CALL TO ORDER
Chairman Jim Schrantz called the meeting to order at 8:40
a.m. in the Committee Room of Anoka City Hall.
ROLL CALL
Hembers present were Jim Schrantz, Scott Erickson, Steve
Jankowski, and John Heaver.
Also present was Anoka alternate Ray Schultz.
CONSIDERATION OF THE HINUTES
Hotion was made by Heaver, seconded by Jankowski, to APPROVE
THE JULY 17, 1991, MEETING MINUTES AS PRINTED.

TREASURER'S REPORT
Erickson presented the Treasurer's Report for the period
ending July 31, 1991, which indicated a money market checking
account balance of $10.00; an interest bearing savings
account balance of $4,857.04; and a certificate of deposit
account balance of $6,000.00. Total balance as of July 31,
1991, was $10,867.04.
Erickson reported the receipt of the second half membership
dues from the cities of Andover, Ramsey, and double payments
from Coon Rapids. He will see they are refunded $42.00. The
City of Anoka has not yet paid its second half membership
dues.
Erickson noted the April 28 through June 1, 1991, bill
Barr Engineering in the amount of $1,690.60, which was
back with a request for further detail on meetings
administration, has not yet come back for payment.

Jankowski queried what will be done with the $10,000 LRRl'lMO
holds in reserve, indicating he has been asked this from
Ramsey's Finance Director. Erickson indicated we will spend
$5,000 on expenses yet this year and carry over $3,500 next
year, leaving only $2,000 in the books, which is not much
cushion.

Jankowski suggested we request additional revenues from the
permitees, adding \Ve have not been vigorous on this. Schultz
disagreed with that suggestion stating the perrnitees are
being feed to death as it is. He felt this board's focus
should be water quality and the preservation of wetlands.
Weaver stated the future will show there to be an ever
increasing focus on the sins of the past.
Schultz added he feels the LRRWMO or perhaps the county in
general should be responsible for the Rum River Dam adjacent
to Anoka's City Hall rather than it being solely the
responsibility of the City of Anoka. He informed those
present there will have to be repairs out there.
Janko\Vski explained his reasons for inquiring is to enable
hiQ to return to Ramsey will more complete information. He
stated the impact on water quality \ViII corne from Ramsey
developments in a different manner than it will corne from
Anoka.
Schrantz suggested Anoka should perhaps review the darn
portion of the Joint Powers Agreement. If it wants this
board to reconsider its inclusion, they should ask that the
issue be placed on our agenda for reconsideration.
Jankowski noted the upcoming September 4, 1991,
Anoka/Ramsey City Councils meeting and suggested this
might be worth discussing at that time.

Schrantz stated the permit fees paid to the LRR\'n10 at the
time of application will only pay for the costs. It is noc
an attempt to draw a profit for the LRRWMO. Schrantz
reported the City of Andover now has a taxing district for
the Lower Rum River \'lMO activities.
Motion was made by Erickson, seconded by Jankowski, to
APPROVE THE TREASURER'S REPORT AS PRESENTED, AUTHORIZING THE
REFUND OF $42.00 TO THE CITY OF COON RAPIDS.

PAYMENT OF BILLS
Erickson presented a bill in the amount of $482.25 from Barr
Engineering for services provided during the period June 2
through June 29, 1991. No extensive breakdown was provided.
However, information provided indicated these costs were for
telephone conversations, correspondence, meetings with the
cities' staffs, etc.

Jankowski suggested perhaps correspondence should corne to
this board first, and we should detemine what we want him to
rev iew. It '.vas, however, noted since this board meets only
once a month a time element must be considered. Schrantz
felt the biggest expense on this bill was for the meeting
with the staffs.
Motion was made by Weaver, seconded by Erickson, to AUTHORIZE
PAYMENT OF THIS $482.25 BILL FROM BARR ENGINEERING.
JankO'.vski indicated he has no problem approving payment of
this bill, but queried the board's position on retaining more
control over what the consulting engineer is doing for us in
the future. Schultz felt that would be reasonable. Erickson
stated the board will have to keep a careful watch on these
itemized costs.
VOTE: 4 ayes - 0 nayes. Motion carried.
REPORT OF OFFICERS
Handling of Administrative Costs Per Permitted Project

The Recording Secretary reported the Deputy Treasurer ver-
bally indicated there are no new projects and, therefore, no
change in the proj ec t repor t since t,he las t meeting.
Erickson suggested he call Barr Engineering after a pemitted
project has begun to see if and when they are done billing,
thereby, allowing the remaining fee to be returned to the
applicant after the ten per cent has been taken out for
administration costs.
CONSIDERATION OF COMIlliNICATIONS
MPCA Grant Application Program
Members noted the July 25, 1991, memorandum from Dale Sauer
and patricia Rudolph or the Anoka Conservation District along
with the June 24, 1991, attachment indicating the Hinnesota
Pollution Control Agency will be accepting application for
Clean I'later Partnership grants from June 24, 1991, through
October 30, 1991. Members noted the September 18, 1991,
grant assistance workshop to be held at the Brainerd Public
LibravJ is the only opportunity remaining should the LRffi~MO
wish to take advantage of this program. I.1embers concurred
they would each individually try to attend this meeting. The
Recording Secretary was directed to call the Hinnesota
Pollution Control Agency to obtain a grant application.

the Minnesota Pollution Control Agency grant received by Coon
Creek.
Schrantz noted the sixth draft of rules of the Metropolitan
Surface Water Management Plans as prepared by the Minnesota
Board of Water and Soil Resources in conjunction with a
forty-two member advisory committee, on which Schrantz serves
as a member. Schrantz urged board members to attend at least
one of the informational meetings, as outlined in the August
15, 1991, memorandum from Ron Harnack, Executive Director of
the Board of Water and Soil Resources.

Summary for Water Year 1989.

Second Quarter Reports from Coon Rapids and Ramsey
Erickson provided the second quarter project report for the
City of Coon Rapids which indicated no new construction
projects in the LRRNMO watershed during this period.

Seechi Disc Monitoring, SWCD vs. Metro Council
Members noted the July 15, 1991, memorandum to Mava Mikkonen,
Recording Secretary, from the SWCD representatives Dale Sauer
and Patricia RudOlph, with regard to the lake monitoring
programs of the SWCD and the Metropolitan Council. Upon
review of the memorandum, Erickson noted it looks as if the
SWCD is only going to be able to do Seechi Disc monitoring
for Rodgers Lake. The board queried if the Coon Creek

Creek watershed Administrator Tim Kelly who indicated the
program through the MPCA might not be worth the effort.

THE SOIL AND WATER CONSERVATION DISTRICT TO PROVIDE OUR
TESTING OF RODGERS LAKE AND ALSO FOR ROUND LAKE IF IT IS NOT
ALREADY BEING MONITORED FOR THE COON CREEK ,'lATERSHED. THIS
ACTIVITY IS \^lITH THE UNDERSTANDING THE COSTS FOR SAID MONI-
TORING SHALL BE AS INDICATED IN MS. RUDOLPH I S JULY 15, 1991,
MEMORANDUM OF $35.00 FOR SEE CHI DISC HONITORING PER LAKE.

Erickson queried what kind of LRRI'lMO related data base Barr
Engineering has and suggested perhaps we should have copies
of everything at our disposal, perhaps having an LRRNMO
section set up at the Anoka County Library. Schrantz
indicated that will be part of the new rules; to have a
central information gathering place.
Joint Powers Insurance
Members discussed an insurance coverage proposal received
from North Star Risk Services, Inc. Schrantz telephoned
Andover Mayor Ken Orttel and queried the difference between
general liability and errors and omissions insurance.
Following his conversation with Mayor Orttel, Schrantz
reported this board needs the general liability; it is
mandatory. The errors and omissions insurance is needed if
members do something wrong outside the line of duty.
Schrantz stated this board does not need errors and omissions
insurance unless we want to cover ourselves from being sued
individually.
Members discussed whether or not the consulting engineer
would be covered by the LRRI'i'MO insurance or that of his
agency. Schrantz felt he would be covered by his own
company. However, Schultz reported he heard Ska1lman state,
at the member cities' staff meeting at Hardees in June, he
wants the LRID'i'MO to cover him in the area of errors and
omissions.

THAT NORTH STAR RISK SERVICES, INC. SEND THE LRRNMO A POLICY
FOR GENERAL LIABILITY INSURANCE COVERAGE FOR ITS REVIEW PRIOR
TO APPROVING PAYMENT.
Weaver stated the state legislature should allow that Joint
Powers Agreements can be covered under the cities' insurance
umbrella.

In explanation, Schrantz felt this board should purchase the
general liability insurance immediately.
Schrantz noted this board will have to decide if it wants to
go through the City of Anoka and use its agent or record to
avoid having to pay the agent ree.
NEW BUSINESS
Hetropolitan Public Ditch Inventory
Jankowski reported the county is the agency responsible for
responding to the Board of Water and Soil Resources with
regard to the Hetropolitan Public Ditch Inventory. His
concern was the correspondence from our consulting engineer
indicating the county may decide to transfer the ditches to
the, ,~'lMOs. Jankowski reported contacting l'1el Sinn, BWSR, who
explained how this inventory issue carne about. Apparently,
,when amending the Metropolitan Surface \'later Management Act,
the question of maintaining the public ditches was not
addressed well. It was reportedly Natalie Haas-Steffen who
raised this issue. Mr. Sinn reportedly referenced a section
of law addressing the WMO's option to accept jurisdiction
over county ditches. Jankowski went on to explain the taking
over of county ditches by the WHO would depend on the agree-
ment reached in our Joint Powers Agreement. He added he did
not contact anyone at the county in obtaining this
information.

Schrantz suggested Jankowski call the county to make sure
they are in agreement with these findings from BWSR.
Jankowski went on to state changing the jurisdiction of the
ditches would have to progress through public hearings and
approval of a resolution to get rid of the ditches by the
county.

Enclosed is a listing of one-year percentage changes in population for the county and for
the cities and towns within your county. These percentage changes should be shown on
line 4 of the generic notices of proposed property taxes for the taxes payable year 1992,
For counties, cities and towns in the seven county metropolitan area (Anoka, Carver,
Dakota, Hennepin, Ramsey, Scott and Washington Counties), the percentage changes
shown on the enclosed listing were determined by subtracting the April 1, 1989
; '\ Metropolitan Council population estimate from the April 1, 1990 Federal Census popula-
'-.-I tion, and dividing the difference by the April 1, 1989 Metropolitan Council population
estimate,
, Forthe counties, cities and towns outside of the seven county metropolitan area, the State
Demographer has not developed and will not be developing 1989 population estimates,
Therefore, the Department of Revenue has determined 1989 population estimates for the
purpose of the Truth in Taxation generic notices, These estimates were determined by
adjusting the 1988 State Demographer population estimates for one-half of the difference
between the 1988 estimate and the 1.990 Federal Census population, The percentage
changes shown on the enclosed listing were then determined by subtracting the 1989
estimate from the 1990 Federal Census population, and dividing the difference by the 1989
population estimate.
The percentage changes shown on line 4 of the generic notices should indicate increases
with a plus sign (+) and decreases with a negative sign (-), The sign should appear before
the percentage change. '
The Department of Revenue will !J.Q1 be certifying the percentage changes in the number
of pupils in average daily membership for the school districts in your county for you to use
in preparing your county's generic notices forthetaxes payable year 1992. You will receive
this information from the Department of Education. This information will appear in the lower
left corner of page 12 of the Department of Education form titled "Levy Limitation and

Wal-Mart Stores, Inc. has set aside, company-wide, $1,000,000 to be used in our local
communities for economic development and job creation efforts. Funding may be applied for by
economic or industrial development committees, chambers of commerce, or city development
departments. However, we can only approve one economic development grant per community
in which a Wal-Mart store or SAM'S Club is located. An average pledge to a qualified recipient
would total $4500 to $6000 to be distributed over three years. (Pledge amounts will vary based
upon community size, past accomplishments of the recipient organization, planned
development efforts, and other considerations.)
Funding may be applied for to be used for several different community job creation efforts.
Those that would be eligible for approval are:

1. Marketing efforts to attract new industry. Projects such as creating brochures, videos,
and other marketing tools will be considered.
2. Industrial park expansion and development such as purchasing additional land,
building spec buildings, or infrastructure improvements.
3. Hiring a person to work solely on economic development and job creation efforts.
Most favorable consideration will be given to programs which directly enhance the creation of
primary jobs for the community. Beautification programs, shopping promotions, and tourism
enhancement programs are not currently eligible for economic development funding.
An application for economic development funds must be completed by the Industrial/Economic
Development Committee and given to the manager along with the requested attachments.
Consideration of monetary support must be justified by the commitment the Economic
Development Committee in your community demonstrates.
It is helpful if you will add comments about the work the organization is doing and other
considerations that need to be looked at. Send the application and attachments to the
Corporate Affairs Department, Attn: Economic Development Coordinator.
You will be notified about the disposition of the application and all payments will be sent to the
store/club for presentation. PublIcity efforts should be made at the time of the presentation.
Please send a copy of any newpaper articles about the presentation to the Wal-Mart Foundation
Economic Development Coordinator. With your help, we can make each of our communities
dynamic, growth-oriented locations.

The City Council is requested to approve the Special Use Permit
to mine soil as required per Ordinance 8, Section 4.24 as
requested by North Lexington Landscaping.
Mr. Kuiken of North Lexington Landscaping is completing pond #1
and has made application for a Special Use Permit to mine pond #2
which will exceed the 400 cubic yards. Attached is the proposed
diagram of pond #2 indicating the proposed finished elevations.
The City staff and the Planning and Zoning Commission have
reviewed the application and their comments are as follows:

1. Safety precautions be taken at the end of each working
day to prevent injury to playing children, bike riders,
snowmobilers, etc.

2. The applicant shall provide the City of Andover with a
security bond to hold the City harmless for restoration
of the site as determined by the City Engineer.
3. Signs to be placed on both sides of the driveway at
Hanson Boulevard indicating trucks hauling.
4. The applicant is requested to make reasonable use of the
property without altering the topography greatly.
5. Watering of the haul road to control dust during dry
times.
6. Hauling of material is Monday through Friday, 8:00 A.M.
to 8:00 P.M. and Saturdays, 8:00 A.M. to 4:00 P.M.
7. The applicant is required to restore the banks of the
mined area after the area has been excavated using an
approved topsoil, seed, and/or vegetation or brush to
establish erosion control.

REQUEST
The City Council is asked to review the Special Use Permit request

Note: The applicant has no intentions of constructing a principal

the City Council approval of the Special Use Permit requested.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of
the City of Andover hereby agrees with the recommendation of the
Planning & zoning Commission to allow John Ewert to construct an
accessory structure on said property, with the following
conditions:
1. That the properties be linked by restrictive covenant.
2. The Special Use Permit will be subject to annual
review and site inspection.
3. The special Use permit be subject to a one (1) year
sunset clause as defined in Ordinance No.8, Section
5.03(D).
4. The applicant shall place the structure in accordance
with the minimum requirements of the designated zoning
district.

Ordinance No.8, Section 4.05 states that, "No accessory building

Ordinance No. 52, Section 10.08, requires notification to the
Commissioner of Natural Resources and that any decision be
forwarded within ten (10) days after the City has taken final
action.
Ordinance No.8, Section 5.03 regulates the Special Use Permit
process.
In granting a Special Use Permit, the following criteria shall be
examined.
1. The effect of the proposed use upon the health, safety, morals
and general welfare of occupants of surrounding lands.
The construction of the accessory structure prior to the
~onstruction of a principal structure would not have a detrimental
effect. The accessory structure is intended to be used for
storage purposes.

2. The existing and anticipated traffic conditions including
parking facilities on adjacent streets and land.
The proposed use would have no significant negative impact on
traffic and parking conditions in the area.
3. The effect on the values of property and scenic views in the

The proposed use would have no significant negative effect on
the property values and scenic views in the area. The
proposed accessory structure will also be screened from
automotive and pedestrian view.
4. The effect of the proposed use on the Comprehensive Plan
The use would have no negative effect on the Comprehensive Plan.

1. The Planning and Zoning Commission may approve the Special Use
Permit requested by John Ewert to allow for the construction of an
accessory structure prior to the construction of a principal
building to be located at 17615 Roanoke Street NW (PIN 06-32-24-
32-0001).
The Commission finds the request meets the criteria established 1n
Ordinance No.8, Section 5.03, including: the use will not be
detrimental to the health, safety, morals or general welfare of
the community; the use will not cause serious traffic congestions
or hazards; the use will not depreciate the surrounding property
and the use is in harmony with the Comprehensive Plan. The
Commission also finds that the use meets the provisions
specified in Ordinance No.8, Section 4.05, Accessory Structures.
2. The Planning and Zoning Commission may deny the Special Use
Permit requested by John Ewert to allow for the construction of an
accessory structure prior to the construction of a principal
building to be located at 17615 Roanoke Street NW (PIN 06-32-24-32-
0001).
The Commission finds the request does not meet the criteria
established in Ordinance No.8, Section 5.03. In denying the
request, the Commission shall state those reasons for doing so.
3. The Planning and Zoning Commission may table the item.

REQUEST
The City Council is asked to review the Special Use Permit request

Ordinance No.8, Section 5.03 regulates the Special Use Permit
Process.

Ordinance No.8, Section 4.30, requires a Special Use Permit for
any home occupation that is located in an accessory structure.
Consult the attached staff report presented to the Planning and
Zoning Commission on September 10, 1991 for further background
information.
In granting a Special Use Permit, the City Council shall examine
the effect of the proposed use upon the health, safety, morals and
general welfare of occupants of surrounding lands.
Planning & zoning Review & Recommendation
The Planning and Zoning Commission, at their September 10, 1991
meeting, recommended approval of the Special Use Permit with
conditions. Attached for your review are the minutes from the
meeting which reflect those concerns and conditions. The Council
should note the additional request by the Planning and Zoning
Commission to apply for a variance for the sideyard setback
requirement of thirty (30') feet. Mr. Audette's structure is
setback sixteen (16') feet from the sideyard property line.
Attached is a proposed resolution for your review and adoption.

LEGALLY DESCRIBED AS FOLLOWS:
LOT 2, BLOCK 1, AUDETTE BROTHERS ADDITION
WHEREAS, John Audette has requested a Special Use Permit
and variance to operate a home occupation (sharpening service) in
an accessory structure encroaching into the required sideyard
setback, as specified in Ordinance No.8, Section 4.30, on the
property located at 17600 Ward lake Drive NW, legally described
above.
WHEREAS, the Planning & zoning Commission has reviewed the
request and has determined that said request meets the criteria of
Ordinance 8, Sections 4.30 and 5.03; and

WHEREAS, the Planning and zoning Commission finds the
proposed use will not be detrimental to the health, safety and
general welfare of the occupants of the surrounding lands; and
WHEREAS, a public hearing was held and there was no
opposition regarding said request; and
WHEREAS, the Planning and zoning Commission recommends to
the City Council approval of the Special Use Permit and variance
requested.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of
the City of Andover hereby agrees with the recommendation of the
Planning & zoning Commission to allow John Audette to operate a
home occupation (sharpening service) in an accessory structure
encroaching into the required sideyard setback on said property,
with the following conditions:
1. The size of the lot shall be three acres or larger.
2. The specific location and size of the structure and/or
outside storage area shall be as allowed by the City.
3. The combined square footage of the accessory structure
and outside storage area shall not exceed 800 square
feet, with the partition to be built to meet City code
as determined by the Building Department.

4. Setbacks of the accessory structure and/or outside
storage area shall be of a magnitude found necessary
by the City, but in no case shall it be less than a
100 foot front yard setback and a 50 foot rear yard
setback or as required in section 6.02.

5. The number of employees shall be limited to one person
on site in addition to family members.

6. The outside storage area and all vehicles, materials
and equipment being stored there shall be fenced,
landscaped and screened in such a manner as to prevent
it from being visible at any time of the year from
road rights-of-way, public properties and surrounding
properties.
7. The number of employees shall be limited to one (1)
person on site in addition to family members.
8. On-site sales shall be prohibited, except those
clearly incidental to services provided in the
accessory structure.
9. vehicles associated with the home occupation shall be
limited to one (1) vehicle on the premises and as set
out in Section 8.08 of Ordinance No.8.

10. Unusual parking and traffic patterns shall not be
created, which are not normally found in the
neighborhood, and in no case, shall the need for more
than three (3) additional vehicles be created on the
property.
11. Signs shall be regulated as set out in Section 8.07 of
Ordinance No.8.
12. The City may at any time inspect the home occupation
and revoke the Special Use Permit if the applicant is
not adhering to the permit and the conditions of the
permit.
13. The hours of operation shall be between 8 a.m. and 6
p.m., Monday through Friday, and 8 a.m. to 5 p.m. on
saturday, closed Sundays and holidays.
14. All renovations to the structure shall be reviewed by
the Building Department.
15. The Special Use permit be subject to a one (1) year
sunset clause as defined in Ordinance No.8, Section
5.03(D).

Commission detecmined that Wa~d Lake Deive is a City MSA st~eet. so

occupations because of the difficulty of ~egulating them so they do
not become an undesi~able activity in a ~esidential zone. The Staff is

Wa~d Lake D~ive and the~e is a path back to the accesso~y building.
The building was constcucted in 1976 and is p~esently being used fo~

to the st~eet, suggesting the setback on the east be shown parallel to
Wa~d Lake Deive on the sketch plan. M~. Caelbe~g ageeed.

sideyaed setback on the west. The Commission discussed whethe~ the

site. He expected that to be done between the hou~s of 8 a.m. and 2
p.m. F~om 2 o~ 3 o'clock to 5 oe 6 o'clock, the shop would be open to
the gene~al public, though he did not anticipate mo~e than 2 o~ 3

Description of Request:
The accessory structure, (i.e. my pole barn), apparently
does not meet the side lot setback required for compliance
with ordinance 8, sec 4.30, B. #8 (d) which calls for the
accessory structure to have 30' side setback.
The building was erected in 1976 complying with ordinance 8,
sec 4.05, D., which allowed for a 10' side setback. At that
time, no plans were considered for the new sharpening
business.
Specific Hardship:

It would not be feasible for the building to be moved 14'
to be in compliance with the ordinance. It also would not
be feasible, or in the best interest of the city to erect
another building on the property.
My request is therefore to grant this variance request as
presented. The planning and zoning committee recommended I
submit the variance request directly to the city council.

including, "office uses, repair services, photo or art studio,
dressmaking, or teaching limited to three (3) students at anyone
time and similar uses".

Ordinance No.8, Section 3.02 defines repair services as, "Repair
and/or servicing of such items as musical, scientific and medical
instruments, photographic equipment, jewelry, watches, clocks,
small household appliances, office machines, shoes and clothes,
and similar uses".
Ordinance No.8, Section 4.30, Horne Occupations, requires a
Special Use Permit for any home occupation that is located in an
accessory structure and/or that requires exterior storage. These
home occupations shall be subject to the following conditions:
1. The size of the lot shall be 3 acres or larger.
2. The specific location and size of the structure and/or outside
storage area shall be as allowed by the City.
3. The combined square footage of the accessory structure and
outs~de storage area shall not exceed 800 square feet.
4.
Setbacks of the accessory structure and/or outside storage
area shall be of a magnitude found necessary by the City, but
in no case shall it be less than a one hundred (100') foot
front yard setback, thirty (30)' foot sideyard setback and a

5. The outside storage area and all vehicles, materials and
equipment being stored there shall be fenced, landscaped and
screened in such a manner as to prevent it from being visible
at any time of the year from road right-of-ways, public
properties and surrounding properties.
Ordinance No.8, Section 5.03 regulates the Special Use Permit
process.
Ordinance No.8, Section 7.03 lists those uses allowed by Special
Use Permit. In a Residential District, Home occupations, on a
parcel of three acres or larger, utilizing an accessory structure
and/or exterior storage, is allowed under a Special Use Permit.
In granting a Special Use Permit, the following criteria shall be
examined as defined in Ordinance No.8, Section 4.30.
1. The effect of the proposed use upon the health, safety, morals
and general welfare of the city including but not limited to
the factors of noise, glare, odor, electrical interference,
vibrations, dust and other nuisances; fire and safety hazards;
existing and anticipated traffic conditions; parking
facilities on adjacent streets and land.
Staff is concerned with the anticipated traffic conditions
generated by the home occupation and the parking facilities
needed to operate the occupation. The applicant also desires an
additional drive access on Ward Lake Drive. This will need City
Engineer approval as well as County approval.
2. The effect on surrounding properties, including valuation,
aesthetics and scenic views, land uses, character and
integrity of the neighborhood.
If the use is conducted properly, there should be no negative
impact on the above.
3. Consistency with the Andover Comprehensive Plan and
Development Framework.
The use would be consistent with the Comprehensive Plan if
determined to be a use allowed under a home occupation and is
conducted properly.
4. The impact on governmental facilities and services, including
roads, sanitary sewer, water and police and fire.
The use will generate more traffic on Ward Lake Drive NW.
However, the impact should be minimal.
5. The effect on sensitive environmental features including
lakes, surface and underground water supply and quality,
wetlands, slopes, flood plains and soils; 'and other factors as
found relevant to the City.
The use should have no negative effects on the above.

Permit is valid for one year from the date of issuance unless

complaints are received from neighboring property owners, the City
Councilor City Staff and a request for review is made.
GENERAL REVIEW
The applicant has provided to the Commission the attached summary
explaining the intent of the applicant's request.

BUILDING STRUCTURE (Accessory structure to be utilized)
30' X 56' Pole building currently used to garage
recreational vehicles, boat and trailer and personal
lawn and garden equipment.
Interior area of 800 s.f. would be partitioned off and
made into the proposed repair shop work area. The
remaining area (ie.. .not utilized by the shop) would
continue to be used to garage the recreational vehicles,
boat, and personal lawn and garden equipment.

Exterior modifications would be minor, providing for
moving garage door from front to side, adding a few
windows for light/ventilation, and a few service doors.
These changes would not change the characteristics of
the structure, or look of the building in any unusual
way.
The building meets the setback requirements to adjacent
properties. See plat Map. Also, the property is over
3 acre minimum.
THE PROPERTY AND DWELLING
The primary use of my property and dwelling is house and
home, and will remain as such as will be discussed. The
evidence of the home occupation will be subtle and not
distinguishable as a commercial enterprise.

be twofold. Mobile on site sharpening and sharpening
in the home shop (ie...located in the accessory

MOBILE SERVICE
A Daily routine would be starting out working in a
small parcel van. I would solicit business from other
business such as those listed below:

Much of the sharpening would be done right on the van at
the above business locations. That which could not be
done would be collected and brought back to the shop,
sharpened and returned on another day via van.

closed, except that a drop box would be available for
those who absolutely could not bring their blades to the
shop during normal "open hours". (By prearrangement)
SHOP ACTIVITY
Work that had been collected on the van during the
mobile hours would be worked on after 2:00. The shop
would be "open" to the general public described above.
(ie...secondary type customer; amateur home handyman,
and homemaker etc...) I would purposely limit the open
hours to 2:00pm to 6:00pm Monday thru Friday and on
Saturday from 10:00 am to 5:00 pm. Closed Sunday and
all holidays.

Note: Serving the general public is not a high priority
but could be significantly profitable. These
customers would be served by and at the shop.
While working on my primary customers,collected
blades (afternoons and Saturdays anyway),
I would welcome these secondary customers as they
would have sought me out and need the service
too. I do not anticipate very many people coming
to my home for sharpening but there would be
some. (5% of total volume would seem likely,
10% would be highly unlikely)
Growth Plans might include mobile locksmithing in
the future, but only on the truck, not in the shop.
Incidental sales would consist of chain lengths for
chain saws and band saw lengths for band saws when
it would be determined that these could not be
restored without adding new lengths. I will not be
inventorying any blades, cutlery, scissors,
etc.. .for resale over the counter.

The "asthetics" and scenic beauty of the property
would not change. I have no intention or desire
to do anything to make my property look like a
business, or a commercial enterprise in anyway
whatsoever. I would do some minor landscaping to
provide a level parking area (three car maximum)
and haul in buffed rock for driveway to prevent
ruts in the yard. There would be a small (4s.f.)
residential sign identification placed at the
driveway entrance with the words "Sharpening"
or "Sharpening Service" on it. This sign would
not be light or of a commercial nature, but in-
stead, for the purpose of identifying the house
as being the place where the service is.

- My neighbors have been informed of my intentions
and have been supportive. They know that I take
great pride in my property, ie. .maintaining the
grounds, bushes and trees, fence etc...)
- There will be no exterior storage area required
so that the operation will be totally within the
building and out of sight.
- The van will be parked in the garage area so that
it will not be visible to the neighbors.
- Since there will be no environmental or visual
impacts on the property, there should be no
change in property values.

- As previous indicated I do not expect much of any
traffic from the general public. In today's
"throw-away" society, the consumer would rather
replace a skillsaw blade, a pair of scissors,
a knife, a drill bit and so on with another cheap
hardware variety blade. Unless a blade is
expensive, they will probably never use my
service. Therefore, when I refer to the "general
public", we are not referring to big numbers of

customers. If you were to poll those around you
with the question, "When was the last time you
had something sharpened?" you would likely find
that nobody ever did. Therefore, my market is
almost entirely from the professional sector, a
extremely limited clientele.(Builders, carpen-
ters and woodworkers.) These are the people that
would be coming to my home for service.
_ I would not be creating a "Parking Lot" but
mainly an area to park that would not destroy the
beauty of my lot, protecting the lawn from ruts
and bare spots. (Rock driveway up to the shop
with a turn around area.)
The Environment
_ I have conferred with people in the business and
suppliers pertaining to need for chemicals in the
business. The only solution that is needed is a
biodegradable,water soluble coolant which is used
to cut down dust on the carbide grinder. Other
products used would be of the types such as W-D40
LDS Spray or "3 in 1" oil.

Metal grindings would pose no more of a
threat to the environment than a discarded blade,
however, there are scrap metal business that will
buy or take in the steel shavings. Dust in the
shop will be collected in vacuum dust collector.
(One high volume shop that I spoke with indicated
that after three months only a three pound coffee
canfull was collected.
Noise will be minimal, no more noise than a home
vacuum cleaner would make. Shop will be insulated
and should not be heard outside at all. No
vibration should be felt.
_ No outside lighting, except for the possible
need for a security light. No glare to neighbors.

_ No interference should result from electrical
usage.
_ No new plumbing needed or sewer. The house would
be available for restroom if necessary.

_ There will be no odors or fumes created by the
shop.

water tables, nor any effect on topsoils.
Health and Safety
- The equipment used to sharpen blades in not
dangerous to operate. The main danger would
be getting something in the eye, goggles would
be worn by myself. Since the item to be sharp-
end is not being propelled, the danger of cutting
oneself is no more probable than it would be to
cut yourself in the kitchen, the garage etc..
Care in handling blades will taken and I will
provide some form of sheathing material for the
repaired, sharpened blade to the customer.
- No air pollution (dust) will escape the building
and as mentioned before, will be collected by
a dust collector.

- No impact anticipated. Since I do not expect any
type of complaint from my neighbors whatsoever,
and since there are no special fire dangers in-
volved with the work area, there should be no
problems of concern to government(s).
SUMMARY
My request for this "Special Use Permit" ",ould permit
me to repair worn out and damaged blades serving small
business needs and that of the consumer. This home
occupation would enable me to pursue a new business
lifestyle compatible ",ith my thinking of what a job
should be. I would be the sole employee of this en-
terprise. I am convinced that this endeavor will have
absolutely no ill effects on the neighborhood since i~
would be operated on a very low profile in accord with
Andover ordinances. I am a conscientious person that
takes pride in his home and it's appearance. I wouldn't
do anything to degrade the residential character or
integrity of my neighborhood area. Clearly, my proposal
is harmony with the spirit of the law.

WHEREAS, Troy and Nancy Harris have requested a lot split
on the property located at 74 Andover Boulevard NW, legally
described as:
THE NORTH 673.01 FEET OF LOT 8, AUDITORS SUBDIVISION NO.
141; EXCEPT ROADS; SUBJECT TO EASEMENTS OF RECORD
WHEREAS, the Planning and zoning Commission has reviewed
the request and has determined that said request meets the
criteria of Ordinance No. 40; and
WHEREAS, the Planning and zoning Commission finds the
request is consistent with the Comprehensive Plan and would not
have a detrimental effect upon the health, safety, morals and
general welfare of the City of Andover; and
WHEREAS, a public' hearing was held and there was no
opposition to said request; and

WHEREAS, the Planning and zoning Commission recommends to
the City Council approval of the lot split.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of
the City of Andover hereby agrees with the recommendation of the
Planning and zoning Commission to allow the lot split on said
property with the following conditions:
1. The applicant shall have the lots surveyed as required and pay
a park dedication fee of $400 upon City Council approval of
the proposed lot split.
2. The applicant shall transfer an additional road easement of 27
feet on Andover Boulevard NW to meet County requirements of a
60 foot road easement.
3. The lot split request shall be subject to a one year sunset
clause.

Ordinance No. 40 regulates the division of lots under 5 acres in
size. A lot split is defined as, "any division of a lot, parcel
or tract of land into not more than two (2) parcels when both
divided parcels meet or exceed the minimum requirements for
platted lots in the applicable zoning district".

Ordinance No.8, Section 6.02 establishes the provisions for
minimum lot width, lot depth and lot area in an R-l zoned
district. The minimum requirements in an R-1 district are as

is buildable with a minimum width of at least one-hundred fifty
(150') feet and a minimum depth of one-hundred fifty (150') feet
and has a width of three hundred (300') feet at the building
setback line.

Ordinance No. 10, Section 9.07.10 establishes the minimum area of
land dedicated to park and open space. For all subdivisions by
metes and bounds description, the subdivider or developer may
elect to pay, in lieu of the park dedication requirements, the sum
of four hundred dollars ($400.00) for each dwelling unit that
could be constructed upon the proposed subdivided property. In
the event the developer elects to pay said four hundred dollar
($400.00) charge, the City may collect additional park fees if the
developer re-subdivides the property in the future.

The cIty Council is requested to review the Lower Rum River Water
Managements Organizations need for insurance as a joint powers
agreement.
Per Peter Tritz of the League of Minnesota Cities Insurance
Trust, joint power groups are not covered by the City's coverage
and need to obtain their own coverage through the League of
Ci ties.
Attached is a proposal from North Star Risk Services, Inc.
We have been advised by Conway Olson, Anoka's agent that the WMO
should purchase the general liability, the errors or omissions,
and the automobile coverage in the amount of $2,291.00.

Ken Orttel has suggested getting only the general liability
coverage. Conway has had experiences where he thinks that the
errors or omissions is equally important.
The Board will probably approve the entire package of $2,291.00.
Conway advises that if you are on official business for the WMO
the auto coverage may be an advantage. The cost is $91.00 a
year.
Attached is part of the proposal provided by North Star Risk
Services, Inc.

WHEREAS, local cable programming brings our community's
political, educational, cultural, sports and special events to
television; and
WHEREAS, local cable programming is produced in conjunction
with a variety of community groups, including Anoka-Hennepin
School District, Anoka Area Chamber of Commerce and Anoka High
School Varsity Sports; and
WHEREAS, 84 hours of original local programming are
cablecast each week; and

The City Council is requested to reduce the letter of
credit and accept the streets for Genthon Ponds Addition as
requested by the developer, Roger Hokanson.
The City has received results for asphalt thickness, density,
and for oil content.
Asphalt Thickness - 6 of 8 tests failed to meet the 2 inches
minimum requirement.
Density Tests -

6 of 8 tests failed to meet the 97% of maximum
density in accordance with the Marshall
Compaction method. 4 tests are between 90-92%
compaction and 2 tests are 96% which could be
acceptable.
Oil Content - The oil content used in the blacktop is less than
the job mix formula that was calculated. The mix
called for 5.5% oil content. Test results
have indicated the oil content is 5%.

With these results, the streets are considered unacceptable. The
City Engineer and myself will be working with the developer and
his contractor to find a solution that will satisfy the City
requirements,

Genthon Ponds

The City Council is requested to reconsider reducing the letter
of credit and accepting the streets for Genthon Ponds Addition as
requested by the developer, Roger Hokanson. Attached is a
prepared resolution.
The letter of credit would be reduced to $10,177 (this is for
items that have not been completed).
Proposed solution for accepting streets in Genthon Ponds:
Asphalt thickness - there was one bad test of 1.2 inches but 30
feet either side of that sample there were samples that measure
1.8" and 1.9". The city had an inspector on the job that checked
the thickness as the pavement was being laid.
Density tests - the density tests were similar to the thickness
where we had a passing test next to low density test with the
same compactive effort.
Oil content - the test results were by extraction test which is a
very difficult test - the plan scale tickets show that there was
5.5% of bituminous material used.
The solution - the solution we are recommending is: the
contractor will give the city a maintenance bond covering the
work for 2 years at 100% and a 3~year where the cost would be
50/50 with the city.
Under a normal job we get a 1 year warranty which has been an
escrow. In this case the amount would be $3,000.

SECTION 01-32-24.
WHEREAS, the developer has completed the streets of Genthon
Ponds Addition.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Andover to hereby approve the final street construction
of Genthon Ponds Addition contingent upon providing the
following:
1, Developer provide a 100% warranty bond for the first
2 years for the streets.
2. Developer is responsible for 50% warranty and the city
is responsible for 50% for the 3rd year.
3. All warranties would expire 3 years from the date of
this resolution.

The City Council is requested to reconsider reducing the letter
of credit and accepting the streets for Genthon ponds Addition as
requested by the developer, Roger Hokanson. Attached is a
prepared resolution.
The letter of credit would be reduced to $10,177 (this is for
items that have not been completed).
proposed solution for accepting streets in Genthon ponds:
Asphalt thickness - there was one bad test of 1.2 inches but 30
feet either side of that sample there were samples that measure
1.8" and 1.9". The city had an inspector on the job that checked
the thickness as the pavement was being laid.
Density tests - the density tests were similar to the thickness
where we had a passing test next to low density test with the
same compactive effort.
Oil content - the test results were by extraction test which is a
very difficult test - the plan scale tickets show that there was
5.5% of bituminous material used.
The solution - the solution we are recommending is: the
contractor will give the city a maintenance bond covering the
work for 2 years at 100% and a 3Uyear where the cost would be
SO/50 with the city.
under a normal job we get a 1 year warranty which has been an
escrow. In this case the amount would be $3,000.

WHEREAS, the developer has completed the streets of Genthon
Ponds Addition.
NOW,' THEREFORE, BE IT RESOLVED by the City Council of the
City of Andover to hereby approve the final street construction
of Genthon ponds Addition contingent upon providing the
following:
1. Developer provide a 100% warranty bond for the first
2 years for the streets.
2. Developer is responsible for 50% warranty and the city
is responsible for 50% for the 3rd year.
3. All warranties would expire 3 years from the date of
this resolution.

a motion to request the city of Ham Lake to install a trash rack

introduced a policy outlining the water management plan content

11. Legislative Issues: Kelly presented several issues that
have been discussed during 1991 that involve legislative action.
They were: 1. Removal of the Levy Limit; 2. Relating Revenues to
the Runoff from Property; 3. Coordination and Conformance of
State and Regional Facilities. Carlos Avery Wildlife Management
Area, Janes Field - Anoka County Airport, Bunker Hill Park;
4. Recovery or Capturing Costs Associated with State and
Regional Facilities.
Hammes suggested adding the Administrative Levy and
clarifications to the State No Net Loss Policy. Kelly
recommended that the Board direct staff to prepare resolutions on
selected issues for possible adoption by the Board. Kelly also
recommended the Board direct staff to prepare a plan for
distributing the Board's position to affected units of Government
and the legislative delegation. Staff recommendation was moved
by Boyum. Seconded by Williams. Motion carried with five yeas
(Boyum, Hemmes, Hentges, Richmond, and Williams) and no nays.

FINDINGS:
No State wetlands are involved
No Federal wetlands are filled or drained,
however, a wetland on the NWI is the final
receiveing body for runoff from the project.
Drainage swale will carry water at approximately
2.5 ft/sec.
Constructed ditch will carry water at
approximately 4 ft/sec from the pond, slowing
to approximately 2 ft/sec as water enters the
wetland
Runoff from the swale is recieved into .12 acre
pond before being discharged into the
l'let 1 and.
RECOMMENDATION:
Approval with the following stipulations:
1. Contractor is requied to obtain a permit from the
District.
2. Erosion control escrow of $5.106 (1/3 rule = $1.701)
