(SPUR) 13650 Hanson Boulevard NW BY: I. - ---1;;> ~ REQUEST The City Council is asked to review and approve the Special Use permit request of Murphy Oil USA, Inc. (SPUR) to install underground storage tanks for the bulk storage of liquid fuels. The property is located at the southwest corner of Bunker lake Boulevard NW and Hanson Boulevard NW. ,J Consult the attached staff report presented to the Planning and zoning Commission for background information on the request. APPLICABLE ORDINANCES Ordinance No.8, Section 5.03 regulates the Special Use Permit process. Ordinance No.8, Section 4.26, requires a Special Use Permit for all uses associated with the bulk storage of liquid fuels. planning & zoning Review The Planning and zoning Commission, at their November 23, 1993 meeting made the recommendation to the City Council to approve the Special Use Permit with conditions as listed on the attached resolution. Attached are the minutes from that meeting. Attached is a proposed resolution for Council review and adoption. TO INSTALL THREE (3) UNDERGROUND STORAGE TANKS FOR THE BULK STORAGE OF LIQUID FUELS ON THE PROPERTY LOCATED AT 13650 HANSON BOULEVARD NW (PIN 34-32-24-41-0004), LEGALLY DESCRIBED BELOW. " WHEREAS, Murphy Oil USA, Inc. has requested a Special Use Permit to install three (3) underground storage tanks for the bulk storage of liquid fuels (gasoline & diesel) on the property located at 13650 Hanson Boulevard NW, PIN 34-32-24-41-0004, legally described as follows: Lot 4, Block 1, Pankonin Addition; Except the West 148 feet thereof; Subject to Easements of Record. WHEREAS, 'the Planning & zoning Commission has reviewed the request and has determined that said request meets the criteria of Ordinance 8, Section 5.03 and 4.26; and WHEREAS, a public hearing was held and there was no opposition regarding said request; and ,J WHEREAS, the Planning and zoning Commission recommends to the City Council approval of!the Special Use Permit requested. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Andover hereby agrees with the recommendation of ~he planning & zoning Commission to allow for the installation of three (3) underground storage tanks for the bulk storage of liquid fuels (gasoline & diesel) on said property with the following conditions: 1. The applicant shall provide to the City, in writing, proof that the tank meets all State requirements and installation regulations. 2. The Special Use permit will be subject to a one (1) year sunset clause as defined in Ordinance No.8, Section 5.03(D). 3. The Andover Fire Marshal inspect the tanks and their installation. 4. McKelvey, Mayor ATTEST: Victoria Volk, City Clerk Andover Planning and Zoning Commission Meeting Minutes - November 23, 1993 1 Page 3 ~~ PUBLIC HEARING: LOT SPLIT, 17025 ROUND LAKE BOULEVARD NW, BARBARA SCHILLING 7:50 p.m. Mr. Carlberg reviewed the lot split reques of Maris and Barbara Schilling to subdivide a five-acre parcel in two parcels of 2.5 acres each to create an additional lot for t construction of a single family home. He noted the applicable 0 ~nances and the Staff recommendation of approval with the conti encies of paying a park dedication fee for one lot and applyi the sunset clause per the ordinance. The newly created parcel. high, dry and buildable. The existing structure will meet all tback requirements after the lot split. MOTION by Peek, S onded by Pease, to close the public hearing. Motion carried unani sly. hearing. There was no public Chairperson Dehn testimony. Motion rried unanimously. 7:58 p.m. (,:~ (rif:\ PUBLIC HEARING: SPECIAL USE PERMIT, BULK STORAGE OF LIQUID FUELS ~ (SERVICE STATION) - 13650 HANSON BOULEVARD NW, MURPHY OIL USA, INC. 7:58 P.M. Mr. Carlberg reviewed the Special Use Permit request of Murphy Oil USA, Inc., (SPUR) to locate below-ground storage tanks for the storage of liquid fuels, gasoline and diesel, at 13650 Hanson Boulevard NW. This is for a service station. Murphy Oil USA plans to install three 12,000-gallon underground storage tanks. The property is zoned I, Industrial, in which service stations are a permitted use. Mr. Carlberg noted the applicable ordinances and stated Staff is recommending approval with four conditions. He also noted the property already has an existing Special Use Permit for retail trade and services for the commercial green house currently on the site. The Attorney has advised that the existing permit will become null and void one year after the retail trade and services activity is stopped. Chairperson Dehn asked if there are any restrictions or safety issues with the service station and tanks in relation to the power company easements across the property. Mr. Carlberg didn't think so. The power lines are overhead and the tanks will be under ground. No structures are allowed within the easement, and the tanks will be about 100 feet from the overhead easements. \,0 Commissioner Peek asked if the county plans to take additional right of way along Bunker Lake Boulevard. Mr. Carlberg reviewed the map showing the 40-foot easement of the City for a service road along Bunker Lake Boulevard. The City will be working with the county regarding the ultimate width of Bunker Lake Boulevard and access for this site. Staff will be meeting with county representatives on this issue. Andover Planning and Zoning Commission Meeting Minutes - November 23, 1993 " Page 4 '-J (Public Hearing: Special Use Permit, Bulk Storage of Liquid Fuels, Murphy Oil USA, Continued) Commissioner Peek questioned the issue of the number of gas stations on that corner. Mr. Carlberg noted this area is zoned for this use, and it is known what will be on the other three corners -- county property in the southeast corner; proposed SuperAmerica gas station on the northeast corner; and the existing utility substation on the northwest corner. The new proposed structure will be a welcome additional that intersection. Commissioner Putnam stated he will abstain from voting since his firm occasionally does some work for Murphy Oil USA. The public hearing was opened for testimony. ,,) Garv Allen. Construction Enaineer for Murphv Oil - explained the tanks will be a steel tank within a fiberglass tank, so there will be no rust. The steel gives the tank more stability than a total fiberglass tank. There will be an in-tank monitoring system that is monitored for each tank. There will be no above-ground tank for propane storage. He had a drawing of another gas station, stating the one in Andover will be exactly like it. They are also looking at the possibility of having a car wash on that site if there is room. Mr. Carlberg stated a car wash is a permitted use in that district and would be reviewed as a part of the Commercial Site Plan. Mr. Allen - stated they are aware of the 40-foot service road easement and will be meeting with the county regarding easement for both Hanson Boulevard and Bunker Lake Boulevard. The majority of the Commissioners were comfortable with the request as the property is zoned for that use and there are other agencies that deal with the safety issues relating to the power line easement, though Chairperson Dehn felt Commissioner Peek raised a good point regarding the number of service stations on an intersection. MOTION by Apel, Seconded by Jovanovich, to close the public hearing. Motion carried on a 6-Yes, I-Abstain (Putnam) vote. MOTION by Pease, Seconded by Apel, that we forward the Resolution to the City Council with the recommendation of approval as presented. Motion carried on a 5-Yes, 1-No (Peek), 1-Abstain (Putnam) vote. 8:15 p.m. PUBLIC HEARING: SPECIAL USE PERMIT, HOME OCCUPATION IN AN ACCESSORY STRUCTURE - 2648 SOUTH COON CREEK DRIVE, RENATO CASTRO i,\'....) 8: 15 P.M. Mr. Carlberg reviewed the Special Use Permit request of Renato Castro to operate a home occupation in an accessory structure. He noted the applicable ordinances and criteria for issuing a Special Use Permit. (SPUR) to locate below ground storage ~anks for the stqrage of liquid fuels (gasoline & Diesel) on the property located at 13650 Hanson Boulevard NW (PIN 34-32-24-41-0004), legally described on the attached resolution. : The request for the tanks is associated with the future construction of a service station on said property. APPLICABLE ORDINANCES '-/ Ordinance No.8, Section 4.26, establishes the criteria for a Special Use Permit for all uses associated with the bulk storage of oil, gasoline, liquid fertilizer, chemicals and similar liquids. By requiring a Special Use Permit, the City has some assurance that fire, explosion or water or soil contamination hazards are not present that would be detrimental to the public health, safety and general welfare. Ordinance No.8, Section 5.03 regulates the Special Use Permit process, outlining conditions and procedures. GENERAL REVIEW The requested Special Use petmit is for the installation of three (3) 12,000 gallon underground storage tanks. The tanks will be required to be installed per State guidelines. Mr. Carlberg reviewed the Special Use Permit request of Murphy O~ USA, Inc., (SPUR) to locate below-ground storage tanks for the storag of liquid fuels, gasoline and diesel, at l3650 Hanson Boulevard NW. This is for a service station. Murphy Oil USA plans to install three 12, OO-gallon underground storage tanks. The property is zoned I, Industrial, .n which service stations are a permitted use. Mr. Carlberg noted the plicable ordinances and stated Staff is recommending approval wit our conditions. He also noted the property already has an existing Spec~ Use Permit for retail trade and services for the commercial green house rently on the site. WHEREAS, Steven Loudon has requested a variance to allow for the construction of a 12' X 26' addition to an accessory structure that exceeds the total square footage of land cover of the principal structure on the property located at 1831 Crosstown Boulevard NW, legally described as follows: That part of the Northwest Quarter of the Southeast Quarter of Section 22, Township 32, Range 24, Anoka County, Minnesota, that is described as follows: \~ Commencing at a point on the South line of said Northwest Quarter of the Southeast Quarter which is 873 feet East of the Southwest corner therof, thence Northerly at right angles to said South line for a distance of 20 rods, thence East parallel with said South line to a point of intersection with a line parallel with and distance 1020 feet East of the West line of said Northwest Quarter of the Southeast Quarter, thence Southerly and parallel with said West line of said South line; thence West along said South line for a distance of 147 feet to the point of beginning; and WHEREAS, the Planning & Zoning Commission has reviewed the request and has determined that said request meets the conditions established in Ordinance No.8, Section 5.04 and that a hardship exists due to the age of the existing principal structure; and WHEREAS, the Planning and zoning Commission finds that the strict interpretation of the Ordinance due to the age of the house and the fact that it is built as a separate house with a detached garage creates a hardship; and WHEREAS, the Planning & zoning Commission recommends to the City Council approval of the variance request. Motion carried unanimously. 8:45 p.m. ci) VARIANCE: SIZE REQUIREMENT FOR AN ACCESSORY STRUCTURE - 1831 CROSSTOWN BOULEVARD NW, STEVEN LOUDON Mr. Carlberg reviewed the variance request of Steven Loudon to allow for the continued construction of an addition to an accessory structure (12' x 26' lean-to) larger than the principal structure. The property is l.ll acres and zoned R-l, Single Family Rural. The ordinance requires that the total square footage of all the accessory buildings cannot exceed 100 percen~ of the land cover of ~he principal structure. The existing accessory structure already exceeds that requirement, but that has been grandparented. The lean-to addition further exceeds that limit. The existing garage is a lawful existing nonconforming use built prior to the adoption of the ordinance. Staff is recommending it be denied based on the fact that a there is no hardship on the topography or shape of the land. ~) Commissioner Apel expressed anger and frustration with the ordinance. He was also upset that Staff directed Mr. Loudon to apply for a variance when it is very obvious that one cannot be granted under the strict interpretation of the ordinance. Size Requirement for an Accessory Structure, Louci.on, , Steve Loudon, 1831 Crosstown Boulevard NW - stated the house was built in 1935. He does not know when the existing garage was built, but it was before he owned the property in 1990. Michael Click, 1853 Crosstown Boulevard NW - lived next door since 1987, and the garage has always been there. Commissioner Apel stated the garage has been there every since he can remember. Chairperson Dehn understood Commissioner Apel's point. Today the City does allow three- car garages, and this will look like a three-car garage when done. Mr. Carlberg stated attached garages are not counted as part of accessory structures. Mr. Loudon - stated .the existing garage is 36 feet away from the house. Attaching a garage to the house would cost more than he could afford, plus there is no efficient way to attach a garage to the house unless it is put at an angle. ~ There was considerable discussion with Mr. Loudon and several neighbors as to other options. Neighbors noted Mr. Loudon's house has two stories and asked that all the square footage of the house be included. Mr. Carlberg explained only the ground coverage is used. He was not aware of any variances granted to this provision of the ordinance. The neighbors fel t that is discriminating against those who construct two-story houses. When the house was built in 1935, it was built very efficiently. Small, two-story homes that utilized every square foot were the norm. Mrs. Loudon - also explained she runs a small business from her basement and there is no storage space whatsoever. Mr, Carlberg noted she has a Special Use Permit for her business and is in compliance. Another resident stated the reason for the garage is to be able to store things in a garage rather than in the yard to make the yard look better. It really will look nice when it is finished, asking isn't that what the City wants, to clean up the yards? Someone asked if a deck was added to the house if that counts as additional square footage. Mr. Carlberg stated decks have always been excluded in the past. Commissioner Peek then noted that considering the ordinance was written for the way houses are built today with attached garages, and that this house was built in an era without attached garages, he felt that is a potential hardship. He didn't think the ordinance can accommodate that with a strict interpretation. The applicant is asking for nothing more ~ than a three-car garage, which he felt is appropriate. If it wasn't for that addition, his garage would be illegal also. He felt consideration must be given to when the house was built. Both stories are used as one residence. In these old houses, every bit of the square footage is needed. ~J Commissioner Jovanovich didn't think there were many houses in Andover that are this old. If the addition is to improve the property, special consideration should be considered. Chairperson Dehn stated she would refrain from voting on this matter since she has done business with the applicants. MOTION by Peek, Seconded by Jovanovich, that the Andover Planning and Zoning Commission recommends approval of the variance request by Steven Loudon at 1831 Crosstown Boulevard NW for a variance in the size of accessory building to exceed that of the principal structure, that is to add a 12' x 26' attachment to the existing detached garage. That the Planning and Zoning Commission has reviewed the request and has determined that a ha=dship does exist, and that hardship being the age of the existing house. And the fact that the original property has a detached garage and the current house construction is typically more of an a~tached garage situation. And that strict interpretation of the ordinance due to the age of the house and the fact that it is built as a separate house with detached garage creates a hardship. Motion carried on a 5-Yes, 1-No (Squires), 1-Abstain (Dehn) vote. This will go to the City Council on December 21, 1993, DISCUSSION - ORDINANCE NO. 50, FLOOD PLAIN ORDINANCE Mr. Carlberg asked that the Commission table the item to the December 14 meeting as he has not had an opportunity to prepare the necessary background material for it. The Commission agreed. OTHER BUSINESS Special Meeting: Mr. Carlberg announced the Planning Commission is to hold a special meeting on Tuesday, November 30, 1993, tJ discuss the rezoning of Crown pointe and Crown pointe East, which was referred back to the Commission by the Council. The property is zoned R-1, single Family Rural and is 1.11 acres in size. APPLICABLE ORDINANCES ~) Ordinance No.8, Section 4.05(B)(1), Accessory structures, states that, "The accessory buildings on a residential parcel with a lot area of five (5 a.) acres or less, but more than one (1 a.) acre, shall not exceed the total square footage of land cover of the principal structure". Ordinance NO.8, Section 5.04, establishes ~he variance procedure and process. Variances may be granted where there are practical difficulties or unnecessary hardships in any way of carrying out the strict letter of the provisions of the zoning Ordinance. The hardships or difficulties must have to do with the characteristics of the land and not the property owner. BACKGROUND INFORMATION On October 20, 1993, the Building Department stopped construction ("red tagged") a 312 s.f. addition of a lean-to to an accessory structure on said property. Mr. Loudon made application for a building permit on October 21, 1993. Upon reviewing the application, the Building Department on November 3, 1993 sent a letter to the applicant indicating the lean-to addition exceeded the total square footage of the principal structure (letter attached). Mr. Loudon was ordered to remove the structure or apply for a variance. Mr. Loudon opted for the variance procedure hence the request being before the Commission this evening. I .~~ The Commission should be aware that the existing accessory structure (garage) which is 624 s.f. in size exceeds the 550 s.f. principal structure. R A RESOLUTION DENYING THE VARIANCE REQUESTED BY STEVEN LOUDON TO "ORDINA~CE NO.8, SECTION 4.05(B)(1) TO ALLOW FOR THE CONSTRUCTION OF AN ADDITION (LEAN-TO) TO AN ACCESSORY STRUCTURE EXCEEDING THE TOTAL SQUARE FOOTAGE OF LAND COVER OF THE PRINCIPAL STRUCTURE ON THE PROPERTY LOCATED AT 1831 CROSSTOWN BOULEVARD NW, LEGALLY DESCRIBED BELOW. WHEREAS, Steven Loudon has requested a variance to allow for the construction of an addition (lean-to) to an accessory structure that exceeds the total square footage of land cover of the principal structure on the property located at 1831 Crosstown Boulevard NW, legally described as follows: That part of the Northwest Quarter of the Southeast Quarter of Section 22, Township 32, Range 24, Anoka County, Minnesota, that is described as follows: \~ Commencing at a point on the South line of said Northwest Quarter of the Southeast Quarter which is 873 feet East of the Southwest corner therof, thence Northerly at right angles to said South line for a distance of 20 rods, thence East parallel with said South line to a point of intersection with a line parallel with and distance 1020 feet East of the West line of said Northwest Quarter of the Southeast Quarter, thence Southerly and parallel with said West line of said South line; thence West along said South line for a distance of 147 feet to the point of beginning; and WHEREAS, the Planning & zoning Commission has reviewed the request and has determined that said request does not meet the conditions established in Ordinance No.8, Section 5.04 and that a hardship does not exist; and WHEREAS, the Plannlng and zoning Commission finds that a hardship does not exist due to the unique shape or topography of the parcel and that the landowner would not be precluded reasonable of the property; and WHEREAS, the Planning and zoning Commission finds the request does not meet the requirements of Ordinance No.8, Sections 4.05(B)(1); and WHEREAS, the Planning & zoning Commission recommends to the City Council denial of the variance request. The depth of peat was found to vary from 6'-8' at the edges to 30'-40' in the middle of the peat area. The investigation conducted by STS and their recommended construction procedures appear appropriate for the peat conditions encountered. The report states that variations in soil conditions between borings can exist and that the behavior of the peat under loading should be thorougWy monitored by observing the actions of the settlement plates and piezometers to be installed durnlg construction. The repOlt also includes several recommendations regarding staging of the construction of the embankment and surcharge and the use of a geotextile below the embankment to provide for slope stability. All of these recommendations should be followed closely in preparing the plans and specifications and during construction of the roadway. The report states that a I-inch settlement over a 20-year period is a reasonable criteria, I agree that tllis would be an acceptable performance, In addition, STS cautions that some unexpected costs could be incurred due to the uncertainties inherent in this type of construction, I recommend tllat STS be further involved in the project by reviewing the plans and specifications dealing with earthwork in the area of the peat deposit, and be available during construction for on- site observation and interpretation of the results of monitoring the settlement plates and piezometers. I~J The Andover Review Committee has concluded that the proposed method of earthwork and construction procedures is not acceptable for the following reasons: 1. On page 10 of the report, the statements "It should be understood that there are inherent risks associated with embankment support above organic/soft foundation soils" and "The risks of potential failures and greater settlements than anticipated can be reduced, but not eliminated, by proper testing, monitoring and evaluating the project during construction." TKDA in the memo dated November 10, 1993 also states in the last paragraph "In addition, STS cautions that some unexpected costs could be incurred due to the uncertainties inherent in this type of construction." These statements cause concern with the the Andover Review Committee that if these failures do occur and they occur beyond the 1 year warranty that is required for new street and utility improvements, the City would be responsible for repairing the failures which may be very expensive and most likely may not be assessable, 2. Haas, Assistant city Engineer, regarding the proposed method of constructing 154th Lane NW in Wittington Ridge. 1- '\ I ..,J The proposed method of constructing 155th Lane NW is based on a Geotechnical Report prepared by STS Consultants and consists of placing a fabric over the organic soils, surcharging the organic soils and monitoring the settlements. Once the organic soils have consolidated, a portion of the surcharge is removed and the standard street section is constructed (4" Class 5 gravel and 2" bituminous). In the letter from Mr. Haas, he refers to the statement that "It should be understood that there are inherent risks associated with embankment support above organic/soft foundation soils" and "The risks of potential failures and greater settlements than anticipated can be reduced, but not eliminated, by proper testing, monitoring and evaluating the project during construction." I have spoken to your city Engineer/consultant, Mr. John Davidson, regarding the procedure and he does not foresee any major problems with the proposed method of construction providing proper testing and monitoring takes place during construction. In addition, the proposed street will be a low volume residential street and any minor long-term settlement if it occurs will not affect the use of the street. , , j In response to the statement that "some unexpected costs could be incurred due to the uncertainties inherent in this type of construction", all of the construction costs will be paid for by Mr. Windschitl. I checked the situation with Anoka County. In both the cases of Hanson Boulevard at 169th Avenue and County Road 116 lying north of 140th, the fabric ripped during construction due to poor construction procedures. In addition, both those roads are high volume roads which carry heavy commercial traffic in addition to residential traffic. Therefore, the failures stated should not be used to compare the proposed construction of 155th Lane. Mr. Doug Fischer from Anoka county stated they have used the surcharge method with great success in areas with poorer soil conditions. If any of the improvements required under Section 3C are not completed at the time of the final inspection by the Building Inspector, the general contractor or home builder shall furnish to the City, a security agreement in an amount equal to 150 percent of the Building Official's estimated cost for such improvements. The improvements shall be completed within 30 days of the furnishing of the security agreement, except between Nevemae~ October 1 and May 1 and all work shall be completed by June 1. Requests for the release of any security agreements provided hereunder may be made by the general contractor or home builder upon completion of all improvements covered by the security agreement. The Building Official shall approve or deny the request. If denied, the Building Official shall state in writing the reasons for such denial. The general contractor or home builder may appeal the decision to the City Council by filing with the Building Official a written request for such appeal within ten days after receiving the Building Official's notice. The appeal shall be placed on the agenda of the next regular Council meeting. The general contractor or home builder shall be notified of the time and place of such meeting. The Council may affirm or reject the decision of the Building Official. F. BACKGROUND Andover City Council approved the licensing of refuse haulers in 1992. Andover has nine licensed haulers. In 1989 there were five haulers in Andover with five trucks using the streets each week. with the addition of curbside recycling, the number of trucks became ten. Now there are 18 heavy trucks using city streets each week. , , ,. In the interest of maintaining healthful and sanitary conditions, plus the ability of maintaining reasonable conditions of city streets, the number of licenses for garbage haulers could be restricted. If a hauler leaves the city, the number of licenses can drop back by one. Other cities that have reserved the right to limit the number of licenses are Lino Lakes and West st. Paul. Many other cities have organized collection, which limits the weight damage of the trucks even further. REQUEST The City Council is asked to consider limitimg the number of hauler licenses to nine. With proper authority being given, construction contractors and public utility companies are permitted to erect construction and maintenance signs at work sites to protect the public, equipment, and workers, provided that such signs conform to the standards of this Manual. All traffic islands shall be installed by the authority of the public body or official having jurisdiction. For those islands that are elements of street and highway design and are included in the design of the street or highway, no specific authority is required. Secondary messages shall not be used on STOP sign faces, ~ 2B-5 Warrants for Stop Sign Because the STOP sign causes a substantial inconvenience to motorists, it should be used only where warranted. A STOP sign may be warranted at an intersection where one or more of the following conditions exist: 1. Intersection of a less important road with a main road where application of the normal right-of-way rule is unduly hazardous, 2, Street entering a through highway or street. 3, Unsignalized intersection in a signalized area, / 4. Other intersections where a combination of high speed, restricted view, and serious accident record indicates a need for control by the STOP sign. Periodic reviews of existing installations may be desirable to determine whether, because of changed conditions, the use of less restrictive control or no control could accommodate traffic demands safely and more effectively, STOP signs should never be used on the through roadways of expressways. Properly designed expressway interchanges provide for the continuous flow of traffic, making STOP signs unnessary even on the entering roadways. Where at-grade intersections are temporarily justified for local traffic in sparsely populated areas, STOP signs should be used on the entering roadways to protect the through traffic. STOP signs may also be required at the end of diverging roadways at the intersection with other highways not designed as expressways. In most of these cases, the speeds will not warrant any great increase in the sign sizes, STOP signs shall not be erected at intersections where traffic control signals are operating, The conflicting commands of two types of control devices are confusing, If traffic is required to stop when the operation of the stop-and-go signals is not warranted, the signals should be put on flashing operation with the red flashing light facing the traffic that must stop. Where two main highways intersect, the STOP sign or signs should 10rmally be posted on the minor street to stop the lesser flow of traffic, Traffic engineering studies, however, may justify a decision to inStall a STOP sign or signs on the major street, as at a three-way intersection where safety considerations may justify stopping the greater flow of traffic to permit a left-turning movement, STOP signs may be used at selected railroad-highway grade crossings only after their need has been determined by a detailed traffic engineering study. Use of the STOP sign at railroad-highway grade crossings is described in Section 8B-9, Ponable or part-time STOP signs shall not be used except for emergency purposes, Also, STOP signs should not be used for speed control. 11-48 (e) Roy. 3 VIII-5 (e) Rev. 2 2B-6 Multiway Stop Signs The "Multiway Stop" installation is useful as a safety measure at some locations, It should ordinarily be used only where the volume of traffic on the intersecting roads is approximately equal. A traffic control signal is more satisfactory for an intersection with a heavy volume 0 f traffic, Any of the following conditions may warrant a multiway STOP sign installation (sec, 2B-4): 1. Vehicles controlled by a YIELD sign need Stop only when necessary to avoid interference with other traffic that is given the right-of- way. The YIELD sign shall be a downward pointing, equilateral triangle having a red border band and a white interior and the word YIELD in red inside the border band. The Grantor has been allocated funds by the State of Minnesota under the Outdoor Recreation Grant Program, The Grantee has made application to the Grantor for a portion of the allocation for the purpose of conducting the project entitled Kelsey Round Lake Park in the manner described in the Grantee's "APPLICATION" which is incorporated into this Agreement by reference, The Grantor has approved the following project scope from the project activities set forth in the Grantee's "APPLICATION:" Development of trails, outdoor classroom, parking lot and driveway ;' \ t __I The total project cost is $ 120,000.00 In consideration of mutual promises set forth below, the parties agree as follows: The Grantor shall grant to the Grantee the total sum of SIXTY THOUSAND DOLLARS ($60,000) which shall be state funds appropriated to the Grantor under the Outdoor Recreation Grant Program, The Grantee shall perform the activities outlined in the approved project scope during the period from October 26, 1993 through December 31, 1995 in accordance with the provisions of this Agreement and other guidelines provided by the Grantor and all applicable State and Federal rules and laws, The Grantee agrees to complete the project in accordance with the approved budget (Attachment A), incorporated into this Agreement by reference, to the extent practicable and within the proj e.ct period specified in the Agreement, Any material change in the scope of the project, budget or completion date shall require prior written approval by the Grantor, Funds made available pursuant to this Agreement shall be used only for expenses incurred in performing and accomplishing the purposes and activities specified herein. Accounting methods shall be in accordance with the Outdoor Recreation Grant Program Financial Management Manual provided by the Grantor and the Common Rule, Uniform Administrative Requirements for Grants and Cooperative Agreements to State and Local Governments, published in the Federal Register on March 11, 1988, Volume 53, Number 48, if applicable, Reportinq Requirements The Grantee shall submit to the Grantor any reports as the (~ Grantor shall reasonably request, Payment/Disbursement Schedule The Grantor shall disburse funds to the Grantee pursuant to this Agreement on a reimbursement basis, based upon a payment request and required expenditure documentation submitted by the Grantee and reviewed and approved by the Grantor, The Grantee shall be limited to no more than four payment requests during the period covered by this Agreement, The Grantee shall submit a final billing within 30 days of the end of the project period. Retention of Records/Audits Grantee financial records, supporting documents, statistical records, and all other records pertinent to this grant shall be retained for a period of three years, commencing on the date of the closure letter from the Grantor. All such records shall be retained beyond the three year period if audit findings have not been resolved. The Grantor, Legislative Auditor, and, if applicable, the Secretary of the Interior and the Comptroller General of the United States, and their duly authorized representatives shall have access to any books, documents, papers, and records of the Grantee and its subgrantees which are pertinent to this grant for the purpose of making audit, :J 2 examination, excerpts, and transcripts. ~J Notice for Contracts and Subcontracts The Grantee shall include in any contract or subcontract, in addition to the provisions to define a sound and complete agreement, such provisions as to assure contractor and subcontractor compliance with applicable state and federal laws, Fundinq Acknowledqment Upon project completion, the Grantee shall post a permanent funding acknowledgement sign at the entrance to the project site, or at an alternative conspicuous location on the site, Termination If the Grantor finds that there has been a failure on the part of the Grantee to comply with the provisions of this Agreement, that reasonable progress has not been made, or that the purposes for which the funds were granted have not been or will not be fulfilled, the Grantor may take action to protect the interests of the State of Minnesota and, if applicable, the United States, including the refusal to disburse additional funds and requiring the return of all or part of the funds already disbursed, Conversion of Use (J The Grantee shall not at any time convert any property acquired or developed pursuant to this Agreement to uses other than the public outdoor recreation uses specified in this Agreement without the prior written approval of the Grantor. Facilitv Operation and Maintenance The Grantee shall operate and maintain, or cause to be maintained, the property or facilities acquired and/or developed pursuant to this Agreement, Sanitation and sanitary facilities shall be maintained in accordance with the applicable public health standards. Properties and facilities shall be kept reasonably safe for public use. All state and federal accessibility laws, regulations and standards shall be adhered to. Fire prevention, lifeguards and similar safeguards and use supervision shall be provided to the extent feasible. Buildings, roads, trails and other structures and improvements shall be kept in reasonable repair throughout their estimated lifetime to prevent undue deterioration and to encourage recreational use of the project and associated facilities, Failure to adequately 'maintain and properly operate the facility assisted through this grant may result in the withholding by the Grantor of any current or future payments to the Grantee related to this or any other Outdoor Recreation Grant project and may result in ineligibility of the Grantee to receive any future Outdoor Recreation Grant, ~J . 3 :j' , (J :J The Grantee shall keep the facility open to the general public at reasonable hours and at times of the year consistent with the purpose and type of facility, Inspections The Grantor's authorized representatives shall be allowed at any time to conduct periodic site visits and inspections to ensure work progress in accordance with this Agreement, including a final inspection upon project completion, " Following closure of the project, the Grantor's authorized representatives shall be allowed to conduct post-completion inspections of the site to ensure that the site is being properly operated and maintained and that no conversion of use has occurred, Nondiscrimination The Grantee in the conduct of the project shall not engage in discriminatory employment practices and shall in all respects comply with Minnesota Statutes, Chapters 363.03 and 181,60 and all applicable rules and subsequent amendments, Workers Compensation The grantee in the conduct of the project shall comply with the provisions for workers compensation in Minnesota Statutes, Chapter 176,181 subdivision 1 and 176,182, Amendments Any amendments to this Agreement shall require prior written approval by the Grantor and, if applicable, the National Park Service, Any such amendments shall be in writing and shall be executed by either the same persons who executed the original Agreement, their successors in office, or by those persons . authorized by the Grantee through a formal resolution of its governing body, Successors and Assianees This Agreement shall be binding upon any successors and assignees of the parties. This agreement will need to be signed and returned to the state. Do not begin to incur costs on this project until you receive instructions with the grant agreement. A decision has been made to allow construction to begin on the northern portion of the park, but the Minnesota Historical Society will still need to come to a final determination on the type and amount of development which will be allowed on the southern portion. This office has continued to pursue the question of the possible burial mounds located in the park and how their presence will impact park facilities. without a state Archeologist in place to review the case in Andover, it is not possible to proceed with the development which may impact the burial sites. I have enclosed a copy of the map showing the center portion of the park. The dashed line across the park is the boundary across which development should not occur. This permits the city to begin work on a large portion of the park project, including the parking area, access road and some trails. We will continue to solicit a response from the Historical Society in order to approve the remainder of the development in the southern portion of Kelsey Round Lake Park. BACKGROUND '- ) The City Council approved designating $50,000.00 from the building permit revenues generated during 1993 to start a building improvements reserve for future construction or major repair to the City Hall and Public Works buildings. The Fire Department salaries and benefits accounts will have approximately $10,000.00 remaining at year end after implementing the station response system. RECOMMENDATION I recommend the creation of a construction fund to deposit these reserves into, providing the segregation and accountability for accumulating and expending the funds for future City Hall, Public Works and Fire Station improvement or construction projects. Please note: '--- 1) The original estimated building and related permit revenue for 1993 has been surpassed. The amendments adopted August 17th and November 16th recognize and allocate revenue for another 150 new homes for 1993, for a total of 480 new homes. As of 11/30/93, 491 new home permits have been issued. 2) These statements include the amended budgets adopted by resolutions R016-93 on 1/19/93, R186-93 on 8/17/93 and R275-93 on 11/16/93. 3) Fire Department expenditures include $76,237.89 of actual point pay for November 1992 through October 1993. All point pay earned through October 31st was paid on November 24th. $11,437 will be transferred from the Fire Department point pay to the rescue service account. With the combination of of the two functions this year, all point pay was recorded into the Fire Department payroll records. The 1994 financial statements will report the combined efforts of the Fire and Rescue service as one expenditure report. The distribution detail has not been received from the county to post the taxes and special assessment collections to their respective accounts. My projection for the year end surplus of General Fund revenue over expenditures for 1993 is approximately $60,000. This surplus will flow to fund balance, which is used to finance the General Fund operations during the first half of the year until the tax settlement is received from the county. 5) The Water and Sewer Funds are performing close to budget projections. Both Funds should realize a slight surplus from operations due to higher than projected growth in the customer base for 1993. 6) The Central Equipment Fund is operating smoothly. Revenue and expenditures are within budget projections at this time. The unexpended maintenance balance remaining at year end should be placed in a reserve for equipment replacement. PINEWOOD ESTATES 2ND ADDITION AND DIRECTING PREPARATION OF ASSESSMENT SANITARY SEWER, WATERMAIN, STREET AND 92-3, PINEWOOD ESTATES AND 93-2, THE CITY COUNCIL OF THE CITY OF ANDOVER HEREBY RESOLVES: WHEREAS, a contract has been entered into for the construction of the improvements and the contract price for such improvement is $ 1,088,310.36, and the expenses incurred or to be incurred in the making of such improvement amount to $ 644,755.27 and work previously done amount to $ -0- so that the total cost of the improvement will be $ 1,733,065.63. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Andover, MN: 1. The portion of the cost of such improvement to be paid by the City is hereby declared to be $ 189,708.25 and the amount of the cost to be assessed against benefited property owners is declared to be $ 1,543,357.38 . 2. Assessment shall be payable in equal annual installments extending over a period of 10 years. The first of the installments to be payable on or before the 15th day of April 1994, and shall bear interest at the rate of 5.5 percent per annum from the date of the adoption of the assessment resolution. 3. The City Clerk, with the assistance of the City Engineer shall forthwith calculate the proper amount to be specially assessed for such improvement against every assessable lot, piece or parcel of land within the district affected, without regard to cash valuation, as provided by law, and she shall file a copy of such proposed assessment in her office for public inspection 4. The Clerk shall, upon the completion of such proposed assessment, notify the Council thereof. Z;lIY42;' Larry Capeling (Secretary) COUNCIL COpy On 11/11/93 Dale Mashuga and myself attended a Medical Direction Focus Group Meeting sponsored by HealthSpan. At this meeting I learned that the Minnesota Department of Health (MDH) has developed recommendations to regulate and license First Responder Units. .- I received a brief outline of these recommendations and I called the MDH to obtain the whole report and all recommendations on First Responder Units in Minnesota which was developed in 1991. I found several items very interesting. Here is a brief overview: * First responders will have a minimum training level of "First Responder" meaning the 40 hour course MDH will develop standardized testing (written and practical) emphasizing: . - Patient Assessment - Airway Management - CPR - Spinal Management - Splinting and Bandaging Also instead of taking a 16 hour recertification course'we could develop our EMS drills to take its place. It would have to be approved and First Responders would still have to pass the written and practical exam every two years. Testing will be done by a state approved examiner and by someone not affiliated with the department. Additional approved training is required for departments using Defib. and MAST. We also need a medical director and written protocols, approved by the medical director, to use MAST and Defib. We must pass written and practical tests on these items. Also the MDH has developed a list of minimal equipment to be carried by First Responders and will hire field consultants to do onsite inspections on a regular bases and to follow up on complaints.
