The City Council is requested to review and approve the 1991 MSA
street construction for the coming year and to hold informational
meetings for reconstructing various city streets as recommended by
the Road Committee which met February 7th.
1. The Road Committee recommended the following streets be
constructed:
- Crosstown Drive between Bunker Lake Boulevard and Crosstown
Boulevard (designated in 1990). This section is deficient
in cross section, drainage and contains a number of potholes
which are continuously repaired by Public Works.
Approximate reconstruction cost - $144,000.
- Crooked Lake Boulevard south of Bunker Lake Boulevard to the
Coon Rapids border along with construction of sidewalks.
Sidewalks would be eligible using MSA funds. Reconstruction
cost - $200,000.
NOTE: A. The Road Committee reviewed the possibility of
University Avenue from 151st Avenue to 157th Avenue
(Andover would be responsible to implement any required
feasibility reports through construction phase) and
from 157th Avenue to Constance Boulevard (Ham Lake
would be responsible to implement any required
feasibility reports through construction phase) to be
constructed. In reviewing the previous City Council
Minutes of August 1990, the minutes only reflect asking
the Road Committee to review this. In April 1989, the
City Council approved a five year MSA Street
Improvement Program which includes the construction of
University Avenue north and south of 157th Avenue in
1991. See attached. Total cost for construction north
- south is $350,000.

B. The Road Committee also discussed the possible
construction of a road serving Fire Station #2. The
concern the Road Committee has is the existing
alignment already serves the area to allow for fire
truck movements on the west side. By constructing
165th Avenue from County Road 58 to Round Lake, it
would really be only serving the Fire Department. The
majority of traffic movement in Andover is north-south.
For informational purposes, $500,000 is available for
1991 construction plus another $200,000 in Andovers MSA
account for maintenance and construction of MSA
streets. This account is used to balance the
construction projects where the City Council doesn't
assess.
2. The Road Committee recommended holding an informational
meeting for reconstruction of streets in the following areas:
Lakeridge
- Rum River Forest
- Njordmark Dale
A majority of the streets in these areas would be very costly
and time consuming to repair. Attached is a summary of the
cost estimates for the street improvements.
By holding the informational hearing, the Road Committee would
be able to explain the reasoning of the improvement and what
could happen if these streets are not reconstructed. If the
residents favor the improvement the City Council would hold a
public hearing for the improvement soon thereafter.
3. Other discussions with Road Committee. The Road Committee was
presented with 5 roads recommended by staff to be designated
as minumim maintenance roads.
- Jivaro street north of the intersection of County Road 58
and CSAH7
- Xeon street north of Andover Boulevard
- university Avenue Ext. north of Crosstown Boulevard
- 149th Avenue NW east side of Round Lake Boulevard
Currently, the City maintains these roads, grading in the
summer and snowplowing in the winter. Attached is information
what is considered minumim maintenance road in the State
Statue.

The Road Committee is requested to review the list of MSA streets
that are recommended by staff to be constructed.
- University Avenue from 151st Avenue to 157th Avenue (Andover
would be responsible to implement any required feasibility
reports through construction phase). Andover's approximate
share - $200,000.
- University Avenue from 157th Avenue to Constance Boulevard (Ham
Lake would be responsible to implement any required feasibility
reports through construction phase). Andover's approximate
share - $150,000.
- Crosstown Drive between Bunker Lake Boulevard and Crosstown
Boulevard. This section is deficient in cross section, drainage
and contains a number of potholes which are continuously
repaired by Public Works. Reconstruction cost - $144,000.
- 165th Avenue right-of-way acquisition. County of Anoka may be
interested in the construction of the street.
- Crooked Lake Boulevard south of Bunker Lake Boulevard to the
Coon Rapids border along with construction of sidewalk and
watermain. Sidewalk would be eligible using MSA funds.
Reconstruction cost - $200,000.
Enclosed in your packet is a copy of the Joint Powers Agreement II
for review along with a copy of the MSA designation map.
Also, for informational purposes, $600,000 is available for 1991
construction.

HAM LAKE/ANDOVER JOINT POWERS AGREEMENT II

AGREEMENT, made this
day of
, 19_, between
the Cities of Andover (Andover) and Ham Lake (Ham Lake), both
situate in Anoka County, Minnesota:
RECITALS
Andover and Ham Lake share a common border along the
easterly corporate limits of the City of Andover, and along the
we~terly corporate limits of the City of Ham Lake. This common
,
border extends for approximately six miles. Portions of this
common border contain a borderline road known as the University
Avenue Extension.
It is the desire of both communities to
jointly cause the improvement of the University Avenue Extension
for ultimate insertion as a Minnesota State Aid road serving both
communities along or near their common border. This Agreement is
made in furtherance of the implementation of certain portions of
that overall project, as hereinafter described, pursuant to the
provisions of Minnesota Statutes Chapter 471.59, commonly known
as the Joint Powers Act.
NOW, THEREFORE, IT IS AGREED AS FOLLOWS:
1. Definitions. The overall project contemplated ~ this
Agreement shall be divided into two portions, to be defined as
follows:

A. Southern Portion. An improved roadway to MSA
Standards, having as its southerly terminus the
intersection of the centerline of University Avenue
and the south line of the Northwest Quarter of the
Northwest Quarter of the Southwest Quarter (NW-l/4
of NW-l/4 of SW-l/4) of Section 19, Township 32,
Range 23, Anoka County, Minnesota, and having as
its northerly terminus the intersection of the
common boundary between Andover and Ham Lake with
the centerline of the present paved and travelled

portion of a road named in the City of Ham Lake as
"157th Avenue" (15 7th) .

B. Northern Portion. An improved roadway to MSA
Standards, having as its southerly terminus the
northerly terminus of the southern portion, and
having as its northerly terminus the intersection
of the centerline of Constance Boulevard with the
common borderline between Andover and Ham Lake.
2. Construction. Construction of the Northern Portion and
the Southern Portion shall be done in the following manner:
A. Southern Portion. Andover shall be responsible to
implement any required feasibility studies,
engineering and design work, bid procedures,
selection of contractor, .and supervision and
implementation of construction. When construction
has been completed, Ham Lake shall reimburse
Andover for one-half the costs thereof.
Construction costs shall include all costs
incurred by Andover in association with completion
of the Southern Portion, including but not limited
to engineering fees, legal fees, right-of-way
acquisition costs, publication costs, and
contractors' fees. Construction shall be deemed
complete when the City Councils of both Andover and
Ham Lake have accepted, by resolution, the
construction of the Southern Portion upon
recommendation of the City Engineer of each
respective community.
B. Northern Portion. Ham Lake shall be responsible to
implement any required feasibility studies,
engineering and design work, bid procedures,
selection of contractor, and supervision and
implementation of construction. When construction
has been completed, Andover shall reimburse Ham
Lake for one-half the costs thereof. Construction
costs shall include all costs incurred by Ham Lake
in association with completion of the Northern
Portion, including but not limited to engineering
fees, legal fees, right-of-way acquisition costs,
publication costs, and contractors' fees.
Construction shall be deemed complete when the City
Councils of both Ham Lake and Andover have
accepted, by resolution, the construction of the
Northern Portion upon recommendation of the City
Engineer of each respective community.

C. Roadway Location. The design engineers employed
respectively by Andover and Ham Lake shall be
responsible for the establishment of the roadway

location for their respective design
responsibility, taking care to locate the roadway
in a manner that is economically feasible and
aesthetically acceptable. Roadway location shall
be established as soon as practical for review ~
the governing bodies of both Andover and Ham Lake
prior to advertisement for bids.
3. Special Assessment Procedures in Ham Lake. It is
acknowledged between the parties that Ham Lake intends to utilize
Minnesota Statutes Chapter 429 to specially assess benefitted
properties on the Ham Lake side of both the Northern Portion and
the Southern Portion. To this end, Andover will cooperate in all
respects in complying with the terms of Minnesota St atutes
Chapter 429 in preparation of plans, feasibility studies, and any
other required actions. Ham Lake shall be responsible to conduct
such public hearings and to implement such other procedures as
may be necessary to comply with the terms of Minnesota Statutes
Chapter 429 in both the Southern Portion and the Northern
Portion.
4. Bonding. To the extent that either Andover or Ham Lake
utilizes any general obligation bonding to wholly or partially
fund any portion of the costs of either the Northern Portion or
Southern Portion, both Andover and Ham Lake will endeavor to
cooperate with each other in any statutorily required procedures
necessary to implement such bonding.
5. MSA Funding. Both Andover and Ham Lake will cooperate
in all respects in maintaining the eligibility of both the
Northern Portion and Southern Portion to receive MSA funding from
the Minnesota Department of Transportation. Furthermore, design

6.
Riqht-of-Way-Acquisition. Both Andover and Ham Lake
shall jointly employ their respective legal counsel, Burke &
Hawkins for Andover, and Dorn & Edwards, Ltd. for Ham Lake, to
acquire such right-of-way as may be necessary to implement the
overall project. Both Andover and Ham Lake shall authorize their
respective legal counsel to make whatever interoffice arrangements
they deem appropriate in order to implement right-of-way
acquisition, and the legal fees incurred in right-of-way
acquisition shall be billed to Andover for right-of-way
acquisition in the Southern Portion and to Ham Lake for right-of-
way acquisition in the Northern Portion. These legal fees shall
be considered a portion of the overall costs for eventual
reimbursement by the corresponding party. By execution of this
Agreement, Andover and Ham Lake do jointly employ the law firms
of Burke & Hawkins and Dorn & Edwards, Ltd. for the purpose of
acquiring, in the name of both Andover and Ham Lake, any right of
way required for either the Northern Portion or the Southern
Portion. In the absence of agreement between said law firms,
Andover shall employ its counsel to acquire any right of way
needed for either the Northern Portion or the Southern Portion
and located within the corporate limits of Andover; Ham Lake
shall employ its legal counsel to acquire any right of way needed
for either the Northern Portion or the Southern Portion and
located within the corporate limits of Ham Lake. In such event,
the costs so incurred shall remain joint project costs

7. Maintenance.
A. Contractor's Bond and Guaranty. Andover shall be
responsible to enforce any contractor's bond or
guaranty on the Southern Portion. Ham Lake shall
be responsible to enforce any contractor's bond or
guaranty on the Northern Portion. The costs of any
such enforcement shall be borne by Andover for the
Southern Portion and Ham Lake for the Northern
Portion, but if any such costs are incurred, one-
half of such costs shall be reimbursed to the City
incurring the costs.
B. On-Goinq Structural Maintenance. Both the Northern
Portion and the Southern Portion shall be
maintained in such a manner as to comply with on-
going maintenance requirements for MSA roads as
established by the Minnesota Department of
Transportation. Both Andover and Ham Lake shall
share equally in the costs of future maintenance,
subject to the condition that the governing bodies
of each agree as to the need for specific items of
future maintenance.
C. Snowplowinq. Andover shall be responsible, at its
own expense, for snow removal on the Southern
Portion. Ham Lake shall be responsible, at its own
expense, for snow removal on the Northern Portion.
IN WITNESS WHEREOF, the parties have executed this Agreement
the day and year first above written, pursuant to the provisions
of Minnesota Statutes Chapter 471.59, commonly known as the Joint
Powers Act.

2. 1991 Seal coating
program

The Road Committee is requested to review the 1991 seal coating
program.
At this point the City is currently two years behind schedule.
The staff will begin determining which streets will need
sealcoating. The staff expects to begin sealcoating in June.
$50,000 is available in the General Fund and approximately $30,000
is for cracksealing.
Approximately 5.0 miles would be sealcoated.

Alternates A and B are described in detail in the two reports, They include
varying degrees of patching, crack sealing and geotextile paving fabric to
seal and reinforce the existing bituminous pavement.
Alternates C and D are option to remove and dispose of the existing bituminous
pavement and placement of 2 inches of Class 5 aggregate base, before paving.
Alternate E is an option to mill the existing bituminous pavement.

We recommend Alternate A based on our opinion that it is the most cost
efficient, This option is designed to give the roadway an estimated life of
15 to 20 years, Alternate E would also provide a project life of 15 to 20
years compar~ble to Alternate A. The advantage of Alternat~ A is that in
areas where the pavement is in fairly good shape the pavement life could be 20
to 30 years. It is expected that Alternate A would require more crack sealing
maintenance than Alternate E as the existing pavement cracks would reflect to
the surface. Alternate B is designed to give the roadway an estimated life of
5 to 10 years.
