Haas BY: The Park and Recreation Commisssion is requested to review and recommend the park dedication for the proposed sketch plan for Wayne Holmberg. In reviewing the proposed amendment to the Comprehensive Plan, Chapter VIII proposes a Community Park in the area of Ward Lake. Attached is the ordinance amendment. Orttel - Mayor Victoria volk - City Clerk CITY OF ANDOVER COUNTY OF ANOKA STATE OF MINNESOTA \ ,~ ORDINANCE NO. 47 AN ORDINANCE ESTABLISHING A PARK COMMISSION AND REGULATING CON 'UCT IN PUBLIC PARKS; PROVIDING FOR ENFORCEMENT; AND PRESCRIBING PENALTIES FOR THE VIOLATIONS OF ITS PROVISIONS. The City Council of the City of Andover does hereby ordain: SECTION 1. There is hereby created a Park Commission. 1.1 COMPOSITION The Park Commission shall consist of sev'n (7) members. The members shall be appointed by the City Council by a majority vote. A member may be removed at an' time by a majority vote of the City Council. A. Terms of Office The seven (7) members shall be appointed for three (3) year staggered terms. Terms shall expire on January 1. original and successive appointees shall hold their offices until their successors are appointed. Vacancies during a term shll be filled by the City Council for the unexpired porti 'n of the term. ~) B. Absences Three consecutive unexcused absences of a member from duly called Commission meetings shall constitute automatic resignation from Office. Determination that an absence is unexcused shall be i the discretion of the Commission Chairperson. C. Compensation All Commission members shall serve 'ith such compensation as may be set by resolution of the :ity Council. , ~) 1.2 PARK COMMISSION CHAIRPERSON The City Council shall appoint a Chairperson from among the appointed Commission members who shall serve for a term of one (1) year; the Commission may create and fill such other offices as it ma' deem necessary for its own administration. The Commission Chairperson shall attend City Council meetings upon the request of the City Council. 1.3 MEETINGS The Park Commission shall hold regular meet~ngs on the first and third Thursdays of each month. The Commission may hold as many additional meetings per month ~s the City Councilor Park Commission may deem necessary. T:e Commission shall adopt rules for the transaction of busine~s and shall keep a record of its resolutions, transactions ald feelings. 1.4 The Commission shall study and advise the City Counci concerning City parks and recreation programs. , '\ o 1.5 The Commission is responsible to the City Council for all property and programs relating to parks and recreation. T1e Commission shall be responsible for coordinating maintenan:e, improvements, upkeep and operation of all City parks. 1.6 Fees and deposits shall be reviewed by the Commission on an annual basis and a recommendation made to the City Coun:il. SECTION 2. The use and occupancy of City parks and recreation areas owned. rented and/or leased by and located in the City of Andover sha~l be subject to the following regulations: 2.1 No firearms, as defined by Ordinance No. l2A, or explosives shall be brought into or used in City parks exc~pt by approval of the City Council. 2.2 Gambling, excessive use of alcoholic beverages, or engaging in offensive, obscene or abusive language or boisterous and noisy conduct tending reasonably to arouse alarm, anger or resentment in other~ will not be allowed. Consumption or possession of alcoholic beverages is allowe' only in areas of city parks designated by official city si-n as "Picnic Area". Unless an Exclusive Use Permit is obtai~ed under Section 2.3A, consumption or possession of alcoholic beverages is prohibited in game field areas and parking lo~s. (47C, 7-07-87) " -...) 2.3 No advertising, unapproved selling or solicitation is allowed in park or recreation areas. a. An Exclusive Use Permit may be approved by the Ci.y Council and issued by the City Clerk for the selling ~f food, alcoholic or non-alcoholic beverages as set out in City Resolution. -~ 2.4 Pets must be kept leashed or under control. Horses w_ll be allowed only in designated areas. No person in a park shall hunt, molest, harm, kill, trap, chase, tease, shoot ~r throw missiles at any animal, reptile or bird~ nor shall a~y person remove or have in his possession the young of any w'ld animal or have the eggs or nest or young of any reptile, mammal or bird~ exception to the foregoing is made in that snakes known to be poisonous, such as rattlesnakes and/or other hazards to human safety may be killed or removed. 2.5 It shall be unlawful to remove, cut or otherwise defa~e any tree or ground cover in any park without consent from :he Park Commission and written permission from the City Clerk or an appointed representative. 2.6 It shall be unlawful to willfully mark, deface, disfigure, injure, tamper with or displace or remove any buildings, bridges, playground equipment, tables, benches, fireplaces, railings, paving or paving materials, public utilities or parts or appurtenances thereof, signs, notice~ (whether temporary or permanent), monuments, stakes, posts. equipment, facilities or park property or appurtenances; whatsoever either real or personal. Page 2 . \ \. - ..-J 2.1 It shall be unlawful for anyone to interfere with the Park Commission or their appointed representatives in the performance of their duty. 2.8 No person or persons shall engage in racing or playin~ of any games which interferes with the general use of designa:ed play areas. This section shall be construed, but not limi:ed, to prohibit the use of sleds, toboggans, snowmobiles on an~ skating rinks, or other such conflicts of use. 2.9 No one shall ride or drive a vehicle at a rate of spe~d exceeding that posted in City parks or fifteen (15) miles ~er hour. 2.10 Drivers shall confine the operation of any motorized vehicle to roads, parking areas, or other areas specifical~y designated as a temporary parking area by the City Council and/or their designated representative. 2.11 It shall be unlawful for any self-propelled vehicle, including but not limited to motor vehicles as defined in Minnesota statute, Chapter 169, other self-propelled vehic~es, go-carts, and snowmobiles, to travel within City parks, ex=ept on established roadways, trails, or other areas designated for such purpose within said parks. 2.12 City parks and recreation areas shall not be occupie; or used nor may motor vehicles be parked therein between 11 o'clock p.m. and 6 o'clock a.m. except: " 'J a. When camping. b. When participating in an activity for which a per~it has been granted by the City of Andover. c. Red Oaks West Park will be open from sunrise to 11:00 p.m. (47A, 11-07-86; 478, 2-17-87) 2.13 It shall be unlawful to build or attempt to build a :ire except in areas designated for such purpose. No person sh'll drop, throw, or otherwise scatter lighted matches, burning cigarette or cigars, tobacco, paper or other flammable material within any park area, on any highway, road or str)et abutting or contiguous thereto. 2.14 It shall be unlawful to post any sign, placard, advertisement or inscription, or cause to be erected, any ~ign on any City park lands, or highways or roads adjacent to a park unless approved by the City Clerk or an appointed representative. SECTION 3. VALIDITY CLAUSE. ) If any section, subdivision, sentence, clause or phrase of this ordinance is for any reason held to be unconstitutional, such decision shall not affect the validity of the remaining portio1s of this ordinance. The Council hereby declares that it would ~ave passed this ordinance, any section, subdivision, sentence, cla~se or phrase thereof, irrespective of the fact that anyone or mo:e sections, subdivisions, sentences, clauses or phrases be decla~ed unconstitutional. " Paqe 3 SECTION 4. VIOLATION AND PENALTY. " '\ '-J Any person, firm or corporation violating any of the provision, in this ordinance shall be guilty of a misdemeanor, and upon conviction thereof shall be punished by a fine and/or imprison~ent as established by law. SECTION 5. The City Council may at its discretion waive sections of this ordinance. This ordinance shall take effect upon adoption and publication as required by law.
