TEMPORARY STREET CLOSURE
QUINN STREET NW BETWEEN 137TH LANE NW AND 138TH AVENUE NW
WHEREAS, the Andover City Council acknowledges tra~fic issues
occurring on Quinn street NW north of Bunker Lake Boulevard; and
WHEREAS, a public hearing meeting will be conducted on September
21, 1993 to discuss the traffic issue to achieve the greatest
reduction in traffic problems; and
WHEREAS, Quinn Street NW is a local street serving as a
collector, but is not designated on the municipal state aid system;
and
WHEREAS, it is recognized that the temporary closure at the
approximate location of 13788 Quinn Street NW creates a dead end; and
WHEREAS, the Council acknowledges that access for residents and
public safety vehicles has been given consideration in this action;
and
WHEREAS, it is proposed to initially close Quinn Street NW
temporarily so as to monitor the impacts of the closure on both 139th
Avenue NW and l40th Avenue NW within the neighborhood; and
WHEREAS, said closure will be deemed permanent unless rescinded by
. \ council action not later than october 6, 1993.

NOW, THEREFORE, BE IT RESOLVED by the Andover City Council as
follows:
1. The Public Works Department is directed to erect appropriate
signs and traffic control devices as required by the 1991
Minnesota Manual on Uniform Traffic Control Device and to
include barricades to close Quinn street NW at approximately
l3788 Quinn Street NW.
2. The Engineering Department shall periodically monitor traffic
on Quinn street NW and other neighborhood streets and report
the results to the Council not later than September 21, 1993.

NOTICE OF PUBLIC HEARING
The City of Andover City Council will hold a public hearing at
7:30 P.M., or as soon thereafter as can be heard, Tuesday,
September 21, 1993 at the Andover City Hall, 1685 Crosstown
Boulevard NW, Andover, MN to discuss the Quinn Street NW closure
that currently exists located at 138th Avenue NW in the Red Oaks
Manor area.
Quinn Street NW is located in the North half of Section 34,
Township 32, Range 24, Anoka County., Minnesota.
All opponents and proponents of said existing closure will be
heard at the above time and location.

We petition the Andover city council to remove the
Quinn street Northwest for the following reasons:

We have been told the reason the barricades were installed was
to prevent people from speeding through this portion of Quinn
street. Blocking off this portion of Quinn does nothing to
solve the problem of speeding. It only redirects the people
who speed down other area streets in Red Oaks development.

2. We have people who speed down other streets in this
development also. It has been noted by the city council that
the people who speed live outside the Red Oaks development.
The indi~iduals who have been caught speeding must access our
development by the streets near the end of 140th Lane and
Nightingale and near 140th Lane and Raven. We propose that
Andover City council eliminate the real problem, which we have
been told is the people who speed through the Red Oaks
development, by closing off the accesses to our development
near 140th Lane and Nightingale and near 140th Lane and Raven.
In order to insure elimination of dangerous driving practices
in these areas the following alternatives are proposed: a
combination of speed bumps approximately 50 feet in front of
stop signs, a combination of rumble strips approximately 50
feet in front of stop signs, additional law enforcement, and
prosecution by affected homeowners. Law enforcement officials
support the use of rumble strips and stop signs where the
barricades are now installed and also at the corner of Quinn
street and 139th. These two particular corners allow speeds
in excess of the limit and are dangerous because of limited
visibility due to curves.

All children in Red Oaks development deserve to be safe from
dangerous driving practices. 'rhis change will insure all
children in Red Oaks development will be safe from these
individuals, not just the children who live on the new portion
of Quinn street which is barricaded at this time. This option
will not take away the rights of any individual in either Red
Oaks development or the Kensington development. Each area
will continue to have access out of the developments without
infringing on residents' rights.

We petition the Andover city Council to remove the barricades from
,Quinn street Northwest for the following reasons:
1. We have been told the reason the barricades were installed was
to prevent people from speeding through this portion of Quinn
street. Blocking off this portion of Quinn does nothing to
solve the proQ!em of speeding. It only redirects the people
who speed down other area streets in Red Oaks development.

2. We have people who speed down other streets in this
development also. It has been noted by the City council that
the people who speed live outside the Red Oaks development.
The individuals who have been caught speeding must access our,
development by the streets near the end of 140th Lane and
Nightingale and near 140th Lane and Raven. We propose that
Andover City council eliminate the real problem, which we have
been told is the people who speed through the Red Oaks
development, by closing off the accesses to our development
near 140th Lane and Nightingale and near 140th Lane and Raven.

barricades are now installed and also at the corner of Quinn
street and 139th. These two particular corners allow speeds
in excess of the limit and are dangerous because of limited
visibility due to curves.

We petition the Andover city council to remove the barricades from
Quinn street Northwest for the following reasons:
1. We have been told the reason the barricades were installed was
to prevent people from speeding through this portion of .Quinn
street. Blocking off this portion of Quinn does nothing to
solve the problem of speeding. rt only redirects the people
who speed down other area streets in Red Oaks development.
2. We have peopie who speed down other streets in this
development also. It has been noted by the city council that
the people who speed live outside the Red Oaks development.
The individuals who have been caught speeding must access our
development by the streets near the end of 140th Lane and
Nightingale and near 140th Lane and Raven. We propose that
Andover City council eliminate the real problem, which we have
been told is the people who speed through the Red Oaks
development, by closing off the accesses to our development
near l40th Lane and Nightingale and near 140th Lane and Raven.
In order to insure elimination of dangerous driving practices
in these areas the fOllowing alternCltives are proposed: a
combination of speed bumps approximately 50 feet in front of
stop signs, a combination of rumble strips approximately 50
feet in front of stop signs, additional law enforcement, and
prosecution by affected homeowners. Law enforcement officials
support the use of rumble strips and stop signs where the
barricades are now installed and also at the corner of Quinn
street and 139th. These two particular corners allow speeds
in excess of the limit and are dangerous because of limited
visibility due to curves.

All children in Red Oaks development deserve to be safe from
dangerous driving practices. This change will insure all
children in Red Oaks development will be safe from these
individuals, not just the children who live on the new portion
of Quinn street which is barricaded at this time. This option
will not take away the rights of any individual in either Red
Oaks development or the Kensington development. Each area
will continue to have access out of the developments without
infringing on residents' rights.

The City Council is asked to review the Special Use Permit request
of Clifford Mistelske to continue the operation of a repair garage
on the property located at 2134 Bunker Lake Boulevard NW, legally
described on the attached resolution.
APPLICABLE ORDINANCES
Ordinance No.8, Section 5.03 regulates the Special Use Permit
process.

Ordinance No.8, section 7.03, establishes those uses allowed by
Special Use Permit. In an I, Industrial District, repair
garages are allowed by the granting of a Special Use Permit.
In granting a Special Use Permit, the city Council shall examine
the effect of the proposed use upon the health, safety, morals and
general welfare of occupants of surrounding lands; the effect on
traffic patterns and congestions; the effect on surrounding
property values and the use's consistency with the Comprehensive
Plan.
Planning & zoning Review
The Planning and zoning Commission, at their August 24, 1993
meeting, recommended approval of the Special Use Permit request
with conditions. Attached for your review are the minutes and the
staff report from the meeting.
Attached is a proposed resolution for Council review and adoption.

LOCATED AT 2134 BUNKER LAKE BOULEVARD NW (PIN 34-32-24-32-0005),
LEGALLY DESCRIBED BELOW.
WHEREAS, Clifford Mistelske has requested a Special Use
Permit to allow for the continued operation of a repair garage on
the property located at 2134 Bunker Lake Boulevard NW (PIN 34-32-
24-32-0005), legally described as follows:
The North 658 feet of the East 3l2.5 feet of the Northwest Quarter
of the Southwest Quarter of Section 34, Township 32, Range 24,
Anoka County, Minnesota; Except Roads; Subject to Easements of
Record; and
WHEREAS, the Planning and zoning Commission has reviewed
the request and has determined that said request meets the
criteria of Ordinance 8, Sections 5.03 and 7.03; and
WHEREAS, the Planning and zoning Commission finds the
proposed use will not be detrimental to the health, safety and
general welfare of the occupants of the surrounding lands; the use
will not cause serious traffic congestion or hazards; the use will
'1 not depreciate surrounding property; and the use is in harmony
~ with the Comprehensive Plan; and
WHEREAS, a public hearing was held and there was no
opposition regarding said request; and
WHEREAS, the Planning and zoning Commission recommends to
the City Council approval of the Special Use Permit requested.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of
the City of Andover hereby agrees with the recommendation of the
Planning and zoning Commission to allow Clifford Mistelske to
continue the operation of a repair garage on the above described
property with the following conditions:
1. The Special Use Permit will be subject to a sunset
clause as defined in Ordinance No.8, Section 5.03(D).
2. The Special Use Permit will be subject to annual
review and site inspection by City Staff.
3. The applicant shall secure a Hazardous Waste'
Generator's License from Anoka County and provide
proof to the City.
4. The site shall be subject to meeting the requirements
of Ordinance No.8, Section 8.08, Parking.

Representatives from Q Midwest, Inc., were not in attendance; so the
Commission preferred to table the item to address the safety concerns.
The Commission also asked Staff to check on the availability of parking
in the area. The public hearing was not opened.

a hold of the applicant and tells him the Commission's concerns. Motion
carried unanimously.
PUBLIC HEARING: SPECIAL USE PERMIT - AUTO REPAIR GARAGE IN AN I,
INDUSTRIAL DISTRICT, 2134 BUNKER LAKE BOULEVARD NW - CLIFFORD MISTELSKE
7:44 p.m. Mr. Carlberg reviewed the request by Clifford Mistelske for
a Special Use Permit to operate a repair garage at 2134 Bunker Lake
Boulevard NW. Mr. Mistelske has been operating the garage without the
Permit, and Staff has been working with him to bring his business into
conformance with the Zoning Ordinance. The building is set way in back
of the lot, and he thought there is another structure in the back with
some type of construction and office space. There is no residence on
,~ the parcel.
Chairperson Dehn opened the hearing for public testimony.
Clifford Mistelske - didn't realized he needed a permit when he started
a year ago. He works by himself repairing vehicles, trying to keep a
nice, quiet place. He's lived in Andover for 40 to 50 years and is just
trying to help the community. He does general vehicle maintenance,
mechanical, framing of cars, etc., getting them back to running again.
He buys and sells vehicles, cars, trucks, motor homes, as he finds them
and repairs them and does not advertise or solicit business from the
public.
Mr. Carlberg stated the biggest change will be having to meet the
parking requirements with hard surfaced parking and curbs. Mr.
Mistelske stated he didn't have many cars, probably not more than three
at anyone time. He does not keep junk cars. If vehicles come in with
parts he can use, he takes them apart and sends them back.
The Commission felt the requested use is appropriate for this area.
MOTION by Apel, Seconded by Jovanovich, to close the public hearing.
Motion carried unanimously.

MOTION by Squires, Seconded by Apel, that the Special Use Permit be
approved with the first five of the six conditions listed in the Staff
report. I don't think it is necessary, given the nature of the
operation, to impose any hours of operation. Item 6, a public hearing
was held and there was no opposition. Motion carried unanimously. This
item will be on the September 21, 1993, City Council Agenda. 7:57 p.m.

The City Council is requested to approve the recommendation of
the Road Committee to increase the thickness of the bituminous
from two (2) inches to two and a half (2.5) inches for both the
rural and urban areas.
In the urban area, the specification will require the first 1.5
inches to be placed during the initial construction. The final
1.0 inch will be placed the following year. This will allow one
freeze/thaw cycle to occur which will allow us to determine if
any bad areas will show up prior to the final 1.0 inch of
'- bituminous being placed.
In the rural area, the specification will require the 2.5 inches
be placed all in one (1) lift. We recommend the projects be
required to provide two and a half (2.5) inches as minimum.
Councilmembers Perry and Dalien and Mayor McKelvey have backup
information in the side pocket submitted by John Davidson of
TKDA. Councilmembers Knight and Jacobson already have copies.

THE CITY COUNCIL OF THE CITY OF ANDOVER HEREBY RESOLVES:
WHEREAS, a contract has been entered into for the construction of
the improvements and the contract price for such improvement is
$ -0- , and. the expenses incurred or to be incurred in the making
of such improvement amount to $ -0- and work previously done
amount to $ -0- so that the total cost of the improvement will
be $ 3,939.44 per lot.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Andover, MN:
l. The portion of the cost of such improvement to be paid by the city
is hereby declared to be $ -0- and the amount of the cost
to be assessed against benefited property owners is declared to
be $ 3,939.44 per lot.
Assessment shall be payable in equal annual installments extending
over a period of 5 years. The first of the installments to be
payable on or before the first Monday in January 1994, and shall
bear interest at the rate of 5.5 percent per annum from the
date of the adoption of the assessment resolution.

3. The city Clerk, with the assistance of the City Engineer shall
forthwith calculate the proper amount to be specially assessed for
such improvement against every assessable lot, piece or parcel of
land within the district affected, without regard to cash
valuation, as provided by law, and she shall file a copy of such
proposed assessment in her office for public inspection
4. The Clerk shall, upon the completion of such proposed assessment,
notify the Council thereof.

WHEREAS, pursuant to proper notice duly given as required by
law, the council has met and heard and passed upon all objections
to the proposed assessment for the improvements.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
ANDOVER, MINNESOTA:
1. Such proposed assessment, a copy of which is attached
hereto and made part hereof, is hereby accepted and shall
constitute the special assessment against the lands named
therein, and each tract of land therein included is hereby found
to be benefitted by the proposed improvement in the amount of the
assessm~nt levied against it.
2. Such assessment shall be payable in semi-annual
installments, together with principal and accrued interest,
extending' over a period of 10 years, the first of the
installments to be payable on or before the 15th day of April,
19 94 and shall bear interest at a rate of 7 percent
per annum from the date of the adoption of this assessment
resolution.
3. The owners of any property so assessed may at any time
pay the whole of the assessment on such property with interest
accrued to the date of payment to the City Treasurer.

CITY OF .ANDOVER, A MINNESOTA MUNICIPAL CORPORATION
This Agreement made this 24th day of August, 1993, by and
between Winslow I. Holasek and Corinne M. Holasek (hereinafter
"Holaseks") and City of Andover, a Minnesota Municipal Corporation
(hereinafter '!city"), to-wit:
WHEREAS, Winslow Hills Properties caused the platting of that
particular real property described within Exhibit "A" attached
hereto and incorporated herein as WINSLOW HILLS 3RD ADDITION; and,
WHEREAS, City has consented to and approved the platting of
said real property set forth within said Exhibit "A" as WINSLOW
HILLS 3RD ADDITION; and,

WHEREAS, as a condition precedent to the recording of said
Plat, Holaseks have executed and delivered to city that particular
Quit Claim Deed dated July 3rd, 1992, and filed July 22, 1992, as
Anoka County Recorder Document No. 989824, a permanent easement for
storm, drainage and storm drainage pipes and appurtenances over the
real property described within Exhibit "B" attached hereto and
incorporated herein; and,
WHEREAS, city further desires and requires prior to recording
of the Plat of WINSLOW HILLS 3RD ADDITION a covenant by Holaseks
to hold city harmless from any and all overflow from the storm
drainage easement as set forth within said Exhibit "B" which
overflow results directly from waters or other liquids collecting
into said storm drainage easement as set forth within Exhibit "B"

NOW, THEREFORE, in consideration of the foregoing and of the
city's consent and approval relative to the recording of the Plat
of WINSLOW HILLS 3RD ADDITION, Holaseks hereby agree to hold City
harmless and indemnify city from any and all liabilities, and
defend against losses, expenses, damages, acts or failures to act,
attorney's fees and court costs, which directly result from the
flow of waters or other liquids from real property known as WINSLOW
HILLS 3RD ADDITION (as set forth within said Exhibit "A") into
City I S permanent storm drainage easement (as set forth within
Exhibit "B") and which flowage of waters or other liquids from real
property comprising WINSLOW HILLS 3RD ADDITION into said storm
drainage easement directly causes an overflow of water or liquids
from said storm drainage easement onto that particular real'
property, and improvements thereon, as set forth within Exhibit "C"
attached hereto and incorporated herein.
IT IS FURTHER AGREED that this Agreement shall wholly
terminate, and be of no further force and effect, upon the creation
of an outlet from City's permanent storm drainage easement (as set
forth within Exhibit "B").

REQUEST
The Andover city Council is requested to receive the August 1993
Financial statements for the General, Water, Sewer and Central
Equipment Funds.
Please note: 1) The original estimated building and related permit
revenue for 1993 has been surpassed. The amendment
adopted August 17th recognizes and allocates
revenue for another 100 new homes for 1993.
2) These statements include the amended expenditure
budgets adopted by resolutions R016-93 on 1/19/93,
and R186-93 on 8/17/93.
3) Fire Department expenditures include $34,000 of
accrued point pay for December 1992 through
April 1993. All point pay is paid to the fire
fighters in December each year.
4) The Water and Sewer Funds second quarter billing
has been prepared and released. The due date was
August 5th. Water sales and revenue are much
lower than last year due to the above normal
rainfall so far this summer.
5) The Central Equipment Fund is operating smoothly.
Revenues and expenditures are within budget
projections at this time.
Should there be any questions regarding the information presented,
please contact me prior to the meeting so I may have adequate time
to research the question.

LICENSE AGREEMENT
FOR ACCESS TO TIIE TAXSYS SYSTEM
THIS AGREEMENT is made and entered into this _ day of , 1993,
by and between the County of Anoka, a political subdivision of the State of Minnesota, 2100 Third
Avenue, Anoka, Minnesota 55303, hereinafter referred to as the "County," and the City of Andover,
1685 Crosstown Boulevard Northwest, Andover, Minnesota 55304, hereinafter referred to as the
"Municipality. "
WITNESSETH:
WHEREAS, the County maintains and operates an integrated computer system comprised of
hardware, software, and data, relating to the valuation, assessment, calculation, and collection of property
taxes on real property located in Anoka County, Minnesota, which is hereinafter referred to as the
T AXSYS System; and
WHEREAS, the Municipality desires to have direct access via remote computer terminals to the
TAXSYS System; and
WHEREAS, the County agrees to allow the Municipality file inquiry access via remote terminals
to the TAXSYS System, subject to the terms and conditions contained herein.
NOW, TIIEREFORE, it is mutually stipulated and agreed as follows:
1. GRANT OF LICENSE
The County hereby grants to the Municipality a license to access the T AXSYS System and certain
specified information contained therein, subject to the terms and conditions contained in this Agreement.
A. Access to Information:
Pursuant to this License Agreement, the County will permit the Municipality file inquiry
access only to specified TAXSYS System screens and data elements contained therein. The County
specifically retains the right to determine, in its sole discretion, what TAXSYS information will be
accessible, how it will be accessed, and the format by which the information will be accessed by the
Municipality. The specific TAXSYS System screens and data elements contained therein, accessible to
the Municipality as of the date of this Agreement, are described and depicted in Exhibit A, which is
attached hereto and incorporated herein by reference. The County specifically retains the right to, in its
sole discretion, add to or delete from Exhibit A the T AXSYS System screens and/or data elements which

may be accessed by the Municipality. The County shall, on a periodic basis, provide the Municipality
with a current listing of the TAXSYS System and data elements screens which may be accessed by the
Municipality under this Agreement. The Municipality's right of access is specifically limited to T AXSYS
System screens for that Municipality's accounts or parcels.
B. Hours of Availability:
Access to the T AXSYS System shall be limited to the nonnal business hours observed
by the County at the Anoka County Government Center, which is as follows:
1. Monday through Friday, 8:00 a.m. to 4:30 p.m.
2. Access will not be available on holidays or other days off observed by the
County .
3. With prior approval by the County and subject to TAXSYS System capacity
and/or availability, access may be provided outside of the County's nonnal
business hours.

The County reserves the right to change its business hours.
C. Reduction and Interruption of Access:
It is understood and agreed that if it is determined by the County that it is necessary to
reallocate time and capacity utilization of the T AXSYS System in order to properly carry out County
business or provide access to the TAXSYS System to other entities, the County may, in its sole
discretion, reduce or limit the Municipality's access as the County may deem appropriate. The County,
in good faith, shall endeavor to notify the Municipality prior to any such access interruption or reduction,
whenever the County detennines that circumstances pennit such notification. The County shall not be
liable to the Municipality or any other party for damages of any kind resulting from or related to the
interruption or reduction of access to the TAXSYS System. The Municipality shall designate a contact
person in its organization for purposes of County notification in case of variation in operating hours and
reduction or interruption of access.
II. HARDWARE AND SOFTWARE REQUIREMENTS
The Municipality shall be solely responsible for the cost of obtaining, connecting, and maintaining
all hardware, software, and telecommunication services or equipment necessary to connect to the

TAXSYS System. The County specifically retains the right to determine, in its sole discretion, the
number and type of devices that the Municipality can connect to the County's host system. Exhibit B,
which is attached hereto and incorporated herein by reference, outlines the minimum hardware and,
software specifications that must be adhered to by the Municipality when connecting to the T AXSYS
System. Any exceptions to these standards must be authorized in writing in advance by the Director of
Management Information Services for the County. The County assumes no responsibility for diagnosing
or correcting any difficulties associated with the Municipality's hardware, software, and
telecommunications service or equipment. The County will, resources permitting, assist the Municipality
with diagnosing access problems the County believes may be caused by County hardware, software or
telecommunications hardware or software. Neither the furnishing of the information described in Exhibit
B nor providing assistance in diagnosing problems shall in any manner be construed as an expression of
the County's guarantee or warranty of the equipment's quality, performance or compatibility with the
T AXSYS System and it is agreed that the County shall incur no liability whatsoever with respect to
furnishing or providing such information or assistance.
Ill. SECURITY
The Municipality shall adhere to the following security measures to ensure that unauthorized use
of the T AXSYS System does not occur:
() A. The Municipality shall be assigned a System Access Password by the County. The
Municipality shall provide to the County's Director of Management Information Services the names of
Municipality employees who will be authorized users of the TAXSYS System. Each authorized user will
be provided a TAXSYS System password by the County. If an employee should terminate service with
the Municipality, the Municipality shall immediately notify the County's Director of Management
Information Services so that passwords may be changed to preclude unauthorized use. To protect against
unauthorized use, passwords may be changed on a quarterly basis and coordinated through the Director
of Management Information Services.

B. This Agreement authorizes the Municipality access only to those data TAXSYS System
screens and data elements described herein. Any attempt by the Municipality, its employees or other
individuals using the Municipality's equipment and/or access passwords, to access other information or
applications in the TAXSYS System, or any other County system, shall be considered a violation of this
Agreement, upon the occurrence of which the County may, in its discretion, unilaterally terminate this
Agreement.

IV. COSTS

The Municipality shall be soiely responsible for the costs of all hardware, software, and
telecommunications hardware and services which may be necessary to connect the Municipality's terminal
with the County's TAXSYS System. In addition, the Municipality shall pay to the County a monthly
charge for each addressable device connected to the T AXSYS System. The County reserves the right
to establish and amend the monthly charges upon one year written notice to the Municipality. The
original monthly charge to be paid by the Municipality is set forth in Exhibit C, which is attached hereto
and incorporated herein by reference.
V. OWNERSHIP, RESALE, AND USE OF INFORMATION
It is expressly understood and agreed that the format of the screens and the manner in which the
data and information is displayed and generated by the TAXSYS System is the property of the County,
and that the Municipality does not obtain any ownership or proprietary interest in the same as a result
of entering into this Agreement. It is further understood and agreed that access to the information
generated by the TAXSYS System and made available to the Municipality through this Agreement is to
be used by the Municipality solely for its own use and that resale of this information or granting access
to the TAXSYS System to any other party is expressly prohibited by this Agreement. Notwithstanding
anything herein to the contrary, the Municipality may provide a copy of an accessible screen to the
general public, provided that the Municipality charges only a nominal fee for the copy.

VI. PERFORMANCE; ACCURACY OF INFORMATION; WARRANTY
A. The County does not warrant or guarantee the performance of the TAXSYS System or
the accuracy of the information therein. It is specifically understood and agreed to by the Municipality
that additions, changes and adjustments are made to the TAXSYS System which my effect the accuracy.

B. Furthermore, the Municipality specifically understands and agrees that the services
furnished under this Agreement are subject to the temporary or permanent inability of the County to

malfunctions, inoperativeness, scheduled downtime, delays or interruptions which may be due to anyone
or a combination of a wide spectrum of causes. While the County shall endeavor in good faith to
maintain a high degree of accuracy and efficiency for the services provided hereunder, the sole and
exclusive remedy for any breech of this Agreement by the County and for County liability at any time

whatsoever, including but not limited to liability or non-performance for any deficiencies with respect

from the County's records and is believed to be reliable. However, the accuracy, completeness,
timeliness or correct sequence of the information is not guaranteed by the County. There may be delays,
interruptions, omissions or inaccuracies in the receipt of public information. The Municipality agrees
that the County shall have no liability, contingent or otherwise, for the accuracy, completeness, timeliness
or correct sequencing of the data or for any decision made or action taken by the Municipality or anyone
who receives information from the Municipality and acts in reliance upon the data. THERE IS NO
WARRAN1Y OF MERCHANTABILITY, NO WARRAN1Y OF mNESS FOR A PARTICULAR
USE, AND NO WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, REGARDING THE
ACCURACY OR RELIABILITY INFORMATION OR ANY ASPECT OF THE SERVICE PROVIDED
HEREIN.
VII. CHANGE OF T AXSYS SYSTEM
The Municipality understands and agrees that the County may change, modify, and/or replace
the T AXSYS System and any components thereof, and that any such change could possibly extinguish
and or impair the compatibility between the Municipality's equipment and the TAXSYS System, thus
necessitating, perhaps, the replacement of, changes to, and/or modification of the Municipality's
equipment to access the TAXSYS System; and that, in any such event, the County shall not be liable for
the costs and/or damages which may be sustained by the Municipality which are, in any respect,
associated directly or indirectly with any or all of the foregoing occurrences, and that the Municipality
shall bear the full costs thereof. In no event shall the County be liable for actual, direct, indirect, special,
incidental, consequential damages (even if the County has been advised of the possibility of such damage)
or loss of profit, loss of business or any other loss or any other type of damages relating to the
Municipality's use of the T AXSYS System.
VIII. TAXES
The Municipality agrees that during the term of this Agreement, in addition to the fees or other
charges provided herein, the Municipality shall promptly pay all taxes, assessments, and other
governmental charges, if any, levied or assessed upon the services furnished hereunder to the
Municipality, and the Municipality shall promptly payor reimburse the County for all taxes levied or
assessed against and paid by the County on account of its furnishing services to the Municipality
hereunder.

IX. TERMINATION
This Agreement may be terminated by either party at any time, with or without cause, upon not
less than one (1) year written notice delivered by mail or in person to the other party. If notice is
delivered by mail, it shall be deemed to be received two days after mailing.
x. NOTICE:
For purpose of delivery of any notices hereunder, the notice shall be effective if delivered to Dale
Kolstad, Director of~anagement Information Systems, Anoka County Courthouse, 325 East Main Street,
Anoka, Minnesota 55303, on behalf of the County, and
, 1685 Crosstown Boulevard Northwest, Andover,
Minnesota 55304, on behalf of the Municipality.
XI. INDEMNIFICATION:
The Municipality shall defend, indemnify, and save the County harmless from any liability,
claims, damages, judgments, costs (including reasonable attorneys fees), demands or actions arising,
directly or indirectly, or related to obtaining, use, and/or possession of the information provided
hereunder; the Municipality's access to the computer system, use or operation of the Municipality's
equipment; and from all loss or liability by reason of failure of the Municipality, in any respect, to
perform fully or observe all obligations under this Agreement.
XII. ENTIRE AGREEMENTIREQUIREMENT OF A WRlTING:
It is understood and agreed that the entire agreement of the parties is contained herein and that
this Agreement supersedes all oral agreements and all negotiations between the parties relating to the
subject matter thereof, as well as any previous agreement presently in effect between the parties relating
to the subject matter thereof. Any alterations, variations or modifications of the provisions of this
Agreement shall be valid only when they have been reduced to writing and duly signed by the parties
herein.

SEWER AND WATER TRUNK EXTENSIONS FROM WINSLOW HILLS THIRD ADDITION
The property owner agrees that the City may construct and specially
assess the costs against Property I.D. * 23-32-24-23-0002 & * 23-32-
24-23-0003 for sanitary sewer trunk and water trunk extensions from
the Winslow Hills Third Addition to serve said property. The
property owner waives all rights of appeal of special assessments
pursuant to Minnesota Statute S429 and agrees that the costs of such
sanitary sewer and water trunk may be assessed against the lot known
as Property I.D. * 23-32-24-23-0002 & * 23-32-24-23-0003,
notwithstanding the fact that the special benefits received by said
lot may be less than the amount of the special assessments levied by
the City. The amount of the sanitary sewer trunk assessment shall
be Nine Hundred Seventy-five and no/100 ($975.00) Dollars per acre
for 24.10 acres or a total of Twenty-three Thousand Five Hundred and
no/lOO (23,500.00) Dollars. The amount of the water trunk
assessment shall be One Thousand Thirty-eight and no/100 ($1,038.00)
Dollars per acre for 3.95 acres or a total of Four Thousand One
Hundred and no/100 ($4,100.00) Dollars.

RE: Road Closure of Quinn Street Northwest
Dear Ladies and Gentlemen:
I am writing this letter in hopes that it will be considered and/or read at the upcoming
meeting concerning the closure of Quinn Street Northwest. I am unable to attend the
second meeting due to a conflict.
My name is Andrew Miklesh and I reside at 2041 138th Avenue Northwest. This is a
cross street between Quinn Street Northwest and Nightingale Street Northwest. I
spoke to you at the meeting where the petition was presented for the closure of Quinn
Street in which you subsequently voted for the temporary closing.
I've resided on this street for lOIh years, thus, I was in the neighborhood before the
opening of Quinn Street and the new developments to the north of us. Part of the
reason for purchasing a home on 138th Street was due to the low traffic count among
the other fine qualities in the City of Andover.
I know that you are aware of the problems that have occurred on Quinn Street, but I
would also like to reiterate the problems that the completion of Quinn Street to Bunker
Lake Boulevard (County 116), has also created on Nightingale Street. If you recall, I
advised you of a car load of juveniles that while racing down Nightingale Street
missed a 90 degree comer and hit my neighbor's house. They were travelling at a
minimum speed of 58 mph., and knocked the attached garage off its foundation and
caused other structural damage. (I have traffic accident reconstruction training from
my profession). This is just one of the more serious problems that has occurred at the
intersection of Nightingale and 138th Street.
The main concerns, as with Quinn Street, are the speeders not slowing down even
with children present, and the increased traffice volume. My neighbors have reported
several speeders to the sheriff s department and are still uncertain what action was
taken, if any.

Since you voted to close Quinn Street, there has been a dramatic decrease in the
number of incidences and traffic on 138th Avenue. Some of my neighbors are divided
and want the street reopened, arguing that it is convenient. I admit it was convenient
to use Quinn Street when it was open. However, we are not arguing convenience.
By your own traffic count, you indicated that there were an average of 1,000 cars per
day using Quinn Street. As it's designed, Quinn Street is not capable of handling
1,000 cars per day in a safe manner. It is interesting to note on my street all of the
families with young children want the road to be permanently closed, while those who
do not have children or whose children are grown want it opened for convenience.
Since closing the road seems the simplest and the most cost effective way to resolve
the safety issue, I urge you to vote to permanently close Quinn Street and install a
cul-de-sac for a snow plow turn around.
However, if the closing of Quinn Street has caused "maior safety problems" in other
sections of the development, then other alternatives will have to be considered. I
realize that you have been doing traffic counts in other sections of the development, as
I write this letter I do not have those figures.
If you do vote to reopen Quinn Street, at the very minimum in this section of the Red
O~ Development, I would recommend the following. Please note this is just the
mlmmum:
1. A three-way stop at the intersection of Quinn Street and 138th Avenue
Northwest;
2. A four-way stop on Quinn Street and 139th Avenue Northwest. You
will then have to also decide what other intersection would need stop
signs farther to the north.
3. On Nightingale, at the very minimum, there should be a three way stop
at the intersection of Nightingale and 139th Avenue Northwest, and also
some additional stop signs installed farther to the north.
4. Another alternative would be to close the roads leading from the new
developments to the north, channelling them out to County Road 18,
which is designed for large traffic volume.
Once again, I urge you to vote for the permanent closure of Quinn Street Northwest,
unless it is causing a "maior safety problem" in other parts of the development.

Dear Resident:
The City of Andover was informed on September 16, 1993 that
up to thirty (30) trucks (belly dumpers) an hour will be traveling
on Crosstown Boulevard NW south of Coon Creek starting Friday the
17th of September. The hauling is being conducted as a part of
the construction of a cap on the landfill east of Crosstown known
as the Waste Disposal Engineering Site. The City Council
preferred not to allow the use of Crosstown as a haul route;
however, the "Access Agreement" included Crosstown as a secondary
route and the contractor on the site is exercising this option.
The hauling will continue until Tuesday, September 21, 1993.
Trucks will not be hauling on Sunday, September 19th. The hours
of hauling are from 7:00 A.M. to 8:00 P.M. on the 17th, 20th and
21st and from 8:00 A.M. to 5:00 P.M. the 18th.
The City has been informed that this will complete the hauling
operation of clay materials for the site. The City appreciates
your patience in this matter and asks that you take extra
precautions when traveling on Crosstown during the hours indicated
above.

The City Council requested additional information regarding
the Cedar Crest pond at the regular Council meeting on
September 7, 1993.
I have attached the assessment figures for Mr. Hausam's lot
for project #80-4, street and drainage improvements. This is
the only drainage project assessed to Mr. Hausam's
neighborhood.
Also attached are items from the November 18, 1986 regular
Council meeting which established the elevation of 884.5 as
the level at which the City would commence pumping.
It should be noted that the 884.5 elevation extended well
into the Hausam's back yard (indicated with the dashed lines)
prior to the pond being reconstructed at City expense.The
City raised the pond's bank and the Hausam's backyard to an
elevation of roughly 885.4 when the pond was enlarged.
Todd Haas is working with T.K.D.A. on estimating costs for
providing a permanent drainage plan from the pond. A project
to provide an outfall pipe from the pond would most likely be
assessed to the benefitting property owners.
On Tuesday September l4th, the Public Works Department pumped
the pond down to approximately 883 to provide additional
storage capacity and reduce the possibility of the pond
overflowing it's bank into the Hausam's backyard.

The City Council is requested to recommend the pond to be
pumped at an elevation of 884.5. Keep in mind the owner's
east side yard is a natural drainage area. This area prior
to the house being built on the property had water. This is
a natural feature which should be preserved and any storm water
that has drained into the east side yard should be able to
pond as it has in the past. The present owner, Mr. Terry
Hausam, has agreed to use the elevation established by the
En~ineering Department of 884.5. If the water ponds in the
side yard for a period of two (2) weeks, the City of Andover
at that time would need to pump the pond to elevation where
no water is ponding on side yard and in the swale area at the
request of the owner.

MORATORIUM ORDINANCE
Commissioner Apel stated the consensus of the Planning Commission was to
recommend a moratorium ordinance similiar to Ordinance 48 be ad'opted to allow
time for p lanni ng of deve lopment wi th i n the prop osed urban servi ce area that
is not now but is planned to be served with municipal sewer and water.
Council noted a map needs to accompany the ordinance and an escape clause must
be within the ordinance in the event sewer and water is brought to an area
while the moratorium is in effect.
Counci 1 genera.lly had no problem with the proposed ordinance but suggested in
Secti on 3, Affected Areas; Supercedes, the wording be changed to: "This
ordinance shall apply to and govern all districts without availability of public
sewer and water facilities located within the Metropolitan Urban Service search
boundary..." It was then referred back to the Planninq and Zoning Commission
to hold public hearings on it.
CEDAR CREST POND/ESTABCISH ELEVATIONS
t1r. Haas exp lained his recommendati on to pump the Cedar Crest pond at an
elevation of 884.5 for the side yard. Also, Mr. Hausam has agreed to contact
the City when the elevation reaches that level, and the City would let it stand
for two weeks before purrping to see if the water would recede on its own. If
not, the City will pump. For the back yard, the agreement would be to pump if
the water exceeds approximately six inches below the berm that was constructed.
Mr. Hausam - stated he will give the City the benefit of the doubt when calling
and waltlng for it to be pumped. And he agreed to the elevations being
suggested by Mr. Haas.
MOTION by Orttel, Seconded by Lachinski, that the Council agrees to use their
best efforts if feasible to maintain the pond and swale elevations in the Cedar
Crest park pond area according to the drawing presented by the City Engineer at an
elevation of no greater than 884.5; and if the water ponds in the side.yard for
a period of two weeks, we would use our best efforts to reduce the elevation to
below 884.5. Motion carried unanimously.
ELEMENTARY SCHOOL SITE
Mayor Windschitl reported on a meeting this morning with representatives of the
County and the School District regarding the siting of a school on the County
property east of Hanson Boulevard. The. problem is the actua 1 site is going to
end up in the fill area of the proposed landfill in that area. The Metropolitan
Counci 1 has approved the map indicating the fi 11 area of the proposed landfi 11
site, and at this point the County's engineers are not willing to move that fill
area line to accommodate the school site. Those engineers are addressing the
compatibility issue of landfi 11 and school site in the same vicinity. The
Mayor felt the School District is questioning whether it is appropriate to put
an $8 million school next to a landfill.
Counci 1 discussed the prob lems of fitting the school onto the County property.
Counci lman Elling thought those fi 11 lines cou ld be moved, as they were not meant
to be the final proposal. Others expressed the desire that the school would be
placed on that site in hopes that the landfill then would not be iocated there.
Mayor Windschitl stated the School District has been looking at the south 20
acres of the Laptuda property which the City has just purchased in the event the
landfill issue cannot get resolved. The district has until about the first of 1987
to make a decision as to where the school will be located. They are under

M. Winczewski brought up the possibility of having another fund ralslng
dance and the need for a commitment out of the members to assist and
sell tickets to make it successful. A motion was made by P. Gengler
(seconded by D. Mashuga) that "All members be required to sell a minimum
often (10) tickets or buy them themselves". Following discussion, the
motion was voted on and passed 30 for and 3 against.

Sewage Disposal
Many unsewered communities are becoming aware of the problems
associated with individual on-site disposal systems. Most often their
search is for answers to regulations and engineered solutions for site
problems.
With individual maintenance being the responsibility of the owner, the
performance of systems is widely varied. Disposal problems may exist
where past platting and development occurred in unsuitable or marginal
soils for on-site disposal. Enforcement of regulations often was limited
in many rural areas which have since become suburban bedroom
communities. The regulation issue may need to be addressed by
updating ordinances with specific inspection and enforcement
provisions.
Communities situated such that on-site disposal will always be part of
community development need a well thought out, detailed and
engineered plan for system regulation and continued system operation
and maintenance. Early expenditures by a community for development
of such a plan involve costs that are insignificant in comparison to the
cost of resolving problems that may occur without such a plan.
Regulation is implemented via an ordinance based on Minnesota Rules
7080 customized for the specific community characteristics and a plan
based on community mapping, an inventory of existing disposal
systems, soils and ground water data and community zoning including
wetland area designation.
Resolution of problems starts with evaluation of existing facilities and
identification of the nature and extent of problems. Lowest cost
solutions are identified and a framework for corrective action
established. Such a framework can provide alternative solutions that
can be implemented through community action to solve problems for
a number of clustered dwelling units where each unit finds it impossible
to individually address problems.
A typical disposal problem area may have the following components:
· A subdivision of one-acre lots
· Soils characterized as marginal to poor for on-site disposal
· Failing individual on-site systems
· Property owners cannot address or solve the total problem
· A public health threat exists.

Engineer over the past nine years.

Pete is a native of Sebeka,

On-Site Sanitary Sewer Disposal, from page one
An initial community response, outlined within the framework of an
overall disposal system plan, might be an organized and systematic
operation and maintenance of septic tank/drainfield systems. In some
instances, a more intensive program of septic tank cleaning and drain
field maintenance, performed under community authority for all individual
systems may help alleviate some problems. A community directed
program of more frequent disposal system operation and maintenance can
be less costly than less frequent cleaning done by individual owners.
In time, on-site disposal reaches a point where individual drain fields or
mound systems fail to work properly. There simply is not sufficient space
on each and every property for alternative sites, with soil conditions
suitable for disposal. Within the framework of a community disposal
plan, a solution of constructing a community drain field (collector system)
may be appropriate to collect effluent from individual septic tanks and
convey it to a common, suitably sited and designed soil absorption
system. Community action can solve a problem that is impossible for
individual property owners to address.
Many communities that have experienced growth through large lot
development and/or lake development realize that the soil absorption
method used for sewage treatment is both good and bad: Good perhaps
because treatment is a responsibility of the land owner and the burden of
administration, operation and maintenance is not the communities'
burden. It also provides for treatment over a larger area, not a point
source.
The bad part is when systems fail and pollution accesses the groundwater
and wells. The solution to address the problem then falls back onto the
local responsible governmental unit.
Normally, local communities are reluctant to get involved in solving the
problem because they lack expertise and funds. However, planning
should be the first step. Planning may include a three stage scenario.
The first stage would provide for control (operation and maintenance) of
existing systems through ordinances based on Minnesota Rules 7080.
This first stage could be applicable to new subdivisions as well. The
second stage provides the community the ability to correct failing
individual systems with collector or cluster systems. New subdivisions
may find this stage of development beneficial. The third stage provides
the community with a plan for central wastewater treatment facilities that
either discharges to a receiving stream or through irrigation as an
alternative.
Protecting our environment, especially ground water, is everyone's duty.
Properly operating soil absorption systems can help provide protection for
the future. The community, through planning and regulation, can play its
part in good stewardship of our resources.

Letter of Credit established as a special assessment guarantee for
the Woodland Creek Addition from $103,900 to $69,100.
BACKGROUND
Letter of Credit #12-92 was established by the Northeast State
Bank for Woodland Development Corporation, per terms of the
Development Agreement for City project #87-27.
The special assessments for this project have been paid down to a
balance remaining of $69,024.00 plus daily interest as of
September 15, 1993.

REQUEST
The City Council is requested to authorize the release of the
Letter of Credit established for Gorham Builders, Inc. for the
Winslow Hills Addition special assessments.
BACKGROUND
Letter of Credit #91-1l93 was established by The Northern
Bank, now First Bank, N.A., for Gorham Builders Inc.9 per terms of
the Development Agreement for city project #87-32.
The special assessments for this project have been paid in full,
thereby ending the requirement of this Letter of Credit.
