A RESOLUTION ORDERING THE InPROVEMEN~ OF S~REET LIGHTING, PROJECT
NO. 91-26, IN MEADOW CREEK ESTATES METES AND BOUNDS SUBDIVISION
AREA LOCATED IN THE W 1/2 OF THE SW 1/4 OF SECTION 33-32-24.
to adopt the
WHEREAS, pursuant to the required published and mailed
notice, a public hearing was held on the 4th day of February
1992; and
WHEREAS, all per.srns desiring to be heard were given such
opportunity for same.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Andover to hereby order improvement No. 91-26, street
lighting in the Meadow Creek Estates Metes and Bounds Subdivision
with the costs of same to be billed on the normal quarterly
utility billing.

adopted by the City Council of the City of Andover this

Meadow Creek Estates
Formula used to determine street lighting costs:
J4457 installation cost : 14 lights = $318.36 cost/light
The cost of each street light per month for a 5 year at 8.75%
interest is $6.57.
$6.57 + $10.16 (flat monthly rate) = $16.73/month/light
$16.73 cost of light/mo. X 3 mos./qtr. = $7.99/lot/qtr.
6.28 # of lots/light
$7.99/lot/qtr. AEC
$1.28 overhead; computer; postage (city)
$9.27/qtr./lot or $37.08/yr./lot
The city of Andover is paying AEC monthly and lots will be billed
quarterly by the City.

NOTICE IS HEREBY GIVEN that the City Council of the City of
Andover, Anoka County, Minnesota will meet at the Andover City
Hall, 1685 Crosstown Boulevard N.W. in the City of Andover, on
Tuesday, February 4, 1992 at 7:30 P.M. to consider the making of
the following improvement:

The property to be assessed, pursuant to Minnesota Statutes
Section 429, for such improvement is within the following

The Andover City Council is asked to review the request of the
Ashford Development Corporation, Inc. to rezone from R-1,
Single Family Rural to R-4, Single Family Urban the property
legally described on the attached resolution.
BACKGROUND
The Planning and Zoning Commission, at their January 14, 1992
meeting, recommended approval of the rezoning request and in doing
so cited the reasons indicated on the attached resolution.
APPLICABLE ORDINANCES
Ordinance No.8, Section 5.02, establishes the procedure for
changing zoning district boundaries.
Ordinance No.8, Section 5.03 (B) establishes the criteria for
granting a Special Use Permit. These same criteria shall be used
for rezoning requests as well.
RECOMMENDATION
The Planning and zoning Commission and Staff recommend approval of
the rezoning requested by the Ashford Development Corporation,
Inc. to rezone property from R-1, Single Family Rural to R-4,
Single Family Urban with conditions as listed on the attached
resolution. The Council should also consult the January 14, 1992
Planning and zoning Commission meeting minutes included in the
packet materials for details on the public hearing.
NOTE: The Planning and Zoning Commission agreed that the rezoning
should not be contigent upon Metropolitan Council approval of
the Comprehensive Plan. The Council should consider adding thi

WHEREAS, Ashford Development Corporation, Inc. has
requested a rezoning from R-1, Single Family Rural to R-4, Single
Family Urban on the property legally described as:
That part of the west half of the Southeast Quarter of Sectinn 26,
Township 32, Range 24, Annka County, Minnesota, lying west of the
westerly right-of-way line of the Burlington Northern Railroad.
Except that part platted as Creek View Crossing according to the
recorded plat thereof.
WHEREAS, the Planning & zoning Commission has reviewed the
request and has determined that said request meets the criteria of
Ordinance No.8, Section 5.03(B) and that there is no negative
effect of the proposed use upon the health, safety, morals and
general welfare of the occupants of surrounding lands; there will
be no negative effects on the values of property and scenic view
in the surrounding area; and
WHEREAS, the Planning and Zoning Commission finds that
the request is also in compliance with Ordinance No.8, Section
5.02; and
WHEREAS, a public hearing was held and there was no
opposition to said rezoning; and
WHEREAS, the Planning and Zoning Commission recommends to
the City Council approval of the rezoning requested;
NOW, THEREFORE, BE IT RESOLVED, that the City Council of
the City of Andover hereby agrees with the recommendation of the
Planning & Zoning Commission to rezone the above legally describerl
property from R-1, Single Family Rural to R-4, Single Family Urban
with the following conditions:
1. The proposed actions take place within one year from Council
approval as specified in Ordinance No.8, Section 5.03(D).

Commissioner Jonak asked who looks at the effect on traffic conditions
by this rezoning. Mr. Carlberg explained the Anoka County Highway
Department has submitted their comments. Commissioner Peek felt
traffic is not applicable to the rezoning.
The Commission raised the issue of prior use on the property and
.possible environmental concerns. Mr. Windschitl - stated he has
representation from the prior owners. which was a condition of the
purchase of the property, that there are no environmental issues.
Commissioner Peek suggested that documentation be made a condition of
the preliminary plat. which is the next Agenda item.
Mr. Carlberg also reported the 90~day review period for the City's
Comprehensive Plan by the Metropolitan Council has not yet started.
The City is in the process of submitting further information that has
been asked for:.
There being no further: public testimony, Chairperson Dehn asked for a
motion to close the public hearing.

DISCUSSION ON MOTION: It was agreed that the rezoning should not be
contingent upon Metropolitan Council approval o~ the Comprehensive
Plan nor the Minor Amendment to the Plan.

PUBLIC HEARING: PRELIMINARY PLAT. WEYBRIDGE - ASHFORD DEVELOPMENT
7:53 p.m. Mr. Carlberg reviewed the general comments and concerns of
the Andover Review Committee regarding the pro~osed preliminary plat
of Weybrldge located west of the railroad tracks, south of Andover
Boulevard.
Chairperson Dehn opened the hearing for publIc testimony.
Jerry Windschltl. Ashford Development - thought th~ issu~-of the
corner lot. Lot 1, Block 4, was resolved. H~ presented' a drawing of
the lot to scale which shows the lot width at the setback line is
85.32 feet plus another 5.32 feet to the right of way of Xeon. The
. - drawi ng cl ear I y - shows- he-does-not-own- the-property-.to- _ the-stre~t. and.-
that the proposed lot is In compliance with th~ ordinances. He does
not own the remnants and has no control over them.
With that information, Mr. Carlberg suggested the City Engineering
Staff review the item again. Staff is also concerned with eliminating
the lot remnants. requesting that th~ developer try to acquire them.
Mr. Wlndschitl - stated h~can try to obtain them, and has had some
discussions with the owner: but he again claimed the lot as proposed
does meet the ordinance and no variance is needed. Without frontage on
Xeon. he does not have a corner lot. He did not want the plat held up
because of the remnants. stating he is willing.to have his surveyor do
a certificate on the lot.
Mr. Wlndschitl - stated the other objection of the Staff is on the
bubbles. He stated in the past Staff has tried to eliminate them in
plats. although there are bubbles located in three or four other areas
of the City. The bubbles ensure that the plat is in compliance with
the setback requirements. They have shown th~ driveway exists at
those locations and would requir~ th~ driveways to be placed there to
meet the requirement of five feet of green space b~tween property
lines.

Mr. Carlberg stated th~ Review CommIttee looked at the negative aspect
of bubbles for snow removal and street maintenance. There is no place

The City Council is requested to review and recommend approving
of the preliminary plat of weybridge per Ordinance 8 and 10 and
all other applicable Ordinances as requested by Ashford
Development Corporation, Inc.
The Andover Review Committee (ARC) has reviewed the preliminary
plat. Their comments are as follows:
General Comments
* The proposed preliminary plat is currently zoned R-1, Single
Family Rural. The property will need to be rezoned to R-4
Single Family Urban. In addition, the proposed plat is not
within the Metropolitan Urban Service Area (MUSA). This area
has been proposed to be included in a major amendment to the
Comprehensive Plan which has been submitted to the
Metropolitan Council for review.
* The proposed subdivision consists of 148 single family urban
residential lots (the developer submitted a plan of 147 lots
to the planning and zoning Commission).
* The Flood plain Ordinance No. 50 will be in effect. The 100
year flood elevation has been identified on the preliminary
plat for Coon Creek. The developer is proposing not to
disturb the existing floodway.
* The developer and/or owner will be required to obtain all
necessary permits (DNR, U.S. Army Corps of Engineer, Coon
Creek watershed District and any other agency which may be
interested on the site).

Concerns of the Andover Review Committee
A. Lot 1, Block 4 is considered to be a corner lot. Minimum
width at the front setback line is to be 90 feet. The
proposed lot width is approximately 85.32 feet (see letter
dated January 16, 1992 regarding lot from the surveyor). It
is recommended that Outlots A and B from Creek View Crossing
be included with this plat to eliminate any possible lot
remnants which may in the future go tax forfeit and maintained
by a governmental agency. If the developer is unable to
aquire those parcels a variance may be required. The ARC
recommends the variance be denied. The developer could
eliminate a lot to meet all ordinance requirements.
B. The ARC has reviewed the intersection of 144th Lane
NWjWintergreen street NW. It is recommended the outside
right-of-way boundary have a radius of 80 feet which will then
conform to the minimum dimension for right-of-way of 60 feet
(see Ordinance 10 Section 9.03 (streets) (a).
If the City Council agrees with the ARC recommendation, lots
26 and 27 of Block 1 will not meet the 80 feet width at the 35
foot front setback line. There is an option to vary from the
Ordinance to allow the structures to be setback further until
the 80 feet width requirement is met. Another option is to
eliminate lots to meet Ordinance requirements.
C. To date the topos have not been paid. The developer is
responsible to pay for these prior to approving final plat.

WHEREAS, pursuant to published and mailed notice thereof, the
Planning and Zoning Commission has conducted a public hearing and
reviewed the preliminary plat of Weybridge; and
WHEREAS, the Andover Review Committee has reviewed the preliminary
plat; and
WHEREAS, as a result of such hearing, the Planning and Zoning
Commission recommends approval of the plat citing the following:
1. Contingent upon the expansion of the MUSA to include this
property.
2. Flood Plain Ordinance No. 50 will be in effect.
3. The developer and/or owner will be required to obtain all
necessary permits (DNR, U.S. Army Corps of Engineer, Coon Creek
watershed Disctrict and any other agency which may be interested
in the site).
4. Lot 1, Block 4 is considered a cor.ner and the developer is
requir.ed to comply with the Ordinance.
5. The developer is required to comply with Ordinance 10 section 9.03
(streets (a) at the intersection of 144th Lane NW and Wintergreen

6. The City Engineer provide the appropriate signage to conform to

PUBLIC HEARING: PRELIMINARY PLAT. WEYBRIDGE - ASHFORD DEVELOPMENT
7:53 p.m. Mr. Ca~lberg r-eviewed the general comments and concerns of
the Andover Review Committee regar-ding the proposed preliminary plat
of Weybr-idge located west of the r-ailr-oad tr-acks. south of Andover-
Boulevard.
Chairperson Dehn opened the hearing for- public testimony.
Jerr-v Wlndschltl. Ashford Development - thought the issue of the
cor-ner lot, Lot 1, Block 4, was resolved. He presented a dr-awing of
the lot to scale which shows the lot width at the setback line is
85.32 feet plus another 5.32 feet to the right of way of Xeon. The
. --drawing- cl ear-} y-showshe--does-notown~ the-- propeC'ty- to--the- stC'eet-and-
that the proposed lot is in compliance with the ordinances. He does
not own the r-emnants and has no contr-ol over- them.
With that information, Mr-. Car-Iberg suggested the City EngineeC'ing
Staff r-eview the item again. Staff is also concerned with eliminating
the lot remnants. r-equesting that the developeC' tr-y to acquir-e them.
Mr. Windschitl - stated he can tr-y to obtain them, and has had some
discussions with the owner: but he again claimed the lot.as proposed
does meet the ordinance and no variance is needed. Without fr-ontage on
Xeon. he does not have a corner lot. He did not want the plat held up
because of the remnants. stating he is willing to have his surveyor do
a certificate on the lot.
Mr. Windschitl - stated the other- objection of the Staff is on the
bubbles. He stated in the past Staff has tr-ied to eliminate them in
plats, although there ar-e bubbles located in thr-ee or four other ar-eas
of the City. The bubbles ensur-e that the plat is in compliance with
the setback requirements. They have shown the driveway exists at
those locations and would r-equire the driveways to be placed ther-e to
meet the requir-ement of five feet of green space between property
lines.
Mr. Carlberg stated the Review Committee looked at the negative aspect
of bubbles for- snow r-emoval and str-eet maintenance. Ther-e is no place
to put the snow. The Commission noted the additional expense of

plowing bubbles and cul-de-sacs, though CommIssioner Apel noted many
people lIke cul-de-sacs and are willing to pay extra for them. He
felt the higher taxes paid-by those on_cul-de-sacs offsets the higher
maintenance costs for them.
Discussion was then on the proposed grading plan. Mr. Windschltl -
stated the grading plan was changed at the suggestion of City Staff to
move the eastment line back to 140 feet. which Is behind the lots on
Block 2. The easement wil I have no encroachment on the lots
themselves. It allows more flexibility for the use of the rear lots.
He also explained the drainage pattern through the area. The intent is
to have a dry pond, designed not to have standing water and to
permeate in less than one day. It will be seeded or sodded. It Is all
sand.
Commissioner Peek had concern for the person buying a lot where half
of the back yard Is a drainage easement, who wIll be surprised the
first time there is a lOa-year event to see his back yard flooded. He
felt that has been addressed In Block 2, but not the other biocks.
Mr. Windschitl stated he will have it checked again. Mr. Carlberg
stated he will ask the City EngineerIng Staff to review it again also.
Mr. Windchltl - is in the process of looking at signage for the
plat, but felt just one will b~ Installed at Vale and Andover
Boulevard. He will be requestIng that Special Use Permit prior to the
flnai plat. He also noted Staff Is satisfied with the 20-foot
easement to the park along Coon Creek, which also has a la-foot
easement on both sides. He has already obtained a permit from the
Coon Creek Watershed Board.
There being no further testimony, Chairperson Dehn asked for a motion
to close the public hearing.
MOTION by Peek. Seconded by Jovanovich, to so move. Motion carried
on a 5-Yes. 2-Absent (Pease. McMullen) vote.
MOTION by Peek, Seconded by Jonak, to table this item until we
receive detaIls from Staff on Lot 1, Block 4. whether or not this is
considered a corner lot based on information submitted by the
applicant. DISCUSSION: Mr. WIndschItl requested that rather than
delaying the plat because of concerns over one lot, that the plat be
approved contingent upon satisfying the Staff. He felt the item will
be resolved quickly once Staff has the documentation. Mr. Carlberg
agreed wIth the contingency.

MOTION by Peek, Seconded by Apel, that the Andover Planning and
Zoning Commission recommends to the City Council approval of the
preliminary plat of Weybridge as submitted by Ashford Development
Corporation. Inc.. finding that the preliminary plat is in compliance
with Ordinances 8 and 10 with the following comments:
1. The proposed prelimimary plat is currently zoned R-l. Single
Family Rural and needs to be rezoned to R-4. Single Family Urban.
In addition. the proposed plat is not within the Metropolitan
Urban Service Area. This ~rea has been ,proposed to be included in
a major amendment to the Comprehensive Plan which has been
submitted to the Metropolitan Council for review.
2. The proposed subdivision consists of 147 single family urban
residential lots.
3. The Flood Plain Ordinance No. 50 will be in effect. The 100-year
flood elevation has been identified on the preliminary plat for
Coon Creek. The developer- is proposing not to disturb the
existing floodway.
4. The developer- and/or owner will be required to obtain all
necessary permits (DNR. U.S. Army Corps of Engineer. Coon Creek
,.Watecshed.Dlstr.Lct and any other agency which may be interested
in the, site).
5. Determination as to whether Lot 1 of Block 4 is to be considered a
corner lot shall be determined by City Staff based on Information
submi tted by the applicant: anc:l I f. Staff determines it is a corner
lot, that the said lot will have to be adjusted to comply with the
ordinance.
6. That the bubbles at the Intersections of i44'th Lane.NW and
Wintergreen Street NW an-d 141st Lane NW and Vale Street NW are not
In compliance with Ordinance 10 and should be reworked to comply
with Ordinance 10.
7. That signage be provided to address concerns of the Anoka County
Highway Department per theii letter of December 13. 1991.
A public hearing was held and there was no negative comment.

DISCUSSION: The Commission noted the letter from the Anoka County
Highway Department did not specifically place any constraints on the
access to Andover Boulevard. Mr. Carlberg thought the concern is not
having enough warning of th~ railroad tracks for motorists existing
the plat from Vale Street and that signs on Vale Street will be needed
to make them aware of that situation. Mr. Windschitl stated the,
signage i~ controlled by the City Engineer. If the County had been
opposed to that intersection, they would have specifically said so.

On Page 1, in the section titled, Weybridge Preliminary Plat Dedication, the

CHAIRMAN'S REPORT
The Commission and 'Frank Stone, Public Works, discussed the proposed
Weybridge park dedication in reference to their policy of acquiring park land
(see minutes of January 02, 1992). The Park Board felt that their funds were
being used to-acquire dedicate'd land for an easement in: sewer trunk line
development. Mr. Stone expressed that Public Works had proposed this action
only because it would benefit both the Park's trail system and. Public Works
and.that it was not their intention to take this property just so they would have-.
an easement for the trunk sewer line. Chairperson. Kieffer said that the Park
Board did not need two hundred feet (200 ') for the trail system because
seventy-five feet (75') was adequate, but that there might be a possibility in
designating the area for nature rather than just for the trail system. He
concluded that the Park Board misunderstood the proposat of Public Works.
The commissioners will be discussing this dedication at a later time with the
City Council.
. Commissioner Anderson reminds Mr. Haas to resume- the exploration of the
original park dedication with Old Colony Estates of May 19, 1988 and to ask
the City Attorney to determine if the original developer or all three current
developers are liable for cash dedication.
The commissioners also wondered if the grant money had been received.
They expect to be notified soon, possibly by the next meeting.
Chairperson Kieffer expressed concern regarding motorized vehicles in the
parks. He questioned the type of recourse available- if the vehicles are

Commission reviewed park dedication for the proposed sketch plan of

Weybridge. As requested, the Commission is again reviewing park
dedication for the preliminary plat of Weybridge.

Mr. Todd Haas, City Engineer, reported that he and the Public Works
Superintendent have reviewed the preliminary plat and are recommending to
accept the 4.89 acres of park as indicated on the plat and the remainder to be
cash in lieu of land. The remaining dedication is approximately 0.77 acres.
According to Mr. Haas, staff has discussed the issue regarding the low ground
versus high ground with the City Attorney. It is the City Attorney's opinion that
if the Commission recommends accepting the park that whatever the City
accepts, even if it is high ground, low ground or both, the City cannot require
the developer to dedicate the difference between high ground versus low
ground.
Furthermore, the City Engineer and the Public Works Superintendent are
recommending the park to be dedicated for the following reasons:
1. The proposed Andover Comprehensive Plan, Chapter 8, titled Parks,
Recreation and Open Space, Section E subsection (d) "Trail
Deve.lopment" Figure VIII E titled Trails Plan proposes bicycle and
pedestrian uses along the north side of Coon Creek between
Burlington Northern Railroad and Hanson Boulevard.
2. The City should continue to propose to keep the sanitary sewer trunk
furthest away from Coon Creek and closest to the ridge of the hill
due to better soils.
3. The City should accept the Park which will eliminate the extension of
lot lines to Coon Creek, which would have allowed property owners
to build fences, plant trees, store junk, etc. .
After examining the facts and engaging in discussion with Mr. Windschitl and
Mr. Haas, the Commission will-accept the dedication of the preliminary plat of
Weybridge even though the park land does not relate to their policy. The
Commission is dissatisfied with the dedication for the following reasons:

1. The land is unusable and does not follow the definition of park land.
2. Park Board money is being used to acquire land for Public Works
benefits.
3. The original plat agreement contained a negotiated park dedication. .
Cash was never paid into the park dedication fund, The Park Board
feels that this area should be explored before a final decision is
made.
4. . Cash is preferred in lieu of land.
5. The value of the land is questionable to the Park Board.
6. The amount of dedicated land may be in excess of what is needed
for a trail system.
Mr. Windschitl feels he is satisfying the City's ordinance one hundred per cent
and is not concerned with the original plat agreement for park dedication. He
wants a decision from the Park Board as soon as possible, so that he can
advance his development. . Mr. Windschitl said that the bulk of this land is
above the one hundred year flood and considers it the "best property" in the
development. In his opinion, it would "improve those lots that are for sale".
Mr. Haas reports that a feasibility study on the possible expansion of the trunk
line will be ready in approximately two to four weeks.
Commissioner Anderson formulated the Park Board ,recpmmendations to City
Council in accepting the pver-all dedication of the plat .in regard to the
preliminary plat of Weybridge: lake the ac'reage west of property along the
creek up to where the sewer line cuts south, then seventy-five feet (75') from
the creek to the east end of the property in order to facilitate further trail
systems; the dedication required in excess should be in the form of cash and
dependent upon the feasibility study; and original dedication with Old Colony
Estates of May 19,1988 should be explored. The City Attorney is to determine
which party is liable for cash dedication (the original developer or all three
current developers).
MOTION by Lindquist, seconded by Woods to accept the City's
recommendation concerning Weybridge Park Dedication; however, any
Park Board money designated to acquire land for the sewer trunk line
should come from Public Works or the General Fund and not the Park

APPROVE LEITER TO DEMSKY'S
The Commission reviewed the proposed letter to Barbara Demsky, 2421-177th
Lane N.W. and edited the first paragraph. In effect, the commission is not
purchasing a plaque or tree to plant in memory of Matthew Demsky, but
welcomes the family purchase of a tree for Hawkridge Park. Mr. Haas will
handle the corrections and send out the letter.
CHAIRMAN'S REPORT
Commissioner Lindahl recommends that City Council considers an amendment
to the city's policy on property access for Public Works through the Park
Board. Mr. Haas agreed that this would be an item on a future agenda.
Commissioner Anderson suggests that a statement should be added to park
dedication so that the commission does not have to accept lesser valued land
without any recourse.
MOTION by Anderson, seconded by Woods to adjourn at 9:15 p.m.

Prior to the preparation of a preliminary plat, the subdividers or
owners shall meet with the City Planner and City Engineer to
review all applicable ordinances, regulations, and plans in the
area to be subdivided. At this time, or at subsequent informal
meetings, the subdivider shall submit a general development plan
and drainage plan. The general development plan may be presented
in a simple form, but should include any zoning changes which
would be required and show that consideration has been given to
the relationship of the proposed subdivision to existing community
facilities that would serve it to neighboring subdivision and
development, and to the topography or the site.
Subdivision Filing Requirements
After the pre-application meeting, the subdivider shall file this
application along with the following information:
1. Copies of preliminary plat, as needed, complete with data
described in Ordinance No.8 (Zoning Ordinance) and Ordinance
No. 10 (Subdivision & Platting Ordinance) and all other
applicable Ordinances.
2. Complete and accurate list of all property owners and
addresses of record within 350 feet of the exterior boundaries
of the proposed plat.
3. Abstract of title, or registered property abstract, certified
to date covering the premises to be divided.

4. If the property is not zoned for the proposed use, a petition
for rezoning to the precise intended use shall be submitted to
the Planning and Zoning Commission.

Cash filing fee of $40.00 and a cash fee of $7.50 per acre,
plus $500.00 Plat Escrow Deposit for such costs as review by
the attorney, engineering reports, site inspections, signs,
etc. Fees must be paid before item will be placed on the
Planning Commission agenda. Additional plat escrow fees may
be required as development proceeds toward completion.
A public hearing at a Planning & Zoning Commission meeting shall
be arranged within thirty days (30) from the date of application.
Public hearing notice published at least ten (10) days before the
Planning & Zoning Commission meeting at which time the item will
be heard. Notices are sent to area residents within a radius of
350 feet of the subject property to notify them of the meeting
date.

Right-of-way depicted on the plat adjacent to CSAH No. 16 is acceptable as shown
(60 feet total width - south of centerline). It should be noted that the south end of
this plat appears to encroach the limits of the 100 year flood plain, and is under the
jurisdiction of the Coon Creek Watershed District. Calculations must be provided
which show that any drainage to the County Highway Ditch alon~ CSAH No. 16
does not exceed the pre-existing conditions. If drainage to the Highway Ditch will
exceed the current conditions, an alternate drainage plan must be sought.
Construction of a roadway with access to CSAH No. 16 alon~ the alignment of Vale
Street does not allow for any advance railroad crossing warrung for motorists exiting
the plat from Vale Street. This alignment will also contribute to turning movement
conflicts at CSAH No. 16 because of its proximity to the railroad crossing. When
the railrvad crossing gates are activated and vehicles are cued up on CSAH No. 16,
entrance/egress at Vale Street may not be possible.
Access for Lots 26, 27, 28, 29, 30, and 31 of Block #1 must be made from
144th Lane NW. Access for Lot 1 of Block #1 must be made from Xeon Street
NW. Access for Lot 1, Block #7 must be made from Vale Street NW. No accesses
along CSAH No. 16 will be permitted, and right-of-access along CSAH No. 16
should be dedicated to Anoka County.
A permit for work within the county right-of-way is required and must be
obtained prior to the commencement of any construction. Contact Roy Humbert,
Contracts Administrator for the Anoka County Highway Department, for further
information regarding the permit process.
The City of Andover should contact me if and/or when Vale Street is
constructed so that the installation of a stop sign at CSAH No. 16 can be
coordinated.

The city Council is requested to discuss the reconstruction of
1) Round Lake Boulevard from 133rd Avenue NW to 140th Lane NW 2)
Bunker Lake Boulevard from Blackfoot Street NW to Marigold Street
NW.
This item was tabled from the December 17, 1991 City Council
meeting (attached is the agenda item).
In addition, the City Council should consider the following
additional items. They are as follows:
1. The City of Anoka is interested in installing a signal at the
intersection of Round Lake Boulevard (CSAH 9) and 136th
Avenue NW. The problem Anoka is having is Sunny Lane Court
will not have full turning movement at Round Lake Boulevard
because of the raised concrete median that is proposed.
Also a permenant signal is proposed to be installed at the
intersection of 135th Avenue NW.
2. The City Council should consider if 138th Lane NW should have
turning movements to Round Lake Boulevard. The County would
like to shut off all accesses along the frontage road to
Round Lake Boulevard. The City staff would like 138th Lane
to remain with turning movements to Round Lake Boulevard and
the north end of the frontage road remain open to allow
southbound traffic to have the ability to access the frontage
road. In addition, a signal has been requested by the
Downtown Center at 138th Lane. For the intersection to
function properly the Downtown Center will have to move the
access further north to align as much as possible with 138th
Lane.

3. Grace Lutheran Church at the southeast corner of the
intersection of Round Lake Boulevard and Bunker Lake
Boulevard is concerned with access to the site. Vehicles
westbound on Bunker Lake Boulevard from the east will have tc
turn south on Round Lake Boulevard and come in the back way
off 136th Avenue NW.
The church would like to see the City construct a street from
Bunker Lake Boulevard to 136th Lane NW along the east side of
the Medical Building which is located across the street from
First Star Bank (see figure A or B). The County is willing
to buy the right-of-way and reconstruct the intersection on
the south side. The City, if interested, could construct a
street from the Medical Building to 136th Lane NW which is
about 200 feet.
4. Attached is a letter from the County about the Standard Cost
Sharing Agreement for Anoka County Highway projects.

Enclosed for your information is the Standard Cost Sharing Agreement for Anoka
County Highway projects. Based on this policy, the city can expect to participate in
the cost of the curb and gutter, the traffic signal systems, storm sewer and
engineering, for these items. Also, any watermain or sanitary sewer adjustments or
relocations required by this construction will be at 100% city participation. In
addition, if you elect to include sidewalk with this project, the sidewalk and the
right-of-way required for the sidewalk will be at 100% city participation.
Because the plans are still in a preliminary stage, no quantity take-offs have been
provided to date. Therefore, we are unable to give you a cost estimate for the city's
share at this time, however should you desire, a rough estimate can be prepared.

concrete. If a community requests decorative median such as red
brick, stamped concrete, or exposed aggregate concrete the City
will pay the additional cost above the cast of standard. median.

County collects on behalf of the cities (less than 5,000)

In the event that the City requests purchase of right-of-way in
excess of those right-of-ways required by county construction

pay for that portion of the right-of-way. Acquisition of
right-of-way for new alignments shall be the responsibility of the
City requesting the alignment.

areas? If watermain is to ultimately serve these areas the
watermain should be looped to eliminate dead ends or problems
that we associated when the area is not looped. (See
enclosed map of existing watermain location.) The City will
eliminate some costs now because there would be very little
restoration.
C. 1/2 the cost of curb and gutter is Andover's responsibility.
The City should decide to use MSA funding or assess the
adjacent properties.
If the homes the County of Anoka is proposing to be
removed, the City will be required when rebuilt to construct
the home so the driveways access to City streets. If this
occurs these lots would have sideyards.
D. The City may be required to participate in some trunk storm
sewer costs. MSA may participate in some costs. There may
be some costs that are not MSA eligible. Should the City
assess those ineligible costs or use the Cities own MSA fund?

Boulevard to just .east of Quay'. Street .NW.: That portion just
east of Quay Street to Marigold Street should be constructed
or the Round Barn site is developed or redeveloped.

Round Lake Boulevard
The County is proposing to close off the frontage road on the
west side of Round Lake Boulevard north of Bunker Lake
Boulevard.
The County may remove or relocate existing homes south of
Bunker Lake Boulevard on the east side of Round Lake Boulevard.
1 to 4 homes may be effected. The City of Anoka allowed
building too close to Round Lake Boulevard so the road will
have to be moved into Andover.
- Downtown Center wants to talk to Anoka County about moving the
major entrance on Round Lake Boulevard and 138th Avenue NW. If
they do move the access should Andover look at keeping 138th
Lane open and eventually signalizing 138th Lane and Round Lake
Boulevard. There is no funding source for the signal.

Bunker Lake Boulevard
- Downtown Center is concerned about the median across their
first entrance on Bunker Lake Boulevard. It was part of the
approved plan in 1987.
- A frontage road will bave to be constructed from Superamerica
to Underclift street. NW. Superamerica is aware that the
reconstruction of Bunker Lake Boulevard would eliminate full
turning movements to the site when Superamerica went through
the Andover Site Plan Application for construction of the
building. '
Informational Comments
The proposed drawing is on the wall of the Council Chambers if
the Council wishes to study the plan.
- There will be a meeting with the County and the Downtown Center
to discuss the plan. If you want to be part of that meeting
let me know. Ken and Jack have been asked to come to the
meeting by the Downtown Center representatives.

REQUEST
The Andover City Council is requested to review the proposed
amendments to Ordinance No. 10, the Subdividing and Platting
Ordinance, Sections 9.03(g), 9.06(a)(1) and 9.06(a)(2). The
Council should review the attached staff report presented at the
January 14, 1992 Planning and zoning Commission meeting.
The proposed amendment to Section 9.03(g) has been added by Staff.
In reviewing the requirement of a temporary cul-de-sac in all new
subdivisions when the length of the street exceeds one hundred and
sixty (160') feet from the centerline of the intersecting streets,
Staff has found that the length of the street should be two
hundred ten (210') feet. The reasoning for the change is that it
allows two (2) lots, (a ninety (90') foot corner lot and an eighty
(80') foot interior lot) in addition to the street right-of-way
measurement of thirty (30') feet. An additional ten (10') feet
has been added as a safety factor. Figure A indicates the two
hundred ten (210') foot street length that does not require a
temporary cul-de-sac. Figure B indicates a street length greater
than two hundred and ten (210') feet and requires a temporary cul-
de-sac with a minimum roadway diameter of eighty (80') feet.
RECOMMENDATION
The Planning & zoning Commission on January 14, 1992 made the
motion to recommend approval of the proposed ordinance amendments.
The Council should consult the Planning and zoning Commission
minutes dated January 14, 1992 that are included in their packet
materials.
Staff is also recommending that the City Council approve the
amendment to Section 9.03(g) in addition to the amendments to
Section 9.06.

AN ORDINANCE AMENDING ORDINANCE NO. 10, THE SUBDIVISION AND
PLATTING ORDINANCE OF THE CITY OF ANDOVER.

THE CITY COUNCIL OF THE CITY OF ANDOVER HEREBY ORDAINS:
Ordinance No. 10 is hereby amended as follows:
9.03(g). Cul-ne-sacs. The maximum lpngth of cul-oe-sac streets
shall be five hundred (500') feet measured along the centerline
from the intersection to the center of the cul-de-sac area. Each
cul-de-sac shall have a terminus of nearly circular shape with a
minimum right-of-wny diameter of one hundred twenty (120.0') feet
and a minimum roadway diameter of ninety-three (93.0') feet in the
Urban Service Area and the Rural Service Area. Temporary cul-dp.-
sacs shall be required in all new subdivisions to make provision
for the continuation of future streets for adjoining areas when
the length of the street exceeds eRe-AHRaFea-5i*~y-+!~GL+ two
hundred ten (210') feet from the centerline of the intersecting
streets. Each temporary cul-de-sac shall be requir.ed to have a
minimum roadway diameter of eighty (80.0') feet. Adjacent
property owners/developers benefitting from the street
continuation shall be responsible for the rpmoval of the temporary
cul-de-sacs and shall be required to replace the street in
accordance with current City requirements and standards. The
property line at the intersection of the turn around and the
straight portion of the street shall be rounded at a radius of not
less than twenty (20.0') feet.
9.06a(1). Municipal Sanitary Sewer. In areas served by municipal
sanitary sewer systems, no lot shall contain less than 11,400
square feet nor have a width of less than eighty (80') feet at the
building setback line. Corner lots shall be a minimum of ninety
(90') feet wide with a thirty-five (35') foot front setback,
except for two-family lots which shall be required to be one
hundred fifty (150%) percent of a single family minimum area and
width. Residential lots shall be required to have the lowest
floor to be a minimum of three (3') feet above mottled soils or
one (1') foot above the desi3Eated or designed one hundred (100)
year flood elevation, whicnever-lS highe-r. Any stiliOI\jisTon-,~-
split or replatting of existing developments shall be required to
meet the standards of the original development or to meet the
average size of the existing lots. On continuing streets where
houses were constructed prior to the adoption of Ordinance 10H,
adopted AprilS, 1983, the setback shall be thirty-five (~S') feet
unless the existing strnctures wOllld indicate a lesser setback to
maintain uniformity in R-2, R-3 and R-4 districts.

elevation, whichever is higher.
NOTE: The amendments to Ordinance No. 10 will help clarify and
define what is deemed a buildable lot.

WHEREAS, the City of Andover hereby requests the
Metropolitan Waste Control Commission (MWCC) extend the CAB
interceptor to the City.
WHEREAS, the City recognizes the need for the expansion of
the Metropolitan Urban Service Area via the CAB Interceptor to
develop urban lots within the City; and
WHEREAS, the City understands to receive sewer service
via the CAB interceptor, the City must request the extension of
the CAB by resolution; and
NOW, THEREFORE, BE IT RESOLVED, that the City Council of
the City of Andover hereby requests the Metropolitan Waste Control
Commission to extend the CAB interceptor in a timely fashion to
serve the the City of Andover.

The city Council is requested to approve the final plat for
Hidden Creek East 4th Addition.
The final plat is in compliance with the preliminary plat.
It is recommended that the plat be approved subject to the
following:
1. Revised preliminary plat and grading plan if needed by the
City.
Note: The developer is required by ordinance to submit a
preliminary plat and a revised grading plan showing
information such as lowest floor elevation, 100 year
flood elevation for the area and any other
information that is required by ordinance. The City
Engineer requested this information at the time the
developers requested improvements to the property.
The grading for this phase has been proposed to be
changed.
2. The City Attorney presents a favorable title opinion.
3. Security to cover legal, engineering, street sign and
installation costs to be determined by the City Engineer.
4. The developer escrow for the uncompleted grading of the
site which is to be determined by the City Engineer or if
the site is completed, a letter from the developer's
engineer that lots and streets are graded according to the
grading plan submitted and approved by the City.

WHEREAS, the City Engineer has reviewed such plat for conformance
with the preliminary plat; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Andover to hereby approve the final plat of Hidden Creek East 4th
Addition contingent upon receipt of the following:

The Andover City Council is requested to release to Jerry
Windschitl the plat escrows for Kensington Estates 1st thru 6th
totaling $2,581.17.
BACKGROUND
The City Council approved releasing these escrows at the previous
meeting. However, no check was included with the schedule of
bills due to an oversight. The check is included with the
schedule to be approved this evening.
Since no check was issued after the previous meeting, the amount
of interest earned has changed slightly resulting in a different
amount to be released. The amount to be released consists of the

The City Council is requested to consider installing a street
light at the intersection of 152nd Avenue NW and 7th Avenue
(CSAH 7).
Attached is a letter from a concerned property owner.
It is recommended to install a light at the intersection. 5
lights (150W HPS) at City street/County road intersections have
been budgeted for 1992. If Meadow Creek Estates is approved
along with the installation of this light, that will leave the
city with 1 light left to install for 1992.
If the Council approves this light to be installed the City pays
for the installation and the ongoing energy and maintenance
costs, as the city is currently doing at other County/City street
intersections.

Dear Mr. Schrantz,
I am writing to you concerning installing a street light on
the east side of 7th Avenue at the intersection of 152nd
Avenue NW, Andover.
We (my husband,I and our four children) moved into Andover
one year ago last August. Beforehand, I am sure it was not
necessary for a street light here because the area was not
developed yet. Since we moved into this area, many houses
have been built around this location.
First of all, it is dangerous for the children. At the
intersection, there are no houses nearby with lights on;
across the street is a swamp area with lots of trees. The
children have to wait on that corner for the bus in the dark.
Even an adult would be fearful.
Secondly, there have been times when the bus just passed
the children by baause I am sure the drivers have a difficult
time seeing them.
Thirdly, cars are going by at 55 miles per hour and many times
cars pass on the right. With the slippery conditions and with
no lighted areas, the children are not visible to drivers
and could easily be struck down. THAT STREET CORNER IS DARK!
My 8th grade daughter is afraid to stand on that corner alone
in the dark, so everyday, I either walk with her or drive her
to the corner and wait until the bus arrives.
That corner is so dark, it would be easy for anybody to stop
at that corner and abduct a child without anyone noticing.
Please for the safety of the children, install a street light
on that corner! Don't wait until a child gets hurt or killed
before action is taken!

The City Council is requested to authorize the Staff to contract
with a Contract Inspector for the Building Department for this
building season.
It looks like the building boom is here again. This happened
once before in 1987 when in January of that year we had 17 houses
and a total of 398 for the year. This year for the month of
Janaury we had 31 houses and it sounds like, from all we hear in
the field that they are busy right now until at least April +
with houses.
I believe I will need a Contract Inspector to keep up with the
required inspections. The cost would be about 1 building permit
for a house a week ($12.00 hr. x 40 hrs. week = $480.00 +
mileage).

The City Council is requested to approve the filling of the
vacant Public Works position as follows:
1. Move Luann Darveaux to fill the vacancy in the streets
Division where her primary duty will be to operate the blade
and other equipment at a hourly rate of $11.00 for the year of
1992.
Luann has been backing up Wayne for 6 months.
2. We hire one of the two top candidates for the advertised
position at a starting salary of $9.60 hour and provide for a
$0.40 hour increase upon satisfactorily completing the 6 month
probationary period.

The proposed project covers utility and street improvements in the proposed Weybridge
development, located in the NW 1/4 of the SE 1/4 of Section 26-32-24, in the City of
Andover, Minnesota.

A preliminary plat was approved containing 148 single family lots. The plat is proposed
to be developed in three phases. Phase 1 contains 45 lots, Phase 2 contains 37 lots,
Phase 3 contains 53 lots and the remaining 13 lots have been provided with utilities
under the Creekview Crossing development (Project 91-2).

The Weybridge Plat is bordered by Andover Boulevard (CSAH 16) on the North,
Burlington Northem Railroad, on the East, Coon Creek on the South and Creekview
Crossing on the West.

sanitary sewer pipe throughout the plat as shown on sanitary sewer Exhibit 1.

It is proposed to construct an 18" PVC trunk sanitary sewer line under Phase 1 of
this project. The 18" trunk extension will extend to the east from an existing
manhole. In the future, development on the east side of the Burlington Northern
Railroad track will connect to this trunk extension. This trunk line will be paid by
the City of Andover (See Sanitary Sewer Exhibit 1).

Surface water within this plat will be controlled with storm sewers and on-site
ponding. All storm sewer sizing and catch basin spacing is based on a 10-year
design storm frequency. Ponding is based on a 100-year design storm
frequency. Emergency overflow outlets must be provided at all low areas to
provide overflow protection of homes for storms more intense than that used for
design of the storm sewer collection system.

It is proposed to construct catch basins at all low points within the streets as well
as low points along the back lot lines throughout the plat and direct runoff to the
pond located in the backyards of Block 2, Coon Creek, and to existing storm
sewers constructed within the Creekview Crossing Plat (See Storm Sewer
Exhibit 3).

of Engineers, the Department of Natural Resources and/or the Lower Rum River
Watershed Management Organization, All permits related to total site grading
are the responsibility of the developer.

Streets are proposed to be constructed to Andover City Standards of 32-foot
width (face to face of curb) and concrete curb and gutter. Two inches of
bituminous wearing course will be placed over 4 inches of Class 5 gravel base.
It is assumed that all street areas will be graded to within 0.2 feet of the
designed subgrade elevation prior to utility and street construction.
The road shall have a 6-inch crown with 0.5% minimum grade and 7% maximum
grade. Grades within 30 feet of street intersections shall not exceed 3%.
Boulevards are proposed to have a positive 2% grade from the back of curb to a
distance of 8 feet behind the back of curb. Beyond 8 feet behind the back of
curb, the maximum boulevard slope shall be 4:1.
