The existing authority provides for an ad valorem levy of $15,000
annually for "any maintenance, repair, restoration, upkeep, and
rehabilitation of any public ditch, drain, dams, sewer, river,
stream, watercourse, or waterbody, natural or artificial, lying
wholly or partly within the District" (Laws of Minnesota 1974,
Chapter 187). The Coon Creek Watershed District is asking for
the authority for an ad valorem levy of $30,000 annually. This
is the approximate present value of $15,000 in 1974.
The principle benefit of the fund is avoidance of the special
ditch assessment process and viewing process which the District
has used in the past. Processes that are not well suited for
urbanizing areas.
The District is asking for a resolution or letter of support from
the City of Andover in pursuing this legislative authority.
Staff from each of the Cities was involved in reviewing the
District's 1991 budget and plan, and at that time provided input
into this legislative proposal. Too date, the responses to this
proposal have been favorable. "

The City Council is asked to review the Special Use Permit request
of the City of Andover for the installation of a 550 gallon oil
storage tank to be located at the Andover Recycling Center, 1785
Crosstown Boulevard NW. The tank was offered to the City by Anoka
County through a grant from the Minnesota Office of Waste
Management. Council approved the tank receipt at their September
19, 1989 meeting.
Planning & zoning Review
The Planning and Zoning Commission at their November 13, 1990
meeting recommended approval of the Special Use Permit with
conditions. Attached for your review is an excerpt of those
minutes which reflect those conditions.
Applicable Ordinances
Ordinance No.8, Section 4.26 establishes the requirement of
obtaining a Special Use Permit for all uses associated with the
bulk storage of oil, gasoline, liquid fertilizer, chemicals and
similar liquids. The purpose of requiring the Special Use Permit
is to give the City some assurance that fire, explosion or water
or soil contamination hazards are not present that would be
detrimental to the public health, safety and general welfare.
Ordinance No.8, Section 5.03 regulates the issuance of a Special
Use Permit, outlining conditions and procedures.

Staff Review
Upon receiving the recommendation of approval from the Planning &
Zoning Commission, additional discussion was had at the staff
level regarding the placement of the oil storage tank. Frank
Stone, Public Works Superintendent, does not support at this time
the recommendation of a concrete pad. He feels there is a need
for flexibility in placing the tank.
Staff would also recommend that the oil storage tank remain open
24 hours a day. There was concern by the Planning & Zoning
Commission that vandalism and abuse of the oil tank may occur.
Staff will monitor the use of the oil tank and if warranted the
hours of operation will be limited to the daily recycling hours.
Attached is a proposed Resolution for your review and adoption.

WHEREAS, the City of Andover has requested a Special Use
Permit for a 550 gallon oil storage tank on the property described
as 1785 Crosstown Boulevard NW, legally described as:
WEST 330 FEET OF THE NORTHEAST QUARTER OF THE SOUTHEAST
QUARTER, SECTION 22, TOWNSHIP 32, RANGE 24, ANOKA COUNTY,
MINNESOTA.
WHEREAS, the Planning & Zoning Commission has reviewed the
request and has determined that said request meets the criteria of
Ordinance 8, Section 5.03 and 4.26; and
WHEREAS, a public hearing was held and there was comment
received regarding said request; and
WHEREAS, the Planning and Zoning Commission recommends to
the City Council approval of the Special Use Permit requested;
NOW, THEREFORE, BE IT RESOLVED, that the City Council of
the City of Andover hereby agrees with the recommendation of the
Planning & Zoning Commission to allow for A 550 gallon oil storage
tank on said property; with the following conditions:
1. The oil storage tank is to be placed on a cement pad
to prevent contamination of the soil if spillage were
to occur.
2. A security device in the form of cement filled pillars
will be erected about the perimeter of the storage
tank to prevent any accidental contact by vehicles.
3. The tank shall meet State regulations.

The Andover Planning and Zoning Commission is asked to review the
Special Use Permit requested by the city of Andover for a 550
gallon oil storage tank on the following described property:
West 330 feet of tha Northeast 1/4 of the Southeast Quarter,
Section 22, Township 32, Range 24, Anoka County Minnesota.
(1785 NW Crosstown Boulevard - PIN 22-32-24-41-0002)
APPLICABLE ORDINANCES
Section 4.26 of Ordinance No.8 establishes the criteria for a
Special Use Permit for all uses associated with the bulk storage
of oil, gasoline, liquid fertilizer, chemicals and similar
liquids. By requiring a Special Use Permit, the City has some
assurance that fire, explosion or water or soil contamination
hazards are not present that would be detrimental to the public
health, safety and general welfare.
Ordinance 8, Section 5.03 regulates the Special Use Permit,
outlining conditions and procedures.
GENERAL REVIEW
The tank was offered to the City in 1989 by Anoka County through a

The tank is to be used as part of the City's recycling program.
The city Council approved the recommendation to accept ownership
and liability of the oil tank on September 19, 1989.
The oil storage tank would be located at the Andover Recycling
Center. The tank will be used by local residents to recycle their
used motor oil.
The Staff is concerned with the placement of the oil tank. The
close proximity of the tank to the access road leading to the City
Hall Complex Park may cause a safety hazard. Frank Stone, Public
Works Director, believes that the tank can be protected from
incidental contact by placing concrete filled posts around the
tank. The Commission should discuss the need for the concrete
filled posts.

Joyce Noyes, Andover Fire Marshall approves the oil tank as long
as its placement follows State rules. The State requires the oil
tank to be located at least five (5) feet from any structure and
at least ten (10) feet from the property line. The attached
diagram shows the placement of the oil tank.
RECOMMENDATION
Staff recommends approval of the Special Use Permit requested
by the city of Andover for a 550 gallon oil storage tank to be
used for the recycling of motor oil.

Pursuant to due call and notice thereof, a regular meeting of the City Council of the
City of Andover, Minnesota, was duly held in the City Hall in said City on Tuesday,
November 20, 1990, at 7:30 P.M.

The Mayor announced that the next order of business was consideration of the bids
which had been received for the purchase of the City's $1,550,000 General Obligation
Temporary Improvement Bonds, Series 1990B, as advertised for sale. The City Clerk
presented affidavits showing publication of the notice of sale in the City's official
newspaper and in Northwestern Financial Review, a financial paper published in Minneapolis,
Minnesota, which affidavits were examined and found satisfactory and ordered placed on
file.
The City Clerk presented a tabulation of the bids which had been received in the
manner specified in the Official Notice of Sale of the Bonds. The bids were as follows:

GENERAL OBLIGATION TEMPORARY IMPROVEMENT BONDS,

FIXING THEIR FORM AND SPECIFICATIONS;
DIRECTING THEIR EXECUTION AND DELIVERY;
AND PROVIDING FOR THEIR PAYMENT
BE IT RESOLVED By the City Council of the City of Andover, Anoka County,
Minnesota (City) as follows:
Section 1. Sale of Bonds.
1.01. The bid of (Purchaser) to purchase
$1,550,000 General Obligation Temporary Improvement Bonds, Series 1990B (Bonds) of the
City described in the Official Notice of Sale thereof is found and determined to be the
highest and best bid received pursuant to duly advertised notice of sale and is accepted, the
bid being to purchase the Bonds at a price of $ plus accrued interest to date of
delivery, for Bonds bearing interest at the rate of % per annum. Net effective
interest rate: %.
1.02. The sum of $ being the amount bid by the Purchaser in excess of
$1,525,000 will be credited to the Debt Service Fund hereinafter created. The City
Treasurer is directed to retain the good faith check of the Purchaser, pending completion of
the sale of the Bonds, and to return the good faith checks of the unsuccessful bidders
forthwith. The Mayor and City Clerk are directed to execute a contract with the Purchaser
on behalf of the City.
1.03. The City will forthwith issue and sell the Bonds in the total principal amount of
$1,550,000, originally dated December 1, 1990, in the denomination of $5,000 each or any
integral multiple thereof, numbered No. R-l, upward, bearing interest as above set forth,
and maturing on December 1, 1993.
1.04. Optional Redemption. The City may elect on December 1; 1992 and on any date
thereafter to prepay Bonds. Redemption may be in whole or in part of the Bonds subject to
prepayment. If only part of the Bonds are called for prepayment the specific Bonds to be
prepaid will be chosen by lot by the Registrar. Prepayments will be at a price of par plus
accrued interest.
Section 2. Registration and Payment.
2.01. Registered Form. The Bonds will be issued only in fully registered form. The
interest thereon and, upon surrender of each Bond, the principal amount thereof, is payable
",\ by check or draft issued by the Registrar described in Section 2.03.

2.02. Dates; Interest Payment Dates. Each Bond will be dated as of the last interest
payment date preceding the date of authentication to which interest on the Bond has been
paid or made available for payment, unless (i) the date of authentication is an interest
payment date to which interest has been paid or made available for payment, in which case
such Bond will be dated as of the date of authentication, or (Ii) the date of authentication is
prior to the first interest payment date, in which case such Bond will be dated as of the date
of original issue. The interest on the Bonds is payable on June 1 and December 1 of each
year, commencing June 1, 1991, to the owner of record thereof as of the close of business on
the fifteenth day of the immediately preceding month, whether or not such day is a business
day.
2.03. Registration. The City will appoint and maintain, a bond registrar, transfer
agent, authenticating agent and paying agent (Registrar). The effect of registration and the
rights and duties of the City and the Registrar with respect thereto are as follows:
(a) Register. The Registrar must keep at its principal corporate trust office a
bond register in which the Registrar provides for the registration of ownership of
Bonds and the registration of transfers and exchanges of Bonds entitled to be
registered, transferred or exchanged.
(b) Transfer of Bonds. Upon surrender for transfer of a Bond duly endorsed by
the registered owner thereof or accompanied by a written instrument of transfer, in
form satisfactory to the Registrar, duly executed by the registered owner thereof or
by an attorney duly authorized by the registered owner in writing, the Registrar will
authenticate and deliver, in the name of the designated transferee or transferees, one
or more new Bonds of a like aggregate principal amount and maturity, as requested by
the transferor. The Registrar may, however, close the books for registration of any
transfer after the fifteenth day of the month preceding each interest payment date
and until such interest payment date.
(c) Exchange of Bonds. When Bonds are surrendered by the registered owner
for exchange the Registrar will authenticate and deliver one or more new Bonds of a
like aggregate principal amount and maturity, as requested by the registered owner or
the owner's attorney in writing.
(d)

Cancellation. Bonds surrendered upon any transfer or exchange will be
cancelled by the Registrar and thereafter disposed of as directed by the

Registrar is satisfied that the endorsement on the Bond or separate instrument of

it, in its judgment, deems improper or unauthorized.

(f) Persons Deemed Owners. The City and the Registrar may treat the person
in whose name a Bond is registered in the bond register as the absolute owner of the
Bond, whether the Bond is overdue or not, for the purpose of receiving payment of, or
on account of, the principal of and interest on such Bond and for all other purposes,
and payments so made to a registered owner or upon the owner's order will be valid
and effectual to satisfy and discharge the liability upon such Bond to the extent of the
sum or sums so paid.

(g) Taxes, Fees and Charges. For a transfer or exchange of Bonds, the
Registrar may impose a charge upon the owner thereof sufficient to reimburse the
Registrar for any tax, fee or other governmental charge required to be paid with
respect to the transfer or exchange.
(h) Mutilated, Lost, Stolen or Destroyed Bonds. If a Bond becomes mutilated
or is destroyed, stolen or lost, the Registrar will deliver a new Bond of like amount,
number, maturity date and tenor in exchange and substitution for and upon
cancellation of the mutilated Bond or in lieu of and in substitution for a Bond
destroyed, stolen or lost, upon the payment of the reasonable expenses and charges of
the Registrar in connection therewith; and, in the case of a Bond destroyed, stolen or
lost, upon filing with the Registrar of evidence satisfactory to it that the Bond was
destroyed, stolen or lost, and of the ownership thereof, and upon furnishing to the
Registrar of an appropriate bond or indemnity in form, substance and amount
satisfactory to it and as provided by law, in which both the City and the Registrar
must be named as obligees. Bonds so surrendered to the Registrar will be cancelled by
the Registrar and evidence of such cancellation must be given to the City. If the
mutilated, destroyed, stolen or lost Bond has already matured or been called for
redemption in accordance with its terms it is not necessary to issue a new Bond prior
to payment.
(i) Redemption. In the event any of the Bonds are called for redemption,
notice thereof identifying the Bonds to be redeemed will be given by the Registrar by
mailing a copy of the redemption notice by first class mail (postage prepaid) not more
than 60 and not less than 30 days prior to the date fixed for redemption to the
registered owner of each Bond to be redeemed at the address shown on the registration
books kept by the Registrar and by publishing the notice in the manner required by
law. Failure to give notice by publication or by mail to any registered owner, or any
defect therein, will not affect the validity of any proceeding for the redemption of
Bonds. Bonds so called for redemption will cease to bear interest after the specified
redemption date, provided that the funds for the redemption are on deposit with the
place of payment at that time.
2.04. Appointment of Initial Registrar. The City appoints
, , Minnesota, as the initial
Registrar. The Mayor and the City Clerk are authorized to execute and deliver, on behalf of
the City, a contract with the Registrar. Upon merger or consolidation of the Registrar with
another corporation, if the resulting corporation is a bank or trust company authorized by
law to conduct such business, such corporation is authorized to act as successor Registrar.
The City agrees to pay the reasonable and customary charges of the Registrar for the
services performed. The City reserves the right to remove the Registrar upon 30 days'
notice and upon the appointment of a successor Registrar, in which event the predecessor
Registrar must deliver all cash and Bonds in its possession to the successor Registrar and
must deliver the bond register to the successor Registrar. On or before each principal or
interest due date, without further order of this Council, the Treasurer must transmit to the
Registrar moneys sufficient for the payment of all principal and interest then due.
2.05. Execution, Authentication and Delivery. The Bonds will be prepared under the
direction of the Clerk and executed on behalf of the City by the signatures of the Mayor and
the Clerk, provided that all signatures may be printed, engraved or lithographed facsimiles
of the originals. In case any officer whose signature or a facsimile of whose signature
appears on the Bonds ceases to be such officer before the delivery of any Bond, such

signature or facsimile will nevertheless be valid and sufficient for all purposes, the same as
if the officer had remained in office until delivery. Notwithstanding such execution, a Bond
will not be valid or obligatory for any purpose or entitled to any security or benefit under
this Resolution unless and until a certificate of authentication on the Bond has been duly
executed by the manual signature of an authorized representative of the Registrar.
Certificates of authentication on different Bonds need not be signed by the same rep-
resentative. The executed certificate of authentication on each Bond is conclusive evidence
that it has been authenticated and delivered under this Resolution. When the Bonds have
been so prepared, executed and authenticated, the Treasurer shall deliver the same to the
Purchaser upon payment of the purchase price in accordance with the contract of sale
heretofore made and executed, and the Purchaser is not obligated to see to the application
of the purchase price.
2.06. Temporary Bonds. The City may elect to deliver in lieu of printed definitive
Bonds one or more typewritten temporary Bonds in substantially the form set forth in
Section 3 with such changes as may be necessary to reflect more than one maturity in a
single temporary bond. Upon the execution and delivery of definitive Bonds the temporary
Bonds will be exchanged therefor and cancelled.
Section 3. Form of Bond.

The City of Andover, Minnesota, a duly organized and existing municipal corporation
in Anoka County, Minnesota (City), acknowledges itself to be indebted and for value
received hereby promises to pay to the Registered Owner specified above or registered

The City Council has designated the Bonds as "qualified tax exempt obligations" within
the meaning of Section 265(b)(3) of the Internal Revenue Code of 1986, as amended (the
Code) relating to disallowance of interest expense for financial institutions and within the
$10 million limit allowed by the Code for the calendar year of issue.
Additional provisions of this Bond are contained on the reverse hereof and those
provisions have the same effect as though fully set forth in this place.
This Bond will not be valid or become obligatory for any purpose or be entitled to any
security or benefit under the Resolution until the Certificate of Authentication hereon has
been executed by the Bond Registrar by manual signature of one of its authorized
representatives.

This Bond is one of an issue in the aggregate principal amount of $1,550,000 all of like
original issue date and tenor, except as to number and denomination, issued pursuant to a
resolution adopted by the City Council on November 20, 1990 (the Resolution), for the
purpose of providing money to temporarily defray the expenses incurred and to be incurred
in making local improvements, pursuant to and in full conformity with the Constitution and
laws of the State of Minnesota, including Minnesota Statutes, Chapter 429, and the principal
hereof and interest hereon are payable primarily from special assessments against property
specially benefited by local improvements, as set forth in the Resolution to which reference
is made for a full statement of rights and powers thereby conferred. The full faith and
credit of the City are irrevocably pledged for payment of this Bond and the City Council has
obligated itself to issue and sell definitive or additional temporary bonds to redeem the
Bonds and to levy taxes on all of the taxable property in the City in the event of any
deficiency in special assessments pledged, which taxes may be levied without limitation as
to rate or amount. The Bonds of this series are issued only as fully registered Bonds in
denominations of $5,000 or any integral multiple thereof.
As provided in the Resolution and subject to certain limitations set forth therein, this
Bond is transferable upon the books of the City at the principal office of the Bond Registrar,
by the registered owner hereof in person or by the owner's attorney duly authorized in
writing upon surrender hereof together with a written instrument of transfer satisfactory to
the Bond Registrar, duly executed by the registered owner or the owner's attorney; and may
also be surrendered in exchange for Bonds of other authorized denominations. Upon such
transfer or exchange the City will cause a new Bond or Bonds to be issued in the name of the
transferee or registered owner, of the same aggregate principal amount, bearing interest at
the same rate and maturing on the same date, subject to reimbursement for any tax, fee or
governmental charge required to be paid with respect to such transfer or exchange.
The City and the Bond Registrar may deem and treat the person in whose name this
Bond is registered as the absolute owner hereof, whether this Bond is overdue or not, for the
purpose of receiving payment and for all other purposes, and neither the City nor the Bond
Registrar will be affected by any notice to the contrary.
IT IS HEREBY CERTIFIED, RECITED, COVENANTED AND AGREED that all acts,
conditions and things required by the Constitution and laws of the State of Minnesota to be
done, to exist, to happen and to be performed preliminary to and in the issuance of this Bond

3.02. The City Clerk is directed to obtain a copy of the proposed approving legal
opinion of Holmes &. Graven, Chartered, Minneapolis, Minnesota, which is to be complete
except as to dating thereof and to cause the opinion to be printed on each Bond, together
with a certificate to be signed by the facsimile signature of the Clerk in substantially the
form set forth in the form of Bond. The Clerk is authorized and directed to execute the
certificate in the name of the City upon receipt of the opinion and to file the opinion in the
City offices.
Section 4. Payment: Security: Pledges and Covenants.
4.01. The Bonds are payable from the General Obligation Temporary Improvement
Bonds, Series 1990B Debt Service Fund (Debt Service Fund) hereby created, and special
assessments (Assessments) levied or to be levied for the improvements (Improvements)
financed by the Bonds are hereby pledged pledged to the Debt Service Fund. If any payment
of principal or interest on the Bonds becomes due when there is not sufficient money in the
Debt Service Fund to pay the same, the Treasurer is authorized and directed to pay such
principal or interest from the general fund of the City, and the general fund will be
reimbursed for such advances out of the proceeds of Assessments for the Improvements
when collected. There is appropriated to the Debt Service Fund all (i) capitalized interest
financed from Bond proceedS, if any, (ii) any amount over the minimum purchase price paid
by the Purchaser and (iii) accrued interest paid by the Purchaser upon closing and delivery of
the Bonds.
4.02. It is determined that the Improvements to be financed by the Bonds will directly
and indirectly benefit the abutting property, and the City hereby covenants with the holders
from time to time of the Bonds as follows:

(a) The City has caused the Assessments for the Improvements to be promptly
levied and is taking all steps necessary to assure prompt collection. The City Council
will cause all further actions and proceedings relative to the making and financing of
the Improvements financed hereby to be taken with due diligence that are required for
the construction of each Improvement financed wholly or partly from the proceeds of

the Bonds, and for the final and valid levy of the Assessments and the appropriation of
any other funds needed to pay the Bonds and interest thereon when due.
(b) In the event of a current or anticipated deficiency in the Assessments, the
City Council will levy ad valorem taxes in the amount of the deficiency.
(c) The City will keep complete and accurate books and records showing:
receipts and disbursements in connection with the Improvements, Assessments levied
therefor and other funds appropriated for their payment, collections thereof and
disbursements therefrom, moneys on hand and, the balance of unpaid Assessments.
(d) The City will cause its books and records to be audited at least annually
and will furnish copies of such audit reports to any interested person upon request.
4.03. It is determined that the estimated collections of Assessments and interest
thereon for payment of principal and interest on the Bonds will produce at least five percent
in excess of the amount needed to meet when due, the principal and interest payments on
the Bonds and that no tax levy is needed at this time.
4.04. The City Clerk is directed to file a certified copy of this resolution with the
County Auditor of Anoka County, and to obtain the certificate required by Minnesota
Statutes, Section 475.63.
4.05. In accordance with its statutory duties under Minnesota Statutes, Section
429.091, Subdivision 5, the City covenants and agrees with the holders of the Bonds that if
the Bonds cannot be paid at maturity from the proceeds of the Assessments or from other
funds appropriated by the City Council, the Bonds will be paid from the proceeds of
definitive or additional temporary bonds that will be issued and sold prior to the maturity
date of the Bonds.
Section 5. Authentication of Transcript~
5.01. The officers of the City are authorized and directed to prepare and furnish to
the Purchaser and to the attorneys approving the Bonds certified copies of proceedings and
records of the City relating to the Bonds and to the financial condition and affairs of the
City, and such other certificates, affidavits and transcripts as may be required to show the
facts within their knowledge or as shown by the books and records in their custody and under
their control, relating to the validity and marketability of the Bonds and such instruments,
including any heretofore furnished, may be deemed representations of the City as to the
facts stated therein.
5.02. The Mayor and City Clerk are authorized and directed to certify that they have
examined the Official Statement prepared and circulated in connection with the issuance
and sale of the Bonds and that to the best of their knowledge and belief the Official
Statement is a complete and accurate representation of the facts and representations made
therein as of the date of the Official Statement.
Section 6. Tax Covenant.
6.01. The City covenants and agrees with the holders from time to time of the Bonds
that it will not take or permit to be taken by any of its officers, employees or agents any
::.) action which would cause the interest on the Bonds to become subject to taxation under the

.'-...../ Internal Revenue Code of 1986, as amended (the Code), and the Treasury Regulations
promulgated thereunder, in effect at the time of such actions, and that it will take or cause
its officers, employees or agents to take, all affirmative action within its power that may be
necessary to ensure that such interest will not become subject to taxation under the Code
and applicable Treasury Regulations, as presently existing or as hereafter amended and
made applicable to the Bonds.
6.02. (a) The City will comply with requirements necessary under the Code to
establish and maintain the exclusion from gross income of the interest on the Bonds
under Section 103 of the Code, including without limitation requirements relating to
temporary periods for investments, limitations on amounts invested at a yield greater
than the yield on the Bonds, and the rebate of excess investment earnings to the
United States if the Bonds (together with other obligations reasonably expected to be
issued in calendar year 1990) exceed the small-issuer exception amount of $5,000,000.
(b) For purposes of qualifying for the small issuer exception to the federal
arbitrage rebate requirements, the City hereby finds, determines and declares that the
aggregate face amount of all tax-exempt bonds (other than private activity bonds)
issued by the City (and all subordinate entities of the City) during the calendar year in
which the Bonds are issued and outstanding at one time is not reasonably expected to
exceed $5,000,000, all within the meaning of Section 148(f)(4)(C) of the Code.
6.03. The City further covenants not to use the proceeds of the Bonds or to cause or
permit them or any of them to be used, in such a manner as to cause the Bonds to be
"private activity bonds" within the meaning of Sections 103 and 141 through 150 of the
Code.
6.04. In order to qualify the Bonds as "qualified tax-exempt obligations" within the
meaning of Section 265(b)(3) of the Code, the City makes the following factual statements
and representations:
(a) the Bonds are not "private activity bonds" as defined in Section 141 of the
Code;
(b) the City hereby designates the Bonds as "qualified tax-exempt obligations"
for purposes of Section 265(b)(3) of the Code;
(c) the reasonably anticipated amount of tax-exe mpt obligations (other than
private activity bonds, treating qualified 501(c)(3) bonds as not being private activity
bonds) which will be issued by the City (and all subordinate entities of the City) during
calendar year 1990 will not exceed $10,000,000; and
(d) not more than $10,000,000 of obligations issued by the City during calendar
year 1990 have been designated for purposes of Section 265(b)(3) of the Code.
6.05. The City will use its best efforts to comply with any federal procedural
requirements which may apply in order to effectuate the designations made by this section.

The Andover City Council is asked to review the request of Gary
Mulcahey to purchase two lots in the Andover Commercial Park.
Mr. Mulcahey will be purchasing Lots 3 and 4 of Block 2 to
construct a building for M & S Sheetrock.
BACKGROUND
Law II Partnership and their partner Trapp Realty signed a
purchase agreement on February 2, 1990. Mr. Mulcahey entered into
an agreement on October 11, 1990 to replace Law II Partnership and
Trapp Realty giving him 30 days to purchase said property. Since
that time Mr. Mulcahey has submitted plans for preliminaxy
approval by the Andover Review Committee, which ARC returned for
minor changes. ARC will be reviewing the final site plan on
November 21, 1990. Mr. Mulcahey has informed me that if ARC
approves the site plan he will purchase the property that same
day.
COUNCIL OPTIONS
1. The City Council may agree to sell the property to Mr.
Mulcahey and direct legal staff to prepare the appropriate
purchase documents.
3. The City Council may choose not to sell the property to Mr.
Mulcahey for the development of the M & S Sheetrock building.

The Andover City Council is requested to approve the amount of

BACKGROUND
During the budget process last fall and at various times during
this year, the City has eluded to issuing equipment certificates.
with most of the equipment now purchased and 1990 rapidly coming
to an end, the City needs to issue these certificates.
In order to begin the process, the City Council needs to authorize
the attorney to solicit bids and decide on the actual dollar
amount of certificates to be issued. The following is a .summary
of the equipment which to date has been authorized to be purchased
with these certificates:

year.

*4881, our primary pumper, is rusting badly. We have not been
able to include this as a regular item in the budget because of
the high cost. The refurbishing would include complete
disassembly, sandblasting to bare metal, replacement of all steel
treadplates with aluminum, adding st. Paul cab to allow for a full
duty crew and repainting. This is similar to the remodeling of
*4886 which was done last year. This should add 10-15 years to
the expected life of the truck as a fire apparatus. This truck
will likely be stationed as first out pumper at Station *3.

The Public Works Department and the Fire Department met earlier
this month to plan for necessary adjustments when the main Fire
Station #1 is built.
Splitting the existing Fire Station space between the Fire
Department and the Public Works Department creates a number of
problems including access, dirt and contamination, shared space,
etc.
A more acceptable solution is for the Fire Department to vacate
the current station and move into the existing Cold Storage
Building. The Cold storage Building would be modified to
accommodate the plans being drawn up by Howard Becker including: a

I was asked to get a quote for the repair of the Public works/Fire
Department Building at your last meeting. Because the outside
walls were manufactured by FabCon, I gave them the first call and
they recommended I call structural Restoration Incorporated in
Minneapolis.
Mr. Terry L. Threet of Restoration Incorporated came out and
inspected the building for cracks, hairline fractures, etc. To
repair all cracks and fractures they will have to be sawed out and
grouted back. All paint would have to be sandblasted off; cement
resealed and painted. The estimated time to complete the work is
three weeks at a total cost of $17,000.00.
Mr. Threet said he had never seen a building of this age. with so
many cracks in it and that this cracking sometimes happens in cold
weather construction. He also recommended that we don't let the
building remain as it is too much longer because moisture gets
into these cracks and freezes which then enlarges them. This will
only increase our maintenance expenses.

REQUEST
The Andover City Council is requested to review the Permanent
Improvement Revolving Fund Budget, provide direction regarding
modifications and/or approve the resolution establishing the
budget.
BACKGROUND
Resolution Number R74-90 established the PIR Fund. One
requirement of this resolution was the preparation of a budget.
The budget of the PIR Fund includes both revenues and
expenditures. The revenue sources include: interest earnings,
special assessments from the four bonds called earlier tQis year
and excess funds from bonds which mature in 1991.
Expenditures can be made from either or both of two funds. The
Public Improvement Account (PIA) is used to finance assessable
projects and the Capital Improvement Account (CIA) is used for the
acquisition of capital, repair or replacement of equipment, etc.
The proposal for the 1991 budget does not anticipate expending any
funds from the PIA. Potential uses of the CIA include repairing
the exterior of the Public Works Building, remodeling the
Equipment Building to accommodate the fire department, repairing
fire truck 4881 or any other use City Council may deem
appropriate.

The Andover City Council is requested to receive the financial
reports for the General, Water and Sewer Funds for the ten months
ended October 31, 1990.
BACKGROUND
The attached reports show activity for the ten months ended
October 31, 1990. The revenues are shown by major catagory and
the expenditures are shown by department. If you would like
additional detail on any catagory, please let me know and I will
have it available at the meeting.
The format is more condensed than past reports. Please let me
know if for future reports you desire full detail, or if this
