This matter was continued from the City Council meeting on
September 4, 1990 to allow the Building Official an opportunity
to review the house file materials on this property and the
location of the well and. septic system in relationship to the
requested location of the barn. Attached is a site drawing
prepared by Dave Almgren, Building Official. This drawing should
assist you in visualizing this request.
The request, as presented, places the proposed barn 102' from the
habitable portion of the structure. That dimensions satisfies
the Ordinance and no variance would be necessary.
It should be noted that prior to 1979, the City did not .equire
garages at all. with the adoption of that amendment,-a single-
car garage was required. Then in 1981, the requirement was.
updated to include a 4~0 s.f. garage. Prior to 1979, i~most
instances, the setback would have been measured from the
habitable structure as garages were the exception, not the norm.
The location of the well from the barn would have been required
to be 100' feet. Back at the time the house was built, the well
was usually inside the house and the setback measuring stick
then became the house, not the exact location of the well. This
would have been handled by the Department of Health.
It should be further noted that in "normal circumstances", the
front of the house faces the public road, not the side yard.
With that layout, the habitable portion of the structure is
usually the back of the house. In this case, the house faces
south onto the 20' easement and the garage is to the east of the
house closest to the proposed location of the barn.
At the meeting on Tuesday evening, the Leets included in their
comments the possibility of splitting off a piece of land to the
east to create another building site. Two issues should be
considered in regard to this future proposal:

1. A public road would have to be built (60' wide) as we do
not allow structures to front on private easements.
2. Building setback dimensions should be consistent with
what the City currently requires.
The Ordinance requires that the structure be located 50' from any
occupied residential lot. This would apply to the north side
(Steffenson's) and the south side (McKelvey). If the barn is
sited so that the 40' dimension runs north and south, the barn
could be placed 59' from the north fence line (lot line assumed)
and still stay in line with the front of the house. Ordinance
No.8, Section 4.05 Accessory Uses & Structures, provides that no
accessori-btiilding shall be located closer to the front lot line
than the principal structure. This location would prevent the
rieed foi a varian~e if the property were s~bdivided in the
future. It would provide for the visual consistency of setbacks
(as discussed in regard to the Kangas Variance Request)..
The requested location of the barn places it immediately next to
.the lean-to shed. It's location is 79' from the eastern-most
edge ~f the house._ It would appear that shed wouL~ need to-be
removed as the proposed location of the barn is l' from the shed
as well the tree/stump to the east.
Based on the above information, the request as presented
should be granted by the ~ity Council.
