Construction Funds Available to Finance
Assessments for Project #87-3B
At the assessment hearing for project #87-3B on February 20th,
1990, the City Council requested I research the balance of
construction funds available from the ~Dnds issued to finance
this project. As of December 31, 1989, there is $618,780
available. This amount represents the unexpended bond proceeds,
interest thereon and reimbursements from the County.
It must be noted that the following items are not included and
could adjust this amount in either direction:
1. Audit Adjustments - few are anticipated.
2. County reimbursement for retaining wall on Crosstown -
City billed Anoka County for $45,813, the cost of
retaining wall. To date county has not paid this
amount. It is not clear yet if the County will
reimburse the City for the cost of the wall.
3. Interest Earned in 1990.
4. Attorney and engineering costs incurred in assessment
appeals - The cost of the consultants will need to be
paid from these funds.
5. Additional costs which may be incurred by attorney and
TKDA in trying to avoid court costs - Such costs may
include time spent at and preparing for meetings.

1. Kensington ti:;tates 5th Addition, City Project 90-3, Commission No. 9695
Mr. Davidson' did review the construction of Nightingale Street and Raven Street outside
ofthc::'plato'CKensington Estates 5th Addition, but contiguous to the proposed '
development of Project 90-3. A letter dated February 23, 1990 provided detail and
estimated cost of $7,200;t for work within Red Oaks 4th Addition.
Payment co'uld be made from called bonds for 1976 and 1977 construction projects for
work in Red Oaks.
No Council action is required at this time; however, when fmal costs for Project 90-3 are
assessed, these costs would be considered "City costs".
2. Feasibility Report - Hidden Creek East 3rd Addition, Project 90-5,
Commission No. 9716

Mr. Davidson presented a supplemental feasibility report for the above described project.
The estimated assessment per lot is $11,082. Subject to Council receiving the report, a
copy and review will be furnished the developer (Good Value Homes, Inc.).
Council Action
The Council received the report by resolution and directed waiver of hearing, ordered
inlprovement and ordered plans and specifications.
The Engineer was excused at approximately 9:00 PM.

Dear Mayor and Council:
The plat of Kensington 5th Addition <loes abut Red Oaks Manor 4th and 5th Addition.
COlmection to streets and utilities occur at Raven Street on the west and Nightingale Street 011 the
east.
Raven Street is constructed to the south property line of Kensington 5th Addition. However,
street surface must be remove<l in order to connect to the existing sanitary and stonn sewers as
well as meet street grades. The estimated cost outside of the Kensington Estates plat is
$1.200 +/-.
Nightingale Street is non-existent north of 140th Lane NW. As a result approximately 150 feet
'of street, curb and gutter and a stonn sewer collection system will be required to connect the
street and utility systems. The estimated cost outside of the Kensington Estates plat is
$6.000 +/-.
In both cases the City park properties abut the streets on one side. Only street and stonn sewer
'costs are involved. No sanitary sewer or watemlain extensions were considered to benefit
property outside the plat of Kensington Estates 5th Addition.
,Consideration that these costs be City costs have been requested. Since they are outside the plat
'of Kensington Estates 5th Addition and abut City park property, the request should be
considered.
Financing of the City share could be from any cash reserves in original Red Oaks Manor 4th and
5th Additions bond funds or as Council might direct.

Andover teaches boys and girls self-reliance and good
citizenship; and
WHEREAS, through contemporary programs and by speaking out on
issues that affect youth and their families, today's
Camp Fire is helping kids cope with their changing
world; and
WHEREAS, in Camp Fire, the choices and opportunities are wide
open for boys and girls; and
WHEREAS, through Camp Fire, young people are learning to develop
confidence and to gain skills needed to become
tomorrow's leaders; and
WHEREAS, Camp Fire is commended for the opportunities its
programs offer to young people in the City of Andover
and throughout the nation and for the many services

WHEREAS, almost twenty years ago more than twenty million
Americans joined together on Earth Day in a demon-
stration of concern for the environment and their
collective action resulted in the passage of sweeping
new laws to protect our air, water and land; and
WHEREAS, in the nineteen years since the first Earth Day, despite
environmental improvements, the environmental health
of the planet is increasingly endangered, threatened by
Global Climate Change, Ozone Depletion, Growing World
Population, Tropical Deforestation, Ocean pollution,
Toxic Wastes, Desertification, and Nuclear Waste
requiring actio by all sectors of seciety; and
WHEREAS, Earth Day 1990 is a national and international call to
action for all citizens to join in a global effort to
save the planet; and '
WHEREAS, Earth Day 1990 activities and events will educate all
citizens on the importance of acting in an environ-
mentally sensitive fashiong by recycling,
conserving energy and water, using efficient trans-
portation, and adopting more ecologically sound life-
styles; and
WHEREAS, Earth Day 1990 will educate all citizens on the
importance of going business with companies that area
environmentally sensitive and responsible; and
WHEREAS, Earth Day 1990 will educate all citizens on the
importance of voting for those candidates who
demonstrate an abiding concern for the environment;
and
WHEREAS, Earth Day 1990 will educate all citizens on the
importance of supporting the passage of legislation
that will help protect the environment.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City
of Andover designate and proclaim April 22, 1990 as Earth Day
1990 and that that day shall be set aside for public activities
promoting preservation of the global environment and launching
the "Decade of the Environment."

The City Council has discussed assessing the pre-Kensington
developed properties a rate comparable to 88-1 where the lots
adjacent to Crosstown Boulevard were assessed a rate of $100/lot.
87-3B is somewhat different in that not all the properties that
benefit from the storm drainage improvement are adjacent to
Crosstown Boulevard

A RESOLUTION ADOPTING THE ASSESSMENT ROLL FOR THE IMPROVEMENT OF
STORM DRAINAGE, PROJECT NO. 87-3B.
WHEREAS, pursuant to proper notice duly given as required by
law, the council has met and heard and passed upon all objections
to the proposed assessment for the improvements.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
ANDOVER, MINNESOTA:
1. Such proposed assessment, a copy of which is attached
hereto and made part hereof, is hereby accepted and shall
constitute the special assessment against the lands named
therein, and each tract of land therein included is hereby found
to be benefitted by the proposed improvement in the amount of the
assessment levied against it.
2. Such assessment shall be payable in equal annual
installments extending over a period of 10 years, the first of
the installments to be payable on or before the first Monday in
January ,1991 and shall bear interest at a rate of 8.5 percent
per annum from the date of the adoption of this assessment
resolution.
3. The owners, of any property so assessed may, at any time
prior to certification of the assessment to the County Auditor,
pay the whole of the assessment on such property, with interest
accrued to the date of payment, to the City Treasurer.

Dear Residents:
A feasibility report has been prepared to determine the estimated
cost to pave the streets in the 164th Avenue, 163rd Lane, and
Jonquil Street area.
Discussion:
We are proposing to construct with 2" bituminous paving 24
feet wide, with a berm on each side for drainage, over 4" of
gravel base course (Class V). This width is about what is
graded there now.
Estimated Cost:
The estimated cost is $4500.00 per lot. This cost can be
assessed over a 10 year period at about 9% interest or the
assessment can be paid in full within 30 days with no
interest.
Assessment Period/Cost:
The annual assessment payment over 10 years at 9% is $700.00 .
per year.

The City Council is requested to discuss the park dedication
requirements as requested by Clyde Russell.
Mr. Russell is questioning staff's interpretation of Ordinance 10,
Section 9.07.11.
The lot that is proposed to be split is less than 20 acres and is
considered metes and bounds which would require a park dedication
fee. This section was approved in December of 1989.
Attached is a drawing of where the lot is proposed.
Note: The Park and Recreation Commission has recommended that Mr.
Russell complete the process as outlined in Ordinance 10.
Prior to hiring an appraiser, a $250 escrow will be required of
the applicant. This is to pay for the appraisal if Mr. Russell
decides not to split off the lot.

The City Council is asked to discuss the following items from the
Andover Economic Development Committee:
CITY PROMOTIONAL BROCHURE
The AEDC has reviewed the enclosed brochure for promoting the
community. The Committee believes that the brochure can be used
by developers, businesses, realtors and residents. It contains
sections on commercial opportunities, retail, recreation, housing
and general information.
The Committee has recommended that the City print 5,000 copies of
the piece to be distributed to businesses and residents within the
City. Blaine Printing has estimated that the cost for the
brochure (including two color highlighting, typesetting, and
formating the brochure) would come to $3,600 for 5,000 pieces.
Funds for the printing are available from both the Downtown TIF
and Junkyard TIF districts. Construction and administrative funds
would more than cover this expense.
Two typos will be corrected for the final copy and a map
indicating the City of Andover's location relative to the twin
cities will be added.
Copies of the proposed brochure and the price estimate from Blaine
Printing are included in the packet.

AEDC Report
BUILDING DESIGN - M + S SHEETROCK AND BLUELINE COLLISION
The City Council has approved the sale of Lots 3 and 4 of Block 2
to M and S Sheetrock for the construction of a warehouse and
office for the company. The purchaser has brought in a
preliminary building design and site plan for the site. The AEDC
has a concern over the construction materials used on the exterior
of the building. The design does include the use of some metal
siding. Ric Haugland, owner of Blueline Collision is attempting
to secure Small Business Administration Financing for the purchase
of Lot 2, Block 2.
At the request of the AEDC, the exterior design for M and S
Sheetrock will be altered and brought to the City Council at this
meeting. A copy of the site plan has been included in the packet
materials.
Ordinance 78 Commercial Buildings Ordinance states that all
buildings within this district shall be of masonry construction,
its equivalent or better. Walls of such building, facing on
streets must be finished with face brick, stone, modern metal
paneling, glass, wood or their aesthetic equivalent.
The protective covenants approved by the City Council and received
by the purchaser, clearly state that the Council will establish an
Architectural Control Committee and therefore may place additional
architectural controls on each building constructed within the
Commercial Park. A copy of the covenants is included in the
packet.
The proposed buildings would utilize a combination of concrete
block, glass and metal exterior materials. The Council is asked
to review the building designs that are presented at the meeting
and advise M and S Sheetrock, as well as, the possible purchase by
Blueline Collision.

DECLARATION OF COVENANTS, CONDITIONS, RESTRICTIONS
AND RESERVATIONS FOR ANDOVER COMMERCIAL PARK
ACCORDING TO THE MAP OR PLAT THEREOF ON FILE
AND OF RECORD IN THE OFFICE OF THE
COUNTY RECORDER, ANOKA COUNTY, MINNESOTA
Grantor, the City of Andover, a municipal corporation, does
hereby declare that all of the lots in said Andover Commercial
Park, Anoka County, Minnesota, shall be subject to the following
expressed covenants and restrictions as to the use and enjoyment
thereof, all of which are to be construed as running with the
title to said lots and every part and parcel therof, as follows,
to-wit:
1. LAND USE AND BUILDING TYPE. No lot shall be used except
for commercial or industrial purposes.
2. LOT AREA AND WIDTH. Any lot on which a building shall be
constructed, altered, placed or permitted shall have the
same dimensions and area in square feet as said lot is now
platted.
3. BUILDING DESIGN. No building shall be erected, placed or
altered on any lot until the final construction of the
structure and all on-site improvements have been approved
by the Architectural Control Committee as to the quality
of workmanship and materials, compliance with the
applicable requirements of this agreement, and the harmony
of exterial design of existing structures.
4. ARCHITECTURAL CONTROL COMMITTEE. There shall be an
Architectural Control Committee composed of the Andover
City Council. Such members shall have the authority to
designate a successor, which designation shall be
effective upon the date of recording in the office of the
Anoka County Recorder an instrument containing such
designation.

The Committee's approval or disapproval as required in
these covenants shall be in writing. In the event the
Committee fails to approve or disapprove within sixty (60)
days after plans and specifications have been submitted to
it, or in any event, if no suit to enjoin the construction
has been commenced prior to the completion thereof,
approval will not be required and the related covenant
shall be deemed to have been fully complied with.
5. LIVESTOCK AND ANIMALS. No livestock, non-domestic or
pleasure-recreational animals of any kind shall be
permitted on the parcel.

6. TEMPORARY STRUCTURES. No structure of a temporary nature,
including a trailer, mobile home, basement, tent, shack,
garage, barn or other like out-building shall be used on
any lot herein at any time as a residence, either
temporarily or permanently.
7. UNLICENSED VEHICLES. No unlicensed vehicles of any type
shall be kept on the subject property.
8. NUISANCES. No noxious or offensive activities shall be
carried on upon the property, nor shall anything be done
thereon which may be, or may become, an annoyance or
nuisance to the neighborhood.
9. TERM. The Protective Covenants and Restrictions are to
run with the land and shall be binding on all parties and
persons claiming under them for a period of ten (10) years
from and after the date that these Covenants and
Restrictions are recorded, after which time said Covenants
and Restrictions shall be automatically extended for
successive periods of ten (10) years unless an instrument
signed by the(Majority of the then owners of the lots in
the Andover Commercial Park has been recorded, agreeing to
change said Covenants and Restrictions in whole or part,
or to terminate the effect of these Covenants and
Restrictions completely.
10. ENFORCEMENT. Enforcement shall be by proceedings at law
or in equity against any person or persons violating or
attempting to violate any Covenant or Restriction either
to restrain violation, or to recover damages for violation
thereof.
11. INVALIDATION. Invalidation of any of these Covenants and
Restrictions by judgement or court order shall in no way
or manner affect any of the other Covenants or
Restrictions herein which shall remain in full force and
effect.

The Planning Commission at its meeting on March 5, 1990,
considered the request of Michael G. Walker (Ward Lake
contracting) to split his approximately ten (10 a.) acre parcel
into two (2) parcels. The parcels created meet the provisions of
Ordinance No.8, Section 6.02 Minimum Requirements in all
respects. Consideration was made pursuant to Ordinance No. 40
and Ordinance No. 8 as noted above.
It is the recommendation of the Planning Commission that the lot
split request of Michael G. Walker, on the property described as:
The east 418.24 feet of the north 30 acres of all that part
of the SE 1/4 of Section 3-32-24, Anoka County, MN, which
lies east of the center line of the natural watercourse or
ditch now running through said quarter section a/k/a County
Ditch No. 71, said distances being measured along the north
line of said SE 1/4, reserving an easement for road purposes
over the north 33 feet thereof (subject to easement,
restrictions and reservations of record, if any),
be approved with the following conditions:
1. That the two (2) parcels created meet Ordinance No.8,
Section 6.02, as to width, depth and area: Parcel A
consisting of 3.81 acres (including the 33' road easement for
177th Avenue) and Parcel B consisting of 5.85 acres.
2. That a variance be granted for the fifty (50') foot
setback requirement along any major arterial for the existing
structures (house and pole building) as non-conforming

A public hearing was held and there was no opposition.
Mr. Walker's request will be considered by the Park Commission at
their meeting on March 15, 1990, and their recommendation should
be available for your consideration and approval at this meeting.
Attached please find the Planning Commission packet materials
considered with this request. The minutes of the meeting of
March 5, 1990, are not yet available for inclusion with this
agenda item.

A RESOLUTION GRANTING THE LOT SPLIT REQUEST OF MICHAEL G. WALKER
AT 1640 NW 177TH AVENUE and GRANTING A VARIANCE FOR SETBACK ALONG
A MAJOR ARTERIAL.
WHEREAS, Michael G. Walker (Ward Lake Contracting) has
requested a lot split to create two (2) parcels of land pursuant
to Ordinance No. 40 and Ordinance No 8; and
WHEREAS, the Planning & zoning Commission has reviewed the
request and has determined that said request meets the criteria
of Ordinances No.8 and 40, except as noted below; and
WHEREAS, a public hearing was held and no public input was
received, and
WHEREAS, it is the recommendation of the Planning Commission
that said lot split request be granted, with the conditions,
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Andover hereby agrees with the recommendation of the
Planning & Zoning Commission to allow for the splitting of the
property legally described as:
The east 418.24 feet of the north 30 acres of all that part
of the SE 1/4 of Section 3-32-24, Anoka County, MN, which
lies east of the center line of the natural watercourse or
ditch now running through said quarter section a/k/a County
Ditch No. 71, said distances being measured along the north
line of said SE 1/4, reserving an easement for road purposes
over the north 33 feet thereof (subject to easement,
restrictions and reservations of record, if any,
into two (2) parcels: Parcel A consisting of approximately 3.51
acres of land, and Parcel B consisting of approximately 5.85
acres of land; and
BE IT FURTHER RESOLVED that said lot split request is
approved with the following conditions:
1. That the two (2) parcels created meet Ordinance No.8,
Section 6.02, as to width, depth and area.
2. That a variance be granted as it relates to setbacks
along any Major Arterial Street; said variance caused by the
creation of Hanson Boulevard along the east side of said
Parcel A making them non-conforming structures, pursuant to
Ordinance No.8, Section 6.02.

split on the property located at 1640 NW 177th Avenue. The
property is located in the R-l Single Family Rural Residential
District which has minimum requirements as set out below:

The request is to create two (2) parcels; one 3.81 acre parcel
and one 5.85 acre parcel. The proposed lot split is depicted on
the survey prepared by Caine & Associates and attached for your
review.
Parcel A currently has a single family residence on it plus an
additional pole building. Parcel B has no structures on it.
At the time Hanson Boulevard was brought past this property,
there were some difficulties with meeting the sideyard setback
requirements for the home and pole building on Parcel A. You
will note from the drawing that the. house is 41.6' from the
right-of-way line and the pole building is 26.0' from the right-
of-way line. Both structures are non-conforming in regard to
their setback dimension along Hanson Boulevard.

At my request, Todd Haas contacted Bill Sironen from the Anoka
County Highway Department, to clarify some questions I had in
regard to this request as it pertains to Hanson Boulevard. You
will note that there are included in the drawing Parcels 14 and
14A. These are County drainage parcels that direct the water to
the County ditch just west of Hanson Boulevard. Mr. Sironen also
pointed out that the drawing is erroneous as it pertains to the
right-of-way for Hanson Boulevard. The "dark line" should be on
the west side of Parcel 14, not the east side as shown. This
drawing will need to be corrected accordingly.
Mr. Sironen also addressed the right-of-way along Hanson
Boulevard and has requested that the right-of-way along Parcel B
be sixty (60') feet the entire length of Parcel B. This

additional ten (10') feet will not cause any difficulties to the
request before you and will simply take the "jog" out of the
right-of-way line.
Mr. Sironen has put his request in writing and a copy of that
letter is attached.
You will note that on the northern edge of Parcel A there is
thirty-three (33') feet of road easement running with 177th
Avenue. The approval of the lot split should include the
property owner deeding to the City that road easement. We have
consistently done .this in the past and simply changes the
ownership of the easement from the walkers' to the City. This
will not cause a hardship to Parcel A as it will stilI meet the
criteria for a lot in an R-l District.
Mr. walker conducts a business known as ward Lake Contracting
from his home and has stored thereon various pieces of equipment
including, but not limited to: backhoes, catepillars, front end
loaders, concrete culverts, dump trucks, etc. This has been an
issue the staff has been attempting to resolve with mixed
success. The lot split should be contingent upon the removal of
said equipment from Parcel B and further, that it not be stored
on Parcel A. Ordinance No.8, Section 8.01 and 8.02 (and others)
excludes this exterior storage from being a permitted use.
In summary, the lot split request falls short in the following
areas, however, they can be corrected on another drawing, and
fall within the parameters of Ordinances No.8 and 40:
1. The drawing needs to be corrected to show the correct
property line/right-of-way lines for Hanson Boulevard.
2. An additional ten (10') feet of right-of-way along
Hanson Boulevard needs to be dedicated to the County to
make the right-of-way consistent to the northern edge of
Parcel B.
3. The road easement along 177th Avenue needs to be
dedicated to the City as a public road.
4. A variance for Parcel A be granted pursuant to Ordinance
No.8, Section 6.02, Setback Along Any Arterial. A
hardship was created at the time Hanson Boulevard was
constructed and was not caused by any action of the
property owner. The location of the existing structures
does not meet the fifty (50') foot requirement.
Notices have been sent to the adjacent property owners and as of
this writing, no comments have been received.

This lot split request is also subject to Park Dedication Fees as
set out in Ordinance No. 19, Section 9.07. Prior to this lot
split being recorded, new deeds and legal descriptions would need
to be prepared for recording and the Park Dedication Fees paid.
Based on the above information, the Planning Commission can:
a. Approve the lot split request with the provisions as
outlined above.
b. Table the request pending further information.
c. Deny the lot split request based on specific reasons.
It is the recommendation of the Staff that Option A be initiated
by the Planning Commission.

paging systems. The applicant has entered into a lease agreement
with the property owners, Semina, Inc. to locate said antenna
tower at approximately 161st Avenue and Round Lake Boulevard on a
portion of Lot 2, Block 1, Westview Industrial Park, more
specifically described as:

The north seventy-five (75') feet of the east ninety (90')
feet, together with an easement for ingress and egress over
the northerly fourteen (14') feet of the westerly one hundred
ninety (190') feet and the northerly nineteen (19') feet of
the easterly one hundred twenty (120.42') feet of said Lot 2.
The applicant and the Commission reviewed the request pursuant to
Ordinance No.8, Section 5.03 and 7.03. Some of the items
discussed were the design of the structure, the history of other
similar structures within the City, the access to the structure,
security of the structure as it relates to vandalism and its
ability to be climbed, the impact of the structure on the
remainder of the lot, etc.
Based on the information received, it is the recommendation of
the Planning Commission that approval of a Special Use Permit
(SUP) requested by US West NewVector Group to construct a 200'
tower for the purpose of cellular communications and paging
systems be granted with the following restrictions:
(1) construction to commence within two (2) years from the
granting of the Special Use Permit;
(2) that a set of engineering specifications be filed with
the Engineering Department prior to construction;

A public hearing was held and there was no negative input. The
Commission determined that the gr~nting of this request will not
be a detriment to the surrounding land owners, it will not have a
negative effect on the property values or scenic qualities of the
surrounding properties, nor will it be contrary to the
comprehensive plan.
Attached please find the Planning Commission packet materials
with regard to this request. The minutes of the above-noted
meeting, however, are not yet available. Also attached is a
Resolution prepared for your consideration.

request of U. S. West NewVector Group, Inc. to locate and erect a
two hundred (200') foot low energy, self supported, cellular
telephone antenna and construct a pre-fabricated 12' x 30' (360
s.f.) equipment building. Said antenna and building are proposed
to be erected on Lot 2, Block 1, Westview Industrial Park; more
specifically:
The north 75 feet of the east 90 feet, together with an
easement for ingress and egress over the northerly 14' of the
westerly 190' and the northerly 19' of the easterly 120.42'
of said Lot 2.
The antenna and building will have access by a gravel driveway
and the site will be fenced with a 6' chain link fence at the
base of the antenna.
Pursuant to Ordinance No.8, Section 7.03, any antenna in excess
of 35' requires a special use permit (SuP) and the provisions for
considering a SUP are found in Section 5.03 of the same
ordinance.
This antenna is a self-supported tower as opposed to a guyed
tower. If it were to fail, it would bend rather than fall. A
guyed tower falls and the pattern is based on the length of the
tower sections.

Attached you will find the completed application, legal
description, accompanying maps and drawings, and a letter from
Mr. William Buell of U. S. West NewVector, which addresses many
of the issues of concern anticipated.
There are other tower locations within the City, including the
Group W 125' microwave tower, the Anoka County Radio
Communication tower which is 300', the Doc "E" Sales repeater
tower which is 183', and the Ron Ferris Ham Radio towers, the
highest of which is 200'. All of these towers, however, are
guyed towers, not self-supporting.
Present at the meeting on Monday evening, March 5th, will be Jim
Frady, Regional Construction Manager for U. S. West, and Steve
Terhar, Regional Network Manager for U. S. West. Both of these
gentlemen will be able to respond to both general and technical
questions in regard to the tower and the history of like towers
around the nation.

Mr. Buell has also contacted a consulting firm from South Dakota
(I think) who monitors the design and tracks the success/failure
of such towers. A letter setting forth their findings will be
available the night of the meeting for your review and
consideration. '
It would appear from Exhibit F that if the tower were to fail at
its base and fall, it would strike the cabinet shop, the Adcon
building and perhaps even J J's Bottle Boutique. It is the
belief of both the user, U. S. West NewVector, and the designer,
that this type of failure is very improbable. The issue of the
fall pattern has been a concern in previous tower considerations.
Section 5.03 sets out the criteria under which consideration is
made for a SUP. Mr. Buell, in his letter of February 9, 1990,
responds to each portion of that criteria. From a staff
perspective, the only concern would be damage to adjacent
buildings and property if the tower were to fail other than
anticipated. The location proposed meets the other criteria of
the Ordinance as it pertains to setbacks, traffic considerations,
property values and harmony with the comprehensive plan.
Based on the information provided, the Planning Commission may
take one of the following actions:
1. Recommend approval of the SUP as requested, and/or
outline some criteria which is felt to be unique to this
request that should be specifically spelled out.
2. Recommend denial of the request, with reasons spelled
out as to why the request does not meet the criteria of
the Ordinance.
3. Table the matter for receipt of additional information.
It is the recommendation of Staff that Option 1 be followed and
based on the input of the experts, any conditions that might be
significant should be spelled out.

Dear Madam Chair and Commission Members:
This letter accompanies an application for a Special Use Permit to locate a cellular
telephone antenna on property owned by Semina Inc. in Westview Industrial Park. The
application is in the name of US West NewVector Group, Inc" which is part of US
West, Inc., one of the regional holding companies formed as a result of the break up of
AT&T. Dahlgren, Shardlow, and Uban, Inc. has been authorized by US West to act as
its representative for planning and zoning matters.
Specifically, we propose to construct a single 200 foot self supported antenna and 12' x
30' prefabricated equipment building. The base of the tower and equipment building will
be enclosed by a 6 foot high chain link fence. The site will be accessed by a gravel
drive connecting the site to Round Lake Boulevard.
The Cellular Phone System
The primary users of cellular telephone service are members of the business community
and the public sector. The phone becomes a useful tool leading to increased
productivity. Doctors, builders, salespersons, business owners and executives all benefit
by using cellular phones. Additionally, cellular is extensively used in the public sector
principally by fire and police departments. Cellular allows police and others to conduct
discreet communication in the field. 'Citizens can contact "911" to report accidents,
fires or other emergencies. The cellular phone system interfaces fully with the "911"
emergency reporting system. Mr. James R. Beutel~pacher, 911 Project Manager for
Minnesota, recently wrote, "the unimpeded growth of cellular service is an important
adjunct to 9-1-1 emergency reporting". His letter is attached for your information as
Exhibit G.

Cellular Grid System
Cellular service provides subscribers with office quality phone service by developing a
grid of antennas arranged in a geographically hexagonal pattern. Each hexagon is a
"cell" created by an antenna and serves as the link between the customer and the
system while the customer is within that particular cell. Each cell can only handle a
certain number of calls simultaneously. As the number of customers increase, the grid
must be changed to handle the appropriate number of simultaneous calls. This usually
means that more cells need to be created within the same area resulting in a new grid
pattern of smaller cells. A new antenna must be constructed each time a new cell is
created. As the grid matures and more cells are added, antennas are made shorter
because of each cell's smaller coverage area. Antennas are also constructed to expand
the grid of coverage into new areas. The antenna in Andover is being proposed to
expand cellular phone coverage in an 8.5 mile radius area.
The cellular mobile phone system operates on a specific set of channels set aside by
the Federal Communications Commission (FCC). The filtering of spurious signals is very
tightly controlled. Cellular telephones operate within a very strictly controlled set of
allotted frequency between 835 to 897 megahertz. US West NewVector Group is
currently operating over 160 cellular antennas around the country with no case of
television or radio interference reported. .
Search Area Criteria
We have been working for several months to locate an antenna site in the Andover area
to solve cellular phone service coverage needs. Many factors go into the selection of a
location for an antenna site. These include market factors, technical considerations,
cellular grid, zoning and land use compatibility, landowner willingness to sell, land forms
of the surrounding area, and accessibility to roads. All of these factors taken together
create a narrow site search area for location of the antenna.
The technical aspects of fitting a new cell site into the grid pattern dictates a small
search area for new antenna sites. The search area is further refined by topographical
features and a sophisticated computer modeling that takes into account existing antenna
sites, predicted coverage of the new cell and FCC service area requirements. Federal
Aviation Administration regulations must also be followed in locating and constructing
antennas. The search area in Andover that resulted from this type of analysis, is
illustrated on Figure C. It is an area 2.25 miles in diameter centered over the area
platted as Prairie Meadows.

Once the search area has been defined by these technical constraints, zoning and land
use factors can be addressed. We have been in contact with the City's Planning and
Zoning Staff from very early in the process to identify the most appropriate and
compatible location. From these meetings, we were advised to focus on the area zoned
for industrial use. For this reason we narrowed our search to the area around Westview
Industrial Park because it was the only Industrial zone in the search area. The cellular
telephone system does not have the power of eminent domain and we must deal with
willing sellers. We were fortunate in this case to have found a landowner willing to
lease a properly sized parcel of land in Westview Industrial Park.

Local Zoninl;( Requirements
Section 7.03 of the Andover Zoning Ordinance allows antennas in excess of 35 feet as a
special use in accordance with the criteria as stated in Section 5.03 (B). Also Section
7.01 allows public utility uses in all districts in accordance with the special use permit
criteria. The 200 foot self supported antenna proposed in this application is located in
an Industrial district. Section 6.02 provides minimum standards for Industrial districts as
follows: minimum sideyard setback from interior lot line of 10 feet; rear yard setback
of 40 feet; and front yard setback of 40 feet. The equipment building and antenna
base will be set back to meet these requirements. In addition the antenna will be set
back 250 feet from the road which far exceeds the front yard setback requirement of
40 feet.
Special Use Criteria
Section 5.03 addresses the conditions and findings which must be met before a special
use permit is gran~ed. Each fmding is addressed below:

The antenna is located a safe distance away from surrounding buildings. The closest
huilding is 150 feet away. These surrounding buildings are being used for commercial or
industrial uses. The closest residence is 700 feet away.
The 200 foot self supported antenna proposed on this site is one of the safest in design.
As indic.ated in the enclosed letter from Pirod, Inc., Exhibit I, failure of a self
supporting tower is extremely rare such as in instances of a direct hit from a tornado.
In the rare instance of failure, the pattern of failure is a "bowing over" of the upper
portion of the tower against the base of the tower. The tower is constructed to help
ensure the "bowing over" affect.
Cellular is a low power system. The amount of energy generated from a single cellular
phone channel is typically ahout the same as a 100 watt light bulb. This is less energy
than is generated by a cordless telephone which is in use in many homes today,
nor will cause serious traffic congestion nor hazards,
The operation of the antenna and adjoining facility will not be an occupied use,
therefore, there will be no measurable impacts on traffic or parking conditions, A
parking space will be provided immediately adjacent to the equipment building for
maintenance personnel. Maintenance personnel are expected to visit the facility on an
average of once or twice a week. The 200 foot antenna will be located 250 feet from
the nearest public road.

nor will seriously depreciate surrounding property values, and
The existence of cellular telephone antennas have been shown not to appreciably affect
property values even in residential areas. A copy of a letter by Peter J. Patchin,
Appraiser, is attached as Exhibit H and contains his opinion that cellular phone antennas
do not depreciate surrounding property values. Mr. Patchin studied antennas in both
industrial and residential settings.
that said use is in harmony with the general purpose and intent of this Ordinance
and the Comprehensive Plan.
The proposed use is considered an essential public service use and is a permitted use in
all districts by the Ordinance. An antenna is a compatible use in an industrial district
and would not adversely affect the future development of the surrounding properties. A
microwave tower and short wave radio tower already exist in the industrial district
within 300 feet of our proposed antenna. In addition the proposed location of the
antenna is in the very back of an industrial lot, thus allowing further development
potential of that portion of the lot fronting on Round Lake Boulevard.

At your request I have investigated the potential market value
impact of the proposed cellular communication tower which is to be
located on the Minneapolis Gun Club site en Judicial Road.
The proposed tower is to be 350 ft. tall, single pole, with guy
wire s~PPQr~. The specific purpose of this study wdS tv estimate
t~e rua~ket v~lue i~pact, of the proposed tower, UpC:1 properties in
the surrounding neighborhood.
The surrounding neighborhood is of a predominantly rural character
with scatte~ed single family dwellings and small farms located on
large 3creage lots.
T~e presen~ Scott County zoning is A-2 Agricultural District. This
zoning is intended for current use as agricultural, but with a
gradual transition to single family residential. The minimum lot
size under this zoning is 10 acres.

The investigation as to market value impact included the inspection
of sites with the same type of tower as is proposed. Those sites
were:
12666 Dakota Ave. So. Savage, Minnesota
Industrial area with single family bluff top homes,
immediately to south.
1929 Eagle Creek Blvd., Shakopee, Minnesota
Light industrial area between canterbury Downs
and the Haver Addition, a single family residential
area overlooking tower site.
14950 Chippendale Avenue, Rosemount, Minnesota
Located next to City of Rosemount water tower
in a predominantly residential area.
A review of market data in these neighborhoods revealed no
measureable value impacts.
Contacts with well informed real estate brokers and assessors
familiar with these neighborhoods revealed no value impact.
Further, I reviewed appraisals I have made of properties lying in
close proximity to towers and found no value impact.
My conclusion is that given the subject location, there should be
no measureable value impact upon neighborhood properties.

Thank you for your inquiry regarding self-supporting tower design
ractices and predicted failures.
While failure is extremely rare in any king of tower,
especially so for self-supporting towers. In fact, only
tower were subjected to a direct hit from a tornado or
severest of hurricanes would failure be predicated.

We are aware of u~ly a very few documented instances of self-
supporting tower failure. In each of these instances, the
failure was in the upper middle region of the tower, with the
upper portion of the tower remaining connected and "bowing over"
against the base of the tower. The fact that the wind is
normally greater on the upper portion of the structure
contributes to the likelihood of this type of failure. In
addition, the factors of safety in the tower in the upper middle
region are kept somewhat below the factors of safety in the rest
of the tower. Thus, if a failure condition is reached, it should
be reached in the upper middle region of the tower first.
Needless to say, the engineering codes which govern tower designs
are extremely conservative. Towers are designed for extreme wind
conditions, and even under these extreme conditions, stringent
factors of safety are required.

Dear Mr. Frady:
I have reviewed the letter from EHRESMAN ENGINEERING concerning Self Supporting
Tower failures. I am iri agreement with the intent and content of the letter.
However, it has been or experience that self supporting towers do not fail catas-
trophically at the base allowing a collapse of the structure in a straight line.
It has been ou, experience that towers of this type fail in the top third of the
structure. Further, the anticipated failure can be enhanced by strengthening the
majority of the structure and placing the selected failure point so as to ensure
the fall radius of the structure. That is, a weak link can be placed at any pos-
tion(s) desired to create a controled failure in the event the wind exceeds the
anticipated 125mph failure velocity.
Tne anticipated failure wind can be predicted once the structure and desired
failure mechanism have been defined. One final note, the structure is designed
to meet a one in fifty (50) year storm. This is a national standard as required
by a number of building codes. The inclusion of the "weak link" into the tower
design exceeeds the national standards. As stated in Mr. Ehresmann's letter the
struture i6 designed to the one in f1fty year wind with factors of safety intact.
It is acceptable to erect the structure under such criteria. Any modification
of the structure is an extra margin of safety. If you should have any questions

The City Council is requested to review the proposed sketch plan
of Kimberly Oaks.
The Andover Review Committee (ARC) has reviewed the sketch plan
and their comments are as follows:
General Comments
* The proposed sketch plan is located in an R-l Single Family
Rural zoning district with a minimum lot size of 2.5 acres.
Four lots are being proposed.
* The proposed cul-de-sac location is acceptable by ARC as shown.
The Committee has reviewed the possible extension of 166th
Avenue NW. Due to the transmission line which is shown on
sketch plan and the pipeline which is located between the
possible extension of 167th Avenue and the north line of the
sketch plan will not allow for reasonable future platting or
splitting of properties.
* The proposed lot sizes are 2.5 acres or larger. The width at
the setback line for Lots 2 and 3 are less than 300 feet
(minimum requirement). The City has granted variances for those
types of lots. Indian Meadows 3rd Addition was recently granted
a variance for the same situation. Ultimately, the ARC is
recommending that lot lines are created with 90' right
triangles. Attached is an alternate drawing showing possible
lot line configurations.
* The developer is required to meet City Ordinances 8 and 10 and
all other applicable ordinances.

* The Planning and Zoning Commission is recommending that the
sketch plan submitted by the developer be approved.
Planning Department Comments
The Planning Department believes that the development could make
better use of the land if a PUD process were used. If the homes
were clustered towards the north or eastern section of the
property, additional lots could be created. (Density zoning would
allow up to 7 lots versus 4 proposed lots). The developer could
also place restrictive covenants on the wetlands to ensure proper
protection of the natural features of the property.
The developer wants to avoid using a creative design in order to
facilitate a quick plat of the property.

Calls were made to the list of companies and contractors listed
below for the 1990 spring street sweeping hourly rates:
Allied Blacktop Company
Knutson Klean Sweep Inc.
Gorecki & Company
Clean Sweep, Inc.
Only three of the four have answered with their hourly rate.
Gorecki & Company wasn't sure they would sweep streets anyway.
Clean Sweep, Inc. can only provide one sweeper and wouldn't give
date of when a second sweeper could start. If we waited until
June 15th, they would discount 5%.
Allied Blacktop Company
is $55.00 per machine.

The personnel that operate these machines are professional, having the ab-
ility to repair and maintain their own machines. Most of our operators have
been with Allied for many years and their primary duty is running brooms
and sweepers.
I've mentioned our late model. top conditioned and professionally operated
machines not to boast, but to assure you that you can have clean streets
with the least possible machine hours.

Dear Todd:
In June 1989 New Generation Homes applied to the City for
an easement vacation on the above lot. The easement vaca-
tion was requested based upon a regrading of the lot and
provision of an outlet swale to the south of 155th Avenue N.W.
The grading has been completed and the enclosed As-Built
survey of the final elevations has been made. Based upon
review of these elevations, the site has been graded as
required and in fact the building pad has been elevated above
the minimum elevations shown on the grading plan and has been
increased in size. The outlet swale has also been constructed
at a lower elevation than that shown which is better than
required.
In conclusion, the grading has been completed to meet the
specified elevations.

BACKGROUND
Attached is a letter from Mr. Robert Heliker requesting the return
of the remaining escrow for the plat phase of Echo Hill. The
following is a summary of the status of this escrow:

Appraisal Fees 200.00
Total Escrow 500.00
Costs incurred and deducted from

A RESOLUTION ACCEPTING
IMPROVEMENT OF PROJECT
STORM DRAIN AND STREET
ESTATES 5TH ADDITION.
BIDS AND AWARDING CONTRACT FOR THE
NO. 90-3 FOR WATERMAIN, SANITARY SEWER,
CONSTRUCTION IN THE AREA OF KENSINGTON
WHEREAS, pursuant to advertisement for bids as set out in
Council Resolution No. 025-90, dated February 20, 1990, bids were
received, opened and tabulated according to law with results as
follows:
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Andover to hereby accept the bids as shown to indicate
as being the apparent low bidder.
BE IT FURTHER RESOLVED TO HEREBY direct the Mayor and City Clerk
to enter into a contract with in the
amount of for construction of the
improvements; and direct the City Clerk to return to all bidders the
deposits made with their bids, except that the deposit of the
successful bidder and the next lowest bidder shall be retained until
the contract has been executed and bond requirements met.
