Adjournment H r -0 u ;I.Oill s r- ," a ANDOVER CITY COUNCIL WORKSHOP MEETING — JANUARY 31, 2012 MINUTES The Workshop Meeting of the Andover City Council was called to order by Mayor Mike Gamache, January 31, 2012, 6:03 p.m., at the Andover City Hall, 1685 Crosstown Boulevard NW, Andover, Minnesota. Councilmembers present: Sheri Bukkila (6:10 p.m.), Mike Knight, Julie Trude, and Tony Howard Councilmember absent: None Also present: City Administrator, Jim Dickinson City Engineer /Director of Public Works, David Berkowitz Community Development Director, Dave Carlberg DISCUSS STREET LIGHTING FOR B UNKER LAKE BOULEVARD NW WEST OF ROUND LAKE BOULEVARD NW/10 -27 City Engineer Berkowitz stated the City Council directed staff to contract with Connexus for lighting along Bunker Lake Boulevard NW from Round Lake Boulevard to 71' Avenue NW. Connexus is proposing LED fixtures. The cost to install the lights will be funded by Municipal State Aid funds and the ongoing electrical and maintenance costs would be funded by the City's General Fund. He reviewed the proposed lighting layout and the estimated cost of construction along with the monthly electric and maintenance costs. The lights will be mounted on a 30 -foot fiberglass pole. He showed what the lights would look like and explained the lights would still provide adequate coverage even if one of the LEDs were out. Staff is recommending the lights be installed on the side of the road with the trail, approximately 200 -feet apart. This will still provide good light for the entire road surface. Mayor Gamache stated there would also be additional lighting at the intersections. City Engineer Berkowitz stated every traffic signal would have a light. Councilmember Trude asked if the City had any lights in the park or along the trail. The City could look at replacing any security lights, in this area, with this project. City Engineer Berkowitz stated staff would look into this. 0 Councilmember Bukkila entered at 6:10 p.m. Councilmember Trude stated the lights use less energy and it would be worth looking into other lights along this project area to see if there are any that could be changed over. © Andover City Council Workshop Meeting Minutes — January 31, 2012 Page 2 City Engineer Berkowitz stated staff was looking at installing LED lights at Sunshine Park as well. He asked the Council if they wanted to go with the standard bronze color or if the Council would like to continue using the purple color that has been used in other areas of the City, such as Andover Station North and along Hanson Boulevard. Mayor Gamache stated the bronze would be acceptable. Councilmember Howard and Trude agreed. Councilmember Bukkila asked how much more the colored fixtures would be. Councilmember Bukkila stated the City should remain consistent along the main corridors of the City. City Engineer Berkowitz stated he did not have this information but would provide it for the Council at the next meeting. DISCUSS 2012 COUNTY OVERLAYS City Engineer Berkowitz reviewed the sections of road the Anoka County Highway Department has plans to overlay in 2012: 1615` Avenue NW (CSAH 20), Andover Boulevard (CR16), and Hanson Boulevard NW (CSAH 78). The County received funds for a traffic signal at Hanson Boulevard and 16151 Avenue NW. Construction for this traffic signal project including the approaches is planned for 2014. If the City is interested in constructing trails or other improvements along these project limits the County will include such improvements. All costs associated with additional improvements would be the City's expense. Mayor Gamache asked if there are any wetland restrictions along these routes that would impact potential trail locations. City Engineer Berkowitz stated there are wetlands on the north side of 161" Avenue and the City would need to work with the County in these areas. Councilmember Bukkila stated she would like to have the City consider a trail on the north side 161St Avenue between Crane Street and Vale Street. City Engineer Berkowitz stated this would be one location to consider. The City could also consider a trail located along Andover Boulevard. Because these are reconstruction projects and there are no barrier curbs, the trails would need to be a minimum of 20 -feet off the roadway. The County may decide to push the Andover Boulevard project off until 2013 and this may impact © the City's decision on potential trails as well. The City may need to look at easements as well in determining potential trail locations. Councilmember Trude suggested staff talk to the County to be sure they will be fixing the problems at the railroad crossings with the reconstruction projects. © Andover City Council Workshop Meeting Minutes — January 31, 2012 Page 3 City Engineer Berkowitz stated the County is aware of these problems and will be addressing them with the reconstruction project. Councilmember Bukkila asked where the trail would connect if it were part of the Andover Boulevard project. City Engineer Berkowitz stated the trail could start at Bluebird Street and go as far as the City would like on the south side of Andover Boulevard. The trail could connect to either the neighborhood or to existing trails. He stated that crossing the railroad tracks would be a considerable expense for the City and staff would not promote having a trail crossing over the railroad tracks. Councilmember Howard stated the City has received several comments in regard to a trail along Andover Boulevard. Councilmember Trude suggested the County meet with the City to discuss these potential trails to determine if there is any possibility of applying for and receiving grant funds for these trails. Councilmember Trude asked staff to talk to the County about adding striping for a right turn lane into the neighborhoods along Hanson Boulevard. She also suggested the Council discuss the County roads within the City at the next workshop. U -HAUL STORAGE — STOP -N -SHOP Community Development Director Carlberg stated the Andover EDA discussed the operation of a U -Haul rental business at the Stop -N -Shop convenience store located at 13725 Crosstown Drive NW as part of the Crosstown/Bunker Redevelopment Area. The Andover EDA was generally not supportive of this type of operation but believed additional discussion was warranted. The business owner submitted a petition requesting that the U -Haul business be allowed to continue. The City Code does not allow either by permitted or conditional use, a rental business in the Neighborhood Business (NB) District. In order to allow the use to continue, a zoning change to the property would be necessary or the City Code would need to be amended to allow rental businesses in the NB District by either a permitted or conditional use. Another possibility is to examine amending the City Code to provide for an Interim Use Permit (IUP) process and allowing the use to continue under this provision. Councilmember Trude stated the City should have Interim Use Permits included in the code. Mayor Gamache asked if the applicant would be able to request an extension or renewal of an Interim Use Permit. Community Development Director Carlberg stated the applicant would be able to request an extension or renewal. The purpose of an Interim Use Permit is to allow the City to look at © Andover City Council Workshop Meeting Minutes — January 31, 2012 Page 4 allowing a particular operation in a district that would otherwise not be allowed. If the Council decides to move forward with adding an Interim Use Permit to the City Code, then there would be some procedural changes. The overall process would be similar to that used with the Conditional Use Permit including an application and public hearing process. The City would be able to set conditions and limits on what would be allowed with the Interim Use Permit. In this particular situation, the City could limit the number of trailers that were in front of the building and where they are stored. Councilmember Howard asked if the Council could limit the use to one (1) year since the owner has indicated they will not be renewing their lease after this year. Mr. Marwan Merhy, owner of the Stop -N -Shop, stated he has been working to keep the trailers and trucks on the north side of the building so they are out of sight. This has been done by the end of each day. They have kept one in front of the building as advertisement but this would not be necessary. Community Development Director Carlberg stated this is an example of something that could be established during the Interim Use Permit process. If the City wants to move forward with an © Interim Use Permit process the Planning Commission would first review the parameters and uses and then it would come before the City Council for approval. This could happen by March. Once the City has approved adding an Interim Use Permit to the City Code, Mr. Merhy could make an application and work through the process for potential approval. The City would be able to add conditions at that time and if these conditions are violated the City would have the ability to revoke the Interim Use Permit. If the City does move forward with this process it is unlikely an Interim Use Permit could be approved before June 2012 for the Stop -N -Shop location. Staff would recommend the City allow the Stop -N -Shop to continue with the U -Haul operations until that time. It was the consensus of the City Council to allow the Stop -N -Shop to continue operating the U- Haul operations in their current location until an Interim Use Permit could be applied for provided the owner continues to maintain an orderly appearance. DISCUSS ASSESSMENTS 111- 401133rd AVENUE NW RECONSTR UCTION City Engineer Berkowitz stated the proposed improvements to 133`d Avenue NW include milling and reclaiming the existing roadway, replacing isolated segments of deteriorated concrete curb and gutter, minor storm sewer repairs, and paving a new bituminous surface. The total estimated cost of the proposed improvements is $860,430.00. The project costs are proposed to be split equally between Coon Rapids and Andover. There are only two (2) properties within Andover ® that front along this project. The City of Andover typically assesses 25% of the total project costs for street improvements to properties fronting the improvements, but based upon the limited number of properties this is not feasible. Staff is recommending assessing the two (2) parcels in Andover a flat rate of $1,500 per lot for the improvements. This rate is similar to other © Andover City Council Workshop Meeting Minutes — January 31, 2012 Page 5 recent reconstruction projects completed within Andover. Councilmember Trade stated this was a fair assessment. Mayor Gamache agreed with the $1,500 assessment rate. Councilmember Knight stated the City should go with a straight $1,500. Councilmember Bukkila agreed and asked when the project was expected to start. City Engineer Berkowitz stated this is expected to be the City's first project in the spring and will start mid -May. It will take approximately 4 to 6 weeks to complete. The road will be closed to through traffic but will be open to local traffic. He stated staff had not met with the two residents in the project area and would be doing this once there was direction from the Council on the assessment rate. Councilmember Trade stated the assessment for the Johnson's Oakmount Terrace reconstruction project was estimated at $7,000 and the Council has been able to get this rate to approximately $6,000. She asked if it would be possible for the City to set the assessment for this project regardless of what the bids come in at. If they were favorable then the City would benefit but if not then the City would pay the overage. City Engineer Berkowitz stated after the last meeting staff did look at the alternatives the Council had requested. If the City pays for the north side of the road then the assessments would be approximately $6,170. If the bids are favorable then the assessment could be less than $6,000. Councilmember Knight stated setting an assessment rate and then not adjusting it based on the actual costs would be setting a precedent for future projects. Councilmember Trade stated the City is offering to pay for more of the project in this situation and should consider setting the assessment. Mayor Gamache stated the Council had talked about the assessments for this project at a workshop and he had favored a lower assessment at that time. He would recommend the Council stay with the current policy and base the assessments on the actual project costs. City Engineer Berkowitz explained in the Johnson's Oakmount Terrace project the City is proposing to pay for 100% of the north side of the road and 100% of the extra road width and additional road thickness. It was the consensus of the Council to proceed with an assessment rate of $1,500 for the 133`d Avenue NW road reconstruction project. © Andover City Council Workshop Meeting Minutes — January 31, 2012 Page 6 DISCUSS CITY'S PAVEMENT MANAGEMENT PROGRAMISEAL COAT AND CRACK SEAL City Engineer Berkowitz stated currently the City would crack seal a development and follow up the next year with a seal coat. This program has become much smaller the last few years due to budget constraints. Over the past few years, staff has noticed flaking of the seal coat and gaps within the crack seal placement. Staff met with MNDOT Materials personnel to discuss our concerns. They recommend holding off on seal coating for 2012 until more information is available and/or an alternative product such as a fog seal has been researched. If fog sealing becomes available it will be a quarter of the cost of traditional seal coating. Currently fog sealing takes 4 hours to cure and this is generally not feasible. Councilmember Bukkila asked how many times a road was typically seal coated. City Engineer Berkowitz stated the City is on a 7 year cycle for seal coating roads but this would be 4 to 5 years if the City moves to fog sealing. Crack sealing has been more effective on the newer pavement so he would recommend the City do a grout crack seal within the first 4 years. If the City decides to wait and there is a product available next year then the City will do a larger project at that time. It was the consensus of the Council to not proceed with seal coating for 2012 and reevaluate the products available for a potential seal coat project in 2013. DISCUSS TRAIL PLANAND POLICY, CONTINUED City Engineer Berkowitz stated the Park and Recreation Commission at their October 20t1i meeting expressed interest in having a role in trail planning. Staff in reviewing this request has pointed out to the Commission that there is a policy in place that was approved by the City Council that establishes the protocol for the planning, design, construction, and financing of regional trails. At this time, staff does not feel that any changes should be made to the trail planning policy since it has gone through extensive review just a few years ago. The next time the trail plan will be reviewed is when the overall City Comprehensive Plan needs to be updated. If the Council would like for the Park Commission to have some input to the trail planning, the Council could revise the policy. Councilmember Bukkila suggested City Engineer Berkowitz review the Transportation Plan including the Regional Trail System and how residents travel along this system with the Parks Commission. The Council concurred. © City Engineer Berkowitz stated he could explain to the Commission how trails tie into the overall system and that some trail sections may not be feasible. Councilmember Trude stated the trails are used for walking and biking for health and this is a Andover City Council Workshop Meeting Minutes — January 31, 2012 Page 7 natural tie into recreation which is what the Park and Recreation Commission is responsible for. Councilmember Knight stated the City should have a master plan and map of the City, which shows this plan. City Engineer Berkowitz stated the City does have a master plan and it is part of the Transportation Plan. This plan includes the regional trail system. Councilmember Trude stated the City has approved trail sections that are not part of the Transportation Plan including the discussions earlier on a trail section along Andover Boulevard or 161" Avenue. City Engineer Berkowitz stated these sections are on the Transportation Plan and part of the Regional Trail System the City has planned. Councilmember Howard stated the City Council should continue to make decisions regarding the regional trails while the Park and Recreation Commission look at trails that feed into this system and connect the parks. Mayor Gamache stated if the Park Commission wanted to look at a station exercise program in the parks they could do that but the City plans the trails because the Transportation Fund funds these. The Transportation Plan should be reviewed with the Commission. They can work on programs that add to the parks along the trails. Councilmember Bukkila clarified the Commission reviews where recreational facilities may be located along the trails and in the parks. Councilmember Trude stated they would also find areas that could be connected to the trail system and make recommendations to the Council. City Engineer Berkowitz stated there were a couple of Commissioners that felt the Park Commission should have a say in all the trails that are in the City. Councilmember Bukkila stated they are responsible for the recreational aspect of the trails and they should be provided with an overview of the trails the City is considering and the overall Transportation Plan. City Administrator Dickinson agreed the Park Commission can make suggestions and provide input but the Council makes the final decisions. © City Engineer Berkowitz stated as the City plans trails they include the Park Commission whenever they can but adding another layer of involvement and approval is not needed. The Park Commission will have more input as the parks are redeveloped. Andover City Council Workshop Meeting Minutes — January 31, 2012 Page 8 Councilmember Trude stated she does not want to see the City sacrifice trails that are part of the City's long -term plans because of the cost. City Engineer Berkowitz stated the City has evaluated all of the trails and been able to meet in the middle of cost and benefit. It was the consensus of the Council to not change the City's Trail Planning Policy. The Park Commission can provide input on potential trails but the Council will maintain the final approval. The City will share information regarding potential trails, as it is available. CONSIDER IRRIGATION /12- 161WOODLAND ESTATES PARK City Engineer Berkowitz stated the improvement to irrigate Woodland Estates Park is included in the 2012 CIP. Staff has had discussions with the property owner on the east side adjacent to the park about the possibility of connecting into the property owner's irrigation system and entering into an agreement for the use of their water connection. The other option for the City is to make a direct connection into the existing water main. He reviewed the costs for each proposal. © Councilmember Bukkila asked if the City tied into the adjacent property's sprinkler how this would be protected in the future if the property were sold. City Engineer Berkowitz stated the agreement could be recorded with the property so if the property changes owners it would still be in effect. Councilmember Knight asked if the water system at the adjacent home was large enough to accommodate the added zones. City Engineer Berkowitz stated the system would be large enough and the City would schedule it to run on the opposite days as the property owner. If the City decides in the future that the arrangement is not working then it would not be difficult redo the connection. City Administrator Dickinson stated he thought it would be better for the City to spend the extra money at this time to better maintain control. He asked if this was a burden the City wanted to put on an individual resident. Councilmember Bukkila expressed concerns that the costs to do the connection were over the budgeted amount. She suggested an assessment to the neighborhood to cover the additional cost. © Mayor Gamache stated if the water connection charge were waived then the project would be within budget. The park would be irrigated for the residents of the neighborhood only. It would be a waste of money to pay for the water connection. Councilmember Trude stated the park should be irrigated. When it does not look good it Andover City Council Workshop Meeting Minutes — January 31, 2012 Page 9 devalues the neighboring properties. Councilmember Bukkila stated she did not agree with either of the proposals and the neighborhood should be asked to pay for the amount over budget. Mayor Gamache suggested the City waive the water connection fee and then the project would be within the budgeted amount. It was the consensus of the Council to waive the water connection fee for the irrigation at Woodland Estates Park and connect to the existing water main located on the west side of the park. UPDATE ON SOUTH COON CREEK NEIGHBORHOOD MEETING /11 -10 City Engineer Berkowitz stated a neighborhood informational meeting was held on January 10, 2012 to discuss the proposed reconstruction improvements to South Coon Creek Drive NW. He explained the project would be making the drive lanes narrower but adding a total of 5 feet to the © width in order to add a trail component. He reviewed the comments received from residents from this meeting. The feasibility report for this project will go to the City Council on February 6, 2012, with the public hearing to follow on March 6, 2012. Councilmember Trude stated the residents were concerned about the cost of this project. City Engineer Berkowitz stated there were people at the open house that did not understand the City would be paying 100% for the extra width being added to the road. The residents in the more rural area are generally not in favor of the project and those residents in the urban area are generally in favor of it. The road is being positioned so that it does not encroach any further into the property at 3468 South Coon Creek Drive. He stated there might be a need for additional right -of -way to be purchased along this project area. He explained Mr. and Mrs. Brisse at 2530 South Coon Creek Drive has expressed concern about having to pay the same assessment rate as the neighboring properties when his property is not as large. Mr. Erickson at 3065 South Coon Creek Drive would like to have the road shifted in order to save the retaining wall that he has along the road. Staff will need to work with him to determine what needs to be done in this situation. City Engineer Berkowitz also explained a water line would be extended into the area on the north. The City would not be charging for this extension at this time but when the property is developed then it will be charged. Mayor Gamache stated there were some comments that the assessment rate of 25% should be © lowered because this route is a through street and not used just by the residents on the street. City Engineer Berkowitz stated the traffic was studied and it does not meet the requirements to change the assessment. © Andover City Council Workshop Meeting Minutes —January 31, 2012 Page 10 Councilmember Trude pointed out the City is covering 75% of the project costs and 100% of the additional widening of the road. If the project is postponed then it is likely the bids will be higher and the assessments could go up. DISCUSS RESULTS FROM PARTICIPATING IN THE LOCAL PERFORMANCE MEASUREMENT AND REPORTING PROGRAM City Administrator Dickinson stated the Council adopted the ten performance measures recommended by the Council on Local Results and Innovation. Cities and Counties that chose to participate in this voluntary program may receive a reimbursement in LGA and be exempt from levy limits. The adoption of this program allowed the City to collect $0.14 per capita ($4,284) in LGA to help offset any expenditures associated with a community survey, in addition to being exempt from levy limits for taxes payable in 2012. The survey had 42 respondents and those people were probably involved with the City in some way. This makes the results skewed. The City would need to do this survey yearly. Mayor Gamache asked if the City was sanding and salting in Shadowbrook Cove. City Engineer Berkowitz stated the roads in this area are narrow and the truck goes through and there may be more salt on one side of the road than the other. The City salts the local streets and the trucks are calibrated every year. Staff is looking for efficiencies with snow removal and plowing. They are not looking to change the process but rather make it more efficient. The City plows the street "to black" so they do not get slippery and there is less need for salt. After discussing a survey comment about a ladder truck comment. Councilmember Trude asked how things were going with the Fire Department. City Administrator Dickinson stated the City is advertising for volunteers at this time. It takes about two (2) years for volunteers to be trained and ready to be in the field. There have not been as many people interested in volunteering as there were in previous years. If someone is interested they can apply. Also some staffing changes will be taking place between the various fire stations. There are currently some vacant officer positions. Mayor Gamache asked if this survey could be better advertised and also included on the City's Facebook page. Councilmember Bukkila suggested leaving the survey open all year. PRE AUDIT YEAR END 2011 GENERAL FUND BUDGET PROGRESS REPORT City Administrator Dickinson stated the overall City of Andover 2011 Budget estimated total revenues of $28,910,245 and total expenditures of $30,785, 560. The $1,875,560 of expenditures over revenues was largely due to repaying debt in order to save on interest © Andover City Council Workshop Meeting Minutes — January 31, 2012 Page 11 expenditures. He reviewed the City Administration directives and department expectations for 2011. He clarified the City has a net increase in the Fund balance and this puts the City in a good position when considering the levy for next year. Mayor Gamache asked how many new homes the City was budgeting for in 2012. City Administrator Dickinson stated the City has budgeted for 35 new homes and so far this year there have been four. Councilmember Knight asked if the development of the Pov's property was included in the budget figure for this year. City Administrator Dickinson stated this property is not expected to be redeveloped until 2013. NOVEMBER AND DECEMBER 2011 CITY INVESTMENT REVIEW City Administrator Dickinson provided a summary reporting of the City Investment portfolio including an Investment Maturities Summary for November and December, and the City of Andover Investment Policy. OTHER TOPICS STATE OF THE CITY Councilmember Trude asked if Mayor Gamache would be attending the Anoka Area Chamber of Commerce State of the Cities event where the Mayors from surrounding communities get together and discuss what is happening in their communities. Mayor Gamache stated he would be attending and the event is on February 14, at the Harvest Grill in Coon Rapids, at 11:30 a.m. PAPER PACKETS City Administrator Dickinson asked if the Councilmembers would like to continue receiving a hard copy of the Council meeting packets. It was the consensus of the Council to discontinue having hard copies of the meeting packets distributed to the Councilmembers. Councilmember Trude requested the agenda still be printed and available outside of the Council Chambers prior to meetings. Andover City Council Workshop Meeting Minutes —January 31, 2012 Page 12 BEYOND HORIZONS Councilmember Knight stated he had attended a meeting hosted by an organization called Beyond Horizons. They help people who are in need and referred by the County Human Services. He stated the organization is providing a good service to the area. DOME TASK FORCE MEETING Mayor Gamache asked if the Task Force for the dome had met. He explained he had talked with a person who may have interest in building a private dome facility. He stated he would meet with this person and discuss it more to find out what he would have in mind. City Administrator Dickinson stated the Task Force had met and would be doing some research and bringing information forward to the Council. Councilmember Bukkila stated there are no budgets or costs to consider at this time so it is difficult to know if a dome would be something that is feasible at this time. City Administrator Dickinson stated he had been asked to talk to an Anoka- Hennepin School District Representative to find out if they might be interested in doing something as a partnership. Councilmember Bukkila stated it had been staff's preference and direction to look at the area around the Community Center and ice rinks and make it part of the current City complex. LEAGUE OF MINNESOTA CITIES Councilmember Howard stated he had attended a training session put on by the League of Minnesota Cities. He also stated there would be several projects and changes expected in the City in the next couple of years and the City should consider how progressive and proactive they want to be in these developments and he would like more discussion at future workshops. RETAIL MARKETANALYSIS /ANDOVER STATIONDISCUSSION City Administrator Dickinson stated the Retail Market Analysis meeting is scheduled for February 15 and he requested the Councilmembers help let local businesses know about this. It will be held in the Council Chambers and be approximately 30 minutes. Councilmember Knight stated Kottkes was not in a good location in the City and something should be done to address this. © City Administrator Dickinson agreed the location is not ideal for the City, but stated Kottkes provides a significant number of jobs in the community and there would be an employment void if they left the City. Andover City Council Workshop Meeting Minutes — January 31, 2012 Page 13 Councilmember Trude stated a resident was interested in having a dock installed on the pond by Target and do boat rentals out of this area. She questioned if the City owns the pond and the path around it and if the other businesses would be agreeable to allowing people to use their parking lots then this may be something the City can consider. City Administrator Dickinson stated this type of operation may violate the City's parking requirements but the resident should bring the idea to staff and have it reviewed. Councilmember Howard asked if it would be possible to host a private skate on the pond. City Administrator Dickinson stated Target might be in favor of this if it were hosted by the City but not if it was by an individual organization. FISCAL DISPARITIES ARTICLE City Administrator Dickinson pointed out the article in the Star Tribune regarding Fiscal Disparities and stated cities like Andover will be negatively impacted. Mayor Gamache indicated that a written response to the article has been submitted to the Star Tribune. REGIONAL MAYORS COUNCIL Mayor Gamache stated he would be joining the Regional Mayors Council.
