If it is Council's wish to hold a municipal primary, you must adopt either a resolution or an ordinance establishing a municipal primary three months prior to the General Election. This should be done at the last meeting in July. Filings for candidates for Mayor and City Council are July 7, 1992 through July 21, 1992. I know this may cause some problems for both the D~partment and the City. I've weished all that's happened with the Department over the last 2 years that I've been chief. After looking at everything, I feel it best that I take a step back and let someone else tak~ over where I've left off. That person will have my full support. My intentions are to stay on the Department as a firefighter, after all that is really all any of us are. We have to go forward now, as we have in the past. This is a good, young Department with many talonts and lots of anersy, and I'm glQd to be part of this organization. I h~ve to thank Mayor Orttel and all the members nf council for their support in everything we've tried to do. The House is voting on this issue on Thursday of this week. o Anne Higgens from the League of Minnesota Cities called to say that Representative Lynch is wavering and may vote to support the Governor. Testing the state's drinking water for harmful contaminants-lead, copper, agricultural and industrial pollutants-has been an important activity of the state health department. And that activity continues. However, in 1992, Minnesota must begin testing to check the levels of 58 additional contaminants in its drinking water. These new tests, mandated by federal law, will increase the costs of testing Minnesota's drinking water. And there are no new federal funds to support the federally mandated testing programs. Therefore, in 1992 Minnesota's legislators will be asked to set up a system to fund expanded water testing. Not just for 1992, but for years to come. In fact, during the next several years, new tests for additional contaminants will be added to the state's water monitoring programs as a result of the federal mandate. One funding option being proposed applIes a flat service connection fee to homes, schools, and businesses In the state served by municipal water supplies. New statewide water testing requirements will be paid for if each home, business, and school connected to a municipal water supply pays an estimated $5.00 service connection fee annually. The proposed statewide service connection fee will spread out the payment for the new testing requirements among municipal water supply users. Forcing individual water supplIers to pay for testing would mean hefty rate Increases for small water supply systems and those who rely on them. If the proposed change does not occur, homeowners, schools, businesses in small towns, and businesses and schools with their own wells will pay a greater share of the testing costs than those served by the water suppliers in larger cities. Lake Blvd. BY: REQUEST The City Council is asked to review the Amended Special Use Permit request of Grace Lutheran Church to allow for the construction of an addition to the church on the following described property: 13655 Round Lake Blvd. NW (PIN 32-32-24-42-0007 & 0009) The property is legally described on the attached resolution. APPLICABLE ORDINANCES ,~ Ordinance No.8, Section 5.03 regulates the Special Use Permit process as well as the Amended Special Use Permit process. Ordinance No.8, Section 7.03, establishes those uses allowed by Special Use Permit. In an R-4, Single Family Urban District, churches are allowed by the granting of a Special Use Permit. In granting a Special Use Permit, the City Council shall examine the effect of the proposed use upon the health, safety, morals and general welfare of occupants of surrounding lands. APPLICABLE ORDINANCES Ordinance No.8, Section 5.03 regulates the Special Use Permit process. /'-\ Ordinance No.8, Section 5.03(A) states that, "Any change \~ involving structural alteration, enlargement, intensification of use, or similar change not specifically permitted by the Special Use Permit shall require an amended Special Use Permit and all procedures shall apply as if a new permit were being issued". Ordinance No.8, Section 7.03 lists those uses allowed by Special Use Permit. In an R-4, Single Family Urban District, churches are allowed under a Special Use Permit. In granting an Amended Special Use Permit, the following criteria shall be examined. /-~ 'J 1. The effect of the proposed use upon the health, safety, morals and general welfare of occupants of surrounding lands. The use would not have a detrimental effect. The use would provide a service to the City. 2. The existing and anticipated traffic conditions including parking facilities on adjacent streets and land. With the upgrading of Round Lake Boulevard NW and Bunker Lake Boulevard NW the Andover Review Committee is concerned with the traffic conditions generated from the property and the accesses to Round Lake and Bunker Lake Boulevard NW. However, the proposed addition to the Church will not increase the patronage and therefore should not increase the amount of traffic onto the County Roads. The use would be consistent with the Comprehensive Plan. COMMISSION OPTIONS 1. Pre lmlnary P at ~ BY: Andover Review Committee The City Council is requested to review and recommend approving of the preliminary plat of the Holmberg Addition per Ordinance 8 and 10 and all other applicable ordinances as requested by Wayne Holmberg, owner and developer of the property. The Andover review Committee (ARC) has reviewed the preliminary plat. Their comments are as follows: General Comments: * The proposed preliminary plat is currently zoned Family. R-1 allows 2.5 acre minimum size lots. the property will not be necessary. * The proposed subdivision consists 7 single family rural residential lots. R-1 Single Rezoning of CJ * The developer and/or owner will be required to obtain all necessary permits (DNR, U.S. Army Corps of Engineers, Lower Rum River WMO and any other agency which may be interested in the site). Recommendations of the Andover Review Committee A. Lot 4, Block 1 will require a variance for lot width at the front building setback line. The ARC recommends approval of the variance. The analogy that was used by the ARC was determined by the City Council meeting where the recommendation of the sketch plan was to extend Magnolia Street NW south but not to extend north. If Magnolia Street had been extended north Lot 4 would have met the 300' minimum width requirement but then a variance for lot size would have been required. Recommendations of the Planning and Zoning Commission The Commission recommends approval of the preliminary plat and agrees with the recommendations made by the Andover Review Committee. Recommendations of the Park and Recreation Commission The Commission has recommended cash in lieu of land. The following comments are per the preliminary plat checklist (Ordinance 10): 8.01 IDENTIFICATION AND DESCRIPTION a. Proposed name is Holmberg Addition. d. Scale is 1" = 100'. g. The preliminary plat, grading and drainage plan was prepared by Ronald Swenson of Swenson Land Surveying and the drainage plan has been reviewed by Lawrence Olson of Midwest Land and Civil Engineers, Inc. 8.02 EXISTING CONDITIONS b. Total acreage is 19.7. c. The existing zoning within 300 feet of the proposed plat has been shown. f. The total linear road mileage for the proposed plat is 0.25 miles. 9.02 STREET PLANS a. The typical section, right-of-way and grade is indicated on the preliminary plat. b. The proposed Magnolia Street NW has been shown to serve the property to the south to allow for ultimate extension of Magnolia Street and future development. :J 9.03 STREETS a. The proposed right-of-way is shown as 60 feet which conforms to standards by classification. m. Driveway access shall be 60 feet or more from any intersection. 9.04 EASEMENTS n. The area requested is a part of the Weybridge Plat. '-- A public hearing on the amendment may not be required because the request is consistent with the Comprehensive Plan that has been submitted to Metropolitan Council. Staff has determined that this request could be submitted to Metro Council in two or three weeks. This includes report preparation and photocopying time by City Staff. TKDA will also be involved in calculating sewer flow projections for the area requested. The developer shall be responsible for paying all charges incurred by the City during the minor amendment process. The cost is estimated to be between $500 and $1,000. Staff is concerned with the reaction Metropolitan Council has with the City submitting minor amendments while the Comprehensive Plan is being reviewed. Included in this request are approximately 30 acres of buildable land including road right of way and approximately 4.0 acres of park. The plat of Weybridge has received all of the outside permits needed and is not proposing to fill, alter, or construct in any wetland or protected waterway. We would reimburse the City for the expenses of this amendment. The reasons for the above request are as follows: (1) Uncertain time period for the Comprehensive Plan Amendment review process. \ ,-~ The revised Andover Comprehensive Plan has been significantly delayed in the Metropolitan Council review process. As of the date of this request it is our understanding that the time clock (90 days review period) has not yet started. If the minor amendment requested above is submitted to the Metropolitan Council the review process would start immediately and we would have a yes or no withir 60 days. (2) Immediate need for lots. At the present time, we are out of lots for some price level of homes and are very short in other areas. We are especially short of lots for the moderate to middle price range of homes. The lots in Weybridge Phase I and II would solve this shortage of lots. (3) Loss of the 1992 utility construction period. The most significant effect of the delay in the o '\ ,~ , ''\ , '--J C] approval of the Revised Comprehensive Plan is that the 1992 utility construction season will be lost if the approval is not received within the next 60 - 90 days. If our request for the minor amendment is approved we would be able to have the utilities installed yet this year. Given the degree of uncertainty over when the Andover Comprehensive Plan would be reviewed, the immediate need for lots and the potential loss of the 1992 construction season, we hope that our request would be received favorably and that the City Council authorizes the City Staff and consultants to prepare the necessary documents for this request. The current Andover Comprehensive Plan was completed in 1980 and approved in 1982. It addresses few if any housing, (low and moderate income) issues. Because of the rapid growth experienced by Andover, the Comprehensive Plan should address public services and facilities. Administrative costs will be included in this project. All residents of the City of Andover will benefit from the update and improvement of the City's Comprehensive Plan. As the City continues to grow, residents will be better served if the City has long range goals and plans with which to guide development. III. & IV. PROJECT DURATION The Comprehensive Plan is projected to take three years to update, including plan preparation, public input, City approval, Metropolitan Council approval and publication. The City Comprehensive Plan will guide development and City improvement for the next five to seven years and if implemented properly, into the next century. v. This project would address the problems of housing, sewer and water capacity planning, parks and recreation, public facility development, commercial development and other development and growth issues. VI. The Andover City Council proposes to use $5,000 in 1992 for the continuation of the task of updating the Comprehensive Plan. The funding for the Andover revitalization project will come from the project income from the sale of lots acquired in the past. The purpose of the project is to combat the increasing number of homeless people in Anoka County. These figures will be determined by the ACCAP and reported back to the City. III. & IV. PROJECT DURATION This project is to be conducted during the 1992 fiscal year. WITNESSETH: WHEREAS, Anoka County has received SCORE funds for the calendar year 1991 pursuant to Minn. Stat. 9 115A.557 and has entered into joint powers agreement with municipalities in Anoka County for distribution of said funds for local recycling programs; and WHEREAS, it appears likely that the municipalities will not have expended all of these SCORE funds by December 31, 1991; and WHEREAS, the County wishes to reallocate any remaining SCORE funds to further assist municipalities which have achieved recycling goals established by the Anoka County Board; and WHEREAS, the Municipality has met its recycling goal for the calendar year 1991 and wishes to receive additional funding for its recycling and/or yard waste abatement programs; NOW, THEREFORE, in consideration of the mutual covenants and promises contained in this Agreement, the parties mutually agree to the following terms and conditions: 1. PURPOSE, The purpose of this Agreement is to provide for cooperation between the County and the Municipality to implement solid waste recycling and yard waste abatement programs in the Municipality, 2. TERM, The term of this Agreement is from January 1, 1992 through June 30, 1992, unless earlier terminated as provided herein, 3. FUNDING. The County shall disburse to the Municipality a grant of $5,000 in SCORE funds within 30 days of execution of this Agreement. 4. REQUIREMENTS. By accepting the use of grant funds disbursed pursuant to this Agreement, the Municipality agrees to the following: A. The Municipality shall ensure that said grant funds are expended only for the purposes allowed by Minn, Stat. 9 115A.557, Subd, 2 (1991), including solid waste recycling and yard waste abatement programs. Said grant funds may be used to reimburse eligible expenditures by the Municipality in calendar year 1991 or to fund eligible expenditures during the term of the Agreement. ,- \ V 8. The Municipality shall operate the programs funded under this Agreement pursuant to all applicable federal, state and local laws and rules, " C. The Municipality shall submit a report to the County on forms provided by the County no later June 1, 1992. Said report shall include the following information: 1. An itemized accounting of expenditures, including documentation verifying that said expenditure were made, 2, Copies of all promotional materials prepared in whole or in part with funds provided under this Agreement. The Municipality agrees to furnish the County with additional reports in form and at frequencies requested by the County for financial evaluation, program management purposes, and reporting to the Metropolitan Council and the State of Minnesota, ~ 5. RECORDS. The Municipality shall maintain financial and other records and accounts in accordance with requirements of the County and the State of Minnesota, The Municipality shall maintain strict accountability of all funds and maintain records of all receipts and disbursements, Such records and accounts shall be maintained in a form which will permit the tracing of funds and program income to final expenditure, The Municipality shall maintain records sufficient to reflect that all funds received under this Agreement were expended for the purposes allowed by Minn, Stat. S 115A.557, subd. 2. All records and accounts shall be retained as provided by law, but in no event for a period of less than three years. 6. AUDIT, Pursuant to Minn, Stat. S 168.06, Subd, 4, the Municipality shall allow the County or other persons or agencies authorized by the County, and the State of Minnesota, including the Legislative Auditor or the State Auditor, access to the records of the Municipality at reasonable hours, including all books, records, documents, and accounting procedures and practices of the Municipality relevant to the subject matter of the Agreement, for purposes of audit. In addition, the County shall have access to the project site(s), if any, at reasonable hours. 7. GENERAL PROVISIONS. A. In performing the provisions of this Agreement, both parties agree to comply with all applicable federal, state or local laws, ordinances, rules, regulations or standards established by any agency or special governmental unit which are now or hereafter promulgated insofar as they relate to performance of the provisions of this Agreement. In addition, the Municipality shall comply with all applicable requirements of the State of Minnesota for the use of SCORE funds provided to the Municipality by the County under this Agreement. B. No person shall illegally, on the grounds of race, creed, color, religion, sex, marital status, public assistance status, sexual preference, handicap, age or national origin, be excluded from full employment rights in, participation in, be denied the benefits of, ::J - 2 - , "- o E. F '\ 'J or be otherwise subjected to unlawful discrimination under any program, service or activity hereunder. The Municipality agrees to take affirmative action so that applicants and employees are treated equally with respect to the following: employment, upgrading, demotion, transfer, recruitment, layoff, termination, selection for training, rates of pay, and other forms of compensation, C, The Municipality shall be responsible for the performance of all subcontracts and shall ensure that the subcontractors perform fully the terms of the subcontract. The Agreement between the Municipality and a subcontractor shall obligate the subcontractor to comply fully with the terms of this Agreement. D. The Municipality agrees that the Municipality's employees and subcontractor's employees who fall within any job classification established and published by the Minnesota Department of Labor & Industry shall be paid, at a minimum, the prevailing wa'ges rates as certified by said Department. Each Municipality and subcontractor performing work on a public project shall post on the project the applicable prevailing wage rates and hourly basic rates of pay for the County or area within which the project is being performed, including the effective date of any changes thereof, in at least one conspicuous place for the information of the employees working on the project. The information so posted shall include a breakdown of contributions for health and welfare benefits, vacation benefits, pension benefits and any other economic benefit required to be paid. It is understood and agreed that the entire Agreement is contained herein and that this Agreement supersedes all oral and written agreements and negotiations between the parties relating to the subject matter hereof, F. Any amendments, alterations, variations, modifications, or waivers of this Agreement shall be valid only when they have been reduced to writing, duly signed by the parties, G. Contracts let and purchases made under this Agreement shall be made by the Municipality in conformance with all laws, rules, and regulations applicable to the Municipality. H, The provisions of this Agreement are severable, If any paragraph, section, subdivision, sentence, clause or phrase of this Agreement is for any reason held to be contrary to law, such decision shall not affect the remaining portion of this Agreement. 8. PUBLICATION. I have been notified by our insurance adjuster that they have totaled out this machine. The machine is seven years old. They will give us $5,000 for the unit and we can buy it back for $200. Toro's price for repairing the unit is $4,500, which is what I would like to do. Buy back this unit for $200, use Park Operating Budget to repair it for $4,500 and use $4,800 insurance check to purchase a new Toro Grounds Master which would cost an estimated amount of . Andover Water Plan available for review NEW BUSINESS ADJOURN COON CREEK WATERSHED DISTRICT BOARD OF MANAGERS' MEETING January 27, 1992 The Board of Managers of the Coon Creek Watershed Oistrict held their regular meeting on January 27, 1992 at the Bunker Hills Activities Center. Present: Reggie Hemmes, Eldon Hentges, LuEllen Richmond, Paul Williams, Bob Boyum. Staff: Ulrich. Tim Kelly, Kathy Tingelstad, Ed Mathiesen, Michelle 1. The meeting was called to order at 7:30 PM 2. Approval of the Agenda: Moved by Richmond, seconded by Williams. Motion carried I.ith five yeas (Boyum, Hemmes, Hentges, Richmond, and Williams) and no nays. 3. Open Mike: Grace and Ralph Strike were present. They wanted to discuss the Skunk Hollow area near their home, located on Coon Creek below Coon Rapids Boulevard. They showed pictures taken in early November, 1991 and January, 1992. The photos showed high water levels in the Creek and a backup of ice near buildings. Strike would like the Creek cleaned so that the flow will be better. He said that there are no beaver dams there, as far as he knows. He says the water back-up problem is due to culverts blocking up and suggested that larger culverts be put in. Kelly said he was in this area in November, 1991 and identified it as a problem area. Richmond mentioned that the banks of the Creek were eroding from the heavy snow and falling into the Creek. Hentges mentioned that with snow/slush in the ditch that it can block and plug up the Creek. Staff will review the situation and bring recommendations. Kelly will discuss the problem with Paul Ruud of Anoka County Public Works to see if a machine can get into the area and clean it up, or pursue other alternatives. Policy Items 4. Approval of January 13, 1992 Minutes: williams had one correction relating to the motion moved in item 5 under policy items: "to approve the monthly financial statements." This correction was noted. Moved by Hentges, seconded by RIchmond to approve the minutes with the correction. Motion carried with five yeas (Boyum, Hemmes, Hentges, Richmond, and Williams) and no nays. 5. Awarding Bid of Creekview Pond: This item was tabled at the December 9, 1991 meeting to determine if there was a way to reduce the project co~t. On January 15 Park Construction informed the District that it could not change its bid. Discussion centered around the financing strategy. Kelly stated that if Park finishes the project in 1992 the project would have to be paid out of fund balances. If the project is completed after 1992 the District could levy for the cost. Kelly will check with Park to suggest phased payments with one sum paid after the culverts on the pond were connected and the second half when the pond was completed. Mathiesen commented that this project meets the District reQuirements for common benefit. , Page 2. Coon Creek Watershed Distr1ct - January 27, 1992 Ulrich asked about the need to have a public hearing to satisfy requirements for 509 funding. Kelly said that there had already been a public hearing on in July 1991. Hentges moved awarding the bid to Park Construction. He stipulated that the District first try to pay for the project with the 509 County Capital budget. Seconded by Richmond. Motion carried with five yeas (Boyum, Hemmes, Hentges, Richmond, and Williams) and no nays. 6. Training Request: Kelly discussed three training sessions in the Board packets, The first one, Minnesota Water 92, costs $55 and would be attended by Kelly on February 20-21; The second one, on Wetlands, costs $10 per person and would be attended by Hentges, Williams and Kelly; The third one is a series of Sunday afternoon workshops which the Managers were encouraged to attend. Williams suggested that individual managers should touch base with Kelly if interested in attending. Moved by Richmond to approve the training requests. Seconded by Williams. Mot1on carried with five yeas (Boyum, Hemmes, Hentges, Richmond, and Williams) and no hays. Permit Items 7. Independent Estates: Mathiesen presented the permit review on this item for developing 9 lots on 22.67 acres at 2421 Constance Blvd. NS in Ham Lake. The exhibits and findings were in order. The permit applicant offered and is providing drainage easements around the wetlands in the area. Williams moved approval of the permit and Richmond seconded the motion with the following stipulations: Building pad elevation on lot I, block 1 is resolved with the Ham Lake City Eng1neer; Silt fence or hay bales be installed around the two catch basins on Taconite Street until the base course of paving is installed; and Receipt of erosion escrow for $1,400.00. Motion carried with five yeas (Boyum, Hemmes, Hentges, Richmond, and Williams) and no nays. 9. Update on Peterson Permit: This item had been table at the January 13 Board meeting. After conversations with Hentges and the permit applicant, the project may be restructured as a wetland enhancement. This option will be discussed in more detail with staff soon. Kelly mentioned that in the next 19 months wetlands can be replaced acre-per-acre in the same area, however, after that time the replacement procedure becomes more complicated. No action was required by the Board on this item. Discussion Items 9. Rece1Pt of Andover Storm Water Plan: Kelly said that the C1ty of Andover is the first city to submit its Local Water Plan for District review. The first step in this process calls for a hearing within 30 days of rece1pt (by February 24) to review the conformance of the local plan to the District's comprehenS1ve plan and to receive comment. The Board then has 30 days to make its decision or recommendation. He~mes suggested that Kelly bring this plan to the next Board meeting so that the managers can see it. ( Page 3. Coon Creek Watershed District - January 27, 1992 The following motion was moved by Richmond and seconded by Williams: That the District take receipt of the plan and set a hearing for the plan on February 24 as a policy item. Motion carried with five yeas (Boyum, Hemmes, Hentges, Richmond, and Williams) and no nays. Informational Items 10. Results of Administrators' meeting: Kelly presented highlights of the January 21 Watershed District Administrators' meeting, which focused on financing and other topics of concern. The group plans to meet again in April. No action was required by the Board on this item. 11. Annual Plan Update: Hemmes questioned about the Oitch 57 cleaning project which was discussed at the January 13 Board meeting. Kelly said that his report will be in the staff report at the first meeting of each month. He added that Larry Carlson's property will be used to stock-pile wood and burn it. This issue was also on the City of Andover's recent City Council agenda; they supported it if their public works staff was able to do it. No action was required by the Board on this item. To adequately service the system, we propose the following: 1. Grace Lutheran Church will install a sprinkling system to meet the requirements of state codes. 2.
