Schrantz The City Council is requested to discuss the proposed Salary Plan for 1993 with Cy Smythe. Cy is recommending salaries to conform with the Comparable Worth Plan that the State has required. Attached is the maximum salary for each position and a recommended salary for each position recognizing the experience level in that position. Attached is the Union Contract demands. Article VII - Definitions, section 7.7: Discuss at table. ..s~verz.t4J./ce PAr 3. Article XVII - Safety: Employer shall provide safety shoes for employees if required to be worn. 4. Article XIX - Insurance: The Employer shall pay all increases on insurance. The Employer shall pay all insurance premiums for employees who are disabled from work for up to six months. 5. '\ " , - , 6. New Article - Dental Insurance: The Employer shall provide dental insurance to all employees of the city. New Article - Holidays: Add Christmas Eve Day. Appendix A - Wages: Implement a step schedule for wages so employees have a way of moving to the top wage rates. 8. The Andover Volunteer Fire Department must approve the amendment to the By-Laws. Also included is a Grievance policy to be included in the Fire Department Operations Manual. Dale, Bill and I met and drafted the amendment to the by-laws, the ordinance and a grievance policy form which Bill then drafted into final forms. Dale has put together an Andover Volunteer Fire Department Operations Manual. He did an excellent job on the manual. I am recommending that we include both the suspension and the dismissal provisions in section 3 and that Sections 4 and 5 of Article VIII of the By-laws be removed since I they are now dealt with in the new section 3. ~ I have also prepared an amendment to Ordinance 42 for the City/ I Council members which amends section 4 concerning suspensions and dismissals. It is my understanding the City Council did not want to become involved in suspensions or dismissals and had delegated that authority to the city Administrator. This ordinance amendment along with the amendment to the By-laws accomplishes that purpose. Please have the City council consider the ordinance amendment and provide them with a copy of the By-laws change so they can see the new procedures that are being proposed. '1 \.J AMENDMENT TO THE BY-LAWS OF THE ANDOVER VOLUNTEER FIRE DEPARTMENT CITY OF ANDOVER, ANOKA COUNTY, STATE OF MINNESOTA " ARTICLE VIII SUSPENSION/REMOVAL/REINSTATEMENT OF MEMBERS Section 3 The Chief of the Fire Department shall have the sole authority to suspend members as provided herein. The Chief shall investi- gate any allegation on which a suspension might be based before such action is taken. Unless infractions are severe and jeopardize the health, welfare and safety of the other fire department members or the public, disciplinary action against any member shall be progressive and follow the following steps: a. Oral reprimand. ~~ b. Written reprimand. A written reprimand shall state that the member is being warned for misconduct, describe the misconduct, cite past actions taken by the department to correct the problem, urge prompt improvement and show future penal ties if the problem continues. The member shall be given a copy of the written reprimand and sign the original indicating that he has received such copy. The signature of the member does not mean he agrees to the reprimand, only that he has been made aware of it in writing. The reprimand shall be placed in the member's personnel file along with the member's reply. c. Suspension. Prior to the suspension, the member shall be notified in writing of the reasons for the suspension and its length. Unless a suspension is for a severe infraction, it shall not commence until after the appeal rights of the member have been completed as provided herein. The member has seven (7) days from the date of receipt. of notice of suspension to appeal any suspension. Such appeal shall be commenced by the member personally serving written notice thereof upon the Chief. The Chief shall notify the griev- ance committee of the fire department within three (3) days who shall perform an investigation of the alleged incidents and prepare its report within seven (7) days after receipt thereof. Only information on the specific incidents shall be considered in the report of the grievance committee. The grievance committee may seek information from anyone with facts on the incident. The report shall be delivered to the Chief who shall have 24 hours to reconsider his decision. If such decision is not reversed by the Chief, the appeal ') '-J -1- ~) , , ,~ ,) shall be presented to the membership. It shall be voted on by the membership at their next regular meeting or special meeting. Two-thirds of the active members present, provided a quorum is present, must vote to rescind the suspension. Under no circumstances shall any suspension exceed ninety (90) days in length. No further rights of appeal shall be granted for suspensions hereunder. " d. Dismissal. The Chief shall have the authority to dismiss a member after the member is given a notice in writing by the Chief at least five (5) days before the effective date of the dismissal. The member's right to appeal the dismissal shall be the same as those in the case of a suspension, however, such dismissal shall be upon the vote of two-thirds of all active members of the fire department. Should the member choose to appeal the determination of the fire department, he shall notify the fire department and the City Administrator of the City of Andover in writing of his request to appeal within seven (7) days after the department decision. The City Administrator shall review all relevant information concerning the dismissal including the report of the grievance committee and shall personally hear oral and written information from the member and the Chief or his designee. Within thirty (30) days of the decision of the department on dismissal, the City Administrator shall make a determination on whether to uphold the dismissal or rein- state the member on such terms and conditions as the City Administrator deems reasonable. AN ORDINANCE AMENDING ORDINANCE NO. 42 AN ORDINANCE FOR THE ESTABLISHMENT OF A VOLUNTEER FIRE DEPARTMENT, MAKING RULES AND REGULATIONS FOR THE GOVERNMENT OF ';t'HE SA.i."1E AND PROVIDING A PENALTY FOR VIOLATION THEREOF. The City council of the City of Andover hereby ordains: Ordinance No. 42 is hereby amended as follows: Section 2 - Election The Chief of the Fire Department, the ASsistant Chief, and the Fire Marshal shall be elected annually by the members of the department subject to confirmation of the City council. Each shall hold office for one year and until his successor has been duly elected, except that he may be removed by the City Council for cause after a hearing. Firefighters and probationary fire- fighters shall be appointed by the members of the department. Firefighters shall continue to serve as members of the depart- ment during good behavior and may be removed as provided in Section 4 hereof. ~ The Chief shall have control over all of the fire fighting apparatus and shall be solely responsible for its care and condi tion. He shall make a report, semi-annually to the City council at its meetings in February and August, as to the condition of the equipment and needs of the fire department. He may submit additional reports and recommendations at a meeting of the City council and shall report each suspension or dis- missal of a member of the fire department at the first City council meeting following such suspension or dismissal. He shall be responsible for the proper training and discipline of the members of the fire department and may suspend or dismiss any member for refusal or neglect to obey orders or violation of any other personnel standards of the fire department. The City Administrator shall be the final authority in determining the reasonableness of any dismissal. Such suspension or dismissal shall be in accordance with the Fire Department By-laws adopted by the membership. ,~ Section 9 - Loss of Membershi~ Firefighters absent from three consecutive drills or meetings, unless excused by the Fire Chief, shall be dismissed from the Section 4 - Duties of the Chief -1- , '\ ',- .-J :-J " " '-J P~"~-4 - membership in the department. When any members grievance comes to the attention of an officer, the officer shall discuss all relevant circumstances with the member and the members representative if the member so desires, consider and examine the causes of the grievance and attempt to resolve it to the extent that the officer has authority to do so. If the grievance is not dealt with satisfactorily at that level, the grievance may be carried up to the next higher level and if necessary up to the Chief.
