Adjournment ND -A PLANNING AND ZONING COMMISSION WORKSHOP MEETING DECEMBER 11, 2012 The Workshop Meeting of the Andover Planning and Zoning Commission was called to order by Chairperson Daninger on December 11, 2012, 6:02 p.m., at the Andover City Hall, 1685 Crosstown Boulevard NW, Andover, Minnesota. Commissioners present: Chairperson Daninger, Commissioners Dennis Cleveland, Lynae Gudmundson, Kyle Nemeth, Steve Peterson and Michael Steel. Commissioners absent: Valerie Holthus Also present: Community Development Director Carlberg City Planner Stephanie Hanson Assistant City Planner Andrew Liska Others DISCUSS PROPOSED CITY CODE TEXT AMENDMENTS City Planner Hanson stated the Planning Commission is requested to review and consider amendments to the City Code Title 11: Subdivision Regulations, City Code Title 12: Zoning Regulations, and City Code Title 8: Public Ways and Property prior to the public hearing at the regularly scheduled Planning Commission meeting. She stated the amendment to City Code Title 11, Subdivision Regulations to amend the definition for Seasonal High Water Mark and to reduce the minimum requirement to 5 -feet for drainage and utility easements along the front and rear lot lines for urban lots. The proposed amendments to Title 12 Zoning Regulations are to amend the definition for Farm Animals, to require parking stalls to be marked in white paint, and to require parking and accessways to be maintained in a neat and adequate manner. Commissioner Cleveland asked if the language "elevation shown by a geotechnical study accepted by City Staff' was the same or similar to language used by other cities or if the City would need to define geotechnical study. Community Development Director Carlberg stated a geotechnical study is a standard report and is accepted by other cities. Andover Planning and Zoning Commission Workshop Meeting Minutes —December]], 2012 Page 2 Commissioner Nemeth clarified the 10 -foot drainage and utility easement would remain the same for rural lots to accommodate for septic and well systems. Community Development Director Carlberg stated the easement for rural lots would remain the same and the change for urban lots would be for new plats that come to the City. Chair Daninger asked if current properties would need to request a variance if they were encroaching into the 10 -foot easement area. Community Development Director Carlberg clarified that variances would need to be requested for setbacks but not for the easements. Chair Daninger asked if the definition change for Farm Animals was acceptable to everyone. The definition was changed from hogs to swine and this includes potbelly pigs. Community Development Director Carlberg stated other cities have also defined swine to include all pigs. Chair Daninger asked if other exotic pets were also included in this section or if they were covered under other regulations. He asked if a variance could be requested to allow for potbelly pigs. Community Development Director Carlberg stated the City had other regulations that addressed exotic pets, horses, equine, domestic animals and alpacas. If the City wanted to allow potbelly pigs then an amendment to the code would need to be made. Commissioner Steel asked if the phrase "for productive purposes" should be removed. If a person has a swine for a pet then it could be argued that it is not for productive purposes and they could be kept. City Planner Hanson stated that there are set parcel sizes for certain animals to be allowed. Community Development Director Carlberg stated eliminating "for productive purposes" would eliminate the possibility for swine and other livestock animals as a pet. It was the consensus of the Planning Commission to remove the phrase "for productive purposes" from City Code 12 -2 -2: Definitions; Animals, Farm. City Planner Hanson clarified the change to City Code 12 -13 -8, Design Standards, Surfacing, included the addition of maintenance of parking facilities. This addition will allow the City to enforce the maintenance of these areas. Andover Planning and Zoning Commission Workshop Meeting Minutes — December 11, 2012 Page 3 Commissioner Nemeth asked if there was a document of file with the standard specifications. City Planner Hanson stated the standard specifications were on file with the office of the City Engineer. Commissioner Steel asked if business owners were made aware City officials would be looking at the quality of their parking and accessway surfaces. Community Development Director Carlberg stated these inspections were based on complaints. The City does not currently have a proactive maintenance program. City Planner Hanson stated the amendment to City Code 12 -13 -8, Item 7 was to eliminate the option for striping in yellow. The City follows the Minnesota Manual of Uniform Traffic Control Devices (MMUTCD) and this allows for striping in white only. Community Development Director Carlberg stated the City does follow a process of sending out a notice to business owners to check the striping in their parking lots every couple of years. Commissioner Peterson asked if handicap parking stall striping was covered in a different section of the code. The MMUTCD does state the white striping can be supplemented with blue for handicapped parking stalls. City Planner Hanson stated this section addresses non - handicapped parking stalls but the striping of handicapped parking is covered in another code. Staff will verify that this is covered in other sections of the City Code to be compliant with the MMUTCD. Commissioner Steel asked if the City needed to define the length of parking stalls as well. City Planner Hanson stated the City Code specifies parking stalls to be 10 -feet wide and 18 -feet in length. Assistant City Planner Liska stated the change to Title 8; Public Ways and Property, is to prohibit the planting of trees in the boulevard except when approved as part of a plat. Commissioner Peterson asked if bushes and other small plantings would be allowed in the boulevard. Assistant City Planner Liska stated bushes and small plantings would be allowed in the boulevard area. He also clarified that the change would not affect those trees that currently existed in the right -of -way. Andover Planning and Zoning Commission Workshop Meeting Minutes — December 11, 2012 Page 4 DISCUSS CITY CODE 12 -12 PERMITTED, CONDITIONAL AND PROHIBITED USES City Planner Hanson stated the Planning Commission had left off their last discussions on the land use table on line item Community Development Director Carlberg stated the discussions for the Land Use Table start on Item 54: Hotels and Motels. He stated the Planning Commission could allow hotels and motels as a conditional use. There is a separate section of the code that identifies and addresses conditional uses. If the Planning Commission adds hotels and motels as a conditional use then this would be included in this section. The City would then have the chance to review all applications and make a determination on them on a case -by -case basis. Commissioner Peterson asked if the gas stations that currently operate have a CUP. City Planner Hanson stated gas stations were covered under different categories. Chair Daninger stated the goal of the Planning Commission was to eliminate the blank areas in the land use table. He would recommend setting hotels and motels as a conditional use in the Industrial and General Business Districts and not permitted in residential areas. The Planning Commission is not able to designate this as a permitted use in the General Business District because of the recent adoption of the hours of operation and the City Council's decision not to allow continuous hours of operation in the General Business District. He expressed concerns about allowing this as a conditional use in the Neighborhood Business District but the City would have the opportunity to review the application prior to approving it. Community Development Director Carlberg stated there is only one Limited Business District area and he would recommend not permitting hotels and motels in this area. It was the consensus of the Planning Commission to designate as a conditional use hotels and motels in the Industrial, General Business, and Neighborhood Business Districts and marking them as not permitted in all other districts. Commissioner Gudmundson asked if Hotels and Motels also included Bed and Breakfast facilities. These are typically in residential areas so they should be permitted or conditional in the residential districts. They are becoming more popular as retreat sites for activities such as scrapbooking. Community Development Director Carlberg stated Item 59: Borders or roomers, up to two persons, by a resident family, with no private cooking facilities; would be the closest description the City has to address Bed and Breakfast facilities. Commissioner Nemeth asked if the description should incorporate them specifically. Andover Planning and Zoning Commission Workshop Meeting Minutes — December 11, 2012 Page 5 Community Development Director Carlberg stated Andover does not have a large market for Bed and Breakfast facilities because these are typically in historical building and homes. Currently the City Code does not address them specifically so they would not be allowed. Staff will look at adding regulations for Bed and Breakfast facilities. City Planner Hanson stated #55; Interior storage of more than eight (8) waste tires is proposed to be a conditional use in the business and industrial districts. Commissioner Gudmundson asked why the City would allow the storage of tires. Community Development Director Carlberg stated there might be reasons for a facility to have tires on site. Places like Tires Plus or a service station would be covered under different descriptions. He suggested staff do additional research regarding potential uses and the reason for setting the number at eight (8). Commissioner Cleveland stated the description only states tires. The bike shop may have more than eight (8) tires. He suggested identifying these as automotive tires Chair Daninger suggested deleting this item. Community Development Director Carlberg recommended changing to a conditional use in the commercial districts to cover the City. It was the consensus of the Planning Commission to direct staff to do additional research regarding the interior storage of more than eight (8) waste tires and bring this back for further discussion at a future workshop. Development Director Carlberg stated staff is recommending item 56: Interior storage of more than two hundred fifty (250) waste tires be deleted. Commissioner Gudmundson clarified all the facilities in the City that would have waste tires currently operate under a CUP. Community Development Director Carlberg stated this was correct. It was the consensus of the Planning and Zoning Commission to delete item 56: Interior storage of more than two hundred fifty (250) waste tires. City Planner Hanson stated staff was not proposing any changes to item 57: Junkyards. Chair Daninger clarified the only change recommended by staff for Item 58: Keeping of domestic animals in compliance with Title 5 would be to delete the phrase "keeping of'. Commissioner Gudmundson asked what Title 5 referenced. Andover Planning and Zoning Commission Workshop Meeting Minutes —December 11, 2012 Page 6 Community Development Director Carlberg stated Title 5 referenced City Code Title 5: Domestic Cats and Dogs. Commissioner Gudmundson asked if this would restrict business owners from bringing their pets to work with them. Chair Daninger stated bringing a pet to work with you is not keeping them on the property as long as when the owner leaves the pet goes with them. Commissioner Nemeth asked if this would exclude kennels in the commercial districts. He also asked if the dog training facility would be excluded. Community Development Director Carlberg stated commercial kennels are covered under a different category and the dog training facility was currently covered by a CUP. It was the consensus of the Planning and Zoning Commission to remove the phrase "keeping of ' and to mark as excluded in the commercial districts. Chair Daninger stated item 59: Keeping of not more than two (2) borders or roomers by a resident family, with no private cooking facilities is proposed to be changed to "Borders or roomers, up to two (2) persons, by a resident family, with no private cooking facilities. Commissioner Cleveland asked if this would an excluded use in the commercial and industrial districts. Community Development Director Carlberg stated staff would need to research this because there are some industrial businesses that have a security or maintenance person that live on site. It was the consensus of the Planning and Zoning Commission to mark item 59: Borders or roomers, up to two (2) persons, by a resident family, with no private cooking facilities for further research and discussion at a future workshop. Consensus was to mark and research further Community Development Director Carlberg stated staff is recommending changing item #60: Keeping of pleasure /recreation animals on residential properties at least 2.5 acres in size in compliance with Title 5 to read "Pleasure /recreation animals on residential properties at least 2.5 acres in size in compliance with Title 5 and definition under City Code 12 -2" and designating as not permitted in the remaining districts. Commissioner Peterson suggested the words "City Code" be added in front of Title 5 to make it easier for people to locate the correct documents. Andover Planning and Zoning Commission Workshop Meeting Minutes — December 11, 2012 Page 7 It was the consensus of the Planning and Zoning Commission to accept the changes proposed by staff regarding Pleasure /Recreation animals on residential properties at least 2.5 acres in size in compliance with City Code Title 5 and definition under City Code 12- 2. OTHER BUSINESS City Planner Hanson stated the meeting minutes that would be reviewed during the regular meeting had been updated per Councilmember Trade's request, to include the descriptions for each of the land use items discussed rather than just number references. November 13, 2012 Planning and Zoning Meeting November 13, 2012 Planning and Zoning Workshop Meeting Chair Daninger stated the workshop meeting minutes had been updated to include descriptions for the land use items discussed. Commissioner Nemeth stated on page 4, paragraph 6, the word "in" should be removed. Commissioner Nemeth stated on page 4, paragraph 7, the phrase should be changed to read "are an out of date term ". Motion by Commissioner Cleveland, seconded by Commissioner Nemeth, to approve the November 13, 2012 Regular Planning and Zoning Commission Meeting and the November 13, 2012 Workshop Planning and Zoning Commission Meeting minutes as amended. Motion carried on a 6 -ayes, 0 -nays, 1- absent ( Holthus) vote. Regular Andover Planning and Zoning Commission Meeting Minutes —December 11, 2012 Page 2 PUBLIC HEARING — AMEND CITY CODE TITLE 11, SUBDIVISION REGULATIONS TO AMEND THE DEFINITION FOR SEASONAL HIGH WATER MARK AND TO REDUCE THE MINIMUM REQUIREMENT FOR DRAINAGE AND UTILITY EASEMENTS ALONG THE FRONT AND REAR LOT LINES; AND TITLE 12 ZONING REGULATIONS TO AMEND THE DEFINITION FOR FARM ANIMALS, TO REQUIRE PARKING STALLS TO BE MARKED IN WHITE PAINT, AND TO REQUIRE COMMERCIAL PROPERTIES AND DRIVE AREAS TO BE MAINTAINED City Planner Hanson stated City Staff has been working together on minor text amendments to the subdivision and zoning codes. The changes are not substantial, however, staff concurs that the proposed amendments are needed to efficiently enforce the codes. The amendments are to amend the definition for seasonal high water mark, to reduce the minimum requirement for drainage and utility easements along the front and rear lot lines, Title 12 zoning regulations to amend the definition for farm animals, to require parking stalls to be marked in white paint, and the require commercial properties and drive areas to be maintained. Based on the Planning and Zoning workshop discussions the phrase "for productive purposes" will be removed from the definition for farm animals. Chair Daninger stated the Planning Commission had discussed these changes at a workshop and there was no one in the audience at this time. Motion by Commissioner Cleveland, Seconded by Commissioner Peterson to open the Public Hearing at 7:05 p.m. Motion carried on a 6 -ayes, 0 -nays, 1- absent (Holthus) vote No one wished to address the Planning Commission. Motion by Commissioner Cleveland, Seconded by Commissioner Gudmundson, to close the public hearing at 7:06 p.m. The motion carried on a 6 -ayes, 0 -nays, 1- absent (Holthus) vote. Motion by Commissioner Cleveland, Seconded by Commissioner Gudmundson, to approve Ordinances with Amendments to the City Code Title 11, Subdivision Regulations to Amend the Definition for Seasonal High Water Mark and to Reduce the Minimum Requirement for Drainage and Utility Easements Along the Front and Rear Lot Lines; and Title 12 Zoning Regulations to Amend the Definition for Farm Animals, to Require Parking Stalls to be Marked in White Paint, and to Require Parking and Accessways to be Maintained in a Neat and Adequate Manner. The motion carried on a 6 -ayes, 0 -nays, 1- absent (Holthus) vote. City Planner Hanson stated this would be brought to the City Council for approval at the January 2, 2013 regular meeting. Regular Andover Planning and Zoning Commission Meeting Minutes — December 11, 2012 Page 3 AMEND CITY CODE TITLE 8 PUBLIC WAYS AND PROPERTY TO PROHIBIT THE PLANTING OF TREES IN THE CITY RIGHT -OF -WAY UNLESS APPROVED AS PART OF THE PLATTING PROCESS Assistant City Planner Liska stated currently City Code allows for trees to be planted in the right -of -way if they are a minimum of 8 -feet from the curb. This close proximity to the street is problematic and prohibiting the planting of trees in the right -of -way would eliminate issues such as visibility being compromised and reduced maintenance costs for the City. The Platting process approval of planting trees in the right -of -way, allows staff to determine if trees would be detrimental or if they could be beneficial on a case -by -case basis. Motion by Commissioner Peterson, Seconded by Commissioner Steel to approve an Ordinance Amending the City Code to Prohibit the Planting of Trees in the City Right - Of -Way Unless Approved as Part of the Platting Process. The motion carried on a 6- ayes, 0 -nays, 1- absent (Holthus) vote. Chair Daninger stated this would be brought to the City Council for approval at the January 2, 2013 regular meeting. OTHER BUSINESS. Community Development Director Carlberg provided an update on the Wal -Mart application. He stated they are currently working on the final plat and this would be brought to the City for approval in January or February. They are also working on revisions to the Traffic Impact Study the County has requested. Wal -Mart did receive approval from Coon Creek Watershed District. They are proposing to start construction in the spring of 2013 and open in mid - January 2014. Commissioner Gudmundson asked if Wal -Mart had expressed concerns regarding the recent decision by the City Council to not allow 24 -hour continuous hours of operation in the General Business District. Community Development Director Carlberg stated Wal -Mart had supported the 24 -hour continuous operation but the City had not received any feedback from them since the ruling. Commissioner Steel asked if the City had design standards Wal -Mart would need to follow for the exterior of their building. Community Development Director Carlberg stated Wal -Mart had provided a commercial site plan and they have met the design requirements set in the City's Codes. Regular Andover Planning and Zoning Commission Meeting Minutes — December 11, 2012 Page 4 Commissioner Peterson complimented the City on the gateway signs that have been placed in the City. Commissioner Nemeth asked if the gateway sign on Round Lake Boulevard would be lit. Community Development Director Carlberg stated the City does plan on having this sign lit but they are currently working on alternatives to getting power to the sign. Chair Daninger asked if the City would be advertising the open positions. Community Development Director Carlberg stated the newsletter would have information about the open positions and deadlines. He also stated staff would be putting together a year end summary of the work done by the Planning and Zoning Commission. ADJOURNMENT.
