Councilmembers present: Sheri Bukkila, Tony Howai Councilmember absent: None Councilnlember Trude asked i eventually it would be but r Mike Gamache, January 28, rd NW, Andover, Mike Knight, and Julie Trude to approve the agenda tant for open space. Mr. Perry thought that the City needs to consider at the time of space should be purchased for residents to use and enjoy Perry stated the City should purchase the land with future Mr. Perry indicated a walking path could be installed rather than a road until the area is developed and then access to the land could be developed. He noted the City has a lot of park land so the open space land should be kept for future use. He thought the Council needed to look for large parcels'in the City rather than small, park -like land. Mayor Gamache agreed with Mr. Perry's point on open space land that part of this was for long term. He wondered what Mr. Perry's vision was for open space land and if it should be } Andover City Council Interviews for Commission Openings Minutes —January 28, 2013 Page 2 1 continued in the City. Mr. Perry thought this was positive for the City and something they 2 should continue. 3 4 Councilmember Bukkila asked if there was discussion regarding putting a road to the open space 5 land that was being considered and what was his position on this. Mr. Perry indicated he did not 6 voice an opinion but would like to see a road going to the parcel; however, he understood it 7 would not be feasible at this time because of the cost. 8 9 Councilmember Trude wondered how they can get families to appreciate the open space land 10 that has already been purchased. Mr. Perry stated access is not very good so he thought the City 11 needed to provide easier access to the open land. 12 13 Mayor Gamache asked while being on the Commission, what was Mr. Perry most pleased with 14 that has gotten done. Mr. Perry stated he is pleased with what they have accomplished and it has 15 been a really good experience. 16 17 Tony Kowalewski — Park & Recreation Commission 18 19 Councilmember Trude wondered why Mr. Kowalewski wanted to reapply for the Park and 20 Recreation Commission. Mr. Kowalewski indicated he was the co -chair for the Athletic 21 Complex Task Force and wants to see this completed. 22 23 Mayor Gamache asked if the Council is meeting enough with the Commissions or would more 24 meetings be beneficial. Mr. Kowalewski would like to see the Council and Commission meet 25 more often. Councilmember Trude thought it would be beneficial to meet more when projects 26 are going. 27 28 Councilmember Howard asked when they decommission a park what should be maintained. Mr. 29 Kowalewski thought they could use them for gardens or a dog park. He did not like to see parks 30 decommissioned but when they are not being utilized, they need to save on costs. 31 32 Mayor Gamache asked how things are working on the Park Commission. Mr. Kowalewski 33 thought it was valuable that they all have different insights. He thought Ted Butler did a 34 tremendous job and allowed the Commissioners to talk. He thought the communication is there. 35 36 Mr. Kowalewski noted their greatest accomplishment was the skate park because something was 37 needed for individuals who do not want to be in competitive sports. He stated another 38 accomplishment was working with severely impaired children and with birdhouses. i 1 39 40 Councilmember Trude wondered how he felt about the dog park, and if the County should 41 handleithat. Mr. Kowalewski stated he would not have any prdblem if it were to be a joint 42 project with the County and to provide some funds. r s � f Andover City Council Interviews for Commission Openings Minutes —January 28, 2013 Page 3 1 Councilmember Howard asked if they added a teen center to the Community Center, would it be 2 a positive influence for the kids in the City. Mr. Kowalewski thought this would be great. He 3 would also like to see an additional indoor skate rink in the future. 4 5 Hugh Phillips — Open Space Commission 6 7 Mr. Phillips explained to the Council why he would like to be appointed to the Open Space 8 Commission. 9 10 Councilmember Trude wondered if Mr. Phillips thought the City should be only looking for 11 large parcels of land for open space or should they also look for small parcels. Mr. Phillips 12 thought the larger the parcel the more private it becomes for refuge and hiking but a small parcel 13 is useful in order to access a piece of land or park. He was not sure he would consider a one- or 14 two -acre parcel of land as open space. 15 16 Councilmember Knight asked what Mr. Phillips envisioned for prime open space. Mr. Phillips 17 thought it should be held and not used until the future. 18 19 Mayor Gamache noted that there are times the Council does not agree with what the 20 Commissions want so he wondered if Mr. Phillips would be okay with that. Mr. Phillips stated 21 not everyone agrees all of the time and he would not have an issue with it. 22 23 Mr. Phillips wondered how the Commission gets all of their work done when the meetings are 24 short and only once a month. Mayor Gamache stated the Commissioners usually do some 25 research outside of the meeting and bring the information to the meeting for discussion. 26 27 Shane Stenzel — Park & Recreation Commission 28 29 Mr. Stenzel explained to the Council why he would like to be appointed to the Park and 30 Recreation Commission. He noted he currently works for the Minneapolis Park Board. 31 32 Councilmember Bukkila asked with his expertise, can he bring something to the Commission 33 that it may not have. Mr. Stenzel stated they need to look at how Andover will look in twenty 34 years and build parks based on that. He felt there needed to be mixed use recreation in the parks. 35 36 Councilmember Howard wondered what the City should do with decommissioned parks. Mr. 37 Stenzel was not sure because he thought this was a problem in a lot of cities. He thought they 38 could have people adopt a park. 39 40 Mr. Stenzel asked what the Council's thoughts were on corporate sponsorship in the parks. 41 Councilmember Bukkila stated they have not really gone there except with the Community 42 . Center. Mayor Gamache stated they talked about it a little in regard to concession stands. Andover City Council Interviews for Commission Openings Minutes —January 28, 2013 Page 4 1 James Boatwright — Planning Commission/Open Space /Park & Recreation Commission 2 3 Mr. Boatwright explained to the Council why he would like to be appointed to the Planning and 4 Zoning Commission. 5 6 Councilmember Trude asked if Mr. Boatwright has watched any of the meetings. Mr. 7 Boatwright indicated he has and thought he could be of some assistance to the Commission and 8 has done a lot of coordination in the landscape business. 9 10 Mr. Boatwright indicated he was most interested in the Planning and Zoning Commission but 11 would like to help out anywhere the City needs him. 12 13 Councilmember Bukkila asked if Mr. Boatwright has watched any of the recent meetings. Mr. 14 Boatwright indicated he has not. Councilmember Bukkila wondered how Mr. Boatwright would 15 handle an issue with encroachment on easements. Mr. Boatwright stated as long as the land 16 format was not changed, he did not think there would be a real issue. 17 18 Mayor Gamache stated all of the Commissions are advisory to the Council, and he wondered 19 how he would handle a situation where the majority of the City Council votes opposite of what 20 the Commission recommends. Mr. Boatwright explained he would make sure that the Council 21 has received all of the information so they could make an informed decision and he would stick 22 within the ordinance. 23 24 Councilmember Howard asked what Mr. Boatwright would like to see come to Andover. Mr. 25 Boatwright thought there could be more retail businesses or another golf course. 26 27 Bert Koehler —Planning Commission /Park & Recreation Commission 28 29 Mr. Koehler explained to the Council why he would like to be appointed to the Planning and 30 Zoning Commission. He stated he was interested in the development of the City and has seen 31 the City grow over time. 32 33 Councilmember Knight asked if he had a concept of what the Planning and Zoning Commission 34 does. Mr. Koehler indicated he did not but is willing to learn. 35 36 Mr. Koehler indicated he has not seen any Planning and Zoning Commission meetings but he has 37 been to some when it has involved his neighborhood. 38 39 Councilmember Trude noted public hearings are 'very important and the Planning and Zoning 40 Commission holds them and takes resident input to make their decisions. Councilmember 41 Knight stated the Council relies heaVilyon the Planning and Zoning Commission's input in 42 making decisions. = k Andover City Council Interviews for Commission Openings Minutes —January 28, 2013 Page 5 1 Councilmember Trade asked what Mr. Koehler liked about the City and what do they need more 2 of Mr. Koehler stated he liked the location of Andover. He would love to see more things for 3 kids in the community and more businesses that cater to kids. 4 5 Lucas Peterson — Park & Recreation Commission 6 7 Mr. Peterson explained to the Council why he would like to be appointed to the Park and 8 Recreation Commission. 9 10 Councilmember Trade asked if Mr. Peterson has seen things in the parks that could be done 11 differently. Mr. Peterson stated he did not have any other park to compare to the park by his 12 house. 13 14 Councilmember Howard wondered if Mr. Peterson thought they needed to work on the City 15 trails or parks. Mr. Peterson stated they have just started using the trails and did not see any need 16 for improvement. The trails seem to be in good shape. 17 18 Councilmember Howard wondered if Mr. Peterson thought a youth center would be a good idea 19 for the City. Mr. Peterson thought it would be a great idea and it would get the kids out of the 20 house and let them meet other kids. 21 22 Mayor Gamache asked if Mr. Peterson would have any issues if the Council did not follow what 23 the Park Commission recommended. Mr. Peterson indicated he would not and felt it could be 24 good to have some opposition. He welcomed differing opinions. 25 26 Councilmember Knight asked if Mr. Peterson would like to see anything different in the parks. 27 Mr. Peterson stated he would be open to more parks in the City to get people outside. 28 29 Ted Butler — Park & Recreation Commission 30 31 Mr. Butler explained to the Council why he would like to continue on the Park & Recreation 32 Commission. He noted he has been an advocate for the parks. 33 34 Councilmember Trade thanked Mr. Butler for coming to some of their meetings as the Chair of 35 the Commission to explain the Commission's position on items. 36 37 Councilmember Howard asked what Mr. Butler's vision would be on completing the large park 38 project. Mr. Butler stated he is not an expert on the City's finances but he thought they have put 39 together a really compelling Master Plan for the park. He would hate to see the Master Plan 40 shelved for years before finishing it. Part of him thinks bonding for the park may be the way to 41 go because money is cheap right now. He would like to see the Master Plan done in less than 42 seven years. Andover City Council lnterviews for Commission Openings Minutes — January 28, 2013 Page 6 1 2 Mayor Gamache indicated Mr. Butler has done a great job as Chair on the Park & Recreation 3 Commission. 4 5 Bob Roettger — Open Space Commission/Planning Commission 6 7 Mr. Roettger explained to the Council why he would like to be appointed to the Open Space 8 Commission. 9 10 Councilmember Trude asked what characteristics Mr. Roettger would look for in the land to 11 purchase. Mr. Roettger stated he would look at the price, where it is located in the City, what 12 type of land it is, and could it be purchased fairly cheaply. 13 14 Mayor Gamache reviewed the open space history with Mr. Roettger. 15 16 Councilmember Knight asked if Mr. Roettger has anything he would like to see happen. Mr. 17 Roettger thought it was important to have open space in residential areas to make it seem less 18 dense. 19 20 ADJOURNMENT 21 22 Motion by Councilmember Howard, Seconded by Councilmember Bukkila, to adjourn. Andover City Council Interviews for Commission Openings Minutes —January 29, 2013 Page 2 1 there needs to be exceptions but there also has to be compromise between the City and 2 developers. He felt a lot has to do with how the City sets the standards. 3 4 Mayor Gamache stated they have ordinances on outdoor storage and he wondered if the City is 5 too restrictive or are there areas that should have more outdoor storage. Mr. Cleveland stated he 6 is not too concerned about outdoor storage but in some places, it does clutter the look of the area. 7 He thought the City inconsistently applied overall aesthetics over the entire City but he thought 8 the City needed to do it that way for now. 9 10 Mr. Cleveland requested to meet more often for joint Planning and Zoning Commission/City 11 Council meetings to discuss visioning for the City. 12 13 Tim Cleven — Planning & Zoning Commission 14 15 Mr. Cleven explained to the Council why he would like to be appointed to the Planning and 16 Zoning Commission. 17 18 Councilmember Trude asked if Mr. Cleven has watched any of the meetings. Mr. Cleven 19 indicated he has. Councilmember Trude stated the Planning Commission looks at issues related 20 to City Code and she wondered how Mr. Cleven would deal with those types of issues such as 21 infringing on an easement. Mr. Cleven stated he always believed there are laws and rules in 22 place for a reason and he would need to follow them. 23 24 Councilmember Knight asked how Mr. Cleven sees Andover compared to surrounding 25 communities. Mr. Cleven stated the City is very nice but there needs to be more commercial 26 growth, which is important for a more robust tax base and in order for Andover to grow. 27 28 Councilmember Knight asked how Mr. Cleven sees the role of Planning and Zoning 29 Commission. Mr. Cleven stated he would need to make sure the codes and zoning are enforced 30 and maintained for the developers coming in. 31 32 Councilmember Bukkila stated she would like to see more collaboration and discussion at the 33 Commission level and wanted to know if Mr. Cleven has played a role in discussion or 34 leadership. Mr. Cleven stated in his previous position he was looked upon to research codes and 35 to make sure whatever happened in the different cities, the code was met. 36 37 Councilmember Trude asked if Mr. Cleven sees himself as a creative person in order to make 38 decisions. Mr. Cleven stated depending on what the issue is, there might be some give and take 39 ' but they have to look at what the City would be opening themselves up to in the future if the 40 decision does not follow the rules. He stated the City needs to look ahead and not just at the 41 current time. f 42 i 3 s, Andover City Council Interviews for Commission Openings Minutes — January 29, 2013 Page 3 1 Michael Spande — Planning & Zoning Commission/Open Space Commission 2 3 Mr. Spande explained to the Council why he would like to be appointed to the Planning and 4 Zoning Commission. 5 6 Councilmember Trade asked as Mr. Spande drives around Andover, what does he like or dislike 7 about Andover. Mr. Spande thought some of the things Andover has done well is purchasing the 8 gas station and apartments on Bunker Lake Boulevard so something will get redeveloped. 9 Councilmember Trade wondered what Mr. Spande would recommend doing there. Mr. Spande 10 was not sure but did not think another office building would work there because some in the area 11 have sat empty for a while. He was not sure if he would be in favor of an apartment building 12 there either. He noted there would need to be a lot of thought put into that redevelopment. 13 14 Councilmember Bukkila asked if Mr. Spande had any personal knowledge or background 15 regarding personal property rights. Mr. Spande thought the City and the Council had an interest 16 in making things better for the City. The City Council and staff are working for the residents and 17 he thought it was a balancing act that needed to be achieved. He was not in favor of a City being 18 overbearing and taking property from residents unless it is in the best interest of the entire City. 19 He is not in favor of eminent domain. 20 21 Mayor Gamache stated at times the Planning Commission and Council do not agree on items and 22 he wondered how Mr. Spande would handle opposition. Mr. Spande felt everyone should be 23 professional. He indicated he will voice his opinion but understands where his role begins and 24 ends. 25 26 Councilmember Trade asked how long Mr. Spande has lived in Andover. Mr. Spande indicated 27 he has been in Andover for six years. 28 29 Kim Kovich — Open Space Commission 30 31 Mr. Kovich explained to the Council why he would like to be appointed to the Open Space 32 Commission. 33 34 Councilmember Knight asked if the purpose of the open space was for the enjoyment of 35 residents or to prevent development of the area. Mr. Kovich thought the way it was written, 36 preservation is important but people can still enjoy it. 37 ' 38 Councilmember Bukkila wondered how bethought the Open Space Commission worked 39 together. Mr. Kovich thought the Open Space Commission worked well together and 40 communicated. He enjoyed the people on the Commission and felt there was a lot of discussion 41 being made to make the decisions. 42 )1 Andover City Council Interviews for Commission Openings Minutes — January 29, 2013 Page 4 1 John Stong — Planning & Zoning Commission 2 3 Mr. Stong explained to the Council why he would like to be appointed to the Planning and 4 Zoning Commission. Mr. Stong indicated he has read through all of the City Code and felt it 5 was interesting. 6 7 Mayor Gamache asked what Mr. Stong's thoughts were on how the meetings with Wal -Mart 8 worked out. Mr. Stong thought it worked out okay but in general, he would tend to honor the 9 individual property owner's rights as long as they are not violating anything. 10 11 Councilmember Knight stated the Council has reviewed the Nightingale Street reconstruction 12 and how far to extend the trail and he wondered if Mr. Stong had any input on how far north it 13 should be extended. Mr. Stong stated if the trail is brought up to 157th Avenue, it would service 14 the most residents but if it were extended farther north from there, it would not service a large 15 number of people and would not be beneficial. He felt that part of the trail could be extended 16 once development happened. 17 18 Councilmember Bukkila asked what he does for a job. Mr. Stong stated he is in sales, which 19 allows him flexibility. 20 21 Brad Geiss — Planning& Zoning Commission/Park & Recreation Commission 22 23 Mr. Geiss explained to the Council why he would like to be appointed to the Planning and 24 Zoning Commission. 25 26 Councilmember Trude asked when driving around Andover, did Mr. Geiss see anything he liked 27 that the City should do more of Mr. Geiss thought there were phases being done in Andover and 28 that it was being well laid out throughout the City. He thought there were opportunities for more 29 business in the City. 30 31 Councilmember Knight asked what Mr. Geiss saw as a role of the Planning and Zoning 32 Commission. Mr. Geiss thought the Commission would be brought together as a group to come 33 up with suggestions for the Council and provide good data for the Council to review. 34 35 Mr. Geiss wondered what the Council was looking for as a candidate for the positions. Mayor 36 Gamache explained what the Planning Commission was comprised of and what the Council 37 expected from them. 38 39 Lynae Gudmundson — Planning Commission 40 41 Ms. Gudmundson explained to the Council why he would like to be reappointed to the Planning 42 and Zoning Commission. 43 Andover City Council Interviews for Commission Openings Minutes —January 29, 2013 Page 5 1 Mayor Gamache asked what the most interesting part of the three years has been for her. Ms. 2 Gudmundson thought the most interesting item was regulation of fire arms and bow hunting. 3 4 Councilmember Bukkila asked if there were any particular issue where she felt in the minority 5 on an issue or where she was very vocal. Ms. Gudmundson stated often times she is looking at 6 things as a residential appraiser and someone living in the community and she felt the rest of the 7 Commission has more knowledge of commercial. 8 9 Mark Miskowiec — Park & Recreation Commission 10 11 Mr. Miskowiec explained to the Council why he would like to be reappointed to the Park and 12 Recreation Commission. 13 14 Mayor Gamache asked for an example of something he has worked on that either he liked or 15 disliked. Mr. Miskowiec noted people take the parks so seriously. He thought if the Park and 16 Recreation Commission is doing their job, the Council does not have to deal with it. 17 18 Councilmember Knight asked what Mr. Miskowiec saw going forward regarding the parks. Mr. 19 Miskowiec stated they needed to look to the future rather than now when they construct their 20 parks so it will be enjoyable for all now and in the future. 21 22 Councilmember Trude asked what he would like to see in the new park being developed. Mr. 23 Miskowiec stated there should be fields, sliding hills. They need to do a few good things and do 24 them well. He did not think they needed to have everything in one park. 25 26 Twila Hauck Martin — Park & Recreation Commission 27 28 Ms. Hauck -Martin explained to the Council why she would like to be appointed to the Park & 29 Recreation Commission. She noted she likes multi -use in the parks and wants to make all of the 30 parks usable by all the residents. 31 32 Ms. Hauck -Martin discussed with the Council her role on different sports organizations and 33 indicated she joined all of the boards for all the kids in the City, not just for her own. She felt 34 that a person on a board should be looking out for the best for everyone and not just themselves. 35 36 The Council recessed at 8:30 p.m. 37 38 The Council reconvened at 8:36 p.m. 39 40 COUNCIL DISCUSSION AND APPOINTMENTS TO COMMISSIONS 41 42 The Council discussed the appointments and voted on the Commission positions. 43 Andover City Council Interviews for Commission Openings Minutes — January 29, 2013 Page 6 1 Open Space Commission 2 3 1. Shane Stenzal Alternatel: Tony Kowalewski Alternate 2: Twila Hauck - Martin Motion by Trude, seconded by Gamache to reappoint Mr. Butler and Mr. Miskowiec and to appoint Mr. Stenzal to the third open seat on the Park and Recreation Commission with Mr. Kowalewski as first alternate and Ms. Hauck -Martin as second alternate. Motion carried unanimously. ADJOURNMENT Motion by Councilmember Knight, Seconded by Councilmember Bukkila, to adjourn. Motion carried unanimously. NPDES (NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM) PRESENTATIONAND PUBLIC MEETING 113 -1 Mr. Kameron Kytonen, Natural Resources Technician, explained the City of Andover is required to comply with the latest NPDES regulations as set forth by the Minnesota Pollution Control Agency (MPCA). One requirement as part of this process is to hold a public meeting to receive feedback on the program. Mr. Kytonen provided a presentation to the Council and the public. Mayor Gamache asked if the information could be made available online for the public. Mr. Kytonen indicated that it will be available. Mayor Gamache noted the recycle center in Andover has an area for used oil. Motion by Bukkila, Seconded by Knight, to open the public hearing. Motion carried unanimously. There was no public input. Mr. Berkowitz reviewed the information with the Council. Councilmember Howard asked where the hammerhead turnarounds will be located at and will this take away land from any residents. Mr. Berkowitz explained where the hammerheads would be located and noted the City will be contacting the residents of possible impacts to their property, if additional easement is necessary that will be negotiated. Councilmember Howard asked if the concrete curb on 160th Lane will be assessed throughout the entire project. Mr. Berkowitz indicated it was, as the development was originally built as one project. Motion by Knight, Seconded by Bukkila, to open the public hearing. Motion carried unanimously. Mr. Corey Moyer, 4754 160th Lane NW, asked what determines when they need to do the projects because this was proposed five years ago and was not done because the economy was not great. But the economy is still struggling and he wondered if this can be postponed. Mr. Berkowitz explained how the City decides when a road needs to be reconstructed. Mr. Moyer asked if the City takes into consideration if the residents involved in the project want the concrete curb along 160th Lane because that portion of Andover, in his opinion, is more rural than other areas. He would prefer to have the City ask the residents impacted if they want the road reconstructed or to wait until the economy is better. Councilmember Bukkila stated those are good questions and if they hold out a few years, the cost of materials will likely rise in price and the reconstruction will cost more if they wait another 3 -5 years. Mr. Moyer asked how the City comes up with the bids and if it was a sealed bid process. Mr. Berkowitz reviewed the bid process the City goes through and indicated the bids are sealed. Mr. Moyer asked if the project will go forward regardless of what the neighborhood wants. Mayor Gamache stated the Council listens to issues that come up on these types of projects, especially lately with the economy being bad. They used to have an eight year financing and they have tried to stretch it out to make payments easier. They try to stay on schedule unless an issue comes up because there are other road projects that have increase in priority. He wanted the Council to take into mind that it is a substantial amount of money and people are not rolling in all kinds of raises. If the City is voting tonight, it does not give him time to talk to the neighbors to come in and give their opinions. He also wondered if the City had a surplus budget to make sure they keep improving their roads right now or could the City save a little by postponing this and perhaps having someone like himself volunteer to help negotiate a little better rate on getting this project done. Mr. Dickinson explained the reason for levying for street reconstruction and the importance of spreading the projects and cost over time. Mr. Moyer wondered if the banks that own the foreclosed homes in his neighborhood will need to pay their portion of the assessment. Mr. Dickinson stated the assessment will go with the property and when the property is purchased the assessment will need to be paid. Ms. Janet Rudlong, 16037 Quapaw Street NW, thought the City should put this to a vote of the 66 residents whether they want a new road or not because she did not think the project would go through. She also noted that her property is a corner lot and in the spring, her front yard is a "swimming pool" because the entire run off comes into her front yard and if the project goes through, she would like this looked at and resolved. Mr. Berkowitz indicated that would be reviewed with the final design. Ms. Rudlong also wondered if a resident were to take out an eight year loan and then decided to sell after four years, would the loan go with the house or would the seller need to pay the loan off before sale of the house. Mr. Dickinson stated generally the title company would require that it be fulfilled at the time of closing and that could be a negotiating point for buyer and seller. PUBLIC HEARING: VACATION OF EASEMENT — WALMART Mr. Carlberg stated the applicant is seeking to vacate roadway, drainage, utility, and trail easements established for Jay Street NW with document number 1485662 and to vacate roadway and utility easements established for Bunker Lake Boulevard NW with document number 1141388. Mr. Carlberg reviewed the staff report with the Council. Motion by Knight, Seconded by Howard, to open the public hearing. Motion by Howard, Seconded by Bukkila, to approve the resolution granting the vacation of easements to vacate city easements ori ginally reserved in document #1141388 legally described on the attached easement vacation Exhibits A and B. (See Resolution R012 -13) APPROVE FINAL PLAT — WALMART AT ANDOVER STATION Mr. Carlberg stated the City Council is asked to approve the final plat for Walmart at Andover Station. Mr. Carlberg reviewed the staff report with the Council. Motion by Bukkila, Seconded by Howard, to adopt Resolution No. R013 -13 Approving the Final Plat of Walmart at Andover Station on property legally described on Exhibit A with Conditions. PUBLIC HEARING /PRIVATE KENNEL LICENSE /15672 KIOWA STREET NW Mr. Dickinson explained a public hearing has been scheduled to consider approval of a private kennel license requested by John and Deborah Dalos at 15672 Kiowa Street NW. Mr. Dickinson reviewed the staff report with the Council. Mr. Dickinson indicated the Dalos' have been very cooperative with city staff. Motion by Knight, Seconded by Howard, to open the public hearing. Motion carried unanimously. Mr. Robert Truchinski, 15700 Kiowa Street NW, indicated he lives next door to the Dalos. He stated Mr. Dalos' dogs are a pain to him because they bark all the time and the owner does not pick up after the dogs so it smells. He indicated the noise and harassment of the dogs is terrible. Mr. John Dalos, 15672 Kiowa Street NW, stated he is the owner of the five dogs and the dogs are indoor pets. He explained that he has lived there 35 years and has always had dogs. He has never had complaints about their dogs, the dogs are friendly, and all get along. Mr. Dalos noted the yard is completely fenced and there has never been an incident of their dogs biting. He stated he was at a loss that the dogs bother the neighbor. Ms. Leslee Curtis, 15730 Kiowa Street NW, stated she is at the meeting to support the Dalos' request along with four other neighbors. She stated she wants to support the Dalos' because she does not hear the dogs barking and has never felt harassed by the dogs. She has never seen the dogs out in the yard without the owners being with them. Mr. Richard Dahlen, 15701 Kiowa Street NW, stated the dogs are not a barking problem. If the dogs bark, the owners are out immediately to stop the barking. He stated the barking is not an issue at all. Ms. Audra Carlson, 15721 Kiowa Street NW, stated she does not have any issues at all with the dogs. Mr. Tom White, 15710 Kiowa Street NW, stated the Dalos have been an asset to the neighborhood. He stated they have never had any issues with the dogs. Councilmember Bukkila read into record a negative letter from Crystal Truchinski, 15700 Kiowa Street NW. Mr. Johns Dalos stated his dogs range in age from 12 years old to under age one. All the dogs get along and are not vicious by nature, none are bite dogs. He stated the dogs are usually outside for five to ten minutes at a time and he is usually with them. The dogs do not like to be outside. Mayor Gamache thought the house was a distance from the neighbors' yard and felt the dogs stay by their home. Mr. Dalos indicated they did. Mayor Gamache stated it seemed to him that the entire yard is fenced and he did not have a problem with this request. Ms. Curtis asked what happens if the police are called due to barking dogs. Councilmember Bukkila reviewed the process the Sheriff's Department takes in determining if there is an issue. Motion by Howard, Seconded by Bukkila, to close the public hearing. Motion carried unanimously. Motion by Bukkila, Seconded by Knight, to approve issuing a private kennel license for John and Deborah Dalos, 15672 Kiowa Street NW, for the period February 6, 2013 through December 31, 2013. Mr. Berkowitz reviewed the staff report with the Council. The Council concurred with the report. SCHEDULE MARCH EDA MEETING Mr. Dickinson stated the Council is requested to schedule an EDA meeting at 6:00 p.m. before the March 5, 2013 City Council meeting. SCHEDULE APRIL 25TH JOINT MEETING WITH LOWER R UM RIVER WMO MEMBER CITIES Mr. Dickinson stated a meeting is scheduled for Thursday, April 25, 2013 at Greenhaven Golf Course in Anoka. MAYOR/COUNCIL INPUT (Polar Plunge at Crooked Lake) Councilmember Bukkila reminded Andover residents to donate to the Polar Plunge that is taking place on February 9, 2013 at Crooked Lake: Regular Andover City Council Meeting Minutes — February 5, 2013 Page 8 (Meeting Reminder) Mayor Gamache stated Monday, February 11th is the Met Council State of the Region Meeting and indicated he was going to be there. 4 (SAC Charges Committee) Mayor Gamache indicated he received a call from Metro Cities 5 regarding SAC charges, a committee they are putting together to discuss SAC charges and they 6 want elected officials on the committee and asked him to be on it. They want some good 7 discussion on where they should go and where they have been, he indicated he would be using 8 Mr. Dickinson as a resource. 10 (Anoka Area Chamber of Commerce Meeting) Mayor Gamache stated the Anoka Area 11 Chamber of Commerce is meeting on February 12th and staff has prepared a great PowerPoint 12 "State of the City" presentation for him to show. 13 14 (Andover Youth Hockey Assn. Thanks) Mayor Gamache thanked the Andover Youth Hockey 15 Association for participating on Hockey Day Minnesota. NW /Storm Sewer Pipe Extension - Engineering DATE: February 19, 2013 INTRODUCTION The City has received a petition from the property owner of 4038 — 153rd Lane NW requesting the improvement for an existing storm sewer pipe extension, Project 13 -17. DISCUSSION It was discovered during a routine storm sewer inspection that the subject property owner constructed a pool /pool patio within an existing drainage and utility easement back in 2006. When the pool was constructed, the property owner extended an existing storm sewer pipe to provide more usable space in the rear yard. The extension construction was completed with no City approval, was not built to City standards and was not inspected by the City. To make the situation acceptable, City staff has work with the property owner to resolve this issue. The property owner agrees to pay the cost to remove the plastic pipe, replace it with concrete pipe and enter into to an encroachment agreement with the City regarding the pool /pool patio construction within the drainage and utility easement. City crews will install the concrete pipe. The petition is the first step in the assessment process. A feasibility report will be prepared and discussed with the petitioner. The feasibility report along with the encroachment agreement will be brought back to the City Council at a future City Council meeting. BUDGET IMPACT The cost of the improvement would be assessed to the property owner over a 5 year period. DISCUSSION The Park Commission held a public information meeting on January 17`h with the neighborhood to discuss possible improvements to the park. Only one resident was in attendance to address the Commission. The City did receive 5 online surveys that were completed by area residents. Based on input from the meeting and in reviewing the surveys received, it was recommended by the property owners to replace the existing playground equipment with new playground equipment for 2 -12 year olds and install a new swing set. The Park Commission also recommended that $24,000 be allocated to this project for equipment and other items such a wood chips for the fall zones, ADA access and borders that will be installed around the equipment. Note: Neighborhood representatives will be involved in selecting the equipment once the City Council approves the improvements. BUDGET IMPACT The improvements are identified in the 2013 Parks Capital Improvement Plan. The total budget available for park improvements for replacement is $56,000. The amount to be allocated to the park is $24,000. The remaining $32,000 will be allocated at a later date with some of the available funding going towards Green Acres Park for playground equipment replacement. The Park Commission is currently discussing the ball field and where the ball field should be relocated at Green Acres Park. DISCUSSION City staff recently met with Cheryl Kortuem, Crooked Lake Elementary School Principal, and Tom Redmann, Anoka Hennepin School District Sites /Grounds Supervisor, to discuss the Joint Power Agreement (see attachment) in regards to the ownership and maintenance responsibility of the playground equipment at the school. This agreement (which has been in place since 1989) is recommend by staff to be terminated. These types of agreements were popular back in 1980's with the thoughts of the Cities and the school district working together to make improvements more economically feasible for projects such as ball fields and playgrounds on school property. By working together Cities would not have to go out and buy land in the same area where a school may exist. Since those days Cities and the school district have changed philosophies. The City of Coon Rapids was involved in a number of Joint Powers Agreement with the school district but has over time terminated the agreements. The reason this came up is that City staff was doing research on the hockey rink and this agreement was found in one of the Crooked Lake School files. Talking with the Crooked Lake Elementary School Principal, the school did replace the equipment within the last couple of years. Since they were not aware of the agreement and the cost sharing of the new equipment, the school did move ahead to replace the equipment as it was outdated and did not meet ADA requirements. The Park and Recreation Commission and Anoka Hennepin School District staff have reviewed the request and are recommending the agreement be terminated. ACTION REQUIRED The City Council is requested to authorize the City Attorney to prepare an agreement with the Anoka Hennepin School District No. 11 to terminate the Joint Powers Agreement for Crooked Lake Elementary School Playground Development. WITNESSETH: Whereas, the parties have previously determined that a sound educational, recreational, and park system for its citizens requires the joint efforts of both parties so as to provide the highest quality system at the lowest cost possible to the citizens: and Whereas, to implement this decision the parties desire to enter into an agreement for the Joint construction and operation of facilities and programs; and Whereas, the parties desire to share in the funding of the construction and maintenance of the proposed improvements for playground equipment; and Whereas, Minnesota Statutes Section 471.59 permits the parties hereto to enter into a Joint Powers Agreement to plan, build, and maintain the proposed improvements. NOW, THEREFORE, pursuant to the authority granted by Minnesota Statutes Section 471.59 the parties doe agree as follows: 1. Purpose. The purpose of this agreement is to enable the City and the School District, through their Joint and cooperative effort to expand the recreational, park and educational facilities available to the parties through the joint financing, construction, maintenance, and supervision of playground facilities at the Crooked Lake Elementary School located in the City. 2. Scope of the Project. The project shall include the construction of a playground at the north end of the school. Iof4 3. Construction Plans and Specifications. Plans and specifications shall be prepared by the Anoka - Hennepin School District and shall be approved by .the City and the School District prior to construction. 4. Project Funding. The estimated cost of the project is $42,000. Funds are available from the Crooked Lake Parent - Teacher Community Organization in the amount of $14,000. The remaining costs of $28,000 shall be shared by the City and School District with the School District contributing $140000 thereof and the City a maximum of $14,000. Change orders or additional costs must be approved in advance by both parties. 5. IT IS SPECIFICALLY UNDERSTOOD AND AGREED BY AND BETWEEN THE PARTIES THAT THE-ACTUAL DIVISION OF THE COSTS BETWEEN THE CITY AND THE SCHOOL DISTRICT SHALL BE BASED UPON ACTUAL COSTS: 6. Contracting Agency. The School District shall act as the contracting agency for purposes of constructing the project. Contracts shall be awarded on the basis of competitive bids in accordance with applicable state statutes. 7. Accounting. The School District shall account to each contributing party of the funds spent on the project. In the event of excess costs, the School District shall be liable for such costs, although they may negotiate with other contractors for more monies. The School District will bill the Crooked Lake Parent- Teacher Community Organization at the completion of the project. The School District will bill the City in January, 1990, for their contribution of one -third of the actual project costs not to exceed $149000. 8. Ownership. In this project, the City and School District each own one -half of the, playground equipment. 2of4 9. Scheduling and Supervision. The school district shall be responsible for all scheduling during school hours. During nonschool hours, scheduling for activities outside of school buildings shall be the responsibility of the Community Services Department in coordination with the building principal. Supervision shall be the responsibility of the group or groups using the facility. In the event of a conflict in the use of a site by the City or school, the Superintendent or his representative and the City Administrator or his representative will govern its use. 10. Insurance. The owner of the land upon which the facilities are constructed shall provide fire and extended Insurance coverage for such facilities, but shall be reimbursed by the other party for coverage extended to ,Jointly owned facilities as their interests may appear. Each party shall be solely responsible for any loss, damage, or injury to any person or property arising out of the use of these facilities by any person or persons under its authorization; and each party shall hold the other harmless from and defend it against any claim, demand or cause of action Initiated to recover the amount of any such loss, damage, or claim for which it is responsible. Each party shall carry at its own expense comprehensive liability insurance covering its potential liability under this Section with personal injury limits of not less than $100,000 per person and $250,000 per occurrence, and property damage limits of $25,000 per occurrence and $50,000 aggregate. A certificate from the insurance carrier stating the limits of liability and specifically referring to this contract and Section shall be furnished by each party to the other before operation is begun. 11. Maintenance of Facilities. Maintenance of property wholly owned by one party shall be the responsibility of that party. Each party agrees to maintain their properties used in the program in a safe, sanitary, and operable condition. Repair costs in excess of $100 for an individual piece of jointly owned equipment, building or facility provided under this agreement shall be shared on the basis of 50 percent City and 50 percent School. District, subject to prior approval by both parties. 3of4 MAINTENANCE TO BE DONE BY THE SCHOOL DISTRICT Mowing of grass Playground equipment. - Maintenance of the minimum playground equipment is the responsibility of -the School District. Maintenance of the playground main structure shall be the responsibility of the School District with the City sharing In the repair costs as indicated in paragraph 11 above. 12. Revocation of Agreement. This agreement may be terminated by either, party by written notice given not less than one year from the proposed date of termination. On termination, either party shall have the option to acquire the playground equipment or structures acquired under this agreement at a negotiated price. In the event that the parties cannot agree on a price, then the playground equipment shall be sold and the proceeds divided equally between the parties. The annual income for senior citizens should be decreased according to the Federal Rent Assistance for Section 8 Housing. That figure is now $28,850 for senior citizens. The annual income for disable individuals remains the same at $45,100. DISCUSSION Nightingale Street NW between Crosstown Boulevard NW and 161" Avenue NW is included in the Capital Improvement Plan for reconstruction in 2013. As a part of this project, a trail is being evaluated for construction on the east side of Nightingale Street NW that will extend from Crosstown Boulevard NW to 157th Lane NW. The proposed improvements include milling and reclaiming the existing roadway, replacement of existing CMP culverts, construction of left and right turn lanes at select intersections along the corridor, construction of an off - street trail along the east side of Nightingale Street NW and paving a new bituminous surface. Estimated project cost for the proposed improvements is $1,551,300.00 which includes construction costs, contingencies, and indirect costs. Typically assessments to benefitting properties for a reconstruction project are twenty -five percent (25 %) of the total project costs for a City standard street section, which is in accordance with the City's Roadway Reconstruction Assessment Policy and Council direction. The remaining seventy -five percent (75 %) of the City standard street section, plus the extra depth and width of the pavement section and trail construction would be funded through Municipal State Aid Funds. With this project there are a limited number of properties fronting the improvements so assessing 25% of those costs is not feasible. The feasibility report identifies assessing a flat rate of $3,000.00 per unit for properties fronting along the improvements. This amount is consistent with similar improvement projects that have been constructed in prior years. The total estimated assessment amount is $39,000.00. The City costs are estimated at $1,512,300.00. The proposed improvements include milling and reclaiming the existing roadway, replacement of existing CMP culverts, construction of left and right turn lanes at select intersections along the corridor, construction of an off - street trail along the east side of Nightingale Street NW that will extend from Crosstown Boulevard NW to 157`" Lane NW, and paving a new bituminous surface. Estimated project cost for the proposed improvements is $1,551,300.00 which includes construction costs, contingencies, and indirect costs. Typically assessments to benefitting properties for a reconstruction project are twenty -five percent (25 %) of the total project costs for a City standard street section, which is in accordance with the City's Roadway Reconstruction Assessment Policy and Council direction. The remaining seventy -five percent (75 %) of the City standard street section, plus the extra depth and width of the pavement section and trail construction would be funded through Municipal State Aid Funds. With this project there is a limited number of properties fronting the improvements so assessing 25% of those costs is not feasible. The feasibility report proposes to assess a flat rate of $3,000.00 per unit for properties fronting along the improvements. This amount is consistent with similar improvement projects that have been constructed in prior years. The total estimated assessment amount is $39,000.00. The City costs are estimated at $1,512,300.00. A neighborhood meeting was held with affected residents to discuss the preliminary project details on November 27, 2012. In reviewing the roadway layout, I think that the Andover staff has done a nice job of adding in improvements given the many wetland constraints present along this corridor. One of the biggest improvements is the multiuse trail. The existing roadway shoulder sees high pedestrian/bike usage, both among kids going to school/YMCA/ball fields, but also among adults and families. With a 55 mph speed limit, the off - street trail will greatly improve safety for everyone. The demand for this trail will continue to rise as the Gray Oaks high density senior development continues to build out. While the dominant movement on the trail is south from the residential areas, many people walk/run up to the corner of Nightingale and 161St, turn around, and then head south to their homes. I have found that the number of pedestrians/bicyclists using Nightingale to be extremely high given the young families living along the corridor. Here are a few ideas to improve the trail design: 1. The current design of the trail has it ending at 157th Ln NW. I would advocate extending the trail north to either 1591h or 161St for the following reasons: The City's Transportation Plan's Future Trail map has a city trail running all the way along Nightingale from Crosstown to 161ST. This trail would connect to another planned city trail along 16150 By extending the trail 0.3 miles from 157th to 159th, the City provides access to a safe trail for approximately another 80 homes and a church parking lot. Currently, these 80 homes are cut off from the City's trail system and are forced to use the shoulders of a 55 mph roadway. I estimate that extending the trail the 0.3 miles from 157th to 159th would cost an additional $60k -$70k (City staff would need to compute the exact cost, but this is a rough estimate). By extending the trail to 161St, you only provide access to three additional homes and a school bus stop, but it does complete a trail segment that is called for in the Transportation Plan. To extend the trail from 157th to 161St, a rough cost estimate is about $90k- $100k. 2. I would propose that we add some trail wavfindina signs /stop signs as part of this project. For example, at the corner of 157th trail users should be directed to head east along the sidewalk to get on the trail on Hanson Blvd. This is a low -cost solution to greatly improve navigation on the City's trail system. 3. I would also add other trail elements such as a bench, bike rack, and waste receptacle at a designated location on the trail. Based on other projects I have seen, the approximate total cost for these three elements (all sitting on a concrete pad) is between $4k and $5k. Generally, on a city trail system, these elements should be added at approximately one -mile increments or less. This is another low cost solution that will add tremendous value to the trail. As Gray Oaks continues to develop, having a bench for seniors will only become more important. Families will also benefit from this low -cost trail amenity. Jerry L. I received this information letter which was sent to Andover Residents & landowners. First this letter was sent by mail either on the 191 or 20o of November, with mail delivery being 1-2 days we would have received it on the 21s or 22 of November which was Thanksgiving day (no mail delivery and the 23^' being a holiday as well then the weekend, a person only had one or at most 2 days to submit our comments on this. If there was travel involved one had no time to do so. I believe this letter should maybe have been sent out 30 days before the meeting was to take place, if are comments were ever wanted or would even be considered. With that / would still like to voice my comments on this matter. /'m a land owner directly on Nightingale Street NW and my concerns are as follows. would hope that all avenues have been considered before the thought of putting in a roundabout on any street or road. First the roundabouts that are being put in Minnesota are only about % the sizes that are in Europe or on the east coast at least in Washington that / have seen or used. Making it hard for school bus, snow removal, emergency vehicles, motorliomes, motorhomes pulling a boat, people with trucks or larger cars puffing a boat or camper, delivery truck, People pulling large trailers with mowing equipment, you can go on & on. The only thing / see the roundabout doing is to let one long lane oftrafi'lcgo while everyone else sits & waits or try's to but in, in which case could cause an accident and. then what? No one goes any place, can emergency vehicles get near or recovery trucks? 2. The cost ofa roundabout is high because all the approaches need to be lengthened and re done. But what the heck the taxpayers can do that. 3. Yes ever one mentioned in number 1. Can take an alternate route but how far do you have to go with gas prices the way they are going and what distance do you have to travel to get back to the route you need to be on. %m not sure who or why someone things we need to be like the Europeans, but since Minnesota got rid of the U80 Code that seems to be the direction we are go why / do not know? To the Part of bring in a consultant to do a study on the pro, jest. Meaning no offence to consultant they are costly and they really don't look at the cost part except it there pay is based on the prefect cost. They most likely don't even live in the area so they won't have to deal with the roundabout if it's put in but they still get paid. The conditional use permit replaced the special use permit in 2004, thus `the conditional use permit amendment request is being applied for. The permitting and amending processes remain the same; only the title of the permit has changed. BACKGROUND The special use /conditional use permit resolution (R254 -88) approved in 1988 permitting outdoor display, sales, and storage for the Andover Downtown Center reads as follows: NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Andover to hereby approve the special use permit requested by the Andover Limited Partnership, on lots 1, 2, and 3 of Block 1 of the Downtown Center, for outdoor displays, sales, and storage during mall operating hours, with the following Conditions: 1. Outdoor displays, sales, and storage shall be conducted during posted mall operating hours only. 2. The location of the sales are to be restricted to the front locations of the mall parking lot, excluding the back receiving and loading areas. 3. If the outdoor displays or sales are kept over night and if display areas are not well lit, that reflective materials be placed on the displays so as to help illustrate the displays for safety purposes. 4. The special use permit shall be subject to an annual review by the Planning and Zoning Commission and the City Council. In 2002, Frattallone's submitted a Commercial Site Plan that was approved administratively which permitted the use of the garden center. With the approval of the garden center, several stipulations were to be followed including: Condition 5: No retail goods or landscaping materials shall be stacked or stored outside of or above the fence. The applicant is seeking to amend the special use /conditional use permit to allow for expanded outdoor display, sales, and storage specifically in side and rear locations. The original special use /conditional use permit allowed this only for "front locations of the mall parking lot." The Commercial Site Plan in 2002 expanded display, sales, and storage to side locations but within the fenced garden center. The applicant is now requesting display, sales, and storage in the side location outside of the fenced garden center as well as the rear location along the fenced border along the northern property line. Both proposed locations for display, sales, and storage will not encroach in the drive lane access. All other aspects of the original permit will remain unchanged. DISCUSSION City Code 12 -14 -6 C states that an amended application shall be handled in a similar manner as that of a new conditional use permit. City Code 12 -14 -6 B. provides the following criteria for granting conditional use permits: 1. In granting a Conditional Use Permit, the City Council shall consider the advice and recommendation of the Planning and Zoning Commission and: a. The effect of the proposed use upon the health, safety, morals and general welfare of occupants of surrounding lands. b. Existing and anticipated traffic conditions, including parking facilities on adjacent streets and land. c. The effect on values of property and scenic views in the surrounding area, and the effect of the proposed use on the Comprehensive Plan. 2. If it shall determine by resolution that the proposed use will not be detrimental to the health, safety, morals, or general welfare of the community, nor will cause serious traffic congestion or hazards, nor will seriously depreciate surrounding property values, and that said use is in harmony with the general purpose and intent of this title and the Comprehensive Plan, the City Council may grant such permits. PLANNING COMMISSION The Planning Commission held a public hearing and recommended approval of the conditional use permit amendment with a 6 —1 vote. Based on suggestions for the Commission, conditions 5 through 8 were added to the resolution. You would also be allowed to use the same area to sell plants and nursery products inside the fenced area from April 15u' through September 1" each year, as well as for pumpkin sales in the fall, and Christmas tree sales between Thanksgiving and Christmas. The City will allow these uses of the area as long as you are in compliance with the conditions that have been written in this letter. Phvsical Improvements to the Site Some of the physical improvements that you have indicated that you are planning include a new 6 foot high black tubular steel (looks like wrought iron) fence around the entire garden center area (47' x 107'). Also, two twelve foot wide gates would be installed along the easterly fence line (open during business hours). During the staff's review, there was general consensus that there was a need to have the owner of the property make some modifications to one of the driveway curb islands that exist in front of the hardware store. This would need to be reconstructed by the owner of the property, but would be a condition of your site plan approval. I am attaching a photo and diagram of the curb island/driveway that will need to be modified to prevent the traffic entering the site from encountering an unsafe condition. Also, staff felt there should be a couple of safety improvements along the edge of the fenced garden center. The first would be to stripe an area eight feet wide along the entire fenced area to allow for people walking and either loading or unloading to have a place to temporarily park. The second would be to install a stop sign at the southeast corner of the garden center to stop people driving along the easterly side of the garden center before they enter the main driveway for the shopping center. The City of Andover will allow the Garden Center, to open and become an annually renewable operation provided that there are no significant changes from the way the operation is currently being reviewed and. approved. If significant changes are made, City staff would like to review them with the store manager each spring, prior to opening the garden center. It is expected that you will work with the landlord and City to achieve the listed requirements of this Commercial Site Plan approval. Frattallone's Garden Center (Commerical Site Plan Review) Conditions to adhere to for the garden center Page 2 I. Gate access, exiting on the east side is recommended and the gates need to remain open during business hours. The gates would also be restricted to either be sliding, or if hinged, be opened fully and secured to stay fully open during business hours. 2. A striped area for pedestrians shall be painted on the pavement for a distance of 8 feet from the proposed fencing on the south and east sides. This is to provide a safe area in which customers may temporarily park to load and unload goods being purchased. No long term parking shall be allowed anywhere along the fenced area (only temporary loading and unloading is allowed). There will need to be no parking signs installed along the fence to prevent people from parking there. The locations of these signs will need to be shown on the site plan on file with the City. 4. No signs (except "No Parking —By Order of the Fire Chief') shall be attached to the fence, ,-5. No retail goods or landscaping materials shall be stacked or stored outside of, or above the fence. 6. The owner of the store shall perform regular maintenance within and around the garden center to prevent blowing trash. The green house shall be routinely maintained and kept in a like new appearance. No tattered or ripped plastic covering shall be allowed. If not kept in a new appearance, the hoop house shall be removed. 8. Supplemental lighting shall be added along the easterly side of the garden center fence to illuminate the area to avoid potential conflicts between vehicles and customers. 9. There are a few pallets stored outside of the outdoor storage area on the north side of the store. These shall be moved to inside of the fenced area out of sight. Im rovements that must be Dreformed by the owner of the property: 1. The roof of the shopping center is showing signs of wear and should be repainted. 2. Remove and reconstruct the curb island in the front driveway of the shopping center to allow for safe traffic flow (see diagram and photograph for details). Install a stop sign at the southwest comer of the garden center to prevent vehicles from entering the main driveway along the front of the shopping center. Mr. Liska reviewed the staff report with the Commission. Commissioner Gudmundson asked if the Conditional Use Permit was just for Frattalone's or the Downtown Center. Mr. Liska indicated it was for the Downtown Center. Commissioner Gudmundson wondered how that will work with other Conditional Use Permits other businesses would have. Mr. Liska stated a Special Use Permit was granted to the downtown center as a whole so all of the businesses are allowed to display, store and sell in the front area, with the amended CUP, they are including side and rear locations but that is with City approval. Commissioner Holthus indicated they needed to have fire standards in the front of the building in order to have storage there. Mr. Liska indicated that was correct and the fire code would remain in place throughout the area. Commissioner Peterson asked if in the front of the building, Frattalone's is allowed to store items outside. Mr. Liska indicated that was correct. Commissioner Nemeth stated on the map in area number two, the storage will be encroaching in the driveway and he asked for clarification on this. He also wondered if 24 feet will allow two vehicles to pass each other in that area. Mr. Liska stated they are well over the minimum requirements for the driveway. Commissioner Holthus asked what the items would be that would be stored on the east end next to the driveway. Commissioner Kohler asked was there any stipulation or guidelines as to how high the items can be stacked. Mr. Liska indicated that was something that could be included in the resolution. Mr. Michael Frattalone, 3527 North Lexington Avenue, Arden Hills, made a short presentation to the Commission. Commissioner Holthus asked what types of products would the business plan to sell on the east end. Mr. Frattalone indicated they would be palletized products. Mr. Frattalone indicated this would be excess stock and nothing would be sold in this area, just storage. Commissioner Holthus wondered if there was any thought to having the pallets that people can purchase from in area #1 rather that in the other area. Mr. Frattalone indicated the location is far from the garden center and would be inconvenient and could be a hazard for the customers. Chairperson Daninger wondered what the anticipated height will be for the pallets in area #1. Mr. Frattalone indicated a large pallet of mulch might be six foot tall and do not tip over easily. The more they can stack pallets of dirt on top of each other the smaller the footprint and could make the area look better. He thought the maximum would be seven feet high and that would be stacking two pallets on each other. Commissioner Kohler asked if Mr. Frattalone thought if any of the products would be higher than the fence. Mr. Frattalone did not think it would and did not think they have ever peaked over the fence. Commissioner Cleven asked on the unwrapped product, is there a plan to replace the product back onto the pallet if a customer removed it from the pallet and did not purchase it. Mr. Frattalone stated they do clean up the area periodically during the day. Commissioner Gudmundson asked if there was any thought to expanding the garden center fence to include the stacks outside of the fence. Mr. Frattalone indicated he has not because the bags are very heavy and would not be easy to move from behind the fence to a vehicle. Commissioner Peterson asked if there has been any thought to moving the extra product to another area so there is less likelihood of theft. Mr. Frattalone indicated most of the product is stored within the fence and if it can be seen from the road there is less likelihood of theft or vandalism. Commissioner Peterson stated it looked like if there is anything on the front sidewalk could a wheelchair get by. He did not think it looked ADA accessible. Commissioner Koehler stated in area #1, how deep are the pallets going to go in the area. Mr. Frattalone indicated it would be one deep with potentially two pallets high. Commissioner Nemeth stated he would like to install some kind of height requirement in area #1 so it does not exceed the height of the fence. Chairperson Daninger asked if there was a timeline for these areas. Mr. Frattalone indicated in the winter they do not have any outdoor storage. He noted he could work with staff on this. Commissioner Nemeth stated he would like to see the height limit added to the resolution but he would also like to see something put into the resolution that items in the back of the fence are not stacked above the fence line, everything is below it. The Commission discussed the parking area and problems and obstacles that could occur with flow through traffic. Commissioner Cleven wondered if an emergency vehicle could make it through the area with the storage located in the parking area. Chairperson Daninger was not sure but he thought staff would make sure that emergency vehicles would have adequate room to maneuver through the area. Commissioner Gudmundson stated she had some concerns aesthetically, primarily the views for all the neighboring properties and she thought they needed to give some consideration for them and what it might do to their property values because she did not think allowing all the items to be stacked up outside will be a pleasing look for the area. She stated she would like Frattalone's to expand their fence along the side minimally to cover the stuff that goes up next to the garden center and maybe fence in the stuff in the back also. She thought the idea of using restriping where the parking was on the side is also a great idea and would take care of her safety concerns. Commissioner Peterson thought Frattalone's could move the driveway so it goes straight south into the intersection and restripe part of the existing driveway as a loading area. He agreed with the fencing in of area #1. The Commission discussed the pros and cons of extending the fence in the garden center. Motion by Holthus, seconded by Koehler, to recommend to the City Council approval of Resolution No. _, with the stipulation that product on pallets is not to be above a safe height, which will be determined by staff and allowing good transportation flow in the driveway on the east side of the hardware store with the understanding that staff will review the amount of parking spaces required and possibly eliminate those west of the bank. Amendment two is to identify the dates when outdoor sales will occur and have those dates of outdoor sales be consistent with what they have previously indicated for other businesses in the City. Amendment three is to be certain that entrances comply with ADA regulations. Motion carried on a 6 -ayes, 1 -nays ( Gudmundson), 0- absent vote. City Planner Hanson stated that this item would be before the Council at the February 19, 2013 City Council meeting. 1/25/2013 Dear Mayor, Council Members and Planning Committed Members, Frattallone's Ace Hardware would like to request an amendment to the SUP of 1988 for our site at 13735 Round Lake Blvd. After working with the staff from the city, Frattallone's is requesting the following. • We would like to retain storage and outdoor sales in the following areas- northern most area along the fence, not to impede on the flow of traffic around back of building- area #1, the eastern run of the garden center fence (outside of the fence) not to impede on traffic flow between bank and our site- area #2 and lastly, the front or southern sidewalk on our property - area #3, not to impede on the walking traffic that is using the sidewalk now. • We will discontinue use of the parking area that is on the eastern most side of the lot between the bank and our site- area #4. • We will use the fenced in area in the rear of our building to store as much product as possible thus keeping the center clean while still allowing us to progress as a business. • All empty pallets will be removed in a timely fashion and nothing will be stored outside just for the sake of storage. Public Works Director 010 SUBJECT: Presentation of Sports Complex Master Plan /3535 —1615` Avenue NW /12 -31 -- Engineering DATE: February 19, 2013 INTRODUCTION A presentation on the proposed 40 acres Sports Complex Master Plan located at 3535 -161" Avenue NW, Project 12 -31, will be conducted by Jason Amberg from WSB and Associates. DISCUSSION Attached is the proposed Master Plan that will be presented and discussed. Also an Open House was held on February 7, 2013. There was a very good turnout of residents that lived near the proposed complex along with other Andover residents. Listed below are questions, comments and concerns that were raised during the Open House along with staff response: 1. There was a concern about vandalism in the complex and the neighborhood would like to see entrances gated. Staff response: Certainly staff cannot guarantee there will be no damage within the complex. As like any City or park property hopefully the neighborhood and users of the complex will do their part and report any suspicious activity or vandalism immediately to the Anoka County Sheriff's Department. There will be an Anoka County Sheriffs Department Community Service Officer'that is contracted with the City to patrol the parks periodically during spring, summer and fall which hopefully will deter any unwanted activity. The neighborhood has asked about the possibility of installing gates. It has not been past practice to install gates in other City parks. The problem is if gates are installed at this location there will be other parks in neighborhoods that will want gates (example Prairie Knoll Park which has had a number of issues over the years). The other issue is if you want to make sure the gates are opened and closed at the end each day, the city would need to hire someone to do so. The Anoka County Park and Recreation Department has gates at most of their parks but they too have said the gates are left open all season unless there are issues with vandals. But even sometimes when the gates are supposed to be closed at the end of each day they are not. 2. The neighborhood is interested in having the complex lit. Staff response: At this point security lighting is included in Phase 1 construction for the parking lots and drive aisles to deter individuals wanting to hang out after hours. The other concern that was mentioned by one of the residents is a curfew and closing of the complex at dusk. This was discussed in the past by the Park Commission and the City Council to change the City Code but there was not enough support to do this. Park hours per City code are from 6 am until 11 pm. The concern the City Council had was that closing the parks at dusk would not allow residents to enjoy the use of the parks. There are residents that like to walk their dog in the parks or like to take advantage of sledding hills, playing football or hockey after dusk. 3. A concerned was raised regarding the speed along 16st Avenue NW. It was mentioned that they would like to see the speed limit reduced along this section. Staff response: The posted speed limit along this section of street is 35 MPH. Since this section of street is located in a rural area of the City, the Minnesota Department of Transportation (MNDOT) would most likely not approve the speed to be posted any lower than it currently is. Once the Complex is open for use the City Council could request a speed study. 4. The amount of parking was brought up as a concern. Staff response: The number of parking stalls was calculated based on the recommendation from WSB for similar types of parks. The plan currently identifies 182 parking stalls with the possibility of an additional 20 -24 parking stalls could be added if the parking lot gets to capacity. It has been discussed with the Park Commission that when scheduling football games, no more than 2 games are to be played at the same time. As far as soccer, there has not been an parking issue at either Prairie Knoll or Hawkridge Park, so at this time we do not expect many issues if all 3 fields are scheduled at the same time. Lacrosse Association uses Prairie Knoll Park and to date there has not been any issues with parking. 5. The neighbors east of the Sports Complex are concerned with vehicles parking at the end of the cul- de -sacs (162nd Lane and 163`d Lane) and walking across their property to access the Complex. The neighbors would like for the City to install signs indicating "No Parking ". Staff response: The property owners should post their property as "No Trespassing ". If individuals are trespassing, the landowner could talk with the individual(s) or contact the Anoka County Sheriff's Department. If a problem occurs after the Complex is open, property owners can petition the City Council to post "No Parking ". 6. Residents indicated to staff that they would like to see the parking lot paved as part of the Phase 1 construction to control the dust. Staff response: Staff indicated to those in attendance that paving the parking lot is not part of Phase 1 construction but could certainly discuss this further with the City Council. 7. There was mentioned to staff to make sure that enough restrooms be provided. Staff response: Staff would look at providing a portable restroom for the north field and one closer to the south which is typically done at other parks or facilities similar to this complex. Once a permanent building is constructed (which will include restrooms), temporary portable bathroom would still be provided during the peak season which is spring, summer and fall. This is consistent with other community playfields such as Sunshine Park, Prairie Knoll Park and Andover Station North Ball Field Facility. 8. It was mentioned to make sure that enough trash and recycling bins are provided at the Complex. It was also mention that the bins are to be attractive looking. Staff response: The Public Works Parks Maintenance staff is very familiar based on past experience as to what will be necessary to take care of the trash and number of containers would be consistent with other similar complexes. As far as recycling, recycling bins will also be placed at the locations of the trash bins. The recycling bins that are installed are received from Anoka County as part of the recycling program and there is no additional cost to the City to get them. If it is determined that there is not enough bins (trash or recycling), Public Works Parks Maintenance staff will have additional bins installed. 9. It was mentioned that those in attendance would like for the trails to be paved including the trails located on the west side of the Complex. It sounds like they would like to ride, walk or roller blade on a hard surface and not on a gravel or wood chip trail otherwise there will be limited use of the trails. Staff response: Paving of all trails within the complex is not in the overall improvement cost. The trails around the parking lot and ball field in general are to be paved. This is not uncommon. My family walks along this stretch on the road where the trail ends with our two strollers or double stroller. The posted speed is very fast (55 ?), so it could be very dangerous. It is probably only a matter of time before someone is hit!
