US TO: HRA Chairman and Commissioners FROM: Jim Dickinson, City Administrator SUBJECT: Oath of Office - New Housing and Redevelopment Authority Commissioner DATE: May 5, 2009 INTRODUCTION The Andover HRA Commissioners are the members of the Andover City Council and serve on the HRA with terms that coincide with their Council terms. DISCUSSION HRA Commissioner Ken Orttel's term on the HRA has expired as his City Council term has expired. Sheri Bukkila was the successful candidate to secure the City Council seat vacated by © Ken Orttel and should be acknowledged as a HRA Commissioner, and the oath of that office conducted. ACTION REQUESTED An oath of office for Commissioner Sheri Bukkila will be conducted by the City Clerk. When the County created an HRA in 1994 the decision was made to only levy in those communities that did not have a City HRA. I have attached the City of Andover's discussion from back in 1995, when Andover was asked to join the Anoka County HRA. The County HRA currently levies in Bethel, Centerville, Columbia Heights, Columbus, East Bethel, Hilltop, Lexington, Linwood Township, Nowthen, Oak Grove, Ramsey, Spring Lake Park and St. Francis. DISCUSSION The County has received a legal opinion stating that not only does the County have the authority to levy in all cities within the County without the consent of the cities, but also that they do not have the authority to "spread its levy across an area which is smaller than the area of its taxing district ". If a County -wide HRA levy is adopted for 2010, all residents in Andover would have an additional tax to pay. At this time, the County HRA has yet to decide on a levy amount or on how any funds would be spent. Attached is a resolution that the Housing and Redevelopment Authority is requested to consider that is similar to a resolution that the City of Anoka and City of Andover have adopted opposing the Anoka County HRA levy. Peach Recording Secretary L7 2 i —3^ V H ANDOVER HOUSING AND REDEVELOPMENT AUTHORITY CITY OF ANDOVER, MINNESOTA RESOLUTION RES A RESOLUTION OPPOSING THE AUTHORITY OF THE ANOKA COUNTY HOUSING AND REDEVELOPMENT AUTHORITY TO LEVY SPECIAL BENEFIT TAXES IN THE CITY OF ANDOVER WHEREAS, the City of Andover Housing and Redevelopment Authority was created pursuant to State Statute and has been in existence since May 5, 1987; and WHEREAS, the City of Andover Housing and Redevelopment Authority has received information that the Anoka County Housing and Redevelopment Authority has received a legal opinion suggesting that it has the authority to levy special benefit taxes within the jurisdiction of a city in which there already exists a municipal housing and redevelopment authority without first obtaining the consent of such city; and WHEREAS, upon review of the legal opinion rendered to the Anoka County Housing and Redevelopment Authority, the City of Andover Housing and Redevelopment Authority finds that the opinion fails to set forth conclusive, legal authority authorizing the Anoka County Housing and Redevelopment Authority to levy said special benefit taxes as alleged; and WHEREAS, review of Minnesota State Statutes relevant to this subject matter further brings into question the authority of the Anoka County Housing and Redevelopment Authority to levy special benefit taxes in those municipalities which currently have established housing and redevelopment authorities without the consent of the municipality; and WHEREAS, in order to preserve its rights and protect the welfare of its citizens, the City of Andover Housing and Redevelopment Authority urges the City of Andover City Council to make known its opposition to the Anoka County Housing and Redevelopment Authority's levying of special benefit taxes in the City of Andover absent conclusive, legal authority to do so. NOW, THEREFORE, BE IT RESOLVED, that the City of Andover Housing and Redevelopment Authority hereby opposes the alleged authority of the Anoka County Housing and Redevelopment Authority to levy special benefit taxes in the City of Andover and support the City of Andover City Council in doing the same.
